Thiruvananthapuram, 10th November 2009.

Whereas, the Government are of opinion that an industrial dispute exists between the Managing Director, Thrissur Co-operative Spinning Mill, Vazhani P. O., Thrissur and the workman of the above referred establishment represented by the General Secretary, Thrissur Co-operative Spinning Mills Employees Union, Viruppaka, Vazhani P. O., Thrissur-680 589 in respect of matters mentioned in the Annexure to this order;

And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication ;

Whether the denial of transfer of Shri P. T. Samuel, s/o Thomas, Manalithara P. O., Thrissur from the present post to the packing section by the management of Thrissur Co-operative Spinning Mill, Vazhani P. O., Thrissur is justifiable or not ? If not, what relief he is entitled to get?

ANNEXURE

Now, therefore, in exercise of the powers conferred by

section 10 (1) (c) of the Industrial Disputes Act of 1947

1. Whether there was denial of employment to (Central Act XIV of 1947) the Government hereby direct

Smt. Sakunthala, worker of Rosanto Tile Factory, that the said industrial dispute be referred for adjudication

Marathakara P. O., Ollur on 3rd , 4th, 5th of to the Labour Court, Kannur. The Labour Court will pass

February, 2009 ? If so what relief she is entitled to the award within a period of three months.

2. Whether the discharge of Smt. Sakunthala, worker ANNEXURE

Whereas, the Government are of opinion that an

industrial dispute exists between the Managing Partner,

Rosanto Tile Factory, Marathakara P. O., Ollur,

Thrissur-680 306 and the worker of the above reffered

establishment represented by the General Secretay, Ollur

Mekhala Ottu Company Thozhilali Union (CITU),

Avinissery P. O., Thrissur-680 313 in respect of matters

mentioned in the annexure to this order ;

And whereas, in the opinion of Government it is

necessary to refer the said industrial dispute for

adjudication ;

Now, therefore, in exercise of the powers conferred by

section 10 (1) (d) of the Industrial Disputes Act of 1947

(Central Act XIV of 1947), the Government hereby direct

that the said industrial dispute be referred for adjudication

to the Industrial Tribunal, Palakkad. The Industrial Tribunal

will pass the award within a period of three months.
