പേപ്പാറ വൈൽഡ്ലൈഫ് സാങ്ച്വറിയിൽ ഉപയോഗിച്ചിരു ന്നതും മേലധികാരികളിൽനിന്നും ക≠ം ചെയ്ത് ഉത്തരവ് ലഭിച്ചതുമായ താഴെ പറയുന്ന വാഹനങ്ങൾ ഇപ്പോൾ സൂക്ഷിച്ചിരിക്കുന്ന സ്ഥലത്ത്, തൽസമയ അവസ്ഥയിലും സ്ഥിതി യിലും ദർഘാസ്/ലേലം മുഖേന വാങ്ങുന്നതിന് താൽപര്യമുള്ള വരിൽനിന്നും മുദ്രവെച്ച കവറുകളിൽ ദർഘാസുകൾ ക്ഷണിച്ചു കൊള്ളുന്നു.

ദർഘാസ് ഫോറങ്ങൾ നി›ിത വിലയും നികുതികളും ഈടാക്കി 2012 സെപ്റ്റംബർ മാസം 3-ാം തീയതി വൈകിട്ട'് 5 മണി വരെ തിരുവനന്തപുരം വൈൽഡ് ലൈഫ് വാർഡന്റെ ഓഫീസിൽ നിന്നും ലഭിക്കുന്നതാണ്. പൂരിപ്പിച്ച ദർഘാസുകൾ 4-9-2012 ഉച്ചയ്ക്ക് 1 മണിവരെ സ്വീകരിക്കുന്നതും അന്നേദിവസം തന്നെ ഉച്ചയ്ക്കുശേഷം 3 മണിക്ക് അപ്പോൾ സ്ഥലത്ത് ഹാജരുള്ള ദർഘാസുകാരെ മാത്രം പങ്കെടുപ്പിച്ച് തിരുവനന്തപുരം വൈൽഡ് ലൈഫ് വാർഡനോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന Gaz. No. 34/2012/DTP (Forest).

മറ്റേതെങ്കിലും ഉദ്യോഗസ്ഥനോ തിരുവനന്തപുരം വൈൽഡ് ലൈഫ് വാർഡന്റെ ആഫീസിൽ വച്ച് വാഹനം പരസ്യമായി ലേലം ചെയ്യുന്നതും ലേലത്തിനുശേഷം ലേലക്കാരുടെ സാന്നിദ്ധ്യത്തിൽ ദർഘാസുകൾ തുറന്ന് പരിശോധിക്കുന്നതുമായിരിക്കും. ദർഘാസുകൾ സമർപ്പിച്ചിരിക്കുന്നവർക്ക് മാത്രമേ ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവാദമു≠ായിരിക്കുകയുള്ളൂ. അന്നേദിവസം പൊതുഅവധി പ്രഖ്യാപിക്കുകയോ മറ്റ് ഏതെങ്കിലും കാരണ വശാൽ ലേലം നടക്കാതിരുന്നാലോ ടെ≠ർ/ലേലം അടുത്ത പ്രവൃത്തി ദിവസം ടി സ്ഥലത്തും സമയത്തും മുകളിൽ പ്രസ്താവിച്ച വ്യവസ്ഥകൾക്കനുസരിച്ച് ലേലം നടത്തുന്നതും ദർഘാസ് സ്വീകരിക്കുന്നതും തുറന്ന് പരിശോധിക്കുന്നതുമാണ്.

നിബന്ധനകൾ

1. മേൽ വാഹനം ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസറുടെ അനുവാദത്തോടുകൂടി ലേലത്തിനുമുമ്പായി ഓഫീസ് സമയത്ത് പരിശോധിച്ച് വാഹനത്തിന്റെ നിജസ്ഥിതി ബോദ്ധ്യപ്പെടേ≠താണ്. ദർഘാസ്/ലേലത്തിനുശേഷം ഇതു സംബന്ധമായി യാതൊരുവിധ പരാതികളും സ്വീകരിക്കുന്നതല്ല.

2. ദർഘാസ് ഫോറം ആവശ്യമുള്ള വ്യ‡ികൾ അവരുടെ സ്ഥിരം മേൽവിലാസവും കയ്യൊപ്പും രേഖപ്പെടുത്തി ബന്ധപ്പെട്ട വില്ലേജാഫീസർ നൽകിയ സർട്ടിഫിക്കറ്റോ ഇലക്ഷൻ കമ്മീഷണർ നൽകിയിട്ടുള്ള തിരിച്ചറിയൽ കാർഡിന്റെ പകർപ്പോ സഹിതം തിരുവനന്തപുരം വൈൽഡ ് ലൈഫ് വാർഡന് അപേക്ഷ നൽകേ≠താണ്.

3. ഓരോ വാഹനങ്ങൾക്കും പ്രത്യേകം ദർഘാസ് ഫോറങ്ങൾ വാങ്ങേ≠തും പൂരിപ്പിച്ച ദർഘാസുകൾക്കൊപ്പം നി›ിത നിരതദ്രവ്യം പണമായി തിരുവനന്തപുരം വൈൽഡ് ലൈഫ് ഡിവിഷൻ ഓഫീസിൽ അടയ്ക്കേ≠തുമാണ്.

നി›ിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ദർഘാസുകൾ സ്വീകരിക്കുന്നതല്ല.

4. ദർഘാസുകൾ സ്വീകരിച്ചശേഷം നി›ിത സമയത്ത് അപ്പോൾ സ്ഥലത്ത് ഹാജരുള്ള ദർഘാസുകാരെ മാത്രം ഉൾപ്പെടുത്തി ഓരോ വാഹനത്തിന്റെയും ലേലം നടത്തുന്നതും ആയതിനുശേഷം ദർഘാസുകൾ തുറന്ന് പരിശോധിക്കുന്നതുമാണ്. ലേലത്തിലോ/ദർഘാസിലോ കൂടതൽ തുക വാഗ്ദാനം ചെയ്യുന്ന ലേലക്കാരന്റെ പേരിൽ ദർഘാസ്/ലേലം താൽക്കാലികമായി ഉറപ്പിക്കു ന്നതായിരിക്കും. മറ്റ് ദർഘാസുകാരുടെ നിരതദ്രവ്യം 8. മേൽ നിബന്ധനകൾ കൂടാതെ സർക്കാർ കാലാ കാലങ്ങളായി പുറപ്പെടുവിച്ചിരിക്കുന്ന ദർഘാസ്/ലേലം സംബന്ധിച്ച പൊതു വ്യവസ്ഥകൾ ഈ ലേലത്തിനും ബാധകമായിരിക്കും.

9. വാഹനങ്ങൾ സംബന്ധിച്ച വിശദവിവരങ്ങൾ തിരുവനന്തപുരം വൈൽഡ് ലൈഫ് വാർഡന്റെ ഓഫീസിൽ നിന്നോ പേപ്പാറ റെയിഞ്ചാഫീസിൽ നിന്നോ അറിയാവുന്നതാണ്.

10. പരസ്യം സംബന്ധിച്ച വിശദവിവരങ്ങൾ കേരള വനം വകുപ്പിന്റെ വെബ്സെറ്റ് ആയ www.keralaforest.org-ൽ ലഭ്യമാണ്.

Separate sealed competitive tenders superscribing the name of works are invited by the undersigned for and on behalf of the Governor of Kerala from registered eligible contractors for the following works.

അന്നേദിവസം തന്നെ തിരികെ നൽകുന്നതാണ്.

5. ദർഘാസ്/ലേലസംഖ്യ നിരതദ്രവ്യത്തിനേക്കാൾ അധികമാണെങ്കിൽ ദർഘാസ്/ലേല സംഖ്യയുടെ 50 ശതമാനമോ ഏതാണ് അധികം വരുന്നത് ആ തുക അന്നേദിവസംതന്നെ സർക്കാരിലേക്ക് അടയ്ക്കേ≠താണ്.

6. ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനോ നിരാകരിക്കുന്നതിനോ ഉള്ള പൂർണ്ണ അധികാരം ലേലം നടത്തുന്ന ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമായിരിക്കും.

7. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തി അറിയിപ്പ് ലഭിച്ച് 15 ദിവസത്തിനകം ബാക്കി വിലയും നിയമാനുസരണം നികുതികളുമടച്ച് വാഹനം നീക്കം ചെയ്യേ≠താണ്.

ആയതിന് സാധിച്ചിട്ടില്ലായെങ്കിൽ ദർഘാസ്/ലേലക്കാരൻ ആവശ്യപ്പെടുന്നപക്ഷം മറ്റൊരു 15 ദിവസം കൂടി ബാക്കി സംഖ്യയ്ക്ക് 18 ശതമാനം പലിശയും പ്രതിദിനം 20

(cid:31) നിരക്കിൽ ഇരിപ്പു വാടകയും ഈടാക്കി കാലാവധി ദീർഘിപ്പിച്ച് അനുവദിക്കുന്നതായിരിക്കും.

ആയതിനുശേഷം കാലാവധി ഒരു കാരണവശാലും നീട്ടിക്കൊടുക്കുന്നതല്ല. ഇതുപ്രകാരം വീഴ്ച വരുത്തിയ ദർഘാസ്/ലേലക്കാരന്റെ ന„ോത്തരവാദിത്വത്തിൽ പുനർ ദർഘാസ്/ലേല അടിസ്ഥാനത്തിൽ ടി വാഹനം വിൽപ്പന നടത്തുന്നതും ടിയാൻ സർക്കാരിലേക്കടച്ച മുഴുവൻ തുകയും അറിയിപ്പു കൂടാതെ സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നുതുമായിരിക്കും.

Tender forms and other conditions can be obtained from

the office of the undersigned on application in writing and on payment of the cost of the tender form and taxes in cash (not refundable) upto 1 p.m. on 6-9-2012. The filled up tenders will be received in this office upto 3 p.m. on 6-9-2012 and opened by the undersigned or an Officer authorized by him on the same day at 3.30 p.m. at the Office of Wildlife Warden, Thiruvananthapuram in the presence of the contractors attending on the date. If the due date happens to be a holiday, the next working day will be the due date.

The tender forms are not transferable. The Earnest Money Deposit noted against the work should be paid along with the tenders by Demand Draft (cheque will not be acceptable) pledged in favour of the undersigned payable at any Nationalized Bank/Scheduled Bank. Incomplete tenders and tenders without EMD are liable to be rejected. The undersigned reserves the right to reject any tender without assigning any reasons thereof. All other conditions prevailing in the Kerala PWD and Forest Department and modifications there of time to time are applicable to this tender also. The tenders not containing the prescribed preliminary agreement in Stamp Paper worth (cid:31) 100 will be summarily rejected. If there is no response to any of the works included in this notification, the tender will be again be conducted on 13-9-2012 as per the same conditions mentioned above, at the same time and venue.

ദർഘാസ് ഫോറങ്ങളും ജോലികളെ സംബന്ധിച്ച വിവരങ്ങളും ദർഘാസ് ഫോറത്തിന്റെ വിലയും വില്പന നികുതിയും അടച്ച് അപേക്ഷിക്കുന്നവർക്ക് ദർഘാസ് സ്വീകരിക്കുന്ന അവസാന തീയതിയായ 6-9-2012, 1 മണിവരെ ഈ ഓഫീസിൽനിന്നും ലഭിക്കുന്നതാണ്. പൂരിപ്പിച്ച ദർഘാസുകൾ അന്നേദിവസം പകൽ 3 മണിവരെ ഈ ഓഫീസിൽ സ്വീകരിക്കുന്നതാണ്. ദർഘാസ് ഫോറത്തിന്റെ വില മടക്കി കൊടുക്കുന്നതല്ല. ടി ദിവസം ഒരു പൊതു അവധിയായി വരുന്നപക്ഷം അടുത്ത പ്രവൃത്തി ദിവസം ടി സ്ഥലത്തും സമയത്തും വച്ച് ദർഘാസുകൾ സ്വീകരിക്കുന്നതും തുറക്കുന്നതുമായിരിക്കും.

ദർഘാസ് സ്വീകരിക്കുന്ന അവസാന തീയതിയായ 6-9-2012 പകൽ 3.30 ന് ഹാജരുള്ള കരാറുകാരുടെ സാന്നിദ്ധ്യത്തിൽ താഴെ ഒപ്പിട്ടിട്ടുള്ള ആളോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ ടെ≠റുകൾ തുറക്കുന്നതായിരിക്കും. ദർഘാസ് ഫോറങ്ങൾ കൈമാറ്റം ചെയ്യുവാൻ പാടുള്ളതല്ല.

തിരുവനന്തപുരം വൈൽഡ് ലൈഫ് വാർഡന്റെ പേരിൽ പണയപ്പെടുത്തിയതും ദേശീയ/ഷെഡ്യൂൾഡ് ബാങ്കിൽ നിന്നും ലഭിക്കുന്നതുമായ നി›ിത തുകയ്ക്കുള്ള ഡിമാന്റ ് ഡ്രാഫ്റ്റ് നിരതദ്രവ്യമായി ദർഘാസിനോടൊപ്പം സമർപ്പിക്കേ≠താണ്. അപൂർണ്ണമായ ദർഘാസുകൾ നിരസിക്കുന്നതായിരിക്കും. ഏതെങ്കിലും ദർഘാസുകൾ കാരണം ബോദ്ധ്യപ്പെടുത്താതെ നിരസിക്കുന്നതിനുള്ള അധികാരം താഴെ ഒപ്പിട്ടിരിക്കുന്ന ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമായിരിക്കും. വനം വകുപ്പിലും പൊതുമരാമത്ത് വകുപ്പിലും നിലവിലുള്ളതും കാലാകാലങ്ങളിൽ പുറപ്പെടുവിക്കുന്നതുമായ കരാർ വ്യവസ്ഥകൾ ഈ ജോലികൾക്കും ബാധകമായിരിക്കും. കരാറുകാരൻ നിർദ്ദി„ മാതൃകയിൽ 100 മുദ്രപ്പത്രത്തിൽ പ്രാഥമിക ഉടമ്പടി ദർഘാസി നോടൊപ്പം സമർപ്പിക്കേ≠താണ്. പ്രാഥമിക ഉടമ്പടി ഇല്ലാത്ത ദർഘാസുകൾ നിരസിക്കുന്നതാണ്. ഏതെങ്കിലും കാരണവശാൽ ടി ജോലികളുടെ/ഏതെങ്കിലും ജോലിയുടെ ദർഘാസ് നടക്കാതെയിരുന്നാൽ ടി ജോലികളുടെ/ ജോലിയുടെ ദർഘാസ് വീ≠ും 13-9-2012-ൽ മുൻ നി›യിച്ചതുപോലെ നടത്തുന്നതും ഹാജരുള്ള കരാറുകാരുടെ സാന്നിദ്ധ്യത്തിൽ വൈൽഡ്ലൈഫ് വാർഡനോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ തുറക്കുന്നുമായിരിക്കും.

1. വൈദ്യുത കമ്പിവേലികൾ സ്ഥാപിക്കുന്ന ജോലി ഈ രംഗത്ത് പരിചയമുള്ള കരാറുകാർ/ഏജൻസി/സ്ഥാപനം മുഖേന ചെയ്യേ≠തിനാൽ തൃപ്തികരമായ രീതിയിൽ ജോലി ചെയ്തു കൊടുത്തിട്ടു≠െന്ന് തെളിയിക്കുന്നതിന് ജോലി ചെയ്തുകൊടുത്ത സ്ഥാപനത്തിന്റെ/ സ്ഥാപനങ്ങളുടെ ജില്ലാ മേലധികാരി/മേലധികാരികളിൽ നിന്നും ലഭിച്ച പരിചയ സർട്ടിഫിക്കറ്റുകളും/സർട്ടിഫിക്കറ്റു കളുടെ സാക്ഷ്യപ്പെടുത്തിയ പകർപ്പുകളും ടെ≠റിനോ ടൊപ്പം സമർപ്പിക്കേ≠താണ്.

2. കമ്പിവേലി സ്ഥാപിക്കുന്നതിനും അറ്റകുറ്റപ്പണികൾ ചെയ്യുന്നതിനും ഏറ്റവും ഗുണനിലവാരമുള്ള ഉപകരണങ്ങൾ മാത്രം ഉപയോഗിക്കേ≠താണ്. ഉപകരണങ്ങൾ ബാംഗ്ളൂർ ആസ്ഥാനമായ പവർ റിസർച്ച് ഇൻസ്റ്റിറ്റ്യൂട്ടിന്റെയോ ഡി. ജി. എസ്. ആന്റ ് ഡി.യുടെയോ ഗുണമേ∑ാ സർട്ടിഫിക്കറ്റ് ഉള്ളവയായിരിക്കണം.

4. എനർജൈസറിൽ പതിപ്പിച്ചിട്ടുള്ള വാറ≠ി/ഗ്യാര≠ി സീൽ നശിപ്പിക്കുകയോ ഇളക്കി മാറ്റുകയോ കേടുവരുത്തുകയോ ചെയ്യരുത്. വാറ≠ി/ഗ്യാര≠ി കാലയളവ് രേഖാമൂലം ടെ≠ർ സമയത്ത് സമർപ്പിക്കുകയും ചെയ്യേ≠താണ്.

നിബന്ധനകൾ

1. വിൽപ്പനയിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ വാഹനം ബന്ധപ്പെട്ട അധികാരികളുടെ അനുവാദ ത്തോടെ ഓഫീസ് സമയങ്ങളിൽ പരിശോധിച്ച് ബോദ്ധ്യ പ്പെടേ≠താണ്. ലേലം ഉറപ്പിച്ചശേഷം വാഹനത്തെ സംബന്ധിക്കുന്ന യാതൊരു പരാതിയും സ്വീകരിക്കുന്നതല്ല.

2. ദർഘാസ് ഫോറം ആവശ്യമുള്ളവർ അവരെ തിരിച്ചറി യുന്നതിന് ബന്ധപ്പെട്ട വില്ലേജാഫീസറോ മറ്റ് അധികാരികളോ നൽകിയ സർട്ടിഫിക്കറ്റ് അല്ലെങ്കിൽ ഇലക്ഷൻ കമ്മീഷന്റെ തിരിച്ചറിയൽ കാർഡോ പാസ്പോർട്ടിന്റെ കോപ്പിയോ സഹിതം അപേക്ഷിക്കേ≠താണ്.

3. ദർഘാസ് ഫോറം ലേല ദിവസം ഉച്ചയ്ക്ക് 1 മണിവരെ അപേക്ഷകന് ലഭിക്കുന്നതാണ്.

ദിവസം സമയം കൂടി തൃശ്ശൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ അനുവദിക്കുന്നതാണ്. മേൽപ്പറഞ്ഞ 30 ദിവസത്തിനുശേഷം അവധി അനുവദിക്കുന്നതല്ല.

അപ്രകാരം സമയപരിധിക്കുള്ളിൽ തുക ഒടുക്കി വാഹനം നീക്കം ചെയ്യാത്തപക്ഷം ദർഘാസുകാർ ദർഘാസ്/ലേല ദിവസം അടച്ച തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും വാഹനം വീ≠ും ലേലവിൽപ്പന നടത്തുന്നതു മായിരിക്കും.

10. ലേലം/ദർഘാസ് സംബന്ധിച്ച പോസ്റ്റ് ഓഫറുകൾ ലേലം/ ദർഘാസിൽ വാഗ്ദാനം ചെയ്തിട്ടുള്ള തുക 1 (ഒന്ന്) ലക്ഷത്തിൽ കുറവാണെങ്കിൽ 20 (ഇരുപത്) ശതമാനവും ഒരു ലക്ഷമോ അതിൽ കൂടുതലോ ആണെങ്കിൽ 10 ശതമാനവും കൂടുതലായിട്ടുള്ള വാഗ്ദാനങ്ങളെ സ്വീക രിക്കുകയുള്ളൂ. നിയമാനുസൃതമായ പോസ്റ്റ് ഓഫറുകൾ ഉ≠െങ്കിൽ ആയത് ലേലം/ദർഘാസ് കഴിഞ്ഞ് 7 (ഏഴ്) ദിവസത്തിനകം ഈ ഓഫീസിൽ സമർപ്പിക്കേ≠താണ്.

11. മേൽപ്പറഞ്ഞ സമയ പരിധിക്കുള്ളിൽ നീക്കംചെയ്യാത്ത വാഹനം വീ≠ും ലേലത്തിലോ ടെ≠ർ അടിസ്ഥാന ത്തിലോ മുൻലേലക്കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ വിൽക്കുന്നതും മുൻ ലേലത്തുക സർക്കാരിലേക്ക് ക≠ു കെട്ടുന്നതുമാണ്. ഈ ലേലംകൊ≠് സർക്കാരിന് നഷ്ടം സംഭവിക്കുകയാണെങ്കിൽ അങ്ങനെ നഷ്ടം വരുന്ന തുക മുൻലേലക്കാരനിൽ നിന്ന് ഈടാക്കുന്നതിനുള്ള നടപടികൾ സ്വീകരിക്കുന്നതും ലാഭം കിട്ടുകയാണെങ്കിൽ മുൻലേലക്കാരന് ആയതിന് യാതൊരു അർഹതയും ഉ≠ായിരിക്കുന്നതല്ലാത്തതും ആയത് മുഴുവൻ സർക്കാരിലേക്ക് മുതൽ കൂട്ടുന്നതുമായിരിക്കും.

12. ദർഘാസ് സ്വീകരിക്കുന്ന ദിവസം പൊതു അവധി ദിവസമായി വന്നാൽ അടുത്ത പ്രവൃത്തി ദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും ദർഘാസ്/ ലേലം നടത്തുന്നതായിരിക്കും.

13. മുകളിൽ പറഞ്ഞ വാഹനങ്ങൾക്കുപുറമെ ഏതെങ്കിലും കൂട്ടിച്ചേർക്കുന്നതിനോ ഒഴിവാക്കുന്നതിനോ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അധികാരമു≠ായിരിക്കും.

14. വാഹനത്തിന്റെ ആർ. സി. ബുക്കും മറ്റ് അനുബന്ധ രേഖകളും ഈ ഓഫീസിൽ ലഭ്യമല്ലാത്ത പക്ഷം അവ ലേലം വിളിച്ചെടുക്കുന്നവർ സ്വന്തം ഉത്തരവാദിത്വത്തിൽ ബന്ധപ്പെട്ട വകുപ്പിൽനിന്നും ലഭ്യമാക്കേ≠താണ്.

5. If the last date fixed for the receipt of the tenders happens to be a holiday, the tenders will be received and opened on the next working day at the same time and place as per the conditions specified above. If for some technical reason tender could not be conducted for any plantation on the dates mentioned above or nobody turns upto submit a tender it will be again conducted on 12-9-2012 and again on 19-9-2012 on the same time.

6. The tenders received after the specified date and time, without the requisite enclosures or tenders not written up in the proper order or form, will be rejected.

7. Each tender should be accompanied by a Fixed Deposit receipt for the amount fixed as per the schedule below obtained from a scheduled bank in favour of the Divisional Forest Officer, Nilambur North as earnest money deposit for the work.

8. Tenderers should quote uniform percentage of the Departmental estimate rate at which they can take up the work specified in the schedule both in figures and words. Fraction of one percent should not be quoted.

9. All the corrections in the tender forms should be initialled by the tenderer himself.

10. In case more than one tenderer quoted the same lowest rate the successful lowest bidder will be decided in an auction among the tenderers who quoted the same lowest rate.

11. If any of the lowest tenderer is not prepared to reduce rate in the auction without fraction of one percent it will be opened to the confirming authority to draw the tender by lots among or between the lower tenderers.

12. The lowest tender will ordinarily be accepted, provided the character and financial status of the tenderers are found satisfactory, but the authority competent to accept the tender reserves to himself the powers of accepting or rejecting any tender without assigning any reason therefore. There shall be no appeal against such action.

13. Rule notified as per G. O. (P) 62/1976/AD dated 23-2-1976 and published in the Gazette dated 9-3-1976 shall be binding on any person who makes a written tender for the works.

14. The tender submitted by timber merchants, sale coupe contractors and other persons who are engaged in timber trade within the limits of the Forest Division in which working area is situated or by the adjacent Divisions will not be accepted.

15. The tenderers should have no relationship on any Government servant who is in charge of the work or who has any direct control over the work. Relationship in this case will mean father, mother, daughter, son, brother, sister, direct uncle, nephew, father-in-law, mother-in-law and the first cousin of the officers concerned.

16. The earnest money deposit of unsuccessful tenders will be returned to them soon after opening the tenders.

17. Before submitting the tender, the tenderer, is expected to study and scrutinize all the conditions in this agreement to be executed, the draft of which can be had for perusal from the Divisional Forest Officer, Nilambur North on any working day during office hours. He should also be thorough about the field conditions, terrain, labour availability etc. No plea of ignorance of the agreement conditions and field conditions or no complaint regarding the said conditions received after putting in the tender shall be entertained on any account. A bonded agreement should be executed by the successful tenderer on the date of opening of tenders itself.

18. The successful tenderer shall within 15 days from the date of issue of the acceptance of tender, furnish a security deposit of an amount equal to 10% of the total contract value limited to a maximum of (cid:31) 2,00,000 (Rupees Two Lakhs only) and execute an agreement on a stamp paper worth (cid:31) 100 in the approved form, the same of which can be had from the Divisional Forest Officer, Nilambur North for perusal. The security amount should be remitted in the Government Treasuries duly pledged to the Divisional Forest Officer, Nilambur North. If the security is not remitted and the agreement executed within the above said period, a further period of 15 days shall be allowed by the Divisional Forest Officer, for remittance of security and the execution of the agreement subject to realization of (cid:31) 10 (Rupees ten only) per day of extension. If the tenderers remit the security within 15 days from the date of intimation of acceptance order but is not able to execute the agreement within the period, the Divisional Forest Officer may grant an extension of time for 15 days more for execution of agreement with a penalty of (cid:31) 10 per day of extension .The rate of Security Deposit/EMD are subject to variation according to the Government directions/orders issued from time to time.

19. Failure to remit the security deposit and to execute the agreement, within the time specified in the condition 18 above, will lead to cancellation of the tender by the Divisional Forest Officer and forfeiture to Government of the Earnest Money Deposit and security if any, deposited by the tenderer. The work will also be got done through other agencies at the risk and loss of the defaulter. The loss if any will be treated as arrears of public revenue and will be recovered from the defaulter under the provisions of Revenue Recovery Act or by any other legal means if not paid within a reasonable time specified by the Divisional Forest Officer. The defaulter, however will not be entitled for gain, if any.

20. The tenderer should produce valid clearance certificate of Sales Tax, Income Tax and Agricultural Income Tax to the satisfaction of the Divisional Forest Officer before the final payment is made to him in case the contract value is of and above (cid:31) 5,000 (Rupees Five thousand).

21. The contractor shall not enter or send his employees in to the working area mentioned in the schedule without previously obtaining a license for the purpose granted by the Divisional Forest Officer, Nilambur North Division. The contractor shall furnish a receipt to the Range Officers, Edavanna and Nilambur for all the trees marked and entrusted to him for felling and collection. He shall be supplied with a surveyed map of the working area, the boundaries of which have been cleared and demarcated previously. He shall keep the boundaries of this area well cleared to a width of 2 (two) meters and shall keep all the cairns along the boundaries in tact throughout the currency of this contract.

22. The contractor shall fell all the marked trees entrusted to him except those trees which have been certified by the Divisional Forest Officer after his inspection as hollow, defective or impossible to be felled without causing serious damages to their stumps or to other trees standing nearly and collect all available timber, thereof. Billets obtainable from the teak and rose wood trees also should be collected.

23. The contractor shall see that marking numbers chiselled on the trees and the departmental hammer marks affixed on the tree at the base and breast-height are not obliterated or defaced during the process of felling and conversion. If at any time the hammer mark or marking number is obliterated or defaced, he shall report the fact immediately to the Range Officer, who shall renew the hammer mark of marking number as the case may be before the timber collected is removed from the stump site. The contractor shall not remove any timber or billets converted from a tree from its stump site before all the pieces optioned from it are registered and harmer marked at both ends by the officer in charge or the felling area.

24. The contractor shall furnished to the said Divisional Forest Officer for approval a list showing the name of his agents, and other employees entered to the employed by the contractor for the supervision of the work in the contract area and no person not approved by the Divisional Forest Officer shall be employed by the contractor for the said work. Whenever the Divisional Forest Officer orders the removal of any of the contractor's employees from the contract area, Contractor shall immediately carry out the orders. The contractor shall not engage from this contract any person already engaged by the department for any other work.

25. In the case of working down round logs and firewood the contractor shall be bound to deliver at the Depot all hardwood logs within three months, from the date of registration, softwood logs within 15 days from the date of felling and billets and firewood within 2 months from the date of registration or within the contract period whichever is earlier. If the delivery of the produce is not effected within the period originally fixed as above, the Divisional Forest Officer, may grant extension for 15 days for delivery of hardwood, 15 days for softwood and 15 days for billets and firewood subject to a realization of penalty of (cid:31) 7/cum for hardwood (cid:31) 7/cum for softwood for 15 days and (cid:31) 0.50/MT for stacked billets and firewood. 15 days further extension can be granted by the Chief Conservator of Forests, Eastern Circle, Olavakkode with penalty of (cid:31)14/cum for hardwood, (cid:31) 14/cum for softwood, if the periods fall within the original or the extended contract period.

All registered logs remaining undelivered after the expiry of said period will be taken charge of by the Forest Range Officer, Edavanna and Nilambur and the contractor shall be liable to pay a fine of (cid:31) 7/cum for such undelivered logs only and forfeit all claims to 'kolevila' due thereon. The loss, if any, sustained by the Department due to deterioration on account of belated delivery or non-delivery of the timber will be made good from the contractor as assessed by the Department. The contractor should obtain receipts for the logs delivered at the Depot from the Depot Officer when the contractor will be eligible for 'kolevila' therefore. The contractor shall fell all the marked trees entrusted to him except those trees which have been certified by the Divisional Forest Officer after inspection as wholly defective or impossible to be felled without causing serious damages to their stems or to other trees standing nearby and collect all available timber thereof. For every marked trees left unfelled or felled but uncollected at the expiry of the contract period without proper authorization from the Divisional Forest Officer, the contractor is liable to pay a penalty of (cid:31) 300 per tree, besides realization of value of timber of uncollected trees as per other conditions. The value of the logs at schedule rate if rendered useless or deteriorated will be realized.

26. All timber, billets/firewood obtained from the marked trees shall be delivered at the depots specified in the schedule attached hither to within the period contract. In case of lack of sufficient space in the depots mentioned in schedule attached, the contractor is bound to work down timber to the depots decided by the Divisional Forest Officer/ Chief Conservator of Forests (Eastern Circle), Palakkad/ Chief Conservator of Forests (NR)/ Principal Chief Conservator of Forests, Thiruvananthapuram/Government. In such case the 'Kolevila' payment will be paid at the rate fixed by the Divisional Forest Officer/Chief Conservator of Forests, (Eastern Circle), Palakkad/ Chief Conservator of Forests/516 KERALA GAZETTE [PART III Government for the additional distance. To this effect in a Codicil Agreement will be executed. The Contractor shall properly stack at the depot all the billets/firewood in places pointed out and in the manner directed by the depot Officer, who will then take measurements of the stock and give the Contractor receipt in the form prescribed with in 24 hours of stacking the produce. The contractor shall be bound to accept the depot measurements of the timber, billets/fire wood as check measured by the Divisional Forest Officer or his Gazetted Assistant as correct and final.

27. The contractor shall ensure that the felling and collection, proceeds from the end of the coupe to the other end in an orderly and systematic manner and that all trees are felled as low as possible to the ground levels using saw at least on one side. All logs shall be cross cut with saw.

28. For all logs and billets selling at rates less than 'Kolevila', the 'Kolevila' payable to the contractor will be limited to the sale price.

29. If the contractor fails to undertake and complete the work within the specified time or if he leaves any item of work undone, the Divisional Forest Officer, at his discretion make other arrangements for carrying out the works left undone, either Departmentally or through other agencies at the risk and loss of the defaulting contractor and the loss if any, sustained by the Department on this account will be recovered from the security deposit or from other assets of the defaulting contractor, as if such sums are arrears of Land Revenue under the provisions of Revenue Recovery Act, in force in such other manner as the Government may deem fit.

30. If any amount becomes due to any workmen or mazdoor engaged by the contractor as per Workmen's Compensation Act or as per provisions of labour or similar laws, such amounts shall be payable by the contractor.

31. The tenderers should submit a declaration with the tender that they are not related any Government Servant who is in charge of or having control of the work for which the tender is submitted. Relationship for this purpose will be restricted to father, mother, son, daughter, sister, brother, uncle, nephew, father-in" law, mother-in-law, brother-in-law and first cousins of the Officer. If at any stage this condition is found to have been contravened the earnest money/security deposit of the tenderer/contractor will be forfeited to Government and the contract entered into will stand cancelled.

32. (a) The contractor shall not make any damage to bridges or roads and private properties during collection and transport and during unloading logs and billets from lorries and he shall be liable of any such damages. The decision of the Government regarding the amount of compensation payable for the damages caused shall be final and binding on the contractor and the Government shall recover such damages from the contractor.

(b) If the damage caused is in respect of any road under the control of the Kerala State Electricity Board or Public Works Department, the amount of compensation payable for such damages will be assessed by the Forest Range Officer, concerned and the Assistant Engineer of the concerned Division of the Kerala State Electricity Board or Public Works Department and their decision being final and binding on the contractor. In such cases the contractor shall be liable to pay the damages to the Kerala State Electricity Board or Public Works Department and they shall recover such damages from the contractor.

33. The tenderers should give an undertaking in the tender that they undertake to carryout the work at the tendered rates quoted and to abide by the terms and conditions of the tender notice and draft agreement so on by them and also other Departmental rules and orders issued by them from time to time.

34. (a) Post offers which are not advantageous by more than 5% of the lowest rate offered for the original tender (where the total cost of the work as per tender is (cid:31) 1,00,000 (Rupees One lakh) and above and more than 10% where the total cost of the work is less than (cid:31) 1,00,000 (Rupees One lakh) will be summarily rejected. In other cases it will be considered under the following conditions:—

(i) The post offer should be made within 7 days of tender.

(ii) The post offerer should remit double the security for the work based on the work offered by the lowest tenderer. The remittance should be made within 7 days from the date of receipt of registered notice.

35. (b) (i) The post offerer after satisfying the conditions specified above should also execute an agreement before the Divisional Forest Officer pledging the security for the duefulfilment of the terms.

(ii) If the post offerer satisfied the conditions specified above, re-tenders will be called for after giving the usual publicity as per the rules. In the re-tender if the rates offered does not come up to what has been offered by the post offerer it will be awarded to the post offerer at the rate offered by him. If he back out, the security amount will be forfeited to Government. If however, the rate is less than what has been offered by the post offerer in the case of re-tender, the work will be awarded to the lowest tenderer and the amount remitted by the post offerer released to him.

36. The quantity mentioned in the schedule is only approximate and the contractor is bound to work down the full quantity of timber and firewood available from trees marked and entrusted to him.

37. The period of contract will be upto 4 months from the date of intimation of acceptance of tender. No extension of the contract period shall ordinarily be granted. But if however the delay in completing the work in the contract area within the period specified in the schedule attached is due to circumstances beyond the control of the contractor extension of time may be granted for 15 days each by Divisional Forest Officer and Chief Conservator of Forests, Eastern Circle respectively, but not exceeding a total period of 30 days subject to realization of penalties as mentioned below. If he fails to undertake and complete the work within the specified time, or if he leaves any item of work undone, the Divisional Forest Officer may at his discretion make other arrangements for carrying out the work left undone either Departmentally or through other agencies at the risk and loss of the defaulting contractor, and loss if any incurred by the Department on this agencies at the risk and loss of the defaulting contractor, and loss if any incurred by the Department on this account will be recovered from the security or from other assets of the contractor.

Penalty: (a) (cid:31) 7/cum for the quantity of timber delivered at the Depot during the first extension granted by the Divisional Forest Officer.

(b) (cid:31) 14/cum for quantity of timber delivered at the Depot during the extension granted by the Chief Conservator of Forests.

(c) In the same way for billets and firewood (cid:31) 2, (cid:31) 4 for the extension granted by the Divisional Forest Officer and Chief Conservator of Forests, respectively.

38. The contractor shall be responsible for the safety of contract area and safety of all timber, billets/firewood etc. collected by him from the marked trees entrusted to him until they are finally delivered at the prescribed Depots. If any of the logs/billets/firewood be burnt, lost rendered useless or otherwise destroyed before their delivery at depot their value calculated at the current schedule rate will be recovered from the contractor in the case of Teak and Rose wood logs, the value calculated at the highest sale rate for the specious in the depot in which the timber is scheduled to be delivered obtained during the year prior to the date on which such timber is found lost but it shall be recovered from the Contractor. In the Case billets/fire wood the value calculated at the schedule rate or average sale rate of the depot, whichever is higher, will recovered. The above mentioned safety shall include safety of contract area from fire, theft and biotic interference.

39. The Divisional Forest Officer reserves to himself the power to eliminate any tree marked and entrusted to the contractor from felling if it is found during the course of the contract that timber obtainable from such trees have no reasonable market or by some other reasons and the contractor is not entitled to claim any compensation for such elimination.

40. (i) Payment will be based on actual measurement of each work and no basic rate will be followed. In any circumstances no part payment will be allowed before delivery of timber at depot. Payment for ancillary works like roads, fire line etc. will be made only after completion of the whole works.

(ii) Ten percent of each Kolevila bill will be withheld as retention amount which will be released after the connected logs are sold and the liability if any in respect of these logs with the contract is settled.

(a) In case of works, the contract value which exceeds (cid:31) 10,000 Income Tax at the rate of two percent of payment made shall be deducted at each time when payments are made except in the case of non-resident contractors.

41. For working down logs, seignorage on vakka fibre calculated at one vakka drag rope, for every two cum or fraction thereof and grazing fee for one elephant for every two cubic metres or fraction thereof for timber will be recovered from the contractor on the actual quantity collected and Sales Tax on vakka charges as per the rules in force.

(a) All timber the contractor is under obligation to deliver at the prescribed Depots shall be transported to such Depot only along the routes specified in the transport permit. If in the course of work it become necessary to deviate from the routes specified in the schedule, the contractor may be allowed to transport timber and firewood along the deviated routes, provided the Department is satisfied of the necessity for the deviation in the routes. In the case of such deviation in routes, the contractor will be eligible to get 'Kolevila' at the rates worked for those new route minus tender reduction with prior sanction of the Chief Conservator of Forests. Quantity to be supplied to different Depots shall also be changed by the Divisional Forest Officer with prior sanction from the Chief Conservator of Forests.

42. The contractor shall collect all timber available from the trees marked in the plantation within the said contract period as per the instructions issued by the Divisional Forest Officer, Niiambur North. If the collection is delayed the contractor will be liable to pay a penalty at the rate specified above for the timber for the belated period.

43. The contractor should achieve, show and register progress in working down timber.

44. If the rates quoted in the re-tender is more than quoted in the original tender the difference between them and all the expenditure incidental in fixing up of re-tender including notification charges as assessed by the Divisional Forest Officer, Nilambur North will be recovered from the defaulting tenderer through any legal means including Revenue Recovery Act.

45. Further particulars can be had from the Divisional Forest Officer, Nilambur North or the Range Officer, Edavanna and Nilambur on any working days during office hours. Estimate rate given is subject to the approval of Chief Conservator of Forests and exact estimate rate would be given along with the schedule in the tender form.

The tender is fixed to be conducted on 24-8-2012 at the office of the Wildlife Warden, Wayanad Wilde Life Division, Sulthan Bathery. The tender forms can be purchased from the office of the undersigned during office hours upto 1 p. m. on all working days till the tender date. Cost of tender form is non refundable. The intending tenderer should apply with proof of identity such as Electoral Identity Card, Driving License, Indian Passport etc. along with the Registration Certificate in original to get the tender form. The tender form should be properly filled up and should be submitted on or before 2 p. m. on 24-8-2012. It should be accompanied by all necessary documents along with the Earnest Money Deposit by way of Bankers DD or Fixed Deposit or National Savings Certificate pledged in favour of Wildlife Warden, Wayanad Wildlife Division, Sulthan Bathery payable at Sulthan Bathery. The intending tenderers should also furnish a preliminary agreement in stamp paper worth (cid:31) 100 along with tender for each work. Incomplete tender or tenders without necessary documents or tenders not in accordance with tender conditions will not be accepted. Tenders will be opened by the Wildlife Warden or an Officer authorized by him at 3.30 p.m. on the same day, in the presence of those tenderers who are present at that time. The Wildlife Warden reserves the right to reject any tender, either partly or wholly without assiging any reason thereof. If the tender could not be conducted on the notified date due to any reason, it will be conducted at the same place and time on the next working day as per the same conditions.

If the tender for all works or any of the work could not be conducted on the said date/dates, the tender for such work/works will be conducted at the above place and time with same conditions on 4-9-2012. If the tender could not be conducted on that day, it will be conducted on 7-9-2012. If it could not be conducted on that day also, it will be conducted on 11-9-2012. All existing rules, regulations, directions, conditions etc., prevailing in Kerala PWD and Kerala Forest Department and Store Purchase Department in respect of civil works shall be applicable in these works and tender also.
