TENDER NOTICE

No. A1- 142/2012. 4th February 2012.

Separate sealed competitive tenders are invited for the following work indicated form C class Registered PWD contractors/authorized firms so as to reach the Office of the Divisional Forest Officer, Timber Sales Division, Thiruvananthapuram before 3 p.m. on 7-3-2012. The tenders received will be opened by the Divisional Forest Officer, Timber Sales Division, Thiruvananthapuram or any other officer authorized by him at 3.30 p.m. in the presence of the tenderers present at the time on the same day in the Office of the Timber Sales Division, Thiruvananthapuram. Tender forms can be purchased from the office of the Divisional Forest Officer, Timber Sales Division, Thiruvananthapuram on any of the working days till 1 p.m. on 7-3-2012. The registered contractors will be supplied with the tender form only on the production of their registration cards. The price of the tender form is non-refundable under any circumstances. Tenders received after the due time and date and not accompanied by proper Earnest Money Deposit will not be entertained. The tenders not containing the prescribed preliminary agreement in Kerala Government Stamp Paper worth ` 100 will be rejected on the next working day on the same time and venue.

If the tender is not conducted on 7-3-2012 the same will be conducted at the same time and venue on 8-3-2012 as per same conditions mentioned above.

All the rules in force in Public Works Department and Kerala Forest Department regarding the tender notification will be applicable to this tender also.

ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ, ടിംബർ സെയിൽസ് ഡിവിഷൻ തിരുവനന്തപുരം താഴെ പറയുന്ന ജോലിക്ക് കേരള പൊതുമരാമത്ത് വകുപ്പിൽ രജിസ്റ്റർ ചെയ്തിട്ടുള്ളതും, സി. ക്ളാസ്സ് അംഗീകൃത കരാറുകാർ/അംഗീകൃത സ്ഥാപനങ്ങൾ എന്നിവരിൽ നിന്നും മത്സരസ്വഭാവമുള്ള ദർഘാസുകൾ ക്ഷണിച്ചുകൊള്ളുന്നു. മുദ്രവച്ച ദർഘാസുകൾ 7-3-2012-ാം തീയതി 3 മണിവരെ സ്വീകരിക്കുന്നതും ദർഘാസുകൾ അന്നേ ദിവസം തന്നെ 3.30 മണിക്ക് തിരുവനന്തപുരം ടിംബർ സെയിൽസ് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റ് ഉദ്യോഗസ്ഥനോ സ്ഥലത്ത് ഹാജരുള്ള കരാറുകാരുടെ സാന്നിദ്ധ്യത്തിൽ തുറക്കുന്നതുമാണ്. ദർഘാസ് ഫോറങ്ങൾ 7-3-2012-ന് പകൽ 1 മണിവരെ തിരുവനന്തപുരം ടിംബർ സെയിൽസ് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽ നിന്നും ഓഫീസ് പ്രവർത്തി ദിവസങ്ങളിൽ ലഭിക്കുന്നതാണ്.

അംഗീകൃത കരാറുകാർ/അംഗീകൃത സ്ഥാപനങ്ങൾ അവരുടെ രജിസ്ട്രേഷൻ കാർഡ് കാണിച്ചാൽ മാത്രമേ ദർഘാസ് ഫോറങ്ങൾ ലഭിക്കുകയുള്ളു. ദർഘാസ് ഫോറത്തിന്റെ വില യാതൊരു കാരണവശാലും തിരികെ കൊടുക്കുന്നതല്ല.

ദർഘാസ് ഫോറങ്ങൾ കൈമാറുവാനും പാടുള്ളതല്ല. നി›ിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ദർഘാസുകൾ നിരസിക്കു ന്നതാണ്. ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനുള്ള അവസാന തീയതി ഒരു പൊതു അവധി ആയാൽ അടുത്ത പ്രവർത്തി ദിവസം അതേ സമയം വരെ സ്വീകരിക്കുന്നതും അന്നേദിവസം തന്നെ തുറക്കുന്നതുമാണ്. ഏതെങ്കിലും കാരണവശാൽ ദർഘാസ് 7-3-2012-ന് നടക്കാതിരുന്നാൽ ടി ദർഘാസുകൾ 8-3-2012-ന് നി›ിത സ്ഥലത്തും സമയത്തും നടത്തുന്നതാണ്.

പ്രവൃത്തിയുടെ പേരും ഏകദേശ അടങ്കൽ തുകയും— തിരുവനന്തപുരം ടിംബർ സെയിൽസ് ഡിവിഷൻ ഓഫീസ് നവീകരണം— ` 3,30,000.

നിരതദ്രവ്യം— ` 10,000.

ദർഘാസ് ഫോറത്തിന്റെ വില—` 800 + വാറ്റ്+സെസ്സ്.

കാലാവധി—20 ദിവസം.

കേരള പൊതുമരാമത്ത് വകുപ്പിന്റെയും കേരള വനം വകുപ്പിന്റെയും നിലവിലുള്ള ദർഘാസുകളെ സംബന്ധിച്ച എല്ലാ നിബന്ധനകളും മേൽക്കാണിച്ച ജോലിക്ക് ബാധക മായിരിക്കും. ദർഘാസിനോടൊപ്പം ` 100-ന്റെ മുദ്രപത്രത്തിൽ ഒപ്പുവച്ച ഒരു പ്രാഥമിക ഉടമ്പടിയും ഉള്ളടക്കം ചെയ്യേ≠താണ്.

ഏതെങ്കിലും കാരണവശാൽ മേൽ കാണിച്ച ജോലി ടെ≠റിൽ ്നിന്നും ഒഴിവാക്കുവാൻ ടിംബർ സെയിൽസ് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അധികാരമു≠ായിരിക്കുന്നതാണ്.

(പി) 84/97/പി & റ്റി വ്യവസ്ഥകൾ ഉൾപ്പെടെ പൊതുമരാമത്ത് വകുപ്പിലെ ദർഘാസിനെ സംബന്ധിച്ച എല്ലാ വ്യവസ്ഥകളും ഈ ദർഘാസിനും ബാധകമായിരിക്കും. വൈദ്യുത കമ്പിവേലികൾ സ്ഥാപിക്കുന്നതു സംബന്ധിച്ച് പ്രിൻസിപ്പൽ ചീഫ് കൺസർവേറ്റർ, തിരുവനന്തപുരത്തിന്റെ 27-10-2009-ലെ 4/2009 നമ്പർ പ്രകാരമുള്ള സർക്കുലറിലെ താഴെ പറയുന്ന നിബന്ധനകൾ നിർബന്ധമായും ടെ≠റിൽ പങ്കെടുക്കുന്ന കരാറുകാരൻ/ഏജൻസി/സ്ഥാപനങ്ങൾ പാലിക്കേ≠താകുന്നു. 19-8-1997-ലെ കേരള സർക്കാർ ഉത്തരവ് നമ്പർ ജി.ഒ.(പി) 84/97/പി & റ്റി വ്യവസ്ഥകൾ ഉൾപ്പെടെ പൊതുമരാമത്ത് വകുപ്പിലെ ദർഘാസിനെ സംബന്ധിച്ച എല്ലാ വ്യവസ്ഥകളും ഈ ദർഘാസിനും ബാധകമായിരിക്കും.

നിബന്ധനകൾ

1. വൈദ്യുത കമ്പിവേലികൾ സ്ഥാപിക്കുന്ന ജോലി ഈ രംഗത്ത് പരിചയമുള്ള കരാറുകാർ/ഏജൻസി/സ്ഥാപനം മുഖേന ചെയ്യേ≠തിനാൽ തൃപ്തികരമായ രീതിയിൽ ജോലി ചെയ്തു കൊടുത്തിട്ടു≠െന്ന് തെളിയിക്കുന്നതിന് ജോലി ചെയ്തുകൊടുത്ത സ്ഥാപനത്തിന്റെ/സ്ഥാപ നങ്ങളുടെ ജില്ലാ മേലധികാരി/മേലധികാരികളിൽ നിന്നും ലഭിച്ച പരിചയ സർട്ടിഫിക്കറ്റുകളും/സർട്ടിഫിക്കറ്റുകളുടെ സാക്ഷ്യപ്പെടുത്തിയ പകർപ്പുകളും ടെ≠റിനോടൊപ്പം സമർപ്പിക്കേ≠താണ്.

2. കമ്പിവേലി സ്ഥാപിക്കുന്നതിനും അറ്റകുറ്റപ്പണികൾ ചെയ്യുന്നതിനും ഏറ്റവും ഗുണനിലവാരമുള്ള ഉപകരണങ്ങൾ മാത്രം ഉപയോഗിക്കേ≠താണ്. ഉപകരണങ്ങൾ ബാംഗ്ളൂർ ആസ്ഥാനമായ പവർ റിസർച്ച് ഇൻസ്റ്റിറ്റ്യൂട്ടിന്റെയോ ഡി. ജി. എസ്. ആന്റ ് ഡി.യുടെയോ ഗുണമേ∑ാ സർട്ടിഫിക്കറ്റ് ഉള്ളവരായിരിക്കണം.

3. ടെ≠റിനോടൊപ്പം സ്റ്റെയിൻ ഇൻസുലേറ്റർ, പോളി കാർബൺ, റീൽ ഇൻസുലേറ്റർ, പോളിപ്രൊപ്പലൈൻ, വയർ ടൈറ്റ്നർ, ജോയിന്റ ് ക്ലാമ്പ്, ലീഡ് ഒൗട്ട് കേബിൾ, 12 എസ്. ജി. ഡബ്ള്യൂ. ഹൈ ടെൻസിൽ വയർ, 14 എസ്. ജി. ഡബ്ള്യൂ. വൈൻഡിംഗ് വയർ എന്നിവയുടെ സാമ്പിളുകൾ മുദ്രവച്ചതും കരാറുകാരന്റെ പേരുവിവരം രേഖപ്പെടുത്തിയതുമായ കവറിൽ സമർപ്പിക്കേ≠താണ്.

4. എനർജൈസറിൽ പതിപ്പിച്ചിട്ടുള്ള വാറ≠ി/ഗ്യാര≠ി സീൽ നശിപ്പിക്കുകയോ ഇളക്കി മാറ്റുകയോ കേടുവരുത്തുകയോ ചെയ്യരുത്. വാറ≠ി/ഗ്യാര≠ി കാലയളവ് രേഖാമൂലം ടെ≠ർ സമയത്ത് സമർപ്പിക്കുകയും ചെയ്യേ≠താണ്.

5. വൈദ്യുത കമ്പിവേലിക്ക് ആവശ്യമുള്ളത്ര വലിവ് എപ്പോഴും നിലനിർത്തേ≠തും എന്നാൽ അമിത വലിവ് ഉ≠ാകാത്ത വിധത്തിലുമാണ് വേലി സ്ഥാപിക്കേ≠ത്.

6. എ. സി. മെയിൻ വൈദ്യുത കമ്പിവേലിയുമായോ എനർജൈസറുമായോ ഒരു കാരണവശാലും തൊടരുത്.

7. മെയിന്റനൻസ്/എ.എം.സി. കാലാവധിക്കുള്ളിൽ ബാറ്ററി/ എനർജൈസർ/സോളാർ പാനൽ/ക്യാബിൻ സെറ്റ് എന്നിവയ്ക്കു ≠ാകുന്ന പോരായ്മകൾ പരിഹരിക്കുന്നതിനായി ആവശ്യമായ സാങ്കേതിക സേവനങ്ങൾ കരാറുകാരൻ/ ഏജൻസി/സ്ഥാപനം ചെയ്തുകൊടുക്കേ≠താണ്.

8. വലിയ കാറ്റോ ഇടിമിന്നലോ ഉ≠ാകുമ്പോൾ വൈദ്യുത ബന്ധം താൽക്കാലികമായി വിടുവാനുള്ള ലൈറ്റനിംഗ് അറസ്റ്റർ ഘടിപ്പിച്ചിരിക്കേ≠താണ്.

9. ചാർ÷റിൽനിന്നോ സോളാർ പാനലിൽനിന്നോ എനർജൈസറിലേക്ക് നേരിട്ട് വൈദ്യുതി കടത്തിവിട്ടു കൊ≠് വേലി സ്ഥാപിക്കരുത്.

The tender forms are not transferable. The Earnest Money Deposit noted above should be paid along with the tenders by Demand Draft (Cheque will not be acceptable) pledged in favour of the undersigned payable at any Nationalized Bank/Scheduled Bank. Incomplete tenders and tenders without EMD are liable to be rejected. The undersigned reserves the right to reject any tender without assigning any reasons thereof. Tenders are hereby invited from reputed firms to set up, manage and operate automated online and offline ticket reservation system for boating in Periyar Tiger Reserve.

The bidders should handle the payment gateway and manage call center (s) for help and grievance redressal. The interested parties should be willing to invest the cost on build and operate basis and quote a service charge over the online transactions set aside for the online booking for the boat services operated by Periyar Tiger Reserve.

Interested reputed firms and software/hardware suppliers who agree to the following terms and conditions may quote the rate of transaction fees for online booking.

1. The firm shall provide advance online booking facility for the Periyar Tiger Reserve Management through the website www.periyarfoundation.com. The firm shall conduct proper system study, assess the HW, SW requirements and develop solutions for the services as below. The offline booking at different locations at Thekkady shall be integrated with online booking to provide a total ticketing solution for all the Community Based Eco Tourism (CBET) Programmes.

2. The advance online booking facility will be provided for one third of the seating capacity of the boat operating for the tourists in the Periyar Lake owned by Kerala Forest Department. The firm shall agree to change the percentage of seat allocation for advance online booking, number of trips and number of boats, as decided and implemented from time to time by Periyar Tiger Reserve.

7. The firm shall operationalize the advance online booking within two months from the date of the agreement. The hardware will be transferred to the Periyar Tiger Reserve Management after the initial period of operation of 5 years.

8. The quoted transaction cost/service charges by the firm for the advance online booking is exclusively for the tickets sold through online booking only and not for the tickets sold offline or retail through the authorized departmental booking centers.

9. The Firm shall remit a security deposit of Rs. One lakh as demand draft or cash with the Periyar Tiger Reserve Management.

10. The firm shall develop the required software for booking the tickets for the customers and the total cost will be facilitated to be paid through cards and the amount will be debited to specified accounts of Periyar Tiger Reserve within 48 hours of the transaction.

11. The agreement will be renewed every year with or without changes on the basis of the circumstances. The transfer of ownership of hardware and software developed by them to the Periyar Tiger Reserve will apply after fifth year.

12. In case any cancellation of the tickets sold online, the amount will be remitted back to the customers following the cancellation policies to be jointly finalized by the firm and the PTR management.

13. The firm shall also quote special conditions if any.

14. All software used shall be legal and the department shall not be liable for any breach. The firm shall be responsible for license and validity of all the software used during the period of agreement.

15. In case of disputes, the decision of Chief Wildlife Warden shall be final and binding on the firm.

The agreed terms for the above said services, accepted technical specification for the hardware and software and the amount of transaction cost as service charges over the online transactions set aside for the online booking for the boats services operated by the Periyar Tiger Reserve Management is expected to be submitted along with the quote. The firm is also expected to submit the transaction cost for the cancellation separately along with the original quote for the online booking.

The services should be provided within 60 days from the date of executing the agreement. The tender should be submitted to the undersigned in sealed cover superscripted as tender for online tickets on or before 3 p.m. of 10-3-2012. If the tender on this date could not be conducted then the next date of quotation will be on 15-3-2012 and 20-3-2012 and the above said quotation should reach before 3 p. m. of 10-3-2012.

എഗ്രിമെന്റ ് ഒപ്പുവെച്ച് 60 ദിവസത്തിനുള്ളിൽ ടി ജോലികൾ പ്രകാരമുള്ള മെഷീനറികൾ സ്ഥാപിക്കേ≠താണ്. ഇതിനായുള്ള ടെ≠ർ ഫോറങ്ങൾ 10-3-2012 ഒരു മണിവരെ ഡെപ്യൂട്ടി ഡയറക്ടർ (പ്രോജക്ട് ടൈഗർ), പെരിയാർ ഈസ്റ്റ് ഡിവിഷൻ, തേക്കടിയുടെ കാര്യാലയത്തിൽ നിന്നും ലഭ്യമായിരിക്കും. ടെ≠ർ ഫോറത്തിന്റെ വില ` 2,500 + വാറ്റ് ആകുന്നു. ടെ≠റുകൾ മുദ്രവച്ച കവറിലാക്കി ബോട്ടിംഗിനുള്ള ഓൺലൈൻ സംവിധാനത്തിനുള്ള ടെ≠ർ എന്ന ശീർഷകം രേഖപ്പെടുത്തി 10-3-2012 ഉച്ചകഴിഞ്ഞ് 3 മണിക്ക് മുമ്പായി ഈ ഓഫീസിൽ സമർപ്പിക്കേ≠താണ്. ലഭ്യമായ ടെ≠റുകൾ അന്നേ ദിവസം 3.30-ന് പരസ്യമായി ടെ≠ർ സമർപ്പിച്ചവരുടെ സാന്നിദ്ധ്യത്തിൽ തുറക്കുന്നതായിരിക്കും. ഏതെങ്കിലും കാരണ വശാൽ അന്നേദിവസം ടെ≠ർ നടക്കാതെ വരുന്ന പക്ഷം 15-3-2012-നോ അന്നും നടക്കാതെ വരികിൽ 20-3-2012-ന് മേൽപ്പറഞ്ഞ സ്ഥലത്തും സമയത്തും ടെ≠ർ നടത്തുന്ന തായിരിക്കും. കാരണം ബോധ്യപ്പെടുത്താതെ ടെ≠ർ നിരസിക്കാനുള്ള അധികാരം ഡെപ്യൂട്ടി ഡയറക്ടർ (പ്രോജക്ട് ടൈഗർ), പെരിയാർ ഈസ്റ്റ് ഡിവിഷൻ, തേക്കടിയിൽ നിക്ഷിപ്തമായിരിക്കുന്നതാണ്.

Tenders are hereby invited from reputed firms to set up, manage and operate automated online and offline ticket reservation system for Eco Tourism programmes in Periyar Tiger Reserve.

The bidders should handle the payment gateway and manage call center (s) for help and grievance redressal. The interested parties should be willing to invest the cost on build and operate basis and quote a service charge over the online transactions set aside for the online booking for the Eco Tourism packages operated by Periyar Foundation.

Interested reputed firms and software/hardware suppliers who agree to the following terms and conditions may quote the rate of transaction fees for online booking.

1. The Firm shall provide advance online booking facility for the Periyar Foundation Management through the website www.periyarfoundation.com. The firm shall conduct proper system study, assess the HW, SW requirements and develop solutions for the services as below. The offline booking at different locations at Thekkady shall be integrated with online booking to provide a total ticketing solution for all the Community Based Eco Tourism (CBET) Programmes.

2. The details of various Eco Tourism programmes, number of visitors and the anticipated quantum of online booking and the percentage split up for online/offline bookings is available at the office of the Deputy Director, Periyar East Division, Periyar Tiger Reserve during office hours on all working days. The allocation for advance online booking may change and the firm shall agree to implement the changes within a week of intimation.

3. The Firm could have tie up/agreement with any authorized online payment gateway service providers with good track record. The Periyar Management will not be responsible for any disputes related to such tying up (the payment gateway service provider for providing the online payment gateway).

4. The Firm shall develop and maintain the software for the advance online booking and will integrate it in the Periyar Foundation website: www.periyarfoundation.com.

5. The system shall be on build and operate basis.

6. The Firm shall install and place necessary hardware at the site/sites at Thekkady or any other site as suggested by Periyar Management. The firm shall develop suitable software/programmes and maintain the services.

7. The hardwares are expected to be installed at the following locations as below:

1. Towers (As per the requirement—area need to cover upto 7 to 10 Km. Radius with the support of Wi Fi/Gprs/3g) in and around Ecotourism programme area at Thekady

2. RFID Readers—Numbers as required

3. Server (A high end server with original OS )—

1 No. (Centrally at Thekkady)

4. RFID Enabled Wrist Band—100 Nos.

5. PC—5 Numbers

6. Touch Screen Kiosk (information display)—

6 Numbers

Entrance counter—2 Numbers

Information /Booking centres—2 Numbers Boat landing—2 Numbers

8. The firm shall operationalize the booking within two months from the date of the agreement. The hardware will be transferred to the Periyar Management after the initial period of operation of 5 years.

9. The quoted transaction cost/service charges by the firm for the advance online booking is exclusively for the tickets sold through online booking only and not for the tickets sold offline or retail through the authorized departmental booking centers.

10. The Firm shall remit a security deposit of ` Fifty thousand only as demand draft or cash with the Periyar Management.

11. The firm shall develop the required software for booking the tickets for the customers and the total cost will be facilitated to be paid through cards and the amount will be debited to specified accounts of Periyar Tiger Reserve Managment within 48 hours of the transaction.

12. The agreement will be renewed every year with or without changes on the basis of the circumstances. The transfer of ownership of hardware and software developed by them to the Periyar Foundation will apply after fifth year.

13. In case any cancellation of tickets sold online the amount will be remitted back to the customers following the cancellation policies to be jointly developed by the firm and PTR Management.

14. The firm shall also quote special conditions if any.

15. All software used shall be legal and the department shall not be liable for any breach. The firm shall be responsible for license and validity of all the software used during the period of agreement.

16. In case of disputes, the decision of Chief Wildlife Warden shall be final and binding on the firm.

The agreed terms for the above said services, accepted technical specification for the hardware and software and the amount of transaction cost as service charges over the online transactions set aside for the online booking for the Eco tourism packages operated by the Periyar Foundation Management is expected to be submitted along with the quote. The firm is also expected to submit the transaction cost for the cancellation separately along with the original quote for the online booking.

The services should be provided within 60 days from the date of executing the agreement. The tender should be submitted to the undersigned in sealed cover superscripted as tender for online tickets on or before 3 p.m. on 10-3-2012. If the tender on this date could not be conducted then the next date of quotation will be on 15-3-2012 and 20-3-2012 and the above said quotation should reach before 3 p. m. on 10-3-2012.

1. Sealed competitive tenders are invited from registered and experienced P.W.D. Contractors for and on behalf of the Governor of Kerala by the Divisional Forest Officer, Palakkad for the execution of the following works shown in the schedule furnished below. Sealed covers superscribing the name of the work will be opened in the presence of the available contractors by the Divisional Forest Officer, Palakkad or any other officer authorized by him at the stipulated place and time as shown below. The tender forms will be supplied to the contractors only on production of their Registration Card, Pan Card and on payment of the cost and VAT of the tender form. The tender form is not transferable and the cost of the tender form is non-refundable under any circumstances.

2. If the tender could not be conducted on the fixed day, due to any circumstances, the same will be conducted on the next working day at the stipulated place and time.

Separate, sealed competitive tenders are invited from the registered contractors in the Forest Department in pursuance of G.O. (Ms.) No. 226/81 Forest dated 16-11-1981 for working down timber and firewood to be collected from the forest areas handed over to Power Grid Corporation of India for the construction of 400KV DC transmission line between Mysore to Kozhikode to Government timber depot mentioned in the schedule. The contractors who have registered in the Forest Department should produce the attested copies of their Registration Certificate and their Identity Card for proving their permanent address. The above work was tendered on 18-6-2009 and 27-12-2011. As the rate quoted by the contractor is much higher and not feasible to afford it Govt. Order has been issued to cancel the tender.

Tender forms will be issued from this office upto 1 p. m. on 14-3-2012 and will be received upto 2.30 p. m. on 14-3-2012. The received tenders will be opened at 3 p. m. on 14-3-2012 by the Divisional Forest Officer, at Divisional Forest Office, South Wayanad Division, Kalpetta or by any other officer duly authorized by him in the presence of the tenderers or their authorized representatives. The tenderer shall fill in the tender forms purchased from this office and submit the same together with all the pages intact and the rate quoted should be uniform for all items. If any item is seen omitted by the tenderer will be treated as defective. Tenders should be addressed in a sealed cover with the name of work clearly written there on to the Divisional Forests Officer, South Wayanad Division.

If the last date fixed for the receipt of the tenders happens to be a holiday the tenders will be received and opened on the next working day at the same time and place in the conditions specified above.

If the tender could not be conducted due to any reasons on the above date tender for the above works will be conducted on 15-3-2012 and 20-3-2012 at the same time and place as stated above.

അളവ്് സ്ഥലം `28th FEB. 2012] FOREST DEPARTMENT 185 sale of timber in Government Timber Depots published in Government Gazette No. 50 dated 16-12-2008 Page No. 481 to 488 of Forest Sheet as per Pro. (5)-7698/08 dated 6-12-2008 of the Chief Conservator of Forests (P), Thiruvananthapuram. In case the notified date happens to be public holiday, the tender cum auction will be conducted on the next working day at the notified place and time. If there is a requirement of re-auction, it will be conducted on 15-3-2012 and 22-3-2012 at 11 a.m. at the same place.

1. The auction will be on lump sum basis for the right of collection and removal of entire Elavu, Matty, Sterculia and other species of tree growth from the above plantations mentioned in the schedule hereto, the area of which has been surveyed and demarked on the ground.

2. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before participating in the Tender cum Auction. Complaints if any, regarding quality and quantity etc. received after the Tender cum Auction will not be entertained.

3. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another person unless valid power of attorney is produced prior to the commencement of Tender cum Auction.

4. A supply contractor of Kannur Division or any adjacent Divisions will not be allowed to bid in the Tender cum Auction.

5. Intending tenderers/bidders should produce a certificate from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.

6. The successful tenderers/bidders should give an undertaking that he is not related with any officer having control over the work and that he is not a supply contractor of this or any adjacent Division. If this is proved otherwise, it shall result in cancellation of the contract and resale of the coupe at his risk and loss.

7. No post offer received after 7 days of the conduct of the Tender cum Auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is ` One Lakh and above and more than 20% where the original bid amount is less than one lakh will ordinarily be considered. The post offerer will comply with following terms.

(a) Offer should be made within 7 days of Tender cum Auction failing to which the offer will not be considered.

(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender cum Auction date.

(c) The remittance should be made by the chalan or bank deposit and the Bank receipt should be produced before the Divisional Forest Officer concerned within 7 days from the date of receipt of registered notice to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the post offerer satisfied the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules. In the re-auction, the price fetched if does not come up to what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest Bidders/ Tenderers in the re-auction and the amount remitted by the post offerer will be released to him.

8. Further particulars about the Tender cum Auction can be had either from the Office of the Divisional Forest Officer or from the Range Officer, Kannavam/ Kottiyoor.

9. Intending tenderers/bidders should deposit an Earnest Money Deposit of ` 10,000 (Rupees ten thousand only) for each plantation/Block for participating in the Tender/Auction.

10. The successful tenderers/bidders have to remit 1/3rd of sale value on the Tender cum Auction date, failure to which may result in the forfeiture of the E.M.D to the Government and the resale of coupe at the risk and loss of the person concerned.

11. The successful tenderers/bidders have only the right for the collection and removal of Matty, Elavu, Sterculia and other softwood trees as mentioned in the Schedule Appended and will have no right over Teak, Rosewood or such other unmarked trees.

12. The successful tenderers/bidders should execute a bounden agreement on a Stamp Paper worth ` 100 after the completion of Tender cum Auction.

13. The confirmation of the Tender cum Auction sale will be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation, the successful tenderers/bidders shall remit the balance 2/3rd of the sale value and 5% Forest Development Tax, VAT and Income Tax at the rates in force and security deposit of 10% for the total sale value. The successful tenderers /bidders should execute an agreement on a stamp paper worth ` 100. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days shall be granted by the Chief Conservator of Forests, Northern Circle, Kannur subject to the realization of 24% penal interest. But all the above extension period will be within the original contract period. Failure to remit any of the above installment even during the extended period will entail cancellation of the contract and forfeiture of all money paid till then and all produce remaining in the coupe. The right thus cancelled will be resold at the risk and loss of the contractor. In calculating interest, 15 days and below will be reckoned as 1/2 month and over 15 days as one month.

14. 1f the successful tenderers /bidders fails to execute the agreement after remitting the amount even during the extended period as per the above condition, entire amount paid till then will be forfeited to the Government and all the produce left unremoved in the coupe will be confiscated to Government after cancelling the Tender cum Auction. The coupe will be re auctioned at the risk and loss of the tenderers/bidders. He will be liable for all the loss sustained to the Government and will have no right over the profit derived out of the re auction of the coupe.

I5. Failure to remit any of the above instalment even during the extended period will entail the cancellation of the contract and forfeiture of all the money paid till then and confiscation of all the produce remaining in the coupe. The right thus cancelled will be resold at the risk and loss of the contractor. The contractor will have no right over the profit derived out of the resale of the coupe.

16. The period of contract will be 60 days from the date of intimation of confirmation. No extension of period of contract shall be granted on ordinary ground. Under special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests, Northern Circle, Kannur and the Additional Principal Chief Conservator of Forests (Region North), Kozhikode concerned may grant extension of time for 15 days, further 15 days and further 15 days respectively on realization of penalty or penalties for completion of each work for each extension mentioned below:

(a) For enumerated trees and balance unfelled per hectare or fraction thereof ` 750 per hectare.

(b) Unremoved registered logs and unregistered logs ` 100/M3 or fraction thereof.

(c) Unremoved firewood ` 50/Tone or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during the original contract period. The penalty for the first 15 days shall be realized at the above rates, double the rate for the second 15 days and three times of the original rate for the third 15 days shall be realized.

If the tenderers/bidders fails to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenderers/bidders as per the agreement will be forfeited to Government and the tenderers/ bidders will not have any right on the produce confiscated to Government. In the above circumstances the balance work to be executed by the tenderers /bidders shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the tenderers/ bidders.

17. The contractor shall be allowed to remove the timber of Mutty, Elave, Sterculia and other species and fire wood from the coupe subject to the law prevailing in the department from time to time.

18. The contractor or his persons shall be allowed to enter in the coupe only after getting the prior permission either from the Divisional Forest Officer, Kannur or from the Forest Range Officer, Kannavam/Kottiyoor.

19. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 Meters and keep the cairns intact.

20. He will be liable for the damages made to other trees in plantations or RF.

21. The successful tenderers /bidders may allow to stack the timber in the forest area outside the coupe at the risk of the tenderers/bidders up to the period of contract. An amount of ` 250 will be charged as a ground rent for the timber unremoved for 1 Ha or fractions thereof.

22. He will be liable for all illegal activities happened 400 Mtr (2 Furlong) surrounding of the coupe. Such incidents, if noticed by contractor, should be informed the officer concerned, otherwise will lead to the cancellation of the contact.

23. The security deposit will be released to the Contractor on production of clearance certificate of VAT, Agricultural Income Tax etc. Any liability outstanding will be set off from the security deposit.

24. If the value fetched in the re-tender/re-auction is less than that obtained in the original Tender cum Auction, the difference between them together with all incidental expenditure to fix up of the resale including notification charges or any other dues or Government loss as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting tenderers/bidders through all legal means including Revenue Recovery Act in force.

25. General condition of the sale of tree growth. Prevailing in the department from time to time shall be applicable to this Tender cum Auction also.

26. Only marked trees shall be felled. No unmarked tree shall be felled or damaged while felling a marked tree.

ദർഘാസ് കം ലേല ദിവസം പൊതു അവധിയായി വന്നാലോ മറ്റേതെങ്കിലും കാരണത്താലോ ദർഘാസ് കം ലേലം നടത്താൻ കഴിയാതെ വന്നാൽ ടി ദർഘാസ് കം ലേലം അടുത്ത പ്രവൃത്തി ദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും വച്ച് നടത്തുന്നതാ യിരിക്കും. പുനർലേലം ആവശ്യമാണെങ്കിൽ 15-3-2012-നും 22-3-2012-നും ഇതേ സ്ഥലത്തും സമയത്തും വച്ച് നടത്തുന്നതാണ്.

1. ദർഘാസ്-കം-ലേലം ഒരു നി›ിത തുകയുടെ അടിസ്ഥാനത്തിലാണ് നി›യിച്ചിരിക്കുന്നത്. ഇതിലേക്കായി സർവ്വെ ചെയ്ത് തിരി ച്ചിട്ടുള്ള പ്രസ്തുത തോട്ടങ്ങളിലെ നിൽപ്പ്, മട്ടി, ഇലവ്, സ്റ്റെർകുലിയ (പോത്തു≠ി) തുടങ്ങിയ പട്ടികയിൽ പരാമർശിച്ച വിവിധ ഇനം മരങ്ങളുടെ ശേഖരണവും നീക്കംചെയ്യലും സംബന്ധിച്ച ജോലിക്ക് വേ≠ിയാണ് ഇത് തീരുമാനിച്ചിരിക്കുന്നത്.

2. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലത്തിന് മുൻപായി ഉൽപ്പന്നങ്ങളുടെ നിൽപ്പ് നേരിൽക≠് ബോദ്ധ്യപ്പെടേ≠തും ഉൽപ്പന്നത്തിന്റെ ഗുണമേൻമ, അളവ് എന്നിവ സംബന്ധിച്ച യാതൊരു പരാതികളും ലേലത്തിന് ശേഷം പരിഗണിക്കുന്നതുമല്ല.

3. ദർഘാസുകാരൻ/ലേലക്കാരൻ നേരിട്ട് ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കേ≠താണ്. നിയമപരമായ പവർ ഓഫ് അറ്റോർണി ഇല്ലാത്ത പകരക്കാരനെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല.

4. കണ്ണൂർ ഡിവിഷനിലെയും മറ്റ് സമീപ ഡിവിഷനുകളിലെയും സപ്ളൈ കോൺട്രാക്ടർമാരെ ടി ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.

5. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കൈയൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽനിന്നും വാങ്ങിയ സർട്ടിഫിക്കറ്റ് നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാ ക്കേ≠താണ്.

6. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ ആഫീസുമായോ ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസ് കം ലേല ദിവസം ദർഘാസുകാരൻ/ലേലക്കാരൻ ഈ ഓഫീസിൽ സമർപ്പിക്കേ≠താണ്. ഇത്തരത്തിൽ ദർഘാസുകാരൻ/ലേലക്കാരൻ ബന്ധപ്പെട്ട ആഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാന്റെ പേരിലുള്ള ദർഘാസ് കം ലേലം റദ്ദ് ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പുകൾ പുനർ ലേലം ചെയ്യുന്നതാണ്.

7. ദർഘാസ് കം ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുള്ള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരുലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽപ്പെട്ട ലേലങ്ങൾക്ക് 20 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകൾ മാത്രമേ പരിഗണിക്കുകയുള്ളൂ. കൂടാതെ താഴെ പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമാണ്.

(1) ദർഘാസ് കം ലേലത്തിന് 7 ദിവസത്തിനുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.

(2) പോസ്റ്റ് ഓഫറുകാരൻ യഥാർ∞ ദർഘാസുകാരൻ/ലേലക്കാരൻ ഒടുക്കിയ തുകയുടെ ഇരട്ടി തുക അടയ്ക്കേ≠താണ്.

(3) ബന്ധപ്പെട്ട പോസ്റ്റ് ഓഫർ തുകയും മറ്റു നികുതികളും ചെലാൻ മുഖാന്തിരമോ ബാങ്ക് രസീത് വഴിയോ ഈ ആഫീസിൽനിന്നും രജിസ്റ്റേർഡ് തപാൽ മുഖേന അറിയിച്ച് ഏഴു ദിവസത്തിനുള്ളിൽ ഒടുക്കി ഈ ആഫീസിൽ ഹാജ രാക്കേ ≠താണ്. പോസ്റ്റ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ കൂപ്പുകളുടെയും അതിലെ നിൽപ്പു മരങ്ങളുടെയും ഗുണനി ലവാരവും മറ്റ് ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ടശേഷം നി›ിത മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്.

പോസ്റ്റ് ഓഫറുകാരൻ ടി വ്യവസ്ഥകൾ ബോദ്ധ്യപ്പെട്ട് ഉടമ്പടിയിൽ ഏർപ്പെടുന്നപക്ഷം ഇതിൻമേൽ ആവശ്യമായ പരസ്യം നൽകി ഒരു പുനർലേലം നടത്തുന്നതാണ്. പുനർലേലത്തിൽ ലഭിക്കുന്ന തുക പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കുറവാണെങ്കിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയ്ക്ക് ടിയാന്റെ പേരിൽ ദർഘാസ് കം ലേലം സ്ഥിര പ്പെടുത്തുന്നതായിരിക്കും. പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത ലേലത്തുക അടയ്ക്കുന്നതിൽനിന്നും പിൻമാറുന്നപക്ഷം ടിയാൻ അടച്ചിട്ടുള്ള സെക്യൂരിറ്റി തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതാണ്. പുനർലേലത്തിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കൂടുതൽ തുകയ്ക്ക് ദർഘാസ് കം ലേലം നടക്കുകയാണെങ്കിൽ ഉയർന്ന ലേല തുകയ്ക്ക് ആ വ്യ‡ികളുടെ പേരിൽ ലേലം ഉറപ്പിക്കുന്നതും പോസ്റ്റ് ഓഫറുകാരന്റെ സെക്യൂരിറ്റി തുക തിരികെ നൽകുന്നതുമാണ്.

8. ദർഘാസ് കം ലേലം സംബന്ധിച്ച കൂടുതൽ വിവരങ്ങൾ കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസിലോ കണ്ണവം/കൊട്ടിയൂർ റെയിഞ്ചാഫീസിലോ എല്ലാ പ്രവൃത്തി ദിവസങ്ങളിലും അന്വേഷിച്ചാൽ അറിയാവുന്നതാണ്.

9. ദർഘാസ് കം ലേലത്തിൽ പങ്ക് ചേരണമെന്നാഗ്രഹിക്കുന്നവർ ` 10,000 (പതിനായിരം രൂപ) നിരതദ്രവ്യം ഓരോ തോട്ടത്തിനും/ബ്ളോക്കിനും കെട്ടിവയ്ക്കേ≠താണ്.

10. കൂടുതൽ തുകയ്ക്ക് ദർഘാസ് കം ലേലം കൊള്ളുന്ന ആൾ മൊത്തം ലേലത്തുകയുടെ ¹/3

തുക ലേലം കഴിഞ്ഞാലുടൻ ഒടുക്കേ≠താണ്. ടി തുക ഒടുക്കുന്നതിന് വീഴ്ചവരുത്തിയാൽ ടിയാൻ ഒടുക്കിയിട്ടുള്ള നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും ടി കൂപ്പ് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതു മായിരിക്കും.

11. ദർഘാസ് കം ലേലം കൊള്ളുന്ന ആൾക്ക് പ്രസ്തുത കൂപ്പിൽ മാർക്ക് ചെയ്ത് എന്യൂമറേറ്റ് ചെയ്തു നിർത്തിയിരിക്കുന്ന ഇലവ്, മട്ടി, സ്റ്റെർകുലിയ (പോത്തു≠ി) മറ്റു പലജാതി എന്നീ മരങ്ങൾക്ക് മാത്രം അവകാശമുള്ളതും തേക്ക്, ഈട്ടി മുതലായ മറ്റ് മരങ്ങൾക്ക് അവകാശമില്ലാത്തതുമാകുന്നു.

12. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലം കൊള്ളുന്ന ആൾ ` 50-ന്റെ മുദ്രപത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടി കൂടി ലേലം കഴിഞ്ഞാലുടൻ ഒപ്പ് വയ്ക്കേ≠താണ്.

13. ദർഘാസ് കം ലേലം സ്ഥരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുള്ള ²/3

ലേലത്തുകയും മൊത്തം തുകയുടെ 5% ഫോറസ്റ്റ് ഡവലപ്മെന്റ ് ടാക്സും നിലവിലുള്ള നിരക്കിൽ വാറ്റ്, ഇൻകം-ടാക്സ് എന്നിവകളും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10% സെക്യൂരിറ്റി ഡെപ്പോസിറ്റും വെച്ച് ` 50-ന്റെ മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠തുമാണ്. 15 ദിവസത്തിനുള്ളിൽ ടി തുകകൾ ഒടുക്കാതിരുന്നാൽ 12% പലിശയോടുകൂടി തുകകൾ ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയം28th FEB. 2012] FOREST DEPARTMENT 189 ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറും 24% പലിശയോടുകൂടി വീ≠ും 15 ദിവസത്തെ സമയം ചീഫ് കൺസർവേറ്റർ ഓഫ് ഫോറസ്റ്റ്സ്, ഉത്തരമേഖലയും അനുവദിക്കുന്നതാണ്. എന്നാൽ മുകളിൽ പറഞ്ഞ കാലാവധികളെല്ലാം കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും. പലിശ കണക്കാക്കുമ്പോൾ 15 ദിവസമോ അതിൽ കുറവോ വരുന്നത് പകുതി മാസമായും 15 ദിവസത്തിൽ കൂടുതൽ വരുന്ന ദിവസം ഒരു മാസമായും കണക്കാക്കുന്നതാണ്.

14. മുകളിലെ വ്യവസ്ഥപ്രകാരം നീട്ടിക്കൊടുത്ത കാലാവധിക്കുള്ളിലും തുക ഒടുക്കി എഗ്രിമെന്റ ് വയ്ക്കുന്നതിന് വീഴ്ച വരുത്തി യാൽ ദർഘാസുകാരൻ/ലേലക്കാരൻ അതുവരെ ഒടുക്കിയിട്ടുള്ള എല്ലാ തുകയും നീക്കം ചെയ്യാതെ കിടക്കുന്ന എല്ലാ ഉൽപ്പന്ന ങ്ങളും സർക്കാരിലേക്ക് ക≠ുകെട്ടി ലേലം റദ്ദ് ചെയ്യുന്നതും ദർഘാസുകാരന്റെ/ലേലക്കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പ് പുനർലേലം ചെയ്യുന്നതുമാണ്. പുനർലേലം ചെയ്യുമ്പോൾ ലാഭം ഉ≠ാകുകയാണെങ്കിൽ ആയതിന് ലേലക്കാരന് യാതൊരുവിധ അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല. പുനർ ലേലത്തിലു≠ാകുന്ന എല്ലാ നഷ്ടങ്ങളും വീഴ്ചക്കാരനിൽനിന്നും ഈടാക്കുന്നതാണ്.

15. ദർഘാസുകാരൻ/ലേലക്കാരൻ ബാക്കി തുക മുതലായവ നീട്ടികൊടുത്ത കാലാവധിക്കുള്ളിലും ഒടുക്കാതിരുന്നാൽ ഉടമ്പടി റദ്ദ് ചെയ്ത് ടിയാൻ അടച്ചിട്ടുള്ള മുഴുവൻ തുകകളും നീക്കം ചെയ്യാതെ കിടക്കുന്ന എല്ലാ ഉൽപ്പന്നങ്ങളും സർക്കാരിലേക്ക് ക≠ുകെട്ടി ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതാണ്. പുനർലേലത്തിൽ ലാഭം ഉ≠ാക്കുകയാണെങ്കിൽ വീഴ്ചക്കാരന് യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല.

16. ഉടമ്പടി കാലാവധി ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 60 ദിവസമാണ്. സാധാരണഗതിയിൽ കൂപ്പിന്റെ കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ, ചീഫ് ഫോറസ്റ്റ്് കൺസർവേറ്റർ, നോർത്തേൺ സർക്കിൾ, കണ്ണൂർ, അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (റീജിയൻ നോർത്ത്) എന്നിവർ യഥാക്രമം 15 ദിവസം വീതം താഴെ പറയും പ്രകാരം പിഴ ഈടാക്കിക്കൊ≠് ഓരോ ജോലിക്കും കാലാവധി നീട്ടിക്കൊടുക്കുന്നതാണ്.

(1) എന്യൂമറേറ്റ് ചെയ്തതും മുറിക്കാനുള്ളതുമായ മരങ്ങൾക്ക് ഓരോ ഹെക്ടറിനും അതിന്റെ ഭാഗത്തിനും ` 750 വീതം. (2) നീക്കം ചെയ്യാത്ത രജിസ്റ്റർ ചെയ്തതും അല്ലാത്തതുമായ തടികൾക്ക് ഓരോ ക്യു. മീറ്ററിനും അതിന്റെ ഭാഗത്തിലും ` 100 വീതം.

(3) നീക്കം ചെയ്യാത്ത വിറകിന് ഓരോ ടണ്ണിനും അതിന്റെ ഭാഗത്തിനും ` 50 വീതം.

ഒന്നാമത്തെ 15 ദിവസത്തേക്ക് ടി നിരക്കിലും 2-ാം 15 ദിവസത്തേക്ക് ഇതിന്റെ ഇരട്ടിയും 3-ാം 15 ദിവസത്തേക്ക് ഒന്നാം 15 ദിവസത്തിന്റെ നിരക്കിന്റെ മൂന്നിരട്ടിയും എന്ന ക്രമത്തിൽ പിഴ ഈടാക്കുന്നതാണ്. ഇപ്രകാരം നീട്ടി നൽകുന്ന തീയതിക്കുള്ളിലും നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റിലേക്ക് മുതൽകൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ാകുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ചെയ്തുതീർക്കാൻ ബാക്കിയുള്ള ജോലികൾ ഡിപ്പാർട്ട്മെന്റ ് ചെയ്യിക്കുന്നതും ആയതിൽ വച്ചു≠ാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതുമായിരിക്കും.

17. കൂപ്പിൽ ശേഖരിച്ചു വയ്ക്കുന്ന ഇലവ്, മട്ടി, സ്റ്റെർകുലിയ, മറ്റു പലവിധ തടികളും വിറകും നിലവിലുള്ള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും നീക്കം ചെയ്യാനുള്ള ലൈസൻസ് നൽകുന്നത്.

18. കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെയോ കണ്ണവം ഫോറസ്റ്റ് റെയിഞ്ചാഫീസറുടെയോ രേഖാമൂലമുള്ള അനുമതിയോടു കൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ കൂപ്പിൽ പ്രവേശിക്കുവാൻ പാടുള്ളൂ.

19. ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാ സമയവും കൂപ്പിൽ ഉ≠ായിരിക്കണം. കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിയിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കേ≠തുമാണ്.

20. യാതൊരു കാരണവശാലും πാന്റേഷനിലെയോ റിസർവിലെയോ മറ്റ് മരങ്ങൾക്കും തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്തുവാൻ പാടില്ല. അങ്ങനെ ഉ≠ാകുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്.

21. കൂപ്പിന് പുറത്ത് ഫോറസ്റ്റ് സ്ഥലത്തും തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടിക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ അനുവദിക്കുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണങ്ങളാലോ മോശമായ കാലാവസ്ഥ മൂലമോ ഉടമ്പടി കാലാവധിക്കുള്ളിൽ ഇവ നീക്കം ചെയ്തുകൊ≠ുപോകാൻ കഴിയാതെ വന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്ടറിനോ അതിന്റെ ഭാഗത്തിനോ ` 250 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതായിരിക്കും.

22. കൂപ്പിന് 0.4 കി. മീറ്റർ (2 ഫർലോങ്ങ്) ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ അനധികൃത കുറ്റകൃത്യങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്. അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ വിവരം ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥരെ ഉടമ്പടിക്കാരൻ അറിയിക്കേ≠താണ്. ഇതിൽ വീഴ്ചവരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടാവുന്നതാണ്.

23. കരാറുകാരന്റെ സെക്യൂരിറ്റി തുക കാലാവധിക്കുശേഷം കരാറുകാരൻ വാറ്റ്, അഗ്രിക്കൾച്ചറൽ ഇൻകം ടാക്സ് ഇവയുടെ ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റ് ഹാജരാക്കുന്ന മുറയ്ക്ക് തിരിച്ചു നൽകുന്നതാണ്. എന്നാൽ ടി ഇനത്തിൽ ഗവൺമെന്റിലേക്ക് ബാദ്ധ്യതകൾ വല്ലതുമു≠െങ്കിൽ സെക്യൂരിറ്റി തുകയിൽ നിന്നും ഈടാക്കുന്നതാണ്.

24. ഈ ദർഘാസ് കം ലേലത്തിലെ വകുപ്പുകൾ പ്രകാരം ഗവൺമെന്റിലു≠ാകുന്ന ഏതൊരു നഷ്ടവും കിട്ടേ≠തായ ഏതൊരു തുകയും ഡിപ്പാർട്ടുമെന്റിൽ നിന്നും ആവശ്യപ്പെടുന്ന സമയത്ത് ദർഘാസുകാരൻ/ലേലക്കാരൻ അടയ്ക്കാൻ വീഴ്ച വരുത്തുന്ന പക്ഷം പ്രസ്തുത തുക ഭൂനികുതി കുടിശ്ശികയായി പരിഗണിച്ച് നിലവിലുള്ള നിയമപ്രകാരം ഈടാക്കുന്നതാണ്. ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർക്ക് യു‡മെന്നുതോന്നുന്ന മറ്റ് മാർഗ്ഗങ്ങളിൽ കൂടിയും ഈ തുക ഈടാക്കുവാൻ നടപടികൾ സ്വീകരിക്കുന്നതാണ്.

25. വനം വകുപ്പിലെ സെയിൽ കൂപ്പുകളെ സംബന്ധിച്ച എല്ലാ പൊതു നിബന്ധനകളും ഈ ദർഘാസ് കം ലേലത്തിനും ബാധകമായിരിക്കും.

26. കരാറുകാരൻ മാർക്ക് ചെയ്ത മരങ്ങൾ മാത്രം മുറിക്കേ≠തും മാർക്ക് ചെയ്യാത്ത മരങ്ങൾ മുറിക്കുകയോ കേടുവരുത്തുവാനോ പാടില്ലാത്തതാകുന്നു.
