പുനലൂർ ഡിവിഷനിൽപ്പെട്ട പത്തനാപുരം, അഞ്ചൽ എന്നീ റെയിഞ്ചുകളിൽ സൂക്ഷിച്ചിട്ടുള്ള വിവിധ വനനിയമ കേസു കളിലെ തൊ≠ി സാധനങ്ങൾ താഴെ പട്ടികയിൽ അതാതു റെയിഞ്ചിനുനേരെ കാണിച്ചിട്ടുള്ള തീയതികളിൽ പകൽ 3 മണിക്ക് പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസറോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റുദ്യോഗസ്ഥനോ പട്ടികയിൽ കാണിച്ചിരിക്കുന്ന സ്ഥലത്തുവച്ച് 16-11-1988-ലെ സർക്കാർ ഉത്തരവ് (എം. എസ്.) 100/98/വനം, 4-3-1999-ലെ (എം. എസ്.) 18/99/വനം എന്നീ ഉത്തരവുകൾക്കും നിലവിലുള്ള മറ്റുനിയമ ങ്ങൾക്കും വിധേയമായി പരസ്യമായി ലേലം ചെയ്തു വിൽക്കുന്നതായിരിക്കും. ലേലദിവസം പൊതു അവധിയായി പ്രഖ്യാപിച്ചാൽ പ്രസ്തുത ലേലം അടുത്ത പ്രവൃത്തി ദിവസം നി›ിത സമയത്തും സ്ഥലത്തുംവച്ച് നടത്തുന്നതായിരിക്കും.

നി›ിത ലേല തീയതിക്ക് 7 ദിവസം മുമ്പ് തന്നെ ലേലത്തിൽ ഉൾപ്പെടുത്തുന്ന ലേലവസ്തുക്കളുടെ ഇനം, അളവ് മുതലായവ ലോട്ടു തിരിച്ചുള്ള പട്ടിക അതാത് റെയിഞ്ച് ഓഫീസുകളിൽ ക്കുന്നവർ ലോട്ടു തിരിച്ചുള്ള തൊ≠ി വസ്തുക്കൾ നേരിൽ പരിശോധിച്ച് നല്പുനിൽപ്പ് ബോദ്ധ്യപ്പെടേ≠തുമാണ്. ലേലത്തിനു ശേഷം ഇതു സംബന്ധമായ പരാതികൾ പരിഗണിക്കുന്നതല്ല.

14-11-2012 19-12-201210th JAN. 2012] FOREST DEPARTMENT 30 ലേലത്തിൽ പങ്കെടുക്കാൻ ആഗ്രഹിക്കുന്നവർ ലേലത്തിന് മുമ്പായി തേക്ക്, ഈട്ടി എന്നിവയ്ക്ക് ` 20,000-ഉം മറ്റു തടി കൾക്ക് `10,000-ഉം മറ്റു വനവിഭവങ്ങൾക്ക് ` 2,000-ഉം നിരതദ്രവ്യമായി കെട്ടിവയ്ക്കേ≠താണ്. ലേലം കൊ≠യാൾ ലേലം കഴിഞ്ഞാലുടൻതന്നെ ലേലത്തുകയുടെ അഞ്ചിൽ ഒന്ന് നിരതദ്രവ്യം ഉൾപ്പെടെ ഒടുക്കേ≠താണ്. ലേലത്തുക ` 20,000-മോ അതിൽ കുറവോ ആണെങ്കിൽ മുഴുവൻ തുകയും ലേലത്തുക ` 20,000-ത്തിൽ കവിയുകയാണെങ്കിൽ ` 20,000-മോ ലേല തുകയുടെ 35%-മോ ഏതാണ് കൂടുതലെങ്കിൽ ആയത് ലേലം കഴിഞ്ഞാലുടനെ അടയ്ക്കേ≠തുമാണ്. കോടതി ഉത്തരവ് അനുസരിച്ച് ലേലം ചെയ്യപ്പെടുന്ന തൊ≠ിയുടെ മൊത്തം തുകയും ലേലദിവസം അടയ്ക്കേ≠താണ്.

കേരള ഗവർണ്ണർക്കുവേ≠ി പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ താഴെപ്പറയുന്ന പ്രവർത്തിക്ക് അദ്ദേഹത്തിന്റെ ഓഫീസിൽ 20-1-2012-ന് വൈകുന്നേരം 3 മണിവരെ നി›ിത യോഗ്യതയുള്ള അംഗീകൃത കരാറുകാരിൽ നിന്നും സീൽ ചെയ്ത ദർഘാസുകൾ സ്വീകരിക്കുന്നതാണ്.

അന്നേദിവസം പകൽ 3.30-ന് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ ഹാജരായ കരാറുകാരുടെ സാന്നിദ്ധ്യത്തിൽ ദർഘാസുകൾ തുറക്കുന്നതാണ്. ദർഘാസുകൾ പ്രസ്തുത തീയതിയിൽ നി›ിത സമയത്തിനുള്ളിൽ കിട്ടത്തക്കവണ്ണം തപാൽ വഴിയും ലേലത്തിൽ പിടിച്ചെടുത്ത സാധനങ്ങൾ ലേലം സ്ഥിര പ്പെടുത്തിയ വിവരം ലേലക്കാരനെ അറിയിക്കുന്ന തീയതി മുതൽ 40 (നാൽപത്) ദിവസത്തിനകം ബാക്കി മുഴുവൻ ലേലത്തുകയും മൊത്തം നിയമാനുസൃത നികുതികളും മൊത്തം സംഖ്യയ്ക്ക് 1998-ലെ ഫൈനാൻസ് ആക്ട് പ്രകാരമുള്ള ആദായനികുതിയും ഒടുക്കി ലേലത്തിൽ പിടിച്ചെടുത്ത സാധനങ്ങൾ നീക്കം ചെയ്യേ≠താണ്. ലേലത്തുക ഈ കാലാവധിക്കുളളിൽ അടയ്ക്കാതിരുന്നാൽ ലേലം റദ്ദ് ചെയ്യാവുന്നതും ലേലക്കാരൻ അടച്ചിട്ടുള്ള തുക സർക്കാരിലേക്ക് മുതൽകൂട്ടുന്നതും ടി ലേലത്തിൽ പിടിച്ചെടുത്ത സാധനങ്ങൾ ടിയാന്റെ നഷ്ടോത്തര വാദിത്വത്തിൽ വീ≠ും ലേലം ചെയ്ത് വിൽക്കുമ്പോൾ സർക്കാരിന് നഷ്ടം ഉ≠ാവുകയാണെങ്കിൽ അപ്രകാരമുള്ള നഷ്ടം, പരസ്യക്കൂലി മുതലായവ വ്യവസ്ഥകൾക്ക് വിധേയമായി മുൻ ലേലക്കാരനിൽനിന്നും ഈടാക്കുന്നതും ലാഭം ഉ≠ാവുകയാണെങ്കിൽ ആയതിന് മുൻലേലക്കാരന് യാതൊരു അവകാശവും ഇല്ലാത്തതുമാകുന്നു.

ദർഘാസിനാവശ്യമായ പ്രമാണങ്ങളും മറ്റു വിവരങ്ങളും പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽ നിന്നും ദർഘാസ് ദിവസം ഉച്ചയ്ക്ക് 12 മണിവരെ എല്ലാ പ്രവർത്തി ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ 7-12-2011-ലെ പ്രൊ.(5)4668/2011 നമ്പരായി 20-12-2011-ലെ ഫോറസ്റ്റ് ഷീറ്റിൽ 50-ാം നമ്പർ കേരള ഗസറ്റിൽ പ്രസിദ്ധപ്പെടുത്തിയിട്ടുള്ള മറ്റു ലേലവ്യവസ്ഥകളും സർക്കാർ തടി ഡിപ്പോകളിൽ അതാത് കാലങ്ങളിൽ നിലവിലുള്ള മറ്റു ലേലനിബന്ധനകളും ഈ ലേലത്തിനും ബാധകമായിരിക്കും. ലേലത്തിൽ ഉൾപ്പെടുന്ന തടികൾ, ഉരുപ്പടികൾ ഇവയുടെ അളവും തരവും ഗുണവും ലേലക്കാരൻ ലേലത്തീയതിക്ക് മുമ്പുതന്നെ ബോദ്ധ്യപ്പെട്ടു കൊള്ളണം. ലേലം സംബന്ധിച്ച കൂടുതൽ വിവരങ്ങൾ അതാത് റെയിഞ്ചുകളിൽ നേരിട്ട് അന്വേഷിച്ചാൽ അറിയാവുന്നതാണ്.

ലേലത്തിനുശേഷം കാലാവസ്ഥ കാരണമോ അ·ി, വെള്ളപ്പൊക്കം, ഉരുൾപൊട്ടൽ മുതലായ കെടുതികൾമൂലമോ തടി, വിറക്, മറ്റ് സാധനങ്ങൾ എന്നിവയ്ക്കു≠ാവുന്ന നഷ്ടത്തിനോ അളവ് വ്യത്യാസത്തിനോ ഡിപ്പാർട്ടുമെന്റിന് ഉത്തരവാദിത്വം ഉ≠ായിരിക്കുന്നതല്ല.

ദിവസങ്ങളിലും ദർഘാസ് ഫോറത്തിന്റെ വില രൊക്കമായോ മണിയോർഡർ ആയോ അടച്ച് രേഖാമൂലം അപേക്ഷിച്ചാൽ ലഭിക്കുന്നതാണ്. ദർഘാസ് ഫോറത്തിന്റെ വില തിരിച്ചു നൽകുന്നതല്ല. കേരള പൊതുമരാമത്ത് വകുപ്പിന്റെ ദർഘാസുകളെ സംബന്ധിക്കുന്ന എല്ലാ വ്യവസ്ഥകളും ഈ പ്രവർത്തിക്കും ബാധകമായിരിക്കും. ദർഘാസ് ഫോറങ്ങൾ കൈമാറ്റം ചെയ്യാൻ പാടില്ല. കരാറുകാർ ദർഘാസിനോടൊപ്പം നിർദ്ദിഷ്ട മാതൃകയിൽ ` 100-ന്റെ മുദ്രപത്രത്തിൽ പ്രാരംഭ കരാർ കൂടി സമർപ്പിക്കേ≠താണ്. പ്രാഥമിക ഉടമ്പടി ഇല്ലാത്ത ദർഘാസുകൾ നിരസിക്കുന്നതാണ്. ദർഘാസ് ദിവസം ഏതെങ്കിലും കാരണവശാൽ അവധിയായാൽ അടുത്ത പ്രവർത്തി ദിവസം നി›ിത സ്ഥലത്തും സമയത്തും ദർഘാസ് നടത്തുന്നതാണ്.

ഏതെങ്കിലും കാരണവശാൽ നി›ിത ദിവസം ദർഘാസ് ലേലവ്യവസ്ഥകളിൽ എന്തെങ്കിലും മാറ്റങ്ങളോ കൂട്ടിച്ചേർക്ക ലുകളോ ആവശ്യമായിവരുന്ന പക്ഷം ആയത് ലേലത്തിൽ പങ്കെടുക്കുന്നവരെ വായിച്ചു കേൾപ്പിച്ച് ബോദ്ധ്യപ്പെടുത്തുന്ന തായിരിക്കും.

ഫോറസ്റ്റ് ഓഫീസർ താഴെ പറയുന്ന ജോലി ചെയ്യുന്നതിന് മുൻപരിചയമുളള പി.ഡബ്ല്യു.ഡി.-യിലെ നി›ിത യോഗ്യതയുളള കരാറുകാരിൽ നിന്നും ജോലിയുടെ പേരെഴുതി മുദ്രവച്ച ദർഘാസുകൾ ക്ഷണിച്ചുകൊള്ളുന്നു. ദർഘാസുകൾ 17-1-2012, 10 മണി മുതൽ 1 മണിവരെ തെൻമല ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസിൽ നിന്നും ലഭിക്കുന്നതാണ്. 17-1-2012 Separate sealed competitive tenders superscribing the name of the work are invited by the undersigned for and on behalf of the Governor of Kerala from registered eligible contractors for the following works.

The tender forms are not transferable. The Earnest Money Deposit noted for the work should be paid along with the tenders by D.D. (Cheque will not be acceptable) pledged in favour of the undersigned payable at any Nationalised Bank/Scheduled Bank. Incomplete tenders and tenders without EMD are liable to be rejected. The undersigned reserves all the right to reject any tender without assigning any reasons thereof. All other conditions prevailing in the Kerala P.W.D. and Forest Department are applicable to this tender also. The tenders not containing the prescribed preliminary agreement in Stamp Paper worth ` 100 will be summarily rejected.

Tender forms and other conditions can be obtained from the Office of the undersigned on application in writing and on payment of the cost of tender form and taxes in cash (not refundable) up to 1 p. m. on 25-1-2012. The filled up tenders will be received in this office up to 3 p. m. on 25-1-2012 and opened by the undersigned or an officer authorised by him on the same day at 4 p. m. at the office of Divisional Forest Officer, Konni in the presence of the contractors attending on the date. If the due date happens to be a holiday, the next working day will be the due date.

The tender forms are not transferable. The earnest money deposit noted against the work should be paid along with the tenders by Demand Draft (Cheque will not be acceptable) pledged in favour of the undersigned payable at any Nationalised Bank/Scheduled Bank. Incomplete tenders and tenders without EMD are liable to be rejected. The undersigned reserves the right to reject any tender without assigning any reasons thereof. All other conditions prevailing in the Kerala P.W.D. and Forest Department are applicable to this tender also. The tenders not containing the prescribed preliminary agreement in Stamp Paper worth ` 100 will be summarily rejected.

All existing rules, regulations, directions, conditions prevailing in Forest Department and Store Purchase Department in respect of the works shall be applicable in this tender also.

The materials collected by final felling/thinning Teak Plantations in Konni/Naduvathumoozhy Ranges of Konni Forest Division and stacked at dumping sites shown in the schedule hereto attached will be sold in Tender/Auction by the undersigned or by any other officer authorized for the purpose, on the date and time shown in the schedule. The sale condition published by the Chief Conservator of Forests (Protection), Thiruvananthapuram vide notification No. Pro. (5)5628/2010, dated 2-12-2010 in the Kerala Government Gazette Vol. 55 (No. 49) dated 14-12-2010 and other sale conditions prevalent in the Forest Department are applicable to this Tender/Auction sale. This Gazette Notification is available in the website of Forest Department www.keralaforest.org & www.keralaforest.gov.in. Any further notification on the sale conditions that may be ordered by the Government after the publication of this sale notification will also be applicable to the sale. If the notified date of Tender/Auction is declared as a holiday the sale will be conducted on the next working day and if the sale is not possible on the notified date due to other reasons, the same will be conducted on the alternate date shown in the Shedule at the same place and time without further notification. The intending bidders should satisfy themselves about the quality and quantity of the materials put up for sale before the commencement of the auction and any complaints whatsoever will not be entertained after the sale proceedings are over. In case, any Government Department requires any of the materials, the quantity remaining after their selection only will be auctioned. The quantity that may become available for sale after the publication of this notification will also be included in this sale. The Tender/Auction will commence at the time noted in the Schedule in the dumping site and will continue till the sale of materials lotted for the day is over.

ഓഫീസർ പൊതുമരാമത്ത് വകുപ്പിൽ രജിസ്റ്റർ ചെയ്തിട്ടുള്ള നി›ിത യോഗ്യതയുള്ള അംഗീകൃത കരാറുകാരിൽ നിന്നും താഴെ പട്ടികയിൽ കാണിച്ചിരിക്കുന്ന പ്രവൃത്തികൾക്ക് 17-1-2012 പകൽ 3 മണിവരെ മുദ്രവെച്ച ദർഘാസുകൾ ക്ഷണിച്ചുകൊള്ളുന്നു.

Tender will be opened at 3.30 p.m. on 17-1-2012 at the office of the undersigned. Earnest Money is in the form of the Demand Draft or FDR from any scheduled or Nationalised Bank duly pledged in favour of the undersigned should be submitted along with the tender.

The tender should be accompanied by a preliminary agreement in Stamp Paper worth ` 100 otherwise the tender will be rejected outright.

The last date of issue of tender form will be up to 1 p.m. on 17-1-2012 tenders will be opened at 3.30 on 17-1-2012.

Tenders which do not accompany Earnest money in the above said manner will be rejected summarily. The Divisional Forest Officer, Mankulam reserves the right to reject the tender without assigning any reason thereof.

If the day proposed for tender happens to be a public holiday the same will be conducted on the next working day without changes in time, place and conditions of the tender if the tender cannot be conducted due to lack of enough number of tenders or due to any other reasons, the same will be conducted on 20-1-2012 that too, if not happens, the same will again to be conducted on 23-1-2012 without any change in the place, time. All the conditions regarding the execution of civil works in Kerala Public Wrok Department will be applicable in the case of this works.

നിരതദ്രവ്യം മാങ്കുളം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെ പേരിൽ ഏതെങ്കിലും ദേശസാൽകൃത സർക്കാർ/ഷെഡ്യൂൾ ബാങ്കിൽ നിന്നും എടുത്ത ഡിമാന്റ ് ഡ്രാഫ്റ്റോ, ഫിക്സഡ് ഡിപ്പോസിറ്റോ ആയിരിക്കണം.

പൂരിപ്പിച്ച ദർഘാസിനോടൊപ്പം നിരതദ്രവ്യവും 100 രൂപയുടെ മുദ്രപത്രത്തിൽ ഒപ്പുവച്ച ഒരു പ്രാഥമിക ഉടമ്പടിയും ഉ≠ായി രിക്കണം. ഇവ ഇല്ലെങ്കിൽ ദർഘാസ് നിരസിക്കുന്നതായിരിക്കും.

ദർഘാസ് ഫോറം അടിമാലിയിലുള്ള മാങ്കുളം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസിൽ നിന്നും 17-1-2012 പകൽ 1 മണിവരെ നൽകുന്നതും അന്നേദിവസം പകൽ 3 മണിവരെ ദർഘാസുകൾ സ്വീകരിക്കുന്നതുമായിരിക്കും.

പൂരിപ്പിച്ച മുദ്രവെച്ച ദർഘാസുകൾ 17-1-2012 പകൽ 3.30 മണിക്ക് ഹാജരുള്ള ദർഘാസുകാരുടെ സാന്നിദ്ധ്യത്തിൽ മാങ്കുളം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറോ അദ്ദേഹം അധികാര പ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ തുറക്കുന്നതായിരിക്കും. ദർഘാസ് ദിവസം സർക്കാർ പൊതു അവധിയായി പ്രഖ്യാപിക്കു കയാണെങ്കിൽ അടുത്ത പ്രവൃത്തി ദിവസം സ്ഥലം, സമയം നിബന്ധനകൾ ഇവയിൽ മാറ്റമില്ലാതെ ദർഘാസ് നടത്തുന്ന തായിരിക്കും. മറ്റെതെങ്കിലും കാരണങ്ങളാൽ 17-1-2012-ന് ദർഘാസ് നടത്തുവാൻ കഴിഞ്ഞില്ലായെങ്കിൽ സ്ഥലം, സമയം, നിബന്ധനകൾ ഇവയിൽ മാറ്റമില്ലാതെ 20-1-2012, 23-1-2012 എന്നീ ദിവസങ്ങളിൽ ദർഘാസ് നടത്തുന്നതാണ്. കേരള പൊതു മരാമത്ത് വകുപ്പിൽ സിവിൽ ജോലികൾക്ക് ബാധകമായിട്ടുള്ള എല്ലാ നിബന്ധനകളും ഈ ജോലികൾക്കും ബാധകമായിരിക്കും.

കേരള വന നിയമം 1961-ലെ എ വകുപ്പ് പ്രകാരം പിടിച്ചെടുത്ത താഴെ പട്ടികയിൽ വിവരിക്കുന്ന വാഹനങ്ങൾ ബഹു. കേരള ഹൈക്കോടതിയുടെ 2008 ഡിസംബർ 2-ാം തീയതി യിലെ എം.എ.സി.എ. 1458/08-ാം നമ്പർ വിധിയുടെയും ബഹു. കേരള ചീഫ് സെക്രട്ടറിയുടെ 2009 ജനുവരി മാസം 5-ാം തീയതിയിലെ 89584/ജി3/08 ഹോം നമ്പർ സർക്കുലറിന്റെയും അടിസ്ഥാനത്തിൽ അവ സൂക്ഷിച്ചിരിക്കുന്ന സ്ഥലത്ത് തത്സമയ അവസ്ഥയിലും സ്ഥിതിയിലും 2012 ജനുവരി 24-ാം തീയതി പുനർ ദർഘാസ്/ലേലം മുഖേന വിൽക്കുന്നതായിരിക്കും. ടി പുനർ ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ താത്പര്യമുള്ള വരിൽ നിന്നും മുദ്രവച്ച ദർഘാസുകൾ സ്വീകരിക്കുന്നതാണ്. അന്നേ ദിവസം പകൽ 3 മണിക്ക് വൈൽഡ് ലൈഫ് വാർഡനോ അല്ലെങ്കിൽ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ഉദ്യാഗസ്ഥനോ മൂന്നാർ വൈൽഡ് ലൈഫ് ഡിവിഷൻ ആഫീസിൽ വച്ച് ലേലം ചെയ്യുന്നതും, ലേലത്തിനുശേഷം പുനർ ദർഘാസ് തുറന്ന് പരിശോധിക്കുന്നതുമായിരിക്കും. പുനർ ദർഘാസിലോ/ലേല ത്തിലോ ഏറ്റവും കൂടുതൽ തുക വാഗ്ദാനം ചെയ്യുന്നയാളുടെ പേരിൽ പുനർ ദർഘാസ്/ലേലം താൽക്കാലികമായി ഉറപ്പിക്കുന്നതായിരിക്കും.

നിരതദ്രവ്യം—` 10,000 ദർഘാസ് ഫോറത്തിന്റെ വില— ` 150+നികുതി (ഒരു വാഹനത്തിന്).

നിബന്ധനകൾ

4. പുനർ ദർഘാസ്/ലേലത്തിൽ പരിഗണിക്കപ്പെടാത്തവരുടെ നിരതദ്രവ്യം അപ്പോൾ തന്നെ തിരികെ നൽകുന്നതാണ്.

5. കൂടുതൽ തുകയ്ക്കുള്ള ദർഘാസുകൾ അംഗീകാര ത്തിനായി മേലധികാരത്തിലേക്ക് അയയ്ക്കുന്നതും മറ്റു ദർഘാസുകാർ നൽകിയ നിരതദ്രവ്യം അപ്പോൾ തന്നെ തിരികെ നൽകുന്നതുമാണ്.

6. പുനർ ദർഘാസ് സംഖ്യ നിരതദ്രവ്യത്തിനേക്കാൾ കൂടുത ലാണെങ്കിൽ ദർഘാസ് സംഖ്യയുടെ 50% അല്ലെങ്കിൽ ` 10,000 ഏതാണോ കൂടുതൽ (നിരതദ്രവ്യം ഉൾപ്പടെ) അത് അപ്പോൾ തന്നെ ഒടുക്കേ≠താണ്.

7. ദർഘാസുകൾ ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥന്റെ അംഗീകാരത്തിന് വിധേയമായിരിക്കും ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനോ നിരസിക്കുന്നതിനോ ഉള്ള പൂർണ്ണ അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമായിരിക്കും.

8. പുനർ ദർഘാസുകൾ അംഗീകരിച്ചതായി അറിയിപ്പുകിട്ടി 15 ദിവസത്തിനകം ബാക്കി സംഖ്യയും നിയമപ്രകാരമുള്ള നികുതിയും അടച്ച് വാഹനം നീക്കം ചെയ്യേ≠താണ്.

9. 15 ദിവസത്തിനുള്ളിൽ ബാക്കി സംഖ്യയും നികുതിയും അടച്ച് വാഹനം നീക്കം ചെയ്തില്ലെങ്കിൽ ദർഘാസുകാരൻ ആവശ്യപ്പെടുന്ന പക്ഷം മറ്റൊരു 15 ദിവസം കൂടി ബാക്കി സംഖ്യക്ക് 12% പലിശയും ദിവസം ` 20 നിരക്കിൽ ഇരുപ്പു വാടകയും വസൂലാക്കി അനുവദിക്കുന്നതായിരിക്കും. ഇതിനുശേഷം കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല. ഇപ്രകാരം വീഴ്ച വരുത്തിയ ദർഘാസുകാരന്റെ നഷ്ടോത്തര വാദിത്വത്തിൽ പുനർ ലേലത്തിലോ ടെ≠ർ അടിസ്ഥാന ത്തിലോ ടി വാഹനം വിൽക്കുന്നതും ദർഘാസുകാരൻ അടച്ച തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതുമായിരിക്കും.

If the due date happens to be a holiday, the next working day will be the due date. Cost of tender forms will not be refunded at any instances.

In addition to the above tender forms and tender schedules can be downloaded from the official website of the Department www.kerala.gov.in/tender/intex.htm. Filled up tender forms along with other documents shall be submitted to the undersigned upto 3 p.m. on 25-1-2012 by post or any approved courier service. In the case of downloaded tender applications, in addition to the prescribed EMD, a demand draft for the tender form value from a Nationalized Bank drawn in favour of Wildlife Warden, Wildlife Division, Munnar payable at Munnar shall also be enclosed. No other mode of remittance of tender form cost is acceptable.

The Earnest Money Deposit noted against the work should be paid along with the tenders by DD (cheques or fixed deposit receipts will not be acceptable) in favour of the undersigned payable at any Nationalized Bank at Munnar. Incomplete tender or tenders without EMD are liable to be rejected. The Preliminary Agreement in Stamp Paper worth ` 100 should be enclosed with tender. The undersigned reserves the right to reject any tender without assigning any reason. All other conditions prevailing in the Kerala Public Works Department and Forest Department are applicable to this tender notification also.

Separate sealed tenders are invited from eligible 'A'/'B' Class contractors registered in the Forest Department in pursuance of G. O. (Ms.) No. 226/81 (F) dated 16-12-1981 for working down Timber as round logs and Billets and firewood from the marked trees from the teak plantation mentioned in the schedule below to the depot, billets and firewood at site mentioned with the same schedule.

Note:—The contractors who have registered under 'A' Category should produce solvency certificates issued by the Revenue Department or a Bank guarantee from a scheduled Bank under the Bank Guarantee Scheme as follows:

'A' Category ` 75,000 + 10% of the amount by which the contract value exceeds ` 3,00,000 the Solvency Certificate or Bank Guarantee already produced by the tenderer at the time of registration of his name in 'A' Class contractor will be taken to account.

The terms and conditions fixed for 'B' Category contractors should also be binding to them for acceptance of tenders for this work.

2. The conditions embodied in this notification form part and parcel of the agreement to be executed for the work tendered for.

3. Tender forms can be had from the Divisional Forest Officer, Palakkad on payment of the cost and sales tax shown in the schedule, hereto on any working day during the office hours up to 4 p.m. on 18-1-2012. The tender form shall be used only by the persons in whose name it is issued and for the works specified in the schedule given below.

4. The tenderers shall fill in the tender forms purchased from this office and submit the same together with all the pages intact. Tenders should be addressed in a sealed cover with the name of the work clearly written thereon, to the Divisional Forest Officer, Palakkad so as to reach him in his office at Palakkad before 1 p.m. on 19-1-2012. Sealed tenders will be opened by the Divisional Forest Officer at 3 p.m. on the same day in the presence of such of the tenderers who opt to be present on the occasion.

5. If the last date fixed for the receipt of the tenders happens to be a holiday, the tenders will be received and opened on the next working day at the same time and place as per the conditions specified above. If for some technical reason tender could not be conducted for any plantation on the date mentioned above it will be again conducted on 25-1-2012 and again on 31-2-2012.

6. The tenders received after the specified date and time, without the requisite enclosures or tenders not written up in the proper order or form, will be rejected.

7. Each tender should be accompanied by a Fixed Deposit Receipt obtained from an approved Bank in favour of the Divisional Forest Officer, Palakkad as Earnest Money Deposit for the work.

8. Tenderers should quote uniform percentage of the departmental basic rate at which they can take up the work specified in the schedule both in figures and words. Fraction of one per cent should not be quoted.

9. All the corrections in the tender forms should be initialled by the tenderer himself.

10. In case more than one tenderer quoted the same lowest rate the successful lowest bidder will be decided in an auction among the tenderers who quoted the same lowest rate.

11. If any of the lowest tenderer is not prepared to reduce rate in the auction without fraction of one per cent it will be opened to the confirming authority to draw the tender by lots among or between the lower tenderers.

12. The lowest tender will ordinarily be accepted, provided the charector and financial status of the tenderers are found satisfactory, but the authority competent to accept the tender reserves to himself the powers of accepting or rejecting any tender without assigning any reason therefore. There shall be no appeal against such action.

13. Rule notified as per G. O. (P) 62/76/AD dated 23-2-1976 and published in the Gazette dated 9-3-1976 shall be binding on any person who makes a written tender for the works.

14. Tender submitted by timber merchants, sale coupe contractors and other persons who are engaged in timber trade within the limits of the forest division in which working area is situated or by the adjacent divisions will not be accepted.

15. The tenderers should have no relationship on any Government Servant who is in charge of the work or who has any direct control over the work. Relationship in this case will mean father, mother, daughter, son, brother, sister, direct uncle, nephew, father-in-law, mother-in-law and the first cousin of the officers concerned.

16. The earnest money deposit of unsuccessful tenderers will be returned to them soon after opening the tenders.

17. Before submitting the tender, the tenderer, is expected to study and scrutinize all the conditions in this agreement to be executed, the draft of which can be had for perusal from the Divisional Forest Officer, Palakkad on any working day during office hours. He should also be through about the field conditions, terrain, labour availability etc. No plea of ignorance of the agreement conditions as field conditions or no complaint regarding the said conditions received after putting in the tender shall be entertained on any account. A bonded agreement should be executed by the successful tenderer on the date of opening of tenders itself.

18. The successful tenderer shall within 15 days from the date of issue of the acceptance of tender, furnish a security deposit of an amount equal to 10% of the total contract value limited to a maximum of rupees 1,00,000 (Rupees One lakh only) and execute an agreement on a Stamp Paper worth ` 100 in the approved form, the same of which can be had from the Divisional Forest Officer, Palakkad for perusal. The security amount should be remitted in the Government Treasuries duly pledged to the Divisional Forest Officer, Palakkad. If the security is not remitted and the agreement executed within the above said period, a further period of 15 days shall be allowed by the Divisional Forest Officer, for remittance of security and the execution of the agreement subject to realization of ` 10 (Rupees Ten only) per day of extension. If the tenderers remits the security within 15 days from the date of intimation of acceptance order but is not able to execute the agreement within the period, the Divisional Forest Officer may grant an extension of time for 15 days more for execution of agreement with a penalty of ` 1 per day of extension.

19. Failure to remit the security deposit and to execute the agreement, within the time specified in the condition 18 above, will lead to cancellation of the tender by the Divisional Forest Officer and forfeiture to Government of the Earnest Money Deposit and security if any, deposited by the tenderers. The work will also be got done through other agencies at the risk and loss of the defaulter. The loss if any will be treated as arrears of public revenue and will be recovered from the defaulter under the provisions of Revenue Recovery Act or by any other legal means if not paid within a reasonable time specified by the Divisional Forest Officer. The defaulter, however will not be entitled for gain, if any.

20. The tenderer should produce valid clearance certificate of sale-tax, income tax and agricultural income tax to the satisfaction of the Divisional Forest Officer before the final payment is made to him in case the contract value is of and above ` 5,000 (Rupees five thousand).

21. In the case of working down round logs and firewood the contractor shall be found to deliver at the depot all hardwood logs within three months, from the date of registration, softwood logs within 15 days from the date of felling and billets and Firewood within 2 months from the date of registration or within the contract period whichever is earlier. If the delivery of the produce is not effected within the period originally fixed as above, the Divisional Forest Officer, may grant extension for three months for delivery of hardwood, 15 days for softwood and two months for billets and firewood subject to the realization of penalty of ` 7/cum. for hardwood ` 7/cum. for softwood for 15 days and Re 0.50/MT for stacked billets and Firewood. 15 days further extension can be granted by the Chief Conservator of Forests, Olavakkode with penalty of ` 14/ cum for hardwood and ` 14/ cum. for soft wood, if the periods fall within the original or the extended contract period.

All registered logs remaining undelivered after the expiry of said period will be taken charge of by the Forest Range Officer, Olavakkode and the contractor shall be liable to pay a fine of ` 4/ cum. for such undelivered logs only and forfeit all claims to kolevila due thereon. The loss if any sustained by the Department due to deterioration on account of belated delivery or non-delivery of the timber will be made good from the contractor as assessed by the Department. The contractor should obtain receipts for the logs delivered at the depot from the depot officer when the contractor will be eligible for Kolevila therefore. The contractor shall fell all the marked trees entrusted him except those trees which have been certified by the Divisional Forest Officer after inspection as wholly defective or impossible to be felled without causing serious damages to their stems or to other trees standing nearby and collect all available timber thereof. For every marked trees left unfelled or felled but uncollected at the expiry of the contract period without proper authorization from the Divisional Forest Officer the Contractor is liable to pay a penalty of ` 200 per tree, besides realization of value of timber of uncollected trees as per other conditions. The value of the logs at schedule rate if rendered useless or deteriorated will be realized.

22. The contractor shall ensure that the felling and collection proceeds from the end of the coupe to the other end in an orderly and systematic manner and that all trees are felled as low as possible to the ground levels using saw at least on one side. All logs shall be cross cut with saw.

23. For all logs and billets selling at rates less than Kolevila, the Kolevila payable to the contractor will be limited to the sale price.

24. If the contractor fails to undertake and complete the work within the specified time or if he leaves any item of work undone, the Divisional Forest Officer, at his discretion make other arrangements for carrying out the works left undone, either departmentally or through other agencies at the risk and loss of the defaulting contractor and the loss if any, sustained by the department on this account will be recovered from the security deposit or from other assets of the defaulting contractor, as if such sums are arrears of Land Revenue under the provisions of Revenue Recovery Act in force in such other manner as the Government may deem fit.

25. If any amount becomes due to any workmen or mazdoor engaged by the contractor as per Workmen's Compensation Act or as per provisions of labour or similar laws, such amounts shall be payable by the contractor.

26. The tenderers should submit a declaration with the tender that they are not related any Government Servant who is in charge of or having control of the work for which the tender is submitted. Relationship for this purpose will be restricted to father, mother, son, daughter, sister, brother, uncle, nephew, father-in-law, mother-in-law, brother-in-law and first cousins of the officer. If at any stage this condition is found to have been contravened the Earnest Money/Security Deposit of the tenderer/contractor will be forfeited to Government and the contract entered into will stand cancelled.

27. (a) The contractor shall not make any damage to bridges or roads and private properties during collection and transport and during unloading logs and billets from lorries and he shall be liable of any such damages. The decision of the Government regarding the amount of compensation payable for the damages caused shall be final and binding on the contractor and the Government shall recover such damages from the contractor.

(b) If the damage caused is in respect of any road under the control of the Kerala State Electricity Board or Public Works Department the amount of compensation payable for such damages will be assessed by the Forest Range Officer, concerned and the Assistant Engineer of the concerned Division of the Kerala State Electricity Board or Public Works Department and their decision being final and binding on the contractor. In such cases the contractor shall be liable to pay the damages to the Kerala State Electricity Board or Public Works Department and they shall recover such damages from the contractor.

28. The tenderers should give an undertaking in the tender that they undertake to carry out the work at the tendered rates quoted and to abide by the terms and conditions of the tender notice and draft agreement so on by them and also other departmental rules and orders issued by them from time to time.

29. (a) Post offers which are not advantageous by more than 5% of the lowest rate offered for the original tender where the total cost of the work as per tender is ` 1,00,000 (Rupees One Lakh) and above and more than 10% where the total cost of the work is less than 1,00,000 (Rupees One Lakh) will be summarily rejected. In other cases it will be considered under the following conditions:

( i) The post offer should be made within 7 days of tender.

(ii) The post offer should remit double the security for the work based on the work offered by the lowest tenderer.

The remittance should be made within 7 days from the date of receipt of registered notice.

29. (b) (i) The post offerer after satisfying the conditions specified above should also execute an agreement before the Divisional Forest Officer pledging the security for the due fulfillment of the terms.

(ii) If the post offerer satisfied the conditions specified above, re-tenders will be called for after giving the usual publicity as per the rules. In the re-tender if the rates offered does not come up to what has been offered by the post offerer it will be awarded to the post offerer at the rate offered by him. If he back out, the security amount will be forfeited to Government. If however, the rate is less than what has been offered by the post offerer in the case of re-tender, the work will be awarded to the lowest tenderer and the amount remitted by the post offerer released to him.

30. The quantity mentioned in the schedule is only approximate and the contractor is bound to work down the full quantity of timber and firewood available from trees marked and entrusted to him.

31. The period of contract will be three months from the date of intimation of work order. No extension of the contract period shall ordinarily be granted. But if however if the delay in completing the work in the contract area within the period specified in the schedule attached is due to circumstances beyond the control of the contractor extension of time may be granted for one/two/three months by Divisional Forest Officer, Chief Conservator of Forests, Olavakkode Circle and Chief Conservator of Forests respectively but not exceeding a total period of 6 months subject to realization of penalities as mentioned below. If he fails to undertake and complete the works within the specified time, or if he leaves any10th JAN. 2012] FOREST DEPARTMENT 47 item of work undone, the Divisional Forest Officer may at his discretion make other arrangements for carrying out the work left undone either departmentally or through other agencies at the risk and loss of the defaulting contractor, and loss if any, incurred by the department on these agencies at the risk and loss of the defaulting contractor, and loss, if any, incurred by the department on this account will be recovered from the security or from other assets of the contractor.

Penalty:—(a) ` 2/cum. for the quantity of timber delivered at the Depot during the first month extension granted by the Divisional Forest Officer.

(b) ` 2.50/cum. for quantity of timber delivered at the Depot during the extension granted by the Conservator of Forests.

(c) ` 3/cum. for the quantity of timber delivered at the Depot during the extension granted by the Chief Conservator of Forests.

(d) In the same way for billets and firewood ` 1.00, 1.25, 1.50 for the extention granted by the Divisional Forest Officer, Conservator of Forests, the Chief Conservator of Forests, respectively.

32. The Divisional Forest Officer reserves to himself the power to eliminate any tree marked and entrusted to the contractor from felling if it is found during the course of the contract that timber obtainable from such trees have no reasonable market or by some other reasons and the contractor is not entitled to claim any compensation for such elimination.

33. Ten per cent of each kolevila bill will be withheld as retention amount which will be released after the connected logs are sold and the liability if any in respect of these logs with the contract is settled.

33. (a) In case of works, the contract value which exceeds ` 10,000 income tax at the rate of two per cent of payment made shall be deducted at each time when payments are made except in the case of non-resident contractors.

34. For working down logs, seignorage on vakka fibre calculated at one vakka drag rope, for every two cum. or fraction thereof and grazing fee for one elephant for every two cubic meters or fraction thereof for timber will be recovered from the contractor on the actual quantity collected and sales tax on vakka charges as per the rules in force.

34. (a) All timber the contractor is under obligation to deliver at the prescribed depots shall be transported to such depot only along the routes specified in the transport permit. If in the course of work it become necessary to deviate from the routes specified in the schedule, the contractor may be allowed to transport timber and firewood along the deviation routes, provided the department is satisfied of the necessity for the deviated in the routes. In the case of such deviation in routes, the contractor will be eligibile to get kolevila at the rates worked for those new route minus tender reduction with prior sanction of the Conservator of Forests. Quantity to be supplied to different depots shall also be changed by the Divisional Forest Officer, with prior sanction from the Conservator of Forests.

35. The contractor shall collect all timber available from the trees marked in the plantation within the said contract period as per the instructions issued by the Divisional Forest Office, Palakkad. If the collection is delayed the contractor will be liable to pay a penalty at the rate specified above for the timber for the belated period.

36. The contractor should achieve, show and register progress in working down timber.

37. If the rates quoted in the retender is more than quoted in the original tender the difference between them and all the expenditure incidental in fixing up of re-tender including notification charges as assessed by the Divisional Forest Officer, Palakkad will be recovered from the defaulting tenderer through any legal means including Revenue Recovery Act.

38. Further particulars can be had from the Divisional Forest Officer, Palakkad or the Range Officer, Olavakkode on any working days during office hours. Basic rate given is subject to the approval of Conservator of Forests and exact Basic rate would be given along with the schedule in the tender form.

39. The contractor should take every care to collect as much quantity of saleable timber as possible from marked trees.

40. The Divisional Forest Officer has the discretion to postpone the tender without assigning any reason.

1. Sealed competitive tenders are invited from Registered and Experienced P.W.D. Contractors for and on behalf of the Governor of Kerala by the Divisional Forest Officer, Palakkad for the execution of the following works shown in the schedule furnished below. Sealed covers superscribing the name of the work will be opened in the presence of the available contractors by the Divisional Forest Officer, Palakkad or any other officer authorized by him at the stipulated place and time as shown in the schedule. The tender forms will be supplied to the contractors only on production of their Registration Card, PAN Card and on payment of the cost and VAT of the tender form. The tender form is not transferable and the cost of the tender form is non-refundable under any circumstances.

2. If the tender could not be conducted on the fixed day, due to any circumstances, the same will be conducted on the next working day at the stipulated place and time.

3. The EMD noted against each works should be paid along with the tender form by Fixed Deposit Certificate or DD drawn at any Nationalized Bank at Palakkad in favour of Divisional Forest Officer, Palakkad. A Preliminary Agreement in the prescribed format in Kerala Government Stamp Paper worth ` 100 should be attached with the tender. Incomplete tender or the tender without the required EMD and preliminary agreement are liable to be rejected. The Divisional Forest Officer, Palakkad reserves the right to reject any tender without assigning any reasons. All the rules and regulations regarding tender in force in PWD and Forest Department are applicable to this tender also. The Divisional Forest Officer will be at his liberty to exclude any of the works mentioned in the schedule from the tender.

4. The successful tenderer should execute the agreement and commence the work within 15 days from the date of receipt of work order. If he fails to execute the agreement and to execute the work, the work will be re-tendered at the risk and loss of the original bidder or execute departmentally. 5. If nobody comes forward and participate in the tender on 20-1-2012 the same will be conducted on 24-1-2012 or 30-1-2012 of the same place and time. The tenders received will be opened by the Wildlife Warden or any other officer authorized by him at 3.30 p. m. on the same day in the Office of the Wildlife Warden, Silent Valley Division, Mannarkkad. Tender form can be purchased from the office of the Wildlife Warden, Mannarkkad on any of the working days till 1 p. m. on 18-1-2011. The registered contractors will be supplied with the tender forms only on the production of their Registration Cards. The price of the tender form is non-refundable under any circumstances. Tenders received after the due time and date and not accompanied by proper Earnest Money Deposit will not normally be entertained. 1. സർക്കാർ തടി ഡിപ്പോയിൽ അതാത് കാലങ്ങളിൽ നിലവിലുള്ളതും ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ അദ്ദേഹത്തിന്റെ പ്രൊ. 5-7698/08 തീയതി 6-12-2008 പ്രകാരം 16-12-2008-ലെ ഗസറ്റിൽ പ്രസിദ്ധപ്പെടുത്തിയ നിബന്ധനകൾ ഈ ലേലത്തിനും ബാധകമായിരിക്കും.

2. ലേലത്തിൽ പങ്കുകൊള്ളാൻ ഉദ്ദേശിക്കുന്നവർ ലേലം തുടങ്ങുന്നതിന് മുമ്പ് ലേലത്തിന് വച്ചിട്ടുള്ള സാധനങ്ങളുടെയും മറ്റും ഗുണനിലവാരവും അളവുകളും മറ്റു വിശദവിവരങ്ങളും ക≠് ബോദ്ധ്യപ്പെട്ടിരിക്കേ≠തും ലേലത്തിനുശേഷം ഈ വക കാര്യങ്ങളെക്കുറിച്ചുള്ള യാതൊരു പരാതികളും പരിഗണിക്കുന്ന തല്ലാത്തതുമാകുന്നു. ഓരോ ലേലത്തിനും വിൽക്കാൻ ഉദ്ദേശിക്കപ്പെട്ട തടികൾ, മറ്റു വനവിഭവങ്ങൾ മുതലായവയെ പറ്റിയുള്ള വിവരങ്ങൾ വൈൽഡ്ലൈഫ് വാർഡന്റെ ഓഫീസിൽ നിന്നോ റെയിഞ്ചാഫീസുകളിൽ നിന്നോ ലേലത്തിന് മുമ്പ് അറിയാവുന്നതാണ്.

3. ലേലത്തിൽ പങ്കുകൊള്ളാൻ ഉദ്ദേശിക്കുന്നവർ ലേലം തുടങ്ങുന്നതിന് മുമ്പായി ഈട്ടി, തേക്ക് എന്നിവയുടെ ലേലത്തിനാണെങ്കിൽ ` 10,000 മറ്റു തടികളുടെ ലേലത്തിനാണെങ്കിൽ ` 5,000 മറ്റു വനവിഭവങ്ങളുടെ കാര്യ ത്തിൽ ` 1,000 നിരതദ്രവ്യം പണമായി കെട്ടിവയ്ക്കേ≠തും ലേല നിബന്ധനകൾ അനുസരിക്കുന്നതിന് വീഴ്ചവന്നാൽ ത∑ൂലമു≠ാകുന്ന നാശംമൂലം വകുപ്പിന്/സർക്കാരി നു≠ാകുന്ന കഷ്ടനഷ്ടങ്ങൾ തന്നിൽ നിന്നും ഈടാക്കാവുന്ന താണെന്നും സമ്മതിച്ചുകൊ≠ുള്ള ഒരു ഉടമ്പടി ഒപ്പുവെക്കേ≠താണ്.

4. ലേലത്തിൽ പങ്കുകൊള്ളാൻ ഉദ്ദേശിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കൈയ്യൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജ് ഓഫീസറിൽ നിന്നു മുള്ള ഒരു സർട്ടിഫിക്കറ്റോ അതല്ലെങ്കിൽ ഇലക്ഷൻ കമ്മീഷൻ നല്കിയ എെഡന്റിറ്റി കാർഡോ ഇവയിലേതെങ്കിലും ഒന്നിന്റെ സാക്ഷ്യപ്പെടുത്തിയ പകർപ്പോ, നിരതദ്രവ്യം കെട്ടിവയ്ക്കുന്നതിനു മുമ്പായി സമർപ്പിക്കേ≠താണ്. പ്രോപ്പർട്ടിമാർക്ക് രജിസ്ട്രേഷനു ള്ളവർ അവരുടെ സർട്ടിഫിക്കറ്റ് കാണിച്ച് ബന്ധപ്പെട്ട ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥൻമാരിൽ നിന്നും ഫോട്ടോ പതിച്ച എെഡന്റിറ്റി കാർഡ് ഹാജരാക്കിയാൽ മതിയാകുന്നതാണ്. മേൽ വിവരിച്ച പ്രകാരം സർട്ടിഫിക്കറ്റോ ഏതെങ്കിലും തിരിച്ചറിയൽ രേഖയോ ഹാജരാക്കാത്തവരെ ലേലത്തിൽ പങ്കുകൊള്ളാൻ അനുവദിക്കുന്നതല്ല.

5. ലേല വ്യവസ്ഥയിൽ എന്തെങ്കിലും മാറ്റങ്ങളോ കൂട്ടിച്ചേർക്കലുകളോ ആവശ്യമായി വരുന്നപക്ഷം ആയത് ലേലസമയത്ത് വിശദീകരിക്കുന്നതായിരിക്കും. കൂടുതൽ വിവരങ്ങൾക്ക് അതാത് റെയിഞ്ചാഫീസുകളിൽ അന്വേഷിക്കാവു ന്നതാണ്.

6. കോടതിയുടെ അനുമതി വാങ്ങിയശേഷം ലേലം ചെയ്ത് വിൽക്കുന്ന സാധനങ്ങളുടെ മുഴുവൻ വിലയും മറ്റ് നികുതികളും ലേല ദിവസം തന്നെ അടയ്ക്കേ≠താണ്. മറ്റ് ലേലങ്ങളിൽ നികുതികൾ ലേലം സ്ഥിരപ്പെടുത്തി ഉത്തരവായിരി ക്കുന്ന ദിവസം മുതൽ 30 ദിവസത്തിനകം അടയ്ക്കേ≠താണ്.

ഏതെങ്കിലും കാരണവശാൽ ടി തീയതികളിൽ ഏതെ ങ്കിലും പൊതുഅവധി ദിവസമായി വരികയാണെങ്കിൽ അന്നേ ദിവസത്തെ ലേലം തൊട്ടടുത്ത പ്രവൃത്തി ദിവസം നി›ിത സ്ഥലത്തും സമയത്തും നടത്തുന്നതാണ്.

വ്യവസ്ഥകൾ

1. സർക്കാർ തടിഡിപ്പോകളിൽ അതാത് കാലങ്ങളിൽ നിലവിലുള്ള പൊതുവ്യവസ്ഥകൾ അനുസരിച്ചാണ് ലേലം എന്നാൽ പൊതു വ്യവസ്ഥകളിൽ താഴെ പറയുന്ന വ്യതിയാനങ്ങൾ തൊ≠ി ലേലത്തിന് ബാധകമാണ്.

2. ലേലത്തിൽ പങ്കുകൊള്ളാൻ ഉദ്ദേശിക്കുന്നവർ ലേലം തുടങ്ങുന്നതിന് മുമ്പുതന്നെ ലേലത്തിൽ ഉൾപ്പെടുത്തി യിരിക്കുന്ന സാധങ്ങളുടെ സ്ഥിതിയും അളവുകളും മറ്റും ബോദ്ധ്യപ്പെടേ≠താണ്. ലേലത്തിനുശേഷം ഉന്നയിക്കുന്ന യാതൊരു പരാതികളും പരിഗണിക്കുന്നതല്ല.

3. ലേലത്തിൽ വിളിച്ചെടുത്ത തൊ≠ി സാധനങ്ങളുടെ വില `20,000 (ഇരുപതിനായിരം) കവിയുന്നില്ല എങ്കിൽ 20,000 (ഇരുപതിനായിരം) രൂപയോ ലേലത്തുകയുടെ മൂന്നിലൊന്ന് ഭാഗമോ ഏതാണ് കൂടുതൽ ആയത് രൊക്കം പണമായി ലേലം കഴിഞ്ഞ ഉടനെ ഒടുക്കേ≠താണ്.

4. ലേലത്തിൽ പങ്കുചേരാൻ ആഗ്രഹിക്കുന്നവർ ലേലത്തിന് മുമ്പായി ` 10,000 (പതിനായിരം) നിരതദ്രവ്യമായി കെട്ടിവെക്കേ≠താണ്.

നിലമ്പൂർ സൗത്ത് ഡിവിഷനിൽപ്പെട്ട കാളികാവ്, കരുളായി റെയിഞ്ചുകളിലെ വിവിധ വനം കേസുകളിൽ ഉൾപ്പെട്ടതും തൊ≠ി സാധനങ്ങളായ തടികൾ, ഉരുപ്പടികൾ മുതലായവ താഴെ കൊടുത്തിരിക്കുന്ന സ്ഥലത്തും സമയത്തും വച്ച് താഴെ പറയുന്ന ലേല വ്യവസ്ഥകൾക്ക് വിധേയമായി നിലമ്പൂർ സൗത്ത് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റ് ഉദ്യോഗസ്ഥനോ പരസ്യമായി ലേലം ചെയ്ത് വിൽക്കുന്നതാണ്. ലേല തീയതി ഒരു പൊതു അവധിയായി വരുകയാണെങ്കിൽ തൊട്ടടുത്ത ദിവസം നിർദ്ദിഷ്ട സ്ഥലത്തും സമയത്തുംവെച്ച് ലേലം നടത്തുന്നതാണ്.

വർഷം മാസം കരുളായി കാളികാവ് റെയിഞ്ച് റെയിഞ്ച് (1) (2) (3) (4) 2012 ജനുവരി 27 30 2012 ഫെബ്രുവരി 16 21 2012 മാർച്ച് 16 19 5. ലേലത്തിൽ പിടിച്ചെടുത്ത സാധനങ്ങൾ ലേലം സ്ഥിരപ്പെടുത്തിയ വിവരം അറിയിക്കുന്ന തീയതി മുതൽ 30 ദിവസത്തിനകം ബാക്കി വില, വിൽപ്പന നികുതി മുതലായവ അടച്ച് നിയമപ്രകാരമുള്ള പാസ്സ് വാങ്ങി നീക്കം ചെയ്യേ≠താണ്. അപ്രകാരം പണം അടച്ചശേഷം സാധനങ്ങൾ നീക്കം ചെയ്യാതിരുന്നാൽ ലേലം സ്ഥിരപ്പെടുത്തിയതായി അറിയിക്കുന്ന തീയതി മുതൽ 45 (നാൽപ്പത്തിയഞ്ച്) ദിവസത്തിനകമുള്ള അവധികൂടി ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ അനുവദിക്കുന്നതാണ്. പാസ്സിന്റെ കാലാവധി നീട്ടാനുള്ള അപേക്ഷ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല. മേൽപ്പറഞ്ഞ സമയത്തിനുള്ളിൽ സാധനങ്ങൾ നീക്കം ചെയ്യാതിരുന്നാൽ മറ്റൊരു അറിയിപ്പ് കൂടാതെ തന്നെ അവ സർക്കാരിലേക്ക് മുതൽ കൂട്ടുന്നതും അവയിൽ ലേലക്കാരന് യാതൊരുവിധ അവകാശങ്ങളും ഉ≠ായിരിക്കുന്നതുമല്ല.

6. ബാക്കി സംഖ്യകൾ 30 ദിവസത്തിനകം അടയ്ക്കാതിരുന്നാൽ ന്യായമായ കാരണങ്ങളാൽ 15 ദിവസം കൂടി 18% പലിശയോടും നിയമപ്രകാരമുള്ള തറവാടകയോടും കൂടി അടയ്ക്കുവാൻ അനുവാദം തരുന്നതും ആണ്. അതിനുശേഷം ബാക്കി സംഖ്യ അടയ്ക്കുവാനുള്ള കാലാവധി യാതൊരു കാരണവശാലും നീട്ടികൊടുക്കുന്നതല്ല. ലേലത്തുക ഈ കാലാവധിയ്ക്കുള്ളിൽ അടയ്ക്കാതിരുന്നാൽ ലേലം റദ്ദ്10th JAN. 2012] FOREST DEPARTMENT 54 ചെയ്യുന്നതും ലേലക്കാരൻ അടച്ചിട്ടുള്ള മുഴുവൻ തുകയും സർക്കാരിലേക്ക് മുതൽകൂട്ടുന്നതും ലേലം ചെയ്ത സാധനങ്ങൾ അയാളുടെ ന„ോത്തര വാദിത്വത്തിൽ വീ≠ും ലേലം ചെയ്ത് വിൽക്കുന്നതും ആയിരിക്കും. അപ്രകാരം ലേലം ചെയ്യുമ്പോൾ ഉ≠ാകുന്ന നഷ്ടം നിലവിലുള്ള വ്യവസ്ഥകൾക്ക് വിധേയമായി നികുതി കുടിശ്ശിക വസൂൽ ചെയ്യുന്ന നിയമങ്ങൾ അനുസരിച്ച് മുൻ ലേലക്കാരനിൽ നിന്നും ഈടാക്കുന്നതും ലാഭകരമായിരുന്നാൽ ആയതിന് മുൻ ലേലക്കാരന് യാതൊരു അവകാശവും ഇല്ലാത്തതുമാകുന്നു. ലേല വ്യവസ്ഥകൾക്ക് ഏതെങ്കിലും മാറ്റങ്ങളോ കൂട്ടി ചേർക്കലോ ആവശ്യമായി വരുന്നപക്ഷം ആയത് ലേലസമയത്ത് വിശദീകരിക്കുന്നതായിരിക്കും. കൂടാൽ വിവരങ്ങൾക്ക് അതാത് റെയ്ഞ്ച് ഓഫീസുകളിൽ അന്വേഷിക്കേ≠താണ്.

7. കോടതിയുടെ അനുമതി വാങ്ങിയശേഷം ലേലം ചെയ്ത് വിൽക്കുന്ന സാധനങ്ങളുടെ മുഴുവൻ തുകയും വിലയും മറ്റ് നികുതികളും ലേല ദിവസം തന്നെ അടയ്ക്കേ≠താണ്.

8. വനംവകുപ്പിൽ നിലവിലുള്ള ലേല വ്യവസ്ഥകൾ ഈ ലേലത്തിനും ബാധകമായിരിക്കും.

Sealed competitive tenders superscribing the name of the work is invited by the undersigned for and on behalf of the Governor of Kerala from the 'A' class Registered contractors for the following work at the risk and loss of the previous contractor who was the successful bidder of tender dated 15-12-2010 as per tender notification dated 9-11-2010.

Name of work—Construction of Boundary wall for boundary consolidation and preventing entry of Animals at Chokkad Tribal Colony in Kalikavu Range under Nilambur South Division.

Approximate Estimate Amount—` 75 lakh.

EMD—` 50,000.

Cost of tender forms—` 11,300 + VAT.

Period of work—3 months.

Tender forms and other connected conditions can be obtained from the office of the undersigned on application in writing and on payment of the cost of the tender form either in cash or in Money Order (not refundable) upto 1 p. m. on 25-1-2012 and will be received on the same day upto 3 p. m. The tenders will be opened by the undersigned or the person authorised on the same day at 3.30 p. m. in the presence of the tenderers attending that time. In case due to some other reasons the proposed tenders of any work is not materialised on the scheduled date on 25-1-2012, such tender will be accepted at the same time on 2-2-2012 such tender will be opened at 3.30 p. m. on the same day. If the due date happens to be a holiday, the tender form will be received on 7-2-2012 at the same time.

Tender forms are not transferable. The EMD for the work should be paid along with the tender form by Demand Draft (cheque will not be acceptable) drawn in favour of the undersigned payable at any Nationalised Bank at Nilambur. Incomplete tender or tender without EMD and preliminary agreement are liable to be rejected. The undersigned reserves the right to reject any tender without arraying any reasons and changes the estimate amount marginally thereof. All the conditions prevailing in the Kerala PWD tenders are applicable to this tender also.

കേരള ഗവർണ്ണർക്കുവേ≠ി നിലമ്പൂർ സൗത്ത് ഡിവിഷ ണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ കാര്യാലയത്തിൽ 9-11-2010- ാം തീയതിയിലെ ഡി-5173/10-ാം നമ്പർ ദർഘാസ് പ്രകാരം 15-12-2010 തീയതിയിൽ നടത്തിയ ടെ≠ർ ലഭിച്ച കരാറുകാരൻ നി›ിത തീയതിക്കകം കരാർ ഒപ്പുവെയ്ക്കാതിരുന്നതിനാൽ ടി കരാറുകാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ താഴെ പറയുന്ന പ്രവൃത്തി ചെയ്യുന്നതിന് താഴെ കാണിച്ച തീയതിയിൽ പകൽ 3 മണിവരെ കേരള പൊതുമരാമത്ത് വകുപ്പിൽ രജിസ്റ്റർ ചെയ്തി ട്ടുള്ള "എ" ക്ളാസ്സ് കരാറുകാരിൽനിന്നും മത്സരസ്വഭാവമുള്ള ദർഘാസുകൾ ക്ഷണിച്ചുകൊള്ളുന്നു. ദർഘാസുകൾ പ്രവർത്തി യുടെ പേര് ആലേഖനം ചെയ്തിട്ടുള്ള മുദ്രവച്ച കവറുകളിൽ സമർപ്പിക്കേ≠താണ്. ദർഘാസ് ഫോറങ്ങൾ ഗസറ്റിൽ പരസ്യം ചെയ്ത തീയതി മുതൽ എല്ലാ പ്രവർത്തി ദിവസങ്ങ ളിലും 25-1-2012-ന് 1 മണിവരെയും ഈ ഓഫീസിൽ നിന്നും ലഭിക്കുന്നതും 3 മണിവരെ സ്വീകരിക്കുന്നതും 3.30 മണിക്ക് അപ്പോൾ ഹാജരുള്ള കരാറുകാരുടെ സാന്നിദ്ധ്യത്തിൽ തുറക്കുന്നതുമായിരിക്കും.

പ്രവർത്തിയുടെ പേര്—കാളികാവ് റെയിഞ്ചിനു കീഴിലെ ചോക്കാട് ഗിരിജൻ കോളനിയിൽ ബൗ≠റി/എലിഫന്റ ് പ്രൊട്ടക്ഷൻവാൾ നിർമ്മാണം.

ഉദ്ദേശ അടങ്കൽ തുക—` 75 ലക്ഷം.

ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനും നിരാകരിക്കുന്ന തിനുമുള്ള അധികാരം നിലമ്പൂർ സൗത്ത് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറിൽ നിക്ഷിപ്തമായിരിക്കും. ഏതെങ്കിലും കാരണവശാൽ നി›യിച്ച തീയതിയിൽ ദർഘാസുകൾ നടക്കാതെ വന്നാൽ 2-2-2012-ാം തീയതി അതേ സമയത്ത് നടക്കുന്നതാണ്. മുകളിൽ പറഞ്ഞിരിക്കുന്ന തീയതിയിൽ ടെ≠ർ നടക്കാതെ വരികയോ പൊതു അവധി പ്രഖ്യാപിക്കുകയോ ആണെങ്കിൽ 7-2-2012, 3 മണിവരെ ടെ≠ർ സ്വീകരിക്കുന്നതും 3.30 മണിക്ക് ടെ≠ർ തുറക്കുന്നതുമായിരിക്കും.

[ISSUED AS PER SECTION 61 (B) OF THE KERALA FOREST ACT 1961] No. W4-2263/2011. 12th December 2011.

Ref:—1. This office Show Cause Notice No. W4-2263/04 dated 5-11-2004, 23-2-2005, 6-5-2005.

2. OR.7/04 of Muthanga Range.

A TATA Mini Lorry bearing Registration No. KA-19-1913 was seized by excise staff of Muthanga Excise checkpost in connection with the illegal transport of 340 Kg. Sandal chips on 14-5-2004. The vehicle 340 Kg. sandal chips with three accused were produced before the Assistant Wildlife Warden, Muthanga by the excise staff. The Assistant Wildlife Warden, Muthanga was registered a cause in connection with illegal transport of sandal chips as OR.7/04. As per the investigation report of the Assistant Wildlife Warden, Muthanga, the vehicle KA-19-1913 was used for illegal transport of 340 Kg. sandal chips which was collected from Karnataka Forest. The Assistant Wildlife Warden, Muthanga has recommended to confiscate the vehicle and thondy as per Section 61 (A) of the Kerala Forest Act.

Show cause notices were issued as per reference cited to the RC owner of the vehicle KA-19-1913 TATA Mini Lorry. But nobody has approached before the authorized officer.

ടി അന്വേഷണ റിപ്പോർട്ട് പ്രകാരം മേൽ പറഞ്ഞ KA-19-1913 റ്റാറ്റാ മിനി ലോറി അനധികൃതമായി കർണ്ണാടക സംസ്ഥാനത്ത് നിന്നും ശേഖരിച്ച 340 കി. ഗ്രാം ചന്ദനചീളുകൾ കടത്തിക്കൊ≠ുവരാൻ ഉപയോഗിച്ചു എന്നും ആയതിനാൽ 61 (എ) വകുപ്പ് പ്രകാരം വാഹനവും തൊ≠ി മുതലുകളും സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതിന് ശുപാർശ ചെയ്യുകയും ചെയ്തിട്ടു≠്. ടി വാഹനവും തൊ≠ി മുതലുകളും സർക്കാരി ലേക്ക് ക≠ുകെട്ടാതിരിക്കാൻ കാരണമു≠െങ്കിൽ ആയത് ബോധിപ്പിക്കാൻ സൂചന പ്രകാരം വാഹനത്തിന്റെ ഉടമസ്ഥനായ ശ്രീ. ജെ. ഇസ്മായിൽ s/o. അറബിക്കുഞ്ഞിന് കാരണം കാണിക്കൽ നോട്ടീസ് അയച്ചിരുന്നു. എന്നാൽ ടിയാൻ ഓതറൈസ്ഡ് ഓഫീസറായ വൈൽഡ് ലൈഫ് വാർഡന്റെ മുമ്പാകെ ഹാജരായിട്ടില്ല.

മേൽ സാഹചര്യത്തിൽ KA-19-1913 റ്റാറ്റാ മിനി ലോറിയും 340 കി. ഗ്രാം ചന്ദനവും അനുബന്ധ സാമഗ്രികളും 1961-ലെ വന നിയമം 61 (എ) വകുപ്പ് പ്രകാരം സർക്കാരി ലേക്ക് ക≠ുകെട്ടുന്നതിനെതിരെ വാഹന ഉടമയ്ക്ക് എന്തെങ്കിലും ബോധിപ്പിക്കാനു≠െങ്കിൽ ആയത് ബോധിപ്പിക്കു ന്നതിനും ആധികാരിക രേഖകൾ എന്തെങ്കിലും ഹാജരാക്കാനു≠െങ്കിൽ ഹാജരാക്കുന്നതിനും ഈ പരസ്യ തീയതി മുതൽ 15 ദിവസത്തിനകം ഓതറൈസ്ഡ് ഓഫീസറും വയനാട് വൈൽഡ് ലൈഫ് വാർഡനുമായ എന്റെ മുമ്പാകെ നേരിൽ ഹാജരാകേ≠താണ്.

ടി കാര്യത്തിൽ വീഴ്ച വരുത്തുന്നപക്ഷം KA-19-1913 റ്റാറ്റാ മിനി ലോറി ഉടമയ്ക്ക് ഒന്നും ബോധിപ്പിക്കാനില്ല എന്ന നിഗമനത്തിൽ വാഹനവും തൊ≠ി മുതലുകളും ക≠ുകെട്ടി സർക്കാരിലേക്ക് മുതൽ കൂട്ടുന്നതായിരിക്കും എന്ന് ഇതിനാൽ അറിയിക്കുന്നു.

4. ദർഘാസിന്റെ കവറിനു പുറത്ത് വാഹനത്തിന്റെ രജിസ്റ്റർ നമ്പരും 'വാഹനത്തിനുള്ള ദർഘാസ്' എന്നും ദർഘാസ് നൽകുന്ന ആളുടെ പൂർണ്ണമായ പേരും മേൽവിലാസവും ഫോൺ നമ്പരും രേഖപ്പെടുത്തി സീൽ ചെയ്ത് സൗത്ത് വയനാട് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് സമർപ്പിക്കേ≠താണ്.

5. ദർഘാസ് സമർപ്പിക്കുന്നവർക്ക് മാത്രമേ ലേലത്തിൽ പങ്കെടുക്കുവാൻ അർഹതയുള്ളൂ.

6. ദർഘാസിന്റെ തുക വിവരം അക്കത്തിലും അക്ഷരത്തിലും തിരുത്തലുകൾ കൂടാതെ വ്യ‡മായി എഴുതിയിരി ക്കണം.

7. ദർഘാസുകൾ സ്വീകരിച്ചശേഷം ദർഘാസുകാരിൽ സ്ഥലത്തുള്ളവരെ മാത്രം ഉൾപ്പെടുത്തി ഓരോ വാഹന ത്തിനും ലേലം നടത്തുന്നതും അതിനുശേഷം ദർഘാസുകൾ തുറക്കുന്നതുമായിരിക്കും. ലേലം/ ദർഘാസുകൾ കൂടുതൽ തുക വാഗ്ദാനം ചെയ്യുന്ന വരുടെ പേരിൽ ദർഘാസ്/ലേല തുക തൃപ്തികര മാണെങ്കിൽ ലേലം/ദർഘാസുകൾ താൽക്കാലികമായി ഉറപ്പിച്ച് അംഗീകാരത്തിനായി മേലധികാരികൾക്ക് ശുപാർശ ചെയ്യുന്നതാണ്. സ്വീകരിക്കാത്ത മറ്റ് ദർഘാസുകാരുടെ നിരതദ്രവ്യം അന്നേ ദിവസം തന്നെ ലേല നടപടികൾക്കുശേഷം തിരികെ നൽകുന്നതാണ്.

8. ദർഘാസ്/ലേല സംഖ്യ ഓരോ വാഹനത്തിനും ` 10,000 (` പതിനായിരം)-മോ അതിൽ കുറവോ ആണെങ്കിൽ നിരതദ്രവ്യ സംഖ്യ കഴിച്ചുള്ള ബാക്കി മുഴുവൻ തുകയും ദർഘാസ് തുറക്കുന്ന ദിവസം ഓഫീസിൽ ഒടുക്കേ≠താണ്. ദർഘാസ്/ലേല സംഖ്യ ` 10,000 (` പതിനായിരം)-ൽ കൂടുതലാണെങ്കിൽ നിരതദ്രവ്യം ഉൾപ്പെടെ ദർഘാസ്/ലേല സംഖ്യയുടെ പകുതി അഥവാ ഏറ്റവും കുറഞ്ഞത് ` 10,000 (` പതിനായിരം) ദർഘാസ്/ലേല ദിവസം തന്നെ ഒടുക്കേ≠തും ബാക്കി തുകയും മറ്റ് നികുതികളും ദർഘാസ്/ലേലം അംഗീകരിച്ചതായി അറിയിപ്പുകിട്ടി 15 ദിവസത്തിനകം സർക്കാരിലേക്ക് ഒടുക്കി വാഹനം ഏറ്റുവാങ്ങേ≠തുമാണ്. ഇപ്രകാരം വാഹനം നീക്കം ചെയ്യുന്നില്ലായെങ്കിൽ ദർഘാസ്/ലേലക്കാരൻ10th JAN. 2012] FOREST DEPARTMENT 57 ആവശ്യപ്പെടുന്നപക്ഷം മറ്റൊരു 15 ദിവസംകൂടി അനുവദിക്കുന്നതാണ്. ഇപ്രകാരം ദീർഘിപ്പിച്ചു നൽകുന്ന കാലത്തേക്ക് 18% പിഴ പലിശയും ദിവസം ` 20 (` ഇരുപത്) ക്രമത്തിൽ തറവാടകയും ഈടാക്കുന്നതായിരിക്കും. ഇതിൽ വീഴ്ചവരുത്തുന്ന പക്ഷം നിരതദ്രവ്യം ഉൾപ്പെടെ അടച്ചിട്ടുള്ള തുക ക≠ു കെട്ടുന്നതും ദർഘാസ്/ലേലക്കാരന്റെ പക്കൽ നിന്നും ഈടാക്കുന്നതും, നിയമ നടപടികൾ സ്വീകരിക്കുന്നതുമാ ണ്. പുനർലേലത്തിൽ ലാഭം ഉ≠ായാൽ ആയതിന് ദർഘാസ്/ലേലക്കാരന് യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല.

9. ഏറ്റവും കൂടിയ തുക വാഗ്ദാനം ചെയ്യുന്ന ദർഘാസ്/ ലേലക്കാരൻ മേൽ പറഞ്ഞവിധം ദർഘാസ് ദിവസം തുക ഒടുക്കുന്നതിന് തയ്യാറാകാതിരുന്നാൽ ടിയാൻ ഒടുക്കിയ നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടി മുതൽകൂട്ടുന്നതും ലേലം/ദർഘാസ് അടുത്ത കൂടുതൽ തുക വാഗ്ദാനം ചെയ്ത ദർഘാസ്/ലേലക്കാരന്റെ പേരിൽ താൽക്കാലികമായി ഉറപ്പിക്കുന്നതുമായിരിക്കും. ഇപ്രകാരം ക≠ുകെട്ടുന്ന തുകയ്ക്ക് വീഴ്ചവരുത്തിയ ദർഘാസുകാരന് യാതൊരുവിധ അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല.

10. ദർഘാസ് സ്വീകരിക്കുന്നതിനും നിരാകരിക്കുന്നതിനും ആവശ്യമെങ്കിൽ കാരണം ബോധിപ്പിക്കാതെ റദ്ദാക്കുന്നതിനുമുള്ള അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമാണ്.

11. വാഹനത്തിന്റെ ആർ. സി. ബുക്ക് ലഭ്യമല്ലാതായാൽ ലേലക്കാർ സ്വന്തം ഉത്തരവാദിത്വത്തിലും ചിലവിലും ഡ്യൂπിക്കേറ്റ് ആർ. സി. ബുക്ക് ലഭ്യമാക്കാൻ നടപടി സ്വീകരിക്കേ≠താണ്.

12. ഏതെങ്കിലും കാരണവശാൽ വിൽപ്പന സ്ഥിരപ്പെടുത്താ തിരുന്നാൽ ദർഘാസ്/ലേലക്കാരൻ ഒടുക്കിയ സംഖ്യ മടക്കിക്കൊടുക്കുന്നതായിരിക്കും.

13. ദർഘാസ്/ലേലം മേലധികാരത്തിലെ അംഗീകാരത്തിന് വിധേയമാണ്.

14. ദർഘാസ്/ലേലം സംബന്ധിച്ച് നിയമാനുസൃതമായ പോസ്റ്റ് ഓഫറുകൾ എന്തെങ്കിലുമു≠െങ്കിൽ ആയത് ദർഘാസ്/ലേല തീയതി മുതൽ ഏഴുദിവസത്തിനകം ഈ ഓഫീസിൽ ഹാജരാക്കേ≠താണ്. നി›ിത തീയതിക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ സ്വീകരിക്കുന്നതല്ല. പോസ്റ്റ് ഓഫറുകൾ നൽകുന്നത് സംബന്ധിച്ച് നിലവിലുള്ള എല്ലാ നിയമങ്ങളും ഇതിനും ബാധകമായിരിക്കും.

15. ദർഘാസ് സംബന്ധിച്ച് ഫോറസ്റ്റ് ഡിപ്പാർട്ട്മെന്റ ിൽ നിലവിലുള്ള പൊതു നിയമങ്ങളും മറ്റ് നിബന്ധനകളും ഈ ദർഘാസ്/ലേലത്തിനും ബാധകമായിരിക്കും.

16. ദർഘാസ്/ലേലത്തിൽ വയ്ക്കുന്ന വാഹനങ്ങളിൽ ഏതെങ്കിലും ഒഴിവാക്കുന്നതിനും പുതിയവ ഉൾപ്പെടുത്തുന്നതിനും മേലധികാരിക്ക് അവകാശമു≠ാ യിരിക്കുന്നതായിരിക്കും.
