Rule-15, Smt. P. Sosamma, formerly, Agricultural Officer,
Krishi Bhavan, Iverkala, Kollam District of
KCS (CC & A) Rules 1960, Rule 24 of Part—1 KSRs and
Appendix XII-A of Part—1—KSRs is removed from
service with effect from 6-4-1992 ie, the date from which
she unauthorisedly absented from duty and order
accordingly.

ആലപ്പുഴ ജില്ലാ പഞ്ചായത്തിന്റെ നിയന്ത്രണത്തിൽ
പ്രവർത്തിക്കുന്ന മാവേലിക്കര ജില്ലാ കൃഷിത്തോട്ടം, സൂപ്ര≠്
ഫാമിൽ സംരക്ഷിച്ചുവരുന്ന 1233 തെങ്ങുകളിൽ നിന്നും 2013
ജനുവരി മാസം 1 മുതൽ 2013 ഡിസംബർ 31 വരെയുള്ള
കാലയളവിൽ മൂപ്പെത്തിയ വിളഞ്ഞ തേങ്ങ ശേഖരിക്കുന്ന
തിനുള്ള അവകാശം ടെ≠ർ വ്യവസ്ഥ പ്രകാരം വിൽപ്പന
ഉറപ്പിക്കുന്നതാണ്. താൽപ്പര്യമുള്ളവർ 2012 ഡിസംബർ 22
ശനിയാഴ്ച രാവിലെ 11 മണിക്ക് ടി ഓഫീസിൽവച്ച്
നടത്തുന്ന ടെ≠റിൽ പങ്കെടുക്കേ≠താണ്. അന്നേ ദിവസം
ഏതെങ്കിലും കാരണവശാൽ ടെ≠ർ നടക്കാതെവന്നാൽ from 6-4-1992 to 4-7-1992 and requested to sanction five years leave without allowance from 6-4-1992 and submitted leave application. So also the above said 90 days Leave without allowance was cancelled vide Order No. E (1) 13118/92 dated 10-11-1992 of Principal Agricultural Officer, Kollam. Later on Principal Agriculture Officer, Kollam reported that Smt. P. Sosamma, Agricultural Officer had left India without getting the leave sanctioned. That was reported to Government. Government have directed to take disciplinary action against Smt. P. Sosamma, Agricultural Officer, who had left the country without getting the leave sanctioned as per Appendix XII-A. Part I KSR. Accordingly a memo of charges with statement of allegations were issued to her vide 1st paper read above. Smt. P. Sosamma, Agricultural Officer had submitted her defence statement vide 2nd paper read above. But the explanation was not satisfactory and not acceptable. In this circumstances above, a detailed enquiry was found necessary and Sri R. Sasidharan, the then Joint Director of Agriculture (AR and T) who was subsequently promoted as Senior Additional Director of Agriculture was appointed as the Enquiry Officer vide 3rd paper read above in this case as per rule 15 of KCS (CC & A) Rules 1960. Accordingly, the Enquiry Officer had decided to conduct the enquiry into the charges issued to her on 26-6-1996 at 11 a. m. in his chamber at Vikas Bhavan and directed her to attend the enquiry with necessary defence statements. But she had not attended the enquiry on 26-6-1995 and the intimation, letter sent to her address in Australia was returned to this office without acknoweldging the same vide 4th paper read above.

But she had not attended the enquiry also. The Enquiry Officer had submitted the report vide 6th paper read above. In the enquiry the charges levelled against her were stood proved.

രേഖപ്പെടുത്തിയിരിക്കണം.
2. പൂരിപ്പിച്ച ടെ≠ർ ഫോറം 2012 ഡിസംബർ 22
ശനിയാഴ്ച രാവിലെ 10.30-ന് മുമ്പായി ഓഫീസിൽ
സമർപ്പിക്കേ≠താണ്.
In the above circumstances, a show cause notice has been sent to her vide 7th paper above with a copy of Enquiry Report that it has been provisionally decided to remove her from sevice with effect from 6-4-1992, ie, the date in which she was unauthorisedly absenting from duty as per Rule-15 of KCS (CC & A) Rules 1960, Rule 24 of Part-1 KSRs and Appendix XII—A of Part-I—KSRs and a show cause notice was sent to her vide 7th paper read above. She was allowed a period of 15 days to submit her written explanation if any in the matter, which was sent to her by Registered Post. But the same was also returned to the Director of Agriculture due to non receipt of the Registered letter. The above show cause notice was published in two leading dailies ie Kerala Kaumudi and Deshabhimani and awaited for further response if any from her vide 8 th paper read above. No reply or any communication has been received from her till date in response to one show casuse notice.
27th NOV. 2012] AGRICULTURE DEPARTMENT 713. ടെ≠റിൽ ഏറ്റവും കൂടുതൽ തുക വാഗ്ദാനം ചെയ്യുന്നയാൾ നിരതദ്രവ്യത്തിനു പുറമെ മൊത്തം തുകയുടെ മൂന്നിൽ ഒരു ഭാഗം അപ്പോൾ തന്നെ അടയ്ക്കേ≠താണ്. അല്ലാത്തപക്ഷം പ്രസ്തുത വ്യ‡ിയുടെ നിരതദ്രവ്യം സർക്കാരിലേക്ക് മുതൽ കൂട്ടുന്നതായിരിക്കും. ടിയാളുടെ നഷ്ടോത്തരവാദിത്വ ത്തിൽ പുനർലേലം നടത്തുന്നതുമായിരിക്കും.
4. ലേലം അംഗീകരിച്ച് അറിയിപ്പ് കിട്ടി 7 ദിവസത്തിനകം 100 മുദ്രപത്രത്തിൽ ഒരു കരാർ എഴുതി (cid:31) നൽകേ≠തും ലേലത്തുകയുടെ 5 ശതമാനം തുക സെക്യൂരിറ്റിയായും ലേലത്തുകയുടെ മൂന്നിൽ ഒരു ഭാഗം കഴിച്ച് ബാക്കിയുള്ള മുഴുവൻ സംഖ്യയും അടച്ച് ലേല ക്കാരന്റെ സ്വന്തം ചെലവിലും ഉത്തരവാദിത്വത്തിലും വിളവെടുപ്പ് നടത്തേ≠തും വിളവെടുത്ത തേങ്ങയുടെ എണ്ണം ഓഫീസിൽ അറിയിക്കേ≠തും അതിനുശേഷം ഫാമിനുപുറത്തേക്ക് കൊ≠ുപോകേ≠തുമാണ്. ഫാമിന്റെ പ്രവൃത്തി ദിവസങ്ങളിൽ മാത്രമേ ഇവ പുറത്തേക്ക് കൊ≠ുപോകുവാൻ പാടുള്ളൂ.
5. തേങ്ങ വിളവെടുപ്പ് നിലവിലുള്ള തെങ്ങുകയറ്റ തൊഴിലാളിയെ കൊ≠് ചെയ്യിക്കണം. ടി വ്യവസ്ഥകൾ കരാർ എഴുതുമ്പോൾ ഉൾപ്പെടുത്തേ≠താണ്.
6. കരാറുകാരൻ ഈ കാലയളവിൽ എല്ലാ തെങ്ങുകളു ടെയും മ≠ വൃത്തിയാക്കുകയും ടി കാലയളവിൽ 45 ദിവസത്തെ ഇടവേളകളിൽ കുറയാതെ വിളവെടുപ്പ് നടത്തേ≠തുമാണ്.
7. കരാർ കാലയളവിൽ തെങ്ങ് വിളവെടുപ്പ് നടത്തുന്ന അവസരത്തിൽ ലഭിക്കുന്ന ഓല, കൊതുമ്പ് എന്നിവ കരാറുകാരന് അവകാശപ്പെട്ടതാണ്. എന്നാൽ വിളവെടുപ്പിന്റെ ഇടവേളകളിൽ വീഴുന്ന ഓല, കൊതുമ്പ് എന്നിവയിൽ കരാറുകാരന് അവകാശം ഉ≠ായിരി ക്കുന്നതല്ല.
8. നാളികേര വിളവെടുപ്പ് 2013 ഡിസംബർ 31-ന് കഴിഞ്ഞി രിക്കേ≠താണ്. ഇളം പ്രായത്തിലുള്ള കരിക്ക്, മൂപ്പെത്താത്ത നാളികേരം എന്നിവ യാതൊരു കാരണവശാലും ഇടാൻ പാടുള്ളതല്ല. മറിച്ച് ചെയ്യുന്നതായി ശ്രദ്ധയിൽപെട്ടാൽ അത്രയും തേങ്ങ ലേലവ്യവസ്ഥയ്ക്ക് പുറത്തുള്ളതായി കണക്കാക്കുകയും അതിന്റെ വില ഫാം നിരക്കനുസരിച്ച് ലേലക്കാരനിൽ നിന്നും വസൂലാക്കുന്നതുമായിരിക്കും.
9. പ്രത്യേക കാരണം കാണിക്കാതെ തന്നെ ടെ≠ർ അസ്ഥിരപ്പെടുത്തുവാനുള്ള അധികാരം ഫാം സൂപ്ര≠ിന്/ആലപ്പുഴ ജില്ലാ പഞ്ചായത്തിന് ഉ≠ായിരി ക്കുന്നതാണ്.
10. ടെ≠ർ നടപടികൾ സംബന്ധമായ ഫാം സൂപ്ര≠ിന്റെ തീരുമാനം ആലപ്പുഴ ജില്ലാ പഞ്ചായത്ത്/ആലപ്പുഴ പ്രിൻസിപ്പൽ കൃഷി ഓഫീസറുടെ അംഗീകാരത്തിന് വിധേയമായിരിക്കും.
11. മറ്റെല്ലാ സർക്കാർ ടെ≠ർ വ്യവസ്ഥകളും ഇതിനും ബാധകമാണ്.
12. ഫാമിൽ നിന്നുള്ള നിർദ്ദേശങ്ങൾക്ക് വിരുദ്ധമായി പ്രവർത്തിക്കുകയോ, ഫാമിലെ വസ്തുവകകൾക്ക് ഏതെങ്കിലും തരത്തിലുള്ള നാശനഷ്ടങ്ങൾ വരുത്തുകയോ ചെയ്താൽ ആയതിനുള്ള നഷ്ടം ലേലക്കാരനിൽ നിന്നും ഈടാക്കുന്നതാണ്.
13. പ്രവൃത്തി ദിവസങ്ങളിൽ രാവിലെ 8 മുതൽ വൈകിട്ട് 5 മണി വരെ മാത്രമേ വിളവെടുക്കുവാൻ അനുവദിക്കുകയുള്ളൂ.
14. കൂടുതൽ വിവരങ്ങൾ പ്രവൃത്തി ദിവസങ്ങളിൽ ഫാം ഓഫീസിൽ നിന്നും നേരിട്ടറിയാവുന്നതാണ്.
