Dated, Thiruvananthapuram, 12th November 2007 .
8. R. O. No. 1067/2007.-In exercise of the powers conferred by sub - section ( 1 ) of section 3 and sub - section ( 1 ) of section; 5 of Kerala Abkari Workers Welfare Fund Act , 1989 (Act 19 of 1989 ) , the Government of Kerala , hereby make the following scheme further to amend the Kerala Abkari Workers Welfare Fund Scheme 1990 issued under G. O. ( P) No. 33/90 LBR dated 11th May , 1990 and published S. R. O. No. 659/90 in the Kerala Gazette dated 11th May, 1990 , namely :- as Extraordinary No. 480
SCHEME
1. Short title and Commencement . ( 1 ) This Scheme may be called the Kerala Abkari Workers Welfare Fund (Amendment) Scheme , 2007 .
(2) It shall come into force at once .
2. Amendment of the Scheme . In the Kerala Abkari Workers Welfare Fund Scheme, 1990,
(1) for sub-paragraph (3) of paragraph 26 , the substituted, namely:- following shall be "( 3 ) A worker shall file nomination in Form No. 3 at his own choice and on acquiring a family to him , his legally wedded wifeand children shall automatically become heirs eventhough no alteration is made in the nomination :
Provided that though the wife and children may become legal heirs suo molo, his father , mother or any of them if already nominated as legal heirs in his nomination shall continue to be heirs with equal right along with the wife and children . "
(2) after paragraph 29 , the following shall be inserted, namely:-

"29A . Cancellation of Identity Card.-( 1 ) Any identity card issued under paragraph 29 , if satisfied on further verification , be obtained unauthorisedly or undeservingly , the Chief Welfare Fund Inspector may cancel such identity card after giving the party concerned a reasonable opportunity for being heard .
(2) The Board shall have the power to forfeit to the Fund , the entire amount deposited to the Welfare Fund by a person who obtained membership to the scheme unauthorisedly or undeservingly without any notice.
29B Appeal against Cancellation:-If any appeal is to be preferred against the cancellation of Identity Card , it shall be filed to the Board by the person concerned within 30 days from the date of receipt of such order."

Explanatory Note
(This does not form part of the notification, but is intended to indicate its general purport. )
Inorder to dispose of the claims of legal heirs of deceased members of the Kerala Abkari Workers Welfare Fund Scheme, the Kerala Abkari Workers Welfare FundBoard has recommended to amend sub-paragraph (3 ) of para- graph 26 of Chapter 4 of the Scheme . The Board has also recommended to cancel the Identity Cards obtained unauthorisedly or undeservingly by the persons and to forfeit the entire amount deposited to the Fund by such persons. The recommendations made by the Board has been accepted by the Government and decided to make such changes in the Kerala Abkari Workers Welfare Fund Scheme .
This notification is intended to achieve the said object .

തീയതിയിലെ സർക്കാർ ഉത്തരവ് ( പി ) 33 / 90 / തൊഴിൽ നമ്പർ പ്രകാരം പുറപ്പെടുവിച്ചതും 1990 മേയ് 11 -ാം തീയതിയിലെ 480 -ാം നമ്പർ കേരള അസാധരണ ഗസറിൽ എസ് . ആർ , ഒ . നമ്പർ 659/90 ആയി (പ്രസിദ്‌ധപ്പെടു ത്തിയതുമായ 1990 - ലെ കേരള അബ്കാരി വീണ്ടും ഭേദഗതി ചെയ്യുന്നതിന് 30 かず ഉണ്ടാക്കുന്നു , അതായത്:- തൊഴിലാളി ക്ഷേമ പദ്ധതി வாழுz. (வக. പദ്ധതി 1. . ( :---- ( 1 ) 2 പദ്‌ധതിക്ക് കേരള അബ്കാരി തൊഴിലാളി ( ഭേദഗതി ) ക്ഷേമ പദ്ധതി 200- ( 2) ഇത് ഉടൻ തന്നെ പ്രാബല്യത്തിൽ വരുന്നതാണ് .
തൊഴിലാളി 2. പദ്ധതിയുടെ ഭേദഗതി . 1990 - ലെ കേരള അബ്കാരി
ക്ഷേമ പദ്ധതിയിൽ , (1 ) ഖണ്ഡിക 26 - ലെ ഉപഖണ്ഡിക ( 3 ) -ന് പകരം താഴെ പറയുന്ന ഉപഖണ്ഡിക ചേർക്കേണ്ടതാണ് , അതായത്: -
" ( 3) തൊഴിലാളി അയാളുടെ ആഗ്രഹ പ്രകാരം 3-ാം നമ്പർ ഫോറത്തിൽ നോമിനേഷൻ ഫയൽ ചെയ്യേണ്ടതു . അയാൾക്ക് ഒരു കുടുംബം ഉണ്ടാകുന്ന മുറയ്ക്ക് ഫയൽ ചെയ്ത നോമിനേഷനിൽ മേംഗതി വരുത്തിയില്ല എങ്കിൽ പോലും നിയമാനുസൃതമായുള്ള വിവാഹ ബന്ധത്തിലെ ഭാര്യയും മക്കളും സ്വമേധയാ അവകാശികളായി മാറുന്നതുമായിരിക്കും :
അച്ഛൻ , അമ്മ നാമനിർദ്ദേശം എന്നാൽ , ഇത്തരത്തിൽ ഭാര്യയും മക്കളും സ്വമേധയാ അവകാശികളായി മാറുമ്പോഴും അയാളുടെ നാമനിർദേശപത്രികയിൽ അല്ലെങ്കിൽ ഇവരിൽ ആരെങ്കിലും അവകാശികളായി ചെയ്യപ്പെട്ടിട്ടുണ്ടെങ്കിൽ അവരും ഭാര്യയ്ക്കും മക്കൾക്കും ഒപ്പം തുല്യ അവകാശം ഉള്ളവരായി തന്നെ തുടരുന്നതായിരിക്കും . ' '
( 2) ഖണ്ഡിക 29 - ന് ശേഷം 29 എ , 29 ബി എന്നീ ഖണ്ഡ‌ികകൾ താഴെ പറയും പ്രകാരം ചേർക്കേണ്ടതാണ് , അതായത് : -
29 എ . ഐഡൻറിററി കാർഡ് റദ്ദാക്കൽ .- ( 1 ) 29-ാം ഖണ്ഡിക പ്രകാരം നൽകിയിട്ടുള്ള ഏതൊരു ഐഡൻറിററി കാർഡും , തുടർ പരിശോ ധനയിൽ അനധികൃതമായോ അനർഹമായോ നമ്പാദിച്ചതാണെന്ന് ബോദ്‌ധ്യ പ്പെടുകയാണെങ്കിൽ ബന്ധ‌പ്പെട്ട കക്ഷിയുടെ 05 കേൾക്കുന്നതിന് മതിയായ അവസരം നൽകിയശേഷം അങ്ങനെയുള്ള ഐഡൻറിറ്റി കാർഡ് ചീഫ് വെൽഫയർ . ഫണ്ട " ഇൻസ്പെക്‌ടർക്ക് റദ്ദം ചെയ്യാവുന്നതാണ് .
( 2) അനധികൃതമായോ അനർഹമായോ പദ്ധതിയിൽ 3531 സ്വായത്തമാക്കിയ ഒരു വ്യക്‌തിയുടെ പേരിൽ അടവായ ക്ഷേമനിധി തുക മുഴുവൻ മറെറാരു അറിയിപ്പും ஐனை ை കണ്ടുകെട്ടുന്നതിന " ബോർഡിന് അധികാരം ഉണ്ടായിരിക്കുന്നതാണ് . ക്ഷേമനിധിയിലേക്ക് 4
29 ബി . റദ്ദാക്കലിനെതിരെയുള്ള അപ്പീൽ - ഐഡൻറററി കാർഡ റദലാക്കിയതിനെതിരായിട്ടുള്ള അപ്പീൽ എന്തെങ്കിലുമുണ്ടെങ്കിൽ പ്രസ്തുത വ്യക്ത‌ി ആയത് ഉത്താവ് കിട്ടി 30 ദിവസത്തിനുള്ളിൽ മുമ്പാകെ സമർപ്പിക്കേണ്ടതാണ്. ബോർഡ്

മരണപ്പെട്ട കേരള അബ്കാരി തൊഴിലാളി ക്ഷേമ പദ്ധതിയിലെ അംഗങ്ങളുടെ പിന്തുടർച്ച അവകാശികളുടെ അവകാശവാദങ്ങളിൽ തീർപ്പു കൽപ്പിക്കുന്നതിനുവേണ്ടി പ്രസ്തുത പദ്ധതിയിലെ അദ്ധ്യായം 4-00 ഖണ്ഡിക 26 - ലെ ഉപഖണ്ഡിക 3 ഭേദഗതി ചെയ്യുവാൻ കേരള അബ്കാരി തൊഴിലാളി ക്ഷേമനിധി ബോർഡ് ശുപാർശ ചെയ്തു . കൂടാതെ അനധികൃതമായോ അനർഹമായോ സമ്പാദിച്ച ഐഡൻറിററി കാർഡുകൾ റദ്ദാക്കാനും പ്രസ്തുത വ്യക്‌തിയുടെ പേരിൽ തുക മുഴുവൻ ക്ഷേമനിധിയിലേക്ക് കണ്ടുകെട്ടുന്നതിനും ശുപാർശ ചെയ്തു . ബോർഡിൻെറ ശുപാർശ സർക്കാർ ക്കുകയും പ്രസ്തുത മാറ്റങ്ങൾ കേരള അബ്കാരി തൊഴിലാളി പദ്ധതിയിൽ വരുത്തുവാൻ തീരുമാനിക്കുകയും ചെയ്തു . ക്ഷേമനിധി ബോർഡ് അംഗീകരി ഈ ഉദ്ദേശം നിറവേറ്റാനുള്ളതാണ് ഈ വിജ്ഞാപനം .
