Labour and Rehabilitation Department Labour and Rehabilitation (A)
ORDERS

G.O. (Rt. ) No. 297/2008/ LBR . Thiruvananthapuram, 8th February 2008 .
Whereas , the Government are of opinion that an industrial dispute exists between ( 1) The General Manager, Jet Air Private Limited, 41/42, Market Chambers, Nariman Point, Mumbai (2) The General Manager, Saran Chambers , Diamond Hills, Vellayambalam , Thiruvananthapuram and the workmen of the above referred establishment (1) Shri T. P. Chandra Babu , Executive Member , JetAir Group of Companies Employees Union, 202, Church Gate Chambers 5, New Marine Lines, Mumbai-900 020 [T. C. 48/141 (6) , House No. 100, U. P. S. Lane, Ambalathara , Poonthura P. O., Thiruvananthapuram] in respect of matters mentioned in the annexure to this order;
And whereas , in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;
Now, therefore, in exercise of the powers conferred by section 10 ( 1 ) ( c) of the Industrial Disputes Act of 1947 ( Central Act XIV of 1947) , the Government hereby direct that the said industrial dispute be referred for adjudication to the Labour Court, Kollam. The Labour Court will pass the award within a period of three months .
ANNEXURE
Whether the transfer of employees to other States after accepting the scheme of internal source of recruitment is justifiable ? If not what are the reliefs entitled to them?

Whereas, the Government are of opinion that an industrial dispute exists between (1) The Manager, Teekoy Estate, Teekoy P. O. , Kottayam ( 2) The Managing Director, Joseph Thomas (Appachan), Kottukappally, Teekoy Rubbers India Limited, Pala, Teckoy and the workmen of the above referred establishment represented by the Secretary, Teekoy Estate Workers Union K.T.U.C. (M ) , Teokoy P.O. , Kottayam in respect of matters mentioned in the annexure to thisorder;
And whereas , in the opinion of Government it is necessary to refer the said industrial dispute for adjudication ;
Now, therefore , in exercise of the powers conferred by section 1010 ( 1) (d) of the Industrial Disputes Act of 1947 ( Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Industrial Tribunal, Idukki . The Industrial Tribunal will pass the award within a period of three months .
