സൂചന:— നെടുമങ്ങാട് അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ)-ടെ 17-1-2012-ലെ എൻ.ഡി.ഡി/30/2012-ാം നമ്പർ കത്ത്.
റ്റി. 1506-ാം നമ്പർ നെടുമങ്ങാട് താലൂക്ക് നിർമ്മാണ തൊഴിലാളി സഹകരണ സംഘം 14-12-1998-ൽ രജിസ്റ്റർ ചെയ്ത് 3-3-1999-ൽ പ്രവർത്തനം ആരംഭിച്ചുവെന്നും, എന്നാൽ ബൈലാ പ്രകാരമുള്ള ഉദ്ദേശലക്ഷ്യങ്ങളൊന്നും നടത്തിയതായി കാണുന്നില്ലായെന്നും സൂചന പ്രകാരം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ റിപ്പോർട്ട് ചെയ്തിരിക്കുന്നു.
സംഘം പ്രവർത്തനം സംബന്ധിച്ച് സഹകരണ നിയമം വകുപ്പ് 66 പ്രകാരം നടത്തിയ പരിശോധനാ റിപ്പോർട്ടിൽ സംഘം ആസ്ഥാനം, ഭരണസമിതി അംഗങ്ങൾ, ജീവനക്കാർ എന്നിവരെക്കുറിച്ച് യാതൊരു വിവരവും ലഭ്യമല്ലായെന്നും, ടി സംഘം പ്രവർത്തനം സമാപ്തീകരിക്കുന്നതിന് നടപടികൾ സ്വീകരിക്കാവുന്നതാണെന്നും അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) ശുപാർശ ചെയ്തിരിക്കുന്നു.
മേൽ സാഹചര്യത്തിൽ ചുവടെ പരാമർശിക്കുന്ന ഉത്തരവ് പുറപ്പെടുവിക്കുന്നു.
ഉത്തരവ്
റ്റി. 1506-ാം നമ്പർ നെടുമങ്ങാട് താലൂക്ക് നിർമ്മാണ തൊഴിലാളി സഹകരണ സംഘത്തിന്റെ പ്രവർത്തനം 1969-ലെ കേരള സഹകരണ സംഘം നിയമത്തിലെ 71 (ബി) വകുപ്പ് പ്രകാരം സമാപ്തീകരിക്കുന്നതിന് ഇതിനാൽ ഉത്തരവാകുന്നു.
നെടുമങ്ങാട് അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) ആഫീസിലെ നെടുമങ്ങാട് യൂണിറ്റ് ഇൻസ്പെക്ടറെ ടി സംഘത്തിന്റെ ലിക്വിഡേറ്ററായി ഇതിനാൽ നിയമിച്ചിരിക്കുന്നു.
ലിക്വിഡേറ്റർ ടി സംഘത്തിന്റെ ചാർ÷് യഥാവിധി ഏറ്റെടുത്ത് ടി വിവരം ഈ ആഫീസിൽ റിപ്പോർട്ട് ചെയ്യേ≠താണ്.
നിയമാനുസരണമുള്ള അപ്പീൽ കാലാവധിക്കുശേഷം സംഘത്തിന്റെ സമാപ്തീകരണ നടപടികൾ പൂർത്തീകരിച്ച് രജിസ്ട്രേഷൻ റദ്ദു ചെയ്യുന്നതിനാവശ്യമായ റിപ്പോർട്ട് ലിക്വിഡേറ്റർ ഈ ആഫീസിൽ സമർപ്പിക്കേ≠താണ്.

31-12-2004 മുതൽ പാർട്ട് ടൈം അഡ്മ ിനിസ്ട്രേറ്റർ ഭരണത്തിലാണെന്നും, നാളിത് വരെ തെരഞ്ഞെടുപ്പ് നടത്തി ഭരണസമിതിയെ ചുമതലയേൽപ്പിക്കുന്നതിന് സാധിച്ചിട്ടില്ലാ എന്നും, സംഘത്തിന് നിലവിൽ ഓഫീസില്ലായെന്നും, സംഘം ഇപ്പോൾ പൂർണ്ണമായി പ്രവർത്തനരഹിതമാണെന്നും, അതിന്റെ ഉദ്ദേശലക്ഷ്യങ്ങൾക്കനുസൃതമായി പ്രവർത്തിക്കു ന്നതിൽ പൂർണ്ണമായ പരാജയമാണെന്നും, സംഘത്തെ പുനരുദ്ധരിക്കുന്നതിനുള്ള സാദ്ധ്യത ഉള്ളതായി കാണുന്നില്ലായെന്നും ആയതിനാൽ സംഘത്തിന്റെ പ്രവർത്തനം സമാപ്തീകരിക്കുന്നതിന് ആവശ്യമായ നടപടികൾ സ്വീകരിക്കുന്നതിന് ശുപാർശ ചെയ്തുകൊ≠് പരാമർശം (2) പ്രകാരം സമർപ്പിച്ച 66-ാം വകുപ്പനുസരിച്ചുള്ള പരിശോധനാ റിപ്പോർട്ടിന്റെ അടിസ്ഥാനത്തിൽ പ്രസ്തുത സംഘത്തിന്റെ പ്രവർത്തനം സമാപ്തീകരിക്കുന്നതിന് പരാമർശം (1) പ്രകാരം മഞ്ചേരി അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) ശുപാർശ ചെയ്തിട്ടു≠്. ഇതിന്റെ അടിസ്ഥാനത്തിൽ പരാമർശം (3) പ്രകാരം സംഘത്തിനും സർക്കിൾ സഹകരണ യൂണിയനും മലപ്പുറം ജില്ലാ സഹകരണ ബാങ്കിനും ഇക്കാര്യത്തിൽ അഭിപ്രായം അറിയിക്കണമെന്ന് ആവശ്യപ്പെട്ടും ആക്ഷേപങ്ങൾ ബോധിപ്പിക്കാൻ അവസരം നൽകിയും നോട്ടീസ് നൽകി. ടി സംഘം പ്രവർത്തനം നിർത്തൽ ചെയ്യുന്നതിന് നടപടികൾ സ്വീകരിക്കാവുന്നതാണെന്ന് പരാമർശം (4) പ്രകാരം മഞ്ചേരി സർക്കിൾ സഹകരണ യൂണിയൻ സെക്രട്ടറി അഭിപ്രായം അറിയിച്ചു. സംഘം അഡ്മിനിസ്ട്രേറ്ററിൽ നിന്നോ, മലപ്പുറം ജില്ലാ സഹകരണ ബാങ്കിൽ നിന്നോ യാതൊരു മറുപടിയും ലഭിച്ചിട്ടില്ല.

സംഘത്തിന്റെ ഇതുവരെയുള്ള പ്രവർത്തനവും മുകളിൽ കാണിച്ച റിപ്പോർട്ടും വസ്തുതകളും പരിശോധിച്ചതിൽ സംഘം വർഷങ്ങളായി പ്രവർത്തന രഹിതമായതിനാലും സംഘം പുനരുദ്ധരിക്കുന്നതിന് യാതൊരു സാദ്ധ്യതയും ഇല്ലാത്തതിനാലും ടി സംഘത്തെ ലിക്വിഡേറ്റ് ചെയ്യേ≠ത് അനിവാര്യമാണെന്ന് ബോദ്ധ്യ പ്പെട്ടിരിക്കുന്നു. ആയതിനാൽ 1969-ലെ കേരള സഹകരണ നിയമ പ്രകാരം എന്നിൽ നിക്ഷിപ്തമായ അധികാരം ഉപയോഗിച്ച് താഴെ പറയുന്ന ഉത്തരവ് പുറപ്പെടുവിക്കുന്നു.

എം. 525-നമ്പർ മു≠ൻതോട് പട്ടികവർഗ്ഗ സർവീസ് സഹകരണ സംഘം 22-3-1997-ന് രജിസ്റ്റർ ചെയ്ത് 15-6-1997-ന് പ്രഥമ പൊതുയോഗം ചേർന്ന് പ്രവർത്തനമാരംഭിച്ചതായി കണക്കാക്കുന്നു≠െങ്കിലും സംഘത്തിന്റെ ഉദ്ദേശലക്ഷ്യങ്ങൾ നിറവേറ്റുന്നതിനുള്ള പ്രവർത്തനങ്ങൾ ഒന്നും തന്നെ നാളിത് വരെ തുടങ്ങിയിട്ടില്ലായെന്നും, സംഘം രൂപീകരണ സമയത്ത് ജില്ലാ സഹകരണ ബാങ്കിൽ ഷെയർ അനാമത്തായി നിക്ഷേപിച്ച തുക നാളിത് വരെ പിൻവലിച്ചിട്ടില്ല എന്നും, എം. 525-നമ്പർ മു≠ൻതോട് പട്ടികവർഗ്ഗ സർവീസ് സഹകരണ സംഘത്തിന്റെ പ്രവർത്തനം സമാപ്തീകരി ക്കുന്നതിന് 1969-ലെ കേരള സഹകരണസംഘം നിയമം വകുപ്പ് 71 (1) പ്രകാരം ഇതിനാൽ ഉത്തരവാകുന്നു. മഞ്ചേരി അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) ആഫീസിലെ എടവണ്ണ യൂണിറ്റ് ഇൻസ്പെക്ടറെ 1969-ലെ സഹകരണസംഘം നിയമം വകുപ്പ് 72 (1) പ്രകാരം സംഘത്തിന്റെ ലിക്വിഡേറ്ററായി നിയമിച്ച് ഇതിനാൽ ഉത്തരവാകുന്നു. ലിക്വിഡേറ്റർ ഉടൻതന്നെ ചാർ÷െടുക്കേ≠തും ചാർ÷െടുത്ത തീയതിയിലെ ബാക്കി പത്രം, ചാർ÷് ലിസ്റ്റിന്റെ പകർപ്പ് എന്നിവ സഹിതം ചാർ÷െടുത്ത വിവരം ഈ ആഫീസിൽ ഉടൻ തന്നെ റിപ്പോർട്ട് ചെയ്യേ≠തും നിയമാനുസൃതം സമാപ്തീകരണ നടപടികൾ പൂർത്തിയാക്കേ≠തുമാണ്. സഹകരണ നിയമം ചട്ടം 69 (3) പ്രകാരം ലിക്വിഡേഷൻ സംബന്ധിച്ചുള്ള ത്രൈമാസ പുരോഗതി റിപ്പോർട്ട് യഥാസമയം ഈ ഓഫീസിൽ സമർപ്പിക്കേ≠തുമാണ്.
