Qualification of Contractor— 3 years experience in Government or Quasi Government firm.

Period before which works is to be completed— 60 days from the date of agreement for Sl. Nos. 1 to 10 and 30 days from the date of agreement for Sl. Nos. 11 to 15.

The details and necessary documents will be obtained from the Office of the Wildlife Warden, Thiruvananthapuram on any working days till 1 p. m. of tender date. Tender form can be obtained by remitting cash including sale tax with necessary application. The cost of tender form will not be returned. The terms and conditions applicable to tender formalities in Kerala Public Works Department will be applicable to this work also. Tender forms are not transferable. G.O. (P) 84/97/P & T dated 19-8-1997 related to PWD tender is also applicable here. The Earnest Money Deposit will be accepted only as Demand Draft from Nationalized or Scheduled Bank. The Earnest Money Deposit has to be pledged in the name of Wildlife Warden, Thiruvananthapuram and the name of work must be entered on it. A preliminary agreement in Stamp Paper worth Rs.50 in prescribed form should also be submitted along with the tender. The tender without the preliminary agreement will be refused. The successful tender is liable to remit the taxes as per rules. If the tender date becomes holiday, the tender will be conducted on the next working day.

കേരള ഗവർണ്ണർക്കുവേ≠ി തിരുവനന്തപുരം വൈൽഡ് ലൈഫ് വാർഡൻ താഴെ പറയുന്ന പ്രവൃത്തികൾക്ക് ഗുണനിലവാരമുള്ളതും അംഗീകാരമുള്ളതുമായ സാമഗ്രികൾ ഉപയോഗിച്ച് വനം-വന്യജീവി വകുപ്പിലോ മറ്റു വകുപ്പുകളിലോ ഇത്തരം പ്രവൃത്തി ചെയ്ത് മുൻപരിചയമുള്ള കരാറുകാരിൽനിന്നും മത്സരസ്വഭാവമുള്ള ദർഘാസുകൾ പ്രവൃത്തിയുടെ പേര് ആലേഖനം ചെയ്ത മുദ്രവച്ച കവറുകളിൽ 22-1-2010-ന് വൈകുന്നേരം 3 മണിവരെ ക്ഷണിച്ചുകൊള്ളുന്നു. ദർഘാസുകൾ അന്നേദിവസം വൈകിട്ട് 3.30 മണിക്ക് ഹാജരുള്ള കരാറുകാരുടെ സാന്നിദ്ധ്യത്തിൽ തിരുവനന്തപുരം വൈൽഡ് ലൈഫ് വാർഡനോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ തുറക്കുന്നതാണ്. ഏതെങ്കിലും കാരണവശാൽ ടി ടെ≠ർ അന്നേ ദിവസം നടക്കാതെ വന്നാൽ ആയത് 23-1-2010-ന് മേൽപ്പറഞ്ഞ സ്ഥലത്തും സമയത്തും ദർഘാസ് നടത്തുന്നതാണ്.

ദർഘാസ് ഫോറങ്ങളും മറ്റ് വിശദവിവരങ്ങളും തിരുവനന്തപുരം വൈൽഡ് ലൈഫ് ഡിവിഷൻ ആഫീസിൽ നിന്നും ദർഘാസ് സ്വീകരിക്കുന്ന അവസാന ദിവസം 22-1-2010-ന് ഉച്ചയ്ക്ക് ഒരു മണിവരെ ലഭിക്കുന്നതാണ്. ദർഘാസ് ഫോറത്തിന്റെ വില വിൽപ്പന നികുതിയടക്കം രൊക്കം പണമായി അടച്ച് രേഖാമൂലം അപേക്ഷിക്കേ≠താണ്. ദർഘാസ് ഫോറത്തിന്റെ വില യാതൊരു കാരണവശാലും തിരികെ നൽകുന്നതല്ല. ദർഘാസ് പ്രമാണങ്ങൾ കൈമാറ്റം ചെയ്യുവാൻ പാടുള്ളതല്ല. ദർഘാസ് പ്രമാണത്തോടൊപ്പം 50 രൂപ മുദ്രപ്പത്രത്തിൽ പ്രാഥമിക ഉടമ്പടി അടക്കം ചെയ്തിരിക്കേ≠താണ്. നി›ിത നിരതദ്രവ്യം തിരുവനന്തപുരം വൈൽഡ്ലൈഫ് വാർഡന്റെ പേരിൽ πഡ്ജ് ചെയ്തതും പ്രവൃത്തിയുടെ പേര് രേഖപ്പെടുത്തിയിരിക്കേ≠തു മാണ്. മേൽപ്പറഞ്ഞ വ്യവസ്ഥകൾ പാലിക്കാത്തതും നേരിട്ട് സമർപ്പിക്കാത്തതുമായ ദർഘാസുകൾ സ്വീകരിക്കുന്നതല്ല. നിരതദ്രവ്യം പണമായോ ചെക്കായോ ഇന്ദിരാവികാസ് പത്രമായോ സ്വീകരിക്കുന്നതല്ല. നിരതദ്രവ്യം ദേശസാൽകൃത/ഷെഡ്യൂൾഡ് ബാങ്കിലെ ഡി.ഡി.യായി സ്വീകരിക്കുന്നതാണ്. കേരള നിർമ്മാണത്തൊഴിലാളി ക്ഷേമനിധി നിയമമനുസരിച്ച് പ്രവൃത്തി ലഭിക്കുന്ന കരാറുകാരൻ പ്രവർത്തിയുടെ മൊത്തം ചെലവിന്റെ 1% ക്ഷേമനിധിയും നിലവിലുള്ള നിയമമനുസരിച്ചുള്ള മറ്റ് നികുതികളും അടയ്ക്കുവാൻ ബാധ്യസ്ഥനാണ്. ദർഘാസ് സ്വീകരിക്കുന്ന അവസാന ദിവസം പൊതു അവധി പ്രഖ്യാപിച്ചാൽ അടുത്ത പ്രവൃത്തി ദിവസം നി›ിത സമയത്ത് ദർഘാസുകൾ സ്വീകരിക്കുന്നതും തുറക്കുന്നതുമായിരിക്കും.

19-8-1997-ലെ കേരള സർക്കാർ ഉത്തരവ് നമ്പർ ജി. ഒ. (പി) 84/97/പി&റ്റി വ്യവസ്ഥകൾ ഉൾപ്പെടെ പൊതുമരാമത്ത് വകുപ്പിലെ ദർഘാസിനെ സംബന്ധിച്ച എല്ലാ വ്യവസ്ഥകളും ഈ ദർഘാസിനും ബാധകമായിരിക്കും.

പുനലൂർ ഡിവിഷനിലെ അഞ്ചൽ റെയിഞ്ചിൽപ്പെട്ടതും താഴെ പട്ടികയിൽ വിവരിക്കുന്നതുമായ കശുമാവ് തോട്ടങ്ങളിൽ നിന്നും 30-6-2010 വരെയുള്ള കാലത്തേക്ക് കശുവ≠ി ശേഖരിച്ച് നീക്കം ചെയ്യുന്നതിനുള്ള അവകാശം ചുവടെ ചേർത്തിരിക്കുന്ന വ്യവസ്ഥകൾക്ക് വിധേയമായി പട്ടികയിൽ പറയുന്ന സ്ഥലത്തും സമയത്തും പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റുദ്യോഗസ്ഥനോ പരസ്യമായി ദർഘാസ്/ലേലം ചെയ്യുന്നതാണ്. ആദ്യലേലദിവസം എന്തെങ്കിലും കാരണവശാൽ ഏതെങ്കിലും തോട്ടത്തിന്റെ ലേലം നടക്കാതിരിക്കുകയോ, ലേലം കൊള്ളാൻ ലേലക്കാർ ആരും തയ്യാറാകാതെ വരികയോ, ലേലം റദ്ദ് ചെയ്യുകയോ ചെയ്താൽ പട്ടികയിൽ പ്രസിദ്ധീകരിച്ചിട്ടുള്ള അടുത്ത ലേലദിവസങ്ങളിൽ അതേ സ്ഥലത്തും സമയത്തും ലേലം നടക്കുന്നതാണ്. ദർഘാസ്/ലേലദിവസം പൊതു അവധിയായി പ്രഖ്യാപിച്ചാൽ അടുത്ത പ്രവൃത്തി ദിവസം നി›ിത സമയത്തും സ്ഥലത്തും വച്ച് ദർഘാസ്/ലേലം നടത്തുന്നതാണ്. ലേലത്തിന് നി›യിച്ചിട്ടുള്ള തീയതിയ്ക്ക് തലേ ദിവസം 3 മണി വരെ സീൽ ചെയ്ത ദർഘാസുകൾ ഡിവിഷനാഫീസിൽ സ്വീകരിക്കുന്നതാണ്. ദർഘാസ് ഫോറങ്ങൾ ഈ ഓഫീസിൽ നിന്നും വിലയായ 100 (നൂറ്) രൂപയും മൂല്യവർദ്ധിത നികുതിയും ഒടുക്കി വാങ്ങേ≠താണ്.

6. ഏരൂർ സെക്ഷനിലെ ഏഴംകുളം റിസർവ്വ് ഭാഗത്തിന്റെയും തച്ചൻകോണം റിസർവ്വ് ഭാഗത്തിന്റെയും അതിർത്തിയോടു ചേർന്നു നിൽക്കുന്ന 35 മൂട് കശുമാവ് മരങ്ങൾ.

7. ഏരൂർ സെക്ഷനിലെ മറവൻചിറ 1998 പലവക തോട്ടത്തിൽ നിൽക്കുന്ന 700 കശുമാവ് മരങ്ങൾ.

8. മീൻകുളം സെക്ഷനിലെ കല്യാണി ചതുപ്പിൽ ജ≠ായ്ക്കു പുറത്ത് വനത്തിൽ നിൽക്കുന്ന 98 കശുമാവ് മരങ്ങൾ, മേലേ പാണയം ഭാഗത്തുള്ള 9 കശുമാവ് മരങ്ങൾ, നീരാറ്റുതടം ചതുപ്പിൽ നിൽക്കുന്ന 3 മൂട് കശുമാവ് മരങ്ങൾ, ചേറ്റാടി ചതുപ്പിൽ നിൽക്കുന്ന 20 മൂട് കശുമാവ് മരങ്ങൾ (ആകെ 130 എണ്ണം).

9. കളംകുന്ന് സെക്ഷനിൽ 1998 കോമ്പൻസേറ്ററി അഫോറസ്റ്റേഷൻ തോട്ടത്തിൽ നിൽക്കുന്ന 100 കശുമാവ് മരങ്ങൾ നിരതദ്രവ്യം - രൂപ 2,000 ദർഘാസ്/ലേലം നടത്തുന്ന - ഡിവിഷണൽ ഫോറസ്റ്റ് സ്ഥലം ഓഫീസ്, പുനലൂർ.

ലേലത്തീയതിയും സമയവും - 19-1-2010, 11.30. ഉടമ്പടി കാലാവധി - ഉടമ്പടി തീയതി മുതൽ

ആദ്യ ലേല ദിവസം എന്തെങ്കിലും കാരണവശാൽ ഏതെങ്കിലും തോട്ടത്തിന്റെ ദർഘാസ്/ലേലം നടക്കാതിരിക്കു കയോ, ദർഘാസ്/ലേലം വിളികൊള്ളാൻ ലേലക്കാർ ആരും തയ്യാറാകാതെ വരികയോ, ദർഘാസ്/ലേലം റദ്ദ് ചെയ്യുകയോ ചെയ്താൽ 27-1-2010 ടി ദർഘാസ്/ലേലം നി›ിത സ്ഥലത്തും സമയത്തും നടത്തുന്നതാണ്.

വ്യവസ്ഥകൾ

1. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കണമെന്ന് ആഗ്രഹമുള്ളവർ 2,000 രൂപ നിരതദ്രവ്യം ഒടുക്കേ≠തും അപ്രകാരം നിരതദ്രവ്യം ഒടുക്കാത്തവരെ ലേലത്തിൽ പങ്കുകൊള്ളാൻ അനുവദിക്കുന്ന തല്ലാത്തതുമാകുന്നു.

2. ദർഘാസ്/ലേലത്തിൽ പങ്കുകൊള്ളാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കയ്യൊപ്പും സാക്ഷ്യ പ്പെടുത്തിയ ഒരു സർട്ടിഫിക്കറ്റ് ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽ നിന്നും വാങ്ങി നിരതദ്രവ്യം കെട്ടിവയ്ക്കുന്നതിനു മുൻപായി സമർപ്പിക്കേ≠താണ്. ഇപ്രകാരം വില്ലേജാഫീസറുടെ സർട്ടിഫിക്കറ്റ് ഹാജരാക്കാത്തവരെ ലേലത്തിൽ പങ്കുകൊള്ളാൻ അനുവദിക്കുന്നതല്ല.

3. ലേലം കൊ≠യാൾ യൂണിറ്റ് ഒന്നിന് ലേലത്തുകയുടെ മൂന്നിൽ ഒന്ന് (കുറഞ്ഞത് 10,000 രൂപയും പരമാവധി ഒരു ലക്ഷം രൂപയും) ലേലം കഴിഞ്ഞാലുടൻ ഒടുക്കേ≠താണ്. മൊത്തം ലേലത്തുക 10,000 രൂപയോ അതിൽ കുറവോ ആണെങ്കിൽ മുഴുവൻ തുകയും ലേലം കഴിഞ്ഞാലുടനെ തന്നെ ഒടുക്കേ≠താണ്. അതിനു മുടക്കം വരുത്തിയാൽ അയാൾ കെട്ടിവച്ചിട്ടുള്ള നിരതദ്രവ്യം ഗവൺമെന്റിലേക്കു ക≠ു കെട്ടുന്നതും പാട്ടാവകാശം അയാളുടെ പൂർണ്ണനഷ്ടോത്തരവാദി ത്വത്തിൻമേൽ വീ≠ും ലേലം ചെയ്യുന്നതും എന്നാൽ അതിൽ വച്ച് സർക്കാരിന് എന്തെങ്കിലും ലാഭമു≠ായാൽ അതിന് അയാൾക്ക് അവകാശമില്ലാത്തതാകുന്നു. ഇപ്രകാരം ലേലം ചെയ്യുന്നതിൽ വച്ച് സർക്കാരിന് എന്തെങ്കിലും നഷ്ടം ഉ≠ായാൽ ആയത് റവന്യൂ റിക്കവറി നിയമപ്രകാരം ഈടാക്കുന്നതുമാകുന്നു.

4. ലേലം വിജയിക്കുന്ന ആളിന്റെ നിരതദ്രവ്യം അയാൾ ഒടുക്കേ≠തായ ലേലസംഖ്യയിൽ തട്ടിക്കഴിക്കുന്നതും വിജയിക്കാത്തവരുടെ നിരതദ്രവ്യം ലേലം കഴിഞ്ഞാലുടൻ തിരിച്ചു കൊടുക്കുന്നതുമാണ്.

5. ഏറ്റവും കൂടുതൽ തുകയ്ക്ക് വിളികേൾക്കുന്നയാളിന്റെ പേരിൽ ലേലം ഉറപ്പിക്കുന്നതാണ്. എന്നാൽ യാതൊരു കാരണവും കൂടാതെ ലേലം അംഗീകരിക്കുന്നതിനോ നിരാകരിക്കുന്നതിനോ ഉള്ള അധികാരം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് ഉ≠ായിരിക്കുന്നതാണ്. കൂടാതെ പട്ടികയിലെ ഏതെങ്കിലും തോട്ടം ലേലത്തിൽ നിന്നും ഒഴിവാക്കുന്നതിനോ പുതുതായി ഏതെങ്കിലും തോട്ടം കൂടി ഉൾപ്പെടുത്തി ലേലം ചെയ്യുന്നതിനോ ലേലം ചെയ്യുന്ന ഉദ്യോഗസ്ഥന് അധികാരം ഉ≠ായിരിക്കുന്നതാണ്.

6. ലേലം സ്ഥിരപ്പെടുത്തിയതായി പാട്ടക്കാരനെ അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി മുഴുവൻ ലേലത്തുകയും മൊത്തം ലേലത്തുകയുടെ 5% വനവികസന നികുതിയും നിയമാനുസൃത മൂല്യവർദ്ധിത നികുതിയും ഏറ്റവും കുറഞ്ഞത് 500 രൂപയോ ലേലത്തുകയുടെ പത്തു ശതമാനമോ ഏതാണോ കൂടുതൽ അത് സെക്യൂരിറ്റിയായും അടച്ച് 50 രൂപ മുദ്രപ്പത്രത്തിൽ നിലവിലുള്ള വ്യവസ്ഥകൾക്ക് വിധേയമായി ഒരു ഉടമ്പടി എഴുതി ഒപ്പു വയ്ക്കേ≠താണ്. അതിനു മുടക്കം വരുത്തിയാൽ യാതൊരു കാരണവശാലും കാലാവധി ദീർഘിപ്പിച്ചു നൽകുന്നതല്ല. ബാക്കി ലേലത്തുകയും സെക്യൂരിറ്റിയും ഒടുക്കാതിരുന്നാൽ പാട്ടാവകാശം റദ്ദ് ചെയ്യുന്നതും പാട്ടക്കാരൻ നേരത്തെ കെട്ടിവച്ചിട്ടുള്ള മുഴുവൻ തുകയും സർക്കാരിലേക്കു ക≠ു കെട്ടുന്നതുമാണ്. കൂടാതെ പാട്ടാവകാശം, വീഴ്ച വരുത്തിയ Gaz. No. 2/2010/DTP (Forest).

ആളിന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ വീ≠ും ലേലം ചെയ്യുന്നതും അതിൽ വച്ച് എന്തെങ്കിലും നഷ്ടമു≠ായാൽ ആദ്യലേലക്കാരനിൽ നിന്നും നിലവിലിരിക്കുന്ന റവന്യൂ റിക്കവറി നിയമപ്രകാരമോ യു‡മായ മറ്റു മാർഗ്ഗങ്ങളിലൂടെയോ ഈടാക്കുന്നതുമാണ്.

7. ലേലത്തിൽ പങ്കെടുക്കുന്നയാൾ ലേലത്തിനു മുൻപ് കശുമാവിൻ തോട്ടങ്ങൾ നേരിൽക്ക≠് പരിശോധിച്ച് വിളകളുടെ ഗുണവും തരവും നല്ലതുപോലെ ബോദ്ധ്യപ്പെട്ടുകൊള്ളേ≠തും ലേലത്തിനുശേഷം ഉ≠ാകുന്ന പരാതികൾ സാധാരണ ഗതിയിൽ പരിഗണിക്കുന്നതല്ലാത്തതുമാകുന്നു.

8. ലേലം വിളികേൾക്കുന്നയാൾ ലേലത്തിന് ഒരു പൂർണ്ണ തീരുമാനമു≠ാകാതെ പിൻമാറാൻ പാടില്ലാത്തതും അപ്രകാരം പിൻമാറിയാൽ ഡിപ്പാർട്ടുമെന്റിന് വരുന്ന നഷ്ടത്തിന് അയാൾ ഉത്തരവാദിയാകുന്നതുമാണ്. ലേലപ്പരസ്യ വി⁄ാപന വ്യവസ്ഥകൾ ക≠് ബോദ്ധ്യപ്പെട്ട് ഒപ്പിട്ട് തരുന്നവർക്ക് 9-3-1976-ലെ സർക്കാർ ഗസറ്റിൽ പരസ്യപ്പെടുത്തിയിട്ടുള്ള 23-2-1976-ലെ സർക്കാർ ഓർഡർ ജി.ഒ.(പി) 62/76/എ.ഡി. യിലെ നിബന്ധനകളും 28-12-2004-ലെ 51-ാം നമ്പർ കേരള ഗസറ്റിൽ 473 മുതൽ 477 വരെയുള്ള പേജുകളിൽ പ്രസിദ്ധീകരിച്ചിട്ടുള്ള സി. സി. എഫ്. (പി) യുടെ 4-12-2004-ലെ സി2-27223/2004-ാം നമ്പർ ഉത്തരവിലെ നിബന്ധനകളും ബാധകമാണ്.

9. ലേലക്കാരൻ കേന്ദ്രഗവൺമെന്റ ിന്റെ 1995-ലെ ഫൈനാൻസ് ആക്ട് പ്രകാരമുള്ള ആദായ നികുതി നി›ിത സമയത്തും നിരക്കിലും നൽകാൻ ബാദ്ധ്യസ്ഥനാണ്.

10. ലേലത്തിൽ വിജയിക്കുന്ന പാട്ടക്കാരൻ മുഴുവൻ കശുവ≠ിയും ശേഖരിച്ച് സർക്കാർ തീരുമാനത്തിനു വിധേയ മായി കേരള കാഷ്യൂ ഡവലപ്മെന്റ ് കോർപ്പറേഷനോ അവരുടെ അംഗീകൃത ഏജന്റുമാർക്കോ അതാത് കാലയളവിൽ ഗവൺമെന്റ ് അംഗീകരിക്കുന്ന വിലയ്ക്ക് നൽകേ≠താണ്. കൂടാതെ കശുവ≠ി സംഭരണവും വിതരണവും സംബന്ധിച്ച് അതാത് കാലങ്ങളിൽ ഗവൺമെന്റ ് പുറപ്പെടുവിക്കുന്നതായ എല്ലാ ഉത്തരവുകളും പാട്ടക്കാരന് ബാധകമാണ്.

11. കരാറുകാരൻ ആവശ്യപ്പെടുന്ന പക്ഷം ടിയാന്റെ കൂലിക്കാരെ താമസിപ്പിക്കുന്നതിനും കശുവ≠ി സൂക്ഷിക്കുന്ന തിനും സ്ക്വയർ മീറ്ററിന് 5 രൂപ പ്രകാരം ഒരു ഷെഡ് കൂപ്പിനുള്ളിൽ പണിയുന്നതിന് സ്ഥലം അനുവദിക്കുന്നതാണ്. ഷെഡ് അനുവദിക്കുന്നതിനുള്ള അവകാശം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറിൽ നിക്ഷിപ്തമാണ്. കരാർ കാലാവധിക്കു മുൻപായി ഷെഡ് കരാറുകാരൻ പൊളിച്ച് നീക്കം ചെയ്യേ≠ താണ്. ഷെഡ് പണിയുന്നതിനുള്ള സാധനങ്ങൾ നിലവിലുള്ള സീനിയറേജ് റേറ്റ് പ്രകാരം കാട്ടിൽ നിന്നും സൗകര്യമുള്ള പക്ഷം ശേഖരിക്കുവാൻ അനുവദിക്കുന്നതാണ്.

12. കരാർ കാലയളവിൽ എല്ലായ്പ്പോഴും കശുമാവുകൾക്ക് ചുറ്റു മുള്ള കാടുകൾ 5 മീറ്റർ ചുറ്റളവിൽ കരാറുകാരന്റെ ചുമതലയിൽ വെട്ടി നീക്കം ചെയ്തിരിക്കണം. വീഴ്ചവരുത്തിയാൽ യു‡മായ പിഴ കരാറുകാരനിൽ നിന്നും ഈടാക്കുന്നതാണ്.

13. തോട്ടത്തിൽ യാതൊരു കാരണവശാലും തീപിടിക്കാതെ നോക്കി സംരക്ഷിക്കേ≠ത് കരാറുകാരന്റെ പ്രധാന ചുമതല യാണ്. കാട്ടുതീ മൂലമോ, ഉണക്കുമൂലമോ മറ്റു വിധത്തിലുള്ള വല്ല നഷ്ടവും നേരിട്ടാൽ ആയതിന് യാതൊരുവിധ നഷ്ടപരി ഹാരത്തിനും കരാറുകാരന് അവകാശം ഉ≠ായിരിക്കുന്നതല്ല.

14. കശുവ≠ി ശേഖരിച്ചതിന്റെ വിവരങ്ങളടങ്ങിയ പ്രതിമാസ കണക്കുകൾ ഓരോ മാസവും 5-ാം തീയതിയ്ക്കു മുൻപായി ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസർക്കും ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്കും സമർപ്പിക്കേ≠താണ്. അതിന് വീഴ്ച12th JAN. 2010] FOREST DEPARTMENT 25 വരുത്തുന്ന പക്ഷം ഓരോ വീഴ്ചയ്ക്കും 10 രൂപാ വീതം പിഴ വസൂൽ ചെയ്യുന്നതാണ്.

15. ശേഖരണം നടത്തിയ കശുവ≠ി കടത്തിക്കൊ≠് പോകു ന്നതിന് ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസറിൽ നിന്നും നിർബന്ധ മായും പാസ്സ് വാങ്ങേ≠താണ്. വീഴ്ച വരുത്തിയാൽ ഉചിതമായ പിഴ ഈടാക്കുന്നതാണ്.

16. ലേലത്തിനു ശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ വനം വകുപ്പിലെ നിലവിലുള്ള നിബന്ധനകൾക്ക് വിധേയമായി പരിഗണിക്കുന്നതാണ്.

The filed up tenders will be received in this office upto 3 p. m. on 21-1-2010 and opened by the undersigned or an officer authorised for the purpose on the same day at 3.30 p. m. at the office of Divisional Forest Officer, Ranni in the presence of the contractors attending on the date. If the due date happens to be a holiday, the next working day will be the due date.

The tender forms are not transferable. The earnest money deposit noted aginst the work should be paid along with the tenders by Demand Draft (Cheques will not be acceptable) pledged in favour of the undersigned payable26 KERALA GAZETTE [PART III at any nationalized Bank/Scheduled bank. Incomplete tenders and tenders without EMD are liable to be rejected. The undersigned reserves the right to reject any tender without assigning any reasons thereof and also reserve the right to exclude any of the works for the tender. ദർഘാസ് ഫോറങ്ങളും ജോലികളെ സംബന്ധിക്കുന്ന വിവരങ്ങളും ദർഘാസ് ഫോറത്തിന്റെ വിലയും വിൽപ്പന നികുതിയും അടച്ച് അപേക്ഷിക്കുന്നവർക്ക് ദർഘാസ് സ്വീകരിക്കുന്ന അവസാന തീയതിയായ 21-1-2010 1 മണി വരെ ഈ ഓഫീസിൽ നിന്നും ലഭിക്കുന്നതാണ്. പൂരിപ്പിച്ച ദർഘാസുകൾഅന്നേ ദിവസം 3 മണിവരെ ഈ ആഫീസിൽ സ്വീകരിക്കുന്നതാണ്. ദർഘാസ് ഫോറത്തിന്റെ വില മടക്കി കൊടുക്കുന്നതല്ല. ടി ദിവസം പൊതു അവധിയായി വരുന്ന പക്ഷം അടുത്ത പ്രവർത്തി ദിവസം ടി സ്ഥലത്തും സമയത്തും വച്ച് ദർഘാസുകൾ സ്വീകരിക്കുന്നതും തുറക്കുന്നതുമായിരിക്കും. ദർഘാസ് സ്വീകരിക്കുന്ന അവസാന തീയതിയായ 21-1-2010 3.30-ന് ഹാജരുള്ള കരാറുകാരുടെ സാന്നിദ്ധ്യത്തിൽ താഴെ ഒപ്പിട്ടിട്ടുള്ള ആളോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ ടെ≠റുകൾ തുറക്കുന്നതായിരിക്കും. ദർഘാസ് ഫോറങ്ങൾ കൈമാറ്റം ചെയ്യുവാൻ പാടുള്ളതല്ല.

മൂന്നാർ ഡിവിഷനിൽപ്പെട്ട നേര്യമംഗലം, അടിമാലി, മൂന്നാർ, ദേവികുളം എന്നീ റെയിഞ്ചുകളിൽ സൂക്ഷിച്ചിട്ടുള്ള വിവിധ വന നിയമ കേസ്സുകളിലെ തൊ≠ി സാധനങ്ങൾ താഴെ പട്ടികയിൽ അതാതു റെയിഞ്ചിനു നേരെ കാണിച്ചിട്ടുള്ള തീയതികളിൽ പകൽ 11 മണിക്ക് മൂന്നാർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റ് ഉദ്യോഗസ്ഥനോ പട്ടികയിൽ കാണിച്ചിരിക്കുന്ന സ്ഥലത്ത് വെച്ച് പരസ്യമായി ലേലം ചെയ്ത് വിൽക്കുന്നതായിരിക്കും. ലേല ദിവസം പൊതു ഒഴിവ് ദിവസമായി വന്നാൽ പ്രസ്തുത ലേലം അടുത്ത പ്രവർത്തി ദിവസം നി›ിത സമയത്തും സ്ഥലത്തും വെച്ച് നടത്തുന്നതായിരിക്കും. നി›ിത ലേല തീയതിയ്ക്ക് മുമ്പ് തന്നെ ലേലത്തിൽ ഉൾപ്പെടുത്തുന്ന ലേല വസ്തുക്കളുടെ ഇനം, അളവ് മുതലായവ ലോട്ട് തിരിച്ചുള്ള തൊ≠ി വസ്തുക്കൾ നേരിൽ പരിശോധിച്ച് ബോദ്ധ്യ പ്പെടേ≠താണ്. ലേലത്തിന് ശേഷം ഇത് സംബന്ധമായ പരാതികൾ പരിഗണിക്കുന്നതല്ല.

ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ ലേല ത്തിന് മുമ്പായി തേക്ക്, ഈട്ടി എന്നിവയ്ക്ക് 10,000 (പതിനായിരം) രൂപയും മറ്റ് തടികൾക്ക് 5,000 (അയ്യായിരം) രൂപയും മറ്റ് വന വിഭവങ്ങൾക്ക് 1,000 (ആയിരം) രൂപയും നിരതദ്രവ്യമായി കെട്ടിവയ്ക്കേ≠തും ലേലം വിളി കേൾക്കുന്നയാൾ ലേലം കഴിഞ്ഞാലുടനെ തന്നെ ലേലത്തുകയുടെ അഞ്ചിലൊന്ന് നിരതദ്രവ്യം ഉൾപ്പെടെ അടയ്ക്കേ≠തുമാണ്. ലേലത്തുക 10,000 (പതിനായിരം) രൂപയോ അതിൽ കുറവോ ആണെങ്കിൽ മൊത്തം ലേലത്തുകയും. ലേലത്തുക 10,000 (പതിനായിരം) രൂപയിൽ കവിയുകയാണെങ്കിൽ 10,000 (പതിനായിരം) രൂപയോ ലേലത്തുകയുടെ അഞ്ചിലൊന്ന് ഭാഗമോ ഏതാണ് കൂടുതലെങ്കിൽ ആയത് കഴിഞ്ഞയുടനെ അട്ക്കേ≠താണ്. കോടതി ഉത്തരവ് അനുസരിച്ച് ലേലം ചെയ്യപ്പെടുന്ന തൊ≠ിയുടെ മൊത്തം വിലയും ലേല ദിവസം തന്നെ അടയ്ക്കേ≠താണ്.

ലേലത്തിൽ പിടിച്ചെടുത്ത സാധനങ്ങൾ ലേലം സ്ഥിരപ്പെടുത്തിയ വിവരം ലേലക്കാരനെ അറിയിക്കുന്ന തീയതി മുതൽ 30 (മുപ്പത്) ദിവസത്തിനകം ബാക്കി വിൽപ്പന നികുതിയും 5% വനവികസന നികുതിയും മൊത്തം സംഖ്യയ്ക്ക് 1988 ലെ ഫൈനാൻസ് ആക്ട് പ്രകാരമുള്ള ആദായ നികുതി മുതലായവ അടച്ച് ലേലത്തിൽ പിടിച്ചിട്ടുള്ള സാധനങ്ങൾ നീക്കം ചെയ്യാതിരുന്നാൽ ലേലം സ്ഥിരപ്പെടുത്തിയതായി അറിയിക്കുന്ന തീയതി മുതൽ 60 (അറുപത്) ദിവസത്തിനകമുള്ള അവധികൂടി തറവാടക ഈടാക്കിക്കൊ≠് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അനുവദിക്കാവുന്നതാണ്. മേൽപ്പറഞ്ഞ സമയത്തിനുള്ളിൽ സാധനങ്ങൾ നീക്കം ചെയ്യാതിരുന്നാൽ ആ വക സാധനങ്ങൾ മറ്റൊരു അറിയിപ്പ് കൂടാതെ തന്നെ സർക്കാരിലേക്ക് മുതൽ കൂട്ടുന്നതും അവയിൽ ലേലക്കാരന് യാതൊരു വിധ അവകാശങ്ങളും ഉ≠ായിരി ക്കുന്നതുമല്ല.

ബാക്കി സംഖ്യ 30 ദിവസത്തിനകം അടക്കാതിരുന്നാൽ ന്യായമായ കാരണങ്ങളാൽ 30 (മുപ്പത്) ദിവസം കൂടി 18% (പതിനെട്ട് ശതമാനം) പലിശയോടും നിയമപ്രകാരമുള്ള തറവാടകയോടുംകൂടി അടയ്ക്കുവാൻ അനുവാദം നൽകുന്നതാണ്. അതിനുശേഷം യാതൊരു കാരണവശാലും ബാക്കിസംഖ്യ അടയ്ക്കുന്നതിനുള്ള കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല. ലേലത്തുക ഈ കാലാവധിക്കുള്ളിൽ അടയ്ക്കാതിരുന്നാൽ ലേലം ചെയ്ത സാധനങ്ങൾ അയാളുടെ നഷ്ടോത്തരവാദിത്വത്തിൽ വീ≠ും ലേലം ചെയ്ത് വിൽക്കുന്നതാ യിരിക്കും. അപ്രകാരം ലേലം ചെയ്യുമ്പോൾ ഉ≠ാകുന്ന നഷ്ടം നിലവിലുള്ള വ്യവസ്ഥകൾക്ക് വിധേയമായി റവന്യൂ കുടിശ്ശിക വസൂൽ ചെയ്യുന്ന നിയമങ്ങളനുസരിച്ച് മുൻ ലേലക്കാരനിൽ നിന്നും ഈടാക്കുന്നതും ലാഭകരമായിരുന്നാൽ മുൻലേലക്കാരന് ടി ലേലത്തിൽ യാതൊരു അവകാശവും ഇല്ലാത്തതുമാകുന്നു. ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ 16-12-2008-ലെ 50-ാം നമ്പർ കേരള സർക്കാർ ഗസറ്റിൽ 6-12-2008-ലെ പ്രൊ. TENDER-CUM-AUCTION SALE NOTICE

The Divisional Forest Officer, Sandal Division Marayoor reserves the right to exclude any class or quantity of Sandal wood shown in the schedule above from sale. The tenderer/bidder should produce a certificate issued by the concerned District Magistrate to prove his identity, permanent address, signature and photo. They should produce an attested photo copy of the Electoral Identity Card also. Those who fail to produce the Identity Certificate as above will not be allowed to participate in the sale. Each tenderer/bidder must deposit, before being permitted to participate in the sale, an EMD of Rupees Fifty Thousand and sign the sale notice in token of acceptance of the sale conditions. The lot number and the rate should be legibly written in the tender form both in figures and words. The successful tenderer/bidder should remit the full sale value if the tender/bid value is less than Rupees Fifty thousand only. If the tender/bid value is more than Rupees Fifty Thousand, 35% of the sale value, subjected to a minimum of Rupees fifty thousand and a maximum of Rupees Two Lakh and fifty thousand, should be remitted on the date of action either in cash or as nationalised Bank Demand Draft drawn in favour of the Forest Range Officer, Marayoor and payable at State Bank of Travancore, Munnar Branch. If the 35% of the sale value is more than Rupees Two Lakh and Fifty Thousand, the balance amount should be remitted within seven days from the date of action in the Sub Treasury, Devikulam and the receipted chalan should be produced before the Forest Range Officer, Marayoor.

Value added Tax @ 12.5 % will be applicable to all successful bidder/tenderer irrespective of the destination of transportation and purpose.

The following quantities of cleaned sandalwood (billets, roots and chips), sandal saw dust and sandal powder stacked and stored at Government Sandal Depot Godown in Marayoor Range will be offered for sale by tender-cum-action at 10 a.m. on 3rd February, 2010 at the Government Sandal Depot, Marayoor (Marayoor is situated at Munnar-Udumalpet Road 42 Kms. North East of Munnar and 45 Kms. South West of Udumalpet) by the Divisional Forest Officer, Sandal Divsion, Marayoor or any other officer authorized for the purpose in the presence of the Chief Conservator of Forests and the Conservator of Forests, High Range Circle Kottayam as per sale conditions notified in the tender- cum-auction notification, the general sale conditions to be published/published in Kerala Gazette No. 50 dated 22-12-2009 vide notification No. Pro-(5)-6835/2009 dated 2-12-2009 of The Chief Conservator of Forests (Protection), Thiruvananthapuram and the approved general sandal sale conditions published in Kerala Gazette No. 41 dated 14-10-2008 vide notification No. MDE-3991/07 dated 17-9-2008 of the Divisional Forest Officer, Sandal Division, Marayoor. If the tender-cum-auction cannot be conducted on the tender-cum-action day due to unavoidable reasons, it will be conducted on the next working day at the appointed venue and time. The tender forms will be available for sale at Forest Range Office, Marayoor one week before the date of action at a price of Rs. 100+VAT. The sale of tender forms will be closed at 8 a.m. on the date of auction. The sealed tender will be accepted in Forest Range Office, Marayoor until 9 a. m. of the date of auction. The tenders received after the specified time will be rejected. The incomplete and defective tender forms will also be rejected. The tenderer should clearly record the lot numbers as well as the rate offered for each lot which are intended to be purchased. The tenderer should properly sign in tender forms.

If any modifications or change in the sale conditions are intimated by the Cheif Conservator of Forests (protection), Thiruvananthapuram that will also be applicable to this tender-cum-auction sale and it will be informed to the bidder/tenderer before tender-cum-auction. (5) 6835/2009 തീയതി 2-12-2009 പ്രകാരം 22-12-2009-ലെ 50-ാം നമ്പർ കേരള ഗസറ്റിൽ പ്രസിദ്ധപ്പെടുത്തിയിട്ടുള്ള ലേല നിബന്ധനകൾ ഈ ലേലത്തിനും ബാധകമായിരിക്കും. കൂടാതെ, കാലാകാലങ്ങളിൽ ഇത് സംബന്ധിച്ച് പുറപ്പെടുവിക്കുന്ന സർക്കാർ ഉത്തരവുകളും ലേലത്തിന് ബാധകമാകുന്നതാണ്.

ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ ഈട്ടി, തേക്ക് എന്നിവയ്ക്ക് 20,000 രൂപയും മറ്റ് തടികൾക്ക് 10,000 രൂപയും മറ്റ് വന വിഭവങ്ങൾക്ക് 2,000 രൂപയും എന്ന നിരക്കിൽ നിരതദ്രവ്യം കെട്ടിവെയ്ക്കേ≠താണ്. ലേലത്തിൽ പിടിച്ചതും സ്ഥിരപ്പെടു ത്തിയതുമായ വനവിഭവങ്ങൾ അവയുടെ ബാക്കി വിലയും നിലവിലുള്ള വിൽപ്പന നികുതിയും വനവികസന നികുതിയും ആദായ നികുതിയും ഒടുക്കി, ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 40 ദിവസത്തിനകം സ്ഥലത്തുനിന്നും നീക്കം ചെയ്യേ≠താണ്.

ലേലത്തീയതിക്ക് മുമ്പു തന്നെ, ലേലത്തിൽ ഉൾപ്പെടുത്തിയിട്ടുള്ള വനവിഭവങ്ങളുടെ അളവ്, ഗുണനിലവാരം മുതലായവ ലേലക്കാർ ക≠് ബോദ്ധ്യപ്പെടേ≠താണ്. ഇതു സംബന്ധിച്ച് ലേലത്തിനുശേഷം യാതൊരുവിധ പരാതികളും പരിഗണിക്കുന്നതല്ല.

കോടതി ഉത്തരവ് വാങ്ങി ലേലം ചെയ്യുന്ന തടികളുടെ മുഴുവൻ തുകയും നിയമനുസൃതമായ നികുതികളും ലേലത്തീയതിയിൽ തന്നെ കെട്ടിവയ്ക്കേ≠താണ്.

TENDER NOTICE

Sealed tenders are invited from eligible approved contractors registered in Public Works Department for execution of the following civil work in Kerala Forest School, Walayar as shown in the schedule given below.

SCHEDULE

Name of Work and Probable Amount of Contract— Construction of protection wall around the outer boundaries of Kerala Forest School, Walayar during 2009-10—Rs. 9,26,000.

Earnest Money Deposit—2.5%

Cost of tender forms—Rs. 700 + VAT.

Site of work proposed—Kerala Forest School, Walayar, Palakkad District.

Period of completion of work—Two months from the date of execution of agreement.

Sealed tenders will be accepted till 3 p.m. on 20-1-2010 at Kerala Forest School, Walayar. The tender will be opened by the Principal, Kerala Forest School, Walayar or the officer authorized by him on the same day at 3.30 p.m. in the presence of tenderers who are present on the occasion. The tenders received after the specified date and time will not be accepted. The tenders should be accompanied by E.M.D. pledged in favour of the Principal, Kerala Forest School, Walayar. The same should be enclosed with tender papers after affixing necessary stamps and the name of the work has to be superscribed on the cover. The tender without adequate E.M.D. will be rejected. If the tender could not be conducted on the above mentioned date, re-tender shall be conducted on next working day at the same place and time. The opening authority reserves the right to reject any or all of the tenders for valid reasons.

The tender forms can be had from the office of the Principal, Kerala Forest School, Walayar on any working day during the office hours upto 3 p.m. on 19-1-2010. The cost of tender forms should be remitted in cash. The tender forms shall be issued by the persons in whose name it is used and the same is not transferable. The price of tender forms will not be refunded on any account.

If the work has to be entrusted to any other person due to the elusion of the original contractor or due to any other such reasons, the original contractor will be held responsible for all kinds of loss sustained to Government in this regard. Such losses shall be recovered from the original contactor and for that purpose each tenderers shall enclose necessary undertaking in stamp paper worth Rs. 50 along with the tender schedules at the time of its submission. For receiving the tender forms, contractors have to show the original Public works Department Registration Cards and the Registration Certificate issued from the Commercial Tax Department. If the last day fixed for submitting the tender papers happens to be public holiday, then the next working day will be considered as the last day for submission of tenders.

All the prevailing conditions of Public works department with regard to tenders for executing civil works will be binding for this work also. The Sales Tax, Construction Workers Welfare Fund Deductions, Income Tax etc., will be recovered from the bill before making payments to the contractor. പൂരിപ്പിച്ച ദർഘാസുകൾ 20-1-2010 പകൽ 3 മണി വരെ കേരള ഫോറസ്റ്റ് സ്കൂൾ, വാളയാറിന്റെ ഓഫീസിൽ സ്വീകരിക്കുന്നതാണ്. അവ അന്നേ ദിവസം പകൽ 3.30 മണിക്ക് തദവസരത്തിൽ ഹാജരുള്ള ദർഘാസുകാരുടെ സാന്നിദ്ധ്യത്തിൽ പ്രിൻസിപ്പാളോ, അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ തുറക്കുന്നതാണ്. നി›ിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ദർഘാസുകൾ സ്വീകരിക്കുന്നതല്ല. നിരതദ്രവ്യം വാളയാർ കേരള ഫോറസ്റ്റ് സ്കൂൾ പ്രിൻസിപ്പാളുടെ പേരിൽ πഡ്ജ് ചെയ്ത് ആവശ്യമായ സ്റ്റാമ്പ് പതിപ്പിച്ച് ഒപ്പിട്ട് പ്രവൃത്തിയുടെ പേരെഴുതി ദർഘാസിനോടൊപ്പം അടക്കം ചെയ്തിരിക്കണം. ശരിയായ രീതി യിൽ നിരതദ്രവ്യം ഇല്ലാത്ത ദർഘാസുകൾ നിരസിക്കപ്പെടുന്നതാണ്. ഏതെങ്കിലും കാരണവശാൽ മേൽ ദിവസം ദർഘാസ് നടത്താൻ കഴിയാത്ത സാഹചര്യം വന്നാൽ പുനർ ദർഘാസ് അടുത്ത പ്രവൃത്തി ദിവസം നി›ിത സ്ഥലത്തും സമയത്തും നടത്തുന്നതായിരിക്കും.

ദർഘാസ് ഫോറവും മറ്റ് വിവരങ്ങളും വാളയാർ കേരള ഫോറസ്റ്റ് സ്കൂൾ പ്രിൻസിപ്പാളുടെ ആഫീസിൽ നിന്നും 19-1-2010-ന് 3 മണിവരെ ലഭിക്കുന്നതാണ്. ആയതിന് രേഖാമൂലം അപേക്ഷിക്കേ≠താണ്. ദർഘാസുകൾ അന്യോന്യം കൈമാറാൻ പാടുള്ളതല്ല. ദർഘാസ് പ്രമാണങ്ങളുടെ വില യാതൊരു കാരണവശാലും തിരികെ ലഭിക്കുന്നതല്ല.

ദർഘാസുകൾ സ്വീകരിച്ചശേഷം പ്രവൃത്തി ലഭിച്ച കരാറു കാരൻ എഗ്രിമെന്റ ് വയ്ക്കാതെ ഒഴിഞ്ഞു മാറുകയാണെങ്കിൽ ഈ കാരണം കൊ≠് പ്രസ്തുത പ്രവൃത്തി വേറെ കരാറു കരനെ ഏൽപ്പിക്കേ≠ി വരികയോ, അല്ലെങ്കിൽ മറ്റ് ഏതെങ്കിലും തരത്തിലോ സർക്കാരിനു≠ാകുന്ന എല്ലാ കഷ്ടനഷ്ടങ്ങൾക്കും ഇത്തരത്തിൽ ഒഴിഞ്ഞു പോകുന്ന കരാറു കാരൻ ഉത്തരവാദിയായിരിക്കും. അപ്രകാരം ഉ≠ായേക്കാവുന്ന കഷ്ടനഷ്ടങ്ങൾ ആദ്യ കരാറുകാരനിൽ നിന്നും ഈടാക്കുന്ന തിന് 50 രൂപ മുദ്രപത്രത്തിൽ ഒരു സമ്മതപത്രം എഴുതി ദർഘാസ് സഹിതം എല്ലാവരും ഏൽപ്പിക്കേ≠താണ്. ദർഘാസ് ഫോറങ്ങൾ ലഭിക്കുന്നതിന് പൊതുമരാമത്ത് വകുപ്പ് രജിസ്ട്രേഷൻ കാർഡ്, വില്പന നികുതി രജിസ്ട്രേഷൻ സർട്ടിഫിക്കറ്റ് എന്നിവ കാണിക്കേ≠താണ്. ദർഘാസുകൾ സമർപ്പിക്കാവുന്ന അവസാന ദിവസം ഒരു പൊതു അവധി യായി വരുന്ന പക്ഷം അടുത്ത പ്രവൃത്തി ദിവസം ദർഘാസ് സമർപ്പിക്കേ≠ അവസാന ദിവസമായി കണക്കാക്കുന്നതാണ്.

As part of enforcing forest protection in Nelliyampathy area, MLA fund has been provided by Sri V. Chenthamarakshan, MLA of Kollengode Legislative Constituency to the Forest Development Agency, Nemmara it has been proposed to construct watch towers at Ayyappanthittu and Cherunelli area of Nemmara- Nelliyampathy Road. The fund for this has been allotted to the Chief Executive Officer, Forest Development Agency and Divisional Forest Officer, Nemmara as per Order No. RD/3/2646/08 dated 2-11-2009 of District Collector, Palakkad. For the work sealed tenders are invited from registered and experienced P.W.D. contractors for and on behalf of the Governor of Kerala by the Divisional Forest Officer, Nemmara for the execution of the following works shown in the schedule furnished below. Sealed covers superscribing the name of the work will be opened in the presence of the available contractors by the Divisional Forest Officer, Nemmara or any other officer authorized by him at the stipulated place and time as shown in the schedule. The tender forms will be supplied to the contractors only The EMD noted against each works should be paid along with the tender form by fixed Deposit Certificates or DD drawn at any Nationalized Bank at Nemmara in favour of Divisional Forest Officer, Nemmara. A Preliminary agreement in the prescribed format in Kerala Government Stamp Paper worth Rs. 50 should be attached with the tender. Incomplete tender or the tender without the required EMD and preliminary agreement are liable to be rejected. The Divisional Forest Officer, Nemmara reserves the right to reject any tender without assigning any reasons. All the rules and regulations regarding tender in force in PWD and Forest Department are applicable to this tender also. The Divisional Forest Officer will be at his liberty to exclude any of the works mentioned in the schedule from the tender.

The successful tenderer should execute the agreement and commence the work within 15 days from the date of receipt of work order. If he fails to execute the agreement and to execute the work, the work will be re-tendered at the risk and loss of the original bidder or execute departmentally.

CONDITIONS

1. The terms and conditions fixed for 'B' Category contractors should also be binding to them for acceptance of tenders for this work.

2. The conditions embodied in this notification form part and parcel of the agreement to be executed for the work tendered for.

3. Tender forms can be had from the Divisional Forest Officer, Palakkad on payment of the cost and VAT shown in the schedule, hereto on any working day during the office hours upto 1 p.m. on 21-1-2010. The tender form shall be used only by the persons in whose name it is issued and for the works specified in the schedule given below.

4. The tenderers shall fill in the tender forms purchased from this office and submit the same together with all the pages intact. Tenders should be addressed in a sealed cover with the name of the work clearly written thereon, to the Divisional Forest Officer, Palakkad so as to reach him in his office at Palakkad before 2 p.m. on 21-1-2010. Sealed tenders will be opened by the Divisional Forest Officer at 3 p.m. on the same day in the presence of such of the tenderers who opt to be present on the occasion.

5. If the last date fixed for the receipt of the tenders happens to be a holiday, the tenders will be received and opened on the next working day at the same time and place as per the conditions specified above.

6. The tenders received after the specified date and time, without the requisite enclosures or tenders not written up in the proper order or form etc. will be rejected.

7. Each tender should be accompanied by a Fixed Deposit Receipt obtained from a scheduled bank for the amount mentioned in the schedule in favour of the Divisional Forest Officer, Palakkad as Earnest Money Deposit for the work.

8. Tenderers should quote uniform percentage of the departmental basic rate at which they can take up the work speci- fied in the schedule both in figures and words. Fraction of one per cent should not be quoted.

9. All the corrections in the tender forms should be initialed by the tenderer himself.

10. In case more than one tenderer quoted the same lowest rate the successful lowest bidder will be decided in an auction among the tenderers who quoted the same lowest rate.

11. If any of the lowest tenderer is not prepared to reduce rate in the auction without fraction of one per cent it will be opened to the confirming authority to draw the tender by lots among or between the lower tenderers.

12. The lowest tender will ordinarily be accepted, provided the character and financial status of the tenderers are found satisfactory, but the authority competent to accept the tender reserves himself the powers of accepting or rejecting any tender without assigning any reason thereof. There shall be no appeal against such action.

13. Rule notified as per G.O. (P) 62/76/AD dated 23-2-1976 and published in the Gazette dated 9-3-1976 and general sale condition as per Pro. 5-6835/09 dated 2-12-2009 of Chief Conservator of Forests, Published in the Gazette No. 50 dated 22-12-2009. Shall be binding on any person who makes a written tender for the works.

14. Tender submitted by timber merchants, sale coupe contractors and other persons who are engaged in timber trade within the limits of the forest division in which working area is situated or by the adjacent divisions will not be accepted.

15. The tenderers should have no relationship on any Government servant who is in charge of the work or who has any direct control over the work. Relationship in this case will mean father, mother, daughter, son, brother, sister, direct uncle, nephew, father-in-law, mother-in-law and the first cousin of the officers concerned.

16. The Earnest Money Deposit of unsuccessful tenderers will be returned to them soon after opening the tenders.

17. Before submitting the tender, the tenderer, is expected to study and scrutinize all the conditions in the agreement to be executed, the draft of which can be had for perusal from the Divisional Forest Officer, Palakkad on any working day during office hours. He should also be through about the field conditions, terrain, labour availability etc. No plea of ignorance of the agreement conditions as field conditions or no complaint regarding the said conditions received after putting in the tender shall be entertained on any account. A bonded agreement should be executed by the successful tenderer on the date of opening of tenders itself.

18. The successful tenderer shall within 15 days from the date of issue of the acceptance of tender, furnish a security deposit of an amount equal to 10% of the total contract value limited to a maximum of rupees 20,000 (Rupees twenty thousand only) and execute an agreement on a stamp paper worth Rs. 50 in the approved form, the same of which can be had from the Divisional Forest Officer, Palakkad for perusal. The security amount should be remitted in the Government Treasuries duly pledged to the Divisional Forest Officer, Palakkad. If the security is not remitted and the agreement executed within the above said period, a further period of 15 days shall be allowed by the Divisional Forest Officer, for remittance of security and the execution of the agreement subject to realization of Rs. 10 (Rupees Ten only) per day of extension. If the tenderers remits the security within 15 days from the date of intimation of acceptance order but is not able to execute the agreement within the period, the Divisional Forest Officer may grant an extension of time for 15 days more for execution of agreement with a penalty of Re. 1 per day of extension.

19. Failure to remit the security deposit and to execute the agreement, within the time specified in the condition 18 above, will lead to cancellation of the tender by the Divisional Forest Officer and forfeiture to Government of the Earnest Money Deposit and security if any, deposited by the tenderers. The work will also be got done through other agencies at the risk and loss of the defaulter. The loss if any will be treated as arrears of public revenue and will be recovered from the defaulter under the provisions of Revenue Recovery Act or by any other legal means if not paid within a reasonable time specified by the Divisional Forest Officer. The defaulter, however will not be entitled for gain, if any.

20. The tenderer should produce valid clearance certificate of sale-tax, income tax and agricultural income tax to the satisfaction of the Divisional Forest Officer before the final payment is made to him in case the contract value is of and above Rupees 5,000 (Rupees five thousand only).

21. The contractor is bound to deliver all hardwood logs within three months, from the date of registration, softwood logs within 15 days from the date of felling and billets and Firewood within 2 months from the date of registration or within the contract period whichever is earlier to the depot noted in the schedule. If the delivery of the produce is not effected within the period originally fixed as above, the Divisional Forest Officer, may grant extension for 15 days for delivery of hardwood, 15 days for softwood and 15 days for billets and firewood subject to the realization of penalty of Rs. 1.75/Cu. m for hardwood Rs. 2/Cu. m for softwood and Rs. 0.50/MT for stacked billets and Fire Wood. Further 15 days extension may be granted by the Conservator of Forests, Olavakkode with penalty of Rs. 3.50/Cu.m and another 15 days by the Chief Conservator of Forests, with penalty of 5.25/Cu.m for hardwood and Rs. 7/Cu. m for soft wood, if the periods fall within the original or the extended contract period.

All registered logs remaining undelivered after the expiry of said period will be taken charge of by the Forest Range Officer, Olavakkode the contractor shall be liable to pay a fine of Rs. 4/Cu. m for such undelivered logs only and forfeit all claims to Kolevila due thereon. The loss if any sustained by the Department due to deterioration on account of belated delivery or non-delivery of the timber will be made good from the contractor as assessed by the12th JAN. 2010] FOREST DEPARTMENT 37 Department. The contractor should obtain receipts for the logs delivered at the depot from the depot officer when the contractor will be eligible for Kolevila therefore. The contractor shall fell all the marked trees entrusted to him except those trees which have been certified by the Divisional Forest Officer after inspection as wholly defective or impossible to be felled without causing serious damages to their stems or to other trees standing nearby and collect all available timber thereof. For every marked trees left unfelled or felled but uncollected at the expiry of the contract period without proper authorization from the Divisional Forest Officer the Contractor is liable to pay a penalty of Rs. 200 per tree, besides realization of value of timber of uncollected trees as per other conditions. The value of the logs at schedule rate if rendered useless or deteriorated will be realized.

22. The contractor shall ensure that the felling and collection proceeds from the end of the coupe to the other end in an orderly and systematic manner and that all trees are felled as low as possible to the ground levels using saw at least on one side. All logs shall be cross cut with saw.

23. For all logs and billets selling at rates less than Kolevila, the Kolevila payable to the contractor will be limited to the sale price.

24. If the contractor fails to undertake and complete the work within the specified time or if he leaves any item of work undone, the Divisional Forest Officer, at his discretion make other arrangements for carrying out the works left undone, either departmentally or through other agencies at the risk and loss of the defaulting contractor and the loss if any, sustained by the department on this account will be recovered from the security deposit or from other assets of the defaulting contractor, as if such sums are arrears of Land Revenue under the provisions of Revenue Recovery Act in force in such other manner as the Government may deem fit.

25. If any amount becomes due to any workmen or mazdoor engaged by the contractor as per Workmen's Compensation Act or as per provisions of labour or similar laws, such amounts shall be payable by the contractor.

26. The tenderers should submit a declaration with the tender that they are not related to any Government Servant who is in charge of or having control of the work for which the tender is submitted. Relationship for this purpose will be restricted to father, mother, son, daughter, sister, brother, uncle, nephew, father-in-law, mother-inlaw, brother-in-law and first cousins of the officer. If at any stage this condition is found to have been contravened the Earnest Money/Security Deposit of the tenderer/contractor will be forfeited to Government and the contract entered into will stand cancelled.

27. (a) The contractor shall not make any damage to bridges or roads and private properties during collection and transport and during unloading logs and billets from lorries and he shall be liable to any such damages. The decision of the Government regarding the amount of compensation payable for the damages caused shall be final and binding on the contractor and Government shall recover such damages from the contractor.

(b) If the damage caused is in respect of any road under the control of the Kerala State Electricity Board or Public Works Department the amount of compensation payable for such damages will be assessed by the Forest Range Officer, concerned and the Assistant Engineer of the concerned Division of the Kerala State Electricity Board or Public Works Department and their decision being final and binding on the contractor. In such cases the contractor shall be liable to pay the damages to the Kerala State Electricity Board or Public Works Department and they shall recover such damages from the contractor.

28. The tenderers should give an undertaking in the tender that they undertake to carry out the work at the tendered rates quoted and to abide by the terms and conditions of the tender notice and draft agreement so on by them and also other departmental rules and orders issued by them from time to time.

29. (a) Post offers which are not advantages by more than 5% of the lowest rate offered for the original tender (where the total cost of the work as per tender is Rs. 1,00,000 (Rupees one Lakh) and above and more than 10% where the total cost of the work is less than 1,00,000 (Rupees one lakh) will be summarily rejected. In other cases it will be considered under the following conditions:

( i) The post offer should be made within 7 days of tender

(ii) The post offer should remit double the security for the work based on the work offered by the lowest tenderer.

The remittance should be made within 7 days from the date of receipt of registered notice:

(b) (i) The post offerer after satisfying the conditions specified above should also execute an agreement before the Divisional Forest Officer pledging the security for the due fulfillment of the terms.

(ii) If the post offerer satisfied the conditions specified above, re-tenders will be called for after giving the usual publicity as per the rules. In the re-tender if the rates offered does not come up to what has been offered by the post offered it will be awarded to the post offerer at the rate offered by him. If he back out, the security amount will be forfeited to Government. If however, the rate is less than what has been offered by the post offered in the case of re-tender, the work will be awarded to the lowest tenderer and the amount remitted by the post offerer released to him.

30. The quantity mentioned in the schedule is only approximate and the contractor is bound to work down the full quantity of timber and firewood available from trees marked and entrusted to him.

31. The period of contract will be three months from the date of awarding of work order. No extension of the contract period shall ordinarily be granted. However if the delay in completing the work in the contract area within the period specified in the schedule attached is due to circumstances beyond the control of the contractor extension of time may be granted for 15 days each by Divisional Forest Officer, Conservator of Forests, Olavakkode Circle and Chief Conservator of Forests respectively but not exceeding a total period of 45 days subject to realization of penalities as mentioned below. If he fails to undertake and complete the works within the specified time, or if he leaves any item of work undone, the Divisional Forest Officer may at his discretion make other arrangements for carrying out the work left undone either departmentally or through other agencies at the risk and loss of the defaulting contractor, and loss if any, incurred by the department on these agencies at the risk and loss of the defaulting contractor, and loss, if any, incurred by the department on this account will be recovered from the security or from other assets of the contractor.

Penality.—(a) Rs. 2/cum for the quantity of timber delivered at the Depot during the first 15 days extension granted by the Divisional Forest Officer.

(b) Rs. 2.50/Cum for quantity of timber delivered at the Depot during the extension granted by the Conservator of Forests.

(c) Rs. 3/cum for the quantity of timber delivered at the Depot during the extension granted by the Chief Conservator of Forests.

(d) In the same way for billets and firewood Rs. 1.00, 1.25, 1.50 for the extension granted by the Divisional Forest Officer, Conservator of Forests, the Chief Conservator of Forests, respectively.

32. The Divisional Forest Officer reserves to himself the power to eliminate any tree marked and entrusted to the contractor from felling if it is found during the course of the contract that timber obtainable from such trees have no reasonable market or by some other reasons and the contractor is not entitled to claim any compensation for such elimination.

33. Ten per cent of each kolevila bill will be withheld as retention amount which will be released after the connected logs are sold and the liability if any in respect of these logs with the contract is settled.

(a) In case of works, the contract value which exceeds Rs. 10,000 income tax at the rate of two per cent of payment made shall be deducted at each time when payments are made except in the case of non-resident contractors.

34. For working down logs, seignorage on vakka fibre calculated at one vakka drag rope, for every two cubic metres or fraction thereof and grazing fee for one elephant for every two cubic meters or fraction thereof for timber will be recovered from the contractor on the actual quantity collected and sales tax on vakka charges as per the rules in force.

(a) All timber the contractor is under obligation to deliver at the prescribed depots shall be transported to such depot only along the routes specified in the transport permit. If in the course of work it become necessary to deviate from the routes specified in the schedule, the contractor may be allowed to transport timber and firewood along the deviation routes, provided the department is satisfied with the necessity for the deviation in the routes. In the case of such deviation in routes, the contractor will be eligibile to get kolevila at the rates worked for those new route minus tender reduction with prior sanction of the Conservator of Forests. Quantity to be supplied to different depots shall also be changed by the Divisional Forest Officer, with prior sanction from the Conservator of Forests.

35. The contractor shall collect all timber available from the trees marked in the plantation within the said contract period as per the instructions issued by the Divisional Forest Office, Palakkad the collection is delayed the contractor will be liable to pay a penalty at the rate specified above for the timber for the belated period.

36. The contractor should achieve, show and register progress in working down timber.

37. If the rates quoted in the retender is more than quoted in the original tender the difference between them and all the expenditure incidental in fixing up of re-tender including notification charges as assessed by the Divisional Forest Officer, Palakkad recovered from the defaulting tenderer through any legal means including Revenue Recovery Act. 38. Further particulars can be had from the Divisional Forest Officer, Palakkad Range Officer, Olavakkode on any working days during office hours.

39. The contractor should take every care to collect as much quantity of saleable timber as possible from marked trees.

40. The Divisional Forest Officer has the discretion to postpone the tender without assigning any reason.

3. ലേലത്തിൽ പങ്കുകൊള്ളാൻ ഉദ്ദേശിക്കുന്നവർ ലേലം തുടങ്ങുന്നതിനുമുമ്പായി ഈട്ടി, തേക്ക് എന്നിവയുടെ ലേലത്തിനാണെങ്കിൽ 10,000 (പതിനായിരം) രൂപയും മറ്റു തടികളുടെ ലേലത്തിനാണെങ്കിൽ 5,000 (അയ്യായിരം) രൂപയും മറ്റു വനവിഭവങ്ങളുടെ കാര്യത്തിൽ 1,000 (ആയിരം) രൂപയും നിരതദ്രവ്യം പണമായി കെട്ടിവയ്ക്കേ≠തും ലേല നിബന്ധനകൾ അനുസരിക്കുന്നതിന് വീഴ്ചവന്നാൽ ത∑ൂലമു≠ാകുന്ന നാശംമൂലം വകുപ്പിന്/സർക്കാരിന് ഉ≠ാകുന്ന കഷ്ടനഷ്ടങ്ങൾ തന്നിൽനിന്നും ഈടാക്കാവുന്നതാണെന്നും സമ്മതിച്ചു കൊ≠ുള്ള ഒരു ഉടമ്പടി ഒപ്പുവയ്ക്കേ≠താണ്.

4. ലേലത്തിൽ പങ്കുകൊള്ളാൻ ഉദ്ദേശിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കൈയ്യൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജ് ഓഫീസറിൽനിന്നുമുള്ള ഒരു സർട്ടിഫിക്കറ്റോ അതല്ലെങ്കിൽ ഇലക്ഷൻ കമ്മീഷൻ നൽകിയ എെഡന്റിറ്റി കാർഡോ ഇവയിലേതെങ്കിലും ഒന്നിന്റെ സാക്ഷ്യപ്പെടുത്തിയ പകർപ്പോ നിരതദ്രവ്യം കെട്ടിവയ്ക്കുന്നതിനുമുമ്പായി സമർപ്പിക്കേ≠താണ്. പ്രോപ്പർട്ടിമാർക്ക് രജിസ്ട്രേഷനുള്ളവർ അവരുടെ സർട്ടിഫിക്കറ്റ് കാണിച്ച് ബന്ധപ്പെട്ട ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥ∑ാരിൽനിന്നും ഫോട്ടോ പതിച്ച എെഡന്റിറ്റി കാർഡ് ഹാജരാക്കിയാൽ മതിയാകുന്നതാണ്. മേൽ വിവരിച്ച പ്രകാരം സർട്ടിഫിക്കറ്റോ ഏതെങ്കിലും തിരിച്ചറിയൽ രേഖയോ ഹാജരാക്കാത്തവരെ ലേലത്തിൽ പങ്കുകൊള്ളാൻ അനുവദിക്കുന്നതല്ല.

5. ലേലവ്യവസ്ഥയിൽ എന്തെങ്കിലും മാറ്റങ്ങളോ കൂട്ടിച്ചേർക്കലുകളോ ആവശ്യമായിവരുന്നപക്ഷം ആയത് ലേല സമയത്ത് വിശദീകരിക്കുന്നതായിരിക്കും. കൂടുതൽ വിവരങ്ങൾക്ക് അതാത് റെയിഞ്ചാഫീസുകളിൽ അന്വേഷിക്കാവുന്നതാണ്.

6. കോടതിയുടെ അനുമതി വാങ്ങിയശേഷം ലേലം ചെയ്ത് വിൽക്കുന്ന സാധനങ്ങളുടെ മുഴുവൻ വിലയും മറ്റു നികുതികളും ലേലദിവസംതന്നെ അടയ്ക്കേ≠താണ്. മറ്റ് ലേലങ്ങളിൽ നികുതികൾ ലേലം സ്ഥിരപ്പെടുത്തി ഉത്തരവായിരിക്കുന്ന ദിവസം മുതൽ 30 ദിവസത്തിനകം അടയ്ക്കേ≠താണ്.

ഏതെങ്കിലും കാരണവശാൽ ടി തീയതികളിൽ ഏതെങ്കിലും പൊതു അവധി ദിവസമായി വരികയാണെങ്കിൽ അന്നേ ദിവസത്തെ ലേലം തൊട്ടടുത്ത പ്രവൃത്തിദിവസം നി›ിത സ്ഥലത്തും സമയത്തും നടത്തുന്നതാണ്.

15-1-2010-ന് ലേലം/ദർഘാസ് നടക്കാതെ പോവുകയാണെങ്കിൽ പുനർലേലം 22-1-2010-നും അന്നേ ദിവസം ലേലം/ദർഘാസ് നടക്കാതെ പോവുകയാണെങ്കിൽ പുനർ ലേലം 20-1-2010-നും നടത്തുന്നതായിരിക്കും.

ടെ≠ർ ഫോറം നി›ിത ലേലം/ടെ≠ർ തീയതികളുടെ തൊട്ടുമുമ്പുള്ള പ്രവൃത്തി ദിവസം പകൽ 12 മണിവരെ ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസുകളിൽനിന്ന് 300 രൂപ + വാറ്റ് അടച്ച് വാങ്ങാവുന്നതും പൂരിപ്പിച്ച ദർഘാസുകൾ ലേല ദിവസം രാവിലെ 10.30 മണിവരെ സ്വീകരിക്കുന്നതുമാണ്. ലേലം കഴിഞ്ഞാലുടൻ ദർഘാസുകൾ സന്നിഹിതരായിട്ടുള്ള ലേലക്കാരുടെ സാന്നിദ്ധ്യത്തിൽ തുറക്കുന്നതുമായിരിക്കും.

ലേലം സ്ഥിരപ്പെടുത്തിയ നോട്ടീസ് അയച്ചതു മുതൽ 15 ദിവസത്തിനകം ലേലം കൊ≠യാൾ ബാക്കി തുകയും ബന്ധപ്പെട്ട നികുതികളും സെക്യൂരിറ്റി തുകയും ഒടുക്കി ഉടമ്പടി ഒപ്പു വയ്ക്കേ≠താണ്. റെയിഞ്ചാഫീസ് കോമ്പൗ≠ുകളിലെ തോപ്പിന്റെ കരാർ കാലയളവിൽ ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസർ നിർദ്ദേശിക്കുന്ന പ്രകാരം വളമിടേ≠തും മറ്റു പരിചണ പ്രവർത്തികളും നടത്തേ≠താണ്. ഇതോടൊപ്പമുള്ള ലേല നിബന്ധനകൾക്ക് പുറമെ മറ്റ് പൊതു ലേല നിബന്ധനകൾ ഈ ലേലത്തിന് ബാധകമായിരിക്കും. കൂടുതൽ വിവരങ്ങൾക്ക് കുറ്റ്യാടി ഫോറസ്റ്റ് റെയിഞ്ചാ ഫീസിലോ കോഴിക്കോട് സിവിൽ സ്റ്റേഷനിലെ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിലോ ബന്ധപ്പെടേ≠താണ്.

നിബന്ധനകൾ

1. ലേലത്തിൽ പങ്കെടുക്കാൻ ആഗ്രഹിക്കുന്നവർക്ക് ബന്ധപ്പെട്ട റെയിഞ്ച് ഓഫീസറുടെ അനുവാദപ്രകാരം തോപ്പ് പരിശോധിച്ച് തെങ്ങുകളുടെയും മറ്റ് ഫലവൃക്ഷങ്ങളുടെയും എണ്ണം ഓരോ കോമ്പൗ≠ുകളിൽ നിന്നും കിട്ടാവുന്ന ഉൽപ്പന്നങ്ങളുടെ അളവും ഗുണവും എന്നിവ മുൻകൂട്ടി ബോദ്ധ്യപ്പെടാവുന്നതാണ്. ലേലം/ദർഘാസ് നിബന്ധനകളെ കുറിച്ച് യാതൊരു പരാതികളും പരിഗണിക്കുന്നതല്ല.

2. ലേലം/ദർഘാസിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കയ്യൊപ്പും സാക്ഷ്യപ്പെ ടുത്തിയ സർട്ടിഫിക്കറ്റ് ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽ നിന്നും വാങ്ങി നിരതദ്രവ്യം കെട്ടിവയ്ക്കുന്നതിന് മുമ്പായി സമർപ്പിക്കേ≠താണ്. അല്ലാത്തവരെ ലേല/ദർഘാസിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.

3. ലേലം/ദർഘാസിൽ പങ്കെടുക്കുന്ന ആൾ ലേലം/ദർഘാസ് തുടങ്ങുന്നതിനുമുമ്പ് ഓരോ കോമ്പൗ≠ിനും 2,000 (ര≠ായിരം) രൂപ വീതം നിരതദ്രവ്യം കെട്ടി വെയ്ക്കേ≠ തു≠്. ലേലം/ദർഘാസ് നിബന്ധന താങ്കൾക്ക് സ്വീകാര്യമാ ണെന്നതിന്റെ തെളിവിലേക്കായി ലേലം/ദർഘാസ് വി⁄ാപന ത്തിന്റെ ഒരു പകർപ്പിൽ ഒപ്പു വയ്ക്കേ≠തുമാണ്. ലേലത്തിൽ കൂട്ടിവിളിക്കേ≠ ഏറ്റവും കുറഞ്ഞ നിരക്ക് 100 രൂപയാകുന്നു.

4. ലേലം/ദർഘാസ് നടത്തുന്ന ഉദ്യോഗസ്ഥന് ഏതൊരു ലേലാർ∞ിയുടേയും നിരതദ്രവ്യം യാതൊരു കാരണവും കാണിക്കാതെ തന്നെ സ്വീകരിക്കുവാനോ നിരസിക്കുവാനോ ഉള്ള അധികാരം ഉ≠ായിരിക്കുന്നതാണ്. ഇക്കാര്യത്തിൽ അദ്ദേഹത്തിന്റെ തീരുമാനം അന്തിമമായിരിക്കു ന്നതാണ്.

5. ലേലം/ദർഘാസ് ഉറപ്പിക്കപ്പെട്ടയാൾക്ക് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ രേഖാമൂലമുള്ള മുൻകൂർ അനുവാദ മില്ലാതെ ലേലവസ്തുവിൻമേലുള്ള അവകാശം കൈമാറാൻ പാടില്ല. മേൽപ്പടി അനുവാദം യാതൊരു കാരണവും കാണി ക്കാതെ നിഷേധിക്കുവാനുള്ള അധികാരം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് ഉ≠ായിരിക്കും.

6. ലേലം/ദർഘാസ് കൊ≠യാൾ ലേലസംഖ്യയുടെ 1/5 ഭാഗമോ ലേലസംഖ്യയുടെ 1/5 ഭാഗം ഒരു ലക്ഷത്തിൽ കൂടുതലാണെങ്കിൽ ഒരു ലക്ഷം ലേലദിവസവും ബാക്കി സംഖ്യ 7 ദിവസത്തിനുള്ളിലും അടയ്ക്കേ≠താണ്. ലേല ത്തിനുമുമ്പായി കെട്ടിവച്ചിട്ടുള്ള നിരതദ്രവ്യം ടി തുകയുടെ ഭാഗമായി ഉൾപ്പെടുത്താവുന്നതാണ്. ഇങ്ങനെ 5-ൽ ഒരു ഭാഗം വരുന്ന സംഖ്യ ഒടുക്കാതിരുന്നാൽ ടിയാന്റെ നിരത ദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും ലേലം കൊ≠ ബിറ്റുകൾ ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം നടത്തുന്നതുമാണ്.

7. ലേലം ഉറപ്പിച്ചതായി അറിയിച്ചുകൊ≠ുള്ള ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ ഉത്തരവ് അയയ്ക്കുന്ന തീയതി മുതൽ 15 ദിവസങ്ങൾക്കുള്ളിൽ ലേലം കൊ≠യാൾ ബാക്കി തുകയും ഓരോ ബിറ്റിനും ചുരുങ്ങിത് 500 രൂപ എന്ന നിരക്കിൽ മൊത്തം ലേല സംഖ്യയുടെ 10 ശതമാനം വരുന്ന തുക സെക്യൂരിറ്റി ഡിപ്പോസിറ്റായി അടയ്ക്കേ≠തും കോഴിക്കോട് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുമായി 50 രൂപ മുഖവിലയുള്ള മുദ്രപ്പത്രത്തിൽ നിർദ്ദിഷ്ട രൂപത്തിലുള്ള കരാറിൽ ഒപ്പുവയ്ക്കേ≠തുമാണ്.

(i) മേൽ 7-ാം ഖണ്ഡികയിലെ നിബന്ധനകൾ പാലി ക്കുന്നതിൽ വീഴ്ചവരുത്തിയാൽ ഉറപ്പിക്കപ്പെട്ട ലേലം അസ്ഥിരപ്പെടുത്തുന്നതും നിരതദ്രവ്യവും മറ്റുമായി ലേലക്കാരൻ ഒടുക്കിയ തുക മുഴുവനും സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും അയാളുടെ നഷ്ടോത്തരവാദിത്വത്തിൽ ബന്ധപ്പെട്ട ബിറ്റുകൾ പുനർലേലം നടത്തുന്നതുമാണ്. ഇങ്ങനെയുള്ള പുനർലേലത്തിൽ വീഴ്ചവരുത്തിയ ലേലക്കാരൻ പങ്കെടുക്കുവാൻ പാടില്ലാത്തതാണ്. പുനർ ലേലത്തിൽ സർക്കാരിനു≠ാകുന്ന എല്ലാവിധ നഷ്ടങ്ങൾക്കും മുൻലേലക്കാരനിൽ നിന്നും നിലവിലുള്ള റവന്യൂ റിക്കവറി ആക്ട് പ്രകാരമുള്ള നടപടികൾ ഉൾപ്പെടെയുള്ള നടപടി കൾ സ്വീകരിച്ച് ഈടാക്കുന്നതായിരിക്കും. എന്നാൽ മേൽപ്പടി ലേലം/ദർഘാസിൽ സർക്കാ രിന് ലാഭമാണ് ഉ≠ാകുന്നതെങ്കിൽ ആയതിന് മുൻലേലക്കാരന് അവകാശം ഉ≠ായിരിക്കുന്നതല്ല.

(ii) മേൽപ്പടി 7-ാം ഖണ്ഡികയിൽ പറയുന്നതു പോലെ 15 ദിവസത്തിനുള്ളിൽ ലേലക്കാരന് ബാക്കി തുകയും ബന്ധപ്പെട്ട നികുതികളും ഒടുക്കാൻ കഴിയാതെവന്നാൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് യു‡ാനുസരണം 15 ദിവസത്തിൽ കഴിയാത്ത കാലത്തേക്ക് പണം ഒടുക്കുന്നതിനുള്ള അവധി നീട്ടി കൊടുക്കാവുന്ന താണ്. ഇങ്ങനെ വൈകി അടയ്ക്കുന്ന കാലത്തേക്ക് ദിവസത്തിന് ഒരു രൂപ വീതം പിഴയും ലേലസംഖ്യയുടെ 18 ശതമാനം പലിശയും ഒടുക്കേ≠താണ്. ഇപ്രകാരം നീട്ടിക്കൊടുത്ത കാലയളവിലും ലേലക്കാരൻ 1-ാം ഖണ്ഡികയിലെ നിബന്ധനകൾ പാലിക്കുന്നില്ലെങ്കിൽ അയാളുടെ പേരിൽ ലേലം/ദർഘാസ് ഉറപ്പിച്ച ബിറ്റുകൾ 7-ാം ഖണ്ഡികയിലെ (i)-ൽ പറഞ്ഞിട്ടുള്ള പ്രകാരം വീഴ്ചക്കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ലേലം/ ദർഘാസ് ചെയ്തു വിൽക്കുന്നതായിരിക്കും.

(iii)ലേലം/ദർഘാസ് കൊ≠യാൾ ഭൂമിയിൽ നിന്നും അനുഭവങ്ങൾ ശേഖരിക്കുന്നതിന് താഴെ കൊടു ത്തിരിക്കുന്ന നിബന്ധനകൾ നിർബന്ധമായും പാലിക്കേ≠താണ്. ടി നിബന്ധനകൾ പാലിക്കാ ത്തവരെ ലേലം/ദർഘാസ് ഭൂമിയിൽ നിന്നും യാതൊരുവിധ അനുഭവങ്ങളും ശേഖരിക്കാൻ അനുവദിക്കുന്നതല്ല.

(1) മേൽ ഖണ്ഡികയിൽ പറയുന്നതായതും സർക്കാരിലേക്ക് ചെയ്യേ≠തുമായ എല്ലാ വിധ നീക്കി ബാക്കികളും അടച്ചുതീർക്കുക.

(2) നിർദ്ദിഷ്ട കരാറിൽ യഥാസമയം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ മുമ്പാകെ ഒപ്പ് വയ്ക്കുക.

(3) ലേലം/ദർഘാസ് കൊ≠ ബിറ്റിന്റെ അതി രുകൾ കാണുകയും അറിയുകയും ചെയ്തിരിക്കുന്നു എന്നതിന് ബന്ധപ്പെട്ട ഫോറസ്റ്റ് റെയിഞ്ചാഫീസർക്ക് ഒരു സാക്ഷ്യപത്രം കൊടുക്കുക.

8. കരാറിലെ പ്രധാന നിബന്ധനകൾ താഴെ പറയുന്നവയാണ്. ലേലം/ദർഘാസ് കൊ≠യാൾ ഇനിയങ്ങോട്ട് കരാറുകാരൻ എന്നായിരിക്കും പരാമർശിക്കപ്പെടുക.

(എ) കരാർ/കാലാവധി 1-7-2009 മുതൽ അല്ലെങ്കിൽ കരാർ ഒപ്പിടുന്ന തീയതി ഇതിൽ ഏതാണോ വൈകി വരുന്നത് അന്നുമുതൽ 30-6-2012 വരെയായിരിക്കും.

(ബി) ശരിക്കും വിളവായ ഫലങ്ങൾ മാത്രമേ ശേഖരി ക്കാൻ പാടുള്ളൂ.

(സി) ലേലം/ദർഘാസ് ഭൂമിയിലെ ഏതെങ്കിലും ഫലവൃക്ഷ ങ്ങൾക്കോ ഭൂമിയിലെ മറ്റ് മരങ്ങൾക്കോ കരാറു കാരനോ/അയാളുടെ കാര്യസ്ഥനോ ഇവർ ഏർപ്പാടാക്കുന്ന തൊഴിലാളികളോ എന്തെങ്കിലും വിധത്തിലുള്ള നാശ നഷ്ടങ്ങൾ വരുത്തിവച്ചാൽ ടി പ്രവർത്തിക്കും അതു മൂലമു≠ാകുന്ന സർക്കാർ നഷ്ടത്തിനും ഉത്തരവാദി കരാറുകാരൻ മാത്രമായിരിക്കും. ആയത് കരാറുകാരനിൽ നിന്നും യഥാവിധി ഈടാക്കുന്നതായിരിക്കും.

(ഡി) ലേലം/ദർഘാസുകാരൻ ലേലം/ദർഘാസ് ഭൂമിയിലെ ഫലവൃക്ഷങ്ങൾക്ക് മതിയായ വളപ്രയോഗവും പരി രക്ഷയും നൽകുകയും തനിക്കവകാശപ്പെട്ട അനു ഭവങ്ങൾ ശേഖരിച്ചശേഷം ഡിവിഷണൽ ഫേറസ്റ്റ് ഓഫീസർക്ക് തിരിച്ചേൽപ്പിക്കുകയും ചെയ്യേ≠താണ്.

(ഇ) (1) കരാറുകാരൻ തോപ്പിനുള്ളിൽ താഴെപ്പറയുന്ന ജോലികൾ സ്വന്തം ചിലവിൽ നടത്തേ≠ താണ്. ജൂലൈയിലോ ആഗസ്റ്റ് ആദ്യമോ തെങ്ങിന്റെ മ≠ വൃത്തിയാക്കേ≠താണ്.

(ജി) കരാറുകാരൻ അതാതു ദിവസങ്ങളിൽ ശേഖരിക്കുന്ന അനുഭവങ്ങളുടെ കണക്കുകൾ ശരിയായി സൂക്ഷി ക്കുകയും മാസാവസാനം ആയത് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ നിർദ്ദേശിക്കുന്ന ഫോറത്തിൽ ബന്ധപ്പെട്ട ഫോറസ്റ്റ് റെയിഞ്ച് ഓഫീസർക്ക് സമർപ്പിക്കേ≠തുമാണ്.

(എച്ച്) േ ല ല ം / ദ ർ ഘ ാ സ ് ഭ ൂ മ ി യ ി ൽ ന ി ന്ന ു ം അനധികൃതമായി തെങ്ങ് ഉൾപ്പെടെയുള്ള ഫലവൃക്ഷ ങ്ങൾ മുറിച്ച് നീക്കം ചെയ്യപ്പെടുകയോ അനുഭവ ങ്ങൾ നീക്കം ചെയ്യപ്പെടുകയോ ചെയ്താൽ ആയ തിന്റെ പൂർണ്ണ ഉത്തരവാദിത്വം കരാറുകാരനായി രിക്കും. ടി പ്രവർത്തി കരാർ ദുർബലപ്പെടുത്താനും ഒടുക്കിയ മുഴുവൻ തുകയും ക≠ുകെട്ടാനും ശേഖരിച്ച് നീക്കം ചെയ്യാതെ വച്ചിരിക്കുന്ന ഉൽപ്പന്ന ങ്ങൾ പിടിച്ചെടുക്കാനും ഇടയാക്കുന്നതാണ്.

(എെ) കരാറുകാരൻ തെങ്ങുകൾ ചെത്താനോ അവയ്ക്ക് നാശം വരുത്താനോ വീഴ്ത്താനോ പാടില്ലാത്തതാ കുന്നു. തെങ്ങോലകൾ ഉണങ്ങിവീഴുമ്പോൾ മാത്രമേ ശേഖരിക്കാൻ പാടുള്ളൂ. അല്ലാതെ വെട്ടി എടുത്തു ശേഖരിക്കാൻ പാടില്ല. ഉണങ്ങി വീഴുന്ന ഓലയും തേങ്ങയും ഉടൻ ശേഖരിച്ച് നീക്കം ചെയ്യേ≠താണ്. ആയത് നഷ്ടപ്പെട്ടുപോയാൽ ഉത്തരവാദി കരാറുകാരൻ മാത്രമായിരിക്കും.

(ജെ) ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ യു‡മായ നിർദ്ദേശപ്രകാരം വകുപ്പ് ഉദ്യോഗസ്ഥ∑ാർ കായ്പ് നിലച്ചതും പീറ്റയായ തെങ്ങുകളോ, തെങ്ങിൻ തൈ കൾക്ക് ഭീഷണിയായവിധത്തിൽ നിൽക്കുന്നതുമായ തെങ്ങ് ഉൾപ്പെടെയുള്ള ഫലവൃക്ഷങ്ങൾ കായ്ഫലമുള്ള തെങ്കിലും മുറിച്ചുനീക്കിയാൽ കരാറുകാരന് നഷ്ടപരിഹാരം ആവശ്യപ്പെടാൻ അർഹതയു≠ായിരി ക്കുകയില്ല.

(കെ) ലേലം/ദർഘാസ് ഭൂമിയിലെ തെങ്ങ് ഉൾപ്പെടെയുള്ള ഫലവൃക്ഷങ്ങൾക്ക് നാശമു≠ാവുകയാണെങ്കിൽ ആയത് കരാറുകാരൻ യഥാസമയം ബന്ധപ്പെട്ട റെയിഞ്ച് ഓഫീസറെ വിവരം അറിയിക്കേ≠താണ്.

(എൽ) ഫലവൃക്ഷങ്ങളിൽ കായ്ഫലം കുറഞ്ഞാലോ മറ്റു വിധത്തിൽ നഷ്ടങ്ങളു≠ായാലോ കരാറുകാരൻ സർക്കാരിലേക്ക് ഒടുക്കാനുള്ള തുകയിൽ യാതൊരു ഇളവും അനുവദിക്കുന്നതല്ല.

9. കരാറുകാരൻ ഇവിടെ പറഞ്ഞിരിക്കുന്നതുമായ നിബന്ധനകളോ ഒപ്പിട്ട കരാറിലെ വ്യവസ്ഥകളോ ലംഘിക്കു കയാണെങ്കിൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ കരാർ അവസാനിപ്പിക്കുന്നതും കരാറുകാരന്റെ സെക്യൂരിറ്റി ഡിപ്പോസിറ്റ് തുക ക≠ുകെട്ടുന്നതും അവകാശം കരാറുകാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ മറുലേലം ചെയ്യുകയോ ഡിപ്പാർട്ടുമെന്റ ് തന്നെ നേരിട്ട് അനുഭവങ്ങൾ എടുക്കുകയോ ചെയ്യുന്നതായിരിക്കും. ഏതു വിധത്തിലായാലും ഈ കാര്യത്തിൽ സർക്കാരിന് ഉ≠ാവാൻ ഇടയുള്ള എല്ലാവിധ കഷ്ടനഷ്ടങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയായിരിക്കും. ആയതു കരാറുകാരൻ സർക്കാരിലേക്ക് ഒടുക്കേ≠തുമാണ്. എന്നാൽ പുനർലേലത്തിൽ സർക്കാരിന് ലാഭം ഉ≠ാവുകയാണെങ്കിൽ ആയതിന് കരാറുകാരന് അർഹത ഉ≠ായിരിക്കുന്നതല്ല.

10. വി⁄ാപനത്തിലെ വ്യവസ്ഥകൾ വിജയിയായ ലേലക്കാരൻ ഏർപ്പെടുന്ന കരാറിന്റെ അവിഭാജ്യ ഘടകമായിരിക്കും.

11. ലേല/ദർഘാസ് നടന്നുകഴിഞ്ഞതിനുശേഷം അതേക്കുറിച്ച് യാതൊരുവിധ പരാതികളോ കൂടുതൽ വില തരാമെന്ന് കാണിച്ചിട്ടുള്ള അപേക്ഷകളോ (പോസ്റ്റ് ഓഫറു കൾ) സ്വീകരിക്കുന്നതല്ല.

12. കരാറുകാരൻ കരാർ കാലാവധി കഴിഞ്ഞ് സെക്യൂരിറ്റി ഡെപ്പോസിറ്റ് തിരിച്ചുകിട്ടാൻ അപേക്ഷിക്കുമ്പോൾ ബന്ധപ്പെട്ടവരിൽനിന്നും ലഭിച്ച ആദായനികുതി, വിൽപ്പന നികുതി, കാർഷികാദായ നികുതി എന്നിവയുടെ ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റുകൾ ഹാജരാക്കേ≠താണ്. എങ്കിൽ മാത്രമേ സെക്യൂരിറ്റി ഡിപ്പോസിറ്റ് തുക മടക്കി കിട്ടുകയുള്ളൂ.

13. മറ്റു നിബന്ധനകൾ ആവശ്യമായി വരുന്നപക്ഷം ആയത് ലേലം/ദർഘാസിന് തൊട്ടുമുമ്പായി ലേലക്കാരെ അറിയിക്കു ന്നതായിരിക്കും. ലേല/ദർഘാസ് സമയങ്ങളിൽ ലേല നിബ ന്ധനകളിൽ യു‡മായ മാറ്റങ്ങൾ വരുത്താനുള്ള അവകാശം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് ഉ≠ായിരിക്കും.

14. കരാറുകാരൻ വിഭവങ്ങൾ ശേഖരിക്കുന്നതിന് ചുരുങ്ങിയത് 3 ദിവസം മുമ്പെങ്കിലും രേഖാമൂലം ഫോറസ്റ്റ് റെയിഞ്ച് ഓഫീ സറെ ടി വിവരം അറിയിക്കേ≠താണ്. എങ്കിൽ മാത്രമേ ഫോറസ്റ്റ് റെയിഞ്ച് ഓഫീസർക്കോ അദ്ദേഹം അധികാരപ്പെടു ത്തുന്ന മറ്റു ഉദ്യോഗസ്ഥനോ വിഭവ ശേഖരണത്തിന് മേൽനോട്ടം വഹിക്കാൻ കഴിയുകയുള്ളു. ബന്ധപ്പെട്ടവരുടെ മേൽനോട്ടത്തിൽ മാത്രമേ വിഭവങ്ങൾ ശേഖരിക്കുവാൻ പാടുളളൂ.

15. തോട്ടങ്ങളിൽ നിൽക്കുന്ന പടുവൃക്ഷങ്ങളിൽ ഏതെങ്കിലും സർക്കാർ ആവശ്യത്തിനു മുറിച്ചു മാറ്റുന്നതിനുള്ള അധികാരം ഡിപ്പാർട്ടുമെന്റ ിന് ഉ≠ായിരിക്കും. ആയതുകൊ≠് കരാറുകാരനു≠ാകുന്ന നഷ്ടങ്ങൾക്ക് കരാറുകാരന് നഷ്ടപരിഹാരം ആവശ്യപ്പെടാവുന്നതല്ല.

ലേലവ്യവസ്ഥകൾ

1. താഴെ പറയുന്ന പ്രത്യേക ലേല നിബന്ധനകൾക്ക് പുറമേ ചീഫ് ഫോറസ്ററ് കൺസർവേററർ (സംരക്ഷണം)-ടെ 6-12-2008-ലെ പ്രൊ. (5)7698/2008 നമ്പർ പ്രകാരം 16-12-2008-ലെ കേരള ഗസററിൽ പ്രസിദ്ധീകരിച്ച പൊതു ലേലനിബന്ധനകൾ ഈ ലേലത്തിനും ബാധകമായിരിക്കും. സർക്കാർ തടി ഡിപ്പോകളിൽ അതാതു കാലത്ത് നിലവിൽവരുന്ന പൊതു ലേലവ്യവസ്ഥകൾ ഈ ലേലത്തിനും ബാധകമായിരിക്കും.

2. ലേലത്തിന് മുമ്പ് തന്നെ ലേലത്തിൽ ഉൾപ്പെടുത്തിയിരി ക്കുന്ന സാധനങ്ങളുടെയും മററും നൽപ്പുനിൽപ്പു സ്ഥിതിയും അളവ്, എണ്ണം, ഗുണനിലവാരം മുതലായവ നേരിൽ പരിശോധിച്ച് തൃപ്തിപ്പെടേ≠താണ്.

ലേലത്തിനുശേഷം ഉ≠ാവുന്ന യാതൊരു പരാതിയും പരിഗണിക്കുന്നതല്ല.

3. ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ ലേല സമയത്തിനുമുമ്പായി 2,000 (ര≠ായിരം)രൂപ നിരതദ്രവ്യമായി കെട്ടിവയ്ക്കേ≠താണ്.

4. കോടതി അനുമതി വാങ്ങിയശേഷം ലേലം ചെയ്യുന്ന തൊ≠ി സാധനങ്ങളുടെ മുഴുവൻ തുകയും ലേല ദിവസം തന്നെ ഒടുക്കേ≠താണ്.

5. ലേലത്തിൽ വിളിച്ചെടുത്ത തൊ≠ി സാധനങ്ങളുടെ മൊത്തം വില 20,000 (ഇരുപതിനായിരം) രൂപയിൽ കുറവാണെങ്കിൽ മുഴുവൻ തുകയും അതിൽ കൂടുതൽ ആണെങ്കിൽ മൊത്തം ലേലത്തുകയുടെ 35% വില, കുറഞ്ഞത് 20,000 രൂപയും കൂടിയത് 1,00,000 രൂപയും എന്ന കണക്കിൽ ലേലം കഴിഞ്ഞ ഉടനെ കെട്ടിവയ്ക്കേ≠താണ്.

6. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തി വിവരം അറിയിക്കുന്ന തീയതി മുതൽ ര≠ുമാസത്തിനകം (60 ദിവസം) ബാക്കിവിലയും നിലവിലുളള വില്പന നികുതി, വനവി കസനനികുതി, ആദായ നികുതി എന്നിവയും ഒടുക്കി തൊ≠ി സാധനങ്ങൾ നീക്കം ചെയ്യേ≠താണ്.
