Now, therefore, in exercise of the powers conferred by Section 10 (1) (c) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947), the Government hereby direct that the said industrial dispute be referred for adjudication to the Labour Court, Kozhikode. The Labour Court will pass the award within a period of three months.

Whereas, the Government are of opinion that an industrial dispute exists between Sri Pramod Harikishan Das, Partner, New Tech Service Centre, C. K. S. Building, Door No. 32/53, Near Premier Bus Stop, Kallai, Kozhikode and the workman of the above referred establishment Sri M. G. Mukesh, Pilakkat Meethal House, Kottooli P. O., Kozhikode in respect of matters mentioned in the annexure to this order ;

1. Whether there is denial of employement to Sri Pradeep, M., Mannodipath (H), Karanthur P. O., Kunnamangalam, Kozhikode by the management of Navarathna Chemicals, Makkada, Kozhikode ?

2. If yes, what relief the worker is entitled to get ?

Whether there is denial of employment to Sri M. G. Mukesh, Mechinist by the management of M/s. New Tech Service Centre, Kallai, Kozhikode ? If not what relief he is entitled to ?

Whereas, the Government are of opinion that an industrial dispute exists between the General Manager, Sitaram Textiles Ltd., Poonkunnam, Thrissur and the workman of the above referred establishment Shri K. Raveendran, Kuttipparambil Veedu, Kanattukara P. O., Thrissur in respect of matters mentioned in the annexure to this order ;

And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;

Now, therefore, in exercise of the powers conferred by section 10 (1) (d) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Industrial Tribunal, Palakkad. The Industrial Tribunal will pass the award within a period of three months.

ANNEXURE

Thiruvananthapuram, 12th March 2012.

Whereas, the Government are of opinion that an industrial dispute exists between Shri Sreenivasan, Managing Partner, M/s. Navarathna Chemicals, 4/689, Makkada P. O., Kakkodi (via), Kozhikode-673 617 1. Whether the denial of employement to Badly Worker Sri K. Raveendran by the management of M/s Sitaram Textiles Limited, Thrissur is Justifiable ?

2. If not, what all relief Sri K. Raveendran is entitled to get ?
