ಆಡಳಿತಾಧಿಕಾರಿಯವರ ಅವಧಿಯನ್ನು ವಿಸ್ತರಿಸುವ ಬಗ್ಗೆ.

ಪ್ರಸ್ತಾವನೆ :-

ಮೇಲೆ ಕ್ರ.ಸಂ. (1) ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ತಹಸೀಲ್ದಾರ್, ಗ್ರೇಡ್-1, ತುಮಕೂರು ತಾಲ್ಲೂಕು ಇವರನ್ನು ಶ್ರೀ ಸ್ವರ್ಣಾಂಬ ವಿದ್ಯಾ ಸಮಿತಿ, ಹೊನ್ನುಡಿಕೆ, ತುಮಕೂರು ತಾಲ್ಲೂಕು ಈ ಸಂಸ್ಥೆಗೆ ದಿ:23-01-2016 ರಿಂದ ಮುಂದಿನ 06 ತಿಂಗಳ ಅವಧಿಗೆ ಆಡಳಿತಾಧಿಕಾರಿಯನ್ನಾಗಿ ನೇಮಿಸಿ ಆದೇಶಿಸಲಾಗಿತ್ತು.

ಮೇಲೆ ಕ್ರ.ಸಂ. (2) ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಸದರಿ ಸಂಸ್ಥೆಗೆ ಈ ಹಿಂದೆ ಆಡಳಿತಾಧಿಕಾರಿಯಾಗಿದ್ದ ತಹಸೀಲ್ದಾರ್, ಗ್ರೇಡ್-1, ತುಮಕೂರು ತಾಲ್ಲೂಕು ಇವರ ಬದಲಾಗಿ ಸಹಕಾರ ಸಂಘಗಳ ಉಪ ನಿಬಂಧಕರು, ತುಮಕೂರು ಜಿಲ್ಲೆ, ತುಮಕೂರು ಇವರನ್ನು ನೇಮಿಸಿ ದಿ:23-07-2016 ರಿಂದ 06 ತಿಂಗಳ ಅವಧಿಗೆ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ವಿಸ್ತರಿಸಿ ಆದೇಶಿಸಲಾಗಿತ್ತು.

ಮೇಲೆ ಕ್ರ.ಸಂ. (3) ರಲ್ಲಿ ಓದಲಾದ ಆದೇಶದಲ್ಲಿ ಸಂಘದ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ದಿ:23-01-2017 ರಿಂದ 22-07-2017 ರವರೆಗೆ, 23-07-2017 ರಿಂದ 22-01-2018 ರವರೆಗೆ, ದಿ:23-01-2018 ರಿಂದ 22-07-2018 ರವರೆಗೆ ಮತ್ತು ದಿ:23-07-2018 ರಿಂದ ಮುಂದಿನ 6 ತಿಂಗಳವರೆಗೆ ಆಡಳಿತಾಧಿಕಾರಿಯ ಅವಧಿಯನ್ನು ವಿಸ್ತರಿಸಿ ಆದೇಶಿಸಲಾಗಿರುತ್ತದೆ.

ಮೇಲೆ ಕ್ರ.ಸಂ. (4) ರಲ್ಲಿ ಓದಲಾದ ಸಹಕಾರ ಸಂಘಗಳ ನೋಂದಣಾಧಿಕಾರಿಗಳು, ತುಮಕೂರು ಇವರ ಪತ್ರದಲ್ಲಿ ಗೌ.ಉಚ್ಛನ್ಯಾಯಾಲಯ, ಬೆಂಗಳೂರು ಇಲ್ಲಿ ದಾಖಲಾದ ರಿಟ್ ಅರ್ಜಿ ಸಂಖ್ಯೆ:44304/2016ರ ಪ್ರಕರಣವು ಇತ್ಯರ್ಥವಾಗಿದ್ದು, ಸಂಘದ ಕಾರ್ಯಕಾರಿ ಸಮಿತಿಗೆ ಚುನಾವಣೆ ನಡೆಸಲು ಚುನಾವಣಾಧಿಕಾರಿ ನೇಮಕ ಮಾಡಿ ದಿನಾಂಕ:12-06-2019 ರಂದು ಆದೇಶಿಸಲಾಗಿದ್ದು, ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯು ಮುಕ್ತಾಯವಾಗಿರುವುದರಿಂದ ಹಿಂದಿನ ಸದಸ್ಯರ ಪಟ್ಟಿಯಂತೆ ಕಾರ್ಯಕಾರಿ ಸಮಿತಿಗೆ ಚುನಾವಣೆ ನಡೆಸಲು ಕಾಲಾವಕಾಶ ಬೇಕಾಗಿರುವುದರಿಂದ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ದಿನಾಂಕ:31-10-2019ರ ವರೆಗೆ ವಿಸ್ತರಿಸಬೇಕೆಂದು ಕೋರಿರುತ್ತಾರೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳನ್ನು ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿ, ಸಂಘಗಳ ಜಿಲ್ಲಾ ನೋಂದಣಾಧಿಕಾರಿ, ತುಮಕೂರು ಇವರ ಕೋರಿಕೆಯನ್ನು ಪರಿಗಣಿಸಿ ಶ್ರೀ ಸ್ವರ್ಣಾಂಬ ವಿದ್ಯಾ ಸಮಿತಿ, ಹೊನ್ನುಡಿಕೆ, ತುಮಕೂರು ತಾಲ್ಲೂಕು ಈ ಸಂಘದ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ದಿನಾಂಕ:23.01.2019 ರಿಂದ 22.07.2019ರ ವರೆಗೆ ಹಾಗೂ ಅಂತಿಮವಾಗಿ ದಿನಾಂಕ:23.07.2019 ರಿಂದ ಮುಂದಿನ ಆರು ತಿಂಗಳ ಅವಧಿಗೆ ವಿಸ್ತರಿಸಲು ಸರ್ಕಾರವು ತೀರ್ಮಾನಿಸಿದೆ. ಆದ್ದರಿಂದ, ಈ ಆದೇಶ.

ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ: ಸಇ 58 ಸಸಂನೋ 2016, ಬೆಂಗಳೂರು, ದಿನಾಂಕ: 30.08.2019.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಕರ್ನಾಟಕ ಸಂಘಗಳ ನೋಂದಣಿ ಕಾಯ್ದೆ, 1960ರ ಕಲಂ 27-ಎ ರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ದಿ: 23-01-2019 ರಿಂದ 22-07-2019 ರವರೆಗೆ ಹಾಗೂ ಅಂತಿಮವಾಗಿ ದಿ: 23-07-2019 ರಿಂದ ಮುಂದಿನ ಆರು ತಿಂಗಳವರೆಗೆ ವಿಸ್ತರಿಸಿ ಆದೇಶಿಸಿದೆ.

ಈ ಆದೇಶವು ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರುತ್ತದೆ.

ಆಡಳಿತಾಧಿಕಾರಿಗಳು ಸದರಿ ಅವಧಿಯಲ್ಲಿ ಸಂಸ್ಥೆಯಲ್ಲಿನ ಅವ್ಯವಹಾರಗಳನ್ನು ಸರಿಪಡಿಸಿ, ಸಂಘದ ಆಡಳಿತ ಮಂಡಳಿಗೆ ಚುನಾವಣೆ ನಡೆಸಿ, ಚುನಾಯಿತ ನೂತನ ಆಡಳಿತ ಮಂಡಳಿಗೆ ಅಧಿಕಾರ ಹಸ್ತಾಂತರಿಸಿ ಸರ್ಕಾರಕ್ಕೆ ವರದಿ ನೀಡಲು ಸೂಚಿಸಿದೆ.

ವಿಷಯ : ಸಾರ್ವಜನಿಕರ ಅನುಕೂಲಕ್ಕಾಗಿ ಅಸಂಘಟಿತ ವಲಯದ ಕಾರ್ಮಿಕರ ಸೇವೆಯನ್ನು ಸದುಪಯೋಗಪಡಿಸಿಕೊಳ್ಳಲು ಪ್ರತ್ಯೇಕ ಆ್ಯಪ್‌ನ್ನು ಅಭಿವೃದ್ಧಿ ಪಡಿಸುವ ಕುರಿತು.

ಓದಲಾಗಿದೆ : ಕರ್ನಾಟಕ ರಾಜ್ಯ ಅಸಂಘಟಿತ ಕಾರ್ಮಿಕ ಸಾಮಾಜಿಕ ಭದ್ರತಾ ಮಂಡಳಿಯ ಪತ್ರ ಸಂಖ್ಯೆ:ಅಸಂಕಾ/ಇಎಸ್‌ಟಿ/ಆ್ಯಪ್/ಸಿಆರ್-14/2019-20, ದಿ:11.09.2019.

ಪ್ರಸ್ತಾವನೆ :-

ಅಸಂಘಟಿತ ಕಾರ್ಮಿಕರಿಗೆ ಸಾಮಾಜಿಕ ಭದ್ರತೆ ಒದಗಿಸುವ ಮೂಲಕ ಅವರಿಗೆ ಆರ್ಥಿಕ ಭದ್ರತೆ, ಉತ್ಪಾದನಾ ಸಾಮರ್ಥ್ಯ ಹಾಗೂ ಉತ್ತಮ ಜೀವನಮಟ್ಟ ಒದಗಿಸುವುದು ರಾಜ್ಯ ಸರ್ಕಾರದ ಆದ್ಯ ಕರ್ತವ್ಯವಾಗಿದೆ. ತಮ್ಮ ಅವಶ್ಯಕತೆಗಳನ್ನು ಪೂರೈಸಿಕೊಳ್ಳುವಂತೆ ಮಾಡುವಲ್ಲಿ ಸಾಮಾಜಿಕ ಭದ್ರತೆ ಎಂಬುದು ಅವರ ಆಶಾಕಿರಣವಾಗಿರುತ್ತದೆ. ಈ ಹಿನ್ನಲೆಯಲ್ಲಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಆರ್ಥಿಕವಾಗಿ ಹಿಂದುಳಿದಿರುವ ಅಸಂಘಟಿತ ಕಾರ್ಮಿಕರಿಗೆ ಹಲವಾರು ಸಾಮಾಜಿಕ ಭದ್ರತಾ ಯೋಜನೆಗಳನ್ನು ರೂಪಿಸಿ ಜಾರಿಗೊಳಿಸುತ್ತಿದೆ. 2017-18ನೇ ಸಾಲಿನ ಆಯವ್ಯಯದಲ್ಲಿ ಅಸಂಘಟಿತ ಕಾರ್ಮಿಕರಾದ ಹಮಾಲರು, ಗೃಹಕಾರ್ಮಿಕರು, ಚಿಂದಿ ಆಯುವವರು, ಟೈಲರ್‌ಗಳು ಹಾಗೂ ಮೆಕ್ಯಾನಿಕ್‌ಗಳನ್ನು ನೋಂದಾಯಿಸಿ ಸ್ಮಾರ್ಟ್ ಕಾರ್ಡ್ ಒದಗಿಸುವ ಮೂಲಕ ಭವಿಷ್ಯನಿಧಿ ಯೋಜನೆಯನ್ನು ಜಾರಿಗೆ ತರುವುದಾಗಿ ಘೋಷಿಸಲಾಗಿದೆ. ಮುಂದುವರೆದು, 2018-19ನೇ ಸಾಲಿನ ಆಯವ್ಯಯದಲ್ಲಿ ಅಸಂಘಟಿತ ಕಾರ್ಮಿಕರಲ್ಲಿ ಅಗಸರು, ಕ್ಷೌರಿಕರು, ಅಕ್ಕಸಾಲಿಗರು, ಕಮ್ಮಾರರು, ಕುಂಬಾರರು ಹಾಗೂ ಭಟ್ಟಿ ಕಾರ್ಮಿಕರಿಗೂ ಸಹ ಅಂಬೇಡ್ಕರ್ ಕಾರ್ಮಿಕ ಸಹಾಯ ಹಸ್ತ ಯೋಜನೆಯಡಿ ಸ್ಮಾರ್ಟ್ ಕಾರ್ಡ್ ಅನ್ನು ವಿತರಿಸಲಾಗುತ್ತಿದೆ.

ಮೇಲೆ ಓದಲಾದ ಜಂಟಿ ಕಾರ್ಯದರ್ಶಿ, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಅಸಂಘಟಿತ ಕಾರ್ಮಿಕ ಸಾಮಾಜಿಕ ಭದ್ರತಾ ಮಂಡಳಿಯ ಪತ್ರದಲ್ಲಿ ಕಟ್ಟಡ ಕಾರ್ಮಿಕರಿಗೆ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಕಟ್ಟಡ ಮತ್ತು ಇತರೆ ನಿರ್ಮಾಣ ಕಾರ್ಮಿಕರ ಕಲ್ಯಾಣ ಮಂಡಳಿ ವತಿಯಿಂದ ಸ್ಮಾರ್ಟ್ ಕಾರ್ಡ್ ನೀಡಲಾಗುತ್ತಿದ್ದು ಕಟ್ಟಡ ಹಾಗೂ ಇತರೆ ನಿರ್ಮಾಣ ಕಾರ್ಯದಲ್ಲಿ ತೊಡಗಿರುವ ಪೇಂಟರ್, ಪ್ಲಂಬರ್, ಕಾರ್ಪೆಂಟರ್, ಸೆಂಟರಿಂಗ್ ಕೆಲಸಗಾರರು, ಮೇಸನ್ ಕೆಲಸಗಾರರು, ಎಲೆಕ್ಟ್ರಿಷಿಯನ್ಸ್ ಇತ್ಯಾದಿ ಕಾರ್ಮಿಕರು ಅಸಂಘಟಿತ ಕಾರ್ಮಿಕರ ವ್ಯಾಖ್ಯೆಯಲ್ಲಿ ಬರುತ್ತಿದ್ದು, ಸದರಿ ವಲಯಗಳ ಅನುಭವ ಹಾಗೂ ಕುಶಲತೆಯುಳ್ಳ ಕಾರ್ಮಿಕರ ಸೇವೆಯನ್ನು ಸಾರ್ವಜನಿಕರು ಪಡೆಯಲು ಅನುಕೂಲವಾಗುವಂತೆ ಸಂಪೂರ್ಣ ಮಾಹಿತಿಯುಳ್ಳ ಒಂದು ಪ್ರತ್ಯೇಕ ಆ್ಯಪ್‌ನ್ನು ಅಭಿವೃದ್ಧಿಪಡಿಸಲು ಅವಶ್ಯಕತೆ ಇರುತ್ತದೆ.

ಈ ರೀತಿ ಕುಶಲತೆ ಹಾಗೂ ಅನುಭವಯುಳ್ಳ ಕಾರ್ಮಿಕರ ಸೇವೆಯನ್ನು ಪಡೆಯುವ ಸಲುವಾಗಿ ಆ್ಯಪ್‌ನ್ನು ಮೆ:ಕಿಯೋನಿಕ್ಸ್ ಸಂಸ್ಥೆಯ ಮೂಲಕ ಅಭಿವೃದ್ಧಿ ಪಡಿಸುವಂತೆ ಕೋರಿರುತ್ತಾರೆ. ಅದರಂತೆ ಸರ್ಕಾರವು ಪ್ರಸ್ತಾವನೆಯನ್ನು ಪರಿಶೀಲಿಸಿ ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶ ಹೊರಡಿಸಿದೆ.

ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ:ಕಾಇ 150 ಎಲ್ಇಟಿ 2018, ಬೆಂಗಳೂರು, ದಿನಾಂಕ : 12.09.2019.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಅಸಂಘಟಿತ ಕಾರ್ಮಿಕರ ಸಾಮಾಜಿಕ ಭದ್ರತಾ ಮಂಡಳಿಯು ಅಂಬೇಡ್ಕರ್ ಕಾರ್ಮಿಕ ಸಹಾಯ ಹಸ್ತ ಯೋಜನೆಯನ್ನು ಜಾರಿಗೊಳಿಸುತ್ತಿದ್ದು, ಈ ಯೋಜನೆಯಡಿ ರಾಜ್ಯ ಸರ್ಕಾರವು ಗುರುತಿಸಿರುವ 43 ಅಸಂಘಟಿತ ಕಾರ್ಮಿಕ ವಲಯಗಳಲ್ಲಿ 12 ಅಸಂಘಟಿತ ವಲಯಗಳಾದ ``ಹಮಾಲರು, ಮನೆಗೆಲಸದವರು, ಚಿಂದಿ ಆಯುವವರು, ಟೈಲರ್ಸ್, ಮೆಕ್ಯಾನಿಕ್, ಅಗಸರು, ಅಕ್ಕಸಾಲಿಗರು, ಕಮ್ಮಾರರು, ಕುಂಬಾರರು, ಕ್ಷೌರಿಕರು, ಭಟ್ಟಿ ಕಾರ್ಮಿಕರು ಹಾಗೂ ಖಾಸಗಿ ವಾಣಿಜ್ಯ ವಾಹನ ಚಾಲಕರನ್ನು ನೋಂದಾಯಿಸಿ ಸ್ಮಾರ್ಟ್ ಕಾರ್ಡ್ ನೀಡಲಾಗುತ್ತಿದೆ. ಕಟ್ಟಡ ನಿರ್ಮಾಣ ಕಾರ್ಯದಲ್ಲಿ ತೊಡಗಿರುವ ಪೇಂಟರ್, ಪ್ಲಂಬರ್, ಕಾರ್ಪೆಂಟರ್, ಸೆಂಟರಿಂಗ್ ಕೆಲಸಗಾರರು, ಮೇಸನ್ ಕೆಲಸಗಾರರು ಎಲೆಕ್ಟ್ರಿಷಿಯನ್ಸ್ ಇತ್ಯಾದಿ ಕಾರ್ಮಿಕರು ಅಸಂಘಟಿತ ಕಾರ್ಮಿಕರ ವ್ಯಾಖ್ಯೆಯಲ್ಲಿ ಬರುತ್ತಿದ್ದು, ಸದರಿ ವಲಯಗಳ ಅನುಭವ ಹಾಗೂ ಕುಶಲತೆಯುಳ್ಳ ಕಾರ್ಮಿಕರ ಸೇವೆಯನ್ನು ಸಾರ್ವಜನಿಕರು ಸದುಪಯೋಗ ಪಡೆದುಕೊಳ್ಳಲು ಅನುಕೂಲವಾಗುವಂತೆ ಸಂಪೂರ್ಣ ಮಾಹಿತಿಯುಳ್ಳ ಒಂದು ಪ್ರತ್ಯೇಕ ಆ್ಯಪ್‌ನ್ನು ಅಭಿವೃದ್ಧಿಪಡಿಸಲು ಆದೇಶಿಸಲಾಗಿದೆ.

ಸದರಿ ಆ್ಯಪ್‌ನ್ನು ಮೆ:ಕಿಯೋನಿಕ್ಸ್ ಸಂಸ್ಥೆಯ ಮೂಲಕ 3 ತಿಂಗಳೊಳಗೆ ಅಭಿವೃದ್ಧಿ ಪಡಿಸಲು ಆದೇಶಿಸಲಾಗಿದೆ. ಈ ಕುರಿತಂತೆ ಸದರಿ ಪ್ರಗತಿಯನ್ನು 4 ತಿಂಗಳ ನಂತರ ಸರ್ಕಾರವು ಪರಿಶೀಲಿಸಲಾಗುವುದು.

Preamble :

The Principal Chief Conservator of Forests (Head of Forest Force), Bengaluru vide letter read at (1) above has submitted the proposal to obtain the approval under Section-2 of the Forest (conservation) Act, 1980 for diversion of 2.114 hectare of Forest land in Kerwadi and other 4 vllages of Haliyal Taluk in Haliyal Forest Division for providing water supply facility (construction of water Treatment Plant and Pipeline) to Alnavar town and 14 enroute villages in favour of the Chief Officer, Town Panchayat, Alnavar

This proposal was forwarded to Ministry of Environment, Forests and Climate Change, Government of India vide letter read at (2) above, requesting to accord Stage-I approval under Section 2 of the Forest (Conservation) Act, 1980.

The Government of India vide letter read at (3) above have conveyed its in-principle approval (Stage-I) for diversion of forest land by stipulating certain conditions.

Further, the Additional Principal Chief Conservator of Forests (Forest Conservation) and Nodal Office (FCA) Bengaluru vide letter read at (4) above has sent proposal with the compliance report to Governm ent of Karnataka, and requested to accord Stage-II approval and the same was forwarded to the Ministry of Environment, Forests and Climate Change, Government of India with a recommendation to accord Stage – II approval under Section-2 of the Forest (Conservation), Act-1980 vide letter read at (5) above.

The Ministry of Environment, Forests and Climate Change, Regional Office (Southern Zone), Government of India have accorded Stage-II approval under section 2 of the Forest (Conservation) Act, 1980 vide letter read at (6) above by imposing certain conditions.

The proposal has been examined in detail and hence the order.

Government Order No. FEE 61 FLL 2018, Bengaluru, Dated: 04-09-2019.

In the circumstances as explained in the preamble above, Government is pleased to accord approval (Stage-II) under section 2 of the Forest (Conservation) Act, 1980, for diversion of 2.114 hectare of Forest land in Kerwadi and other 4 villages of Haliyal Taluk in Haliyal Forest Division for providing water supply facility (construction of Water Treatment Plant and Pipeline) to Alnavar town and 14 enroute villages in favour of the Chief Officer, Town Panchayath, Alnawar for a period of 20 years subject to the following conditions.

1. The legal status of forest land shall remain unchanged.

2. The Boundary of the forest land to be diverted shall be suitably demarcated on Ground at the project cost as per the direction of concerned Divisional Forest Officer

3. The compensatory afforestation shall be raised over 4.228 hectare of degraded forest land in F Sy.No. 36 of Kurdha Anchanahalli Village and F Sy. No. 131 of Mujrkwad Village both in Mujrkwad Hobli, Haliyal Taluk and Range Uttara Kannada District at the cost of User Agency.

4. The Additional am ount of the Net Present Value (NPV) of the diverted forest land if any becoming due after revision of the same by the Hon'ble Supreme Court of India in future, shall be charged by the State Government/The Principal Chief Conservator of Forests (Head of Forest Force) from the User Agency and the same shall be transferred to the designated Adhoc CAMPA Account.

5. The user Agency shall cut/transplant only those trees that are essential for the project under the supervision of Karnataka Forest Department.

6. The layout plan of the proposal shall not be changed without prior approval of Central Government.

7. No. Additional or new path will be constructed inside the forest area for transportation of construction materials for execution of the project work.

9. The forest land proposed to be diverted shall under no circumstances be transferred to any other agencies, department or person without prior approval of Government of India.

10. The period of diversion under this approval shall be co-terminus with the period of lease to be granted in favour of the user agency of the project life, whichever is less.

11. Any other condition that the Ministry of Environment, Forests and Climate may stipulate from time to time in the interest of conservation, protection and development of Forest and Wildlife.

12. Violation of any of these conditions will amount to violation of Forest (Conservation) Act, 1980 and action would be taken as per the MoEF&CC Guideline F.No. 11-42/2017-FC, dated: 29-01-2018.

13. The Principal Chief Conservator of Forests (Head of Forest Force) and User Agency shall comply the provisions of the all Acts, Rules, Regulations, Guidelines, NGT order and Hon'ble Court Order (s) pertaining to this project, if any, for the time being in force, as applicable to the project.

PREAMBLE :

In the Government (earlier Bombay Government) Resolution dated: 06.06.1949 of the Revenue Department read at (1) with a view to establish a factory in Kanara District forest for manufacture of pulp & Paper with Bamboo an Ad-hoc Committee was appointed by the Governm ent to examine the schemes called from corporations or individuals who were interested in paper Industry.

In the Government Resolution dated: 17.11.1950 read at (2) the scheme prepared by the Ad-hoc Committee headed by Shri M.G Kotibhaskar and Shri A.D. Choudari on behalf of the west coast paper mills ltd., has been accepted and granted 150 acres of land for a period of 30 years with certain conditions.

In the letter read at (3) the Government has granted additional 50 acres of land to the west coast paper mills ltd totaling 200 acres.

In the order dated: 18.05.1962 read at (4) the forest department has disforested the forest land to an extent of 1112 acres and 34 guntas in forest survey no. 4A at Dandeli forest Sy. No. 1 to 8 at Kumbarkoppa taluk Haliyal District north Kanara and Surrendered to Dandeli Township authorities.

However in the same Government Order it is also categorically stated that "The proprietory right over the areas that are occupied by the Government Timber depot including Jai Hind saw mill etc., (ii) Research Garden (iii) Wet Nursery (iv) Forest Bungalow with their compounds and (v) the four industries at Dandeli should rem ain vested in the Forest Department". Hence after de-notification of land Pertaining to above five items which is non forest Governm ent land has continued to be under the proprietoryship of forest department. In view of the same, Forest Conservation Act does not apply to this area. However in view of proprietoryship remaining with the forest department this land can be leased out by forest department for the purpose of same activity for a further period of 30 years from the date of expiry of 2nd(term) lease.

In the letter dated: 14.04.1969 read at (5) the forest settlement officer, Kanara, Karwar has informed Deputy Commissioner, North Kanara, Karwar that the extent of area after survey is found to be 1119.19 acre/gunta and forest sy. no. mentioned in the order have been converted into compartment/block and hence modification order may be issued to the Disforestation order (read at 4) Hence notification dated: 19.09.1972 read at (6) has been issued to forest sy. No. compartment no. & area Disforested to the extent of 1119.19 Acre/gunta in various regions of Dandeli, Kumbarkop, Ambewadi, Kerwadi, Badaka Shirda & Birampali in Haliyal Taluk, North Canara.

In the document read at (7) The Lease Agreement has been signed between (dated: 29.06.1956) the Bombay Government & West Coast paper mill ltd., a company incorporated under the Indian Company Act 1913 having registered office at Bombay where in 200 acres or 80.00 ha. sy.no. 4 of Dandeli has been assigned to the lessee for paper factory (main scheme) for a period of 30 years from 29.06.1956 to be negotiated afresh after every 30 years for further 60 years from the date of expiration which shall expire on 29.06.1986 In the same agreement strip area of an extent 4.80 ha (12 acres) has been granted for keeping inflammable material through out the said tenure.

The Government of India vide its letter dated: 20.07.1999 read at (8) and vide Government of Karnataka Order dated: 05.06.2000 read at (9) renewal of lease of 80 ha of Forest (Disforest) land in sy.no. 4 of Dandeli Village in favour of West Coast paper mills has been made with effect from 29.06.1986 for further period of 30 years subject to conditions read at (10) As such this land being a denotified forest land put to non-forestry use much before Forest (Conservation) Act, 1980 came into force. It was not correct to trust the lease renewal under Forest (Conservation) Act, 1980.

As per the earlier agreement strip area of an extent 4.80 ha (12 acres) should be considered.

A part from 200 acres land granted an additional 40.00 acres of demised land has been granted vide agreement dated:

23.10.1970 read at (11) for labour colony with effect from 01.05.1960 for a period of 30 years & for further extention for a period of 60 years subject to conditions. In Ambewadi sy.no.21, 12.80 acres Dandeli sy. no. 4, 27.20 acres total 40 acres. The lease has been expired on 30.04.1990

In the letter dated: 28.01.1960 read at (12) it is learnt that vide letter No. G/D/619 dated: 25.03.1957 of Divisional forest officer Kanara & DCF Haliyal letter Government Order AFD 3 FAC 57 dated: 06.04.1957, an extent of 4.7868 ha of forest land has been granted on lease for Railway sidings with effect from 1955 for a period of 30 years which has expired on 1985

In the Attested document of Munsif Haliyal dated: 15.06.1976 read at (13) it is learnt that vide Government Order no. AFD 38 DAR 57 dated: 21.05.1957, an extent of 15 acres of land has been granted on lease for water purification plant (pump house) for a period of 30 years. As per DCF Haliyal letter the land in extent is 3.8849 ha (9.7 acres) and the lease has expired in the year 1985.

In the letter dated: 13.07.1984 read at (14) it is learnt that an extent of 1.60 ha (4.00 acres) of land has been permitted to use by the company for nursery/stoking purpose.

In the Government Order dated: 23.06.1975 read at (15) lease of 12 acres of land out of compartment no. V of Dandeli range for effluent treatment plant for a period of 20 years has been granted subject to conditions and the lease has been expired on 22.06.1995 In the letter read at (16) DCF Haliyal has insisted the user agency to get sanction the lapsed leased out area or to hand over the land to Government/Forest Department.

In the letter read at (17) West Coast paper mills ltd., has requested the Deputy Commissioner Uttara Kannada for extention of all the leased out (Disforested land) areas lease period used by the company for paper Industry for a period of 30 years with effect from 29.06.2016

lease tenure and letter read at (19) the Deputy Commissioner Uttar Kannada District has recommended the proposal.

In the Government Order dated: 29.08.1997 read at (20) lease rent has been fixed for all the user agency for the piece & parcel of the Forest land.

In the forest Conservation Act 1980 Chapter-1 Part-C section 1.2 clarifies

"The cases in which specific orders for de-reservation or diversion of forest areas in connection with any project were issued by the State Governm ent prior to 25.10.1980, need not be referred to the Central Government. However, in cases where only administrative approval for the project was issued without specific orders regarding dereservation and or diversions of forest lands, a prior approval of the Central Government would be necessary". In the instant case the forest land was denotified and subjected non- forestry use much before Forest (Conservation) Act, 1980 came into force.

Hence the following order,

GOVERNMENT ORDER NO. FEE 98 FLL 2017, BENGALURU, DATED: 08.03.2018

In the circumstances explained in the preamble above Government are pleased to grant the extension of lease of the main factory land an extent of 80 ha i.e., 200 acres Denotified forest land in Uttar Kannada District Haliyal Taluk Dandeli original sy.no.4A1- A/Revised sy.no.CB 3A/ Forest department compartment or Block to west Coast paper mills ltd., for a period 30 years with effect from 29.06.2016 to 28.06.2046

Along with the main land for Factory scheme leased out all the other piece and parcel of the Denotified forest land adjoining to factory site and for Industrial usage granted earlier in a way of lease by the earlier Bombay Government/Mysuru Government/ Governm ent of Karnataka in Uttar Kannada District, Haliyal Taluk, Dandeli, Ambewadi is extended upto 28.06.2046 till the end of the main factory lease.

The extent of Denotified forest land granting lease extend as follows:

The grant of extension of lease period is made by the Forest department Government of Karnataka as the power vests with Forest Department Government of Karnataka vide Government of Mysuru Order No.AFD 60 DST 57 dated: 18.05.1962 & as per guidelines of Governm ent of India under Forest Conversation Act 1980, Chapter-1 part 'C' section 1.2 & Government of Karnataka letter no. FEE 71 FLL 2007 dated: 30.04.2008

The lease rent and other statutory fees shall be insisted by the concerned DCF to user agency for all the periods & all piece & parcels of the land (Denotified) used by/granted/lease extended to west Coast paper mills ltd., along with the penalties/interest.

The user agency shall pay the lease rent & other statutory fees from time to time as fixed by the Government along with the interest/penalties from the effective dates & rates with cumulative effect.

If necessary concerned Forest Authorities shall make a representation to Government to fix the lease rent for Denotified forest land as the earlier lease rent fixed by the Government dates back to 20 years.

All the terms & conditions in the earlier Resolutions/orders/agreements shall continue

The DCF concerned shall verify the boundaries granted to user agency for any discrepancies.

The leased out Denotified forest land shall be taken back by the Forest department after lapse of lease period. This shall not be granted further.

The user agency shall take the permission of all the Government Department concerned for the ongoing Industry.

ಪ್ರಸ್ತಾವನೆ :

ಮೇಲೆ ಓದಲಾದ (1) ರ ಪತ್ರದಲ್ಲಿ ಕರ್ನಾಟಕ ಜೀವವೈವಿಧ್ಯ ಮಂಡಳಿಯ, ಕರ್ನಾಟಕ ಸರ್ಕಾರದಿಂದ ಹಣಕಾಸಿನ ಅನುದಾನವನ್ನು ಪಡೆದಿರುವುದಲ್ಲದೆ ರಾಷ್ಟ್ರೀಯ ಜೀವವೈವಿಧ್ಯತೆ ಪ್ರಾಧಿಕಾರದಿಂದ ಹಾಗೂ ಕೇಂದ್ರ ಸರ್ಕಾರಗಳ ವಿವಿಧ ಇಲಾಖೆಗಳಿಂದಲೂ ಸಹ ಅನುದಾನವನ್ನು ಪಡೆಯಲು ಅವಕಾಶವಿರುತ್ತದೆ. ರಾಜ್ಯ ಜೀವವೈವಿಧ್ಯತೆ ಮಂಡಳಿಗೆ ರಾಷ್ಟ್ರೀಯ ಜೀವವೈವಿಧ್ಯತೆ ಪ್ರಾಧಿಕಾರದಿಂದ ಅನುದಾನವು ಬಿಡುಗಡೆಯಾಗುವಲ್ಲಿ ವಿಳಂಬವಾಗಿದ್ದು, ಇದಕ್ಕೆ ಪ್ರಮುಖ ಕಾರಣ ರಾಷ್ಟ್ರೀಯ ಜೀವವೈವಿಧ್ಯತೆ ಪ್ರಾಧಿಕಾರ ನಿಯಮಾವಳಿಗಳ ಪ್ರಕಾರ ಹಣ ಬಳಕೆ ಪ್ರಮಾಣ ಪತ್ರಕ್ಕೆ ಮಂಡಳಿಯ ಸದಸ್ಯ ಕಾರ್ಯದರ್ಶಿಗಳು ಹಾಗೂ ಮಂಡಳಿಯಿಂದ ಹಣಕಾಸಿನ ಅಧಿಕಾರಿಗಳು ಜಂಟಿಯಾಗಿ ದೃಡೀಕರಿಸಿ ಸಹಿ ಮಾಡುವುದು ಕಡ್ಡಾಯವಾಗಿರುತ್ತದೆ. ಸಹಿ ಹಾಕಿದಂತಹ ಹಣ ಬಳಕೆ ಪ್ರಮಾಣ ಪತ್ರಗಳನ್ನು ರಾಷ್ಟ್ರೀಯ ಜೀವವೈವಿಧ್ಯತೆ ಪ್ರಾಧಿಕಾರಕ್ಕೆ ಸಲ್ಲಿಸಿದಲ್ಲಿ ಮಾತ್ರ ಅದಕ್ಕೆ ಮಾನ್ಯತೆ ದೊರೆತು ಹಣಕಾಸಿನ ನೆರವನ್ನು ನೀಡಲಾಗುವುದು. ಹಾಲಿ ಕರ್ನಾಟಕ ಜೀವವೈವಿಧ್ಯ ಮಂಡಳಿಯಲ್ಲಿ ಹೊರಗುತ್ತಿಗೆ ಆಧಾರದ ಮೇಲೆ ಕಾರ್ಯನಿರ್ವಹಿಸುತ್ತಿರುವ ನೌಕರರಿಂದ ಹಣಕಾಸಿನ ಶಾಖೆಯನ್ನು ನಿರ್ವಹಿಸಲಾಗುತ್ತಿದೆ. ಸದರಿ ನೌಕರರು ಸಾಮಾನ್ಯವಾಗಿ ಅನುಭವಿಗಳಾಗಿದ್ದು, ಕಛೇರಿಯ ಲೆಕ್ಕ ಪತ್ರಗಳ ವ್ಯವಹಾರದ ಸೀಮಿತ ಜ್ಞಾನವನ್ನು ಹೊಂದಿರುವುದಲ್ಲದೆ, ಹೊರಗುತ್ತಿಗೆ ನೌಕರರು ಪದೇ ಪದೇ ಬದಲಾಗುವುದರಿಂದ ಮಂಡಳಿಯ ಹಣಕಾಸಿನ ಶಾಖೆಯ ಕಾರ್ಯನಿರ್ವಹಣೆ ಕಷ್ಟ ಸಾಧ್ಯವಾಗಿರುತ್ತದೆ ಎಂದು ಸದಸ್ಯ ಕಾರ್ಯದರ್ಶಿ, ಕರ್ನಾಟಕ ಜೀವವೈವಿಧ್ಯ ಮಂಡಳಿ ಇವರು ತಿಳಿಸಿರುತ್ತಾರೆ.

ಸದರಿ ವಿಷಯವನ್ನು ಮೇಲೆ ಓದಲಾದ (2) ರ ದಿನಾಂಕ: 18.08.2016 ರಂದು ನಡೆದ ಕರ್ನಾಟಕ ಜೀವವೈವಿಧ್ಯ ಮಂಡಳಿಯ 32ನೇ ಸಭೆಯಲ್ಲಿ ಚರ್ಚಿಸಿ, ರಾಜ್ಯ ಲೆಕ್ಕಪತ್ರ ಇಲಾಖೆಯಲ್ಲಿ ಕಾರ್ಯನಿರ್ವಹಿಸುವ ಸಹಾಯಕ ನಿಯಂತ್ರಕ ಮಟ್ಟದ ಹಣಕಾಸು ಅಧಿಕಾರಿ ಹುದ್ದೆಯನ್ನು ಸೃಜಿಸುವಂತೆ ಹಾಗೂ ಪ್ರಧಾನ ಮುಖ್ಯ ಅರಣ್ಯ ಸಂರಕ್ಷಣಾಧಿಕಾರಿಗಳು (ಅರಣ್ಯ ಪಡೆ ಮುಖ್ಯಸ್ಥರು) ರವರ ಕಛೇರಿಯಲ್ಲಿ ಹಣಕಾಸು ಸಹಾಯಕರಾಗಿ ಸೇವೆ ಸಲ್ಲಿಸುತ್ತಿರುವ ಒಬ್ಬ ನೌಕರರ ಸೇವೆಯನ್ನು ಕರ್ನಾಟಕ ಜೀವವೈವಿಧ್ಯ ಮಂಡಳಿಗೆ ಎರವಲು ಆಧಾರದ ಮೇಲೆ ಪಡೆಯುವಂತೆ ನಿರ್ಣಯವಾಗಿರುತ್ತದೆ. ಮೇಲೆ ಓದಲಾದ (3) ರ ದಿನಾಂಕ: 17.12.2016 ರಂದು ನಡೆದ ಕರ್ನಾಟಕ ಜೀವವೈವಿಧ್ಯ ಮಂಡಳಿಯ 33ನೇ ಸಭೆಯಲ್ಲಿ ಕರ್ನಾಟಕ ಜೀವವೈವಿಧ್ಯ ಮಂಡಳಿಗೆ ಹಣಕಾಸು ಅಧಿಕಾರಿ ಹುದ್ದೆಯನ್ನು ಹಾಗೂ ಲೆಕ್ಕಾಧಿಕಾರಿ ಹುದ್ದೆಯನ್ನು ಸೃಜಿಸುವಂತೆ ನಿರ್ಣಯವಾಗಿರುತ್ತದೆ.

ಮೇಲೆ ಓದಲಾದ (4) ದಿನಾಂಕ: 19.06.2003 ರ ಸರ್ಕಾರದ ಅಧಿಸೂಚನೆಯನ್ವಯ ಕರ್ನಾಟಕ ಜೀವವೈವಿಧ್ಯ ಮಂಡಳಿಗೆ ಲೆಕ್ಕ ಮೇಲ್ವಿಚಾರಕರ (Accounts Supervisor) ಹುದ್ದೆ ಮಾತ್ರ ಮಂಜೂರಾಗಿರುತ್ತದೆ. ಸದರಿ ಹುದ್ದೆಯನ್ನು ಮ್ಯಾನ್ ಪವರ್ ಏಜೆನ್ಸಿ ಮೂಲಕ ಭರ್ತಿ ಮಾಡುವ ಅವಕಾಶವನ್ನು ಕಲ್ಪಿಸಲಾಗಿದೆ.

ಕರ್ನಾಟಕ ಜೀವವೈವಿಧ್ಯ ಮಂಡಳಿಗೆ ಒಂದು ಹಣಕಾಸು ಅಧಿಕಾರಿ ಮತ್ತು ಒಂದು ಲೆಕ್ಕಾಧೀಕ್ಷಕರ ಹುದ್ದೆಯನ್ನು ಸೃಜಿಸುವ ಬಗ್ಗೆ ಆರ್ಥಿಕ ಇಲಾಖೆಯ ಸಹಮತಿಯನ್ನು ಕೋರಲಾಗಿರುತ್ತದೆ. ಕರ್ನಾಟಕ ಜೀವವೈವಿಧ್ಯ ಮಂಡಳಿಗೆ ಒಂದು ಲೆಕ್ಕಾಧೀಕ್ಷಕರ (Accounts Superintendent) ಹುದ್ದೆಯನ್ನು ಸೃಜಿಸಿ, ರಾಜ್ಯ ಲೆಕ್ಕಪತ್ರ ಇಲಾಖೆಯಿಂದ ನಿಯೋಜನೆ ಮೇಲೆ ಭರ್ತಿ ಮಾಡಲು ಆರ್ಥಿಕ ಇಲಾಖೆಯು ಸಹಮತಿಯನ್ನು ನೀಡಿರುತ್ತದೆ.

ಸದರಿ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಪರಿಶೀಲಿಸಿ, ಸರ್ಕಾರವು ಈ ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿದೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಕರ್ನಾಟಕ ಜೀವವೈವಿಧ್ಯ ಮಂಡಳಿಗೆ ಒಂದು ಲೆಕ್ಕಾಧೀಕ್ಷಕರ (Accounts Superintendent) ಹುದ್ದೆಯ ಸೃಜಿಸಿ, ಸದರಿ ಹುದ್ದೆಯನ್ನು ರಾಜ್ಯ ಲೆಕ್ಕಪತ್ರ ಇಲಾಖೆಯಿಂದ ನಿಯೋಜನೆ ಮೇಲೆ ಭರ್ತಿ ಮಾಡಲು ಸರ್ಕಾರವು ಅನುಮತಿಸಿ ಆದೇಶಿಸಿದೆ.

ಸದರಿ ಹುದ್ದೆಗೆ ತಗಲುವ ವೆಚ್ಚವನ್ನು ಲೆಕ್ಕ ಶೀರ್ಷಿಕೆ 3435-03-103-0-06 ರಡಿಯಲ್ಲಿ ಭರಿಸತಕ್ಕದ್ದು.

ಈ ಆದೇಶವನ್ನು ಆರ್ಥಿಕ ಇಲಾಖೆಯ ಟಿಪ್ಪಣಿ ಸಂಖ್ಯೆ: ಆಇ 45 ವೆಚ್ಚ-5/2019, ದಿನಾಂಕ: 15.07.2019 ರಲ್ಲಿ ಆರ್ಥಿಕ ಇಲಾಖೆಯು ನೀಡಿದ ಸಹಮತಿಯನ್ವಯ ಹೊರಡಿಸಲಾಗಿದೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಿರುವ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಕರ್ನಾಟಕ ಸಂಘಗಳ ನೋಂದಣಿ ಕಾಯ್ದೆ 1960ರ ಕಲಂ 27(ಎ) ರನ್ವಯ ಉದಯ ವಿದ್ಯಾ ಕೇಂದ್ರ, ಭುವನೇಶ್ವರಿ ನಗರ, ಆರ್.ಟಿ.ನಗರ(ಪೋ), ಬೆಂಗಳೂರು ಈ ಸಂಘದ ಆಡಳಿತಾಧಿಕಾರಿ ಅವಧಿಯನ್ನು ಅಂತಿಮವಾಗಿ ದಿನಾಂಕ:04.11.2019 ರಿಂದ ಮುಂದಿನ ಆರು ತಿಂಗಳ ಅವಧಿಗೆ ಮಾತ್ರ ವಿಸ್ತರಿಸಿ ಆದೇಶಿಸಿದೆ. ಈ ಆದೇಶವು ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರುತ್ತದೆ.

ಆಡಳಿತಾಧಿಕಾರಿಗಳು ಸಂಘದಲ್ಲಿ ನಡೆದಿರುವ ಹಣ ದುರುಪಯೋಗದ ಕುರಿತು ವಿಚಾರಣಾ ವರದಿಯನ್ವಯ ನಿಯಮಾನುಸಾರ ಕ್ರಮಕೈಗೊಂಡು ಸಂಘದಲ್ಲಿನ ನ್ಯೂನ್ಯತೆಗಳನ್ನು ಸರಿಪಡಿಸಿ, ಸಂಘದ ಆಡಳಿತ ಮಂಡಳಿಗೆ ಚುನಾವಣೆ ನಡೆಸಿ, ಚುನಾಯಿತ ನೂತನ ಆಡಳಿತ ಮಂಡಳಿಗೆ ಅಧಿಕಾರ ಹಸ್ತಾಂತರಿಸುವಂತೆ ಸೂಚಿಸಲಾಗಿದೆ. ಒಂದುವೇಳೆ ಚುನಾವಣೆ ನಡೆಸಲು ಸಾಧ್ಯವಾಗದೇ ಇದ್ದಲ್ಲಿ ಸಂಘವನ್ನು ವಿಸರ್ಜನೆಗೊಳಿಸಿ, ನೋಂದಣಿ ರದ್ದುಪಡಿಸಲು ಮತ್ತು ಸಂಘದ ಆಸ್ತಿಯನ್ನು ಸರ್ಕಾರದ ವಶಕ್ಕೆ ತೆಗೆದುಕೊಳ್ಳಲು ಸೂಕ್ತ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಸದರಿ ಅವಧಿಯ ಒಳಗಾಗಿ ಸಲ್ಲಿಸಲು ಸೂಚಿಸಿದೆ.
