It is hereby notified for the general information of the public that Acacia timber collected from the various Acacia Plantations in Palode Range of Thiruvananthapuram Division will be sold in tender/ auction sale as per the schedule furnished below subject to the detailed Tender/Auction sale conditions published in Kerala Gazette No. 49 dated 14-12-2010 in Forest Sheet Page No. 589 to 595 by Chief Conservator of Forests (Protection), Thiruvananthapuram, vide Notification No. Pro. (5) 5628/2010 dated 2-12-2010, and other rules and conditions in force. Tender forms will be available in Divisional Forest Office, Thiruvananthapuram and Forest Range Office, Palode on payment of (cid:31) 200 and action will be taken as per sale conditions. The intending bidders should satisfy themselves about the quantity and quality of the materials put up for tender/auction sale and no complaints will be entertained later on regarding the same. Further details of tender/auction sale will be available from the Range Office, Palode. Materials taken to stock upto the day before the auction will be included in sale and hence the quantity shown is approximate. If there is no bid or part bid in the 1st day of auction, the remaining materials will be put up for sale on subsequent dates and time shown in the schedule. The Auctioning Officer has discretion to conduct the auction completely or partially and to postpone the auction without assigning any reason, thereof.

It is hereby notified that the Teak poles collected from final felling of matchwood plantation in Kallar Range of Achencovil Division will be sold in public Tender cum Auction at dumping sites shown in the schedule, by the Divisional Forest Officer, Achencovil or any officer authorised by him, subject to the conditions published in Kerala Gazette No. 49 dated 14-12-2010 vide Notification No. Pro (5) 5628/08 dated 4-12-2010 of the Chief Conservator of Forests (P) Thiruvananthapuram and other conditions prevalent in the Forest Department.

Besides the quantity shown in the schedule, the quantity if any delivered to dumping sites before the date of Tender cum Auction will also be included in the sale. If the date of Tender cum Auction noted in the schedule is declared as public holiday, the tender cum auction will be conducted in the next working day at the same time and place and if the proposed tender cum auction is not held due to other reasons, the same will be conduced on the alternate dates as shown in the schedule at the same time and place. Tender forms can be had from the respective Range Office on all working days on payment of (cid:31) 400 and VAT.

Last date for receipt of tenders—up to 9 a. m. on 1-3-2013. Upto 9 a. m. on 7-3-2013 (Alternate date).

Those who intend to participate in the Tender cum Auction shall deposit a sum of (cid:31) 20,000 as E. M. D. in cash at the time of submission of tender. Those who intend to participate in the auction alone, shall deposit the EMD at the above rate before the commencement of auction.

Intending persons may ensure the quantity and quality of materials put up for auction/tender before the commencement of the same and no complaints will be entertained after the auction/tender. The tenderers/bidders should produce a Certificate showing the permanent address and signature of the bidders duly attested by the concerned Village Officer, or any other approved identity documents before depositing the EMD. Those who do not produce any approved identity card or certificate will not be allowed to participate in the tender/auction.

In case any Government Department requires any of the materials put up for the auction the quantity remaining after their selection only will be auctioned. The quantity that may become ready for sale after the publication of this notification will also be included in the tender cum auction. Any further notification to the sale conditions that may be issued by Government after the issuance of this notification will also be applicable to this tender-cum auction.

Separate sealed tenders are invited from eligible 'A'/'B' Class Contractors registered in the Forest Department in pursuance of G. O. (Ms.) No. 226/1981 (F) dated 16-12-1981 for working down timber as Round Logs and Billets and Firewood from the marked trees from the Teak Plantation mentioned in the Schedule below to the depot, billets and firewood at site mentioned with the same Schedule.

Note:—The contractors who have registered under 'A' Category should produce solvency certificates issued by the Revenue Department or a Bank guarantee by a Bank approved by Government Scheduled Bank under the Bank Guarantee Scheme as follows:

CONDITIONS

1. The terms and conditions fixed for 'B' catgegory contractors should also be binding to them for acceptance of tenders for this work.

2. The condition embodied in this notification form part and parcel of the agreement to be executed for the work tendered for.

3. Tender forms can be had from the Divisional Forest Officer, Mannarkkad on payment of the cost and sales tax shown in the schedule, hereto on any working day during the office hours upto 1 p. m. on 13-2-2013. The tender form shall be used only by the persons in whose name it is issued and for the works specified in the schedule given above.

4. The tenderers shall fill in the tender forms purchased from this office and submit the same together with all the pages intact. Tenders should be addressed in a sealed cover with the name of the work clearly written thereon, to the Divisional Forest Officer, Mannarkkad so as to reach him in his office at Mannarkkad before 3 p. m. on 13-2-2013. Sealed tenders will be opened by the Divisional Forest Officer at 3.30 p. m. on the same day in the presence of such of the tenderers who elect to be present on the occasion.

5. If the last date fixed for the receipt of the tenders happens to be a holiday, the tenders will be received and opened in the next working day at the same time and place in the conditions specified above.

6. The tenders received after the specified date and time, without the requisite enclosures or tenders not written up in the proper order or form, will be rejected.

7. Each tender should be accompanied by a Deposit Receipt obtained from an approved bank in favour of the Divisional Forest Officer, Mannarkkad as Earnest Money Deposit for the work.

8. Tenderers should quote uniform percentage of the departmental basic rate at which they can take up the work specified in the schedule both in figures and words. Fraction of one per cent should not be quoted.

9. All the corrections in the tender forms should be initialled by the tenderer himself.

10. In case more than one tenderer quoted the same lowest rate the successful lowest bidder will be decided in an auction among the tenderers who quoted the same lowest rate.

11. If any of the lowest tenderer is not prepared to reduce rate in the auction without fraction of one per cent it will be opened to the confirming authority to draw the tender by lots among or between the lower tenderers.

12. The lowest tender will ordinarily be accepted, provided the character and financial status of the tenderers are found satisfactory, but the authority competent to accept the tender reserves to himself the powers of accepting or rejecting any tender without assigning any reason therefore. There shall be no appeal against such action.

13. Rule notified as per G. O. (P) 62/76/AD dated 23-2-1976 and published in the Gazette dated 9-3-1976 general sale condition as per Pro. 5-2613/08 dated 12-6-2008 of Chief Conservator of Forests, Thiruvananthapuram published in the Gazette No. 26 on 24-6-2008 and other conditions if any inform shall be binding on any person who makes a written tender for the works.

14. The tender submitted by timber merchants, sale coupe contractors and other persons who are engaged in timber trade within the limits of the forest division in which working area is situated or by the adjacent divisions will not be accepted.

15. The tenderers should have no relationship on any Government Servant who is in charge of the work or who has any direct control over the work. Relationship in this case will mean father, mother, daughter, son, brother, sister, direct uncle, nephew, father-in-law, mother-in-law and the first cousin of the officers concerned.

16. The Earnest Money Deposit of the unsuccessful tenderers will be returned to them soon after opening the tenders.

17. Before submitting the tender, the tenderer is expected to study and scrutinize all the conditions in this agreement to be executed, the draft of which can be had for perusal from the Divisional Forest Officer, Mannarkkad on any working day during office hours. No plea of ignorance of the agreement conditions or no complaint regarding the said conditions received after putting in the tender shall be entertained on any account. A bonded agreement should be executed by the successful tenderer on the date of opening of tenders itself.

18. The successful tenderer shall within 15 days from the date of issue of the acceptance of tender, furnish a security deposit of an amount equal to 10% of the total contract value limited to a maximum of (cid:31) 50,000 (Rupees Fifty thousand only) and execute an agreement on a Stamp Paper worth (cid:31) 100 in the approved form, the same of which can be had from the Divisional Forest Officer, Mannarkkad for perusal. The security amount should be remitted in the Government Treasuries duly pledged to the Divisional Forest Officer, Mannarkkad. If the security is not remitted and the agreement executed within the above said period, a further period of 15 days shall be allowed by the Divisional Forest Officer, Mannarkkad for remittance of security and the execution of the agreement subject to realization of (cid:31) 50 (Rupees fifty only) per day of extension.

19. If the tenderers remits the security within 15 days from the date of intimation of acceptance order but is not able to execute the agreement within the period, the Divisional Forest Officer may grant an extension of time for 15 days more for execution of agreement with a penalty of (cid:31) 10 per day of extension.

20. Failure to remit the security deposit and to execute the agreement, within the time specified in the condition 18 above, will entire cancellation of the tender by the Divisional Forest Officer, and forfeiture to Government of the Earnest Money Deposit and security if any, deposited by the tenderers. The work will also be got done through other agencies at the risk and loss of the defaulter. The loss if any will be treated as arrears of public revenue and will be recovered from the defaulter under the provisions of Revenue Recovery Act or by any other legal means if not paid within a reasonable time specified by the Divisional Forest Officer. The defaulter, however will not be entitled for gain, if any.

21. The tenderer should produce vaild clearance certificate of sales tax, income tax and agricultural income tax to the satisfaction of the Divisional Forest Officer before the final payment is made to him in case the contract value is of and above (cid:31) 5,000 (Rupees Five thousand).

22. In the case of working down round logs and firewood the contractor shall be bound to deliver at the Depot all hardwood logs within three months, from the date of registration, softwood logs within 15 days from the date of felling and billets and firewood within 2 months from the date of registration or within the contract period whichever is earlier. If the delivery of the produce is not effected within the period originally fixed as above, the Divisional Forest Officer, may grant extension for three months for delivery of hardwood, 15 days for softwood and two months for billets and firewood subject to a realization of penalty of (cid:31) 1.75/cum for hardwood, (cid:31) 2/cum for softwood for 15 days and (cid:31) 0.50/MT for stacked billets and firewood. 30 days further extension can be granted by the Chief Conservator of Forests, Eastern Circle with penalty of (cid:31) 3.50/cum and another 15 days by the Chief Conservator of Forests, with penalty of 5.25/cum and further 30 days by the Chief Conservator of Forests, with penalty of (cid:31) 7/cum for softwood, if the periods fall within the original or the extended contract period.

All registered logs remaining undelivered after the expiry of said period will be taken charge of by the Forest Range Officer, Mannarkkad and the contractor shall be liable to pay a fine of (cid:31) 4/cum for such undelivered logs only and forfeit all claims to Kolevila due thereon. The loss if any, sustained by the Department due to deterioration on account of belated delivery or non-delivery of the timber will be made good from the contractor as assessed by the department. The contractor should obtain receipts for the logs delivered at the depot from the Depot Officer when the contractor will be eligible for Kolevila therefore. The contractor shall fell all the marked trees entrusted to him except those trees which have been certified by the Divisional Forest Officer after inspection as wholly defective or impossible to be felled without causing serious damages to their stems or to other trees standing nearby and collect all available timber thereof. For every marked trees left unfelled or felled but uncollected at the expiry of the contract period without porper authorization from the Divisional Forest Officer, the contractor is liable to pay a penalty of (cid:31) 200 per tree, besides realization of value of timber of uncollected trees as per other conditions. The value of the logs at schedule rate if rendered useless or deteriorated will be realized.

23. The contractor shall ensure that the felling and collection, proceeds from the end of the coupe to the other end in an orderely and systematic manner and that all trees are felled as low as possible to the ground levels using saw at least on one side. All logs shall be cross cut with saw.

24. For all logs and billets selling at rates less than Kolevila, the Kolevila payable to the contractor will be limited to the sale price.

25. If the contractor fails to undertake and complete the work within the specified time or if he lives any item of work undone, the Divisional Forest Officer, at his discretion make other arrangements for carrying out the works left undone, either departmentally or through other agencies at the risk and loss of the defaulting contractor and the loss if any, sustained by the department on this account will be recovered from the security deposit or from other assets of the defaulting contractor, as if such sums are arrears of Land Revenue under the provisions of Revenue Recovery Act in force in such other manner as the Government may deem fit.

26. If any amount becomes due to any workmen or mazdoor engaged by the contractor as per Workmen's Compensation Act or as per provisions of labour or similar laws, such amounts shall be payable by the contractor.

27. The tenderers should submit a declaration with the tender that they are not related any Government Servant who is in charge of or having control of the work for which the tender is submitted. Relationship for this purpose will be restricted to father, mother, son, daughter, sister, brother, uncle, nephew, father-in-law, mother-in-law, brother-in-law and first cousins of the officer. If at any stage this condition is found to have been contravened the earnest money/ security deposit of the tenderer/contractor will be forfeited to Government and the contract entered into will stand cancelled.

28. (a) The contractor shall not make any damage to bridges or roads and private properties during collection and transport and during unloading logs and billets from lorries and he shall be liable of any such damages. The decision of the Government regarding the amount of compensation payable for the damages caused shall be final and binding on the contractor and the Government shall recover such damages from the contractor.

(b) If the damage caused is in respect of any road under the control of the Kerala State Electricity Board or Public Works Department the amount of compensation payable for such damages will be assessed by the Forest Range Officer, concerned and the Assistant Engineer of the concerned Division of the Kerala State Electricity Board or Public Works Department and their decision being final and binding on the contractor. In such cases the contractor shall be liable to pay the damages to the Kerala State Electricity Board or Public Works Department and they shall recover such damages from the contractor.

29. The tenderers should give an undertaking in the tender that they undertake to carry out the work at the tendered rates quoted and to abide by the terms and conditions of the tender notice and draft agreement so on by them and also other departmental rules and orders issued by them from time to time.

30. (a) Post offers which are not advantageous by more than 5% of the lowest rate offered for the original tender (where the total cost of the work as per tender is

31. (cid:31) 1,00,000 (One Lakh) and above and more than 10% where the total cost of the work is less than (cid:31) 1,00,000 (One lakh) will be summarily rejected. In other cases it will be considered under the following conditions:

(i) The post offer should be made within 7 days of tender.

(ii) The post offerer should remit double the security for the work based on the work offered by the lowest tenderer.

The remittance should be made within 7 days from the date of receipt of registered notice.

29. (b) (i) The post offerer after satisfying the conditions specified above should also execute an agreement before the Divisional Forest Officer pledging the security for the due fulfilment of the terms.

(ii) If the post offerer satisfied the conditions specified above, re-tenders will be called for after giving the usual publicity as per the rules. In the re-tender if the rates offered does not come upto what has been offered by the post offerer it will be awarded to the post offerer at the rate offered by him. If he back out the security amount will be forfeited to Government. If however, the rate is less than what has been offered by the post offerer in the case of re-tender the work will be awarded to the lowest tenderer and the amount remitted by the post offerer realeased to him.

30. The quantity mentioned in the schedule is only approximate and the contractor is bound to work down the full quantity of timber and firewood available from tress marked and entrusted to him.

31. The period of contract will be 4 months from the date of intimation of work order. No extension of the contract period shall ordinarily be granted. But if however the delay in completing the work in the contract area within the period specified in the schedule attached is due to circumstances beyond the control of the contractor extension of time may be granted for one/two/three months by Divisional Forest Officer, Chief Conservator of Forests, Eastern Circle, Chief Conservator of Forests respectively but not exceeding a total period of 6 months subject to realization of penalties as mentioned below. If he fails to undertake and complete the work within the specified time, or if he leaves any item of work undone, the Divisional Forest Officer may at his discretion make other arrangements for carrying out the work left undone either departmentally or through other agencies at the risk and loss of the defaulting contractor, and loss if any incurred by the department on this agencies at the risk and loss of the defaulting contractor and loss if any incurred by the department on this account will be recovered from the security or from other assets of the contractor.

Penalty: (a) (cid:31) 2/cum for the quantity of timber delivered at the Depot during the first months extension granted by the Divisional Forest Officer.

(b) (cid:31) 2.50/cum for quantity of timber delivered at the Depot during the extension granted by the Chief Conservator of Forests.

(c) (cid:31) 3/cum for the quantity of timber delivered at the Depot during the extension granted by the Chief Conservator of Forests.

(d) In the same way for billets and firewood (cid:31) 1.00, 1.25, 1.50 for the extension granted by the Divisional Forest Officer, Chief Conservator of Forests, the Additional Principal Chief Conservator of Forests respectively.

32. The Divisional Forest Officer reserves to himself the power to eliminate any tree marked and entrusted to the contractor from felling if it is found during the course of the contract that timber obtainable from such trees have no reasonable market or by some other reasons and the contractor is not entitled to claim any compensation for such elimination.

33. Ten percent of each Kolevila bill will be withheld as retention amount which will be released after the connected logs are sold and the liability if any in respect of these logs with the contract is settled.

33.(a) In case of works, the contract value which exceeds (cid:31) 10,000 income tax at the rate of two percent of payment made shall be deducted at each time when payments are made except in the case of non-resident contractors.

34. For working down logs, seignorage on vakka fibre calculated at one vakka drag rope, for every two cum or fraction thereof and grazing fee for one elephant for every two cubic metres or fraction thereof for timber will be recovered from the contractor on the actual quantity collected and Sales Tax on Vakka charges as per the rules in force.

34. (a) All timber the contractor is under obligation to deliver at the prescribed depots shall be transported to such depot only along the routes specified in the transport permit. If in the course of work it become necessary to deviate from the routes specified in the schedule, the contractor may be allowed to transport timber and firewood along the deviated routes, provided the department is satisfied of the necessity for the deviation in the routes. In the case of such deviation in routes, the contractor will be eligible to get Kolevila at the rates worked for those new route minus tender reduction with prior sanction of the Conservator of Forests. Quantity to be supplied to different depots shall also be changed by the Divisional Forest Officer, with prior sanction from the Conservator of Forests.

35. The contractor shall collect all timber available from the trees marked in the plantation within the said contract period as per the instructions issued by the Divisional Forest Officer, Mannarkkad. If the collection is delayed the contractor will be liable to pay a penalty at the rate specified above for the timber for the belated period.

36. The contractor should show register progress in working down timber.

37. If the rates quoted in the re-tender is more than quoted in the original tender the difference between them and all the expenditure incidental in fixing up of re-tender including notification charges as assessed by the Divisional Forest Officer, Mannarkkad will be recovered from the defaulting tenderer through any legal means including Revenue Recovery Act.

38. Further particulars can be had from the Divisional Forest Officer, Mannarkkad or the Range Officer, Mannarkkad on any working days during office hours.

39. The contractor should take every care to collect as much quantity of saleable timber as possible from marked trees.

40. The tenderer are bound to above by the instructions issued from the Forest Department from time to time regarding tender as well as working down of timber.

അനുബന്ധത്തിൽ കാണിച്ച യൂണിറ്റുകളിൽ ഏതെങ്കിലും യൂണിറ്റിന്റെ ലേലം മുഴുവനായോ ഭാഗികമായോ നിർത്തി വയ്ക്കാനുള്ള അവകാശം പുനർ ലേലം നടത്തുന്ന ഉദ്യോഗസ്ഥന് ഉ≠ായിരിക്കുന്നതാണ്. അങ്ങനെ നിർത്തിവയ്ക്കുന്ന യൂണിറ്റുകളുടെ വിവരങ്ങൾ പുനർ ലേലത്തിന് മുമ്പായി അറിയിക്കുന്നതായിരിക്കും.

ഗവൺമെന്റ ് ആവശ്യപ്പെടുകയാണെങ്കിൽ ഓരോ യൂണിറ്റിൽ നിന്നും ശേഖരിക്കുന്ന കശുവ≠ി/കുരുമുളക് ഗവൺമെന്റ ് നി›യിക്കുന്ന ഏജൻസിക്ക് നി›ിത വിലയ്ക്ക് കൊടുക്കുവാൻ കരാറുകാരൻ ബാദ്ധ്യസ്ഥനാണ്.

കണ്ണൂർ ഡിവിഷനിലെ കൊട്ടിയൂർ റെയിഞ്ചിൽപ്പെട്ടതും താഴെ പട്ടികയിൽ വിവരിക്കുന്നതുമായ കശുമാവിൻ തോട്ടങ്ങളിൽ നിന്നും 30-6-2013 വരെയുള്ള കാലത്തേക്ക് കശുവ≠ി ശേഖരിച്ച് കൊ≠ുപോകുന്നതിനുള്ള അവകാശം കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റുദ്യോഗസ്ഥനോ താഴെപ്പറയുന്ന ലേല നിബന്ധനകൾക്ക് വിധേയമായി പരസ്യമായി പുനർലേലം ചെയ്തു വിൽക്കുന്നതാകുന്നു. പുനർലേല ദിവസം പൊതു അവധിയായി പ്രഖ്യാപിക്കുകയാണെങ്കിൽ അതിന് അടുത്ത പ്രവൃത്തി ദിവസം അതേ സ്ഥലത്തും സമയത്തും വച്ച് പുനർലേലം നടത്തുന്നതായിരിക്കും.

2. പുനർലേലത്തിൽ പങ്കെടുക്കുന്നവർ പുനർലേലദിവസം ലേലത്തിന് മുമ്പായി യൂണിറ്റിലെ കശുവ≠ി ശേഖരണത്തിന് 2,000 വീതം നിരതദ്രവ്യം കെട്ടിവയ്ക്കേ≠തും പുനർലേല വിജ്ഞാപനത്തിലെ വ്യവസ്ഥകൾ (cid:31)

ഓരോ യൂണിറ്റിനും അംഗീകരിച്ചതായി ഒപ്പിടേ≠തുമാണ്.

3. പുനർലേലത്തിൽ നി›യിച്ചിട്ടുള്ള തീയതിക്ക് തൊട്ടുമുമ്പുള്ള പ്രവൃത്തി ദിവസം 3 മണിവരെ ഓരോ യൂണിറ്റിനും പ്രത്യേകം സീൽ ചെയ്ത ദർഘാസുകൾ സ്വീകരിക്കുന്നതാണ്. ടെ≠റിന്റെ കൂടെ നി›ിത തുകയ്ക്കുള്ള നിരതദ്രവ്യവും 100-ന്റെ മുദ്രപത്രത്തിൽ പ്രാഥമിക ഉടമ്പടിയും സമർപ്പിക്കേ≠താണ്. ദർഘാസ് ഫോറങ്ങൾ കണ്ണൂർ ഡിവിഷണൽ (cid:31) ഫോറസ്റ്റ് ഓഫീസറിൽ നിന്നും പുനർ ലേല ദിവസത്തിനു തൊട്ടുമുമ്പുള്ള പ്രവൃത്തി ദിവസം ഒരു മണിവരെ നി›ിത വിലയും വിൽപ്പന നികുതിയും അടച്ചാൽ ലഭിക്കുന്നതാണ്. നി›ിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ടെ≠റുകൾ പരിഗണിക്കുന്നതല്ല. വിളിച്ചെടുക്കാനുദ്ദേശിക്കുന്ന കശുവ≠ി തോട്ടത്തിന്റെ പേരും യൂണിറ്റ് നമ്പർ ഉദ്ദേശിക്കുന്ന വില എന്നിവയും ദർഘാസിൽ വ്യ‡മായി രേഖപ്പെടുത്തേ≠താണ്. പുനർലേലം കഴിഞ്ഞാലുടൻ ദർഘാസുകൾ തുറക്കുന്നതും ഓരോ യൂണിറ്റിനും രേഖപ്പെടുത്തിയിട്ടുള്ള വില പുനർലേലത്തിൽ അതേ യൂണിറ്റിൽ ലഭിച്ച ഏറ്റവും ഉയർന്ന വിലയേക്കാൾ കൂടുതലാണെങ്കിൽ ദർഘാസ് വിലയ്ക്കും കുറവാണെങ്കിൽ പുനർലേലത്തിൽ ലഭിച്ച വിലയ്ക്കും ടി യൂണിറ്റിന്റെ വിൽപ്പന സ്ഥിരപ്പെടുത്തുന്നതിനുള്ള നടപടി സ്വീകരിക്കുന്നതാണ്. എന്നാൽ ര≠ു വിലയും വകുപ്പിന്/സർക്കാരിന് ലാഭകരമായി ബോദ്ധ്യപ്പെടാത്തപക്ഷം ടി യൂണിറ്റിന്റെ പുനർ ദർഘാസ്/ലേല വിൽപ്പന റദ്ദ് ചെയ്യുന്നതാണ്. ദർഘാസ് ഫോറം വാങ്ങിച്ചവർ ഉൾപ്പെടെ ആർക്കും നിശ്ചിത തുക നിരതദ്രവ്യം ഒടുക്കി ലേലത്തിൽ പങ്കെടുക്കാവുന്നതാണ്.

4. പുനർലേലത്തിൽ പങ്കുകൊള്ളുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കയ്യൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ഒരു സർട്ടിഫിക്കറ്റും ആറുമാസത്തിനുള്ളിൽ ബന്ധപ്പെട്ട വില്ലേജ് ഓഫീസറിൽ നിന്നും വാങ്ങിയതും ആദായ നികുതി വകുപ്പ് അനുവദിക്കുന്ന പാൻ കാർഡിന്റെ പകർപ്പും നിരതദ്രവ്യം കെട്ടിവയ്ക്കുന്നതിന് മുമ്പായി ഹാജരാക്കേ≠താണ്. ഇപ്രകാരം ഒരു സർട്ടിഫിക്കറ്റ് ഹാജരാക്കാത്തവരെ പുനർലേലത്തിൽ പങ്കുകൊള്ളാൻ അനുവദിക്കുന്നതല്ല.

5. പുനർലേലത്തിനുശേഷം യാതൊരു തരത്തിലുള്ള പരാതികളും പരിഗണിക്കുന്നതല്ല. എന്നതിനാൽ പങ്കുകൊള്ളുന്നവർ ലേലത്തിന് മുമ്പ് തോട്ടങ്ങൾ പരിശോധിച്ച് വിളവുകളുടെ തരവും ഗുണവും മറ്റും നല്ലതുപോലെ ബോദ്ധ്യപ്പെടേ≠താണ്.

6. പുനർലേലത്തിൽ വയ്ക്കുന്ന യൂണിറ്റിന്റെ ചാർ÷് വഹിക്കുന്നതും അവ നിയന്ത്രിക്കുന്നതും ആയ സർക്കാർ സേവകന്റെയും ബന്ധുക്കൾക്ക് ലേലത്തിൽ പങ്കെടുക്കുവാനോ കരാർ എടുക്കുവാനോ പാടില്ല.

7. ഏറ്റവും കൂടിയ തുകയ്ക്ക് പുനർലേലം/ദർഘാസ് കൊള്ളുന്ന ആളുടെ പേരിൽ പുനർലേലം താൽക്കാലികമായി ഉറപ്പിക്കുന്നതുമാണ്. പുനർലേലം അഗീകരിക്കുന്നതിനോ നിരാകരിക്കുന്നതിനോ ഉള്ള അധികാരം കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് ഉ≠ായിരിക്കുന്നതാണ്. പുനർലേലം നടത്തുന്നത് സംബന്ധിച്ച് ഏതെങ്കിലും വ്യവസ്ഥകളുടെ വ്യാഖ്യാനം സംബന്ധിച്ചോ വല്ല പരാതികളും ഉൽഭവിക്കുകയാണെങ്കിൽ അതുസംബന്ധിച്ച് ലേലം നടത്തുന്ന ഉദ്യോഗസ്ഥന്റെ തീരുമാനം അന്തിമമായിരിക്കും.

10,000-മോ അതിൽ കുറവോ ആണെങ്കിൽ മുഴുവൻ തുകയും 10,000-മോ പുനർലേലത്തുകയുടെ മൂന്നിൽ ഒന്നോ ഏതാണ് കൂടുതൽ അത് നിരതദ്രവ്യം ഉൾപ്പെടെ കെട്ടിവയ്ക്കേ≠താണ്. ഇതിനു വീഴ്ചവരുത്തിയാൽ നിരതദ്രവ്യം സർക്കാരിലേക്ക് മുതൽ കൂട്ടുന്നതും കശുവ≠ി ശേഖരിക്കുന്നതിനുള്ള അവകാശം വീഴ്ചക്കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ വീ≠ും ലേലം നടത്തുന്നതുമായിരിക്കും. അങ്ങനെയുള്ള ലേലത്തിൽ വീഴ്ചക്കാരനെ പുനർലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല. ലേലത്തിൽ പരാജയപ്പെട്ടവരുടെ നിരതദ്രവ്യം ലേലം കഴിഞ്ഞ ഉടനെ അവർക്ക് തിരിച്ചുനൽകുന്നതായിരിക്കും.

9. പുനർലേലം സ്ഥിരപ്പെടുത്തിയ വിവരം പുനർലേലം കൊ≠ ആളിനെ അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി മുഴുവൻ ലേലത്തുകയും നിയമാനുസൃതമായ നികുതികളും ലേലത്തുകയുടെ 10% വരുന്ന സെക്യൂരിറ്റി തുകയും കുറഞ്ഞത് 100-ന്റെ മുദ്രപത്രത്തിൽ നിലവിലുള്ള വ്യവസ്ഥകൾക്ക് വിധേയമായി ഉടമ്പടി ഒപ്പ് വയ്ക്കേ≠താണ്.

10. തക്കതായ കാരണമു≠െങ്കിൽ 15 ദിവസത്തിനകം പ്രസ്തുത തുകകൾ അടയ്ക്കുന്നതിനും കരാർ ഒപ്പ് വയ്ക്കുന്നതിനും സാധിക്കാതെവന്നാൽ ആയതിന് 18% പലിശയോടുകൂടി 15 ദിവസം കൂടി ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അനുവദിക്കാവുന്നതാണ്. ഇപ്രകാരം ദിവസം ഒന്നിന് 25 വച്ച് പിഴ ഈടാക്കുന്നതുമാണ്.

11. പ്രസ്തുത കാലാവധിക്കകം പ്രസ്തുത തുക അടയ്ക്കാൻ വീഴ്ചവരുത്തിയാൽ 24% പലിശയോടുകൂടി 15 ദിവസം കൂടി കണ്ണൂർ വനപാലകന് യു‡മാണെന്ന് തോന്നുന്നപക്ഷം അനുവദിക്കാവുന്നതാണ്.

12. പ്രസ്തുത തുക അടയ്ക്കുകയും ഉടമ്പടി വെയ്ക്കാൻ സാധിക്കാതെ വരികയും ചെയ്താൽ ദിവസം ഒന്നിന് 10 വച്ച് പിഴ

(cid:31) ഈടാക്കി ഉടമ്പടി വെയ്ക്കുന്നതിന് 15 ദിവസം കൂടി ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അനുവദിക്കാവുന്നതാണ്.

13. പ്രസ്തുത കാലാവധിയ്ക്കകം പ്രസ്തുത തുകകൾ അടയ്ക്കാൻ വീഴ്ചവരുത്തുന്നപക്ഷം പുനർലേലം കൊ≠ ആളുടെ നഷ്ടോത്തരവാദിത്വത്തിൽ വീ≠ും ലേലം നടത്തുന്നതും അതിൽ നിന്നു≠ാകുന്ന നഷ്ടത്തിനും ആദ്യലേലക്കാരൻ ഉത്തരവാദിയാകുന്നതും ലാഭം കിട്ടിയാൽ ടിയാന് അവകാശമില്ലാത്തതും നഷ്ടം വരുന്ന തുക കുടിശ്ശികയായി പരിഗണിച്ച് നി›ിത തീയതിയ്ക്കകം ഒടുക്കിയില്ലെങ്കിൽ നിലവിലുള്ള റവന്യൂ റിക്കവറി ആക്ട് അനുസരിച്ചോ യു‡മായ മറ്റു മാർഗ്ഗങ്ങളിലൂടെയോ ടിയാനിൽ നിന്നും ഈടാക്കുന്നതുമാണ്.

14. പുനർലേലം സ്ഥിരപ്പെടുത്തിയ വിവരം ലേലം കൊ≠യാളിനെ അറിയിക്കുകയും ടിയാൻ പുനർലേലത്തുക അടയ്ക്കുകയും ചെയ്തതിനുശേഷം കശുവ≠ി ശേഖരണം ടിയാൻ നടത്താതിരിക്കുകയോ ടിയാന് നടത്താൻ സാധിക്കാതിരിക്കുകയോ ചെയ്താൽ അടച്ച പുനർലേലത്തുക ടിയാന് തിരിച്ചുകൊടുക്കുന്നതിനും യാതൊരുവിധ നഷ്ടപരിഹാരവും സിദ്ധിക്കുന്നതിനും അവകാശമു≠ായിരിക്കുന്നതല്ല.

15. ലേലത്തിൽ വിജയിക്കുന്ന ആൾ 9-3-1976-ലെ കേരള സർക്കാർ ഗസറ്റിൽ പരസ്യപ്പെടുത്തിയ 23-2-1976-ലെ ജി.ഒ. (പി) 62/76/എ.ഡി. നമ്പർ ഉത്തരവിലെ വ്യവസ്ഥകൾ അനുസരിക്കേ≠താണ്.

16. ലേലംകൊ≠ ആൾ കരാറിൽ ഒപ്പുവച്ചശേഷം ശേഖരിക്കുന്ന കശുവ≠ി മുഴുവൻ 1976-ലെ കേരള അസംസ്കൃത കശുവ≠ി (വിതരണവും വിപണനവും) ഉത്തരവ് പ്രകാരം കേരള ഗവൺമെന്റ ് കശുവ≠ി കുത്തക സംഭരണത്തിനും അതാത് കാലത്ത് നി›യിക്കുന്നതും ഏജൻസിക്കും സർക്കാർ അപ്പോൾ നി›യിക്കുന്ന വില നിരക്ക് അനുസരിച്ച് വിൽക്കേ≠താണ്.

17. നേഴ്സറികൾ ഉ≠ാക്കുന്നതിന് ആവശ്യമുള്ളപക്ഷം കശുമാവ് തോട്ടങ്ങളിൽ നിന്ന് നല്ലതരം കശുവ≠ി വിത്തുകൾ അംഗീകൃത വില നൽകി തെരഞ്ഞെടുക്കുന്നതിനുള്ള അവകാശം വനം വകുപ്പിന് ഉ≠ായിരിക്കും.

18. കരാർ കാലയളവിൽ എല്ലായ്പ്പോഴും കശുമാവുകൾക്ക് ചുറ്റുമുള്ള കാടുകൾ 5 മീറ്റർ ചുറ്റളവിൽ കരാറുകാരൻ തന്നെ വെട്ടി നീക്കം ചെയ്തിരിക്കണം. തോട്ടത്തിൽ യാതൊരു കാരണവശാലും കളപിടിക്കാതെ നോക്കി സംരക്ഷിക്കേ≠ത് കരാറുകാരന്റെ ചുമതലയാണ്. കാട്ടുതീമൂലമോ ഉണക്കുമൂലമോ മറ്റു വല്ലവിധത്തിലുള്ള നഷ്ടവും നേരിട്ടാൽ ആയതിന് യാതൊരുവിധ നഷ്ടപരിഹാരത്തിനും കരാറുകാരന് അവകാശം ഉ≠ായിരിക്കുന്നതല്ല.

19. ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ രേഖാമൂലമുള്ള അനുവാദം കൂടാതെ പാട്ടത്തിനെടുത്ത സ്ഥലം മറ്റൊരാൾക്ക് കൈമാറ്റം ചെയ്യുവാനോ സ്ഥലം മുഴുവനായോ ഭാഗികമായോ ഏൽപിച്ചുകൊടുക്കുവാനോ പാടുള്ളതല്ല. അങ്ങനെ നൽകാനുള്ള അപേക്ഷ യാതൊരു കാരണവും കാണിക്കാതെ തള്ളാനുള്ള അധികാരം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് ഉ≠ായിരിക്കും.

20. മുകളിൽ 8-ാം നമ്പർ വ്യവസ്ഥയിൽ നിബന്ധനകൾ പൂർത്തീകരിച്ചതിന് ശേഷം കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറിൽ നിന്നും രേഖാമൂലമുള്ള അനുവാദം വാങ്ങിയതിനുശേഷം മാത്രമേ ലേലക്കാരൻ പാട്ടസ്ഥലത്തു പ്രവേശിക്കുവാൻ പാടുള്ളൂ. അങ്ങനെയുള്ള അംഗീകാരം കിട്ടുന്നതിന് മുമ്പ് സ്ഥലത്ത് പ്രവേശിക്കുന്നത് കയ്യേറ്റമായി കണക്കാക്കുകയും അതിന് ലേലക്കാരന് എതിരെ കേരളാ വനനിയമ പ്രകാരം പ്രോസിക്യൂഷൻ നടപടികൾ കൈക്കൊള്ളുന്നതുമായിരിക്കും.

21. പുനർലേല വില 1,000-ന് മുകളിലും

5,000-ന് താഴെയും ആണെങ്കിൽ സെക്യൂരിറ്റി ഡെപ്പോസിറ്റ് മടക്കിക്കിട്ടുന്നതിന് വിൽപ്പന നികുതിയോടൊപ്പം കാർഷിക നികുതിയുടെയും ക്ളിയറൻസ് സർട്ടിഫിക്കറ്റ് ഹാജരാക്കേ≠താണ്. ലേലസംഖ്യ 5,000-മോ അതിനുമുകളിലോ ആണെങ്കിൽ വിൽപ്പന നികുതിയുടെയും കാർഷികാദായ നികുതിയുടെ പുറമേ ആദായ (cid:31) നികുതിയുടെയും ക്ളിയറൻസ് സർട്ടിഫിക്കറ്റ് കൂടി ഹാജരാക്കണം. കേസ് സംബന്ധിച്ച് വല്ല കുടിശ്ശികകളും ഉ≠െങ്കിൽ ആയത് സെക്യൂരിറ്റിയിൽ നിന്നും ഈടാക്കുന്നതായിരിക്കും. കരാറുകാരൻ കേരള സംസ്ഥാനത്തിന് പുറത്ത് ബിസിനസ്സ് ചെയ്യുന്ന ആളാണെങ്കിൽ ആദായ നികുതിക്ക് ക്ളിയറൻസ് സർട്ടിഫിക്കറ്റ് മാത്രം ഹാജരാക്കിയാൽ മതി.

22. വല്ല കാരണവശാലും കരാർ റദ്ദാക്കേ≠ി വരുന്നതാകയാൽ മുകളിൽ വിവരിച്ച പ്രകാരമുള്ള പിഴകൾക്ക് പുറമെ കരാറുകാരനോ അദ്ദേഹം അധികാരപ്പെടുത്തിയ ഏജന്റോ കരാർ റദ്ദാക്കിയ തീയതിക്കോ അതിനുമുമ്പോ ശേഖരിച്ചിട്ടുള്ളതും നീക്കം ചെയ്യാതെ സ്ഥലത്തു കിടക്കുന്നതുമായ എല്ലാ ഉൽപന്നങ്ങളും കസ്റ്റഡിയിൽ എടുത്ത് സർക്കാരിലേക്ക് മുതൽകൂട്ടുന്നതും അങ്ങനെയുള്ള കാര്യത്തിൽ കരാറുകാരന് യാതൊരു നഷ്ടപരിഹാരത്തിനും അതനുസരിച്ച് ഉൽപന്നങ്ങൾ വിറ്റുകിട്ടുന്ന തുകയ്ക്കോ അർഹത ഉ≠ായിരിക്കുന്നതല്ല.

23. കരാറുകാരനും അദ്ദേഹത്തിന്റെ അംഗീകൃത ഏജന്റും പണിക്കാരും കേരളാ ഫോറസ്റ്റ് നിയമത്തിലെ എല്ലാ നിയമങ്ങളും നിബന്ധനകളും ചട്ടങ്ങളും പാലിക്കേ≠താണ്. വനംവകുപ്പ് ഉദ്യോഗസ്ഥർക്ക് അവർ ആവശ്യപ്പെടുകയാണെങ്കിൽ കാട്ടുതീയിൽ നിന്നും മറ്റും വനസംരക്ഷണത്തിനും പാട്ടസ്ഥലത്തോ അതിനടുത്ത സ്ഥലങ്ങളിലോ ഉ≠ാകുന്ന വനംകുറ്റങ്ങൾ ക≠ുപിടിക്കുന്നതിനുവേ≠ എല്ലാ സഹായങ്ങളും നൽകേ≠താണ്.

24. ഉൽപ്പന്നങ്ങൾ പാട്ടസ്ഥലത്തുനിന്നും നീക്കം ചെയ്യുന്നതിന് ആവശ്യമായ പാസ്സ് ഡിപ്പാർട്ടുമെന്റ ിൽ നിന്നും നൽകുന്നതായിരിക്കും. ശേഖരിക്കുന്ന ഉൽപന്നത്തിന്റെ അളവ് കരാറുകാരൻ നൽകുന്നത് മാസാന്ത്യ കണക്കുകളിൽ കാണിക്കുന്നത് ഡിപ്പാർട്ടുമെന്റിൽ നൽകുന്ന പാസ്സുകളുമായി ബന്ധപ്പെട്ടതായിരിക്കണം. പാട്ടസ്ഥലത്തിന് പുറമേയുള്ള വനങ്ങളിൽ നിന്നും ഉൽപ്പന്നങ്ങൾ ശേഖരിക്കുവാൻ കരാറുകാരനെ അനുവദിക്കുന്നതല്ല. കരാർ സ്ഥലത്തുനിന്നും സാധനങ്ങൾ രാവിലെ 6 മണി മുതൽ വൈകുന്നേരം 6 മണിവരെ മാത്രമേ നീക്കം ചെയ്യാൻ അനുവദിക്കുകയുള്ളൂ.

25. നിയമാനുസൃതമായി ലേലത്തിനുശേഷം നൽകുന്ന വാഗ്ദാനങ്ങൾ വല്ലതും ഉ≠െങ്കിൽ അവ സ്വീകരിച്ച് നിയമാനുസൃതമായ നടപടികൾ അതിൻമേൽ കൈക്കൊള്ളുന്നതായിരിക്കും.

26. കരാറുകാരൻ ആവശ്യപ്പെടുന്നപക്ഷം ടിയാന്റെ കൂലിക്കാരെ താമസിപ്പിക്കുന്നതിനും കശുവ≠ി സൂക്ഷിക്കുന്നതിനും 45 സ്ക്വയർ മീറ്ററിന് 5 പ്രകാരം 1 ഷെഡ് കൂപ്പിനുള്ളിൽ പണിയുന്നതിന് സ്ഥലം അനുവദിക്കുന്നതാണ്. ഷെഡ് അനുവദിക്കുന്നതിനുള്ള അവകാശം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറിൽ നിക്ഷിപ്തമാണ്. കരാർ കാലാവധിക്ക് മുമ്പായി ഷെഡ് കരാറുകാരൻ പൊളിച്ച് നീക്കം ചെയ്യേ≠താണ്. അല്ലാത്തപക്ഷം ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ആയത് പൊളിച്ചുനീക്കം ചെയ്യുന്നതും അതിനുവരുന്ന ചെലവ് കരാറുകാരനിൽ നിന്നും പിടിച്ചെടുക്കുന്നതുമായിരിക്കും. ഷെഡ് പണിയുന്നതിനുള്ള സാധനങ്ങൾ നിലവിലുള്ള സിനിയറേജ് റേറ്റ് പ്രകാരം കാട്ടിൽ നിന്നും സൗകര്യമുള്ളപക്ഷം ശേഖരിക്കുവാൻ അനുവദിക്കുന്നതാണ്.

27. കരാർ കാലാവധി തീരുന്നതുവരെ ഓരോ യൂണിറ്റിലെയും വീഡിംഗ് പ്രവൃത്തി ടി യൂണിറ്റുകൾ പുനർ ലേലത്തിനെടുത്ത ആളുകൾ തന്നെ സ്വന്തം ചെലവിൽ ചെയ്യേ≠തുമാണ്.

28. പുനർ ദർഘാസ്/ലേലത്തിനുശേഷം പുനർ ദർഘാസ്/ലേല സംഖ്യയേക്കാൾ കൂടുതൽ വിലകൊടുക്കുവാൻ തയ്യാറാണെന്ന് കാണിച്ചുകൊ≠് നൽകുന്ന വാഗ്ദാനങ്ങൾ താഴെപ്പറയുന്ന നിബന്ധനകൾക്ക് വിധേയമായി സ്വീകരിക്കുന്നതായിരിക്കും.

(എ) പുനർ ദർഘാസ്/ലേല സംഖ്യ 1 ലക്ഷമോ അതിൽ കൂടുതലോ ആണെങ്കിൽ വാഗ്ദാന സംഖ്യ ദർഘാസ്/

(ബി) പുനർ ദർഘാസ്/ലേല സംഖ്യ 1 ലക്ഷത്തേക്കാൾ കുറവാണെങ്കിൽ വാഗ്ദാന സംഖ്യ ദർഘാസ്/ലേല

(സി) പുനർ ദർഘാസ്/ലേലക്കാരൻ, ദർഘാസ്/ലേല ദിവസം കെട്ടിയ സംഖ്യയുടെ ഇരട്ടി സംഖ്യ ജാമ്യമായി അടയ്ക്കേ≠താണ്.

(ഡി) പുനർ ദർഘാസ്/ലേലത്തീയതി മുതൽ 7 ദിവസത്തിനകം വാഗ്ദാനം (പോസ്റ്റ് ഓഫർ) ഈ ഓഫീസിൽ ലഭിച്ചിരിക്കണം.

(ഇ) വാഗ്ദാനങ്ങൾ നൽകിയ അപേക്ഷ കണക്കിലെടുത്ത് അയക്കുന്ന നോട്ടീസ് കൈപ്പറ്റി 7 ദിവസത്തിനകം ടി സംഖ്യ ട്രഷറിയിൽ അടച്ച് ചെലാൻ രസീത് ഹാജരാക്കണം.

(എഫ്) വാഗ്ദാനക്കാരൻ 100 മുദ്രപ്പത്രത്തിൽ കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ മുമ്പാകെ മേൽ (cid:31)

നിബന്ധനകൾ സ്വീകാര്യമാണെന്ന ഉടമ്പടി വയ്ക്കേ≠താണ്.

(ജി) മേൽ നിബന്ധനകൾ അനുസരിച്ചാൽ ആവശ്യമായ പരസ്യം നൽകി പുനർ ദർഘാസ്/ലേലം നടത്തുന്നതു മാണ്. പുനർ ദർഘാസ്/ലേലത്തിൽ മുൻ ദർഘാസ്/ലേലത്തേക്കാൾ കുറഞ്ഞ സംഖ്യ മാത്രമേ ലഭിച്ചിട്ടുള്ളു വെങ്കിൽ വാഗ്ദാനക്കാരന് നൽകുന്നതായിരിക്കും. എന്നാൽ കൂടുതൽ സംഖ്യയ്ക്ക് ദർഘാസ്/ലേലം നടന്നാൽ കൂടുതൽ സംഖ്യക്ക് കൊ≠ ആൾക്ക് നൽകുന്നതുമാണ്. കൂടുതൽ വിവരങ്ങൾക്ക് ഈ ഓഫീസിലോ ബന്ധപ്പെട്ട റെയിഞ്ച് ആഫീസിലോ അന്വേഷിച്ചാൽ അറിയാവുന്നതാണ്.

29. താഴെ പട്ടികയിൽ കാണിച്ചിരിക്കുന്ന യൂണിറ്റുകളിൽ ഏതെങ്കിലും യൂണിറ്റിന്റെ ലേലം ഭാഗികമായോ മുഴുവനായോ നിർത്തി വയ്ക്കുന്നതിനുളള അധികാരവും അവകാശവും ലേലം നടത്തുന്ന ഉദ്യോഗസ്ഥന് ഉ≠ായിരിക്കുന്നതുമാണ്. അങ്ങനെ നിർത്തിവെക്കുന്ന വിവരങ്ങൾ ലേലത്തിന് മുമ്പായി അറിയിക്കുന്നതാണ്.
