Now therefore, in exercise of the powers conferred by sub - section (2) of Section 3 of the Karnataka Protection of interest of Depositors in Financial Establishment Act, 2004 (Karnataka Act 30 of 2005), the Government under the circumstances stated above having satisfied that in order to protect the interest of depositors it is necessary to attach the movable and immovable properties believed to belong to M/s Aala Ventures Limited. Therefore, the Government hereby attaches all movable and immovable properties as specified in Annexures-1, 2 to this order believed to have been acquired by the M/s Aala Ventures Limited either in its own name or in the name of any other person from and out of the deposits collected by the M/s Aala Ventures Limited and where it transpires that such money or such other properties of the said financial establishment, or the personal assets of the promoters, partners, directors, managers or members or any other person of the said financial establishment is not sufficient for the repayment of the deposits or interest or such other assured benefits to the depositors.

Note: All the aforesaid properties, from the date of publication of this order in the Official Gazette, shall forthwith vest with the Competent Authority, who has been appointed by the Government, pending further orders from the Special Court.

Now therefore, in exercise of the powers conferred by sub - section (2) of Section 3 of the Karnataka Protection of interest of Depositors in Financial Establishment Act, 2004 (Karnataka Act 30 of 2005), the Government under the circumstances stated above having satisfied that in order to protect the interest of depositors it is necessary to attach the movable and immovable properties believed to belong to M/s Muzaribha Bullion Trading LLP. Therefore, the Government hereby attaches all movable and immovable properties as specified in Annexures-1, 2 & 3 to this order believed to have been acquired by the M/s Muzaribha Bullion Trading LLP either in its own name or in the name of any other person from and out of the deposits collected by the M/s Muzaribha Bullion Trading LLP and where it transpires that such money or such other properties of the said financial establishment, or the personal assets of the promoters, partners, directors, managers or members or any other person of the said financial establishment is not sufficient for the repayment of the deposits or interest or such other assured benefits to the depositors.

RULES

1. Title and Commencement.

"3. Penalty against jurisdictional officer failing to prevent unauthorized deviation or constructions.- (1) Notwithstanding anything contained in any other rules in this regard, if the commissioner or chief officer upon a complaint or on suo moto cognizance is satisfied, that the jurisdictional officer has failed to prevent unauthorized deviation or constructions under section 187-B of the Act, that have taken place in his jurisdiction during his period, he shall call upon the officer concerned by a notice in writing to show cause as to why he shall not be punished and after giving him reasonable opportunity of being heard, pass appropriate order either to drop the proceedings or impose upon him the punishment to pay penalty as below and such process shall be completed normally within two months,-

(i) for the first instance he shall be levied with a penalty of not less than ten thousand rupees but not more than twenty five thousand rupees;

(ii) for second instance he shall be levied with a penalty of not less than twenty five thousand rupees but not more than fifty thousand rupees; and

(iii) for third and every subsequent instance the Commissioner or chief officer shall initiate further proceedings under section 342 of the Act.

- depending upon the gravity of the negligence or misconduct or violation.

(2) payment of penalty by the jurisdictional officer under these rules shall not deem to regularize the building plan approved by such jurisdictional officer.

4. Appeal.- (1) Any officer aggrieved by the order of the Commissioner or the Chief Officer may prefer an appeal to the Deputy Commissioner of the District within thirty days from the date of communication of the order.

(2) The Deputy Commissioner shall after giving an opportunity of being heard to the aggrieved officer dispose the appeal within forty five days from the date of appeal.

(3) The orders of the Deputy Commissioner shall be final.

Whereas, the draft of the Karnataka Municipal corporations (levy of penalty on jurisdictional officer for failure to prevent unauthorized construction and deviation) Rules, 2019 was published as required by sub-section (1) of section 421 of the Karnataka Municipal Corporations Act, 1976 (Karnataka Act 14 of 1977) vide Notification –II No. UDD 1107 MNU 2015, dated: 03.10.2019 in Part IVA, No. 835 of the Karnataka Gazette extra-ordinary dated: 04-10-2019 for inviting objections/Suggestions from all persons likely to be affected thereby within thirty days from the date of its publication in the official Gazette.

And whereas, the said Gazette was made available to the public on 04.10.2019.

And whereas, the objections and suggestions received in this behalf have been considered by the State Government.

Now, therefore in exercise of the powers conferred by section 321-B read with section 421 of Karnataka Municipal Corporations Act, 1976, (Karnataka Act 14 of 1977) the Government of Karnataka hereby make the following rules namely;

RULES

1. Title, Commencement and Application.- (1) These rules may be called the Karnataka Municipal corporations (levy of penalty on jurisdictional officer for failure to prevent unauthorized construction and deviation) Rules, 2019.

(2) They shall come into force from the date of their publication in the Official Gazette.

(3) They shall apply to all the Municipal Corporations including Bruhat Bengaluru Mahanagara Palike.

2. Definitions.- In these rules, unless the context otherwise requires,-

(a) "Act" means the Karnataka Municipal Corporations Act, 1976 (Karnataka Act 14 of 1977);

(b) "Building bye-laws" means the relevant building bye-laws applicable to the Municipal Corporation";

(c) "Corporations" shall have the same meaning as provided under the Karnataka Municipal Corporations Act, 1976 (Karnataka Act 14 of 1977);

(d) "Jurisdictional officer" means an officer who is responsible for preventing any unauthorized construction or deviation"; and

(e) "Unauthorized construction/deviation" means any building which has been constructed or is being constructed in violation of the norms prescribed under the building bye-laws of the Municipal Corporation.

"3. (ii) for second instance he shall be levied with a penalty of not less than fifty thousand rupees but not more than one lakh rupees; and

(iii) for third and every subsequent instance the Commissioner shall initiate further proceedings under section 90 of the Act.
