NOTIFICATION

WHEREAS, the Government of Kerala has published Act No. 21 of 2005, namely, the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Act 2003, which came into effect from 2nd day of June 2000 for the conservation and management of ecologically fragile lands, minimizing the reduction of degradation of the Eco-System and Biological Diversity therein.

Now, it is hereby notified for the information of the public that the ownership and possession of the land as per the details shown in the schedule hereto, in the District of Wayanad has been vested with the Government of Kerala free from all encumbrances and the right, title and interest of the owner or any other person thereon shall stand extinguished from the date of commencement of the Act, ie., 2nd June 2000.

The publication of the notification is made as required under Section 3(2) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Act, 2003 as per Government Notification No. 15567/Leg./B1/01/Law dated 3rd May 2005 and published in Kerala Gazette No. 929 dated 3rd May 2005.

TENDER/AUCTION NOTICE

The materials collected by final felling/thinning teak plantations in Konni/Naduvathumoozhy/Mannarappara Ranges of Konni Forest and stacked at dumping site shown in the schedule hereto attached will be sold in Tender/Auction by the undersigned or by any other officer authorized for the purpose, on the date and time shown in the schedule. The sale condition published by the Chief Conservator of Forests, Thiruvananthapuram vide Notification No. Pro. (5)-6835/2009 dated 2-12-2009 in the Kerala Govt. Gazette No. 54 dated 22-12-2009 and other sale conditions prevalent in the Forest Department are applicable to this Tender/Auction sale. This Gazette notification is available in the website of Forest Department www.keralaforest.org and www.keralaforest.gov.in. Any further notification to the sale conditions that may be ordered by the Government after the publication of this sale notification will also be applicable to the sale. If the notified date of Tender/Auction declared as a holiday the sale will be conducted on the next working day and if the sale is not possible on the notification date due to other reasons, the same will be conducted on the alternate date shown below at the same place and time without further notification. The intending bidders should satisfy themselves about the quality and quantity of the materials put up for sale before the commencement of the auction and any complaints whatsoever will not be entertained after the sale proceedings are over. In case, any Government Department requires any of the materials, the quantity remaining after their selection only will be auctioned. The quantity that may become ready for sale after the publication of this notification will also be included in this sale. The tender/auction will commence at the time noted in the schedule in the dumping site and will continue till the sale of materials lotted for the day is over.

Tender form can be had from the office of the undersigned till 1 p.m. on the day before the auction date on payment of Rs. 200 + VAT. The last date and time of receipt of tender is at 9 a.m. on the auction date.

അളവിൽ വ്യത്യാസം വരാവുന്നതാണ്. ലേലം താഴെ പറഞ്ഞിരിക്കുന്ന സമയത്ത് അതത് ഡമ്പിംഗ് സൈറ്റിൽ ആരംഭിക്കുന്നതും തത്ദിവസത്തെ വിൽപ്പനയ്ക്കായി ലോട്ടു ചെയ്തിട്ടുള്ള ഉൽപ്പന്നങ്ങളുടെ വിൽപ്പന തീരുന്നതുവരെ തുടരുന്നതുമായിരിക്കും.

TENDER-CUM-AUCTION NOTICE No. MDE-2638/2010. 23rd July 2010.

Sealed tenders are invited for the sale of the vehicles which are listed in details hereunder. These vehicles were seized under Section 52 (1) and being Proceeded under Section 61 A of Kerala Forest Act, 1961. The Vehicle in Sl. No. 9, was previously bid by Sri Jainalabdeen, J. K. Iron and Steel 189/2, 3, 8, 9, 10,11, Near Masjid, Diara Street, Palakkad and he failed to remit all the dues in time. The vehicle will be sold at the risk and loss of Sri Jainalabdeen. The tender cum- auction will be conducted on 3rd September, 2010 at 2 p. m. in accordance with the Judgment of Honourable High Court of Kerala in MACA 1458/2006 dated 2-12-2008 and the direction from Government of Kerala in Circular No. 89584/G3/08/Home dated 5-1-2009. The Divisional Forest Officer, Marayoor or the Officer authorized by him will conduct the tender-cum-auction at the Office of the Divisional Forest Officer, Sandal Division, Marayoor. The highest rate quoted in the tender-cum-auction will be confirmed in the name of the bidder in accordance with Government order G. O. (Rt.) No. 92/2009/F&WLD dated 25-2-2009.

If the prescribed date fixed for tender-cum-auction will be a holiday, tender-cum-auction will be conducted on the next working day. If nobody participates in the tender-cum-auction fixed on 3-9-2010, or if any of the vehicles could not be sold on the tender-cum-auction day, the tender-cum-auction will be conducted again on 14-9-2010, 2 p. m. as per the same conditions, venue, isssuance and accepting time of tenders etc. Tender forms will be issued from this office upto 12 noon of the tender-cum-auction day and it will be received back upto 1 p. m. on the tender-cum-auction day. More details of the tender-cum-auction can be had from Divisional Forest Office, Marayoor and Range Office, Marayoor/Kanthalloor during working hours.

EMD—Rs. 10,000.

Value of tender form—Rs. 200 + 4% VAT (for each vehicle).

CONDITIONS

1. Those who intend to take part in the tender- cum-auction can inspect and verify the present condition of the vehicle in the presence of the Range Officer, Marayoor. The complaints which are brought forward after the tender-cum-auction will not be entertained.

2. Those who need the tender forms should apply along with the attested copy of the Identity Card issued by the Election Commission or Driving license or a PAN Card or Certificate obtained from concerned Village Officer, for proving identity and correct address duly verified with the original in the office of Divisional Forest Officer, Marayoor Division.

3. The prescribed EMD is to be paid at the Divisional Forest Office, Marayoor before the commencement of the tender-cum-auction. The EMD of the bidders, except those of the highest bidders, will be returned then and there.

4. If the tender amount is more than EMD, either 50% of the tender amount or Rs. 10,000 (ten thousand only), whichever is higher (including EMD), should be remitted on the spot.

5. The Divisional Forest Officer, Marayoor will be the sole authority in accepting or rejecting the tenders with sufficient reasons raised to the best interest of the Government.

6. Once there is a notice that the highest bid has been approved, the balance amount and the legally payable taxes should be paid by the highest bidder and the vehicle should be taken away within 15 days.

7. In case the due amount are not remitted and vehicle is not taken away within 15 days, another 15 days will be allowed on the request of the highest bidder on payment of 12% penal interest for the balance anount along with a ground rent of Rupees twenty per day. Further prolongation of the payment will not be allowed. The vehicle in this case will be re-auctioned on his own risk and loss and the payment already made by the defaulter will be forfeited to Government.

8. The insurance of the vehicle by himself should be ensured by the highest bidder soon after the delivery of the vehicle from the premises of Government Sandal Depot, Marayoor.

(ആർറ്റി) 92/2009/എഫ.് ആ ന്റ ് ഡ ബ്ല ി യ ൂ . എ ൽ . ഡ ി . ന മ്പ ർ സ ർ ക്ക ാ ർ ഉത്തരവിന്റെയും അടിസ്ഥാനത്തിൽ അവ കിടക്കുന്ന സ്ഥലത്ത് തൽസമയ അവസ്ഥയിലും സ്ഥിതിയിലും 2010 സെപ്റ്റംബർ 3-ാം തീയതി ദർഘാസ്/ലേലം മുഖേന വിൽക്കു ന്നതായിരിക്കും. ടി ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കാൻ താൽപര്യമുള്ളവരിൽനിന്നും മുദവച്ച ദർഘാസുകൾ10th AUG. 2010] FOREST DEPARTMENT 406 ക്ഷണിക്കുന്നു. ക്രമനമ്പർ 9 പ്രകാരമുള്ള വാഹനം മുമ്പിനാലെ ശ്രീ. ജൈനലാബ്ദീൻ, ജെ. കെ. അയൺ ആന്റ ് സ്റ്റീൽ 189/2, 3, 8, 9, 10, 11, മസ്ജിദിനു സമീപം, ഡയറാ സ്ട്രീറ്റ്, പാലക്കാട് എന്നയാൾ ലേലം കൊ≠ിരുന്നതും ടിയാന്റെ പേരിൽ ലേലം സ്ഥിരപ്പെടുത്തിയിരുന്നതുമാണ്. എന്നാൽ ബാക്കി പണമടച്ചു വ≠ി നീക്കം ചെയ്യുന്നതിൽ ടിയാൻ പരാജയപ്പെട്ടതിനാൽ ടി വാഹനം ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിലാണ് ലേലം ചെയ്യുന്നത്. അന്നേ ദിവസം പകൽ 2 മണിക്ക് മറയൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസറോ അല്ലെങ്കിൽ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ മറയൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽ വച്ച് വാഹനങ്ങൾ ലേലം ചെയ്യുന്നതും ലേലത്തിനുശേഷം ദർഘാസുകൾ തുറന്ന് പരിശോധിക്കുന്നതുമായിരിക്കും. ദർഘാസിലോ/ലേലത്തിലോ ഏറ്റവും കൂടുതൽ തുക വാഗ്ദാനം ചെയ്യുന്നയാളുടെ പേരിൽ ദർഘാസ്/ലേലം 25-2-2009-ലെ ജി. ഒ. (ആർറ്റി) 92/2009/എഫ്. ആന്റ ് ഡബ്ലിയൂ. എൽ. ഡി. നമ്പർ സർക്കാർ ഉത്തരവിന്റെ അടിസ്ഥാനത്തിൽ ഉറപ്പിക്കുന്നതുമായിരിക്കും.

2010 സെപ്റ്റംബർ 3 അവധി ദിവസമായി വന്നാൽ തൊട്ടടുത്ത പ്രവൃത്തി ദിവസം അതേ സ്ഥലത്തും അതേ സമയത്തും ടി ദർഘാസ്/ലേലം നടത്തുന്നതായിരിക്കും. 3-9-2010-ാം തീയതി നടക്കുന്ന ദർഘാസ്/ലേലത്തിൽ ആരും പങ്കെടുക്കാതിരിക്കുകയോ ഏതെങ്കിലും വാഹനങ്ങൾ വിൽക്കാതെയിരിക്കുകയോ ചെയ്താൽ ടി വാഹനങ്ങൾ 14-9-2010-ാം തീയതി അതേ സ്ഥലത്തും സമയത്തും വീ≠ും ദർഘാസ്/ലേലം വഴി വിൽക്കുന്നതായിരിക്കും. ദർഘാസ് ഫോറങ്ങൾ ലേല ദിവസം ഉച്ചയ്ക്ക് 12 മണി വരെ ഈ ഓഫീസിൽനിന്നും ലഭിക്കുന്നതും ഉച്ചയ്ക്ക് ശേഷം ഒരു മണി വരെ ദർഘാസ് തിരികെ സ്വീകരിക്കുന്നതുമായിരിക്കും. ദർഘാസ്/ലേലം സംബന്ധിച്ച കൂടുതൽ വിവരങ്ങൾ ഈ ഓഫീസിൽ നിന്നോ, മറയൂർ, കാന്തല്ലൂർ റെയിഞ്ചാഫീസു കളിൽനിന്നോ അറിയാവുന്നതാണ്.

നിബന്ധനകൾ

1. താൽപര്യമുള്ളവർക്ക് മുകളിൽ പറയുന്ന സ്ഥലത്ത് സൂക്ഷിച്ചിരിക്കുന്ന വാഹനത്തിന്റെ ഗുണനിലവാരം മറയൂർ റെയിഞ്ചാഫീസറുടെ സാന്നിദ്ധ്യത്തിൽ പരിശോധിച്ച് ബോദ്ധ്യപ്പെടാവുന്നതാണ്. ലേലത്തിനു ശേഷം ഉന്നയിക്കുന്ന യാതൊരു പരാതികളും പരിഗണിക്കുന്നതല്ല.

2. ദ ർ ഘ ാ സ ു ക ൾ ആ വ ശ ്യ മ ു ള്ള വ ർ അ വ െ ര തിരിച്ചറിയുന്നതിന് തിരഞ്ഞെടുപ്പ് കമ്മീഷൻ നൽകിയിട്ടുള്ള തിരിച്ചറിയൽ കാർഡോ/ബന്ധപ്പെട്ട വില്ലേജാഫീസറുടെ സർട്ടിഫിക്കറ്റോ സഹിതം അപേക്ഷിക്കേ≠താണ്. ഡ്രൈവിംഗ് ലൈസൻസ,് പാൻകാർഡ് എന്നിവയും സ്വീകരിക്കുന്നതാണ്. ഇതിന്റെ സാക്ഷ്യപ്പെടുത്തിയ പകർപ്പ് ടെ≠ർ ഫോറത്തിനോടൊപ്പം സമർപ്പിക്കേ≠താണ്. മേൽവിലാസം തെളിയിക്കുന്നതിനാവശ്യമായ രേഖകളും ഹാജരാക്കേ≠തുമാണ്.

3. ദർഘാസിനോടൊപ്പം ലേലത്തിന് മുമ്പായി നി›ിത നിരതദ്രവ്യം ഈ ഓഫീസിൽ ഒടുക്കേ≠താണ്. ദർഘാസ്/ലേലം എന്നിവ പരിഗണിക്കപ്പെടാത്ത വരുടെ നിരതദ്രവ്യം അപ്പോൾത്തന്നെ തിരികെ നൽകുന്നതുമാണ്.

4. ദർഘാസ് സംഖ്യ നിരതദ്രവ്യത്തിനേക്കാൾ കൂടുത ലാണെങ്കിൽ ദർഘാസ് സംഖ്യയുടെ 50 ശതമാനമോ 10,000 (പതിനായിരം) രൂപയോ ഏതാണോ കൂടുതൽ (നിരതദ്രവ്യം ഉൾപ്പെടെ) അത് അപ്പോൾത്തന്നെ ഒടുക്കേ≠താണ്.

5. ദർഘാസുകൾ മറയൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ അംഗീകാരത്തിന് വിധേയമായിരിക്കും. കാരണം രേഖപ്പെടുത്തി, സർക്കാർ താൽപ്പര്യത്തിന് അനുസൃതമായി ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനോ നിരസിക്കുന്നതിനോ ഉള്ള പൂർണ്ണ അധികാരം മറയൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറിൽ നിക്ഷിപ്തമായിക്കും.

6. ദർഘാസുകൾ അംഗീകരിച്ചതായി അറിയിപ്പുകിട്ടി 15 ദിവസത്തിനകം ബാക്കി സംഖ്യയും നിയമപ്രകാരമുള്ള നികുതികളും അടച്ച് വാഹനം നീക്കം ചെയ്യേ≠താണ്.

7. 15 ദിവസത്തിനുള്ളിൽ ബാക്കി സംഖ്യയും നികുതിയും അടച്ച് വാഹനം നീക്കം ചെയ്തില്ലെങ്കിൽ ദർഘാസുകാരൻ ആവശ്യപ്പെടുന്ന പക്ഷം മറ്റൊരു 15 ദിവസം കൂടി ബാക്കി സംഖ്യയ്ക്ക് 12% പിഴപലിശയും ദിവസം 20 രൂപ നിരക്കിൽ ഇരുപ്പുവാടകയും വസൂലാക്കി വാഹനം നീക്കം ചെയ്യുന്നതിന് അനുവദിക്കുന്നതായിരിക്കും. ഇതിനുശേഷം യാതൊരു കാരണവശാലും കാലാവധി നീട്ടികൊടുക്കുന്നതല്ല. ഇപ്രകാരം വീഴ്ച വരുത്തിയ ദർഘാസുകാരന്റെ നഷ്ടോത്തര വാദിത്വത്തിൽ പുനർലേലത്തിലോ ടെ≠ർ അടിസ്ഥാനത്തിലോ ടി വാഹനം വിൽക്കുന്നതും ദർഘാസുകാരൻ അടച്ച തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതുമായിരിക്കും.

8. ലേലത്തിൽ പിടിക്കുന്ന വാഹനം മറയൂർ ഡിപ്പോയിൽനിന്നും ഏറ്റെടുക്കുന്ന മുറയ്ക്ക് സ്വന്തം ചിലവിൽ ഇൻഷ്യൂർ ചെയ്യേ≠ത് ലേലക്കാരന്റെ ഉത്തരവാദിത്വമായിരിക്കും.

Tenders without adequate EMD, incomplete, defective or belated tenders will be summarily rejected. The undersigned reserves the right to reject any tender without assigning any reason thereof. The Co-operative societies, rendering the tenders should produce true copies of relevant orders exempting them from remittance of EMD/security along with the tenders if any. Sealed competitive tenders in the prescribed form are invited till 3 p. m. on 19-8-2010 from approved contractors for the following works by the Wildlife Warden, Aralam Wildlife Division for and on behalf of the Governor of Kerala. Tender form can be had from the office of the undersigned till 1 p. m. on the date of tender on payment of the cost of tender doucuments along with a request in writing. The last date and time of receipt of tender in sealed cover superscribing the name of the work is at 3 p. m. on the tender date. The tender will be opened at 3.30 p. m. in the presence of the bidders present on that date. In case the tender is not happened on 19-8-2010, it will be conducted on 26-8-2010. If it is also not happened on 26-8-2010, it will be conducted on 2-9-2010 and if it is not happened on 2-9-2010, it will be conducted on 8-9-2010. If the tender could not happen on the fixed date due to reasons beyond our control like public holiday, Hartal etc., the tender will be take place in the next working day at the same time and place.
