WHEREAS, the Government of Kerala has published Act No. 21 of 2005, namely, the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Act 2003, which came into effect from 2nd day of June 2000 for the conservation and management of ecologically fragile lands, minimizing the reduction of degradation of the Eco-system and Biological Diversity therein.
NOW, it is hereby notified for the information of the public that the ownership and possession of the land as per the details shown in the schedule hereto, in the District of Wayanad has been vested with the Government of Kerala free from all encumbrances and the right, title and interest of the owner or any other person thereon shall stand extinguished from the date of commencement of the Act, i.e. 2nd June 2000.
The publication of the notification is made as required under Section 3(2) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Act, 2003 as per Government Notification No. 15567/Leg./B1/01/Law dated 3rd May 2005 and published in Kerala Gazette No. 929 dated 3rd May 2005.

P V V P V But on scrutiny of the above said notification by the Custodian of Ecologically Fragile Lands as provided under Section 19(3) (b) of the Ecologically Fragile Lands Act, 2003 by following the Procedure prescribed under Rule 20 of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Rules 2007, it was found that the land is not predominantly supporting natural vegetation or any special features as an Ecologically Fragile Land even in the year 2000 and the said land does not qualify the definition of Ecologically Fragile Land as defined under Section 2b(i) of the Ecologically Fragile Land Act 2003 and therefore it is decided that the area has to be excluded from the Ecologically Fragile Land notification.
26th FEB. 2013] FOREST DEPARTMENT 151In the above circumstances it is hereby notified that the area notified against Serial Number 58 in column number (1) of the original Notification No. C6-21437/2000 dated 12-7-2001 and published in Kerala Gazette No. 36, Volume 46 dated 11-9-2001 and revised to the above extent by invoking the powers conferred under Section 19(3) (b) of the Ecologically Fragile Lands Act 2003 with immediate effect.
Explanatory Note
(This does not form part of the notification, but is intended to indicate its general purport.) An extent of 2.1367 Hectares of land in Survey No. 1pt of Ambalappara Village of Cherattimala locality of Ottappalam Forest Range of Palakkad Forest Division, Ottappalam Taluk in Palakkad District was notified as Ecologically Fragile Land under Section 3 (1) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Ordinance 2000 as per Notification No. C6-21437/2000, dated 12-7-2001 and published in Kerala Gazette No. 36, Volume 46 dated 11-9-2001 as Sl. No. 58 in Column No. 1. The notified land is not predominantly supporting Natural vegetation even in the year 2000 and does not come under the definition of Ecologically Fragile Lands as defined under Section 2(b) (i) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Act 2003.
As per letter No. T-1038/2008 dated 29-11-2011 of DFO, Palakkad and as per report dated 23-9-2011 of Committee which inspect the land, it has been reported that the land is having well maintained rubber plantation. It shows that the area does not come under the definition of Ecologically Fragile Land, it was reported that the land is having well maintained rubber plantation. It shows that the area does not come under the definition of Ecologically Fragile Land, as defined under Section 2(b) (i) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Act and hence the said land is not liable to be vested as Ecologically Fragile Land under Section 3(1) of the Ecologically Fragile Lands Act 2003.
In the above circumstances this notification is issued to remove the said land from the original Notification No. C6-21437/2000 dated 12-7-2001 and published in Kerala Gazette No. 36, Volume 46 dated 11-9-2001 as Sl. No. 58 in column No. (1) and original notification is revised extent by invoking the powers conferred under Section 19(3) (b) of the Ecologically Fragile Lands Act with immediate effect. The above notification is intended to achieve the above purpose.

It is hereby notified for the information of the public that the Ecologically Fragile Lands notified vide C6-21437/2000 dated 12-7-2001 of Principal Cheif Conservator of Forests and Custodian has already been vested with Government by virtue of the provisions under secction 3 (1) of the Kerala Forest Vesting and Management of Ecologically Fragile Lands Ordinance 16/2001. But the name of Village, Survey No. with sub division, extent and boundaries of the land was mentioned erroneously instead of actual in the original Notification. Hence the following corrections are made in the column Nos. 8, 9, 10, 11, 12, 13 & 14 of schedule shown below in respect of the notification published in Kerala Gazette No. 36 volume 46 dated 11-9-2001 as Serial Number 47 as per No. vide C6-21437/2000 dated 12-7-2001 of Principal Cheif Conservator of Forest and Custodian. The materials collected by final felling teak plantations in Mannarappara Range of Konni Forest Division and stacked at dumping sites shown in the schedule hereto attached will be sold in tender/auction by the undersigned or by any other officer authorized for the purpose, on the date and time shown in the schedule. The sale condition published by the Additional Principal Chief Conservator of Forests (protection), Thiruvananthapuram vide notification No. Pro.(5)-26274/2012 dated 11-12-2012 in the Kerala Government Gazette Vol. 1 (No. 29) dated 25-12-2012 and other sale conditions prevalent in the Forest Department are applicable to this Tender/Auction sale. This Gazette notification is available in the website of Forest Department www.forest.kerala.gov.in. Any further notification on the sale conditions that may be ordered by the Government after the publication of this sale notification will also be applicable to the sale. If the notified date of Tender/Auction is declared as a holiday, the sale will be conducted on the next working day and if the sale is not possible on the notified date due to other reasons, the same will be conducted on the alternate date shown in the schedule at the same place and time without further notification. The intending bidders should satisfy themselves about the quality and quantity of the materials put up for sale before the commencement of the auction and any complaint whatsoever, will not be entertained after the sale proceedings are over. In case, any Government Department requires any of the materials, the quantity remaining after their selection only will be auctioned. The quantity that may become available for sale after the publication of this notification will also be included in this sale. The tender/ auction will commence at the time noted in the schedule in the dumping site and will continue till the sale of materials lotted for the day is over.
Tender form can be had from the concerned Range Offices till 1 p.m. on the day before the auction date on payment of ` 200 + VAT. The last date and time of receipt of tender is at 9 a.m. on the auction date.

Filled up tender forms along with other documents shall be submitted to the undersigned upto 3 p.m. on 13-3-2013 by post or any approved courier service. In the case of downloaded tender applications, in addition to the prescribed EMD, a Demand Draft for the tender form value from a Nationalized Bank drawn in favour of Wildlife Warden, Wildlife Division, Munnar payable at Munnar shall also be enclosed. Other mode of remittance of tender form cost is not acceptable.
The Earnest Money Deposit noted against the work should be paid along with the tenders by DD (cheques or fixed deposit receipt will not be acceptable) in favour of the undersigned payable at any Nationalized Bank at Munnar. Incomplete tender or tenders without EMD are liable to be rejected. The preliminary agreement in Stamp Paper worth ` 100 should be enclosed with tender. The undersigned reserves the right to reject any tender without assigning any reason. All other conditions prevailing in the Kerala Public Works Department and Forest Department are applicable to this tender notice also.
If the tender is not conducted on the stipulated date due to administrative reason, that will be conducted on the next working day.
