NOTIFICATION
No. A5-95489/2011. 10th January 2012.
In exercise of the powers conferred by Article 229 of the Constitution of India, the Honourable the Acting Chief Justice hereby makes the following amendments to the Kerala High Court Service Rules, 2007, namely :
categories 1 and 2 viz. Translator and Translator (Kannada) shall be renumbered as category 2 and 3 respectively.
Amendment (C. S. No. 17)
In the Rules,
I. In Rule 4,
(a) Under Sub Division 4 of Division I, after category 3 Assistant Public Relations Officer and before category 4 Assistant Protocol Officer, "Assistant Protocol Officer (Higher Grade)" shall be inserted as category 4 and the present category 4 Assistant Protocol Officer shall be renumbered as category 5.
(b) Under Sub Division 5 of Division II, before category 1 Translator, "Translator (Higher Grade)" shall be inserted as category 1 and the present (c) Under Sub Division 8 of Division II, before category 1 Senior Grade Chauffeur, "Head Chauffeur" shall be inserted as category 1 and the present categories 1, 2 and 3 viz. Senior Grade Chauffeur, Chauffeur Grade-I and Chauffeur Grade-II shall be renumbered as category 2, 3 and 4 respectively.
(d) Under Sub Division 11 of Division II, before category 1 Telephone Operator, "Telephone Operator (Higher Grade)" shall be inserted as category 1 and the present category 1 Telephone Operator shall be renumbered as category 2.
(e) Under Sub Division 13 of Division II, after category 4 A Plumber/Pump Operator and before category 5 Lift Operator, "Lift Operator (Higher Grade)" shall be inserted as category 5 and the present categories 5 and 6 viz. Lift Operator and Carpenter shall be renumbered as category 6 and 7 respectively.

(a) In Sub Rule 2 of Rule 17, after the words "Assistant Public Relations Officer" and before the words "Assistant Protocol Officer", the words "Assistant Protocol Officer (Higher Grade)" shall be inserted.
(b) In Sub Rule 2 of Rule 17, after the words "Cataloguer" and before the words "Translator", the words "Translator (Higher Grade)" shall be inserted.
III.
(a) In Annexure I, after category 3 Assistant Public Relations Officer under Sub Division 4 of Division 1, the following shall be inserted in columns (1) to (4) and the present category 4 Assistant Protocol Officer shall be renumbered as category 5.

(c) In Annexure I, before category 1 Senior Grade Chauffeur under Sub Division 8 of Division II, the following shall be inserted in columns (1) to (4) and the present categories 1, 2 and 3 viz. Senior Grade Chauffeur, Chauffeur Grade-I and Chauffeur Grade-II shall be renumbered as category 2, 3 and 4 respectively.

(f) In column (4) against the category 1 in Sub Division 4 of Division I in Annexure I, ie. Public Relations Officer, the words "or Assistant Public Relations Officer" shall be inserted after the words "Protocol Officer" and before the words "or Assistant Protocol Officer".
(g) In column (4) against the category 2 in Sub Division 4 of Division I in Annexure I, ie. Protocol Officer, the words "or Assistant Public Relations Officer" shall be inserted after the words "Public Relations Officer" and before the words "or Assistant Protocol Officer".
(h) In column (4) against the category 1 in Sub Division 9 of Division I, in Annexure I, ie. Head Translator, the words "Translator (Higher Grade) or" shall be inserted after the words "or promotion from" and before the words "Translator or Translator (Kannada)".
The above amendments shall come into force, with immediate effect.

തിരുവനന്തപുരം ജില്ലാക്കോടതിയിൽ ഉപയോഗിച്ചു വന്നിരുന്നതും കാലപ്പഴക്കം ചെന്നതുമായ 1995 മോഡൽ KL-7L-6095 നമ്പർ അംബാസിഡർ കാർ 15-2-2012 പകൽ 3 മണിക്ക് ഈ ആഫീസിൽ വച്ച് പരസ്യമായി ലേലം/ ടെ≠ർ വഴി വിൽപ്പന നടത്തുന്നതാണ്.
ലേലത്തിൽ പങ്കെടുക്കുവാൻ താൽപര്യമുള്ളവർ കൃത്യസമയത്ത് ഹാജരാകേ≠തും അന്നേദിവസം പകൽ 1 മണിക്ക് മുമ്പായി താഴെ കാണുന്ന നിരക്കിൽ നിരതദ്രവ്യം ലേലസ്ഥലത്ത് അടച്ച് രസീത് വാങ്ങേ≠തുമാണ്.

` KL-7L-6095 അംബാസിഡർ കാർ 1995 1,500 മേൽപ്പറഞ്ഞ വാഹനത്തിനുവേ≠ി മുൻകൂട്ടി സീൽ ചെയ്ത ടെ≠റുകളും സ്വീകരിക്കുന്നതാണ്. ടെ≠റുകൾ നൽകാൻ ആഗ്രഹിക്കുന്നവർ ആയത് വെള്ളക്കടലാസിൽ എഴുതി ജില്ലാ ജഡ്ജി, ജില്ലാക്കോടതി, തിരുവനന്തപുരം എന്ന് മുദ്രണം ചെയ്ത കവറിൽ 15-2-2012 പകൽ 2 മണിക്ക് മുമ്പായി ടി ആഫീസിൽ ലഭ്യമാക്കേ≠താണ്. ടെ≠റിനോടൊപ്പം മേൽപ്പറഞ്ഞ നിരതദ്രവ്യം ഡിസ്ട്രിക്ട് ജഡ്ജ്, ഡിസ്ട്രിക്ട് കോർട്ട്, തിരുവനന്തപുരം എന്ന പേരിൽ എടുത്ത ഡിമാന്റ ് ഡ്രാഫ്റ്റും ഉ≠ായിരിക്കേ≠താണ്. മേൽപ്പറഞ്ഞ നിരതദ്രവ്യം ഇല്ലാത്ത ടെ≠റുകൾ യാതൊരു കാരണവശാലും സ്വീകരിക്കു ന്നതല്ല. കവറിന്റെ മുകളിൽ വാഹനത്തിന്റെ രജിസ്റ്റർ നമ്പർ രേഖപ്പെടുത്തേ≠താണ്. ടെ≠റുകൾ 15-2-2012 പകൽ 3 മണിക്ക് നടത്തുന്ന പരസ്യലേലത്തിനുശേഷം തദവസരത്തിൽ സന്നിഹിതരായിട്ടുള്ള ടെ≠റുകാരുടെ സാന്നിദ്ധ്യത്തിൽ തുറക്കുന്നതും ലേലത്തിലോ ടെ≠റിലോ കൂടുതൽ തുക കാണിക്കുന്നവർക്ക് ലേലം താൽക്കാലികമായി ഉറപ്പിക്കുന്നതും ടിയാൻ ഉടൻതന്നെ ലേല/ടെ≠ർ തുകയുടെ മൂന്നിലൊന്ന് സംഖ്യ കഴിച്ച് ലേലസ്ഥലത്തുവച്ചുതന്നെ അടയ്ക്കേ≠തും ബാക്കി തുക ലേലം/ടെ≠ർ സ്ഥിരപ്പെടുത്തിയ ഉത്തരവ് കിട്ടി 10 ദിവസത്തിനകം അടച്ച് വാഹനം സ്വന്തം ചെലവിൽ നീക്കം ചെയ്യേ≠തുമാണ്.
മേൽപ്പറഞ്ഞ വാഹനത്തിന്റെ വില്പന നിലവിലുള്ള മൂല്യ വർദ്ധിത നികുതിക്ക് വിധേയമായിരിക്കും. മേൽ പ്രസ്താ വിച്ച നിബന്ധനകൾക്ക് വിപരീതമായി ലേലം/ടെ≠ർ കൊ≠ ആൾ പ്രവൃത്തിക്കുകയാണെങ്കിൽ തുടർന്നുള്ള ലേലക്കാർക്ക് ലേലം ഉറപ്പിക്കുന്നതും അതിന് സാധിക്കാതെ വരുമ്പോൾ ലേലം/ടെ≠ർ ചെയ്ത വാഹനം പുനർലേലം ചെയ്യുന്നതും ആയതിൽ സർക്കാരിന് നഷ്ടം സംഭവിക്കുകയാ ണെങ്കിൽ ആയത് ഏറ്റവും ആദ്യം ലേലം/ടെ≠ർ കൊ≠ ആളിൽനിന്നും ഈടാക്കുന്നതും ടിയാൻ അടച്ച നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതുമാണ്. അഥവാ പുനർലേലത്തിൽ ലാഭമു≠ാകുകയാണെങ്കിൽ ടിയാന് ആയതിൽ യാതൊരുവിധ അർഹതയും ഉ≠ായിരിക്കുന്നതല്ല. ലേലം കഴിഞ്ഞാലുടൻ ലേലം/ടെ≠ർ നഷ്ടപ്പെട്ടവർക്ക് നിരതദ്രവ്യം മടക്കി കൊടുക്കുന്നതാണ്. ടെ≠ർ/ലേലത്തിൽ പങ്കെടുക്കുന്നവർ മേൽ പ്രസ്താവിച്ച നിബന്ധനകൾ പാലിക്കേ≠താണ്. ലേലം ചെയ്യാനുള്ള വാഹനം എല്ലാ പ്രവൃത്തി ദിവസങ്ങളിലും രാവിലെ 10.15 മണി മുതൽ വൈകുന്നേരം 5 മണി വരെയുള്ള സമയങ്ങളിൽ ജില്ലാ ജഡ്ജിയുടെ അനുവാദത്തോടെ ഈ ആഫീസിൽ വന്ന് പരിശോധിക്കാവുന്നതും കൂടുതൽ വിവരങ്ങൾ ശേഖരിക്കാവുന്ന തുമാണ്. 15-2-2012 ഏതെങ്കിലും കാരണവശാൽ അവധിയാവു കയാണെങ്കിൽ തൊട്ടടുത്ത പ്രവൃത്തി ദിവസം മേൽ നിബന്ധനകൾ പ്രകാരം ലേലം നടത്തുന്നതായിരിക്കും. യാതൊരു കാരണവും കൂടാതെ ലേലത്തീയതി മാറ്റുന്നതിനും ലേലം നിർത്തിവയ്ക്കുന്നതിനും അസ്ഥിരപ്പെടുത്തുന്നതിനുമുള്ള പൂർണ്ണ അധികാരം ജില്ലാ ജഡ്ജിയിൽ നിക്ഷിപ്തമാണ്.

തൊടുപുഴ ചീഫ് ജുഡീഷ്യൽ മജിസ്ട്രേറ്റ് കോടതി യിലെ സി. സി. 695/2005 നമ്പർ കേസ് (ക്രൈം 447/2005, തൊടുപുഴ പോലീസ് സ്റ്റേഷൻ) 27-11-2006-ൽ തീർപ്പാക്കിയി ട്ടുള്ളതാണ്. ടി കേസിൽ ഉൾപ്പെട്ട കെ. എൽ. 6-3891 ബജാജ് ഓട്ടോറിക്ഷ ബന്തവസ്സിലെടുത്ത് തൊടുപുഴ പോലീസ് സ്റ്റേഷൻ പരിസരത്ത് സൂക്ഷിച്ചുവരുന്നതുമാണ്. ടി കോടതിയിലെ 31-8-2011-ലെ ഉത്തരവുപ്രകാരം മേൽപ്പറഞ്ഞ ഓട്ടോറിക്ഷ പോലീസ് സ്റ്റേഷൻ പരിസരത്തുവച്ച് 3-4-2012-ാം തീയതി പകൽ 2 മണിക്ക് പരസ്യമായി ലേലം ചെയ്യുന്നതുമാണ്.
ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ കൃത്യ സമയത്ത് പോലീസ് സ്റ്റേഷൻ പരിസരത്ത് എത്തി ലേലത്തിൽ പങ്കെടുക്കേ≠തും ഏറ്റവും കൂടുതൽ തുകയ്ക്ക് വിളിക്കുന്നയാളിന്റെ പേരിൽ ലേലം സ്ഥിരപ്പെടുത്തുന്നതും ലേലം കൊള്ളുന്നയാൾ അപ്പോൾത്തന്നെ ലേല സംഖ്യയും നിയമാനുസൃത സെയിൽസ് ടാക്സും അധികാരികളെ ഏൽപ്പിച്ച് ടി വാഹനം ഏറ്റുവാങ്ങേ≠തുമാണ്.
ലേലം സ്ഥിരപ്പെടുത്തുന്നതിനും അസ്ഥിരപ്പെടുത്തു ന്നതിനും ഉള്ള പൂർണ്ണ അധികാരം തൊടുപുഴ ചീഫ് ജുഡീഷ്യൽ മജിസ്ട്രേറ്റിൽ നിക്ഷിപ്തമായിരിക്കും. ലേലം സാധാരണ രീതിയിൽ നടത്തുന്നതും മറ്റ് എല്ലാ സർക്കാർ ലേലങ്ങൾക്കുമുള്ള നിയമങ്ങൾ ഈ ലേലത്തിനും ബാധകമായിരിക്കുന്നതുമാണ്.
