Thiruvananthapuram, 3rd November 2010.

Whereas, the Government are of opinion that an industrial dispute exists between the Managing Director, Foster Marketing Company, Peringandoor, Thrissur and the workmen of the above referred establishment represented by the President, Foster Employees Union, Peringandoor, Thrissur in respect of matters mentioned in the annexure to this order ;

section 10 (1) (d) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Industrial Tribunal, Palakkad. The Industrial Tribunal will pass the award within a period of three months.

ANNEXURE

(1) Whether change of designation of the workers of Shri (1) O. B. Sathyendran, (2) P. K. Sukumaran and (3) E. P. Baiju from production helpers into Machine/Cooker Operators is justifiable ? 2. If yes, what benefits they are eligible to have ?

In exercise of the powers conferred by Sections 3 and 5 of the Notaries Act, 1952 (Central Act 53 of 1952) read with sub-rule (4) of rule 8 of the Notaries Rules, 1956 the Government of Kerala hereby re-appoint Sri A. P. Premlal, Advocate, Thalikulam P. O., Chavakkad, Thrissur as Notary for a further period of five years with effect from 21-8-2010 in the area comprising the jurisdiction of Munsiff's Court, Chavakkad in the Revenue District of Thrissur with Register No. 7/2000/TCR.

Whereas, the Government are of opinion that an industrial dispute exists between the Manager, Morning Star Tile Works, Ollur, Thrissur District-680 306 and the workmen of the above referred establishment represented by the General Secretary, Thrissur District National Tile Workers Union (INTUC), Alagappa Nagar, Thrissur-680 302 in respect of matters mentioned in the annexure to this order;

In exercise of the powers conferred by Sections 3 and 5 of the Notaries Act, 1952 (Central Act 53 of 1952) read with sub-rule (4) of rule 8 of the Notaries Rules, 1956 the Government of Kerala hereby re-appoint Sri K. J. Johnson, Advocate, Kanadan House, Thevara, Kochi-13 as Notary for a further period of five years with effect from 20-12-2010 in the area comprising Kochi Corporation area in the Revenue District of Ernakulam with Register No. 19/2000/EKM.

And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;

Now, therefore, in exercise of the powers conferred by section 10 (1) (d) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Industrial Tribunal, Palakkad. The Industrial Tribunal will pass the award within a period of three months.

In exercise of the powers conferred by Sections 3 and 5 of the Notaries Act, 1952 (Central Act 53 of 1952) read with sub-rule (4) of rule 8 of the Notaries Rules, 1956 the Government of Kerala hereby re-appoint Sri G. Madhusoodanan Pillai, Advocate, 'Venuka' Near Kacheri, Attingal, Thiruvananthapuram as Notary for a further period of five years with effect from 15-12-2010 in the area comprising Chirayinkeezhu Taluk in the Revenue District of Thiruvananthapuram with Register No. 109/97/TVPM.

(1) Whether there was denial of employment to Shri C. A. Ramachandran, Worker of Morning Star Tile Works, Ollur during the period from 2-10-2008 to 14-9-2009 by the management ? If so what relief he is entitled to get ? (2) Whether the demand to recognise his service under the management of Morning Star Tile Works, Ollur as continuous service from 2004 onwards is justifiable ? If so what relief he is entitled to get ?

O., Neyyattinkara Taluk, Thiruvananthapuram District as Notary for a further period of five years with effect from 6-12-2010 in the area comprising Neyyattinkara Taluk in the Revenue District of Thiruvananthapuram with Register No. 20/2000/TVPM.
