1981-ലെ കേരള സർവ്വെയും അതിർത്തിയും സംബന്ധിച്ച ആക്ടിലെ 13-ാം വകുപ്പ് പ്രകാരമുള്ള പരസ്യം നമ്പർ ഡി1-308/1996. 2012 നവംബർ 30.

1. താഴെപ്പറയുന്ന പ്രദേശങ്ങളിലെ റീസർവ്വെ ഇപ്പോൾ പൂർത്തിയായിരിക്കുന്നതായി 1961-ലെ കേരള സർവെയും അതിർത്തിയും സംബന്ധിച്ച ആക്ടിലെ (1961-ലെ 37-ാം) വകുപ്പ് പ്രകാരം ഇതിനാൽ പരസ്യം ചെയ്യുന്നു.

2. പ്രസ്തുത ആക്ടിലെ 14-ാം വകുപ്പിലെ വ്യവസ്ഥകൾ പ്രകാരം ഒരു സിവിൽ കോടതിയുടെ ഡിക്രിമൂലം ഇതിനാൽ പരസ്യം ചെയ്യുന്ന റീസർവെ ഭേദഗതി ചെയ്യപ്പെടുന്നില്ലെങ്കിൽ ഈ റീസർവെ റിക്കാർഡ് അതിർത്തി നിർണ്ണയിക്കുകയും രേഖപ്പെടു ത്തുകയും ചെയ്തിട്ടുള്ള അതിരുകൾ ശരിയായി നിർണ്ണയിക്കുകയും രേഖപ്പെടുത്തുകയും ചെയ്തിട്ടു≠െന്നുള്ളതിന്റെ തർക്കമറ്റ തെളിവായിരിക്കു ന്നതുമാണ്.

1. താഴെപ്പറയുന്ന പ്രദേശങ്ങളിലെ റീസർവ്വെ ഇപ്പോൾ പൂർത്തിയായിരിക്കുന്നതായി 1961-ലെ കേരള സർവെയും അതിർത്തിയും സംബന്ധിച്ച ആക്ടിലെ (1961-ലെ 39-ാം ആക്ട് 13-ാം) വകുപ്പ് പ്രകാരം ഇതിനാൽ പരസ്യം ചെയ്യുന്നു.

2. പ്രസ്തുത ആക്ടിലെ 14-ാം വകുപ്പിലെ വ്യവസ്ഥകൾ പ്രകാരം ഒരു സിവിൽ കോടതിയുടെ ഡിക്രിമൂലമോ 2007-ലെ ഭേദഗതി ആക്ട് 29 പ്രകാരം സെക്ഷൻ 13എ അനുസരിച്ച് ജില്ലാ കളക്ടറുടെ ഉത്തരവുപ്രകാരമോ ഇതിനാൽ പരസ്യം ചെയ്യുന്നു. റീസർവെ ഭേദഗതി ചെയ്യപ്പെടുന്നില്ലെങ്കിൽ റീ സർവ്വെ റിക്കാർഡ്സ് അതിൽ നിർണ്ണയി ക്കുകയും രേഖപ്പെടുത്തുകയും ചെയ്തിട്ടുള്ള അതിരുകൾ ശരിയായി നിർണ്ണയിക്കുകയും രേഖപ്പെടു ത്തുകയും ചെയ്തിട്ടു≠െന്നുള്ളതിന്റെ തർക്കമറ്റ തെളിവായിരിക്കുന്നതുമാണ്.

UNDER SECTION 13 OF THE KERALA SURVEY AND BOUNDARIES ACT, 1961

1. It is hereby notified under section 13 of the Kerala Survey and Boundaries Act, 1961 (Act 37 of 1961) that the survey of the undermentioned areas are now completed.

2. Unless the survey hereby notified is modified by a decree of a Civil Court under the provision of Section 14 of the said Act, or as per the Order of District Collector under section 13A of the Amendment Act 29 of 2007 the records of the survey shall be conclusive proof that the boundaries determined and recorded there in have been correctly determined and recorded.

താഴെപ്പറയുന്ന ഭൂമിയുടെ ഉള്ളിലോ അഥവാ അവയോട് ചേർന്നോ സ്ഥിതിചെയ്യുന്ന രജിസ്റ്റർ ചെയ്ത ഭൂമിയിൽ അവകാശമു≠െന്ന് തേർച്ച ചെയ്യുന്ന ഏതൊരാളേയും നേരിട്ടോ ഏജന്റ ് മുഖേനയോ സ്ഥലത്ത് ജോലി ചെയ്യുന്ന സർവ്വെയറുടെ അടുത്ത് ഹാജരാക്കുന്നതിനും അതിരുകൾ കാണിച്ചുകൊടുക്കുന്നതിനും അതിനോട് ബന്ധപ്പെട്ട വിവരങ്ങൾ നൽകുന്നതിനും വേ≠ി അതാതു സമയം ആവശ്യപ്പെടുമ്പോൾ ഹാജരാക്കുന്നതിനും വേ≠ി ഇതിനാൽ ക്ഷണിച്ചുകൊള്ളുന്നു.

പ്രസ്തുത ആക്ടിലെ 6 (2) എന്ന വകുപ്പു പ്രകാരം ഈ പരസ്യം താഴെപ്പറയുന്ന ഭൂമിയിൽ അവകാശ ബന്ധമുള്ള ഏതൊരാൾക്കുമുള്ള സാധുവായ നോട്ടീസ് ആയി കണക്കാക്കപ്പെടുന്നതാണ്.

പ്രസ്തുത ആക്ടിലെ 6(3) എന്ന വകുപ്പ് പ്രകാരം രജിസ്റ്റർ ചെയ്ത എല്ലാ കൈവശക്കാരും:—

(എ) സർവ്വെ ചെയ്യുന്നതിനുവേ≠ി നിർമ്മാർ÷നം ചെയ്യേ≠ ആവശ്യമു≠ായേക്കാവുന്ന വല്ല മരങ്ങളോ, കുറ്റിക്കാടുകളോ വേലികളോ നിൽക്കുന്ന വിളകളോ അഥവാ സാരവത്തായ മറ്റ് തടസ്സങ്ങളോ 15 ദിവസത്തിനകം മുറിച്ചു കളയുകയോ നീക്കം ചെയ്യുകയോ ചെയ്ത് അതിരുകളോ മറ്റ് ലൈനുകളോ വെടിപ്പാക്കണ മെന്നും;

(ബി) കൊടിപിടിക്കുന്നവരേയും ചെയിൻമാൻമാരേയും നിയോഗിച്ച് അതാത് സമയം ആവശ്യമാ യേക്കാവുന്ന സമയത്തേക്കും കാലത്തേക്കും തൊഴിലാളികളെ ഏർപ്പെടുത്തണമെന്നും;

നിറമരുതൂർ വില്ലേജ് റി.സ. 332/8-ൽ (ഒട്ടളവ് 74 സെന്റ ്) പ്പെട്ട 24 സെന്റ ് ഭൂമി 2163/78 നമ്പർ ആധാരപ്രകാരം പഴയപുത്തൻ വീട്ടിൽ കാടായിൽ കുഞ്ഞിമൂസ്സയിൽ നിന്നും ഞാളുപറമ്പിൽ മുഹമ്മദ് മുതൽ 5 ആളുകൾ പേരിൽ തിരു ലഭിച്ചതും 3209/09 നമ്പർ ആധാരപ്രകാരം മറ്റുള്ള 4 അവകാശികളിൽ നിന്നും കൂട്ടവകാശ ഒഴിമുറി വാങ്ങിയതുമാണ്.

ടി ഭൂമി പുറമ്പോക്കിലോ, പഞ്ചായത്തിലോ നിക്ഷിപ്തമായ ഭൂമിയല്ലായെന്നും, അപേക്ഷകൻ സ്വകാര്യ സ്വത്തായി കൈവശം വെച്ചു വരുന്നതാണെന്നും ടി ഭൂമി പട്ടയഭൂമിയാക്കി മാറ്റി രജിസ്റ്റർ ചെയ്യുന്നതിന് അയൽ കൈവശക്കാർ സമ്മതപത്രം നൽകിയിട്ടു≠െന്നും തഹശീൽദാർ റിപ്പോർട്ട് നൽകിയിട്ടു≠്.

ടി ഭൂമിയിൽ അവകാശം തെളിയിക്കുന്ന അസ്സൽ ആധാരങ്ങൾ, മറ്റു രേഖകൾ ഇവ സഹിതം ഹാജരാകുവാൻ അപേക്ഷകന് നോട്ടീസ് നൽകുകയും അപേക്ഷകൻ അബൂബക്കർ 9-4-2012-ന് ഹാജരായി രേഖകൾ ഹാജരാക്കുകയും ചെയ്തു.

തിരൂർ തഹശീൽദാരുടെ റിപ്പോർട്ടും, രേഖകളും പരിശോ ധിച്ചതിൽ അപേക്ഷക്കാസ്പദമായ ഭൂമി അപേക്ഷകൻ ആധാരപ്രകാരം കൈവശം വെച്ചുവരുന്നതായി കാണുന്നു. കൂടാതെ 5-6-2012-ന് സ്ഥലപരിശോധന നടത്തി. ടി വസ്തു വില്ലേജ് റിക്കാർഡ് പ്രകാരം കുളമാണെങ്കിലും, സ്ഥലപരിശോധനയിൽ കുളം തൂർത്ത് പുരയിടമാക്കിയിട്ടുള്ള തായി കാണുകയു≠ായി. ടി സ്ഥലത്ത് 15-35 വർഷം പ്രായമുള്ള തെങ്ങുകളും, മറ്റ് മരങ്ങളുമു≠്. അപേക്ഷാ വസ്തു വിന്റെ തെക്കും, വടക്കും അന്യകൈവശമുള്ള നികുതി കെട്ടാത്ത ഭൂമികളും, കിഴക്കും, പടിഞ്ഞാറും അപേക്ഷകന്റെ തന്നെ കൈവശമുള്ള പട്ടയഭൂമികളുമാണ്.

സ്ഥലപരിശോധനയുടെയും തിരൂർ തഹശീൽദാരുടെ റിപ്പോർട്ടിന്റെയും ഹാജരാക്കിയ രേഖകളുടെയും അടിസ്ഥാനത്തിൽ, തിരൂർ താലൂക്ക്, നിറമരുതൂർ വില്ലേജ,് റി.സ. 332/8-ൽപ്പെട്ട 24 സെന്റ ് നി.കെ. ഭൂമി എം. എൽ. ആർ. ആക്ട് പ്രകാരം രജിസ്റ്റർ ചെയ്തു നൽകുന്നതിനെതിരെ ആക്ഷേപങ്ങൾ ക്ഷണിച്ചുകൊ≠ുള്ള നോട്ടീസ് 24-7-2012-ലെ 30-ാം നമ്പർ കേരള ഗസറ്റിലും, താലൂക്ക് ഓഫീസ്, വില്ലേജ് ഓഫീസ്, ഗ്രാമപഞ്ചായത്ത് ഓഫീസ്, കൃഷി ഭവൻ നോട്ടീസ് ബോർഡുകളിലും വഹ സ്ഥലത്തും പരസ്യപ്പെടുത്തിയെങ്കിലും ആരും തന്നെ ആക്ഷേപമോ അവകാശമോ തേർച്ചയോ ഉന്നയിച്ചിട്ടില്ല.

മേൽ സാഹചര്യത്തിൽ തിരൂർ താലൂക്ക്, നിറമരുതൂർ വില്ലേജ്, റി.സ. 332/8-ൽപ്പെട്ട 24 സെന്റ ് നി.കെ. ഭൂമി അപേക്ഷകനായ ഞാളുപറമ്പിൽ അബൂബക്കർ s/o മുഹമ്മദ്, നിറമരുതൂർ എന്നയാളുടെ പേരിൽ എം. എൽ. ആർ. ആക്ട് പ്രകാരം രജിസ്റ്റർ ചെയ്യുന്നതിന് അനുമതി നൽകികൊ≠് ഇതിനാൽ ഉത്തരവാകുന്നു. തിരൂർ തഹശീൽദാർ, ടി ഭൂമി പട്ടയ ഭൂമിയാക്കി മാറ്റി റവന്യൂ റിക്കാർഡുകളിൽ ആവശ്യമായ മാറ്റങ്ങൾ വരുത്തുന്നതിനും അപേക്ഷകനിൽ നിന്നും കുടിശ്ശിക അടക്കമുള്ള ഭൂനികുതി ഈടാക്കുന്നതിനുള്ള നടപടികൾ സ്വീകരിക്കേ≠തുമാണ്.

NOTIFICATION

UNDER SECTION 6(1) OF THE KERALA SURVEY AND BOUNDARIES ACT 1961

NO. G3-6879/09. 19th November 2012.

Whereas, the Government have directed the survey of land comprised in survey number noted below, it is hereby notified under sub-section (1) of Section 6 of the Kerala Survey and Boundaries Act, 1961, that the survey operation will be started in the Village soon and the survey number of the Village noted below will be demarcated and surveyed and that every persons claiming to be interested in the registered land situated within or adjoining the undermentioned land is hereby invited to attend immediately either in person or by agent on the surveyor employed in the locality and also from time to time when called upon for the purpose of pointing out the boundaries and supplying information in connection therewith.

Under sub-section (2) of Section 6 of the above said Act, this notification shall be held to be a valid notice to every person having any interest in the undermentioned land.

Under sub-secion (3) of Section 6 of the above said Act, all the registered holders are hereby required:—

(a) to clear within 15 days by cutting down or removing any trees, jungle, fences, standing crops or other material obstructions, the boundaries or other lines the clearance of which may be necessary for the purpose of survey; and

(b) to provide labour at such time and for such periods as may from time to time be required by furnishing flag holders and chainman; and (c) to provide suitable survey marks and otherwise to give such assistance in the survey as may be demanded under the said Act or the rules made thereunder.

If any person fails to comply with these requisitions under clauses (a) to (c) mentioned above, the work will be got done by employing hired labour and the cost here of will be recovered from the defaulters as provided in the Act and Rules made thereunder.

NOTIFICATION

UNDER SECTION 6(1) OF THE KERALA SURVEY AND BOUNDARIES ACT, 1961

Ref. 7809/96/H2. 21st November 2012.

Whereas, the Government have directed the survey of lands comprised in survey numbers noted below, it is hereby notified under sub-section (1) of Section 6 of the Kerala Survey and Boundaries Act, 1961, that the survey operation will be started in the Village soon and the survey number of the Village noted below will be demarcated and surveyed and that every persons claiming to be interested in the registered lands situated within or adjoining the undermentioned land is hereby invited to attend immediately either in person or by agent on the surveyor employed in the locality and also from time to time when called upon for the purpose of pointing out the boundaries and supplying information in connection therewith.

Under sub-section (2) of Section 6 of the said Act, this notification shall be held to be a valid notice to every person having any interest in the undermentioned land.

Under sub-secion (3) of Section 6 of the above said Act, all the registered holders are hereby required:—

(a) to clear within 15 days by cutting down or removing any trees, jungle, fences, standing crops or other material obstructions, the boundaries or other lines, the clearance of which may be necessary for the purpose of survey; and

(b) to provide labour at such time and for such periods as may from time to time be required by furnishing flag holders and chainman; and (c) to provide suitable survey marks and otherwise to give such assistance in the survey as may be demanded under the said Act of the rules made thereunder.

If any person fails to comply with these requisitions under clauses (a) to (c) mentioned above, the work will be got done by employing hired labour and the cost thereof will be recovered from the defaulters as provided in the Act and Rules made thereunder.
