ORDER
G. O. (Rt. ) No. 300/2008/LBR . Thiruvananthaparam, 11th February 2008 .
an Whereas, the Government are of opinion that industrial dispute exists between ( 1 ) The Managing Director, K. S. R. T. C. , Transport Bhavan, Fort , Thiruvananthapuram (2) The Assistant Transport Officer , K. S. R. T. C. , Angamaly and the workman of the above referred establishment Sri V. Somasekharan, Soubhagya , U. C. College P. O. , Aluva in respect of matters mentioned in the annexure to this order ;
Andwhereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;
Now, therefore , in exercise of the powers conferred by section 10 ( 1 ) (c) of the Industrial Disputes Act of 1947 ( Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Labour Court, Ernakulam. The Labour Court will pass the award within a period of three months.
ANNEXURE
Whether the dismissal of Shri V. Somasekharan Conductor, K. S. R. T. C. , Angamaly Depot by the Management is justifiable ? If not what relief he is entitled to ?

Whereas, the Government are of opinion that an industrial dispute exists between ( 1 ) The Secretary, Kerala State Electricity Board , Vydyuthi Bhavan, Pattom, Thiruvananthapuram, ( 2) The Executive K. S. E. B. , Civil Division , Vydyuthi Bhavan, Thrissur- 4 and (3 ) The Assistant Executive Engineer, K. S. E. B. , Civil Division , Vydyuthi Bhavan, Thrissur -4 and the workman of the above referred establishment represented by the Jilla Secretary, Kerala State Electricity Workers Union , Reg. No. 43/56 , P. O. Thalakkottukara , Kerehery (via.), Thrissur District in respect of matters mentioned in the annexure to this order ;
And whereas , in the opinion of Government it is necessary to refer the said industrial dispute for adjudication ;
Now, therefore, in exercise of the powers conferred by section 10 ( 1 ) (d ) of the Industrial Disputes Act of 1947 ( Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Industrial Tribunal , Palakkad. The Industrial Tribunal will pass the award within a period of three months .
ANNEXURE
"Whether the Management of K. S. E. B. , Civil Station, Vydyuthi Bhavan , Thrissur -4 has denied employment to Sri P. K. Sivaraman , Driver ? Ifso, what are the benefits he is entitled to ? "
