പുനലൂർ ഡിവിഷനിലെ പത്തനാപുരം റെയിഞ്ചിലെ ഒ. ആർ. 5/08 നമ്പർ കേസിൽ പിടിച്ചെടുത്ത് സർക്കാരിലേക്ക് ക≠ുകെട്ടിയിട്ടുള്ള താഴെ പറയുന്ന വാഹനം ലേലം കൊള്ളുന്നതിന് താൽപ്പര്യമുള്ളവരിൽ നിന്നും മുദ്രവച്ച ദർഘാസുകൾ ക്ഷണിച്ചുകൊള്ളുന്നു. പൂരിപ്പിച്ചതും മുദ്രവച്ചതുമായ ദർഘാസുകൾ നി›ിത നിരതദ്രവ്യത്തോടൊപ്പം 12-3-2013-ാം തീയതി 3 മണിവരെ ഈ ആഫീസിൽ സ്വീകരിക്കുന്നതും അന്നേദിവസം 3.30 മണിക്ക് അപ്പോൾ ഹാജരുള്ള ദർഘാസുകാരുടെ സാന്നിദ്ധ്യത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറോ അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന മറ്റ് ഉദ്യോഗസ്ഥനോ ഡിവിഷൻ ഓഫീസിൽവച്ച് വാഹനങ്ങൾ പരസ്യമായി ലേലം ചെയ്യുന്നതും തുടർന്ന് ദർഘാസുകൾ തുറക്കുന്നതുമായിരിക്കും. 12-3-2013-ന് ലേലം നടക്കാതെ വന്നാൽ 16-3-2013-ന് ലേലം നി›ിത സ്ഥലത്തും സമയത്തും വച്ച് നടത്തപ്പെടുന്നതായിരിക്കും. ദർഘാസ് ഫോറങ്ങൾ ദർഘാസ് ദിവസം ഒരു മണിവരെ നി›ിത വിലയും നികുതിയും അടച്ചാൽ ഈ ഓഫീസിൽ നിന്നും ലഭിക്കുന്നതാണ്. കൂടുതൽ വിവരങ്ങൾ പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ ഓഫീസിൽ ഓഫീസ് സമയങ്ങളിൽ അന്വേഷിക്കേ≠താണ്.

ദർഘാസ് ദിവസം പൊതു അവധി ദിവസമായി പ്രഖ്യാപിക്കപ്പെട്ടാൽ അടുത്ത പ്രവൃത്തി ദിവസം നി›ിത സ്ഥലത്തും സമയത്തും ലേലം നടത്തുന്നതാണ്.

വാഹനത്തിന്റെ പേര്—കെ. എൽ.-25-1776 മഹീന്ദ്ര പിക്ക് അപ്പ് വാൻ, എഞ്ചിൻ നമ്പർ—GA 61 J-33-480 ചെയിസ് നമ്പർ—MAIRC-4-GAA 61 J 36351, മോഡൽ—2006.

നിബന്ധനകൾ

താൽപ്പര്യമുള്ളവർക്ക് മുകളിൽ പറയുന്ന സ്ഥലത്ത് സൂക്ഷിച്ചിരിക്കുന്ന വാഹനം ബന്ധപ്പെട്ട ആഫീസറുടെ അനുവാദത്തോടെ പരിശോധിച്ച് ഗുണനിലവാരം ബോദ്ധ്യപ്പെടാ വുന്നതാണ്. ലേലത്തിനുശേഷം ഗുണനിലവാരം സംബന്ധിച്ച് ഉന്നയിക്കുന്ന യാതൊരു പരാതികളും പരിഗണിക്കുന്നതല്ല.

ദർഘാസുകൾ ആവശ്യമുള്ളവർ അവരെ തിരിച്ചറിയുന്നതിന് തെരഞ്ഞെടുപ്പ് കമ്മീഷനോ ബന്ധപ്പെട്ട വില്ലേജാഫീസറോ നൽകിയിട്ടുള്ള തിരിച്ചറിയൽ കാർഡ്/സർട്ടിഫിക്കറ്റ് സഹിതം അപേക്ഷിക്കേ≠താണ്.

ദർഘാസിനോടൊപ്പം നി›ിത നിരതദ്രവ്യം ഈ ഓഫീസിൽ ഒടുക്കേ≠താണ്.

ലേലം/ദർഘാസിൽ പരിഗണിക്കപ്പെടാത്തവരുടെ നിരതദ്രവ്യം അപ്പോൾത്തന്നെ തിരികെ നൽകുന്നതാണ്.

കൂടുതൽ തുകയ്ക്കുള്ള ദർഘാസുകൾ ആവശ്യമു≠െങ്കിൽ മേലധികാരത്തിലേക്ക് അയയ്ക്കുന്നതും മറ്റ് ദർഘാസുകാർ നൽകിയ നിരതദ്രവ്യം അപ്പോൾത്തന്നെ തിരികെ നൽകുന്നതുമാണ്.

ദർഘാസ് സംഖ്യ നിരതദ്രവ്യത്തിനേക്കാൾ കൂടുതലാണെങ്കിൽ ദർഘാസ് സംഖ്യയുടെ 50% (നിരതദ്രവ്യം ഉൾപ്പെടെ) അപ്പോൾത്തന്നെ ഒടുക്കേ≠താണ്. ദർഘാസ് സംഖ്യ നിരതദ്രവ്യത്തിനേക്കാൾ കുറവാണെങ്കിൽ കൂടുതൽ അടച്ച തുക വിജയിയായ ദർഘാസുകാരന് ദർഘാസ് തുറക്കുന്ന ദിവസം തന്നെ തിരികെ നൽകുന്നതാണ്. ലേലം/ ദർഘാസ് തുക ` 10,000-ൽ കുറവാണെങ്കിൽ മുഴുവൻ തുകയും അപ്പോൾത്തന്നെ ഒടുക്കണം.

ദർഘാസുകൾ ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥന്റെ അധികാരത്തിന് വിധേയമായിരിക്കും. ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനുള്ള പൂർണ്ണ അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമായിരിക്കും.

ദർഘാസുകൾ അംഗീകരിച്ചതായി അറിയിപ്പുകിട്ടി 15 ദിവസത്തിനകം ബാക്കി സംഖ്യയും നിയമപ്രകാരമുള്ള നികുതിയും അടച്ച് വാഹനം നീക്കം ചെയ്യേ≠താണ്.

15 ദിവസത്തിനുള്ളിൽ ബാക്കി സംഖ്യയും നികുതികളും അടച്ച് വാഹനം നീക്കം ചെയ്തില്ലെങ്കിൽ ദർഘാസുകാരൻ ആവശ്യപ്പെടുന്നപക്ഷം മറ്റൊരു 15 ദിവസംകൂടി സംഖ്യയ്ക്ക് 12% പലിശയും ദിവസം ` 20 നിരക്കിൽ ഇരുപ്പുവാടകയും വസൂലാക്കി അനുവദിക്കുന്നതായിരിക്കും. ഇതിനുശേഷം കാലാവധി നീട്ടി അനുവദിക്കുന്നതല്ല. ഇപ്രകാരം വീഴ്ച വരുത്തിയ ദർഘാസുകാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ലേലത്തിലോ ടെ≠ർ അടിസ്ഥാനത്തിലോ പുനർ വിൽപ്പന നടത്തുന്നതും അതിൽ ഉ≠ാകുന്ന നഷ്ടം അടച്ച തുകയും ശേഷമുള്ളത് നിയമാനുസൃതം വീഴ്ച വരുത്തിയ ദർഘാസുകാരിൽ നിന്നും ഈടാക്കുകയും ചെയ്യുന്നതാണ്.

ദർഘാസ് പൂരിപ്പിച്ച് നൽകിയവർക്കുമാത്രമേ ലേലത്തിൽ പങ്കെടുക്കുവാൻ അവകാശമുള്ളൂ.

ദർഘാസിനാവശ്യമായ പ്രമാണങ്ങളും മറ്റു വിവരങ്ങളും പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽനിന്നും ദർഘാസ് ദിവസം ഉച്ചയ്ക്ക് ഒരു മണിവരെ എല്ലാ പ്രവൃത്തി ദിവസ ങ്ങളിലും ദർഘാസ് ഫോറത്തിന്റെ വിലയും വാറ്റും രൊക്കമായോ മണിയോർഡറായോ അയച്ച് രേഖാമൂലം അപേക്ഷിച്ചാൽ ലഭിക്കുന്നതാണ്. ദർഘാസ് ഫോറത്തിന്റെ വില തിരിച്ചുനൽകുന്നതല്ല. കേരള പൊതുമരാമത്ത് വകുപ്പിന്റെ ദർഘാസുകളെ സംബന്ധിക്കുന്ന എല്ലാ വ്യവസ്ഥകളും ഈ പ്രവൃത്തിക്കും ബാധകമായിരിക്കും. ദർഘാസ് ഫോറങ്ങൾ കൈമാറ്റം ചെയ്യാൻ പാടില്ല. കരാറുകാർ ദർഘാസിനോടൊപ്പം നിർദ്ദിഷ്ട മാതൃകയിൽ ` 100-ന്റെ മുദ്രപ്പത്രത്തിൽ പ്രാരംഭ കരാർ, നി›ിത തുകയ്ക്കുള്ള നിരതദ്രവ്യം പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെ പേരിൽ പുനലൂർ എസ്.ബി.റ്റി. യിൽ മാറാവുന്ന ഡിമാന്റ ് ഡ്രാഫ്റ്റ് എന്നിവ കൂടി സമർപ്പിക്കേ≠താണ്. പ്രാഥമിക ഉടമ്പടി ഇല്ലാത്ത ദർഘാസുകൾ നിരസിക്കുന്നതാണ്. ദർഘാസ് ദിവസം ഏതെങ്കിലും കാരണവശാൽ അവധിയായാൽ അടുത്ത പ്രവർത്തി ദിവസം നി›ിത സ്ഥലത്തും സമയത്തും ദർഘാസ് നടത്തുന്നതാണ്.

ഏതെങ്കിലും കാരണവശാൽ നി›ിത ദിവസം ദർഘാസ് നടപടികൾ നടക്കാതെ വന്നാൽ 16-3-2013-ന് ക്രമപ്രകാരം ദർഘാസ് നടപടി നടത്തുന്നതാണ്.

Tenders are invited from reputed firms to set up, manage and operate automated online/offline ticket reservation systems for boating tickets in Periyar Tiger Reserve. The interested parties should be willing to invest the cost on Build, Operate and Transfer (BOT) basis for a period of five years and quote service charge over the online transactions set aside for the online booking of boat tickets operated by Periyar Tiger Reserve. The services will also include total hardware and software solutions. For not only boating services but also for other tourism related activities of Periyar Tiger Reserve. The successful tender will have to sign an agreement in a stamp paper worth ` 100 regarding the successful execution of the supply in respect of quality, quantity and the period of supply. The tenders will be opened by the undersigned at 3.30 p.m. on 6-3-2013 in the presence of such of the tenderers or their authorized representatives who may be present at that time.

This Gazette notification is available in the website of Forest Department www.forest.kerala.gov.in. 2. Intending Tenderers/Bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before participating in the Tender cum Auction. Complaints if any, regarding quality and quantity etc. received after the Tender cum Auction will not be entertained.

3. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another person unless valid power of attorney is produced prior to the commencement of Tender cum Auction.

4. A supply contractor of Kannur Division or any adjacent Divisions will not be allowed to bid in the Tender cum Auction.

5. Intending tenderers/bidders should produce photo identity proof issued by government authority or a certificate from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.

KANNUR DIVISION

TENDER-CUM- AUCTION NOTICE No. KN-9825/2012. 4th February 2013.

It is hereby notified for the information of the public that the right of collection and removal of enumerated standing Elavu, Kambili, Matty, Murikku, Vatta and other misc. species of trees in the 1955 softwood plantation, Kannavam (10 Ha), 1980 Teak & Softwood plantation, Velumbath (64.41 Ha), Kannavam in Kannavam Range of this Division as specified in the schedule appended below will be sold in tender-cum-auction by the Divisional Forest Officer, Kannur or any other officers authorized by him on 15-3-2013 at 11.30 a.m. at the Divisional Forest Office, Kannur, subject to the terms and conditions of sale of timber in Government Timber Depots published in Government Gazette No. 50 dated 16-12-2008 Page No. 481 to 488 of Forest Sheet as per Pro.(5)-7698/08 dated 6-12-2008 of the Chief Conservator of Forests (P), Thiruvananthapuram. In case the notified date happens to be public holiday, the Tender cum Auction will be conducted on the next working day at the notified place and time. If there is a requirment of re-auction, it will be conducted on 19-3-2013 at the same place.

1. The auction will be on lump sum basis for the right of collection and removal of entire Elavu, Kambili, Matty, Murikku, Vatta and other soft wood species of trees growth from the above plantations mentioned in the schedule hereto, the area of which has been surveyed and demarked on the ground.

6. The successful tenderers/bidders should give an undertaking that he is not related with any officer having control over the work and that he is not a supply contractor of this or any adjacent Division. If this is proved otherwise, it shall result in cancellation of the contract and resale of the coupe at his risk and loss.

7. No post offer received after 7 days of the conduct of the Tender cum Auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is ` One lakh and above and more than 20% where the original bid amount is less than one lakh will ordinarily be considered. The post offerer will comply with following terms.

(a) Offer should be made within 7 days of Tender cum Auction failing to which the offer will not be considered.

(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender cum Auction date.

(c) The remittance should be made by the chalan or bank deposit and the Bank receipt should be produced before the Divisional Forest Officer concerned within 7 days from the date of receipt of registered notice to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the post offerer satisfied the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules. In the re-auction, the price fetched if does not come up to what has been offered by the post offerer,5th MARCH 2013] FOREST DEPARTMENT 171 it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest Bidders/ Tenderers in the re-auction and the amount remitted by the post offerer will be released to him.

8. Further particulars about the Tender cum Auction can be had either from the Office of the Divisional Forest Officer or from the Range office, Kannavam.

9. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of ` 10,000 (Rupees ten thousand only) for each Plantation/Block for participating in the Tender/Auction.

10. The successful Tenderers/Bidders have to remit 1/3rd of sale value on the Tender cum Auction date, failure to which may result in the forfeiture of the E.M.D. to the Government and the resale of coupe at the risk and loss of the person concerned.

11. The successful tenderers/bidders have only the right for the collection and removal of marked Elavu, Kambili, Matty, Murikku, Vatta and other softwood trees as mentioned in the Schedule Appended and will have no right over Teak, Rosewood or such other unmarked trees.

12. The successful tenderers/bidders should execute a bounden agreement on a stamp paper worth ` 100 after the completion of Tender cum Auction.

13. The conformation of the Tender cum Auction sale will be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the conformation, the successful tenderers/bidders shall remit the balance 2/3rd of the sale value and 5% Forest Development Tax, VAT and Income Tax at the rates in force and security deposit of 10% for the total sale value. The successful tenderers/bidders should execute an agreement on a stamp paper worth ` 100. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. In case of failure to remit the amount within the extended period further extension for 15 days by the Chief Conservator of Forests, Northern Circle, Kannur subject to the realization of 24% penal interest. But all the above extension period will be within the original contract period. Failure to remit any of the above installment even during the extended period will entail cancellation of the contract and forfeiture of all money paid till then and all produce remaining in the coupe. The right thus cancelled will be resold at the risk and loss of the contractor. In calculating interest, 15 days and below will be reckoned as ½ month and over 15 days as one month.

14. If the successful tenderers/bidders fails to execute the agreement after remitting the amount even during the extended period as per the above condition, entire amount paid till then will be forfeited to the Government and all the produce left unremoved in the coupe will be confiscated to Government after canceling the Tender cum Auction. The coupe will be re-auctioned at the risk and loss of the tenderers/bidders. He will be liable for all the loss sustained to the Government and will have no right over the profit derived out of the re-auction of the coupe.

15. Failure to remit any of the above instalment even during the extended period will, entail the cancellation of the contract and forfeiture of all the money paid till then and confiscation of all the produce remaining in the coupe. The right thus cancelled will be resold at the risk and loss of the contractor. The contractor will have no right over the profit derived out of the resale of the coupe.

16. The period of contract will be allowed 90 days from the date of intimation of confirmation. No extension of period of contract shall be granted on ordinary ground. Under special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests, Northen Circle, Kannur and the Additional Principal Chief Conservator of Forests (Region North), Kozhikode concerned may grant extension of time for 30 days, further 30 days, further 30 days respectively on realization of penalty or penalties for completion of each work for each extension mentioned below:

(a) For enumerated trees and balance unfelled per hectare or fraction thereof ` 750 per hectare.

(b) Unremoved registered logs and unregistered logs and bamboo ` 100/M³/MT or fraction thereof.

(c) Unremoved firewood ` 50/Tone or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during the original contract period. The penalty for the first 30 days shall be realized at the above rates, double the rate for the second 30 days and three times of the original rate for the third 30 days shall be realized.

If the tenderers/bidders fails to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenderers/bidders as per the agreement will be forfeited to Government and the tenderers/bidders will not have any right on the produce confiscated to Government. In the above circumstances the balance work to be executed by the tenderers/bidders shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the tenderers/bidders.

17. The contractor shall be allowed to remove the timber of Elavu, Kambili, Matty, Murikku, Vatta and other misc. species and fire wood from the coupe subject to the law prevailing in the department from time to time.

18. The contractor or his persons shall be allowed to enter in the coupe only after getting the prior permission either from the Divisional Forest Officer, Kannur or from the Forest Range Officer, Kannavam.

19. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 Meters and keep the cairns intact.

20. He will be liable for the damages made to other trees in plantations or RF.

21. The successful tenderers/bidders may allow to stack the timber in the forest area outside the coupe at the risk of the tenderers/bidders up to the period of contract. An amount of ` 250 will be charged as ground rent for the timber unremoved for 1 Ha. or fractions thereof.

22. He will be liable for all illegal activities happened 400 Mtr. (2 Furlong) surrounding of the coupe. Such incidents, if noticed by contractor, should be informed the officer concerned, otherwise will lead to the cancellation of the contact.

23. The security deposit will be released to the Contractor on production of clearance certificate of VAT, Agricultural Income Tax etc. any liability outstanding will be set off from the security deposit.

24. If the value fetched in the re-tender/re-auction is less than that obtained in the original Tender cum Auction, the difference between them together with all incidental expenditure to fix up of the resale including notification charges or any other dues or Government loss as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting tenderers/bidders through all legal means including Revenue Recovery Act in force.

25. General condition of the sale of tree growth. Prevailing in the department from time to time shall be applicable to this Tender cum Auction also.

26. No unmarked tree shall be felled or damaged while felling a marked tree. Such instances if any will be treated as violation of agreement condition.

27. The tenderer/bidder should have PAN card otherwise Income Tax at the higher rate in force will be lived.

ദർഘാസ് കം ലേല ദിവസം പൊതു അവധിയായി വന്നാലോ മറ്റേതെങ്കിലും കാരണത്താലോ ദർഘാസ് കം ലേലം നടത്താൻ കഴിയാതെ വന്നാൽ ടി ദർഘാസ് കം ലേലം അടുത്ത പ്രവൃത്തി ദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും വച്ച് നടത്തുന്നതായിരിക്കും. പുനർലേലം ആവശ്യമാണെങ്കിൽ 19-3-2013-ന് ഇതേ സ്ഥലത്തും സമയത്തും വച്ച് നടത്തുന്നതാണ്.

3. ദർഘാസുകാരൻ/ലേലക്കാരൻ നേരിട്ട് ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കേ≠താണ്. നിയമപരമായ പവർ ഓഫ് അറ്റോർണി ഇല്ലാത്ത പകരക്കാരെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല.

4. കണ്ണൂർ ഡിവിഷനിലെയും മറ്റ് സമീപ ഡിവിഷനു കളിലെയും സപ്ളൈ കോൺട്രാക്ടർമാരെ ടി ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.

5. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹി ക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കൈയ്യൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽ നിന്നും വാങ്ങിയ സർട്ടിഫിക്കറ്റോ സർക്കാർ നൽകിയ ഫോട്ടോ പതിച്ച എെഡന്റ ിറ്റി കാർഡോ നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാക്കേ≠താണ്.

6. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ ആഫീസുമായോ ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസ് കം ലേല ദിവസം ദർഘാസുകാരൻ/ലേലക്കാരൻ ഈ ഓഫീസിൽ സമർപ്പിക്കേ≠താണ്. ഇത്തരത്തിൽ ദർഘാസുകാരൻ/ലേലക്കാരൻ ബന്ധപ്പെട്ട ആഫീസർ മാരുമായി ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാന്റെ പേരിലുള്ള ദർഘാസ് കം ലേലം റദ്ദ് ചെയ്ത് ടിയാന്റെ നഷ്ടോ ത്തരവാദിത്വത്തിൽ ടി കൂപ്പുകൾ പുനർ ലേലം ചെയ്യുന്നതാണ്.

7. ദർഘാസ് കം ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭി ക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുള്ള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരു ലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10 ശതമാനത്തിൽ കുറ യാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽപ്പെട്ട ലേലങ്ങൾക്ക് 20 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകൾ മാത്രമേ പരിഗണിക്കുകയുള്ളൂ. കൂടാതെ താഴെ പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമാണ്.

10. കൂടുതൽ തുകയ്ക്ക് ദർഘാസ് കം ലേലം കൊള്ളുന്ന തുക ലേലം കഴിഞ്ഞാലുടൻ ഒടുക്കേ≠താണ്. ടി തുക ഒടുക്കുന്ന തിന് വീഴ്ചവരുത്തിയാൽ ടിയാൻ ഒടുക്കിയിട്ടുള്ള നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും ടി കൂപ്പ് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതുമായിരിക്കും.

11. ദർഘാസ് കം ലേലം കൊള്ളുന്ന ആൾക്ക് പ്രസ്തുത കൂപ്പിൽ മാർക്ക് ചെയ്ത് എന്യൂമറേറ്റ് ചെയ്തു നിർത്തി യിരിക്കുന്ന ഇലവ്, കമ്പിളി, മട്ടി, മുരിക്ക്, വട്ട, മറ്റു പലജാതി എന്നീ മരങ്ങൾ മാത്രം അവകാശമുള്ളതും തേക്ക്, ഈട്ടി മുതലായ മറ്റ് മരങ്ങൾക്ക് അവകാശമില്ലാ ത്തതുമാകുന്നു.

12. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലം കൊള്ളുന്ന ആൾ ` 100-ന്റെ മുദ്രപത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടി കൂടി ലേലം കഴിഞ്ഞാലുടൻ ഒപ്പ് വയ്ക്കേ≠താണ്.

13. ദർഘാസ് കം ലേലം സ്ഥരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുടെ  ലേലത്തുകയും മൊത്തം തുകയുടെ ⁵% ഫോറസ്റ്റ് ഡവലപ്മെന്റ ് ടാക്സും നിലവിലുള്ള നിരക്കിൽ വാറ്റ്, ഇൻകം-ടാക്സ് എന്നിവകളും ഒടുക്കി മൊത്തം ലേല തുകയുടെ 10% സെക്യൂരിറ്റി ഡെപ്പോസിറ്റും വെച്ച ` 100-ന്റെ മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠തുമാണ്. 15 ദിവസത്തിനുള്ളിൽ ടി തുകകൾ ഒടുക്കാതിരുന്നാൽ 12% പലിശയോടുകൂടി തുകകൾ ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറും മുകളിൽപ്പറഞ്ഞ കാലാവധിക്കുള്ളിൽ തുകയടയ്ക്കാതിരുന്നാൽ 15 ദിവസത്തെ സമയം ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ, നോർത്തേൺ സർക്കിൾ, കണ്ണൂരിന് 24% പലിശയോടുകൂടി കാലാവധി ദീർഘിപ്പിച്ചു നൽകുന്നതാണ.് പലിശ കണക്കാക്കുമ്പോൾ 15 ദിവസമോ അതിൽ കുറവോ വരുന്നത് പകുതി മാസമായും 15 ദിവസത്തിൽ കൂടുതൽ വരുന്ന ദിവസം ഒരു മാസമായും കണക്കാക്കുന്നതാണ്.

14. മുകളിലെ വ്യവസ്ഥപ്രകാരം നീട്ടിക്കൊടുത്ത കാലാവധി ക്കുള്ളിലും തുക ഒടുക്കി എഗ്രിമെന്റ ് വയ്ക്കുന്നതിന് വീഴ്ച വരുത്തിയാൽ ദർഘാസുകാരൻ/ലേലക്കാരൻ അതുവരെ ഒടുക്കിയിട്ടുള്ള എല്ലാ തുകയും നീക്കം ചെയ്യാതെ കിടക്കുന്ന എല്ലാ ഉൽപ്പന്നങ്ങളും സർക്കാരി ലേക്ക് ക≠ുകെട്ടി ലേലം റദ്ദ് ചെയ്യുന്നതും ദർഘാസു കാരന്റെ/ലേലക്കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പ് പുനർലേലം ചെയ്യുന്നതുമാണ്. പുനർലേലം ചെയ്യുമ്പോൾ ലാഭം ഉ≠ാകുകയാണെങ്കിൽ ആയതിന് ലേലക്കാരന് യാതൊരുവിധ അവകാശവും ഉ≠ായിരി ക്കുന്നതല്ല. പുനർ ലേലത്തിലു≠ാകുന്ന എല്ലാ നഷ്ടങ്ങളും വീഴ്ചക്കാരനിൽനിന്നും ഈടാക്കുന്നതാണ്.

15. ദർഘാസുകാരൻ/ലേലക്കാരൻ ബാക്കി തുക മുതലായവ നീട്ടിക്കൊടുത്ത കാലാവധിക്കുള്ളിലും ഒടുക്കാതിരുന്നാൽ ഉടമ്പടി റദ്ദ് ചെയ്ത് ടിയാൻ അടച്ചിട്ടുള്ള മുഴുവൻ തുകകളും നീക്കം ചെയ്യാതെ കിടക്കുന്ന എല്ലാ ഉൽപ്പന്നങ്ങളും സർക്കാരിലേക്ക് ക≠ുകെട്ടി ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതാണ്. പുനർലേലത്തിൽ ലാഭം ഉ≠ാകുകയാണെങ്കിൽ വീഴ്ച ക്കാരന് യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല.

16. ഉടമ്പടി കാലാവധി ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 90 ദിവസമാണ്. സാധാരണഗതിയിൽ കൂപ്പിന്റെ കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ, ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ, നോർത്തേൺ സർക്കിൾ, കണ്ണൂർ, അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (കോഴിക്കോട് നോർത്ത്) എന്നിവർ യഥാക്രമം തുടർന്നുള്ള 30 ദിവസം വീതം താഴെ പറയുംപ്രകാരം പിഴ ഈടാക്കിക്കൊ≠് ഓരോ ജോലിക്കും കാലാവധി നീട്ടിക്കൊടുക്കുന്നതാണ്.

(1) എന്യൂമറേറ്റ് ചെയ്തതും മുറിക്കാനുള്ളതുമായ മര ങ്ങൾക്ക് ഓരോ ഹെക്ടറിനും അതിന്റെ ഭാഗത്തിനും ` 750 വീതം.

(2) നീക്കം ചെയ്യാത്ത രജിസ്റ്റർ ചെയ്തതും അല്ലാത്ത തുമായ തടികൾക്ക്/മുളകൾക്ക് ക്യു. മീറ്ററിനും/ മെ. ടണ്ണിനും അതിന്റെ ഭാഗത്തിലും ` 100 വീതം.

ഒന്നാമത്തെ 30 ദിവസത്തിന് ടി നിരക്കിലും 2-ാമത്തെ ദീർഘിപ്പിച്ച കാലാവധിയിൽ ഇതിന്റെ ഇരട്ടിയും 3-ാമത്തെ ദീർഘിപ്പിച്ച കാലയളവിൽ ഒന്നാമത്തെ 30 ദിവസത്തിന്റെ നിരക്കിന്റെ മൂന്നിരട്ടിയും എന്ന ക്രമത്തിൽ പിഴ ഈടാക്കുന്നതാണ്. ഇപ്രകാരം നീട്ടി നൽകുന്ന തീയതിക്കുള്ളിലും നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റിലേക്ക് മുതൽ കൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ാകുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ചെയ്തുതീർക്കാൻ ബാക്കിയുള്ള ജോലികൾ ഡിപ്പാർട്ട്മെന്റ ് ചെയ്യിക്കുന്നതും ആയതിൽ വച്ചു≠ാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടി ക്കാരനിൽനിന്നും ഈടാക്കുന്നതുമായിരിക്കും.

17. കൂപ്പിൽ ശേഖരിച്ചു വയ്ക്കുന്ന മൃദുമരങ്ങൾ, വിറകുകൾ എന്നിവ നിലവിലുള്ള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും നീക്കം ചെയ്യാനുള്ള ലൈസൻസ് നൽകുന്നത്.

18. കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെയോ കണ്ണവം ഫോറസ്റ്റ് റെയിഞ്ചാഫീസറുടെയോ രേഖാമൂലമുള്ള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ കൂപ്പിൽ പ്രവേശിക്കുവാൻ പാടുള്ളൂ.

19. ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാ സമയവും കൂപ്പിൽ ഉ≠ായി രിക്കണം. കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിയിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കേ≠തുമാണ്.

20. യാതൊരു കാരണവശാലും πാന്റേഷനിലെയോ റിസർവിലെയോ മറ്റ് മരങ്ങൾക്കും തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്തുവാൻ പാടില്ല. അങ്ങനെ ഉ≠ാകുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്.

21. കൂപ്പിന് പുറത്ത് ഫോറസ്റ്റ് സ്ഥലത്തും തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടിക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ അനുവദിക്കുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണങ്ങളാലോ മോശമായ കാലാവസ്ഥ മൂലമോ ഉടമ്പടി കാലാവധിക്കുള്ളിൽ ഇവ നീക്കം ചെയ്തു കൊ≠ുപോകാൻ കഴിയാതെ വന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്ടറിനോ അതിന്റെ ഭാഗത്തിനോ ` 250 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്ന തായിരിക്കും.

22. കൂപ്പിന് 0.4 കി. മീറ്റർ (2 ഫർലോങ്ങ്) ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ അനധികൃത കുറ്റകൃത്യ ങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്. അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ വിവരം ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥരെ ഉടമ്പടിക്കാരൻ അറിയിക്കേ ≠താണ്. ഇതിൽ വീഴ്ചവരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടാവുന്നതാണ്.

23. കരാറുകാരന്റെ സെക്യൂരിറ്റി തുക കാലാവധിക്കുശേഷം കരാറുകാരൻ വാറ്റ്, അഗ്രിക്കൾച്ചറൽ ഇൻകം ടാക്സ് ഇവയുടെ ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റ് ഹാജരാക്കുന്ന മുറയ്ക്ക് തിരിച്ചു നൽകുന്നതാണ്. എന്നാൽ ടി ഇനത്തിൽ ഗവൺമെന്റ ിലേക്ക് ബാദ്ധ്യതകൾ വല്ലതുമു≠െങ്കിൽ സെക്യൂരിറ്റി തുകയിൽ നിന്നും (3) നീക്കം ചെയ്യാത്ത വിറകിന് ഓരോ ടണ്ണിനും അതിന്റെ ഭാഗത്തിനും ` 50 വീതം.
