Whether the dismissał of Shri R. Vijayakumar C. R. No. 407 by the management of Penshurust Estate ofM/ s . Malankara Plantations Limited is justifiable ? If not , what are the reliefs he is entitled ?

Whereas, the Government are of opinion that an industrial dispute exists between The Manager , M/ s . Malankara Plantations , Penshurust Estate , Fairfield Post, Elappara , Peermade, Idukki District and the workmen of the above referred establishment Shri R. Vijayakumar , Worker, C. R. No. 407, Penshurust Estate, Fairfield Post , Elappara , Idukki District in respect of matters mentioned in the annexure to this order;
Whereas, the Government are of opinion that an industrialial dispute exists between the President/ Secretary, Devi Vilasam Yogam, Panachayam Devi Kshethram Bharana Samithi , Panachayam, Nedungapra P. O. - 683 545 and the workmen of the above referred establishment Shri Santhosh, T.K. , Thekkumcheri Marath (H) , Asamannoor Р.О. , Nooleli-683 549 in respect of matters mentioned in the annexure to this order ;
And whereas , in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;
And whereas , in the opinion of Government it is necessary to refer the said industrial dispute for adjudication ;
Now, therefore , in exercise of the powers conferred by section 10 (1 ) (d) of the Industrial Disputes Act of 1947 ( Central Act XIV of 1947) the Government hereby direct that the said industrial. dispute be referred for adjudication to the Industrial Tribunal, Idukki . The Industrial Tribunal will pass the award within a period of three months .
Now, therefore, in exercise of the powers conferred by section 10 (1 ) (c) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Labour Court, Ernakulam. The Labour Court will pass the award within a period of three months.
