NOTIFICATION
No. 25939/S3/2004/G.Edn . Thiruvananthapuram, 17th Aprel 2007.
The following draft of the Vesting Order and Scheme which the Government of Kerala propose to issue and settle in exercise of the powers conferred by sub - section ( 1 ) of section + and sub - section (1) of section of the Charitable Endowments Act, 1890 (Central Act 6 of 1890 ) , is hereby published as required by rule 3 of the Charitable Endowments (Kerala) Rules, 1966, for information of all persons likely to be affected thereby .
Notice is hereby given that the said draft will be taken up for consideration on or after the sixtieth day from the date of publication of this notification and that any objection or suggestion which may be received from any person with respect of the said draft before the expiry of the period specified above will be consideredby the Government . Objections and suggestions if any, shall be addressed to the Secretary Government of Kerala, General Department, Govern ment Education to (8) Secretariat, Thiravananthapuram-1.
DRAFT VESTING ORDER
in exercise of the powers conferred by sub - section ( 1 ) of section of the Charitable Endowments Act , 1890 (Central Act 6 of 1890 ) , the Government ofKerals hereby order that the property specified in column (2 ) of the Schedule appended hereto belongingto the Endowment mentioned in column (1) thereof, shall be vested with the Treasurer of Charitable Endowments , Kerala and under sub- sections ( 1 ) and ( 3 ) of section 5 of the said Act , the Government of Kerala, hereby settle the following Scheme for the administration of the said property and appoint the date of publication of the final notification to be the date on which the said Scheme shall come into operation, namely:-
DRAFT SCHEME
1. The Endowment shall be called " Smt . A. Jaya Teacher Memorial Endowment " .
2. The corpus of the Endowment shall consist of Rs . 5,000 ( Rupees live thousand only) and shall be vested with the Treasurer of Charitable Endowments, Kerala .
3. The corpus of the Endowment shall be invested in any long term securities of the Govera- ment of India or of the Government of Kerala or in any of the securities approved by the Government .
4. The Principal, Government Vocational Higher Secondary School, Kottukal shall be the Administrator of the Fund.
5. The annual interest accruing on the fund shall be utilized during the succeeding year for awarding scholarship to the student of Government Vocational Higher Secondary School, Kottukal who score the highest marks in the Vocational Higher Secondary Course Examination conducted during the previous year in the first attempt .
or 6. The prize shall be awarded on the occasion of the School Day Celebration any other suitable occasion in the academic year itself as decided by the Administrator and thereafter the fact of such award with relevant particulars shall be published in the notice board of the School for information of the public .
one student 7. If, in a year, more than is found eligible for the prize by securing the same number of marks , then the amount of prize shall be equally divided among them .
8. Requisition for payment of annual interest shall be sent by the Administrator at any time not later than two months prior to the date fixed for award of the prize and the Treasurer of Charitable Endowment shall thereupon arrange to place the annual interest at the disposal of the Administrator .
9. If, in any year the interest is not utilized as provided in clause 5 above or ifthe prizes is not awarded owing to the non- availability of a suitable candidate or for any other reason or if any surplus is left after awarding the prizes, such amount shall be added on the corpus of the fund by the Treasurer of Charitable Endowments unless that payment is allowed by the Treasurer in exceptional cases on the specific recommendation of the Controlling Authority specified in clause 10 of the Scheme .
10. Ifany doubt or dispute arises regarding the meaning or interpretation of the provisions of the Scheme, it shall be referred to the Director of Public Instruction whose decision thereon shall be final .
