In view of the urgency of the case, the Commissionerate of Land Revenue under sub -section (4) of section 17 of the said Act has directed that the provisions of section 5A of the Act shall not apply to thiscase.

കേരള സർക്കാരിൻറെ 16-1-1987-ാം തീയതിയിലെ നമ്പർ വിജ്‌ഞാപന 1.6. ( ) 16/ 87-5. പ്രകാരം 1894 ലെ സ്ഥലമെടുപ്പ് ആക്‌ട് ( 1894 ലെ 1-ാം കേന്ദ്ര ആക്‌ട്) അനുസരിച്ച് ഒരു കളക്‌ടറുടെ ചുമതലകൾ നിർവ്വഹിക്കുന്നതിന് കാസറകോഡ് ലാൻറ് അക്വിസിഷൻ സ്പെഷ്യൽ തഹശീൽദാരെ നിയമിച്ചിരിക്കുന്നതിനാലും ,
ഇതോടൊപ്പമുള്ള പട്ടികയിൽ വിവരിച്ചിരിക്കുന്ന ഭൂമി ഒരു പൊതു ആവശ്യത്തിനായി അതായത് സുനാമി ബാധിതരുടെ പുനരധിവാസത്തിന് ആവശ്യ മുണ്ടെന്നോ ആവശ്യമുണ്ടായേക്കാമെന്നോ പ്രസ്തുത കളക്ടർക്ക ബോദ്ധ്യപ്പെട്ടിരിക്കുന്നതിനാലും ;
ഇതിനാൽ തൻമൂലം ഇതുമായി ബന്ധപ്പെട്ട എല്ലം വ്യക്തികൾക്കും 1894 - ലെ സ്ഥലമെടുപ്പ് ആക്‌ട് ( 1894 -ലെ 1-ാം കേന്ദ്ര ആക്‌ട് , 4-ാം വകുപ്പിലെ ( 1 )200 ഉപവകുപ്പിലെ വ്യവസ്ഥകൾക്കനുസൃതമായി ഇക്കാര്യ ത്തിലുളള അറിയിപ്പ് ഇതിനാൽ നൽകുകയും ചെയ്യുന്നു .

ഇക്കാര്യത്തിലുള്ള അടിയന്തിര സ്വഭാവം കണക്കി ലെടുത്ത് ലാൻഡ് റവന്യൂ കമ്മീഷണർ മേൽപ്പറഞ്ഞ ആക്‌ട ' 17-ാം വകുപ്പ് ( 4 )-ാം ഉപവകുപ്പിന് വിധേയ മായി ആക്‌ടിലെ 5 ( എ ) വകുപ്പിലെ വ്യവസ്ഥകൾ ഇക്കാര്യത്തിൽ ബാധകമാക്കേണ്ടതില്ലെന്ന് നിർദ് ദേശി

Whereas the Government of Kerala have in notification No. G.O. ( Ms) 16/87 dated 16-1-1987 , Law appointed the Special Tahsildar ( LA) , Kasaragod to perform the functions of a Collector under the Land Acquisition Act , 1894 ( Central Act 1 of 1894).

And whereas it appears to said Collector that the land specified in the schedule below is needed or is likely to be needed for a public purpose , to witfor the rehabilitation of the Tsunami victims .
