ദർഘാസ് ഫോറവും മറ്റു വിവരങ്ങളും ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (IHRD)-ടെ കാര്യാലയത്തിൽ നിന്നും 2011 ഫെബ്രുവരി 7-ാം തീയതി 11 മണി വരെ ലഭിക്കുന്നതാണ്. ആയതിന് രേഖാമൂലം അപേക്ഷിക്കേ≠താണ്. ദർഘാസ് ഫോറത്തിന്റെ വിലയോടൊപ്പം വാറ്റും പ്രത്യേകം ഈടാക്കുന്ന താണ്. ദർഘാസുകൾ അന്യോന്യം കൈമാറാൻ പാടുള്ളതല്ല. ദർഘാസ് പ്രമാണങ്ങളുടെ വില യാതൊരു കാരണവശാലും തിരികെ ലഭിക്കുന്നതല്ല.

പൂരിപ്പിച്ച ദർഘാസുകൾ 7-2-2011 പകൽ 1 മണിവരെ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (IHRD)-ഓ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ സ്വീകരിക്കുന്നതാണ്. ദർഘാസ് സമർപ്പിച്ചവരിൽ സ്ഥലത്ത് ഹാജരായിട്ടുള്ള കരാറുകാരുടെ സാന്നിദ്ധ്യത്തിൽ ടി ദിവസം 3.30-ന് ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ ദർഘാസുകൾ തുറക്കുന്നതാണ്. നി›ിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ദർഘാസുകൾ സ്വീകരിക്കുന്നതല്ല. നിരതദ്രവ്യം ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (IHRD), ഫോറസ്ട്രി ട്രെയിനിംഗ് കോംപ്ളക്സ്, തിരുവനന്തപുരം എന്ന പേരിൽ πഡ്ജ് ചെയ്ത് ദർഘാസിനോടൊപ്പം അടക്കം ചെയ്തിരിക്കണം. ശരിയായ രീതിയിൽ നിരതദ്രവ്യം ഇല്ലാത്ത ദർഘാസുകൾ നിരസിക്കപ്പെടുന്നതാണ്. ഏതെങ്കിലും കാരണവശാൽ മേൽ ദിവസം ദർഘാസ് നടത്താൻ കഴിയാത്ത സാഹചര്യം വരികയോ ദർഘാസുകൾ സമർപ്പിക്കേ≠ുന്ന/ ദർഘാസ് നടത്തുന്ന ദിവസം പൊതു അവധിയായിവരുന്നപക്ഷം അടുത്ത പ്രവൃത്തി ദിവസം ദർഘാസ് സമർപ്പിക്കേ≠/ദർഘാസ് നടത്തുന്ന ദിവസമായി കണക്കാക്കുന്നതാണ്.

No. PL2-167/2011. 11th January 2011.

It is hereby notified for the information of the public that the produces as per the Schedule below, collected by Fourth silvicultural thinning in 1978 Teak Plantation Cheruppittakavu in Vellamthetty Section and Final silvicultural thinning in 1968 Teak Plantation Vellamthetty Channackamon in Ambanar Section of Pathanapuram Range of this division will be sold in public tender/auction at the site at the time and place mentioned in the schedule by the Divisional Forest Officer, Punalur or any other officer duly authorized by him subject to the conditions published in Kerala Gazette No. 49 dated 14-12-2010 by the Chief Conservator of Forests (P) vide Letter No. Pro. (5)-5628/10 dated 2-12-2010.

In case the date of auction happens to be a holiday, the sale will be conducted in the next working day at the time and place mentioned in the notification. If the tender/ auction could not be conducted on the notified date due to any other reason or if all the produce put for the tender/auction could not be sold on the above notified date, the same shall be conducted on 14-2-2011 at the same time and place mentioned in the notification. In addition to the above, the produce delivered at the dumping depots till the date of tender/auction will also be included in the auction. More details can be had either from Range Office, Pathanapuram or the office of the undersigned during working hours or in the Kerala Forest Website www.keralaforest.org.

Tender form can be had from the office of the undersigned till 1 p. m. on the day before the auction date on payment of `200+VAT. The last date and time of receipt of tender is at 9 a. m. on the auction date.

ദർഘാസ് സ്വീകരിച്ചശേഷം പ്രവൃത്തി ലഭിച്ച കരാറുകാരൻ എഗ്രിമെന്റ ് വയ്ക്കാതെ ഒഴിഞ്ഞുമാറുകയാണെങ്കിൽ ഈ കാരണംകൊ≠് പ്രസ്തുത പ്രവൃത്തി വേറെ കരാറു കാരനെ ഏൽപ്പിക്കേ≠ിവരികയോ അല്ലെങ്കിൽ മറ്റ് ഏതെങ്കിലും തരത്തിലോ സർക്കാരിനു≠ാകുന്ന എല്ലാ കഷ്ടനഷ്ടങ്ങൾക്കും ഇത്തരത്തിൽ ഒഴിഞ്ഞുപോകുന്ന കരാറുകാരൻ ഉത്തരവാദി യായിരിക്കും. അപ്രകാരം ഉ≠ായേക്കാവുന്ന കഷ്ടനഷ്ടങ്ങൾ ആദ്യകരാറുകാരനിൽനിന്ന് ഈടാക്കുന്നതിന് `50-ന്റെ മുദ്രപത്ര ത്തിൽ ഒരു സമ്മതപത്രം എഴുതി ദർഘാസ് സഹിതം എല്ലാവരും ഏൽപ്പിക്കേ≠താണ്. ദർഘാസ് ഫോറങ്ങൾ ലഭിക്കുന്നതിന് പൊതുമരാമത്ത് വകുപ്പ് രജിസ്ട്രേഷൻ കാർഡ്, വിൽപ്പന നികുതി രജിസ്ട്രേഷൻ സർട്ടിഫിക്കറ്റ് എന്നിവ കാണിക്കേ≠താണ്.

Intending tenderers/bidders are bound to remit KVAT, K.F.D. Tax, Income Tax and Other Taxes in force from time to time. ലേലദിവസം പൊതു അവധിയായി വന്നാൽ അടുത്ത പ്രവൃത്തി ദിവസം നി›ിത സ്ഥലത്തും സമയത്തും ലേലം നടത്തുന്നതാണ്. എന്തെങ്കിലും കാരണവശാൽ ലേലദിവസം ലേലം നടക്കാതെ വരികയോ ഉൽപ്പന്നങ്ങൾ പൂർണ്ണമായും വിൽക്കാൻ കഴിയാതെ വരികയോ ചെയ്താൽ താഴെ കാണിച്ചിരിക്കുന്ന തീയതിയിൽ ഉൽപ്പന്നങ്ങൾ വീ≠ും പരസ്യമായി ലേലം ചെയ്തു വിൽക്കുന്നതാണ്.

ലേലത്തിൽ പങ്കെടുക്കണമെന്നാഗ്രഹിക്കുന്നവർ ലേലത്തിന് മുൻപായി ഉൽപ്പന്നങ്ങൾ അട്ടിവച്ചിരിക്കുന്നത് പരിശോധിച്ച് അവയുടെ നൽപ്പുനിൽപ്പുകൾ ബോദ്ധ്യപ്പെട്ടുകൊള്ളേ≠താണ്. ഉൽപ്പന്നങ്ങളുടെ ഗുണനിലവാരത്തെ സംബന്ധിച്ച് ലേലത്തിനുശേഷം ഉ≠ാകുന്ന പരാതികൾ പരിഗണിക്കുന്നതല്ല.

ലേലത്തിൽ പങ്കെടുക്കണമെന്നാഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കയ്യൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ സർട്ടിഫിക്കറ്റും ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽനിന്നും വാങ്ങി നിരതദ്രവ്യം കെട്ടിവയ്ക്കുന്നതിനുമുൻപായി ഹാജരാക്കേ≠താണ്. ഇപ്രകാരമുള്ള സർട്ടിഫിക്കറ്റ് ഹാജരാക്കാത്തവരെ ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.

ലേലക്കാർ അതാതു കാലത്ത് പ്രാബല്യത്തിലുള്ള വിൽപ്പന നികുതിയും വനവികസന നികുതിയും മറ്റ് നികുതികളും കൊടുക്കുന്നതിന് ബാദ്ധ്യസ്ഥരായിരിക്കും. ടി തോട്ടങ്ങളിൽ ജോലികൾ പുരോഗമിക്കുന്നതിനാൽ ഈ വി⁄ാപനത്തിൽ പരസ്യപ്പെടുത്തിയതിനേക്കാളും കൂടുതൽ ഉൽപ്പന്നങ്ങൾ പ്രസ്തുത ലേലത്തിൽ വിൽപ്പനയ്ക്ക് പ്രതീക്ഷിക്കാവുന്നതാണ്.

TENDER CUM AUCTION NOTICE

No. A1-2453/2010.

6th January 2011.

1. It is hereby notified for the information of the public that the right of collection and removal of standing Elavu and Vatta trees in the 1969 Match Wood Plantation, Aruvikkara in Achencovil Range of this division as specified in the schedule appended below will be sold in tender cum auction by the Divisional Forest Officer, Achencovil or any other officer authorized by him on 24-2-2011 at 11 a.m. in the Divisional Forest Office, Achencovil subject to the terms and conditions of sale of timber in Government Timber Depots published in Government Gazette No. 50 dated 16-12-2008 Gaz. No. 4/2011/DTP (Forest).

page No. 481 to 488 of Forest sheet as per Pro(5)-7698/08 dated 6-12-2008 of the Chief Conservator of Forests (P) Thiruvananthapuram and as per general conditions of the sale of tree growth prevailing in the department. In case the notified date happens to be a public holiday the tender/sale will be conducted on the next working day at the notified place and time.

2. The auction will be on lumpsum basis for the right of collection and removal of entire Elavu and Vatta tree growth from the above Plantations/blocks mentioned in the schedule hereto the area of which has been surveyed and demarcated on the ground.

3. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before participating in the tender/auction. Complaints if any regarding quality and quantity etc. received after the Tender/Auction will not be entertained.

4. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless valid power of attorney is produced prior to commencement of auction/tender.

5. A supply contractor of Achencovil Division or the adjacent divisions will not be allowed to bid in the Auction/Tender.

6. Intending Tenderers/ bidders should produce a certificate from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.

7. The successful tenderers/bidders should give an undertaking that he is not related to any Officer having control of the work and that he is not supply contractor of this or any adjacent divisions. If this is proved otherwise it shall result in cancellation of the contract and resale of the coupe at his risk and loss.

8. No petition or post offer received after seven days of the conduct of the Tender/Auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is ` One Lakh and above and more than 20% where the original bid amount is less than one lakh will ordinarily be considered.

The post offerer will comply with following terms.

(a) Offer should be made within seven days of tender/auction failing which the offer will not be considered.

(b) Offerer should remit double the amount paid by the successful tenderers/bidders on the tender/auction date.

(c) The remittance should be made by the Chalan or Bank Deposit and the Bank Receipt should be produced before the Divisional Forest Officer concerned within seven days from the date of receipt of registered notice to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned, pledging the Security Deposit for the due fulfillment of the above terms. If the post offerer satisfied the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules. In the re-auction, the price fetched, if does not comes up to what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest bidder/tenderer in the re-auction and the amount remitted by the post offerer will be released to him.

9. Further particulars can be had either from the Office of the Divisional Forest Officer or from the Range Officer concerned.

10. Intending Tenderers/Bidders should Deposit an Earnest Money Deposit of ` 10,000 (Rupees Ten Thousand only)for each coupe for participating in the tender/auction. Separate tender should be sumitted for each block/bit.

11. The successful Tenderers/Bidders have to remit 35% sale value on the tender/auction date. If this 35% value exceeds ` 1,00,000, ` 1,00,000 will be remit on auction date itself and balance value have to remit in Sub Treasury, Punalur within 7 working days through the countersigned chalan issued from this office and submit the chalan to this office. If failed to remit this amount, the EMD will be forfeited to Government and the coupe will be resaled at his risk and loss.

12. If the value fetched in the resale/retender is less than that obtained in the original tender/sale the difference between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting tenderers/Bidders through legal means including Revenue Recovery Act inforce.

13. The participating tenderers/Bidders have only right to collection and removal of enumerated standing Elavu and Vatta trees and no right for removal of trees like teak, Rose Wood etc.

14. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax etc. at the rate prevailing from time to time.

15. The successful Tenderers/Bidders should execute a bounded agreement on a Stamp Paper worth ` 50 after the completion of the Tender/Auction.

16. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit 1/3rd of the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force and Security Deposit of 10% for the total sale value. The successful Tenderers/Bidders should execute an agreement on a Stamp Paper worth ` 50. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days shall be granted by the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the amount within the extended period further extension for 15 days by the Chief Conservator of Forests and 15 days by the Addl. Principal Chief Conservator of Forests shall be granted subject to the realization of penal interest at 24% and 48% respectively. But all the extension periods mentioned above will be within the original contract period.

17. The balance 2/3rd sale value should be remitted in two equal installments by the successful Tenderers/Bidders. The first installment should be remitted within 15 days from the date of agreement and the second installment within 30 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers/Bidders fails to remit the above amount within the period mentioned above, extension for 15 days by realizing penal interest at 12% by Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Chief Conservator of Forests concerned and further extension for 30 days by the Addl. Principal Chief Conservator of Forests concerned by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will be within the original contract period.

18. The period of contract will be 60 days from the date of intimation of conformation. No extension of period of contract shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests concerned may grant extension of time for one month and two months respectively on realization of penalty or penalties for completion of each work for each month mentioned below:

(a) For enumerated trees and balance unfelled per hectare or fraction there of— ` 750 per hectare.

(b) Unremoved registered logs and unregistered logs—` 100/m³ or fraction thereof.

(c) Unremoved firewood— ` 50/Tone or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during the original contract period. The Penalty for the first month shall be realized as the above rates; double the rate for the second month and three times of the original rate for the third month shall be realized. If the Tenderers/Bidders fail to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenders as per the agreement will be forfeited to Government and the Tenderers/Bidders have not any right on the produce confiscated to Government. In the above circumstances the balance work to be executed by the tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the Tenderers/Bidders.

19. The license for removal of Elavu and Vatta Timber and Fire Wood collected in the coupe should be issued only on the basis of the prevailing norms.

20. The contractor/his agent shall enter the coupe only after getting the written permission from the Divisional Forest Officer, Achencovil/Forest Range Officer, Achencovil.

21. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 meters and keep the cairns intact.

22. The contractor will be liable for any damage or loss caused to other trees in the plantation or reserve.

23. The Divisional Forest Officer will give permission to keep the timber and other produce outside the coupe if requested by the contractor at his risk. But if the collected timber/fire wood are not removed within the agreement period due to unforeseen situation/climate, a ground rent @ ` 250 will be recovered from the contractor.

24. The contractor will be liable for all the illegal activities occurred within 0.4 k. m. perimeter of the coupe. Any such activities noticed will be reported to the forest officials by the contractor, otherwise the contract will be cancelled.

25. The security deposit will be refunded only after the successful completion of contract after producing the clearance certificates of VAT, Income Tax etc. If there is any liabilities outstanding in this respect to the Government that will be adjusted from the security deposit of the contractor.

26. All common conditions regarding sale coupe are also applicable to this Tender/Auction.

Remarks:— If the Tender/Auction could not be conducted on the notified date due to any other reason the Tender/ Auction shall be conducted on 9-3-2011 at 11 a.m. at the same place. In that case tender forms will be issued till 5 p. m. on 8-3-2011 and the sealed tenders will be accepted till 10 a. m. on 9-3-2011.

ദർഘാസ്/ലേല ദിവസം പൊതു അവധിയായി വന്നാലോ മറ്റേതെങ്കിലും കാരണത്താലോ ദർഘാസ്/ലേലം നടത്താൻ കഴിയാതെ വന്നാൽ ടി ദർഘാസ്/ലേലം അടുത്ത പ്രവൃത്തി ദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും വച്ച് നടത്തുന്നതായിരിക്കും.

2. ടെ≠ർ/ലേലം ഒരു നി›ിത തുകയുടെ അടിസ്ഥാനത്തിലാണ് നി›യിച്ചിരിക്കുന്നത്. ഇതിലേക്കായി സർവ്വെ ചെയ്ത് തിരിച്ചിട്ടുള്ള പ്രസ്തുത ബ്ലോക്കുകളിലെ നിൽപ്പ് ഇലവ്, വട്ട മരങ്ങളുടെ നീക്കം ചെയ്യൽ സംബന്ധിച്ച ജോലിക്കുവേ≠ിയാണ് ഇത് തീരുമാനിച്ചിരിക്കുന്നത്.

3. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലത്തിന് മുൻപായി ഉൽപ്പന്നങ്ങളുടെ നൽപ്പുനിൽപ്പ് ക≠് ബോദ്ധ്യപ്പെടേ≠തും അവ സംബന്ധിച്ച യാതൊരു പരാതികളും ലേലത്തിനുശേഷം പരിഗണിക്കുന്നതുമല്ല.

4. ദർഘാസുകാരൻ/ലേലക്കാരൻ നേരിട്ട് ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കേ≠താണ്. നിയമപരമായ പവർ ഓഫ് അറ്റോർണി ഇല്ലാത്ത പകരക്കാരെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല.

5. അച്ചൻകോവിൽ ഡിവിഷനിലേയും മറ്റ് സമീപ ഡിവിഷനുകളിലേയും സപ്ളൈ കോൺട്രാക്ടർമാരെ ടി ദർഘാസ്/ ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.

6. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ വിലാസവും കൈയൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽനിന്നും വാങ്ങിയ സർട്ടിഫിക്കറ്റ് നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാക്കേ≠താണ്.

7. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ ആഫീസുമായോ ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസ്/ലേലദിവസം ദർഘാസുകാരൻ/ലേലക്കാരൻ ഈ ആഫീസിൽ സമർപ്പിക്കേ≠താണ്. ഇത്തരത്തിൽ ദർഘാസുകാരൻ/ലേലക്കാരൻ ബന്ധപ്പെട്ട ആഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാൻെറ പേരിലുള്ള ദർഘാസ്/ലേലം റദ്ദ് ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പുകൾ പുനർലേലം ചെയ്യുന്നതാണ്.

8. ദർഘാസ്/ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുള്ള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരു ലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10%-ൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽപ്പെട്ട ലേലങ്ങൾക്ക് 20%-ൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകൾ മാത്രമേ പരിഗണിക്കുകയുള്ളു. കൂടാതെ താഴെ പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമാണ്.

(എ) ദർഘാസ്/ലേലത്തിൽ 7 ദിവസത്തിനുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.

(ബി) പോസ്റ്റ് ഓഫർകാരൻ യഥാർ∞ ദർഘാസ്/ലേലക്കാരൻ ഒടുക്കിയ തുകയുടെ ഇരട്ടി തുക അടയ്ക്കേ≠താണ്.

(സി) ബന്ധപ്പെട്ട പോസ്റ്റ് ഓഫർ തുകയും മറ്റു നികുതികളും ചെലാൻ മുഖാന്തിരമോ ബാങ്ക് രസീത് വഴിയോ ഈ ആഫീസിൽനിന്നും രജിസ്റ്റേർഡ് തപാൽ മുഖേന അറിയിച്ച് ഏഴ് ദിവസത്തിനുള്ളിൽ ഒടുക്കി ഈ ആഫീസിൽ ഹാജരാക്കേ≠താണ്. പോസ്റ്റ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ കൂപ്പുകളുടെയും അതിലെ നിൽപ്പ് മരങ്ങളുടെയും ഗുണനിലവാരവും മറ്റ് ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ടശേഷം നി›ിത മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്.

13. ദർഘാസ്/ലേലംകൊള്ളുന്ന ആൾക്ക് പ്രസ്തുത കൂപ്പിൽ എന്യൂമറേറ്റ് ചെയ്ത് നിർത്തിയിരിക്കുന്ന ഇലവ്, വട്ട മരങ്ങൾക്ക് മാത്രം അവകാശമുള്ളതും തേക്ക്, ഈട്ടി, മററ് മരങ്ങൾ മുതലായവയ്ക്ക് അവകാശമില്ലാത്തതുമാകുന്നു.

14. വിജയിയായ ദർഘാസ്/ലേലക്കാരൻ നിലവിലുള്ള നിരക്കിൽ മൂല്യവർദ്ധിത നികുതി, വനവികസന നികുതി, വരുമാന നികുതി എന്നിവയും ഒടുക്കേ≠താണ്.

15. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലംകൊള്ളുന്ന ആൾ ` 50-ന്റെ മുദ്രപത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടികൂടി ലേലം കഴിഞ്ഞാലുടൻ ഒപ്പ് വയ്ക്കേ≠താണ്.

16. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുടെ മൂന്നിൽ ഒന്നും മൊത്തം തുകയുടെ 5% ഫോറസ്റ്റ് ഡെവലപ്മെന്റ ് ടാക്സും, നിലവിലുള്ള നിരക്കിൽ വില്പന നികുതി, ഇൻകം-ടാക്സ് എന്നിവകളും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10% സെക്യൂരിറ്റി ഡെപ്പോസിറ്റും വച്ച് ` 50-ന്റെ മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠തുമാണ്. 15 ദിവസത്തിനുള്ളിൽ ടി തുകകൾ ഒടുക്കാതിരുന്നാൽ 12% പലിശയോടുകൂടി തുകകൾ ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയവും 24% പലിശയോടുകൂടി വീ≠ും 15 ദിവസത്തെ സമയവും യു‡ംപോലെ അച്ചൻകോവിൽ ഡിവിഷണൽ ഫോറസ്റ്റോഫീസർ അനുവദിക്കുന്നതാണ്. ഈ കാലാവധിക്കുള്ളിലും തുക ഒടുക്കാതെ വന്നാൽ കൊല്ലം ഫോറസ്ററ് കൺസർവേറററുടെ യു‡ംപോലെ 24% പലിശ നിരക്കിൽ 15 ദിവസത്തേയും വീ≠ും 48% പലിശ നിരക്കിൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ംപോലെ സമയം അനുവദിക്കുന്നതാണ്. എന്നാൽ മുകളിൽ പറഞ്ഞ കാലാവധികളെല്ലാം കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും.

17. ബാക്കി മൂന്നിൽ ര≠് ലേലത്തുക ര≠് തുല്യ ഗഡുക്കളായി ഒടുക്കേ≠താണ്. ആദ്യ ഗഡു കരാർ തീയതി മുതൽ 15 ദിവസത്തിനകവും ര≠ാം ഗഡു കരാർ തീയതി മുതൽ ഒരു മാസത്തിനകമോ കരാർ കാലാവധിക്കകമോ ഏതാണോ ആദ്യം ആ കാലാവധിക്കുള്ളിലും ഒടുക്കേ≠താണ്. ടി കാലാവധിക്കുള്ളിൽ പണം ഒടുക്കുവാൻ കഴിയാതെ വന്നാൽ 12% പലിശ നിരക്കിൽ ഡിവിഷണൽ ഫോറസ്റ്റോഫീസർക്ക് 15 ദിവസത്തേയും 24% പലിശ നിരക്കിൽ കൊല്ലം ചീഫ് ഫോറസ്റ്റ് കൺസർവേ റ്ററുടെ യു‡ംപോലെ 30 ദിവസത്തേക്കും, വീ≠ും 30 ദിവസത്തേയ്ക്ക് 48% പലിശ നിരക്കിൽ അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ംപോലെയും കാലാവധി നീട്ടിക്കൊടുക്കാവുന്നതാണ്. എന്നാൽ നീട്ടിക്കൊടുക്കുന്ന കാലാവധി കളെല്ലാംതന്നെ കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും.

18. ഉടമ്പടി കാലാവധി ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 60 ദിവസമാണ്. സാധാരണ ഗതിയിൽ കൂപ്പിന്റെ കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും അച്ചൻകോവിൽ ഡിവിഷണൽ ഫോറസ്റ്റോഫീസർ, കൊല്ലം ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ എന്നിവർ യഥാക്രമം ഒന്നും ര≠ും മാസംവീതം താഴെ പറയുംപ്രകാരം പിഴ ഈടാക്കിക്കൊ≠് ഓരോ ജോലിക്കും കാലാവധി നീട്ടിക്കൊടുക്കുന്നതാണ്.

(എ) എന്യൂമറേറ്റ് ചെയ്തതും മുറിക്കാനുള്ളതുമായ മരങ്ങൾക്ക് ഓരോ ഹെക്ടറിനും അതിന്റെ ഭാഗത്തിനും ` 750 വീതം.

(ബി) നീക്കം ചെയ്യാത്ത രജിസ്റ്റർ ചെയ്തതും അല്ലാത്തതുമായ തടികൾക്ക് ഓരോ ക്യൂ. മീറ്ററിനും അതിൻെറ ഭാഗത്തിനും ` 100 വീതം.

(സി) നീക്കം ചെയ്യാത്ത വിറകിന് ഓരോ ടണ്ണിനും അതിന്റെ ഭാഗത്തിനും ` 50 വീതം.

ഒന്നാമത്തെ മാസത്തേക്ക് ടി നിരക്കിലും 2-ാം മാസത്തേക്ക് ഇതിന്റെ ഇരട്ടിയും 3-ാം മാസത്തേക്ക് ഒന്നാം മാസത്തെ നിരക്കിന്റെ മൂന്നിരട്ടിയും എന്ന ക്രമത്തിൽ പിഴ ഈടാക്കുന്നതാണ്. ഇപ്രകാരം നീട്ടി നൽകുന്ന തീയതിക്കുള്ളിലും നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റിലേക്ക് മുതൽ കൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ാകുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ചെയ്തു തീർക്കുവാനുള്ള ജോലികൾ ഡിപ്പാർട്ട്മെന്റ ് ചെയ്യിക്കുന്നതും ആയതിൽ വച്ചു≠ാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതുമായിരിക്കും.

19. കൂപ്പിൽ ശേഖരിച്ച് വയ്ക്കുന്ന ഇലവ്, വട്ട തടികളും വിറകും നിലവിലുള്ള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും നീക്കം ചെയ്യാനുള്ള ലൈസൻസ് നൽകുന്നത്.

20. അച്ചൻകോവിൽ ഡിവിഷണൽ ഫോറസ്റ്റോഫീസറുടെയോ അച്ചൻകോവിൽ റെയിഞ്ചോഫീസർമാരുടെയോ രേഖാമൂലമുള്ള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ കൂപ്പിൽ പ്രവേശിക്കുവാൻ പാടുള്ളു.

21. ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാ സമയവും കൂപ്പിൽ ഉ≠ായിരിക്കണം.

കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിയിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കേ≠തുമാണ്.

22. യാതൊരു കാരണവശാലും പ്ളാൻേറഷനിലേയോ റിസർവ്വിലേയോ മറ്റ് മരങ്ങൾക്കും തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്തുവാൻ പാടില്ല. അങ്ങനെ ഉ≠ാകുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദി ആകുന്നതാണ്.

23. കൂപ്പിന് പുറത്ത് ഫോറസ്റ്റ് സ്ഥലത്ത് തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടിക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ അനുവദിക്കുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണങ്ങളാലോ മോശമായ കാലാവസ്ഥമൂലമോ ഉടമ്പടി കാലാവധിക്കുള്ളിൽ ഇവ നീക്കം ചെയ്തുകൊ≠് പോകാൻകഴിയാതെ വന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്ടറിന് ` 250 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതായിരിക്കും.

24. കൂപ്പിന് 0.4 കീ. മീറ്റർ (2 ഫർലോങ്) ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ അനധികൃത കുറ്റകൃത്യങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്. അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ വിവരം ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥരെ ഉടമ്പടിക്കാരൻ അറിയിക്കേ≠താണ്. ഇതിൽ വീഴ്ച വരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടാവുന്നതാണ്.

25. കരാറുകാരന്റെ സെക്യൂരിറ്റി തുക കാലാവധിക്കുശേഷം കരാറുകാരൻ സെയിൽസ് ടാക്സ്, ഇൻകം ടാക്സ്, അഗ്രികൾച്ചറൽ ഇൻകം ടാക്സ് ഇവയുടെ ക്ളിയറൻസ് സർട്ടിഫിക്കറ്റ് ഹാജരാക്കുന്ന മുറയ്ക്ക് തിരിച്ചു നൽകുന്നതാണ്. എന്നാൽ ടി ഇനത്തിൽ ഗവൺമെന്റിലേക്ക് ബാദ്ധ്യതകൾ വല്ലതുമു≠െങ്കിൽ സെക്യൂരിററി തുകയിൽ നിന്നും ഈടാക്കുന്നതാണ്.

26. സെയിൽ കൂപ്പുകളെ സംബന്ധിച്ച എല്ലാ പൊതു നിബന്ധനകളും ഈ ദർഘാസ്/ലേലത്തിനും ബാധകമായിരിക്കും.

ദർഘാസ്/ലേലം സംബന്ധിച്ച കൂടുതൽ വിവരങ്ങൾക്ക് ഈ ആഫീസുമായോ അച്ചൻകോവിൽ റെയിഞ്ചാഫീസുകളുമായോ എല്ലാ പ്രവൃത്തി ദിവസങ്ങളിലും ബന്ധപ്പെടാവുന്നതാണ്.

കുറിപ്പ്്:—ദർഘാസ്/ലേലം ഏതെങ്കിലും കാരണവശാൽ നി›ിത ദിവസമോ അതിനടുത്ത ദിവസമോ നടക്കാതെ വന്നാൽ ടി മരങ്ങളുടെ ദർഘാസ്/ലേലം 9-3-2011-ൽ ടി സ്ഥലത്തും സമയത്തും നടത്തുന്നതായിരിക്കും. അങ്ങനെ വന്നാൽ ദർഘാസ് ഫോറങ്ങൾ 8-3-2011 വൈകിട്ട് 5 മണിവരെ വിതരണം ചെയ്യുന്നതും മുദ്രവച്ച ദർഘാസ് 9-3-2011 പകൽ 10 മണിവരെ സ്വീകരിക്കുന്നതുമായിരിക്കും.

Separate sealed competitive tenders superscribing the name of work are invited by the undersigned, for and on behalf of the Governor of Kerala, from Registered eligible contractors for the following work.

Name of Work with Approximate PAC—Construction of RO's Quarters at Ranni Range in Ranni—` 15 Lakh.

EMD— ` 37,500.

Cost of tender form—` 2,300+ VAT 4%.

Last date and time for receipt of tender—16-2-2011, 3 p.m.

Period of Work—3 months from the date of handing over of the site.

Tender forms and other conditions can be obtained from the office of the undersigned on application in writing and on payment of the cost of tender form and taxes in cash (not refundable) up to 1 p. m. on 16-2-2011. The filled up tenders will be received in this office up to 3 p. m. on 16-2-2011 and opened by the undersigned or an officer authorised by him on the same day at 3.30 p. m. at the office of the Divisional Forest Officer, Ranni in the presence of the contractors attending on the date. If the due date happens to be a holiday, the next working day will be the due date.

The tender forms are not transferable. The earnest money deposit noted above should be paid along with the tenders by Demand Draft (Cheque will not be acceptable) pledged in favour of the undersigned payable at any nationalized Bank/Scheduled Bank. Incomplete tenders and tenders without EMD are liable to be rejected. The undersigned reserves the right to reject any tender without assigning any reasons thereof. All other conditions prevailing in the Kerala PWD and Forest Department are applicable to this tender also. The tenders not containing the prescribed preliminary agreement in Stamp Paper worth ` 100 will be summarily rejected. If there is no response to any of the works included in this notification, the same will be again tendered on 23-2-2011, 28-2-2011 as per the same conditions mentioned above, at the same time and venue.

6. ദർഘാസ് സംഖ്യ നിരതദ്രവ്യത്തിനേക്കാൾ കൂടുതലാണെങ്കിൽ ദർഘാസ് സംഖ്യയുടെ 50 ശതമാനം (നിരതദ്രവ്യം ഉൾപ്പെടെ) അപ്പോൾത്തന്നെ ഒടുക്കേ≠താണ്. ദർഘാസ് സംഖ്യ നിരതദ്രവ്യത്തിനേക്കാൾ കുറവ് ആണെങ്കിൽ കൂടുതൽ അടച്ച തുക വിജയിയായ ദർഘാസുകാരന് ദർഘാസ് തുറക്കുന്ന ദിവസം തന്നെ തിരികെ നൽകേ≠ താണ്. ലേലം/ദർഘാസ് തുക 10,000-കുറവാണ് എങ്കിൽ മുഴുവൻ തുകയും അപ്പോൾത്തന്നെ ഒടുക്കണം.

7. ദർഘാസുകൾ ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥന്റെ അധികാരത്തിന് വിധേയമായിരിക്കും. ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനുള്ള പൂർണ്ണ അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമായിരിക്കും.

8. ദർഘാസുകൾ അംഗീകരിച്ചതായി അറിയിപ്പുകിട്ടി 15 ദിവസത്തിനകം ബാക്കി സംഖ്യയും നിയമപ്രകാരമുള്ള നികുതികളും അടച്ച് വാഹനം നീക്കം ചെയ്യേ≠താണ്.

9. 15 ദിവസത്തിനുള്ളിൽ ബാക്കി സംഖ്യയും നികുതികളും അടച്ച് നീക്കം ചെയ്തില്ലെങ്കിൽ ദർഘാസുകാരൻ ആവശ്യപ്പെടുന്നപക്ഷം മറ്റൊരു 15 ദിവസംകൂടി സംഖ്യയ്ക്ക് 12 ശതമാനം പലിശയും ദിവസം ` 20 നിരക്കിൽ ഇരുപ്പുവാടകയും വസൂലാക്കി അനുവദിക്കുന്ന തായിരിക്കും. ഇതിനുശേഷം കാലാവധി നീട്ടി അനുവദി ക്കുന്നതല്ല. ഇപ്രകാരം വീഴ്ചവരുത്തിയ ദർഘാസു കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ലേലത്തിലോ ടെ≠ർ അടിസ്ഥാനത്തിലോ പുനർ വിൽപ്പന നടത്തുന്നതും ആയതിൽ ഉ≠ാകുന്ന നഷ്ടം അടച്ച തുകയും ശേഷ മുളളതും നിയമാനുസൃതം വീഴ്ചവരുത്തിയ ദർഘാസു കാരിൽ നിന്നും ഈടാക്കുകയും ചെയ്യുന്നതാണ്.

It is hereby notified for the general information of the public that the right of collection and removal of entire cashew tree growth and other miscellaneous tree growth available in the area scheduled below will be sold on lumpsum basis by the Divisional Forest Officer, Malayattoor Division or his nominee at the Office of the Divisional Forest Officer, Malayattoor at 3 p.m. on 28-1-2011. If the notified day happens to be a holiday, the same will be conducted on next working day at the scheduled time and place mentioned above. If the auction25th JAN. 2011] FOREST DEPARTMENT 74 could not be conducted as noted above; the same will be conducted on 4-2-2011 at the same place and time without change of any of the conditions. The intending bidders are advised to inspect the area with the permission of the Range Officer concerned before the sale and satisfy themselves of the area, quality and the probable quantity of the produce in the area and the facilities for the transport of produce. Complaints of any sort about the area, extent, quality or quantity of produce etc. made after the sale will not be considered.

Bidders should appear for the tender/auction and produce a certificate of identification issued by the Village Officer in which Village the bidders are residing or such other valid documents. Nobody will be permitted to bid on behalf of another person unless valid power of attorney is produced.

The intending bidders should deposit EMD of ` 10,000 (Rupees Ten thousand only) for each Block as Demand Draft from a Nationalised Bank drawn in favour of the Divisional Forest Officer, Malayattoor along with the sealed tenders and sign in the copies of the sale notification having agreed to abid by the conditions of the sale. Any complaints raised afterwards in the matter will not be accepted. The successful bidder should remit 1/3rd of sale price soon after the sale is knocked down in his favour. The period of contract is two months from the date of confirmation of the sale. The detailed sale conditions regarding the sale of cashew trees and other miscellaneous tree growth are furnished hereunder.

1. The auction will be on lumpsum basis for the right of collection and removal of entire cashew tree growth and other miscellaneous tree growth from the coupe (Plantation) mentioned in the schedule.

2. (a) Intending bidders are advised to inspect the area with the permission of the Range Officer, Kalady before the sale and satisfy themselves of the area, quality and probable quantity of the produce in the area and transport facilities etc. No complaint of any sort about the area, extent or quantity of produce etc., made by them afterwards will be considered.

(b) Bidders should appear for the tender/auction in person and nobody will be permitted to bid on behalf of another unless valid power of attorney is produced prior to commencement of auction.

(c) The intending bidders should deposit EMD of `10,000 (Rupees Ten Thousand only) for each Block as Demand Draft from a Nationalised Bank drawn in favour of the Divisional Forest Officer, Malayattoor along with the sealed tenders and sign in the copies of the sale notification. Any complaint raised afterwards in the matter will not be accepted.

(d) The Officer conducting the auction sale may refuse or accept the earnest money deposit of any intending bidder without assigning any reason thereof. So also he may accept or reject any bid or may stop the sale at any stage without assigning any reason for such action.

3. The bid shall on lumpsum basis and shall be in terms of at least ` 100 and will be exclusive of taxes.

4. (a) The sale will ordinarily be knocked down in the name of the highest bidder who in turn will sign against the note of highest bid amount in the concerned auction list. Immediately after the closure of auction on the day, the highest bidder should remit the full one third value of the coupes (less the Earnest Money Deposit already paid). If the highest bidder fails to remit the full 1/3rd sale value for the auction bid by him after close of the auction on the day itself, the EMD remitted by the highest bidder will be forfeited to Government and the sale will be cancelled and resale at the risk and loss of the defaulted bidder will be conducted. Rule notified under G.O. (P) 62/76/AD dated 23-2-1976 and published in Gazette dated 9-3-1976 shall be binding on any person who attest copy of the sale notification in token of having satisfied with the condition of the sale.

(b) The Earnest Money Deposit of the unsuccessful bidders will be returned soon after the auction.

(c) The intending bidders should give their correct home address and full particulars of business concerned duty attested by the Village Officer concerned or by other competent person to prove the identity before auction.

5. The sale will ordinarily be confirmed in the name of the highest bidder by competent authority depending on their financial or other powers delegated to them, taking into consideration of the character, financial status and antecedents of the highest bidder. The confirming authority reserves himself the right to make such enquiries as he deems necessary before passing final orders on the sale. He also reserves the right to accept or reject any bid without assigning any reason thereof. There shall be no appeal against such auction.

6. (a) The confirmation of sale will ordinarily be communicated to the party concerned as early as possible within 15 days from the date of intimation of confirmation, the successful bidder shall (i) remit the balance 1/3rd value together with VAT, Cess, FDT etc. due on the full sale amounts (ii) deposit an amount 10% of the sale value as security deposit in any Nationalized Bank and pledge the same in the name of the25th JAN. 2011] FOREST DEPARTMENT 75 Divisional Forest Officer, Malayattoor (iii) execute an agreement in the prescribed form on a stamp paper worth ` 100. The highest bidder should also remit the Income Tax as per rules before the execution of agreement.

Note:—The value of Stamp Paper may vary according to the rules in force from time to time.

(b) No extension for payment of the balance sale value, sale tax etc. will ordinarily be granted but in exceptional cases (in the case of failure or remit the above amount within 15 days) extension of time for 15 days with 12% penal interest per annum may be granted by the Divisional Forest Officer, Malayattoor at his discretion.

(c) In the case of failure to satisfy conditions 6(b) above, The Chief Conservator of Forests, Central Circle, Thrissur may at his discretion grant further extension up to 30 days with penal interest at 24% per annum and the Chief Conservator of Forest (Protection) may at his direction grant further extension up to 30 days with penal interest at 48% per annum provided the above period falls within the contract period.

(d) In case the bidder has remitted the balance 1/3rd value, VAT, Cess, FDT, IT, security etc. and the execution of agreement alone is delayed, a fine @ ` 1 per day for the delay from the date of remittance of security deposit will be levied up to 30 days by the Divisional Forest Officer.

(e) Failure to remit sale dues and execute the agreement even within the period extended will entail cancellation of the sale, forfeiture of all money remitted and resale of the coupe at the purchaser's risk and loss. He shall have no claim for the gain if any, by the resale, but liable, to make good the loss to Government if any.

7. The balance 1/3rd value should be remitted in two equal instalments, the first within 15 days and the second within one month from the date of execution of agreement or before the expiry of the original contract period whichever is earlier, extension of time (If within the contract period) up to 30 days, for the remittance of the balance value may be granted by the Divisional Forest Officer subject to recovery of penal interest at 24% per annum and the Chief Conservator of Forests, Kozhikkode at his discretion, grant further extension of 30 days with penal interest at 48% per annum provided the period falls within the contract period and failure to remit any of the above instalment even during the extended period will entail cancellation of the contract and forfeiture of all money paid till then and all products remaining in the coupe. Removal of produce will be permitted only after the 1st instalment of the balance 1/3rd value and the removal will be restricted to 1/3rd value of the money value of the sale will be pays up full purchase value.

Note:—In calculation of penal interest 15 days and above will be reckoned as one month and below 15 days will be ignored.

8. For failure to remit the security, balance value etc. on the due date or extension, the right acquired shall be cancelled and the amount already paid will be forfeited to Government. The right shall also be resold at the risk and loss of the contractor who shall then be held responsible for any loss to Government resulting from such resale but shall have no claim over the game, if any. The loss will be recovered as per the Revenue Recovery Act in force or by any other legal means.

9. The period of the contract will be 2 months from the date of confirmation of the sale. The contractor shall complete the work provided for herein including the removal of all the stock from the contract area within the contract period itself. He should also take up the slash felling, burning and heaping and retaining before the end of the contract period. All the cashew tree growth and other miscellaneous tree growth inside the coupe will be felled flush with ground and in any grassy areas, the grass should be uprooted and burnt along with slash. The burning operations will have to be done by the contractor according to the directions of the Departmental Officers. During the burning operations, the contractor should see that the fire does not spread into the Forest outside the coupe and also does not damage the other trees retained there. If the work of slash felling, skinning, burning etc. are not done to the satisfaction of the Department arrangement, will be made for getting them done otherwise at the risk and loss of the contractor and the cost thereof will be recovered from him besides suitable fine imposed at the discretion of the Divisional Forest Officer. Under very special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests, Central Circle, Thrissur may grant extension of time for one month and two months respectively on realization of penalty or penalties for completion of each work for each month.

(i) For enumerated trees and balance unfilled ` 75 (Rupees Seventy Five only) per hectare or fraction thereof

(ii) Unremoved registered logs and unregistered logs ` 2 (Rupees Two only) per cubic metre or fraction thereof.

(iii) Unremoved firewood 50 paise (fifty paise only) per tonne ( two cum.) or fraction thereof.

(iv) Slash felling `100 (Rupees Hundred

only) per hectare

(v) First burning ` 25 (Rupees Twenty five only) per hectare

(vi) Heaping and reburning ` 100 (Rupees Hundred only) per hectare and fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during the original contract period, in addition to the penalties as assessed on area basis. In the event of the contractor failing to remove the stock from the contract areas by the expiry of the extended period such stock shall be forfeited and shall revert to and become the absolute property of Government and the contractor shall not by reason of such forfeiture be entitled to any refund or abatement on the amount payable or due from him under this contract.

10. The Divisional Forest Officer may grant permission to the contractor to store the timber and other produce collected by him from the coupe in any locality in the reserve forest but outside the coupe at the contractors sole risk and responsibility. If due to adverse circumstances of climatic conditions the produce should not be removed outside the limits of the Government Forests within the contract period but such permission will be granted only on payment of rental for the area permitted at ` 250 (Rupees Two hundred and fifty only) per hectare or part thereof per month or part thereof.

11. The contractor will be responsible for any illicit felling or removal of produces from such felling of dead and fallen trees within 0.4 Kilometer (2 furlong) of the area under contract. He should also report regarding any illicit felling there. Any violation of this condition will even entitle cancellation of the contract.

12. Seigniorage value of vakka fibre calculated at one vakka drag rope for every two cubic metres of timbers or fraction thereof together with VAT, Cess and FDT due thereon and grazing fees for one elephant for every two cubic meters of timber or fraction thereof actually collected, will be recovered from the contractor at current rates. The amount shall be paid to the Range Officer, before each pass is issued.

13. The security deposited by the purchaser will be realized within a reasonable time after the expiry of the contract period on production of valid clearance certificates of Income tax, Sales Tax and Agricultural Income Tax as per rules. The amount if any due under these three items will be deducted from the security deposit and the balance, if any, paid to him after deducting further dues, if any due to Government.

14. The successful bidder should give an undertaking that he is not related to any officer having control of the work and that he is not supply contractor of this or any adjacent divisions. If this is proved otherwise if shall result in cancellation of the contract and resale of the coupe at his risk and loss.

15. If any amount becomes due to any workmen or mazdoor engaged by the contractor as per the Workmen's Compensation Act or as per provisions of the labour or similar laws, such amount will be payable by the contractor.

16. No petition or post offer received will ordinarily be considered except when the post offer is advantageous by more than 10% of the original offer where, the bid amount is ` 1,00,000 (Rupees one lakh only) and above and more than 20% where the original bid amount is ` One lakh. The post offer will comply with the following terms.

(i) Offer should be made within 7 days of auction failing which the offer will not be considered.

(ii) Offerer should remit double the amount paid by the bidder on the auction date.

(iii) The remittance made through the Chalan or Bank Deposit Receipt should be produced before the Divisional Forest Officer concerned within 7 days from the date of receipt of registered notice to that effect.

The post offer after satisfying the conditions specified above, should execute an agreement before the Divisional Forest Officer concerned, pledging the security for the due fulfillment of above terms.

If the post offer satisfied the conditions, a reauction of the right will be conducted after giving the usual publicity as per rules. In the reauction, the price fetched if does not come up to what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs outs, the security amount remitted by him will be forfeited to Government. If however the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest bidder in the reauction and the amount remitted by the post offerer will be released to him.

17. The contractor shall at all times during the currency of the contract, keep the coupe boundaries cleared to a width of two metres and keep the cairns intact.

19. If in the course of working it is found by the Divisional Forest Officer that the progress of work is not satisfactory the Divisional Forest Officer may cancel the agreement and make other arrangements for carrying out the works at the Contractor's risk and loss. But, the contractor shall not be entitled to any profit that the department may derive in this arrangement.

20. The contractor should insure the timber and firewood collected by him from the coupe as per the rules governing the insurance of goods.

21. The purchase contractor shall not export any firewood to outside State.

22. The sale is exclusive of teak, rosewood and all other species except cashew and other trees mentioned in the schedule, if any found in the area and the contractor shall not be entitled for the same. He shall pay damages caused to all the teak and rosewood tree standing if any, in the coupes as assessed by the Divisional Forest Officer.

23. The contractor shall not make any damages to the bridges or roads and private properties during the collection and transport of timber etc. or during unloading the produce from lorries and stacking them on the roadside and he shall be liable for any such damages. The decision of Government regarding the amount of compensation payable for the damages caused shall be final and binding on the contractor and the Government shall recover such damages from the contractor.

25. Any addition or modification to the conditions, if any found necessary will be added to and to read out at the time of auction.

3. ശേഖരിക്കുന്ന കശുവ≠ി ഡിപ്പാർട്ട്മെന്റ ് നൽകുന്ന പാസ്സുകൾ പ്രകാരം മാത്രമേ നീക്കം ചെയ്യുവാൻ പാടുള്ളൂ. ഇപ്രകാരം പാസ്സുകൾ മുഖേന സർക്കാർ ഏജന്റിനോ അവരുടെ അംഗീകൃത ഏജന്റിനോ വിൽക്കുന്ന കശുവ≠ിക്ക് പ്രസ്തുത ഏജന്റുമാരിൽ നിന്നും കശുവ≠ി അവർക്ക് ലഭിച്ചിട്ടു≠െന്നുള്ള തെളിവിലേക്കായി രശീതി വാങ്ങി സമർപ്പിക്കേ≠താണ്.

4. കശുവ≠ി കുത്തക സംഭരണം ഏർപ്പെടുത്തിയിട്ടു≠െങ്കിൽ സർക്കാർ ഏജന്റ ിനോ മറ്റ് ഏജന്റ ിനോ കശുവ≠ി കൊടുത്തിട്ടുള്ളതിന്റെ സർട്ടിഫിക്കറ്റ് ഹാജരാക്കിയാൽ മാത്രമേ സെക്യൂരിറ്റി തുക തിരികെ നൽകുകയുള്ളൂ.

5. ഏറ്റവും കൂടുതൽ തുക വിളിക്കുന്ന ആളുടെ പേരിൽ ലേലം/ദർഘാസ് ഉറപ്പിക്കുന്നതാണ്. യാതൊരു കാരണവും ബോധിപ്പിക്കാതെ ലേലം/ദർഘാസ് റദ്ദു ചെയ്യുവാൻ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അധികാരമു≠ായിരിക്കുന്നതാണ്.

6. പോസ്റ്റ് ഓഫറുകൾ ദർഘാസ്/ലേലത്തിനുശേഷം മൂന്ന് ദിവസത്തിനകം അതാത് ഓഫീസിൽ ലഭിക്കുന്ന രേഖാമൂലമായ ദർഘാസ്/ലേലാനന്തര വാഗ്ദാനങ്ങൾ (പോസ്റ്റ് ഓഫറുകൾ) താഴെ പറയുന്ന വ്യവസ്ഥകൾക്ക് വിധേയമായി സ്വീകരിക്കുന്നതാണ്.

(എ) ദർഘാസ്/ലേലത്തിൽ വാഗ്ദാനം ചെയ്തിട്ടുള്ള തുക ഒരു ലക്ഷത്തിൽ അധികമാണെങ്കിൽ 10 ശതമാനത്തിലും ഒരു ലക്ഷമോ അതിൽ താഴെയോ ആണെങ്കിൽ 20 ശതമാനത്തിലും കൂടുതലായിട്ടുള്ള വാഗ്ദാനങ്ങളെ സ്വീകരിക്കുകയുള്ളൂ.

(ഡി) മേൽപറഞ്ഞ വ്യവസ്ഥകൾക്ക് അനുസൃതമായി പോസ്റ്റ് ഓഫർ സമർപ്പിക്കുന്ന വ്യ‡ിയുടെ അടച്ച തുക മുഴുവൻ സെക്യൂരിറ്റി ഡെപ്പോസിറ്റായി സൂക്ഷിച്ചുകൊ≠് പൊതു ദർഘാസ്/ലേലം വീ≠ും നടത്തുന്നതാണ്. പ്രസ്തുത ദർഘാസ്/ലേലത്തിൽ ലഭിക്കുന്ന ഏറ്റവും കൂടിയ തുക പോസ്റ്റ് ഓഫർ തുകയേക്കാൾ കുറവാണെങ്കിൽ പോസ്റ്റ് ഓഫറിൽ വാഗ്ദാനം നൽകപ്പെട്ടിട്ടുള്ള തുകയ്ക്ക് ദർഘാസ്/ലേലം ഉറപ്പിക്കുന്നതാണ്. പോസ്റ്റ് ഓഫർ സമർപ്പിച്ചിട്ടുള്ള ആൾ അടച്ചിട്ടുള്ള മുഴുവൻ തുകയും ഡിവിഷനിലേക്ക് വസൂൽ ചെയ്യുന്നതാണ്. എന്നാൽ ദർഘാസ്/ലേലത്തിൽ കിട്ടുന്ന തുകയാണ് കൂടുതലെങ്കിൽ അപ്രകാരം ഓഫർ ചെയ്തിട്ടുള്ള ലൈസൻസിക്ക് ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തുന്നതും പോസ്റ്റ് ഓഫർ സമർപ്പിച്ചിട്ടുള്ള ആൾ അടച്ചിട്ടുള്ള മൊത്തം തുകയും മടക്കി കൊടുക്കുന്നതുമാണ്.

8. ഉടമ്പടിവയ്ക്കുന്നതിന് മുമ്പായി നിരതദ്രവ്യമുൾപ്പെടെ ലേലസംഖ്യയുടെ 10 ശതമാനം സംഖ്യ സർക്കാർ ട്രഷറിയിൽ സെക്യൂരിറ്റിയായി അടച്ച് പാസ്സ് ബുക്ക് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ മുമ്പാകെ ഹാജരാക്കേ≠താണ്.

9. ദർഘാസ്/ലേല സ്ഥിരീകരണ തീയതി മുതൽ പതിനഞ്ചു ദിവസത്തിനുള്ളിൽ മുഴുവൻ പണവും അടയ്ക്കുവാനുള്ള സമയപരിധി നി›യിച്ചിരിക്കുന്നു. ഈ തീയതിക്കുശേഷം പലിശയോടുകൂടിയോ, പിഴ പലിശയോടുകൂടിയോ, പണം ഒടുക്കുവാനുള്ള അവസരം കൊടുക്കുന്നതല്ല.

10. നി›ിത കാലയളവിൽ പണമടച്ച് ഉടമ്പടിവയ്ക്കാത്തപക്ഷം ലേലം റദ്ദു ചെയ്യുകയും ലേലക്കാരൻ അടച്ച മുഴുവൻ സംഖ്യയും സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർ ദർഘാസ്/ലേലം നടത്തുന്നതുമായിരിക്കും. ആയതു വഴി സർക്കാരിന് ഉ≠ാകുന്ന എല്ലാ നഷ്ടങ്ങൾക്കും മുൻ ലേല/ദർഘാസുകാരൻ ഉത്തരവാദിയായിരിക്കുന്നതാണ്. പുനർ ദർഘാസ്/ലേലത്തിൽ സർക്കാരിനു ലാഭം ഉ≠ാവുകയാണെങ്കിൽ ആയതിൽ മുൻ ദർഘാസുകാർക്ക്/ലേലക്കാർക്ക് അവകാശമു≠ായിരിക്കുന്നതല്ല. ഏതെങ്കിലും സാഹചര്യത്തിൽ കശുവ≠ി സംഭരണം ഡിപ്പാർട്ട്മെന്റ ് നേരിട്ട് നടത്തേ≠ിവരികയാണെങ്കിൽ ആയതുമൂലം സർക്കാരിനു≠ാകുന്ന നഷ്ടം വീഴ്ചക്കാരിൽ നിന്നും റവന്യൂ റിക്കവറി അടക്കമുള്ള നിയമനടപടികളിൽ കൂടി ഈടാക്കുന്നതാണ്. ഈ ഇനത്തിൽ ഉ≠ാകുന്ന ലാഭത്തിൽ മുൻ ദർഘാസുകാരന്/ലേലക്കാരന് യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല.

11. ദർഘാസ്/ലേലക്കാരൻ ബാക്കി സംഖ്യയെല്ലാം യഥാസമയം അടയ്ക്കുകയും ഉടമ്പടിവയ്ക്കാൻ മാത്രം താമസിക്കുകയും ചെയ്യുകയാണെങ്കിൽ പണം അടച്ച തീയതി മുതൽ 30 ദിവസത്തേക്ക് ദിവസത്തിൽ ` 2 വസൂലാക്കിക്കൊ≠് ഉടമ്പടി വയ്ക്കാൻ അനുവാദം നൽകുന്നതാണ്.

12. ദർഘാസ്/ലേലത്തിനു മുമ്പായി ലേല പരസ്യം വായിച്ച് മനസ്സിലാക്കി ഒപ്പിട്ടു തരുന്നവർ 9-3-1976-ലെ സർക്കാർ ഗസറ്റിൽ പ്രസിദ്ധീകരിച്ച 23-2-1976-ലെ ജി. ഒ. (പി) 64/76/എം. ഡി.-യിൽ പറഞ്ഞ നിബന്ധനകൾക്ക് വിധേയരാണ്. ദർഘാസ്/ ലേലത്തിൽ പങ്കെടുക്കുന്ന ആൾ ലേലത്തിനു മുമ്പ് കശുമാവ് തോട്ടം നേരിട്ട് പരിശോധിച്ച് ബോദ്ധ്യപ്പെടേ≠താണ്.

ലേലത്തിനുശേഷം ഇതു സംബന്ധിച്ചുള്ള യാതൊരു പരാതിയും സ്വീകരിക്കുന്നതല്ല.

13. ദർഘാസ്/ലേലത്തിന് നി›യിച്ച ദിവസം പൊതു അവധിയായി വരികയാണെങ്കിൽ അടുത്ത പ്രവർത്തി ദിവസം അതേ സ്ഥലത്തും സമയത്തും വെച്ച് ദർഘാസ്/ലേലം നടത്തുന്നതാണ്.

14. കരാർ കാലാവധി ഉടമ്പടിവയ്ക്കുന്ന ദിവസം മുതൽ 30-6-2011 വരെയായിരിക്കും.

15. ഉടമ്പടി കാലയളവിൽ കശുമാവ് വൃക്ഷങ്ങളുടെ മുഴുവൻ പരിചരണവും രോഗ പ്രതിരോധ പ്രവർത്തനങ്ങളും ചെയ്യേ≠ത് കരാറുകാരാണ്.

16. കരാറുകാരൻ നിലവിലുള്ള നിയമങ്ങളെല്ലാം പാലിക്കേ≠താണ്. കൂടാതെ തോട്ടങ്ങളിൽ അ·ി സംരക്ഷണ പ്രവർത്തനങ്ങൾ നടത്തേ≠താണ്.

17. വനം കുറ്റങ്ങളെ സംബന്ധിച്ച അറിവ് ലഭിച്ചാൽ അത് ഉടനെ റെയിഞ്ച് സ്റ്റാഫിനെ അറിയിക്കേ≠തും കുറ്റകൃത്യങ്ങൾ തടയുവാൻ ആവശ്യപ്പെട്ടാൽ സഹായിക്കേ≠തുമാണ്.

(കേരള ഗവർണ്ണർക്കുവേ≠ി) ഒടുക്കി ഈ ആഫീസിൽ നിന്നും വാങ്ങാവുന്നതാണ്.

അന്നേദിവസം ഉച്ചയ്ക്ക് 3 മണിക്ക് അപ്പോൾ ഹാജരുള്ള ദർഘാസുകാരെ ഉൾപ്പെടുത്തി വാഹനം പരസ്യമായി ലേലം ചെയ്യുന്നതും തുടർന്ന് ദർഘാസുകൾ തുറക്കുന്നതുമായിരിക്കും.

ദർഘാസുകളിൽ ഏറ്റവും കൂടുതൽ തുക വാഗ്ദാനം ചെയ്യുന്ന ആളുടെ പേരിൽ താല്ക്കാലികമായി ലേലം ഉറപ്പിക്കുന്നതാണ്.

അപ്രകാരം വിജയിക്കുന്ന ആൾ ലേലം/ദർഘാസ് തുകയുടെ പകുതി അന്നേദിവസം തന്നെ അടയ്ക്കേ≠താണ്. 7-2-2011 ഒരു പൊതു അവധിദിനമായി വരികയാണെങ്കിൽ തൊട്ടടുത്ത പ്രവർത്തിദിവസം പ്രസ്തുത ദർഘാസ്/ലേലം നി›ിത സമയത്തും സ്ഥലത്തുംവച്ച് നടത്തുന്നതാണ്.

മേൽ ദിവസം ഏതെങ്കിലും കാരണവശാൽ പ്രസ്തുത ലേലം/ദർഘാസ് നടത്തുവാൻ സാധിക്കാതെ വരികയാണെങ്കിൽ ടി വാഹനത്തിന്റെ വിൽപ്പന 17-2-2011-നും അന്നും വിൽപ്പന നടക്കാതിരുന്നാൽ 24-2-2011-നും നി›ിത സമയത്തും സ്ഥലത്തുംവച്ച് വിൽപ്പന നടത്തുന്നതാണ്.

1. മേൽ പറയുന്ന വാഹനം ദർഘാസ്/ലേലത്തിന് മുമ്പായി ആഫീസ് സമയത്ത് നോർത്ത് വയനാട് ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസറുടെ/ബേഗൂർ റെയിഞ്ചാഫീസറുടെ അനുവാദത്തോടെ നേരിൽ പരി ശോധിച്ച് അവയുടെ ഗുണനിലവാരം ബോദ്ധ്യപ്പെടേ≠ താണ്. ഗുണനിലവാരം സംബന്ധിച്ച് ലേലത്തിന് ശേഷം ഉന്നയിക്കുന്ന യാതൊരു പരാതിയും പരിഗണി ക്കുന്നതല്ല.

2. ദർഘാസ് ഫോറത്തിന്റെ വില ` 400 + വാറ്റ് ആയിരിക്കും.

5. നി›ിത സമയത്തിനുശേഷം സമർപ്പിക്കുന്ന ദർഘാ സുകൾ സ്വീകരിക്കുന്നതല്ല.

6. അപൂർണ്ണമായതോ നിബന്ധനകൾ പാലിക്കാത്തതോ ആയ ദർഘാസുകൾ പരിഗണിക്കുന്നതല്ല.

7. വിജയികളായവരുടെ നിരതദ്രവ്യം വിൽപ്പന വിലയി ലേക്ക് നീക്കിവയ്ക്കുന്നതും മറ്റുള്ളവരുടെ നിരതദ്രവ്യം ലേലം കഴിഞ്ഞശേഷം തിരികെ നൽകുന്നതുമാണ്.

8. ദർഘാസ്/ലേല സംഖ്യ നിരതദ്രവ്യത്തേക്കാൾ കൂടുതലാണെങ്കിൽ നിരതദ്രവ്യം ഉൾപ്പെടെ 50% അപ്പോൾതന്നെ ഒടുക്കേ≠താണ്. ഇതിൽ വീഴ്ച വരുത്തുന്നവരുടെ നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടി, വിളിച്ചെടുത്ത വാഹനം അവരുടെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർ ദർഘാസ്/ പുനർലേലം ചെയ്യുന്നതായിരിക്കും.

9. ദർഘാസ്/ലേല സംഖ്യ നിരതദ്രവ്യത്തേക്കാൾ കുറവാ ണെങ്കിൽ കൂടുതലുള്ള തുക ദർഘാസ് തുറക്കുന്ന ദിവസം തന്നെ തിരിച്ചു നൽകുന്നതായിരിക്കും. ദർഘാസ്/ലേലം സ്വീകരിക്കുന്നതിനോ നിരാകരിക്കുന്ന തിനോ ഉള്ള പൂർണ്ണ അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥരിൽ നിക്ഷിപ്തമായിരിക്കും.

10. അധികാരപ്പെട്ട ഉദ്യോഗസ്ഥൻ ദർഘാസ്/ലേലം സ്വീകരിച്ചാലുടൻ വിജയികളെ വിവരം അറിയിക്കുന്നതാണ്.

12. മേൽ പറഞ്ഞ പ്രകാരം 15 ദിവസത്തിനകം വാഹനം നീക്കം ചെയ്തില്ലെങ്കിൽ ലേല/ദർഘാസുകാരന്റെ അപേക്ഷയിൻമേൽ 12% പലിശയും ` 20 ഇരുപ്പു വാടകയും ഈടാക്കിക്കൊ≠് 15 ദിവസം കൂടി പണം അടയ്ക്കുവാനോ, വാഹനം നീക്കംചെയ്യുവാനോ സമയം അനുവദിക്കുന്നതാണ്. അതിനുശേഷം പണം അടയ്ക്കാനോ വാഹനം നീക്കം ചെയ്യാനോ കാലാവധി അനുവദിക്കുന്നതല്ല. ഈ സമയപരിധിക്കുള്ളിൽ വാഹനം നീക്കംചെയ്യാത്തപക്ഷം ദർഘാസ്/ലേലക്കാ രന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ വാഹനം പുനർദർഘാസ്/പുനർലേലം ചെയ്യുന്നതും നഷ്ട മു≠ായാൽ ടിയാനിൽനിന്നും സർക്കാരിനു≠ായ ദർഘാസ്/ലേല ചെലവു സഹിതം ഈടാക്കുന്നതുമാ യിരിക്കും. ലാഭമു≠ായാൽ അതിൻമേൽ ടിയാന് യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്നതുമല്ല.

13. ദർഘാസുകൾ സമർപ്പിച്ചിട്ടുള്ളവർക്ക് മാത്രമേ ലേല ത്തിൽ പങ്കെടുക്കുവാൻ അർഹതയു≠ായിരിക്കുക യുള്ളു.

14. ദർഘാസ്/ലേലത്തിലെ പറഞ്ഞ തുക സ്വീകരിക്കുന്ന തിനോ നിരാകരിക്കാനോ ഉള്ള അധികാരം ബന്ധ പ്പെട്ട അധികാരിയിൽ നിക്ഷിപ്തമായിരിക്കും.

15. ഏതെങ്കിലും ദർഘാസ്/ലേല തീയതി ഒരു പൊതു ഒഴിവ് ദിവസമായി വരികയാണെങ്കിൽ പ്രസ്തുത ടെ≠ർ-കം-ലേലം തൊട്ടടുത്ത പ്രവർത്തി ദിവസം നടത്തുന്നതായിരിക്കും.

പോസ്റ്റ് ഓഫറുകൾ

ദർഘാസ്/ലേലത്തിനുശേഷം 3 ദിവസങ്ങൾക്കകം ഈ ഓഫീസിൽ ലഭിക്കുന്ന രേഖാമൂലമുള്ള ദർഘാസ്/ ലേലാനന്തര വാഗ്ദാനങ്ങൾ (പോസ്റ്റ് ഓഫറുകൾ) താഴെ പറയുന്ന വ്യവസ്ഥകൾക്കുവിധേയമായി സ്വീകരിക്കുന്നതാണ്.

(എ) ദർഘാസ്/ലേലത്തിൽ വാഗ്ദാനം ചെയ്തിട്ടുള്ള തുക ഒരു ലക്ഷത്തിൽ അധികമാണെങ്കിൽ അതിന്റെ 10 ശതമാനത്തിൽ കൂടുതലുള്ളതും ഒരു ലക്ഷമോ അതിൽ താഴെയോ ആണെങ്കിൽ അതിന്റെ 20 ശതമാനത്തിൽ കൂടുതലുള്ളതുമായ വാഗ്ദാനങ്ങൾ മാത്രമേ സ്വീകരിക്കുകയുള്ളു.
