Anujan, Over any part All cases of persons Honorary Special of Southern travelling without a Judicial Railway within proper pass or ticket Magistrate of the District of over any part of the 2nd Class Thiruvanantha- Southern Railway (Railways), puram within the District of Kollam Thiruvananthapuram and any of the offences falling u/s. 137 to 139, 141, 142, 144 to 147, 155 to 157, 159, 162, 163, 166 and 167 of the Indian Railways Act 1989 (Central Act 24 of 1989) committing over any part of the Southern Railway within the District of Thiruvananthapuram. In exercise of the powers conferred under section 14 (1) and 190 (2) of the Code of Criminal Procedure 1973, (Act 2 of 1974), the Chief Judicial Magistrate, Thiruvananthapuram hereby empowers the Honorary Magistrate mentioned in Column No. (1) of the Schedule given below, all the powers conferred on a Magistrate of the First Class under the said code and to take cognizance of the offences mentioned in Column No. (3) of the Schedule within the area mentioned in Column No. (2) of the Schedule below for a period of one year with effect from the date of assumption of charge. The Hon'ble High Court of Kerala as per the Notification cited under reference, appointed Sri K. K. Anujan, Sree Lekshmi, Thittamel, Near Government Hospital Junction, M. C. Road, Chengannur, Alappuzha District as Honorary Special Judicial Magistrate of 2nd Class (Railways), Kollam u/s. 13 of Cr. PC empowering all the powers conferred upon a Magistrate of the First Class under the said code in respect of the cases as mentioned in Col. No. 3 of the schedule above, over any part of the Southern Railway within the District of Thiruvananthapuram, Kollam, Pathanamthitta, Kottayam and Alappuzha and that part of the District of Ernakulam which lies to the south of and inclusive of Ernakulam Junction and Cochin Harbour Terminus or committing over any part of the said Railway in the above said area and directed this court to issue necessary notification u/s.

190 (2) and 14 (1) of Cr. P. C. Hence this notification.

1. ലേലത്തിൽ പങ്കെടുക്കാൻ ആഗ്രഹിക്കുന്നവർ ലേലം തുടങ്ങുന്നതിന് ഒരു മണിക്കൂർ മുൻപ് മേൽ പറഞ്ഞ നിരതദ്രവ്യം ലേലസ്ഥലത്ത് അടച്ച് രസീത് വാങ്ങേ≠തും കൃത്യസമയത്ത് ലേലത്തിൽ പങ്കെടുക്കേ≠തുമാണ്.

2. കൂടാതെ മേൽപറഞ്ഞ വാഹനം വാങ്ങാൻ താൽപര്യമുള്ള വരിൽനിന്നും സീൽചെയ്ത ടെ≠റുകൾ ക്ഷണിച്ചു കൊള്ളുന്നു. തീയതിവച്ച ടെ≠റുകൾ ഏപ്രിൽ മാസം 30-ാം തീയതി വൈകുന്നേരം 4 മണിക്ക് മുൻപായി ഈ ഓഫീസിൽ കിട്ടത്തക്കവിധത്തിൽ നേരിട്ടോ തപാൽ മാർഗ്ഗമോ ഹാജരാക്കേ≠താണ്.

3. ടെ≠റുകൾക്കൊപ്പം ഏതെങ്കിലും ദേശസാൽകൃതബാങ്കിൽ നിന്നും 'ചീഫ് ജുഡീഷ്യൽ മജിസ്ട്രേറ്റ്' കോഴിക്കോട് എന്ന പേരിൽ എടുത്ത ഡിമാന്റ ് ഡ്രാഫ്റ്റ് അല്ലെങ്കിൽ നിരതദ്രവ്യം അടച്ച രസീത് അടക്കം ചെയ്യേ≠താണ്. കവറിനുമുകളിൽ വാഹന നമ്പർ എഴുതേ≠താണ്.

4. പരസ്യലേലം അവസാനിച്ചാലുടൻ ദർഘാസുകൾ തുറക്കു ന്നതും ലേലത്തിലാണോ ടെ≠റിലാണോ കൂടുതൽ തുക എന്നു നോക്കി കൂടിയ തുകയ്ക്ക് ലേലം ഉറപ്പിക്കുന്നതാണ്.

5. ലേലം/ടെ≠ർ നഷ്ടപ്പെട്ടവർക്ക് നിരതദ്രവ്യം ലേലം കഴിഞ്ഞയുടൻ തിരിച്ച് നൽകുന്നതാണ്. ലേലത്തിലെടുത്ത ആൾ ഉടൻതന്നെ ലേല തുകയും വിൽപ്പനനികുതിയും (നിരതദ്രവ്യം കുറച്ച്) ലേലസ്ഥലത്തുതന്നെ അടച്ച് രസീത് വാങ്ങേ≠തും സ്വന്തം ചെലവിൽ വാഹനം നീക്കം ചെയ്യേ≠തുമാണ്.

കോഴിക്കോട് ചീഫ് ജുഡീഷ്യൽ മജിസ്ട്രേറ്റ്് കോടതി പരിസരത്ത് സൂക്ഷിച്ചിട്ടുള്ള ക്രിമിനൽ ജുഡീഷ്യൽ വകുപ്പിലെ താഴെ പറയുന്ന വാഹനം 2012 മേയ് മാസം 2-ാം തീയതി കാലത്ത് 10.30-ന് പ്രസ്തുത കോടതി ഓഫീസിൽ വച്ച് പരസ്യമായി ലേലം ചെയ്തു വിൽക്കുന്നതാണ്. മേൽദിവസം അവധി/ഹർത്താൽ ആവുന്നപക്ഷം തൊട്ടടുത്ത പ്രവർത്തി ദിവസം ലേലം നടത്തുന്നതായിരിക്കും.

6. ഏതെങ്കിലും കാരണവശാൽ ലേലം/ടെ≠ർ സ്ഥിരപ്പെടുത്തി കിട്ടുന്ന ആൾ ലേല നിബന്ധനകൾ ലംഘിക്കുക യാണെങ്കിൽ ടിയാൻ അടച്ച സംഖ്യ സർക്കാരിലേക്ക് മുതൽക്കൂട്ടുന്നതും വാഹനം പുനർലേലം ചെയ്യുന്നതും ആയതുവഴി സർക്കാരിന് എന്തെങ്കിലും നഷ്ടം സംഭവിക്കുകയാണെങ്കിൽ ലേലം/ടെ≠ർ കൊ≠ ആളിൽനിന്നും ഈടാക്കുന്നതുമാണ്. പുനർലേലത്തിൽ എന്തെങ്കിലും ലാഭമു≠ായാൽ ലേലം/ടെ≠ർ കൊ≠ ആൾക്ക് ലാഭത്തിന് അർഹതയില്ലാത്തതും പുനർലേല ത്തിൽ സർക്കാരിന് നഷ്ടം വരികയാണെങ്കിൽ നഷ്ടം മുൻലേലക്കാരനിൽനിന്നും ഈടാക്കുന്നതുമാണ്.

7. മേൽപ്പറഞ്ഞ വാഹനം കോഴിക്കോട് ചീഫ് ജുഡീഷ്യൽ മജിസ്ട്രേറ്റിന്റെ അനുവാദത്തോടെ ചീഫ് ജുഡിഷ്യൽ മജിസ്ട്രേറ്റ് കോടതി പരിസരത്ത് വച്ച് പ്രവർത്തി ദിവസങ്ങളിൽ 10 മുതൽ 5 വരെ പരിശോധിക്കാവുന്ന താണ്.

8. യാതൊരു കാരണവും കൂടാതെ ലേലം മാറ്റി വയ്ക്കുന്ന തിനും അസ്ഥിരപ്പെടുത്തുന്നതിനും മറ്റ് തീരുമാനങ്ങൾ എടുക്കുന്നതിനുമുള്ള അധികാരം കോഴിക്കോട് ചീഫ് ജുഡീഷ്യൽ മജിസ്ട്രേറ്റിൽ നിക്ഷിപ്തമാണ്.

9. ടെ≠ർ ഫോമുകൾ ` 12 (10 രൂപ + വാറ്റ്)-ന് 10-4-2012 മുതൽ ഈ ഓഫീസിൽ നിന്നും ലഭ്യമാണ്.
