തിരുവനന്തപുരം ഡിവിഷനിൽപ്പെട്ടതും താഴെ പട്ടികയിൽ വിവരിക്കുന്നതുമായ റെയിഞ്ചുകളിലെ കശുമാവ് തോട്ടങ്ങളിൽ നിന്നും 30-6-2009 വരെ കശുവ≠ി ശേഖരിച്ച് നീക്കം ചെയ്യുന്നതിനുള്ള അവകാശം നിലവിലുള്ള ദർഘാസ്/ലേല വ്യവസ്ഥകൾക്ക് വിധേയമായി താഴെ പറയുന്ന സ്ഥലത്തും സമയത്തും തിരുവനന്തപുരം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റുദ്യോഗസ്ഥരോ പരസ്യമായി ദർഘാസ്/ലേല വ്യവസ്ഥയിൽ വിൽക്കുന്നതാണ്. ദർഘാസ് ഫോറങ്ങൾ തിരുവനന്തപുരം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽ നിന്നും ലഭിക്കുന്നതായിരിക്കും. ലേലത്തീയതിക്ക് തലേദിവസം ഉച്ചയ്ക്ക് 3 മണിവരെ സീൽ ചെയ്ത കവറുകളിൽ ദർഘാസ് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽ സ്വീകരിക്കുന്നതാണ്. നി›ിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ദർഘാസുകൾ സ്വീകരിക്കുന്നതല്ല. തോട്ടത്തിന്റെ പേര്, വാഗ്ദാനം ചെയ്ത വില എന്നിവ ദർഘാസിൽ വ്യ‡മായി രേഖപ്പെടുത്തേ≠താണ്. ലേലദിവസം പൊതു അവധിയായി പ്രഖ്യാപിക്കുന്നപക്ഷം അടുത്ത പ്രവൃത്തി ദിവസം നി›ിത സ്ഥലത്തും സമയത്തും ലേലം നടത്തുന്നതാണ്. ആദ്യ ലേലദിവസം എന്തെങ്കിലും Gaz. No. 3/2009/DTP (Forest).

കാരണത്താൽ ഏതെങ്കിലും തോട്ടത്തിന്റെ ലേലം നടക്കാതിരിക്കുകയോ ലേലംവിളി കൊള്ളാൻ ആരും തയ്യാറാകാതെ വരികയോ ലേലം റദ്ദാക്കുകയോ അഥവാ പുതിയ തോട്ടങ്ങൾ ഉൾക്കൊള്ളിക്കേ≠ിവരികയോ ചെയ്താൽ അപ്രകാരമുള്ള തോട്ടങ്ങൾ താഴെ പ്രസിദ്ധീകരിച്ചിട്ടുള്ള അടുത്ത ലേലദിവസങ്ങളിൽ അതേ സമയത്ത് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽ വച്ച് ലേലം ചെയ്ത് വിൽക്കുന്നതാണ്. ലേലം കഴിഞ്ഞാലുടൻ അപ്പോൾ ഹാജരുള്ളവരുടെ സാന്നദ്ധ്യത്തിൽ ദർഘാസുകൾ തുറന്ന് പരിശോധിക്കുന്നതും ദർഘാസ്/ ലേല നിബന്ധന പ്രകാരമുള്ള അനന്തര നടപടികൾ സ്വീകരിക്കുന്നതുമാണ്.

ലേലത്തീയതിയും സമയവും—28-1-2009 രാവിലെ 11 മണി. അന്നേദിവസം ലേലം നടക്കാത്ത തോട്ടങ്ങൾ 5-2-2009 രാവിലെ 11 മണിക്ക്, 5-2-2009-നും ലേലം നടക്കാത്ത തോട്ടങ്ങൾ 12-2-2009 രാവിലെ 11 മണിക്ക്.

ലേലം നടത്തുന്ന സ്ഥലം—ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസ്, വഴുതക്കാട്, തിരുവനന്തപുരം.

നിരതദ്രവ്യം—ഓരോ തോട്ടത്തിനും 1,000 രൂപ വീതം.

ദർഘാസ് ഫോറത്തിന്റെ വില—100 രൂപ+വിൽപ്പന നികുതി കാലാവധി—ഉടമ്പടി തീയതി മുതൽ 2009 ജൂൺ മാസം 30 വരെ.

2. ദർഘാസ്/ലേലത്തിൽ പങ്കുകൊള്ളാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കയ്യൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ഒരു സർട്ടിഫിക്കറ്റ് ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽനിന്നും വാങ്ങി നിരതദ്രവ്യം കെട്ടിവയ്ക്കുന്നതിനു മുൻപായി സമർപ്പിക്കുകയോ ഫോട്ടോപതിച്ച തിരിച്ചറിയൽ കാർഡിന്റെ അസ്സൽ പരിശോധനയ്ക്ക് ഹാജരാക്കുകയോ ചെയ്യേ≠താണ്. അല്ലാത്തവരെ ദർഘാസ്/ലേലത്തിൽ പങ്കുകൊള്ളാൻ അനുവദിക്കുന്നതല്ല.

3. ദർഘാസ്/ലേലം കൊ≠യാൾ ദർഘാസ്/ലേലത്തുകയുടെ അഞ്ചിലൊന്ന് (കുറഞ്ഞത് 10,000 രൂപയും പരമാവധി ഒരു ലക്ഷം രൂപയും) ലേലം കഴിഞ്ഞാലുടൻ തന്നെ ഒടുക്കേ≠താണ്. മൊത്തം ലേലത്തുക 10,000 രൂപയോ അതിൽ കുറവോ ആണെങ്കിൽ മുഴുവൻ ലേലത്തുകയും ലേലം കഴിഞ്ഞാലുടൻ ഒടുക്കേ≠താണ്. അതിന് മുടക്കം വരുത്തിയാൽ അയാൾ കെട്ടിവച്ചിട്ടുള്ള നിരതദ്രവ്യം ഗവൺമെന്റ ിലേക്ക് ക≠ുകെട്ടുന്നതും പാട്ടാവകാശം അയാളുടെ പൂർണ്ണനഷ്ടോത്തരവാദിത്വത്തിൽ വീ≠ും ലേലം ചെയ്യുന്നതും എന്നാൽ അതിൽ വച്ച് വല്ല ലാഭവുമു≠ായാൽ അയാൾക്ക് അതിന് അവകാശ മില്ലാത്തതുമാകുന്നു. അപ്രകാരം ലേലം ചെയ്യുന്നതിൽവച്ച് സർക്കാരിന് എന്തെങ്കിലും നഷ്ടം ഉ≠ായാൽ ആയത് റവന്യൂ റിക്കവറി നിയമപ്രകാരം ഈടാക്കുന്നതുമാകുന്നു.

4. ദർഘാസ്/ലേലത്തിൽ വിജയിക്കുന്ന ആളിന്റെ നിരതദ്രവ്യം അയാൾ ഒടുക്കേ≠തായ ലേലസംഖ്യയിൽ തട്ടിക്കഴി ക്കുന്നതും വിജയിക്കാത്തവരുടെ നിരതദ്രവ്യം ലേലം കഴിഞ്ഞാലുടൻ തിരിച്ചുകൊടുക്കുന്നതുമാണ്.

5. ഏറ്റവും കൂടുതൽ തുകയ്ക്ക് വിളികേൾക്കുന്നയാളിന്റെ പേരിൽ ദർഘാസ്/ലേലം ഉറപ്പിക്കുന്നതാണ്. എന്നാൽ യാതൊരു കാരണവും ചൂ≠ിക്കാണിക്കാതെ ലേലം അംഗീകരിക്കുന്നതിനോ നിരാകരിക്കുന്നതിനോ ഉള്ള അധികാരം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് ഉ≠ായിരിക്കുന്നതാണ്. കൂടാതെ പട്ടികയിലെ ഏതെങ്കിലും തോട്ടം ലേലത്തിൽ നിന്നും ഒഴിവാക്കാനോ പുതുതായി ഏതെങ്കിലും തോട്ടം കൂടി ഉൾപ്പെടുത്തി ലേലം ചെയ്യുന്ന തിനോ ലേലം ചെയ്യുന്ന ഉദ്യോഗസ്ഥന് അധികാരം ഉ≠ായിരിക്കുന്നതാണ്.

6. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തിയതായി പാട്ടക്കാരനെ അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി മുഴുവൻ ദർഘാസ്/ലേലത്തുകയും മൊത്തം ദർഘാസ്/ ലേലത്തുകയുടെ 5% വനവികസന നികുതിയും നിയമാനുസൃത വില്പന നികുതിയും ഏറ്റവും കുറഞ്ഞത് 500 രൂപയോ ലേലത്തുകയുടെ പത്തു ശതമാനമോ ഏതാണോ കൂടുതൽ അത് സെക്യൂരിറ്റിയായും അടച്ച് 50 രൂപ മുദ്രപ്പത്രത്തിൽ നിലവിലുള്ള വ്യവസ്ഥ കൾക്ക് വിധേയമായി ഉടമ്പടി എഴുതി ഒപ്പു വയ്ക്കേ≠താണ്. അതിനു മുടക്കം വരുത്തിയാൽ യാതൊരു കാരണവശാലും കാലാവധി ദീർഘിപ്പിച്ചു നൽകുന്നതല്ല. ബാക്കി ദർഘാസ്/ലേലത്തുകയും20th JAN. 2009] FOREST DEPARTMENT 29 സെക്യൂരിറ്റിയും ഒടുക്കാതിരുന്നാൽ പാട്ടാവകാശം റദ്ദ് ചെയ്യുകയും പാട്ടക്കാരൻ നേരത്തെ കെട്ടിവച്ചിട്ടുള്ള മുഴുവൻ തുകയും സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതുമാണ്. കൂടാതെ പാട്ടാവകാശം വീഴ്ച വരുത്തിയ ആളിന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ വീ≠ും ലേലം ചെയ്യുന്നതും അതിൽവച്ച് എന്തെങ്കിലും നഷ്ടമു≠ായാൽ ആദ്യ ലേലക്കാരനിൽ നിന്നും നിലവിലിരിക്കുന്ന റവന്യൂ റിക്കവറി ആക്ട് അനുസരിച്ചോ യു‡മായ മറ്റു മാർഗ്ഗങ്ങളിലൂടെയോ ഈടാക്കുന്നതുമാണ്.

7. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുന്നയാൾ ലേലത്തിന് മുൻപായി കശുമാവിൻ തോട്ടങ്ങൾ നേരിൽക്ക≠് പരിശോധിച്ച് വിളകളുടെ ഗുണവും തരവും നല്ലതുപോലെ ബോദ്ധ്യപ്പെട്ടുകൊള്ളേ≠തും ലേലത്തിനുശേഷം ഉ≠ാകുന്ന പരാതികൾ സാധാരണഗതിയിൽ പരിഗണി ക്കുന്നതല്ലാത്തതുമാകുന്നു.

8. ദർഘാസ്/ലേലം വിളി കേൾക്കുന്നയാൾ ലേലത്തിന് ഒരു പൂർണ്ണ തീരുമാനമു≠ാകാതെ പിൻമാറാൻ പാടില്ലാത്തതും അപ്രകാരം പിൻമാറിയാൽ ഡിപ്പാർട്ടുമെന്റ ിന് വരുന്ന നഷ്ടത്തിന് അയാൾ ഉത്തരവാദിയാകുന്നതുമാണ്. ലേലപ്പരസ്യ വി⁄ാപന വ്യവസ്ഥകൾ ക≠് ബോദ്ധ്യപ്പെട്ട് ഒപ്പിട്ട് തരുന്നവർക്ക് 9-3-1976-ലെ കേരള സർക്കാർ ഉത്തരവ് (പി) 62/76 എ.ഡി. യിലെ നിബന്ധനകളും 19-12-2006-ലെ കേരള ഗസറ്റിലെ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (സംരക്ഷണം)-ടെ പ്രൊ (5) 5427/2006-ാം നമ്പർ ഉത്തരവിലെ നിബന്ധനകളും ബാധകമാണ്.

9. ലേലക്കാരൻ കേന്ദ്ര ഗവൺമെന്റ ിന്റെ 1995-ലെ ഫൈനാൻസ് ആക്ട് പ്രകാരമുള്ള ആദായ നികുതി നി›ിതസമയത്തും നിരക്കിലും നൽകാൻ ബാദ്ധ്യസ്ഥനാണ്.

13. തോട്ടത്തിൽ യാതൊരു കാരണവശാലും തീപിടിക്കാതെ നോക്കി സംരക്ഷിക്കേ≠തും കരാറുകാരന്റെ പ്രധാന ചുമതലയാണ്. കാട്ടുതീ മൂലമോ ഉണക്കുമൂലമോ മറ്റു വിധത്തിലുള്ള വല്ല നഷ്ടവും നേരിട്ടാൽ ആയതിന് കരാറുകാരന് യാതൊരുവിധ നഷ്ടപരിഹാരത്തിനും യാതൊരുവിധ അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല.

14. കശുവ≠ി ശേഖരിച്ചതിന്റെ വിവരങ്ങളടങ്ങിയ പ്രതിമാസ കണക്കുകൾ ഓരോ മാസവും 5-ാം തീയതിക്കു മുൻപായി ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസർക്കും ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്കും സമർപ്പിക്കേ≠താണ്. അതിനു വീഴ്ച വരുത്തുന്നപക്ഷം ഓരോ വീഴ്ചയ്ക്കും 50 രൂപ വീതം പിഴ വസൂൽ ചെയ്യുന്നതാണ്.

15. ശേഖരണം നടത്തിയ കശുവ≠ി കടത്തിക്കൊ≠ു പോകുന്നതിന് ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസറിൽ നിന്നും നിർബന്ധമായും പാസ്സ് വാങ്ങേ≠താണ്. വീഴ്ച വരുത്തിയാൽ ഉചിതമായ പിഴ ഈടാക്കുന്നതാണ്.

16. ദർഘാസ്/ലേലത്തിനുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ വനം വകുപ്പിലെ നിലവിലുള്ള നിബന്ധനകൾക്ക് വിധേയമായി പരിഗണിക്കുന്നതാണ്.

17. മറ്റു ബാദ്ധ്യതകളൊന്നുമില്ലെങ്കിൽ വിൽപ്പന നികുതി, ആദായ നികുതി, കാർഷികാദായനികുതി എന്നിവയുടെ ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റുകൾ കാലാവധി കഴിഞ്ഞ് ആറു മാസത്തിനകം ഹാജരാക്കിയാൽ സെക്യൂരിറ്റി ഡെപ്പോസിറ്റ് തിരികെ നൽകുന്നതാണ്.

പട്ടികയിൽ രേഖപ്പെടുത്തിയ 28-1-2009-ലെ ലേലത്തിൽ മറ്റുതരത്തിൽ ലേലം വിളികൊള്ളാത്ത തോട്ടങ്ങളുടെ പുനർലേലം 5-2-2009-ാം തീയതി പകൽ 11 മണിക്ക് നടത്തുന്നതാണ്. വീ≠ും പുനർലേലം ആവശ്യമായി വന്നാൽ 12-2-2009-ാം തീയതി പകൽ 11 മണിക്കും തിരുവനന്തപുരം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽവച്ച് ലേലം ചെയ്തു വിൽക്കുന്നതാണ്.

കൂടുതൽ വിവരങ്ങൾക്ക് തിരുവനന്തപുരം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസിലോ ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസുകളിലോ നേരിട്ട് അന്വേഷിച്ച് അറിയേ≠താണ്.

10. ദർഘാസ്/ലേലത്തിൽ വിജയിക്കുന്ന പാട്ടക്കാരൻ മുഴുവൻ കശുവ≠ിയും ശേഖരിച്ച് സർക്കാർ തീരുമാനത്തിന് വിധേയമായി കേരള കാഷ്യൂ ഡെവലപ്പ്മെന്റ ് കോർപ്പറേഷനെയോ അവരുടെ അംഗീകൃത ഏജന്റുമാരെയോ അതാതു കാലയളവിൽ ഗവൺമെന്റ ് അംഗീകരിക്കുന്ന വിലയ്ക്ക് നൽകേ≠താണ്. കൂടാതെ കശുവ≠ി സംഭരണവും വിതരണവും സംബന്ധിച്ച് നിലവിലുള്ളതും അതാത് കാലങ്ങളിൽ ഗവൺമെന്റ ് പുറപ്പെടുവിക്കുന്നതുമായ എല്ലാ ഉത്തരവുകളും പാട്ടക്കാരന് ബാധകമാണ്.

11. കരാറുകാരൻ ആവശ്യപ്പെടുന്നപക്ഷം ടിയാന്റെ കൂലിക്കാരെ താമസിപ്പിക്കുന്നതിനും കശുവ≠ി സൂക്ഷിക്കു ന്നതിനും സ്ക്വയർ മീറ്ററിന് 5 രൂപ പ്രകാരം ഒരു ഷെഡ് കൂപ്പിനുള്ളിൽ പണിയുന്നതിന് സ്ഥലം അനുവദിക്കു ന്നതാണ്. ഷെഡ് അനുവദിക്കുന്നതിനുള്ള അവകാശം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറിൽ നിക്ഷിപ്തമാണ്. കരാർ കാലാവധിക്കു മുൻപായി ഷെഡ് കരാറുകാരൻ പൊളിച്ച് നീക്കം ചെയ്യേ≠താണ്. ഷെഡ് പണിയുന്ന തിനുള്ള സാധനങ്ങൾ നിലവിലുള്ള സീനിയറേജ് നിരക്ക്പ്രകാരം വനത്തിനുള്ളിൽ നിന്നും സൗകര്യമുള്ള പക്ഷം ശേഖരിക്കുവാൻ അനുവദിക്കുന്നതാണ്.

12. കരാർ കാലയളവിൽ എല്ലായ്പ്പോഴും കശുമാവുകൾക്ക് ചുറ്റുമുള്ള കാടുകൾ 5 മീറ്റർ ചുറ്റളവിൽ കരാറുകാരന്റെ ചുമതലയിൽ വെട്ടി നീക്കം ചെയ്തിരിക്കണം. വീഴ്ച വരുത്തിയാൽ യു‡മായ പിഴ കരാറുകാരിൽനിന്നും ഈടാക്കുന്നതാണ്.

CONDITIONS

1. The terms and conditions fixed for 'B' category contractors should also be binding to them for acceptance of tenders for this work.

2. The conditions embodied in this notification from part and parcel of the agreement to be executed for the work tendered for.

3. Tender forms can be had from the Divisional Forest Officer, Munnar on payment of the cost and Sales Tax shown in the schedule, hereto any working day during the office hours up to 1 p . m. on 29-1-2009. The tender form shall be used only by the persons in whose name it is issued and for the works specified in the schedule given below.

4. The tenderers shall fill in the tender forms purchased from this office and submit the same together with all the pages intact tenders should be addressed in the sealed cover with the name of work clearly written thereon, to the Divisional Forest Officer, Munnar so as to reach him in his office at Devikulam before 3 p. m. on 29-1-2009. Sealed tenders will be opened by the Divisional Forest Officer at 3.30 p. m. on the same day in the presence of such of the tenderers who elect to be present on the ocasion.

5. If the last date fixed for the receipt of the tenders happens to be a holiday, the tenders will be received and opened in the next working day at the same time and place is the conditions specified above.

6. The tenders received after the specified date and time, without the requisite enclosure of tender not written up in the proper order or form, will be rejected.

7. Each tender should be accompanied by a deposit receipt obtained from an approved Bank in favour of the Divisional Forest Officer, Munnar as Earnest Money Deposit for the work.

8. Tenderers should quote uniform percentage of the Departmental basic rate at which they can take up the work specified in the schedule both in figures and words. Fraction of one per cent should not be quoted.

9. All the corrections in the tender form should be intialed by the tenderer himself.

10. Incase more than one tenderer quoted the same lowest rate the successful lowest bidder will be decided in an auction among the tenderers who quoted the same lowest rate.

11. If any of the lowest tender is not prepared to reduce rate in the auction without fraction of one per cent it will be opened to the confirming authority to draw the tender of lots among or between the lower tenderers.

12. The lowest tender will ordinarily be accepted, provided the character and financial status of the tenderers are found satisfactory, but the authority competent to accept the tender reserves to himself the powers of accepting or rejecting any tender without assigning any reason therefore. There shall be no appeal against such action.

13. Rule notified as per GO (P) 62/76/AD dated 23-2-1976 and published in the Gazette date 9-3-1976, general sale conditions as per Pro. 5-2613/08 dated 12-6-2008 of Cheif Conservator of Forests, Thiruvananthapuram published in the Gazette No. 26 on 24-6-2008 and other conditions if any inform shall be binding on any person who makes a written tender for the works.

14. Tender submitted by the timber merchants, sale coupe contractors and other persons who are engaged in timber trade within the limits of the forest division in which working area is situated or by the adjacent divisions will not be accepted.

15. The tenderers should have no relationship on any Government servant who is in charge of the work or who has any direct control over the work. Relationship in this case will mean Father, Mother, Son, Daughter, Brother, Sister, Direct Uncle, Nephew, Father-in-Law, Mother-in-Law and the first Cousion of the officers concerned.

16. The Earnest Money Deposit of the unsuccessful tenderers will be returned to them soon after opening the tenders.

17. Before submitting the tender, th tenderer is expected to study and scrutinize all the conditions in this agreement to be executed, the draft of which can be had for perusal from the Divisional Forest Officer, Munnar or any working day during office hours. No plea of ignorance of the agreement conditions or no complaint regarding the said conditions received after putting in the tender shall be entertained on any account. A bounded agreement should be executed by the successful tenderer on the date of opening of the tenders itself.

18. The successful tenderer shall within 15 days from the date of issue of the acceptence of tender, furnish a security deposit of an amount equal to 10 % of the total contract value limited to a maximum of Rs. 20,000 (Rupees Twenty Thousand only) and execute an agreement on a Stamp Paper worth Rs. 50 in the approved form, the same of which can be had from the Divisional Forest Officer, Munnar for perusal. The security amount should be remitted in the Government Treasures duly pledged to the Divisional Forest Officer, Munnar. If the security is not remitted and the agreement executed with in the above said period, a further period of 15 days shall be allowed by the Divisional Forest Officer, Munnar for remittance of security and the execution of the agreement subject to realization of Rs. 10 (Rupees Ten only) per day of extension. If the tenderers remits the security within 15 days from the date of intimation of acceptance order but is not able to execute the agreement within the period, the Divisional Forest Officer, Munnar may grant and extension of time for 15 days more for execution of agreement with a penalty of Rs. 1 per day of extension.

19. Failure to remit the security deposit and to execute the agreement with in the time specified in the condition 18 above, will entire to cancellation of the tender by the Divisional Forest Officer, and forefeture to government of20th JAN. 2009] FOREST DEPARTMENT 32 the Earnest Money Deposit and security if any deposited by he tenderers. The work will also be got done through other agencies at the risk and the loss of the defaulter. The loss if any will be treated as arrears of Public revenue and will be recovered from the defaulter under the provisions of Revenue Recovery Act or by any other legal means if not paid within a responsible time specified by the Divisional Forest Officer. The defaulter, however will not be entitled for again, if any.

20. The tenderer should produce valid clearance certificate of Sales Tax, Income Tax and Agricultural Income Tax, to the satisfaction of the Divisional Forest Officer before the final payment is made to him in case the contract value is of and above Rs. 5,000 (Rupees Five Thousand only).

21. In the case of working down round logs and firewood the contractor shall be bound to deliver at the depot all hardwood logs within 3 months from the date of registration, softwood logs within 15 days from the date of felling and billets and firewood within 2 months from the date of registration or within the contract period which ever is earliest. If the delivery of the produce is not effected within the period orginally fixed as above, the Divisional Forest Officer may grant extension for 3 months for delivery of hardwood, 15 days for softwood and 2 months for billets and firewoods subject to realization of penalty of Rs. 1.75/cum. for hardwood Rs. 2 cum. for softwood for 15 days and Rs. 0.50 MT for stacked billets and firewood. 30 days further extension can be granted by the Conservator of Forests, High Range Circle Kottayam with penalty of Rs. 3.50 cum. and another 15 days by the Cheif Conservator of Forests, with penalty of Rs. 5.25 cum. and further 30 days by the Cheif Conservator of Forests, with penalty of Rs. 7 cum. for softwood, if the periods fall within the original or the extended contract period.

All Registered logs remaining undelivered after the expiry of said period will be taken charge of by the Forest Range Officer, Neriamangalam and the contractor shall be liable to pay a fine of Rs. 4 cum. for such undelivered logs only and forefeit all clains to Kolevila due thereon. The lose if any sustained by the department due to the deterioration on account of be lated delivery or non- delivery of the timber will be made good from the contractor as assessed by the department. The contractor should obtain receipts for the logs delivered at the depot from the depot officer when the contractor will be eligible for Kolevila therefore. The contractor shall fell all the marked tree entrusted him expect those trees which have been certified by the Divisional Forest Officer after inspection as wholly defective or impossible to be felled without causing serious damages to their stems or to other trees standing near by and collect all available timber therefore. For every marked trees left unfilled or felled but uncollected at the expiry of the contract period without proper authorization from the Divisional forest Officer, the contractor is liable to pay a penalty of Rs. 200 per tree, besides realization of value of timber of uncollected trees as per other conditions. The value of the logs at schedule rate if rencerec useless or deteriorated will be realized.

22. The contractor shall ensure that the felling and collection proceeds from the end of the coupe to the other end in an orderly and systematic manner and that all trees are felled as low as possible to the ground levels using saw at least on one side. All logs shall be cross cut with saw.

23. For all logs and billets selling at rates less than Kolevila, and Kolevila payable to the contractor will be limited to the sale price.

24. If the contractor fails to undertake and complete the work within the specified time or if he leaves any item of work undone. The Divisional Forest Officer at his discretion make other arrangement for carrying out the work left undone, either departmentally or through other agencies at the risk and loss of the defaulting contractor and the loss if any, sustained by the department on this account will be recovered from the security deposit or from other assests of the defaulting contractor, as if such sums are arrears of Land Revenue under the provisions of Revenue Recovery Act in force in such other manner as the Government may deem fit.

25. If any amount becomes due to any workman or mazdoor engaged by the contractor as per Workman's Compensation Act or as per provisions of labour or similar laws, such amounts shall be payable by the contractor.

26. The tenderers should submit declaration with the tender that they are not related any Government Servents who is in charge of or having control of the work for which the tender is submitted. Relationship for this purpose will be restricted to Father, Mother, Son, Daughter, Sister, Brother, Uncle, Nephew, Father-in-Law, Mother-in-Law, Brother-in-Law and the first Cousion of the Officer. If at any stage this condition is found to have been contravened, the Earnest Money Deposit of the tenderer/contractor will be forfeited to Government and the contract entered into will stand cancelled.

27. (a) The contractor shall not make any damages to bridges or roads and private properties during collection and transport and during unloading logs and billets from lorries and he shall be liable of any such damages. The decision of the Government regarding the amount of compensation payable for the damages caused shall be final and binding on the contractor and the Government shall recover such damages from the contractor.

(b) If the damages caused is in respect of any road under the control of the Kerala State Electricity Board or Public Works Department the amount of compensation payable for such damage will be assessed by the Forest Range Officer and Assistant Engineer of the concerned and the Assistant Engineer of the concerned Division of the Kerala State Electricity Board or Public20th JAN. 2009] FOREST DEPARTMENT 33 Works Department and their decision being final and binding on the contractor. In such cases the contractor shall be liable to pay the damages to the Kerala State Electricity Board or Public Works Department and they shall recover such damages from the contractor.

28. The tenderers should give an undertaking in the tender that they undertake to carry out the work at the tendered rates quoted and to abide by the terms and conditions of the tender notice and draft agreement so on by them and also other departmental rules and orders issued by them from time to time.

29. (a) Post offers which are not advantageous by more that 5% of the lowest rate offered for the original tender (where the total cost of the work as per the tender is Rs. 1,00,000 (Rupees One Lakhs only) and above and more than 10% where the total cost of the work is less than Rs. 1,00,000 (Rupees One Lakhs only) will be summarily rejected. In other cases it will be considered under the following conditions:—

(i) The post Offer should be made within 7 days of tender.

(ii) The post offerer should remit double the security for the work based on the work offered by the lowest tender.

The remittance should be made within 7 days from the date of receipt of registered notice.

(b) (i) The post offerer after satisfying the conditions specified above should also execute an agreement before the Divisional Forest Officer pledging the security for the due fulfilment of the terms.

(ii) If the post offerer satisfied the condition specified above, re-tenders will be called for after giving the usual publicity as per the rules. In the re-tender if the rates offered doesn't come up to what has been offered by the post offerer it will be awarded to the post offerer at the rate offered by him. If he back out, the security amount will be forfeited to the Government. If however, the rate is less than what has been offered by the post offerer in the case of re-tender, the work will be awarded to the lowest tenderer and the amount remitted by the post offerer released to him.

30. The quantity mentioned in the schedule is only approximate and the contractor is bound to work down the full quantity of timber and firewood available from trees marked and entrusted to him.

31. The period of contract will be four months from the date of intimation of work order. No extension of the contract period shall ordinarily be granted. But if however the delay incompleting the work in the contract area within the period specified in the schedule attached is due to circumstances beyond the control of the contractor extension of time may be granted for one/two/three months by Divisional Forest Officer, Conservator of Forests, High Range Circle, Kottayam Chief Conservator of Forests respectively but not exceeding a total period of five months subject to realization of penalties as mentioned below. If he fails to undertake and complete the work within the specified time, or if he leaves any item of work undone, the Divisional Forest Officer, may at his discretion make other arrangements for carrying out the work left undone either departmentally or through other agencies at the risk and loss of the defaulting contractor and loss if any incurred by the department on this account will be recovered from the security or from other assets of the contractor.

Penalty :-

(a) Rs. 2/cum. for the quantity of the timber delivered at the depot during the first month extension granted by the Divisional Forest Officer.

(b) Rs. 2.50/cum. for quantity of timber delivered at the depot during extension granted by the Conservator of Forests.

(c) Rs. 3/cum. for quantity of timber delivered at the depot during extension granted by the Chief Conservator of Forests.

(d) In the same way for billets and firewood Rs. 1.00, 1.25, 1.50 for extension granted by the Divisional Forest Officer, Conservator of Forests, Chief Conservator of Forests respectively.

32. The Divisional Forest Officer reserves to himself the power to eliminate any tree marked and entrusted to the contractor from felling if it is found during the course of the contract that timber obtainable from such trees have no reasonable market or by some other reasons and the contractor is not entitled to claim any compensation for such elimination.

33. Ten percent of each Kolevila bill will be with held as retention amount which will be released after the collected logs are sold and the liability if any in respect of these logs with the contract is settled.

33. (a) In case of works, the contract value which exceeds Rs. 10,000 Income Tax at the rate of 2 percent of payment made shall be deducted at each time when payments are made except in the case of nonresident contractors.

34. For working down logs, Seigniorage on Vakka fibre calculated at one vakka drag rope, for every 2 cum. or fraction thereof and grazing fee for one elephant for every 2 cum or fraction thereof for timber will be recovered from the contractor on the actual quantity collected and sales tax on vakka charges as per the rules in force.

34. (a) All timber the contractor is under obligation to deliver at the prescribed depot shall be transport to such depot only along with the routes specified in the transport permit. If in20th JAN. 2009] FOREST DEPARTMENT 34 the course of work it become necessary to deviate from the routes, specified in the schedule, the contractor may be allowed to transport timber and firewood along with the deviated routes provided the department is satisfied of the necessity for the deviation in the routes. In the case of such deviation in routes, the contractor will be eligible to get Kolevila at the rates worked for those new route minus tender reduction with prior sanction of the Conservator of Forests. Quantity to be supplied to different depot shall also be changed by the Divisional Forest Officer, Munnar, with prior sanction from the Conservator of Forests.

35. The contractor shall collect all timber available from the trees marked in the plantation within the said contract period as per the instructions issued by the Divisional Forest Officer, Munnar. If the collection is delayed the contractor will be liable to pay a penalty at the rate specified above for the timber for the belated period.

36. The contractor should show register progress in working down timber.

37. If the rates quoted in the re-tender is more than quoted in the original tender the difference between them and all the expenditure incidental in fixing up of re-tenderer including notification charges as assessed by the Divisional Forest Officer, Munnar will be recovered from the defaulting tenderer through any legal means including Revenue Recovery Act.

38. Further particulars can be had from the Divisional Forest Officer, Munnar or the Range Officer, Neriamangalam on any working days during office hours.

39. The contractor should take every case to collect as much quantity of saleable timber as possible from marked trees.

40. The tenderer are bound to above by the instructions issued from the Forest Department from time to time regarding tender as well as working down of timber.

Incomplete tender or tenders without EMD are liable to be rejected. The preliminary agreement in Stamp Paper worth Rs. 50 should be enclosed with tender. The undersigned reserves the right to reject any tender without assigning any reason.

All other conditions prevailing in the Kerala Public Works Department and Forest Department are applicable to this tender notification also.

കോതമംഗലം ഡിവിഷനിൽപ്പെട്ട താഴെ പട്ടികയിൽ പറയുന്ന റെയിഞ്ചുകളിലെ വിവിധ കേസുകളിൽപ്പെട്ട തൊ≠ി തടികൾ, കഴകൾ, വിറക് ഉരുപ്പടികൾ മുതലായവ പട്ടികയിൽ കാണിച്ചിരിക്കുന്ന തീയതികളിൽ അതാത് റെയിഞ്ച് ഓഫീസുകളിൽ വച്ചോ, ഡിപ്പോ കോമ്പൗ≠ിൽ വച്ചോ 24-6-2008-ലെ 26-ാം നമ്പർ കേരള ഗസറ്റും, ഫോറസ്റ്റ് ഷീറ്റ് നമ്പർ 253 മുതൽ 259 വരെയുള്ള പേജുകളിൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (സംരക്ഷണം) അവർകളുടെ 12-6-2008-ലെ പ്രൊ. (5) 2613/08 പ്രകാരം ആധികാരികമായി പ്രസിദ്ധപ്പെടുത്തിയിരിക്കുന്ന വിശദമായ ദർഘാസ്/ലേല വ്യവസ്ഥകൾക്കും അവയ്ക്ക് കാലാകാലങ്ങളിൽ ഉ≠ാകുന്ന കൂട്ടിച്ചേർക്കലുകൾക്കും മാറ്റങ്ങൾക്കും തൊ≠ി ലേലവ്യവസ്ഥ കൾക്കും വിധേയമായി കോതമംഗലം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറോ, അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റ് ഉദ്യോഗസ്ഥനോ പരസ്യമായി ലേലം ചെയ്ത് വിൽക്കുന്നതാണ്.

ലേല നടപടികൾ അതാത് ദിവസം രാവിലെ 11 മണിക്ക് ആരംഭിക്കുന്നതാണ്. ലേല ദിവസം ഒരു പൊതു അവധി പ്രഖ്യാപിക്കുന്നതായാൽ അടുത്ത പ്രവൃത്തി ദിവസം നി›ിത സമയത്ത് ലേലം നടക്കുന്നതായിരിക്കും.

കേസിൽ ഉൾപ്പെട്ട കയറ്റുമതി ഇനം തേക്ക്, ആഞ്ഞിലി തടികളും ലേലത്തിൽ ഉൾപ്പെടുന്നതായിരിക്കും. ലേലത്തിൽ പങ്കുകൊള്ളുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലം ആരംഭിക്കുന്നതിന് Gaz. No. 3/2009/DTP (Forest).

മുൻപ് ലേലത്തിൽ ഉൾപ്പെടുത്തിയിട്ടുള്ള സാധനങ്ങളുടെ ഗുണനിലവാരവും അളവുകളും ക≠് ബോദ്ധ്യപ്പെടേ≠താണ്. ലേലത്തിനുശേഷം ഇതു സംബന്ധിച്ച് യാതൊരുവിധ പരാതിയും പരിഗണിക്കുന്നതല്ല. ലേലത്തിൽ പങ്കുകൊള്ളുവാൻ ആഗ്രഹിക്കുന്നവർ തേക്ക് തടിയുടെ ലേലത്തിനാണെങ്കിൽ 20,000 രൂപയും മറ്റ് തടികളുടെ ലേലത്തിനാണെങ്കിൽ 10,000 രൂപയും മറ്റ് വന വിഭവങ്ങളുടെ കാര്യത്തിൽ 5,000 രൂപയും നിരതദ്രവ്യമായി ലേലത്തിനു മുൻപ് കെട്ടി വയ്ക്കേ≠താണ്. കോടതി ഉത്തരവു വാങ്ങി ലേലം ചെയ്യുന്ന തടികളുടെയും മറ്റ് വനവിഭവങ്ങളുടെയും മുഴുവൻ ലേലത്തുകയും ലേല ദിവസം തന്നെ കെട്ടിവയ്ക്കേ≠താണ്. കൂടുതൽ വിവരങ്ങൾക്ക് അതാത് റെയ്ഞ്ചാഫീസുമായി ബന്ധപ്പെടേ≠താണ്.

ദർഘാസ്/ലേലപ്പരസ്യം

നമ്പർ എ2-3783/2008. 2008 ഡിസംബർ 31. 1961-ലെ കേരള വന നിയമം 61 എ വകുപ്പ് അനുസരിച്ച് സർക്കാരിലേക്ക് ക≠ുകെട്ടിയ താഴെ പട്ടികയിൽ പറയുന്ന വാഹനങ്ങൾ ഇപ്പോഴുളള സ്ഥിതിയിലും അവസ്ഥയിലും ദർഘാസ്/ലേല അടിസ്ഥാനത്തിൽ വിൽപന നടത്തുന്നതാണ്.

പ്രസ്തുത വിൽപനയ്ക്ക് സീൽ വച്ച ദർഘാസുകൾ ക്ഷണിച്ചു കൊള്ളുന്നു. ദർഘാസ് ഫോറങ്ങൾ ഓരോ വാഹനത്തിനും പ്രത്യേകം പ്രത്യേകം അപേക്ഷിക്കുന്ന മുറയ്ക്ക് 2009 ഫെബ്രുവരി 12-ാം തീയതി ഉച്ചയ്ക്ക് 1 മണി വരെ ലഭിക്കുന്നതാണ്. പൂരിപ്പിച്ച സീൽവച്ച ദർഘാസുകൾ അന്നേ ദിവസം പകൽ 3 മണി വരെ ഈ ആഫീസിൽ സ്വീകരിക്കുന്നതും അന്നേ ദിവസം 3.30-ന് ദർഘാസുകൾ സമർപ്പിച്ചവരെ മാത്രം പങ്കെടുപ്പിച്ചുകൊ≠് കോതമംഗലം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറോ അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ പ്രസ്തുത വാഹനങ്ങൾ ലേലം ചെയ്യുന്നതും ലേലത്തിനുശേഷം ദർഘാസുകൾ തുറക്കുന്നതും ആയിരിക്കും. ലേലത്തിലോ ദർഘാസിലോ ഏതിലാണോ കൂടുതൽ തുക വാഗ്ദാനം ചെയ്തിരിക്കുന്നത് ആ വ്യ‡ിയുടെ പേരിൽ വിൽപ്പന താൽക്കാലികമായി ഉറപ്പിക്കുന്നതായിരിക്കും.

(5) 2613/08 നമ്പർ പ്രകാരം 24-6-2008-ലെ കേരള സർക്കാർ ഗസറ്റ് നമ്പർ 26-ൽ 253 മുതൽ 257 വരെ പേജുകളിൽ പ്രസിദ്ധീകരിച്ച ലേല നിബന്ധനകളും സർക്കാർ തടി ഡിപ്പോകളിലും ഡിവിഷനുകളിലും അതാത് കാലങ്ങളിൽ നിലവിലുള്ള ലേല നിബന്ധനകളും ഈ ലേലത്തിനും ബാധകമായിരിക്കും. കൂടുതൽ വിവരങ്ങൾ ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസുകളിൽ നിന്നും അറിയാവുന്നതാണ്.

ഓരോ ലേലത്തിനുമുള്ള ടെ≠റുകൾ ലേല തീയതിയുടെ തലേ ദിവസം വൈകുന്നേരം അഞ്ച് മണിവരെ അതാത് റെയിഞ്ചാഫീസുകളിൽ സ്വീകരിക്കുന്നതാണ്. ഓരോ ലേല തീയതികളിലും ലേലത്തിന് ലഭ്യമാകുന്ന നടപടികൾ പൂർത്തി യാകുന്ന തൊ≠ികളായിരിക്കും ലേലത്തിന് വയ്ക്കുക.

Tender/auction date, time and place— 3-2-2009, It is hereby notified for the information of the public that the Re-tender/Auction Sale of usufructs from the resumed estates of Rosary Estate in Nelliyampathy Range shown below will be conducted by the Divisional Forest Officer, Nemmara or any other officer authorized by him. This re-tender/auction sale will be as per the sale conditions in the Notification No.C1-2445/2008 as per the general tender/auction sale conditions prevailing the Kerala Forest Department.

CONDITIONS

The sale in respect of Rosary Estate shown below was already conducted on 17-12-2008 and the same is included in re-tender due to receipt of valid post offer.

1. Those who intend to participate in the tender/auction should produce their valid identity card such as Certificate attesting signature and permanent address obtained from Village Officer or attested Election If the date of auction declared to be a Public holiday/ Harthal, the sale will be conducted on the next working day at the same place and time.

Identity Card/Driving License/Passport before remitting the EMD. They should also file an undertaking agreeing that they will personally held responsible for the loss if any, sustained to Government due to the breach of any sale conditions.

2. Those who intend to participate in the tender/auction should ensure themselves of the quality, quantity etc. of the produce before the tender/auction. Complaints if any, in this regard will not be entertained after the sale.

3. The produce will be put up for sale in lots. The tender should be submitted by quoting the rate for 1 kg., for each lot. The tender will be opened and finalized in the presence of the tenderers present on completion of the auction procedure.

4. The successful tenderer/bidder should remit the full sale value if the total sale amount is below Rs. 20,000 and if it exceeds, he should remit the 35% of the bid amount subject to a minimum of 20,000 and maximum of Rs. 1,00,000 in cash or by DD on the same day. If the 35% bid amount is more than 1,00,000, the amount exceeding 1 lakh has to be remitted in the treasury and the receipt produced within 7 working days after the auction sale. If anybody fails to remit the balance amount, the amount already remitted by them will be forfeited to Government.

5. Balance bid amount and taxes thereon should be remitted to Government Treasury within 40 days from the date of communication of the confirmation orders.

6. An extension of 30 days time will be allowed on payment of 18% interest and a further extension of 30 days on payment of 24% interest + 2½ % surcharge on interest. Another 30 days extension will be granted on payment of 36% interest with 5% surcharge on interest. There will be no extension beyond the above 90 days. If the bidder fails to remit the amount within the extended period the amount already remitted by the defaulters will be forfeited to Government and the produce will be re-tendered/re-auction at the risk and loss of the defaulter.

7. If the bidder fails to remit all the amount within 130 days from the date of communication of the confiscation order, the tender/auction will be cancelled and the produce will be re-tendered/ re-auctioned at the risk and loss of the defaulter after issuing a notice to the defaulter with 10 days validity.

8. The following powers of the undersigned are unquestionable.

(a) The EMD of any person/firm can be denied without assigning any reason.

(b) Any notified lots can be excluded from the sale or any additional lots can be put up for sale.

(c) Any person/firm can be expelled from the auction process if the person/firm is believed to be involved in any activities against the auction sale.

(d) Auction process can be stopped by the undersigend at any time if the participants are indulged in activities which are detrimental to Government interest.

9. Post offer will be accepted within 7 days from the date of tender/auction. The same will be considered as per the prevailing rules in this respect.

More details regarding the re- tender/auction can be made available from this office or from the Range Office, Nelliyampathy, Kollengode and Alathur during office hours.

10. The general conditions regarding tender/auction published in Kerala Gazette No. 26 dated 24-6-2008 vide Notification No. Pro(5) 2613/08 dated 12-6-2008 are also applicable for this tender/auction.

If nobody come forward to participate in the tender/ auction sale or on cancellation of re- tender/auction on 3-2-2009, the produce in will be sold out by re-tender/ auction sale in the subsequent days on 4-2-2009 and 5-2-2009.

1. ദർഘാസ്/ലേല വിൽപ്പനയിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കൈയൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജ് ഓഫീസറിൽ നിന്നുമുള്ള സർട്ടിഫിക്കറ്റ് അല്ലെങ്കിൽ ഇലക്ഷൻ എെഡന്റിറ്റി കാർഡ്/ഡ്രൈവിംഗ് ലൈസൻസ്/ പാസ്പോർട്ട് ഇവയിൽ ഏതെങ്കിലും ഒന്നിന്റെ സാക്ഷ്യപ്പെടുത്തിയ പകർപ്പോ നിരതദ്രവ്യം കെട്ടിവയ്ക്കു ന്നതിന് മുമ്പായി ഹാജരാക്കേ≠താണ.് കൂടാതെ ദർഘാസ്/ലേല നിബന്ധനകൾ പാലിക്കുന്നതിൽ വീഴ്ചവരുത്തിയാൽ തൻമൂലം സർക്കാരിന് ഉ≠ാകുന്ന കഷ്ടനഷ്ടങ്ങൾ ഈടാക്കാവുന്നതാണെന്ന് സമ്മതിച്ച് കൊ≠് ഒരു സമ്മതപത്രം ഒപ്പുവയ്ക്കേ≠താണ്. മേൽവിവരിച്ച സർട്ടിഫിക്കറ്റോ ഏതെങ്കിലും തിരിച്ചറിയൽ രേഖയോ ഹാജരാക്കാത്തവരെ പുനർ ദർഘാസ്/ ലേലത്തിൽ പങ്കുകൊള്ളുവാൻ അനുവദിക്കുന്നതല്ല.

2. പുനർ ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുന്നവർ ദർഘാസ്/ ലേലം മുമ്പായി വിൽപ്പനയ്ക്ക് വച്ചിരിക്കുന്ന വിഭവങ്ങളുടെ ഗുണനിലവാരവും മറ്റും നേരിൽ ക≠് ബോധ്യപ്പെടേ≠താണ്. ലേലത്തിനുശേഷം ഈവക കാര്യങ്ങളെക്കുറിച്ചുള്ള യാതൊരു പരാതിയും പരിഗണിക്കുന്നതല്ല.

3. മുകളിൽ കാണിച്ചിരിക്കുന്ന വിഭവങ്ങൾ ലോട്ടുകളായിട്ടായിരിക്കും വിൽക്കുക. ഓരോ ലോട്ടിലെയും വിഭവങ്ങൾക്ക് ഒരു കിലോഗ്രാമിനുള്ള നിരക്ക് രേഖപ്പെടുത്തിവേണം ദർഘാസുകൾ സമർപ്പിക്കേ≠ത്. ലേലം കഴിഞ്ഞാലുടൻ ഹാജരായവരുടെ സാന്നിദ്ധ്യത്തിൽ ദർഘാസുകൾ തുറക്കുന്നതും വിജയിയെ നി›യിക്കുന്നതുമാണ്.

4. വിജയിയായ ദർഘാസ്/ലേലക്കാരൻ ലേലം കഴിഞ്ഞാലുടൻ മൊത്തവില 20,000 രൂപയിൽ കുറവാണെങ്കിൽ മുഴുവൻ തുകയും അതിൽ കൂടുതലാണെങ്കിൽ മൊത്തം ലേലത്തുകയുടെ 35% വില, കുറഞ്ഞത് 20,000 രൂപയും കൂടിയത് 1,00,000 രൂപയും എന്ന കണക്കിൽ മൊത്തം പണമായോ ഡി.ഡി. യായോ ലേലദിവസം തന്നെ അടയ്ക്കേ≠താണ്. ലേല സംഖ്യയുടെ 35% തുക 1 ലക്ഷം രൂപയിൽ കൂടുതലാണെങ്കിൽ ലേലദിവസം അടച്ച 1,00,000 രൂപ കിഴിച്ച് ബാക്കി തുക ലേലദിവസം കഴിഞ്ഞ് 7 പ്രവർത്തി ദിവസത്തിനകം ട്രഷറിയിൽ അടച്ച് രശീത് ഹാജരാക്കേ≠താണ്. നി›ിത തുക ഒടുക്കാതിരുന്നാൽ ലേലം റദ്ദ് ചെയ്തതായി കണക്കാക്കി നിരതദ്രവ്യം ഉൾപ്പെടെ അതുവരെ അടച്ച എല്ലാ തുകയും സർക്കാരിലേക്ക് മുതൽക്കൂട്ടുന്നതാണ്. അഡ്വാൻ്സ് തുക അവസാനം നീക്കം ചെയ്യുന്ന വനവിഭവങ്ങളുടെ വിലയിലേക്ക് മാത്രമേ വകകൊള്ളിക്കുകയുള്ളു.

5. ദർഘാസ്/ ലേലം സ്ഥിരപ്പെടുത്തിയതായുള്ള അറിയിപ്പും ബാക്കി തുകയും അടച്ച് തീർക്കുവാനുള്ള ചലാൻ ഫോറവും അയച്ച തീയതി മുതൽ 40 ദിവസത്തിനകം ചലാൻ ഫോറത്തിൽ കാണിച്ചിട്ടുള്ള തുക സർക്കാരിന്റെ നിർദ്ദിഷ്ട ഖജനാവിൽ അടച്ച് ചലാൻ രശീത് റെയിഞ്ച് ഓഫീസർക്ക് എത്തിച്ച് കൊടുക്കേ≠താണ്. എല്ലാ വിഭവങ്ങളും മുഴുവൻ തുകയും അടച്ച് തീർത്ത് ലേലം സ്ഥിരപ്പെടുത്തിയ വിവരം അറിയിക്കുന്ന ദിവസം മുതൽ 40 ദിവസത്തിനകം നീക്കം ചെയ്യേ≠താണ്.

6. മേൽ സൂചിപ്പിച്ച നാല്പത് ദിവസത്തിനകം (40 ദിവസം) തുക അടച്ച് ലേല വസ്തുകൾ നീക്കം ചെയ്യാത്തപക്ഷം പതിനെട്ട് ശതമാനം (18%) പലിശയോടുകൂടി ബാക്കി തുക അടയ്ക്കുന്നതിന് ഒരു മാസം (30 ദിവസം) വരെയും ഇരുപത്തിനാല് ശതമാനം (24%) പലിശയും പിഴപലിശയിൻമേൽ ര≠ര ശതമാനം (2½%) സർചാർ÷ും ഈടാക്കിക്കൊ≠് അടുത്ത ഒരു മാസം വരെയും (30 ദിവസം) 36% പിഴപലിശയും പിഴപലിശയിൻമേൽ 5% സർചാർ÷ും ഈടാക്കിക്കൊ≠് വീ≠ും ഒരു മാസം കൂടിയും (30 ദിവസം) ഇങ്ങനെ ആകെ 3 മാസം വരെ (90 ദിവസം) റെയിഞ്ച് ഓഫീസർക്ക് കാലാവധി ദീർഘിപ്പിച്ച് അനുവദിക്കാവുന്നതാണ്. അപ്രകാരം ദീർഘിപ്പിച്ച സമയപരിധിക്കകവും പണമടയ്ക്കാതെ വന്നാൽ. അടച്ച തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുകയും ലേലം കൊ≠ വകകൾ വീഴ്ചക്കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർ ദർഘാസ്/ലേലം വഴി വിറ്റഴിക്കുന്നതുമാണ്.

7. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തിയത് അറിയിക്കുന്ന തീയതി മുൽ 130 ദിവസത്തിനകം (നൂറ്റിമുപ്പത് ദിവസം) എല്ലാ തുകയും അടച്ചു തീർക്കാത്തപക്ഷം ദർഘാസ്/ ലേലം റദ്ദാക്കുന്നതും ആയത് ദർഘാസ്/ലേലക്കാരന് 10 ദിവസത്തെ അവധി വെച്ച് മുൻകൂട്ടി നോട്ടീസ് കൊടുത്തതിനുശേഷം അതേ റെയിഞ്ചിലെ ദർഘാസ്/ ലേലത്തിൽ ഇപ്രകാരം പുനർ ലേല വില്പന നടത്തുന്നതുമാണ്. ത∑ൂലം ഡിപ്പാർട്ടുമെന്റ ിന് ഉ≠ാകുന്ന എല്ലാ കഷ്ടനഷ്ടങ്ങൾക്കും ആദ്യ ലേലക്കാരൻ/ദർഘാസുകാരൻ ഉത്തരവാദിയാകുന്നതുമാണ്.

8. ദർഘാസ്/ലേലം നടത്തുന്ന ഉദ്യോഗസ്ഥന്റെ താഴെപ്പറയുന്ന അധികാരങ്ങൾ ചോദ്യം ചെയ്യാൻ പാടുള്ളതല്ല.

(എ) ഏതെങ്കിലും വ്യ‡ിയുടെയോ സ്ഥാപനത്തിന്റേയോ നിരതദ്രവ്യം യാതൊരു കാരണവും പറയാതെ സ്വീകരിക്കുകയോ നിരാകരിക്കുകയോ ചെയ്യാവുന്നതാണ്.

(ബി) ദർഘാസ്/ലേലത്തിനായി പരസ്യപ്പെടുത്തിയ ഏതെങ്കിലും ലോട്ടുകൾ വിൽക്കാതിരിക്കുകയോ പരസ്യപ്പെടുത്തിയിട്ടില്ലാത്ത ഏതെങ്കിലും ലോട്ട് വിൽക്കുകയോ ചെയ്യാവുന്നതാണ്.

(സി) ലേലത്തിന് പ്രതികൂലമായി ബാധിക്കുന്ന ഏതെങ്കിലും നടപടികളിൽ ഏർപ്പെട്ടെന്ന് ബോദ്ധ്യപ്പെടുന്നപക്ഷം ലേലക്കാരനെ ലേലത്തിൽനിന്നോ ലേലസ്ഥലത്തു നിന്നോ പുറത്താക്കാവുന്നതാണ്.

(ഡി) ലേലം വിളിക്കുന്നവർ പരോക്ഷമായി യോജിച്ച് സർക്കാരിനെ പ്രതികൂലമായി ബാധിക്കുന്ന നടപടികളിൽ ഏർപ്പെട്ട് പ്രതീക്ഷിച്ച വില ലഭിക്കുന്നില്ല എന്ന് ബോദ്ധ്യപ്പെട്ടാൽ ലേലം20th JAN. 2009] FOREST DEPARTMENT 42 നിർത്തിവയ്ക്കാൻ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അധികാരമു≠ായിരിക്കുന്നതാണ്.

9. പോസ്റ്റ് ഓഫർ ദർഘാസ്/ലേലം നടത്തി 7 ദിവസത്തിനകം സമർപ്പിക്കേ≠താണ്. ആയത് നിലവിലുള്ള നിബന്ധനകൾക്ക് വിധേയമായി മാത്രം പരിഗണിക്കുന്നതാണ്. ദർഘാസ്/ലേലം സംബന്ധിച്ച കൂടുതൽ വിവരങ്ങൾ ഈ ഓഫീസിൽ നിന്നോ നെല്ലിയാമ്പതി/കൊല്ലങ്കോട്/ആലത്തൂർ എന്നീ ഫോറസ്റ്റ് റെയിഞ്ച് ഓഫീസുകളിൽ നിന്നോ പ്രവർത്തി ദിവസങ്ങളിൽ അന്വേഷിച്ചറിയാവുന്നതാണ്.

10. 24-6-2008-ലെ ഗസറ്റ് നമ്പർ 26-ൽ പ്രസിദ്ധപ്പെടുത്തിയ Prot (5) 2613/2008-ാം തീയതി 12-6-2008 നമ്പർ ആയി പരസ്യപ്പെടുത്തിയ പുതുക്കിയ ദർഘാസ്/ലേല പരസ്യത്തിലെ പൊതുവായ നിബന്ധനകൾ ഈ ലേലത്തിനും ബാധകമായിരിക്കുന്നതാണ്.

3-2-2009-ന് പുനർ ദർഘാസ്/ലേലത്തിൽ പങ്കുകൊള്ളുവാൻ ആരും തന്നെ മുന്നോട്ട് വരാതിരിക്കുകയോ ടെ≠ർ/ലേലം റദ്ദ് ചെയ്യുകയോ ചെയ്യുന്ന പക്ഷം പ്രസ്തുത വിളകൾ 4-2-2009, 5-2-2009 എന്നീ തീയതികളിൽ നി›ിത സ്ഥലത്തും സമയത്തും ദർഘാസ്/ലേല പ്രകാരം വിൽപ്പന നടത്തുന്നതായിരിക്കും.

Tender documents can be available during office hours from the Office of the Divisional Forest Officer, Timber Sales Division, Kozhikode-28 upto 1 p. m. on the last date fixed for receipt of tender, on application in writing and on payment of the value of documents (not transferable) either in cash or by money order. This amount will not be refunded. If the date mentioned above happens to be a holiday declared by the Government the receipt of the tender and opening of the tender will be on the next working day. In any case if tender cannot be accepted or opened in this day it will be again conducted on 20-2-2009.

All conditions stipulated for Kerala P. W. D. works and Kerala Forest Department works are applicable to this works also. EMD in the normal course should be pledged in favour of the Divisional Forest Officer, Timber Sales Division, Kozhikode and name of work should be superscribed on the cover of tender. പൊതുമരാമത്ത് വകുപ്പിന്റെ അംഗീകാരമുള്ള കരാറുകാർക്ക് നി›ിത വിലയടച്ച് രേഖാമൂലം അപേക്ഷിച്ചാൽ ദർഘാസ് ഫോറങ്ങളും മറ്റും ദർഘാസ് ദിവസം 1 മണിവരെ കോഴിക്കോട് ടിമ്പർ സെയിൽസ് ഡിവിഷനിൽനിന്നും ലഭിക്കുന്ന താണ്. ദർഘാസ് പ്രമാണത്തിനുവേ≠ി അടച്ച തുക യാതൊരു കാരണവശാലും തിരികെ നൽകുന്നതല്ല. ആവശ്യമായ നിരത ദ്രവ്യം ചെക്കാണെങ്കിൽ ദർഘാസ് പ്രമാണത്തിന് 50 രൂപ (അ മ്പത്) വിലയുള്ള കേരള സർക്കാർ മുദ്രപത്രത്തിൽ നി›ിത പ്രാഥമിക ഉടമ്പടി ഇല്ലെങ്കിൽ ദർഘാസുകൾ സ്വീകരിക്കുന്നതല്ല.
