തിരുവനന്തപുരം ഡിവിഷന്റെ കീഴിലുള്ള താഴെപ്പറയുന്ന റെയിഞ്ചുകളിലെ വിവിധ ഫോറസ്റ്റ് കേസുകളിൽപ്പെട്ട തൊ≠ി തടികൾ, വിറക്, കരി, ഉരുപ്പടികൾ, യന്ത്രസാമഗ്രികൾ മുതലായവ 2009 വർഷത്തിലെ താഴെ കൊടുത്തിരിക്കുന്ന പട്ടികയിൽ അതാതു റെയിഞ്ചിൽ അതിന് നേരെ കാണിച്ചിരിക്കുന്ന തീയതികളിൽ പകൽ 11 മണിക്ക് തിരുവനന്തപുരം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റുദ്യോഗസ്ഥനോ 16-11-1988-ലെ സർക്കാർ ഉത്തരവ് (എം. എസ്.) 100/98/വനം, 4-3-1999-ലെ സർക്കാർ ഉത്തരവ് (എം. എസ്.) 18/99/വനം എന്നീ ഉത്തരവുകളും നിലവിലുള്ള മറ്റ് നിയമങ്ങൾക്കും വിധേയമായി പരസ്യമായി ലേലം ചെയ്തു വിൽക്കുന്നതാണ്. നിർദ്ദിഷ്ട ദിവസം പൊതു അവധിയായി പ്രഖ്യാപിക്കുന്നപക്ഷം അടുത്ത പ്രവർത്തി ദിവസം നി›ിത സമയത്തും സ്ഥലത്തും വച്ച് ലേലം നടത്തുന്നതായിരിക്കും.

ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ ലേല സമയത്തിന് മുമ്പായി തേക്ക് തടികൾക്ക് 10,000 രൂപയും മറ്റു തടികൾക്ക് 5,000 രൂപയും മറ്റു വനവിഭവങ്ങൾക്ക് 1,000 രൂപയും ക്രമത്തിൽ നിരതദ്രവ്യം കെട്ടിവയ്ക്കേ≠താണ്. ലേലത്തിൽ വിളിച്ചിട്ടുള്ള തൊ≠ി സാധനങ്ങളുടെ വില പതിനായിരം രൂപയിൽ കവിയുന്നപക്ഷം ലേലത്തുകയുടെ അഞ്ചിലൊന്ന് ഭാഗമോ പതിനായിരം രൂപയോ ഇതിൽ ഏതാണ് കൂടുതൽ ആയത് അന്ന് ലേലം കഴിഞ്ഞാലുടൻ കെട്ടിവയ്ക്കേ≠താണ്.
എന്നാൽ കോടതി ഉത്തരവനുസരിച്ച് കേസ്സ് നിലവിലിരിക്കേ ലേലം ചെയ്യപ്പെടുന്ന തൊ≠ിത്തടിയുടെ മൊത്തം വില ലേല ദിവസം തന്നെ അടയ്ക്കേ≠താണ്.
ലേലം സ്ഥിരപ്പെടുത്തിയ വിവരം ലേലക്കാരനെ അറിയിക്കുന്ന നോട്ടീസിന്റെ തീയതി മുതൽ 60 ദിവസത്തിനകം ബാക്കി ലേലത്തുകയും നിയമാനുസൃത നികുതികളും മൊത്ത സംഖ്യയ്ക്ക് 1988-ലെ ഫൈനാൻസ് ആക്ട് പ്രകാരമുള്ള ആദായ നികുതിയും ഒടുക്കി ലേലത്തിൽ പിടിച്ചിട്ടുള്ള സാധനങ്ങൾ നീക്കം ചെയ്യേ≠താണ്. ലേലത്തുക ഈ കാലാവധിക്കുള്ളിൽ അടയ്ക്കാതിരുന്നാൽ ലേലം റദ്ദ് ചെയ്യാവുന്നതും ലേലക്കാരൻ168 KERALA GAZETTE [PART III അടച്ചിട്ടുള്ള തുക സർക്കാരിലേക്ക് മുതൽ കൂട്ടുന്നതും ടി ലേലത്തിൽ പിടിച്ച സാധനങ്ങൾ ടിയാന്റെ നഷ്ടോത്തര വാദിത്വത്തിൽ വീ≠ും ലേലം ചെയ്തു വിൽക്കുമ്പോൾ സർക്കാരിന് നഷ്ടം ഉ≠ാവുകയാണെങ്കിൽ അപ്രകാരമുള്ള നഷ്ടം, പരസ്യക്കൂലി മുതലായവ വ്യവസ്ഥയ്ക്കുവിധേയമായി മുൻലേലക്കാരനിൽ നിന്നും ഈടാക്കുന്നതും ലാഭമു≠ാവുകയാ ണെങ്കിൽ ആയതിന് മുൻ ലേലക്കാരന് യാതൊരു അവകാശവും ഇല്ലാത്തതും ആകുന്നു.
ലേലത്തിൽ പങ്കുകൊള്ളാൻ ഉദ്ദേശിക്കുന്നവർ ലേലം തുടങ്ങുന്നതിന് മുമ്പായി ലേലത്തിന് വച്ചിട്ടുള്ള സാധനങ്ങളുടെ നൽപ്പുനിൽപ്പു സ്ഥിതിയും അളവുകളും മറ്റു വിശദവിവരങ്ങളും ബോദ്ധ്യപ്പെട്ടിരിക്കേ≠തും, ലേലത്തിന് ശേഷം ഈ വക കാര്യങ്ങളെക്കുറിച്ചുള്ള യാതൊരു പരാതികളും പരിഗണിക്കു ന്നതല്ലാത്തതുമാകുന്നു. ലേലത്തിന് ശേഷം കാലാവസ്ഥ കാരണമോ അ·ി, വെള്ളപ്പൊക്കം, ഉരുൾപൊട്ടൽ മുതലായ കെടുതികൾമൂലമോ തടി, വിറക്, മറ്റ് സാധനങ്ങൾ എന്നിവയ്ക്കു ≠ാകുന്ന നഷ്ടത്തിനോ അളവ് വ്യത്യാസത്തിനോ ഡിപ്പാർട്ടു മെന്റിന് ഉത്തരവാദിത്വം ഉ≠ായിരിക്കുന്നതല്ല.
ലേലവ്യവസ്ഥകളിൽ എന്തെങ്കിലും മാറ്റങ്ങളോ കൂടിച്ചേർക്കലുകളോ ആവശ്യമായി വരുന്നപക്ഷം ആയത് ലേലത്തിൽ പങ്കെടുക്കുന്നവരെ വായിച്ച് കേൾപ്പിച്ച് ബോധ്യ പ്പെടുത്തുന്നതായിരിക്കും.

It is notified for the information of the public that the Teak Poles and other produce collected by thinning and final felling from the various Teak and MW Plantations of Achencovil Division shall be sold in the public tender/auction on the date, time and places as detailed in the schedule appended below by the Divisional Forest Officer, Anchencovil or any other Officer authorized by him.
The tender/auction will be conducted subject to the terms and conditions of the auction sale of timber in Government Depots and as published by the Chief Conservator of Forests (P), Thiruvananthapuram vide No. Pro. (5)-7698/08 dated 6-12-2008 in Kerala Gazette No. 50 dated 16-12-2008 in Forest Sheet from 481 to 488 and also as14th APRIL 2009] FOREST DEPARTMENT 169 per the existing conditions regarding tender/auction in the Forest Department. Any conditions regarding tender/auction published by the Department after the publication of this notification will also be applicable to this tender/auction. In case the notified dates happen to be a public holiday, the sale will be conducted on the next working day at the notified place and time.
But if the produce could not be sold in full or the tender/auction could not be conducted on that date the produce will be sold on the date specified in the remarks column of the schedule appended.
Intending tenderers/bidders are bound to remit KVAT, K.F.D. Tax, Income Tax and other Taxes in force from time to time. The Government Orders if any regarding the Tender/Auction sale issued after the date of this notification will be applicable for this Tender/Auction also. The works in the above plantations are in good progress. Hence more quantity of produce can be presented than the notified quantity in the proposed tender/auction.

ലേലദിവസം പൊതു അവധിയായി വന്നാൽ അടുത്ത പ്രവൃത്തി ദിവസം നി›ിത സ്ഥലത്തും സമയത്തും ലേലം നടത്തുന്ന താണ്. എന്തെങ്കിലും കാരണവശാൽ ലേലദിവസം ലേലം നടക്കാതെ വരികയോ ഉൽപ്പന്നങ്ങൾ പൂർണ്ണമായും വിൽക്കാൻ കഴിയാതെ വരികയോ ചെയ്താൽ താഴെ പട്ടികയിൽ റിമാർക്ക് കോളത്തിൽ കാണിച്ചിരിക്കുന്ന തീയതിയിൽ ഉൽപ്പന്നങ്ങൾ വീ≠ും പരസ്യമായി ലേലം ചെയ്തു വിൽക്കുന്നതാണ്.
ലേലത്തിൽ പങ്കെടുക്കണമെന്നാഗ്രഹിക്കുന്നവർ ലേലത്തിന് മുൻപായി ഉൽപ്പന്നങ്ങൾ അട്ടിവച്ചിരിക്കുന്നത് പരിശോധിച്ച് അവയുടെ നൽപ്പുനിൽപ്പുകൾ ബോദ്ധ്യപ്പെട്ടുകൊള്ളേ≠താണ്. ഉൽപ്പന്നങ്ങളുടെ ഗുണനിലവാരത്തെ സംബന്ധിച്ച് ലേലത്തിനുശേഷം ഉ≠ാകുന്ന പരാതികൾ പരിഗണിക്കുന്നതല്ല.
ലേലത്തിൽ പങ്കെടുക്കണമെന്നാഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കയ്യൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ സർട്ടിഫിക്കറ്റും ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽനിന്നും വാങ്ങി നിരതദ്രവ്യം കെട്ടിവയ്ക്കുന്നതിനു മുൻപായി ഹാജരാക്കേ≠താണ്.
ഇപ്രകാരമുള്ള സർട്ടിഫിക്കറ്റ് ഹാജരാക്കാത്തവരെ ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.
ലേലക്കാർ അതാതു കാലത്ത് പ്രാബല്യത്തിലുള്ള വിൽപ്പന നികുതിയും വനവികസന നികുതിയും മറ്റ് നികുതികളും കൊടുക്കുന്നതിന് ബാദ്ധ്യസ്ഥരായിരിക്കും. ടി തോട്ടങ്ങളിൽ ജോലികൾ പുരോഗമിക്കുന്നതിനാൽ ഈ വി⁄ാപനത്തിൽ പരസ്യപ്പെ ടുത്തിയതിനേക്കാളും കൂടുതൽ ഉൽപ്പന്നങ്ങൾ പ്രസ്തുത ലേലത്തിൽ വിൽപ്പനയ്ക്ക് പ്രതീക്ഷിക്കാവുന്നതാണ്.

It is hereby notified for the information of public that Tender-cum-Auction sale of Teak Poles, Teak billets, Soft Wood & Firewood (miscellaneous species) collected from the final felling 1943 Teak Plantations at Kallar of Ayyappancoil Range and stacked at Kallar Dumping Depot, under this division as mentioned in the schedule below will be conducted by Divisional Forest Officer, Kottayam or any other Officer authorized by him on the dates specified below subject to the sale conditions published by the Chief Conservator of Forests (P) Thiruvananthapuram vide No. Pro (5) 2613/2008 dated 12-6-2008 in the Kerala Gazette No. 26 dated 24-6-2008.
Conditions mentioned about post offer in this regard are applicable to this auction. Sealed tender for the auction shall be received on or before 9 a. m. on the date of auction. Tender forms costing Rs. 100 will be available from Ayyappancoil Range Office. If the dates of auction happen to be a public holiday or if the sale is not conducted due to some unexpected reasons, like bundh etc. the sale will be conducted on the next working day at the same place and time.
