THE INDIAN PARTNERSHIP (KERALA AMENDMENT) BILL, 2011
A
BILL
further to amend the Indian Partnership Act, 1932, in its application to the
State of Kerala.
Preamble.—WHEREAS, it is expedient further to amend the Indian Partnership Act, 1932, in its application to the State of Kerala, for the purposes hereinafter appearing ;
BE it enacted in the Sixty-second year of the Republic of India as follows:—
1. Short title, extent and commencement.—(1) This Act may be called the Indian Partnership (Kerala Amendment) Act, 2011.
(2) It extends to the whole of the State of Kerala.
(3) It shall come into force at once.
2. Substitution of new Schedule for Schedule I.—In the Indian Partnership Act, 1932 (Central Act 9 of 1932), for Schedule I, the following Schedule shall be substituted, namely:—

Copies from the Register of Firms One hundred rupees for each hundred words or a part thereof.".
STATEMENT OF OBJECTS AND REASONS
Schedule I of the Indian Partnership Act, 1932 (Central Act 9 of 1932) envisages the maximum fees payable in respect of various documents under the said Act. The existing rates of fees are ranging from fifty paise to fifteen rupees, which has come into force in the year 1973, vide the Indian Partnership (Kerala Amendment) Act, 1973 (25 of 1973).
Since the fees specified in Schedule I of the Indian Partnership Act, 1932 are very meagre, Government of Kerala have decided to enhance the maximum fee for filing various documents under the said Act.
The present proposal is to enhance the maximum fee ranging from rupees fifty to rupees three hundred for filing various documents, by amending Schedule I of the Indian Partnership Act, 1932.
The Bill seeks to achieve the above objects.
FINANCIAL MEMORANDUM
The Bill, if enacted and brought into operation, would not involve any additional expenditure from the Consolidated Fund of the State.

പീഠിക.—1932-ലെ ഇൻഡ്യൻ പങ്കാളിത്ത ആക്റ്റ്, അത് കേരള സംസ്ഥാനത്തെ ബാധിക്കുന്നിടത്തോളം, താഴെ കാണുന്ന ആവശ്യങ്ങൾക്കായി വീ≠ും ഭേദഗതി ചെയ്യുന്നത് യു‡മായിരിക്കുകയാൽ ;
ഇന്ത്യൻ റിപ്പബ്ലിക്കിന്റെ അറുപത്തിര≠ാം സംവത്സരത്തിൽ താഴെപ്പറയും പ്രകാരം നിയമമു≠ാക്കുന്നു :—
1. ചുരുക്കപ്പേരും വ്യാപ്തിയും പ്രാരംഭവും.—(1) ഈ ആക്റ്റിന് 2011-ലെ ഇൻഡ്യൻ പങ്കാളിത്ത (കേരള ഭേദഗതി) ആക്റ്റ് എന്ന് പേര് പറയാം.
(2) ഇതിന് കേരള സംസ്ഥാനം മുഴുവൻ വ്യാപ്തിയു≠ായിരിക്കുന്നതാണ്.
(3) ഇത് ഉടൻ പ്രാബല്യത്തിൽ വരുന്നതാണ്.
2. I-ാം പട്ടികയ്ക്ക് പകരം പുതിയ പട്ടിക ചേർക്കൽ.—1932-ലെ ഇൻഡ്യൻ പങ്കാളിത്ത ആക്റ്റിലെ (1932-ലെ 9-ാം കേന്ദ്ര ആക്റ്റ്), I-ാം പട്ടികയ്ക്ക് പകരം, താഴെ പറയുന്ന പട്ടിക ചേർക്കേ≠താണ്, അതായത്:—

ഉദ്ദേശ്യകാരണങ്ങളുടെ വിവരണം
1932-ലെ ഇൻഡ്യൻ പങ്കാളിത്ത ആക്റ്റിന്റെ (1932-ലെ 9-ാം കേന്ദ്ര ആക്റ്റ്) I-ാം പട്ടികയിൽ മേൽപ്പറഞ്ഞ ആക്റ്റ് പ്രകാരമുള്ള വിവിധ രേഖകളെ സംബന്ധിച്ച് കൊടുക്കേ≠തായ പരമാവധി ഫീസ് വിഭാവനം ചെയ്യുന്നു. അൻപത് പൈസ മുതൽ പതിനഞ്ച് രൂപവരെ വരുന്ന നിലവിലുള്ള ഫീസ് നിരക്കുകൾ, ആയത് 1973-ലെ ഇൻഡ്യൻ പങ്കാളിത്ത (കേരള ഭേദഗതി) ആക്റ്റ് (1973-ലെ 25) പ്രകാരം 1973 വർഷത്തിൽ പ്രാബല്യത്തിൽ വന്നതാണ്.
1932-ലെ ഇൻഡ്യൻ പങ്കാളിത്ത ആക്റ്റിൽ വിനിർദ്ദേശിച്ചിരിക്കുന്ന ഫീസ് വളരെ കുറവായതിനാൽ, പ്രസ്തുത ആക്റ്റ് പ്രകാരം ഫയൽ ചെയ്യുന്നതിനായുള്ള വിവിധ രേഖകൾക്ക് കൊടുക്കേ≠തായ പരമാവധി ഫീസ് വർദ്ധിപ്പിക്കുന്നതിന് കേരള സർക്കാർ തീരുമാനിച്ചു.
71932-ലെ ഇൻഡ്യൻ പങ്കാളിത്ത ആക്റ്റിലെ I-ാം പട്ടിക ഭേദഗതി ചെയ്ത്, ഫയൽ ചെയ്യുന്നതിനായുള്ള വിവിധ രേഖകൾക്ക് കൊടുക്കേ≠തായ പരമാവധി ഫീസ് അൻപത് രൂപ മുതൽ മുന്നൂറ് രൂപ വരെയായി വർദ്ധിപ്പിക്കുന്നതിനുള്ളതാണ് ഇപ്പോഴത്തെ നിർദ്ദേശം.
മേൽപ്പറഞ്ഞ ലക്ഷ്യം നിറവേറ്റുന്നതിന് ഉദ്ദേശിച്ചുകൊ≠ുള്ളതാണ് ഈ ബിൽ.
ധനകാര്യ മെമ്മോറാ≠ം
ഈ ബിൽ നിയമമാക്കുകയും പ്രാബല്യത്തിൽ കൊ≠ുവരികയും ചെയ്താൽ സംസ്ഥാന സഞ്ചിതനിധിയിൽ നിന്നും യാതൊരു അധിക ചെലവും ഉ≠ാകുന്നതല്ല.
