removal of in 1966 MW this Division as It is hereby notified for the information of the public that the right of collection and standing Elavu and Vatta trees in Block No. 1A, 1B and 1C Plantation, Chittar in Thulumala section of Kallar Range (80.170ha . ) of specified in the schedule will be sold in tender- cum - auction by the Divisional Forest Officer, Achencovil or any other officers authorized by him on 11-11-2008 at 3 p.m. in the Divisional Forest Office , Achencovil , subject to the terms and conditions of sale of timber in Government Timber Depots published in Government Gazette No. 26 dated 24-6-2008 , Page No. 253 to 259 of Forest Sheet as per Pro . (5) -2613/2008 dated 12-6-2008 of the Chief Conservator of Forests (P) , Thiruvananthapuram and as per general conditions of the sale of tree growth prevailing in the department . In case the notified date happens to be a public holiday, the Tender/ Sale will be conducted on the next working day at the notified place and time .
CONDITIONS
1. The auction will be on lumpsum basis for the right of collection and removal of entire Elavu , and Vatta tree growth from the above plantations/blocks mentioned in the schedule hereto the which has been surveyed and demarcated on the ground . area of 2. Intending Tenderers /Bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before participating in the Tender /Auction . Complaints if any regarding quality and quantity etc. received after the Tender /Auction will not be entertained .
3. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unjess valid power of attorncy is produced prior to commencement of Auction/Tender .
4. A Supply contractor of Achencovil Division or the adjacent divisions will not be allowed to bid in the Auction/Tender .
5. Intending Tenderers/Bidders should produce a certificate from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.
6. The successíuí Tenderers /Bidders should give an undertaking that he is not related to any officer having control of the work and that he is not supply contractor of this or any adjacent divisions . If this is proved otherwise it shall result in cancellation of the contract and resale of the coupe at his risk and loss .
7. No petition or post offer received after 7 days of the conduct of the tender/ auction sale and post offer which is not advantageous by more than 10 % of the original offer where the bid amount is Rs . One lakh and above and more than 20 % where the original bid amount is less than considered . The post offerer will comply with following terms . lakh will ordinarily be one
(a) Offer should be made within 7 days of Tender/Auction failing which the offer will not be considered.
(b) Offerer should remit double the amount paid by the successful Tenderers /Bidders on the Tender/ Auction date .
(c) The remittance should be made by the chalan or bank deposit and the Bank receipt should be produced before the Divisional Forest Officer concerned within 7 days from the date of receipt of registered notice to that effect .

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned , pledging the security deposit for the due fulfillment of the above terms .
If the post offerer satisfied the conditions , a re- auction of the right will be conducted after giving the usual publicity as per rules . In the re -auction , the price fetched , if does not comes up to what has been offered by the post offerer , it will be awarded to the post offerer at the amount offered by him. If he backs out the security amount remitted by him will be forfeited to Government. If however , the bid amount is above what has been offered by the post offerer , the right will be awarded to the highest Bidder /Tenderer in the re- auction and the amount remitted by the post offerer willbe released to him .
8. The contractor shall at all time during the currency of the contract , keep the coupe boundaries cleared to a width of 2 metres and keep the cairns intact.
9. Further particulars can be had either from the Office of the Divisional Forest Officer or from the Range Officer concerned .
10. If the value fetched in the resale /re - tender is less than that obtained in the original Tender/ Sale the difference between them together with all incidental expenditure to fixing up of the resale including notifica- tion charges as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/ Bidders through legal means including Revenue Recovery Act inforce .
11. Intending Tenderers /Bidders should deposit an Earnest Money Deposit of Rs . 10,000 (Rupees Ten thousand only) for each coupe for participating in the Tender /Auction.
12. The successful Tenderers /Bidders have to remit 35% sale value on the Tender/Auction date .
13. The successful Tenderers /Bidders have to pay VAT, FDT , income tax etc. at the rate prevailing from time to time .
14. The successful Tenderers / Bidders should execute a bounded agreement on a stamp paper worth Rs . 50 after the completion of the Tender/Auction .
15. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as carly as possible . Within 15 days from the date of intimation of the confirmation, the successful Tenderers /Bidders shall remit of 1/3 of the balance sale value and 5% Forest Development Tax, VAT and Income Taxat the rates inforce and security deposit of 10 % for the total sale value. The successful Tenderers /Bidders should execute an agreement on a stamp paper worth Rs . 50. In case of failure to remit the amount within 15 days extension shall be granted by thethe Divisional Forest Officer for 15 days subject to the realization of 12 % penal interest. Further extension for 15 days shall be granted by the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the amount within the extended period further extension for 15 days by the Conservator of Forests and 15 days by the Chief Conservator of Forests shall be granted subject to the realization of penal interest at 24 % and 48 % respectively. But all the extension periods mentioned above will be within the original contract period.
16. The balance sale value should be remitted in two equal instalments by the successful Tenderers/ Bidders . The first instalment should be remitted within 15 days from the date of agreement and the second instalment within 30 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers /Bidders fails to remit the above amount within the period mentioned above , extension for 15 days by realizing penal interest at 12 % by Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24 %by the Conservator of Forests concerned and further extension for 30 days by the ChiefConservator of Forests concerned by realizing penal interest at 30 % shall be granted respectively . But all the above extended periods will be within the original contract period .
17. The period of contract will be 60 days from the date of intimation of confirmation. No extension of period of contract shall be granted on ordinary ground . Under very special circumstances , for good and sufficient reasons , the Divisional Forest Officer and the Conservator of Forest concerned may grant extension of time for one month and two months respectively on realization of penalty or penalties for completion of each work for each mouth mentioned below :
(a) For enumerated trees and balance unfelled per hectare or fraction thereof Rs . 75 per hectare .
(b ) Unremoved registered logs and unregistered logs-Rs . 2/M³ or fraction thereof.
(c) Unremoved firewood- Re . 1 /Tonne or fraction thereof.
Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during the original contract period . The penalty for the first month shallbe realized as the above rates ; double the rate for the second month and three times of the original rate for the third month shall be realized .
If the Tenderers /Bidders fails to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenders as per the agreement will be forfeited to Government and the tenderers /bidders have not any right on the produce confiscated to Government. In the above circumstances the balance work to be executed by the tenderer shallbe completed departmently and all the loss sustained to Government in this regard shall be realized from the Tenderers /Bidders .

1. ടെണ്ടർ ലേലം ഒരു നിശ്ചിത തുകയുടെ അടിസ്ഥാനത്തിലാണ് നിശ്ചയിച്ചിരിക്കുന്നത് . ഇതിലേക്കായി സർവ്വെ ചെയ്ത് തിരിച്ചിട്ടുള്ള പ്രസ്പ്രസ്തുത ബ്ലോക്കുകളിലെ നിൽപ്പ് ഇലവ് , വട്ട സംബന്ധിച്ച ജോലിക്കുവേണ്ടിയാണ് ഇത് തീരുമാനിച്ചിരിക്കുന്നത് .* മരങ്ങളുടെ നീക്കം ചെയ്യൽ 2. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദദേശിക്കഉദ്ദേശിക്കുന്നവർ ലേലത്തിനുമുൻപായി ഉൽപ്പന്നങ്ങളുടെ നൽപ്പ് നിൽപ്പുകണ്ട് ബോദ്ധ്യപ്പെടേണ്ടതുംകണ്ട് ബോദ്‌ധ്യപ്പെടേണ്ടതും അവ സംബന്ധിച്ച യാതൊരു പരാതികളും ലേലത്തിനുശേഷം പരിഗണിക്കുന്നതുമല്ല .
3. ദർഘാസുകാരൻ / ലേലക്കാരൻ നേരിട്ട് ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കേണ്ടതാണ് . നിയമപരമായ പവർ ഓഫ് അറോർണി ഇല്ലാത്ത പകരക്കാരെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല .

6. വിജയിക്കുന്ന ദർഘാസുകാരന്/ ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ ആഫീസുമായോ ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസ് /ലേല ദിവസം ദർഘാസുകാരൻ /ലേലക്കാരൻ ഈ ആഫീസിൽ സമർപ്പിക്കേണ്ടതാണ് . ഇത്തരത്തിൽ ദർഘാസുകാരൻ ലേലക്കാരൻ ബന്ധപ്പെട്ട ആഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധമുണ്ടെന്ന് പിന്നീട് തെളിയിക്ക പ്പെട്ടാൽ ടിയാൻറ പേരിലുള്ള ദർഘാസ്/ലേലം റദ്ദു ചെയ്ത് ടിയാൻറ നഷ്ടോത്തരവാദിത്വത്തിൽ รา കൂപ്പുകൾ പുനർലേലം ചെയ്യുന്നതാണ് .
7. ദർഘാസ്/ ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്ററ് ഓഫറുകളോ മറേറതെങ്കിലും തരത്തിലുളള പരാതികളോ പരിഗണിക്കുന്നതല്ല . ഒരു ലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസ്സുകളിൽ ലേലത്തുകയുടെ 10 ശതമാനത്തിൽ കുറയാത്ത പോസ്ററ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസ്‌സുകളിൽപ്പെട്ട ലേലങ്ങൾക്ക് 20 ശതമാനത്തിൽ കുറയാത്ത പോസ്ററ് ഓഫറുകളും മാത്രമേ പരിഗണിക്കു കയുളളൂ . കൂടാതെ താഴെ പറയുന്ന നിബന്ധനകളും പോസ്ററ് ഓഫറുകൾക്ക് ബാധകമാണ് .

(3 ) ബന്ധപ്പെട്ട പോസ്ററ് ഓഫർ തുകയും മറ്റു നികുതികളും ചെലാൻ മുഖാന്തിരമോ ബാങ്ക് രസീത് വഴിയോ ഈ ആഫീസിൽനിന്നും രജിസ്‌റേറർഡ് ' തപാൽ മുഖേന് അറിയിച്ച് ഏഴ ദിവസത്തിനുള്ളിൽ ഒടുക്കി ഈ ആഫീസിൽ ഹാജരാക്കേണ്ടതാണ് . പോസ്ററ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ കൂപ്പുകളുടെയും അതിലെ നിൽപ്പുമരങ്ങളുടെയും ഗുണനിലവാരവും മറ്റ് ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ടശേഷം നിശ്ചിത മുദ്രപ്പത്രത്തിൽ ഉടമ്പടി വയ്ക്കേണ്ടതാണ് .

10. മുകളിലെ വ്യവസ്ഥപ്രകാരം നീട്ടിക്കൊടുത്ത കാലാവധിക്കുള്ളിലും തുക ഒടുക്കി എഗ്രിമെൻറ് വയ്ക്കുന്നതിന് വീഴ്ച വരുത്തിയാൽ ലേല/ഭർഘാസുകാരൻ ഒടുക്കിയിട്ടുള്ള എല്ലാ തുകയും സർക്കാരി ലേക്ക് കണ്ടുകെട്ടി ലേലം റദ്ദു ചെയ്യുന്നതും ലേല ദർഘാസുകാരൻറെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പ് പുനർലേലം ചെയ്യുന്നതുമാണ് . പുനർലേലം ചെയ്യുമ്പോൾം ചെയ്യുമ്പോൾ ഉണ്ടാകുകയാണെങ്കിൽ ആയതിന് ലേല ക്കാരന് യാതൊരുവിധ അവകാശവും ഉണ്ടായിരിക്കുന്നതല്ല . പുനർലേലത്തിലുണ്ടാകുന്ന എല്ലാ നഷ്ടങ്ങളും വീഴ്ചക്കാരനിൽ നിന്നും ഈടാക്കുന്നതാണ് .
11. ദർഘാസ്/ലേലത്തിൽ പങ്കുചേരണമെന്നാഗ്രഹിക്കുന്നവർ 10,000 ( പതിനായിരം ) രൂപ നിരതദ്രവ്യം ഓരോ കൂപ്പിനും / ബ്ലോക്കിനും കെട്ടിവയ്ക്കേണ്ടതാണ് .
കൊളളുന്ന 12. കൂടുതൽ തുകയ്ക്ക് ദർഘാസ്ലേലം ലേലത്തുകയുടെ 35 % തുക ലേലം കഴിഞ്ഞാലുടൻ ഒടുക്കേണ്ടതാണ് . ടി തുക ഒടുക്കുന്നതിന് വീഴ്ച വരുത്തിയാൽ ടിയാൻ ഒടുക്കിയിട്ടുള നിരതദ്രവ്യം സർക്കാരിലേക്ക് കണ്ടുകെട്ടുന്നതും ടി കൂപ്പ് ടിയാൻറെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതുമായിരിക്കും .
13. ദർഘാസ്/ ലേലം" ലേലം കൊളളുന്നകൊളളും ആൾക്ക് പ്രസ്തുത കൂപ്പിൽ എന്യൂമറേറ്റ് ചെയ്തു നിർത്തിയിരിക്കുന്ന ഇലവ്, വട്ട മരങ്ങൾക്കു മാത്രം അവകാശമുള്ളതും തേക്ക് , ഈട്ടി മറ്റ് മരങ്ങൾ മുതലായവയ്ക്ക് അവകാശമില്ലാത്ത തുമാകുന്നു .
14. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലംകൊളളുന്ന ആൾ 50 രൂപ മുദ്രപ്പത്ര ത്തിൽ ഒരു ബൗണ്ടൻ ഉടമ്പടികൂടി ലേലം കഴിഞ്ഞാലുടൻ ഒപ്പുവയ്ക്കേണ്ടതാണ് .
15. ദർഘാസ്/ലേലം സ്‌ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുടെ മൂന്നിൽ ഒന്നും മൊത്തം തുകയുടെ 5 % ഫോറസ്ററ് ഡവലപ്പ്മെൻറ് ടാക്സും നിലവിലുള്ള നിരക്കിൽ വിൽപ്പന നികുതി , ഇൻകം ടാക്സ് എന്നിവകളും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10 % സെക്യൂരിററി ഡെപ്പോസിററും വച്ച് 50 രൂപ മുദ്രപ്പത്രത്തിൽ ഉടമ്പടി വയ്ക്കേണ്ടതുമാണ് . 15 ദിവസത്തിനുള്ളിൽ ടി തുകകൾ ഒടുക്കാതിരുന്നാൽ 12 % പലിശയോടുകൂടി തുകകൾ ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയവും 24% പലിശയോടുകൂടി വീണ്ടും 15 ദിവസത്തെ സമയവും യുക്‌തംപോലെ അച്ഛൻകോവിൽ ഡിവിഷണൽ 392

[PART III ഫോറസ്ററാഫീസർ അനുവദിക്കുന്നതാണ് . ഈ കാലാവധിക്കുള്ളിലും തുക ഒടുക്കാതെവന്നാൽ കൊല്ലം ഫോറസ്ററ് കൺസർവേറ്ററുടെ യുക്ത‌തംപോലെ 24 % പലിശ നിരക്കിൽ 15 ദിവസത്തേയും വീണ്ടും 48% പലിശ നിരക്കിൽ ചീഫ് ഫോറസ്ററ് കൺസർവേറ്ററുടെ യുക്‌തംപോലെ സമയം അനുവദിക്കാവുന്നതാണ് . എന്നാൽ മുകളിൽ പറഞ്ഞ കാലാവധികളെല്ലാം കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും .
16. ബാക്കി മൂന്നിൽൗണ്ട് ലേലത്തുക രണ്ടു തുല്യ ഗഡുക്കളായി ഒടുക്കേണ്ടതാണ് . ആദ്യഗഡു കരാർ തീയതി മുതൽ 15 ദിവസത്തിനകവും രണ്ടാം ഗഡു കരാർ തീയതി മുതൽ ഒരു മാസത്തിനകമോ കാലാവധിക്കകമോ ഏതാണോ ആദ്യം ആ കാലാവധിക്കുള്ളിലും ഒടുക്കേണ്ടതാണ് . ടി കാലാവധിക്കുള്ളിൽ പണം ഒടുക്കുവാൻ കഴിയാതെ വന്നാൽ 12 % പലിശ നിരക്കിൽ ഡിവിഷണൽ ഫോറസ്ററാഫീസർക്ക് 15 ദിവസത്തേയും 24% പലിശ നിരക്കിൽ കൊല്ലം ഫോറസ്ററ് കൺസർവോററുടെ യുക്ത‌തം പോലെ 30 ദിവസത്തേക്കും വീണ്ടും 30 ദിവസത്തേക്ക് 30 % പലിശ നിർക്കിൽ ചീഫ് ഫോറസ്ററ് കൺസർവേറററുടെ യുക്‌തം പോലെയും കാലാവധി നീട്ടിക്കൊടുക്കാവുന്നതാണ് . എന്നാൽ നീട്ടിക്കൊടുക്കുന്ന കാലാവധികളെല്ലാം തന്നെ കരാർ കാലാവധിക്കുളളിൽ ആയിരിക്കും .
17. ലേല ദർഘാസുകാരൻ ബാക്കി തുക മുതലായവ നീട്ടിക്കൊടുത്ത കാലാവധിക്കുള്ളിലും ഒടുക്കാതിരുന്നാൽ ഉടമ്പടി റദ്ദു ചെയ്ത് ടിയാൻ അടച്ചിട്ടുള്ള മുഴുവൻ തുകകളും സർക്കാരിലേക്ക് കണ്ടുകെട്ടി ടിയാൻറെ നഷ്ടോ ത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതാണ് . പുനർലേലത്തിൽ ലാഭം ഉണ്ടാകുകയാണെങ്കിൽ വീഴ്ചക്കാരന് യാതൊരു അവകാശവും ഉണ്ടായിരിക്കുന്നതല്ല .
18. ഉടമ്പടി കാലാവധി ലേലം സ്‌ഥിരപ്പെടുത്തിയ തീയതി മുതൽ 60 ദിവസമാണ് . സാധാരണഗതിയിൽ കുപ്പിൻറെ കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല . എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും അച്ഛൻകോവിൽ ഡിവിഷണൽ ഫോറസ്ററാഫീസർ , കൊല്ലം ഫോറസ്ററ് കൺസർവേറ്റർ എന്നിവർ യഥാക്രമം ഒന്നും രണ്ടും മാസം വീതം താഴെ പറയും പ്രകാരം കാലാവധി നീട്ടിക്കൊടുക്കുന്നതാണ് . പിഴ ഈടാക്കിക്കൊണ്ട് ഓരോ ജോലിക്കും ( i) എന്യൂമറേറ്റ് ചെയ്തതും മുറിക്കാനുള്ളതുമായ മരങ്ങൾക്ക് ഓരോ ഹെക്‌ടറിനും അതിന്റെ ഭാഗത്തിനും 75 രൂപ വീതം .
(ii) നീക്കം ചെയ്യാത്ത രജിസ്ററർ ചെയ്തതും അല്ലാത്തതുമായ തടികൾക്ക് ഓരോ ക്യൂ . മീറററിനും അതിൻറ ഭാഗത്തിനും 2 രൂപ വീതം .
(iii) നീക്കം ചെയ്യാത്ത വിറകിന് ഓരോ ടണ്ണിനും അതിൻറ ഭാഗത്തിനും 1 രൂപ വീതം .
ഒന്നാമത്തെ മാസത്തേക്ക് ടി നിരക്കിലും 2-ാം മാസത്തേക്ക് ഇതിൻെറ ഇരട്ടിയും 3 -ാം മാസത്തേക്ക് ഒന്നാം മാസത്തെ നിരക്കിൻറെ മൂന്നിരട്ടിയും എന്ന ക്രമത്തിൽ പിഴ ഈടാക്കുന്നതാണ് . ഇപ്രകാരം നീട്ടി നൽകുന്ന തീയതിക്കുള്ളിലും നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും കണ്ടുകെട്ടി ഗവൺമെൻറിലേക്ക് മുതൽ കൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉണ്ടാകുന്നതുമല്ല . ഉടമ്പടിക്കാരൻ ചെയ്തു തീർക്കുവാനുള്ള ജോലികൾ ഡിപ്പാർട്ടുമെൻറ് ചെയ്യിക്കുന്നതിനും ആയതിൽ വച്ചുണ്ടാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടിക്കാരനിൽനിന്നും ഈടാക്കുന്നതുമായിരിക്കും .
19. കൂപ്പിൽ ശേഖരിച്ച് വയ്ക്കുവയ്ക്കുന്ന ഇലവ് ,ലവ് , വട്ട , തടികളും വിാകും നിലവിലുളള നിയമങ്ങൾക്ക് വിധേയ മായിട്ടായിരിക്കും നീക്കം ചെയ്യാനുള്ള ലൈസൻസ് നൽകുന്നത് .
20. അച്ചൻകോവിൽ ഡിവിഷണൽഫോറസ്ററാഫീസറുടെയോ കല്ലാർ റെയിഞ്ചാഫീസറുടെയോ രേഖാമൂലമുളള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ കൂപ്പിൽ പ്രവേശിക്കുവാൻ പാടുള്ളൂ .
21. യാതൊരു കാരണവശാലും പ്ലാൻറഷനിലെയോ റിസർവിലെയോ BOO കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്തുവാൻ പാടില്ല . ഉത്തരവാദിയാകുന്നതാണ് . ഉണ്ടാകുന്ന മരങ്ങൾക്കും തടികൾക്കും നഷ്ടത്തിന് കരാറുകാരൻ 22. കൂപ്പിനുപുറത്ത് ഫോറസ്ററ് സ്ഥലത്തും തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടിക്കാരൻറെ ഉത്തരവാദിത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്ററാഫീസർ അവിചാരിതമായ കാരണങ്ങളാലോ മോശമായ അനുവദിക്കുന്നതാണ് . എന്നാൽ കാലാവസ്ഥമൂലമോ ഉടമ്പടി കാലാവധിക്കുള്ളിൽ ഇവ നീക്കം ചെയ്തുകൊണ്ടുപോകാൻ കഴിയാതെവന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്‌ടറിന് 250 രൂപ നിരക്കിൽ ഉടമ്പടി ക്കാരനിൽനിന്നും ഈടാക്കുന്നതായിരിക്കും .
23. കൂപ്പിന് 0.4 കി . മീററർ (2 ഫർലോംഗ്) ചുററളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ അനധികൃത കുററകൃത്യങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ് . അനധികൃത കുററങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ വിവരം ഉടമ്പടിക്കാരൻ അറിയിക്കേണ്ടതാണ് . ഇതിൽ വീഴ്ചവരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടാവുന്നതാണ് . ഉദ്യോഗസ്ഥരെ
24. കരാറുകാരൻറെ സെക്യൂരിററി തുക കാലാവധിക്കുശേഷം കരാറുകാരൻ സെയിൽസ് ടാക്സ് , " , അഗ്രികൾച്ചറൽ ഇൻകംടാക്സ‌സ് ഇവയുടെ ക്ലിയറൻസ് സർട്ടിഫിക്കററ് ഹാജരാക്കുന്ന മുറയ്ക്ക് ", നൽകുന്നതാണ് . എന്നാൽ ടി ഇനത്തിൽ ഗവൺമെൻറിലേക്ക് ബാധ്യതകൾ തൃകയിൽനിന്നും ഈടാക്കുന്നതാണ് . തിരിച്ചു വല്ലതുമുണ്ടെങ്കിൽ സെക്യൂരിററ് 25. ഈ ദർഘാസ്‌ലേലത്തിലെ വകുപ്പുകൾ പ്രകാരം ഗവൺമെൻറിലേക്ക് കിട്ടേണ്ടതായ ഏതൊരു തുകയും ഡിപ്പാർട്ടുമെൻറിൽ നിന്നും ആവശ്യപ്പെടുന്ന സമയത്ത് ദർഘാസുകാരൻ ലേലക്കാരൻ അടയ്ക്കാൻ വീഴ്ച വരുത്തുന്ന പക്ഷം പ്രസ്തുത തുക ഭൂനികുതി കുടിശ്‌ശികയാ പരിഗണിച്ച് നിലവിലുള്ള നിയമപ്രകാരം ഈടാക്കുന്ന താണ് . ഡിവിഷണൽ ഫോറസ്ററാഫീസർക്ക് യുക്തമെന്ന് തോന്നുന്ന മറ്റ് മാർഗ്ഗങ്ങളിൽ കൂടിയും ഈ തുക ഈടാക്കുവാൻ നടപടികൾ സ്വീകരിക്കുന്നതാണ് .
