The Emd will be accepted as demand draft only taken from the Nationalised Banks in the name of divisional Forest officer, Nilambur North. separate tenders should be submitted for each work.

Tender forms can be obtained from the office of the undersigned on application in writing and on payment of value and VAT (not refundable). The tender forms are not transferable. A preliminary agreement in27th March 2012] FoREsT dEPARTmENT 231 stamp paper worth ` 100 should be enclosed with the tender form. The tenders which does not satisfied with the above conditions will be rejected. All the conditions prevailing in the Kerala Forest department and Kerala Public Works department for the tenders are applicable to this tender also. The undersigned reserves the right to reject the tenders without attributing any reason. conditions with the tender form will also be binding to this tender. It is hereby notified that consequent to receipt of post officer, in respect of sale of KL-01 B/5858 Ambassador Car, also consequent to non-receipt of upset price in respect of KL-11 H/9638 Ambassador car in tender cum auction sale on 13-9-2011 and also due to condemnation of department Vehicle KL-11 B/8845 maheendra Jeep which was used in Thamarassery Range, all the three vehicles and KL-18 A/6532 Bajaj motor cycle which was confiscated under 61 A in oR-7/10 of Thamarassery Range will be sold in re-tender cum-re-auction sale, in as and where in condition by the Divisional Forest Officer, Kozhikode or an authorised Officer by him on 4-4-2012 at 3 p. m. in the Office of Divisional Forest Officer, Kozhikode. The tender forms will be issued from the O/o the Divisional Forest Officer, Kozhikode from 10.30 a. m. to 1 p. m. on all working days from 25-3-2012 till 1 p. m. on the tender cum auction date and filled up tenders should be submitted before 2.30 p. m. on the re-tender date. subsequently, auction sale of each vehicle will be conducted at 3 p. m. on the same day in the presence of those who have submitted tenders.

In case the notified date happens to be a public holiday, the re-tender cum re-auction sale will be conducted on the next working day at the notified place and time, as per the same conditions. All the terms and conditions in respect of the tender cum auction prevailing in Forest department will be applicable to this auction also. if the sale of the vehicles could not be conducted on the day, the re-tender cum re-auction sale of the vehicles will be conducted on 11-4-2012 at the same place and time as per the same conditions mentioned above. if the sale of all or any of the vehicle could not be conducted on the day also, it shall be again conducted on 18-4-2012 and if the sale could not be conducted on this day also it shall be again conducted on 25-4-2012. The place, time, conditions etc. shall remain the same for all the days.

The sale of vehicles will be knocked down in the name of the persons offer highest amount, in the tender or in the auction (whichever is highest) on the day.

condItIonS

1. The vehicles will be auctioned in as and where in condition. Before participating in the tender/auction sale, intending tenderers/bidders should satisfy themselfs of the quality of each vehicle after personal inspection with prior permission of the officer concerned. Complaints, if any raised after the sale regarding the quality of the vehicle will not be entertained.

2. The intending tenderers/bidders should produce either the Electoral Identity Card, Indian Passport, a Certificate from the concerned Village Officer showing the permanent address and also signature attested by him or any legally valid identity card for getting tender forms or remitting Emd.

3. Intending tenderers/bidders should deposit the EMD by cash in the office of the undersigned for participation in tender/auction. Tenders received after the due time will not be accepted.

4. Those who submit tenders could only be eligible to participate in the Tender/Auction. separate tenders/Emd's should be submitted remitted in the office of the undersigned for each vehicle for participation in Tender/Auction.

Tenders will be opened and auctioned in front of those who present at the fixed time.

5. Tenders for the higher amount will be submitted to the competent authority for confirmation and others will be rejected and Emd of the same will be returned.

6. successful tenderers/bidders have to remit 50% of the sale value (including Emd) on the tender/auction date if the sale value is more than Emd.

7. The right for accepting or rejecting any tender/bid amount shall be vested with competent authority.

8. The successful bidder/tenderer should remit the balance amount and taxes and remove the vehicle within 15 days from the date of receipt of intimation of the confirmation.

9. if the vehicle is not removed within 15 days after remitting the balance amount, taxes etc. as above, another 15 days will be allowed for remittance of balance amount and removal of vehicles after realization of 12% of interest and ground rent of ` 20 for each vehicle. Further extension of time will not be allowed. if the vehicle is not removed even within this period the vehicle will be sold in re-auction cum re-tender and Government loss, if any shall be recovered from the defaulter. He shall not have any claim on profit if any on account of the re-tender cum re-auction.

10. All the terms and conditions in respect of the tender cum auction prevailing in Forest department will be applicable to this auction also.

11. The Rc book and connected documents of the vehicles should be obtained from the concerned departments at their own responsibility.

12. Post offers received within 3 days of auction/tender date shall only be accepted, subject to the following conditions.

(a) Post offer is entertainable only if the post offer amount is above 10% in the case of amount of tender/auction is more than ` 1 lakh and only if the post offer amount is more than 20% where the bid/tender amount is less than ` 1 lakh.

(b) Post offer with Demand Draft drawn in favour of Divisional Forest Officer, Kozhikode for the full amount offered alone shall be entertained.

(c) A separate agreement to the above effect should be executed along with the post offer on that day of the submission of the post offer.

(d) Re-auction/re-tender will be conducted after retaining the full amount deposited as per the above conditions as security deposit. The sale shall be confirmed in the name of person who offers highest amount in the post offer, if the amount fetched in the re-auction/re-tender sale is less than amount in the post offer, the amount deposited as per demand draft by the post offer shall be adjusted towards the sale value. if the amount offered in the re-auction/re-tender is more, the re-auction/re-tender shall be confirmed in the name of such tenderer/bidder and the full amount deposited by the post offerer shall be returned.

(e) All conditions of tender/auction shall be applicable in the post offer also.

ദർഘാസ് /ലേല നിബന്ധനകൾ

1. പ്രസ്തുത വാഹനങ്ങൾ നൽപു നിൽപ്പു സ്ഥിതിയിലാണ് വിൽപ്പന നടത്തുന്നത്. വാഹനങ്ങളുടെ ഗുണനിലവാരം ലേലത്തിനുമുമ്പ് പരിശോധിച്ച് ബോദ്ധ്യപ്പെടേ താണ്. വാഹനങ്ങൾ അധികൃതരുടെ അനുവാദത്തോടെ എല്ലാ പ്രവൃത്തി ദിവസങ്ങളിലും പരിശോധിക്കാവുന്നതാണ്. ദർഘാസ്/ലേലത്തിനു ശേഷം വാഹനത്തിന്റെ ഗുണനിലവാരത്തെ സംബ ന്ധിച്ച് യാതൊരുവിധ പരാതിയും സ്വീകരിക്കുന്നതല്ല.

2. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കാൻ അവരെ തിരിച്ചറിയുന്നതിന് ബന്ധപ്പെട്ട വില്ലേജ് ഓഫീസർ നൽകിയ സർട്ടിഫിക്കറ്റ,് തെരഞ്ഞെടുപ്പ് കമ്മീഷൻ നൽകിയ തിരിച്ചറിയൽ കാർഡ്, ഇന്ത്യൻ പാ ്പോർട്ട് അല്ലെങ്കിൽ മറ്റു നിയമാനുസൃതമായ തിരിച്ചറിയൽ രേഖ എന്നിവയിൽ ഏതെങ്കിലുമൊന്ന് ഹാജരാക്കേ താണ്.

3. ലേലത്തിന് മുമ്പ് പൂരിപ്പിച്ച ദർഘാസ് ഫോറം സമർപ്പിക്കുന്നതോടൊപ്പം നിരതദ്രവ്യം കെട്ടി വയ്ക്കേ താണ്. നി›ിത സമയത്തിനു ശേഷം ലഭിക്കുന്ന ദർഘാസുകൾ സ്വീകരിക്കുന്നതല്ല.

4. ദർഘാസ് സമർപ്പിക്കുന്നവർക്ക് മാത്രമേ ലേലത്തിൽ പങ്കെടുക്കാൻ അർഹതയുള്ളു. ഓരോ വാഹനത്തിനും വെവ്വേറെ ദർഘാസുകൾ സമർപ്പിക്കേതും വെവ്വേറെ നിരതദ്രവ്യം ഈ ഓഫീസിൽ അടയ്ക്കേ തുമാണ്. ദർഘാസുകൾ സ്വീകരിച്ച ശേഷം ദർഘാസുകാരിൽ സ്ഥലത്തുള്ളവരെമാത്രം ഉൾപ്പെടുത്തി ഓരോ വാഹനത്തിനും ലേലം നടത്തുന്നതും അതിനു ശേഷം ദർഘാസുകൾ തുറക്കുന്നതുമായിരിക്കും.

5. കൂടുതൽ തുകയ്ക്കുള്ള ദർഘാസുകൾ അംഗീകാരത്തിനായി മേലധികാരികൾക്ക് അയയ്ക്കുന്നതും മറ്റുള്ളവ നിരസിക്കു ന്നതും അത്തരം ദർഘാസുകാർ നൽകിയ നിരതദ്രവ്യം ലേലത്തിനുശേഷം തിരികെ നൽകുന്നതുമാണ്.

6. ഉയർന്ന ദർഘാസ് സംഖ്യ നിരതദ്രവ്യ സംഖ്യയേക്കാൾ കൂടുതലാണെങ്കിൽ ദർഘാസ്/ലേലസംഖ്യയുടെ 50% (നിരതദ്രവ്യം ഉൾപ്പെടെ) അപ്പോൾത്തന്നെ അടയ്ക്കേ താണ്.

7. ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനും നിരാകരിക്കുന്നതിനമുള്ള പൂർണ്ണ അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥരിൽ നിക്ഷിപ്തമായിരിക്കും.

8. ദർഘാസുകൾ അംഗീകരിച്ചതായി അറിയിപ്പ് കിട്ടി 15 ദിവസത്തിനകം ബാക്കി ലേല സംഖ്യയും നിയമപ്രകാരമുള്ള നികുതിയും അടച്ച് വാഹനം നീക്കം ചെയ്യേ താണ്.

9. മേൽപ്പറഞ്ഞ 15 ദിവസത്തിനകം ബാക്കി സംഖ്യയും നികുതിയും അടച്ച് വാഹനം നീക്കം ചെയ്യാത്തപക്ഷം മറ്റൊരു 15 ദിവസം കൂടി ബാക്കി സംഖ്യക്ക് 12% പലിശയും ദിവസത്തിൽ 20 രൂപ നിരക്കിൽ തറ വാടകയും വസൂലാക്കി സമയം അനുവദിക്കുന്നതായിരിക്കും. അതിനുശേഷം അവധി അനുവദിക്കുന്നതല്ല. അപ്രകാരം സമയപ രിധിക്കുള്ളിൽ നീക്കം ചെയ്യാത്ത വാഹനം വീഴ്ച വരുത്തിയ ദർഘാസുകാരുടെ/ലേലക്കാരുടെ നഷ്ടോത്തരവാദിത്വ ത്തിൽ ഇതേ ദർഘാസ്/ലേല വ്യവസ്ഥകൾക്ക് വിധേയമായി വീ ും ദർഘാസ്/ലേലം നടത്തി വിൽക്കുന്നതായിരിക്കും.

10. ദർഘാസ് സംബന്ധിച്ച് ഫോറസ്റ്റ് ഡിപ്പാർട്ട്മെന്റിൽ നിലവിലുള്ള പൊതുനിയമങ്ങളും മറ്റ് നിബന്ധനകളും ഈ ദർഘാസ്/ ലേലത്തിനും ബാധകമായിരിക്കും. ദർഘാസ്/ലേലം സ്വീകരിക്കുന്നതിനോ നിരാകരിക്കുന്നതിനോ ഉള്ള പൂർണ്ണ അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥരിൽ നിക്ഷിപ്തമായിരിക്കും.

11. ടി വാഹനങ്ങളുടെ ആർ. സി. ബുക്കും അനുബന്ധരേഖകളും സ്വന്തം ഉത്തരവാദിത്വത്തിൽ ബന്ധപ്പെട്ട വകുപ്പിൽ നിന്നും ലഭ്യമാക്കേ താണ്.

12. പോസ്റ്റ് ഓഫറുകൾ (അനന്തര വാഗ്ദാനം)

ദർഘാസ്/ലേലത്തിനുശേഷം 3 ദിവസങ്ങൾക്കകം കോഴിക്കോട് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽ ലഭിക്കുന്ന രേഖാമൂലമുള്ള ദർഘാസ്/ലേലാനന്തര വാഗ്ദാനങ്ങൾ (പോസ്റ്റ് ഓഫറുകൾ) താഴെപ്പറയുന്ന വ്യവസ്ഥകൾക്കു വിധേ യമായി സ്വീകരിക്കുന്നതാണ് :

(എ) ദർഘാസ്/ലേലത്തിൽ വാഗ്ദാനം ചെയ്തിട്ടുള്ള തുക ഒരുലക്ഷത്തിൽ അധികമാണെങ്കിൽ അതിന്റെ 10 ശതമാ നത്തിലും ഒരുലക്ഷമോ അതിൽ താഴെയോ ആണെങ്കിൽ അതിന്റെ 20 ശതമാനത്തിലും കൂടുതലുള്ളതുമായ വാഗ്ദാനങ്ങൾ മാത്രമേ സ്വീകരിക്കുകയുള്ളു.

(ബി) പോസ്റ്റ് ഓഫർ പ്രകാരം വാഗ്ദാനം ചെയ്യപ്പെടുന്ന മുഴുവൻ തുകയും ഡിമാന്റ ് ഡ്രാഫ്റ്റ് ആയി കോഴിക്കോട് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ പേരിൽ മാറത്തക്കവിധം ഹാജരാക്കുന്ന ഓഫറുകൾ മാത്രമേ പരിഗണിക്കു കയുള്ളു.

(സി) ഇതിലേക്കായി പോസ്റ്റ് ഓഫർ സമർപ്പിക്കുന്ന ദിവസം പ്രത്യേക ഉടമ്പടി വയ്ക്കേ തുമാണ്.

(ഡി) മേൽപ്പറഞ്ഞ വ്യവസ്ഥകൾക്ക് അനുസൃതമായി പോസ്റ്റ് ഓഫർ സമർപ്പിക്കുന്ന വ്യ‡ിയുടെ അടച്ച തുക മുഴുവൻ സെക്യൂരിറ്റി ഡെപ്പോസിറ്റായി സൂക്ഷിച്ചുകൊ ് പൊതു ദർഘാസും ലേലവും വീ ും നടത്തുന്നതാണ്. പ്രസ്തുത ദർഘാസ്/ലേലത്തിൽ ലഭിക്കുന്ന ഏറ്റവും കൂടിയ തുക പോസ്റ്റ് ഓഫർ തുകയേക്കാൾ കുറവാണെങ്കിൽ പോസ്റ്റ് ഓഫറിൽ വാഗ്ദാനം നൽകപ്പെട്ടിട്ടുള്ള ഡിമാന്റ ് ഡ്രാഫ്റ്റ് പ്രകാരം അടച്ച മുഴുവൻ തുകയും ദർഘാസ്/ലേല വിലയിലേക്ക് വകയിരുത്തുന്നതാണ്. എന്നാൽ ദർഘാസ്/ലേലത്തിൽ കിട്ടുന്ന തുകയാണ് കൂടുതൽ എങ്കിൽ അപ്ര കാരം ഉയർന്ന വില വാഗ്ദാനം ചെയ്യുന്ന ലേലക്കാരന്റെ പേരിൽ ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തുന്നതും പോസ്റ്റ് ഓഫർ സമർപ്പിച്ചിട്ടുള്ള ആൾ അടച്ചിട്ടുള്ള മൊത്തം തുകയും മടക്കി കൊടുക്കുന്നതുമാണ്.

(ഇ) സാധാരണ ദർഘാസ്/ലേലക്കാർ പാലിക്കേ മറ്റെല്ലാ നിബന്ധനകളും പോസ്റ്റ് ഓഫറിൽ പാലിക്കേ താണ്.
