ಮೇಲೆ ಓದಲಾದ (1)ರ ಪತ್ರದಲ್ಲಿ ನಿರ್ದೇಶನಾಲಯದ ಮಟ್ಟದಲ್ಲಿ ಸದರಿ ವೈದ್ಯರಿಂದ ಯಾವುದೇ ಬಾಕಿ ಬರಬೇಕಾಗಿಲ್ಲ ಮತ್ತು ಬಂಧಪತ್ರದ ಅವಧಿಯಲ್ಲಿ ಇರುವುದಿಲ್ಲವೆಂದು ಹಾಗೂ ಅವರ ವಿರುದ್ಧ ಇಲಾಖಾ ವಿಚಾರಣೆಗಳು ಬಾಕಿ ಇರುವುದಿಲ್ಲವೆಂದು ತಿಳಿಸುತ್ತಾ. ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ ನಿಯಮಾವಳಿಗಳ ನಿಯಮ 285(1)(ಎ) ಪ್ರಕಾರ ದಿನಾಂಕ: 31/05/2019ರಿಂದ ಅಥವಾ ಆದೇಶ ಹೊರಡಿಸಿದ ದಿನಾಂಕಕ್ಕೆ ಅನ್ನಯಿಸಿ ಸ್ವ-ಇಚ್ಚಾ ನಿವೃತ್ತಿ ಹೊಂದಲು ಅನುಮತಿ ನೀಡುವಂತೆ ಕೋರಿ ಮುಖ್ಯ ಆಡಳಿತಾಧಿಕಾರಿಗಳು, ಆರೋಗ್ಯ ಮತ್ತು ಕುಟುಂಬ ಕಲ್ಯಾಣ ಸೇವೆಗಳು, ಬೆಂಗಳೂರು ಇವರು ಸರ್ಕಾರಕ್ಕೆ ಪ್ರಸ್ತಾವನೆ ಸಲ್ಲಿಸಿರುತ್ತಾರೆ. ಮೇಲೆ ಓದಲಾದ (2)ರ ಪತ್ರದಲ್ಲಿ ಸದರಿ ವೈದ್ಯಾಧಿಕಾರಿಯವರು ದಿನಾಂಕ: 31/05/2019 ಕ್ಕೆ 28 ವರ್ಷ 05 ತಿಂಗಳ ಅರ್ಹತಾದಾಯಕ ಸರ್ಕಾರಿ ಸೇವೆಯನ್ನು ಸಲ್ಲಿಸಿದ್ದಾರೆಂದು ತಿಳಿಸಿದ್ದಾರೆ.
ಹಾಗೆಯೇ ಸದರಿ ವೈದ್ಯರ ವಿರುದ್ಧ ಸರ್ಕಾರದ ಹಂತದಲ್ಲಿಯೂ ಸಹ ಯಾವುದೇ ಇಲಾಖಾ ವಿಚಾರಣೆ/ ವಗೈರೆ ಬಾಕಿ ಇಲ್ಲದಿರುವ ಬಗ್ಗೆ ದೃಡೀಕರಿಸಿಕೊಳ್ಳಲಾಗಿದೆ.
ಆಯುಕ್ತಾಲಯದ ಪ್ರಸ್ತಾವನೆಯನ್ನು ಕೂಲಂಕಷವಾಗಿ ಪರಿಶೀಲಿಸಿ ಕೆಳಕಂಡಂತೆ ಆದೇಶಿಸಿದೆ.

ಪ್ರಸ್ತಾವನೆಯಲ್ಲಿ ವಿವರಿಸಲಾದ ಅಂಶಗಳ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಡಾ|| ಶಶಿಕಲಾ ಎಂ.ಕೆ. ಅರವಳಿಕೆ ತಜ್ಞರು, ಜಿಲ್ಲಾ ಆರೋಗ್ಯ ಮತ್ತು ಕುಟುಂಬ ಕಲ್ಯಾಣಾಧಿಕಾರಿಗಳ ಕಛೇರಿ, ಹಾಸನ ಜಿಲ್ಲೆ ಇವರಿಗೆ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ ನಿಯಮಾವಳಿಗಳ ನಿಯಮ 285(1)(ಎ) ಪ್ರಕಾರ ದಿನಾಂಕ: 31/10/2019 ರಿಂದ ಜಾರಿಗೆ ಬರುವಂತೆ ಸ್ವ-ಇಚ್ಚಾ ನಿವೃತ್ತಿ ಹೊಂದಲು ಸರ್ಕಾರವು ಅನುಮತಿಯನ್ನು ನೀಡಿದೆ.
ಈ ಅನುಮತಿಯು ಸದರಿ ವೈದ್ಯಾಧಿಕಾರಿಗಳಿಂದ ಗೃಹ ನಿರ್ಮಾಣ/ವಾಹನ ಖರೀದಿ ಇತ್ಯಾದಿ ಯಾವುದೇ ಮುಂಗಡ ಸರ್ಕಾರಕ್ಕೆ ಬಾಕಿ ಇದ್ದಲ್ಲಿ ಅವರ ನಿವೃತ್ತಿ ಉಪದಾನಗಳಿಂದ ಕಡಿತಗೊಳಿಸಲಾಗುವುದೆಂಬ ಷರತ್ತಿಗೊಳಪಟ್ಟಿದೆ.

2. Letter No: IMA correspondence/ CBI/ ACB/ BLR/ 2019, Dated:04.09.2019.
Preamble:
In the Government order read at reference (1) above Sri L.C.Nagaraj, K.A.S (Junior Scale) Officer, the then Assistant Commissioner, Bangalore North Sub-Division, Bangalore was suspended from the Government service retrospectively from 06.07.2019 in connection with the charges of accepting bribe of Rs.4.5 crore in 3 instalments with malafide intentions to help the accused persons in respect of the financial irregularities of I Monetary Advisory (IMA) case.
The Superintendent of Police & Head of Branch, CBI, ACB, Bangalore vide the letter read at reference (2) above has stated that the Government of Karnataka vide notification No. E-HD 08 PCR 2019 dated 19.08.2019, has granted sanction to CBI to take over the investigation of all the FIRs registered in connection with IMA Company and its entities to investigate the following aspects:-
1. Investigation of Crime No.73/2019 registered in Commercial Street Police Station, Bangalore and all other FIRs related to investment in I Monetary Advisory (IMA), Bangalore and its group entities lodged elsewhere in Karnataka state.
2. Enquire and investigate into all types of illegal activities of I Monetary Advisory (IMA), Bangalore and its entities.
3. Identification and investigation of persons involved in the illegal activities in connection with affairs of
I Monetary Advisory (IMA) Bangalore and its group entities
In this regard, CBI has taken over the investigation of IMA related cases from SIT and re-registered FIR vide RC 14(A)/2019 and started the investigation.
In this connection, based on the report of SIT chief, the State ACB has also registered two FIRs:-
➢ FIR No. 25/2019 Dated 09.08.2019 under section 7, 7(A), 8, 12 of PC Act against Shri B.M.Vijaya
Shankar and others
➢ FIR No. 26/2019 Dated 09.08.2019 under 7(A), 12 of PC Act against Shri P.D.Kumar, Executive
Engineer, BDA, North Division, Bangalore.
The certified copies of these two FIRs were also forwarded to CBI vide ACB/HQ/CRM/02/2019 dated 01.09.2019 of Superintendent Of Police, ACB (HQ), Bangalore for further necessary action.
Accordingly, CBI, ACB, Bangalore re-registered FIR vide RC No.15 (A)/2019 dated 01.09.2019 under sections 7(A), 12 of PC Act 1988 (as amended in 2018) and took up investigation against Shri P.D.Kumar, Executive Engineer, BDA, North Division, Bangalore based on the FIR 26/2019 dated 09.08.2019 of State ACB, Bangalore.
However, in respect of FIR 25/2019 registered by State ACB under sections 7(A), 12 of PC Act 1988 (as amended in 2018), offences allegedly committed by the accused persons are relatable to recommendation made or decision taken by public servants in discharge of their Official functions of duties. As per the section under sections 7(A) of PC Act (as amended in 2018), prior approval of the Government is necessary to conduct any enquiry or investigation, wherever alleged offences are relatable to recommendation made of decision taken by public servants in discharge of their Official functions of duties. Therefore, CBI has sought necessary sanction U/s 17-A of PC Act 1988 (as amended in 2018) in respect of Shri B.M.Vijaya Shankar, Deputy Commissioner, Bangalore Urban;
Shri L.C.Nagaraj Assistant Commissioner, Bangalore North Sub Division; Shri Manjunath village Accountant, officiating at Sub Division Office, Bangalore North Division (who are under suspension), to take up investigation of this case by Central Bureau of Investigation.
And Whereas, the Chief Minister on behalf of the Government of Karnataka, being the Competent Authority to accord sanction to conduct any enquiry or investigation against the said Sri L.C.Nagaraj, K.A.S (Junior Scale) Officer, the then Assistant Commissioner, Bangalore North Sub Division, Bangalore on due exam ination of the facts and circumstances of the case, the Proposal of investigating agency vide letter at reference (2) above with regard to the said allegations, has satisfied himself that a prima-facie case has been made out against the said Sri L.C.Nagaraj, K.A.S (Junior Scale) Officer, the then Assistant Commissioner, Bangalore North Sub Division, Bangalore and that he should be enquired or investigated for the said offences and any other offences made out from the facts mentioned above. Hence the following order:
GOVERNMENT ORDER NO. DPAR 88 KEV 2019, BENGALURU, DATED: 14.10.2019
In exercise of powers conferred under Section 17 (A) (b) of Prevention of Corruption (Amendment) Act, 2018, The Governor of Karnataka, being the authority competent to remove Shri L.C.Nagaraj, K.A.S (Junior Scale) Officer, the then Assistant Commissioner, Bangalore North Sub-division (during the period Between 08.06.2018 to 05.07.2019) after being satisfied that prima facie the offences appear to have been committed by Shri L.C.Nagaraj, K.A.S (Junior Scale), the then Assistant Commissioner, Bangalore North Sub- division, Bangalore do hereby authorise Central Bureau of Investigation, ACB, (Branch) , Bangalore to conduct any enquiry or investigation into the allegations mentioned in the enclosed complaint.
