NOTIFICATION

In exercise of the powers conferred by Article 227 of the Constitution of India, S. 477 of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974) and of all other powers hereunto enabling and with the previous approval of the Governor of Kerala conveyed in G.O.(Ms) No. 226/2012/Home dated 18-8-2012, the High Court of Kerala hereby makes the following amendments to the Criminal Rules of Practice, Kerala, 1982, published in Part III of the Kerala Gazette No. 33 dated 14th August, 1984.

statement under Section 164 of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974) or a dying declaration, shall prepare such confession/statement/declaration in duplicate and retain one such confession/statement/ declaration in his court, after duly entering the particulars of such confession/statement/ declaration in Administrative Form No. 46." (ii) in Appendix II,—

(a) under the heading "Administrative Forms", under the sub-heading "Form No. and description", after Sl. No. 45 and the entries against it, the following serial

AMENDMENTS

In the Criminal Rules of Practice, Kerala, 1982,—

(i) the existing Rule 71 shall be re-numbered as sub-rule (1) thereof and after sub-rule (1) as so renumbered, the following sub-rule shall be inserted, namely:—

In exercise of the powers conferred by Section 11(3) of the Code of Criminal Procedure 1973, the High Court of Kerala hereby appoints the person mentioned in In the Criminal Rules of Practice, Kerala, 1982, there is no provision to retain the certified copies of dying declarations and statements under Section 164 of the Code of Criminal Procedure, 1973. As the above documents are very crucial for adjudication, the High Court is convinced that it will be helpful if the judicial9th OCT. 2012] JUDICIAL DEPARTMENT 53 column (2) of the schedule hereto attached to be the Judicial Magistrate of the first class to preside over the Court specified against his name in column (3) thereof from the date on which he takes charge.

In exercise of the powers conferred by Sub-section (1) of Section 260 of the Code of Criminal Procedure 1973, the High Court of Kerala hereby specifically empowers the Judicial Magistrate of the first class mentioned in column (2) of the schedule hereto attached to try in a summary way all the offences mentioned in the said sub-section.

ക്രിമിനൽ ജുഡീഷ്യൽ ഡിപ്പാർട്ടുമെന്റ ിന്റെ വകയിലു ള്ളതും പത്തനംതിട്ട ചീഫ് ജുഡീഷ്യൽ മജിസ്ട്രേറ്റിന് അനുവദിച്ചി ട്ടുള്ളതും ക≠ം ചെയ്യുവാൻ അനുമതിയായി കഴിഞ്ഞതുമായ കെ.എൽ.3ബി-3883 അംബാസിഡർ ഡീസൽ കാർ ബഹു. കേരളാ ഗവൺമെന്റിന്റെയും കേരളാ ഹൈക്കോടതി രജിസ്ട്രാറി ന്റെയും ഉത്തരവുകൾ പ്രകാരം 30-11-2012-ൽ അപ്പോഴുള്ള സ്ഥിതിയിലും അവസ്ഥയിലും അന്നേദിവസം 2 മണിക്ക് ദർഘാസ്/ലേല അടിസ്ഥാനത്തിൽ വിൽപ്പന നടത്തുന്നു. വെള്ളകടലാസിൽ വിശദമായി എഴുതിയ ദർഘാസുകൾ അന്നേ ദിവസം രാവിലെ 11 മണിവരെ ഈ ഓഫീസിൽ സ്വീകരിക്കു ന്നതും 4 മണിക്ക് ദർഘാസുകൾ സമർപ്പിച്ചവരെ മാത്രം ഉൾപ്പെടുത്തി ചീഫ് ജുഡീഷ്യൽ മജിസ്ട്രേറ്റോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റൊരു ജുഡീഷ്യൽ ഓഫീസറോ ടി വാഹനം പരസ്യമായി ലേലം ചെയ്തു കൊടുക്കുന്നതും ആയിരിക്കും. ടി വാഹനത്തിന് അടിസ്ഥാന ലേല തുക ` 40,000 (നാൽപതിനായിരം) (നികുതിക്കുപുറമെ) ആയി നി›യിച്ചിട്ടുള്ളതാകുന്നു. പരസ്യമായ ലേലത്തിനുശേഷം ദർഘാസുകൾ ഇറക്കുന്നതും ലേലത്തിലോ ദർഘാസിലോ കൂടുതൽ തുക വാഗ്ദാനം ചെയ്യുന്നവരുടെ പേരിൽ ചീഫ് ജുഡീഷ്യൽ മജിസ്ട്രേറ്റിന്റെ അന്തിമ ഉത്തരവിന് 2. ദർഘാസ് അപേക്ഷകളോടൊപ്പം അപേക്ഷകരെ തിരിച്ചറിയുന്നതിലേക്ക് ബന്ധപ്പെട്ട വില്ലേജ് ആഫീസറോ, മറ്റ് അധികാരപ്പെട്ട ഉദ്യോഗസ്ഥരോ നൽകിയ സർട്ടിഫിക്കറ്റ് അല്ലെങ്കിൽ റേഷൻ കാർഡിന്റെ പകർപ്പ്, ഇലക്ഷൻ കമ്മീഷന്റെ തിരിച്ചറിയൽ കാർഡ്, പാസ്പോർട്ടിന്റെ കോപ്പി എന്നിവ സമർപ്പിക്കേ≠താണ്.

3. നി›ിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ദർഘാസുകൾ പരിഗണിക്കുന്നതല്ല.

4. ലേലം കൂടുതൽ തുക വാഗ്ദാനം ചെയ്യുന്ന രീതിയിൽ അംഗീകരിക്കുന്നതും മറ്റ് ദർഘാസുകാർ നൽകിയ നിരതദ്രവ്യം ലേലത്തിനുശേഷം തിരിച്ചു നൽകുന്നതുമാണ്.

5. ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനും യാതൊരു കാരണവും പറയാതെ നിരാകരിക്കുന്നതിനുള്ള പൂർണ്ണ അധികാരം ദർഘാസ്/ലേലം ചെയ്യുന്ന ഉദ്യോഗസ്ഥന് ഉ≠ായിരിക്കും.

6. ദർഘാസ്/ലേലം അംഗീകരിച്ചതായി അറിയിപ്പ് കിട്ടി ഉടൻ തന്നെ ലേല സംഖ്യയും നിയമപ്രകാരമുള്ള നികുതികളും അടച്ച് വാഹനം മൂന്നു ദിവസത്തിനകം നീക്കം ചെയ്യേ≠ താണ്. ദർഘാസുകാരൻ ആവശ്യപ്പെടുന്ന പക്ഷം 3 ദിവസം കൂടി വാഹനം നീക്കം ചെയ്യാൻ അനുവദിക്കും. അതിനുശേഷം അവധി അനുവദിക്കുന്നതല്ല.
