G.O. (Rt. ) No. 69/2009/ LBR .
Thiruvananthapuram , 15th January 2009 .
Whereas, the Government are of opinion that an industrial dispute exists between The Director, St. Josephs Engineering Works , Near St.Mary's High School , Vattayal , Thiruvampady P. O. , Alappuzha and the workmen of the above referred establishment represented by Sri A. R. Joy , Secretary, All Kerala Skilled General Workers Union ( UTUC- M ) , District Committee, Canal Ward , Alappuzha- 688 007 in respect of matters mentioned in the annexure to this order ;
And whereas , in the opinion of Government it is necessary to refer the said industrial dispute for adjudication ;
Now, therefore , in exercise of the powers conferred by section 10 ( 1) (c) of the Industrial Disputes Act of 1947 ( Central Act XIV of 1947) the Government hereby direct that the said Industrial Dispute be referred for adjudication to the Labour Court , Kollam. The Labour Court will pass the award within a period of three months .
ANNEXURE
Whether the denial of employment of Shri K.S. Xavier and Issac alias Benedict , workers of St. Josephs Engineering Works , Alappuzha by the management is justifiable ? If not, what are the reliefs they are entitled to ?

Whereas the Government are of opinion that an industrial dispute exists between The Managing Director , Kerala State Co - operative Coir Marketing Federation (Coirfed) , Alappuzha and the workmen of the above referred establishment represented by 1. Shri A. A. Shukkoor , President, Kerala State Goirfed Employees Congress ( INTUC ) , Alappuzha - 12 2. Shri A. Yakkoob , Machine Assistant, R.C.P. Unit, Coirfed, Alappuzha- 12 in respect of matters mentioned in the annexure to this order ;
And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;
Now, therefore , in exercise of the power1 conferred by section 10 ( 1 ) (c) of the Industria , Disputes Act of 1947 ( Central Act XIV of 1947) the 32

Whether the Machine Assistants in the R.C.P. unit Alappuzha of Kerala State Coir Marketing Federation Limited are eligible and entitled to avail all the holidays enjoyed by other employees and officers of Coirfed?

3. Application dated 14-10-2008 from the General Secretary, T. C. C. Thozhilali Union , Udyogamandal, Ernakulam.
4. Letter No. 1(2) 23473/2008 dated 1-11-2008 from the Labour Commissioner , Thiruvananthapuram .
1. An Industrial Dispute arose between the Managing Director , Travancore Cochin Chemicals Limited, Udyogamandal , Ernakulam and its workman , over the issue of date promotion of Shri P. R. Vikraman , workman and date of refixation ofhis pay. The issue was referred for adjudication to the Industrial Tribunal , Alappuzha as per Government Order read as Second paper above .
2. General Secretary, T.C.C. Thozhilali Union vide his letter read as third paper above, has intimated Government that in the annexure portion of the Government Order read as second paper above, the eligible date of promotion of Shri P. R. Vikraman to the grade of Senior Assistant is wrongly shown on 21-11-2007 instead of 21-11-1997 . Moreover, in the second part in the annexure eligibility of Shri P. R. Vikraman to get his pay refixed with effect from 21-6-1996 in parity with "his junior Shri K. J. Sabu " is wrongly shown as "his Junoir Shri M. J.Sabu".
3. The Labour Commissioner , Thiruvanantha- puram in his letter read as 4th paper above has reported to Government that the date of promotion

as iswrongly given as 21-11-2007 instead of 21-11-1997 and the name of his junior is wrongly given M. J. Sabu instead of Shri K. J. Sabu and reques- tedGovernment to issue appropriate orders correcting the above error .
4. Government have considered the matter and Government Order read accordingly the corrected as follows: above The date eligibility to get promotion will be 21-11-1997 instead of 21-11-2007 and name of the junior will be K. J. Sabu instead of M. J. Sabu in the annexure to the Government Order read as second paper above .
3. The Government Order read as second paper stands modified to the above extent .
(4) G.O. (Rt . ) No. 119/2009/LBR .
Thiruvananthapuram, 29th January 2009 .
Whereas , the Government are of opinion that an industrial dispute exists between 1. M/ s Tata Tea Limited represented by its Executive Director , Cochin, 3 , 2. The Manager , Grahamsland Estate , Munnar and the workmen of the above referred establishment represented by the General Secretary , Devikulam Estates Workers' Union (AITUC) , Reg . No. 122/57 , Munnar P. O. -685 612 , in respect of matters mentioned in the annexure to this order;
And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication ;
Now, therefore , in exercise of the powers conferred by section 10 (1 ) (d) of the Industrial Disputes Act of 1947 ( Central Act XIV of 1947) theGovernment hereby direct that the said industrial dispute be referred for adjudication to the Industrial Tribunal , Idukki . The Industrial Tribunal , will pass the award within a period of three months .
ANNEXURE
Whether the alleged dismissal of workers namely Mookiah- 1623 and Sekhar- 2227 are justifiable or not ? If not what will be the relief entitled to them?
