TENDER NOTICE

No. A2-3169/2012. 4th March 2013.

Sealed competitive tenders superscribing the name of work is invited till 3 p. m. on 27-3-2013 for the following work by Wildlife Warden, Thiruvananthapuram Wildlife Division for and on behalf of the Governor of Kerala from the contractors/firms having experience in similar works using standard materials of good quality for the Forest and Wildlife Department or any department for the following work. The tender will be opened at 3.30 p.m. in the presence of the bidders present on that date. The tender can be sent by post also well in advance so as to reach this office in time.

Name of Work with Approximate Estimate Amount— Construction of water supply arrangements at Elephant Rehabilitation Centre, Kappukadu in ABP Range, Kottoor during 2012-13—` 1.65 lakhs.

EMD—` 4,200.

Cost of tender form—` 400 + VAT. Qualification of Contractor—3 Years experience in Government or Quasi Government firm.

2 months from the date of agreement.

The details and necessary documents will be obtained from the Office of the Wildlife Warden, Thiruvananthapuram on any working days till 1 p. m. of tender date. Tender forms can be obtained by remitting cash including sale tax with necessary application. The cost of tender form will not be returned. The terms and conditions applicable to tender formalities in Store Purchase Rules will be applicable to this works also. Tender forms are not transferable. G. O. (P) 84/97/ P&T dated 19-8-1997 related to PWD tender is also applicable here. The Earnest Money Deposit will be accepted only as Demand Draft from Nationalised or Scheduled Bank. The Earnest Money Deposit has to be pledged in the name of Wildlife Warden, Thiruvananthapuram and the name of work must be entered on it. A preliminary agreement in Stamp Paper worth ` 100 in prescribed form should also be submitted along with the tender. The tender without the preliminary agreement will be refused. The successful tenderer is liable to remit the taxes as per rules. If the tender date becomes holiday, the tender will be conducted on the next working day.

ദർഘാസ് ഫോറങ്ങളും ജോലി സംബന്ധിച്ച വിവരങ്ങളും ദർഘാസ് ഫോറത്തിന്റെ വിലയും വില്പന നികുതിയും അടച്ച് അപേക്ഷിക്കുന്നവർക്ക് ദർഘാസ് സ്വീകരിക്കുന്ന അവസാന തീയതിയായ 27-3-2013, 1 മണിവരെ ഈ ഓഫീസിൽനിന്നും ലഭിക്കുന്നതാണ്. പൂരിപ്പിച്ച ദർഘാസുകൾ അന്നേദിവസം 3 മണിവരെ ഈ ഓഫീസിൽ സ്വീകരിക്കുന്നതാണ്. ദർഘാസ് ഫോറത്തിന്റെ വില മടക്കി കൊടുക്കുന്നതല്ല. ടി ദിവസം ഒരു പൊതു അവധിയായി വരുന്നപക്ഷം അടുത്ത പ്രവൃത്തി ദിവസം ടി സ്ഥലത്തും സമയത്തും വച്ച് ദർഘാസുകൾ സ്വീകരിക്കുന്നതും തുറക്കുന്നതുമായിരിക്കും.

ദർഘാസ് സ്വീകരിക്കുന്ന അവസാന തീയതിയായ 27-3-2013 പകൽ 3.30 ന് ഹാജരുള്ള കരാറുകാരുടെ സാന്നിദ്ധ്യത്തിൽ താഴെ ഒപ്പിട്ടിട്ടുള്ള ആളോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ ടെ≠റുകൾ തുറക്കുന്നതായിരിക്കും. ദർഘാസ് ഫോറങ്ങൾ കൈമാറ്റം ചെയ്യുവാൻ പാടുള്ളതല്ല.

തിരുവനന്തപുരം വൈൽഡ് ലൈഫ് വാർഡന്റെ പേരിൽ പണയപ്പെടുത്തിയതും ദേശീയ/ഷെഡ്യൂൾഡ് ബാങ്കിൽ നിന്നും ലഭിക്കുന്നതുമായ നി›ിത തുകയ്ക്കുള്ള ഡിമാന്റ ് ഡ്രാഫ്റ്റ് നിരതദ്രവ്യമായി ദർഘാസിനോടൊപ്പം സമർപ്പിക്കേ≠താണ്. അപൂർണ്ണമായ ദർഘാസുകൾ നിരസിക്കുന്നതായിരിക്കും. ഏതെങ്കിലും ദർഘാസുകൾ കാരണം ബോദ്ധ്യപ്പെടുത്താതെ നിരസിക്കുന്നതിനുള്ള അധികാരം താഴെ ഒപ്പിട്ടിരിക്കുന്ന ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമായിരിക്കും. വനം വകുപ്പിലും പൊതുമരാമത്ത് വകുപ്പിലും നിലവിലുള്ളതും കാലാകാലങ്ങളിൽ പുറപ്പെടുവിക്കുന്നതുമായ കരാർ വ്യവസ്ഥകൾ ഈ ജോലികൾക്കും ബാധകമായിരിക്കും. കരാറുകാരൻ നിർദ്ദി„ മാതൃകയിൽ ` 100 മുദ്രപ്പത്രത്തിൽ പ്രാഥമിക ഉടമ്പടി ദർഘാസിനോടൊപ്പം സമർപ്പിക്കേ≠താണ്. പ്രാഥമിക ഉടമ്പടി ഇല്ലാത്ത ദർഘാസുകൾ നിരസിക്കുന്നതാണ്.

The evelopes containing the tenders should be superscribed as "Tender for ..................................................... (the name of work).

The tender is fixed to be conducted at 3 p. m. on 10-4-2013. The tender forms can be obtained by remitting cash including tax with necessary application from the office of the undersigned during office hours upto 1 p. m. on 10-4-2013. Cost of tender form is not refundable. Tender forms are not transferable. The tender form should be properly filled up and should be submitted on or before 2 p.m. on 10-4-2013. It should be accompanied by all necessary documents including identity proof of applicant along with Earnest Money Deposit by way of Bankers DD or Fixed Deposit or National Saving Certificate pledged in favour of the Assistant Conservator of Forests, Social Forestry Division, Kollam payable at Kollam. The intending tenderers should furnish a Preliminary Agreement in Stamp Paper worth ` 100 along with tender for the work.

TENDER NOTICE

No. SA-1337/2012. 25th February 2013.

Sealed competitive tenders are invited till 2 p. m. on 10-4-2013 by the Assistant Conservator of Forests, Social Forestry Division, Kollam on behalf of the Governor of Kerala in the prescribed form from eligible contractors/ agencies/firms for the following works in Pathupara Vanadeepthi Project Area in Social Forestry Range, Punalur during 2012-13.

Incomplete tender or tenders without necessary documents or tenders not in accordance with tender conditions will not be accepted. Tenders will be opened and scrutinized at 3 p.m. on the same day in the presence of those tenderers who are present at that time by the Assistant Conservator of Forests, Social Forestry Division, Kollam or an officer authorized by him. If the tender could not be conducted on the notified date due to any reason, the tender will be conducted on 17-4-2013 at the same place and time as per the same conditions. If the tender date happens to be holiday, the tender will be opened at the same place and time in the next working day. The Assistant Conservator of Forests, Social Forestry Division, Kollam reserves the right to exclude any item from the tender, or reject any tender either partly or in full, without assigning any reason thereof.

All existing rules, regulations, directions, conditions prevailing in Forest Department and Store Purchase Department in respect of the works shall be applicable in these tenders also.

The details and necessary documents will be obtained from the Office of the Assistant Conservator of Forests, Social Forestry Division, Kollam on any working days till 1 p. m. of tender date. The successful tenderer should remit 2.5% amount of the PAC in addition to the EMD as security deposit for the contract and enter in to an agreement with the Forest Department within 7 days from the datge of intimation regarding the acceptance of the tender. After completing the works satisfactorily, the security deposit will be released to the tenderer on production of necessary tax clearance certificate. G. O. (P) 84/97/P & T dated 19-8-1997 related to PWD tender is also applicable here.

THENMALA DIVISION

TENDER-CUM-AUCTION NOTICE

No. A2-613/2013.

6th March 2013.

1. It is hereby notified for the information of the public that the right of collection and removal of standing trees in the 1997 Kalluvarambu Choodal Acacia Plantation, (17 Ha.) in Thenmala Range of this Division as specified in the schedules appended below will be sold in Tender-Cum-Auction by the Divisional Forest Officer, Thenmala or any other officer authorized by him on 4-4-2013 at 11 a. m. in the Divisional Forest Office, Thenmala on outright sale basis subject to the terms and conditions of sale of timber in Government Timber Depots published in Government Gazette No. 50, dated 20-12-2011 Page Nos. 600 to 606 of Forest Sheet as per Pro (5) 4668/11 dated 7-12-2011 of the Additional Principal Chief Conservator of Forests (Protection), Thiruvananthapuram and as per General Conditions of the sale of tree growth prevailing in the Department. In case the notified date happens to be a public holiday the tender/auction will be conducted on the next working day at the notified place and time.

2. The auction will be on lumpsum basis for the right of collection and removal of entire trees growth from the above 1997 Acacia Plantation, Choodal Kulathupuzha mentioned in the schedule hereto the area of which has been surveyed and demarcated on the ground.

3. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quatity and quality of the produce before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after the Tender/Auction will not be entertained.

4. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless valid power of attorney is produced prior to commencement of Auction/Tender.

5. A supply contractor of Thenmala Division or the adjacent Divisions will not be allowed to participate in the Auction/Tender.

6. Intending tenderers/bidders should produce a certificate obtained from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.

7. Those who does not possess Income Tax PAN Card shall not be allowed to participate in the Tender/Auction.

8. The successful Tenderers/Bidders should give an undertaking that he is not related to any officer having control of the work and that he is not a supply contractor of this or any adjacent divisions. If this is proved otherwise it shall result in cancellation of the contract and resale of the coupe at his risk and loss.

9. No petition or post offer received after seven days of the conduct of the tender/auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is one lakh and above, and more than 20% where the original bid amount is less than one lakh will ordinarily be considered. The post offerer will comply with following terms.

(a) Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.

(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender/Auction date.

(c) The remittance should be made by the Chalan or Bank Deposit and the bank receipt should be produced before the Divisional Forest Officer concerned within seven days from the date of receipt of the registered notice to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the post offerer satisfied with the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules. In the re-auction, if the price fetched, does not come up to what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.

10. Further particulars can be had either from the Office of the Divisional Forest Officer or the Range Officer, Thenmala during working hours.

11. Intending tenderers/bidders should Deposit Earnest Money Deposit as shown against the Schedule I and II before tender/auction.

12. The successful tenderers/bidders have to remit 35% sale value on the tender/auction date itself. If the 35% value exceeds ` 1,00,000, ` 1,00,000 will be remitted on the auction date itself and balance value have to be remitted in the Sub Treasury, Punalur within 7 working days through the countersigned chalan issued from this office and the chalan submitted to this office. If he fails to remit this amount, within the specified time the EMD will be forfeited to Government and the coupe will be re-auctioned at his risk and loss.

13. If the value fetched in the resale/re-tender is less than that obtained in the original tender/sale the difference between them together with all incidental expenditure fixing up the resale including notification charges as assessed by the Divisional Forest Officer will be recovered from the defaulting Tenderers/Bidders through legal means including Revenue Recovery Act in force.

14. The participating Tenderers/Bidders have right only for collection and removal of enumerated standing trees and has no right for removing any other trees including Teak, Rose wood etc.

15. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax, etc., at the rates prevailing from time to time.

16. The successful Tenderers/Bidders should execute a bounden agreement on Stamp Paper worth ` 100 after the completion of the Tender/Auction.

17. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit 1/3rd of the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force and security deposit at 10% of the total sale value. The successful Tenderers/Bidders should execute an agreement on Stamp Paper worth ` 100. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to realization of 12% penal interest. Further extension for 15 days shall be granted by the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the amount within the extended period further extension for 15 days by the Chief Conservator of Forests and 15 days by the Additional Principal Chief Conservator of Forests shall be granted subject to realization of penal interest at 24% and 48% respectively. But all the extension periods mentioned above will be within the original contract period.

18. The balance 2/3 sale value should be remitted in two equal instalments by the successful Tenderers/Bidders. The first instalment should be remitted within 15 days from the date of agreement and the second instalment within 30 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers/Bidders fail to remit the above amount within the period mentioned above extension for 15 days by realizing penal interest at 12% by Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Chief Conservator of Forests concerned and further extension for 30 days by the Additional Principal Chief Conservator of Forest concerned by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will be within the original contract period.

19. The period of contract will be as shown in the schedule hereto appended. No extension of period of contract shall ordinarily be granted. Under very special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests concerned may grant extension of time for one month and two months respectively on realisation of penalty or penalties for completion of each work for each month mentioned below:

(a) For enumerated trees and balance un-felled per hectare or fraction thereof ` 750 per hectare.

(b) Un-removed registered logs and unregistered logs ` 100 m³ or fraction thereof.

(c) Un-removed firewood-` 50/ MT or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or un-removed during the original contract period. The penalty for the first month shall be realized at the above rates; double the rate for the second month and three times of the original rate for the third month shall be realized. If the Tenderers/ Bidders fail to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenderers as per the agreement will be forfeited to Government and the Tenderers/Bidders shall not have any right on the produce confiscated to Government.

In the above circumstances the balance work to be executed by the tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the Tenderers/Bidders.

20. The license for removal of timber and firewood collected from the coupe shall be issued only on the basis of the prevailing norms.

21. The contractor/his agent shall enter the coupe and start work only after getting the written permission from the Divisional Forest Officer, Thenmala/Forest Range Officer, Thenmala.

22. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 meters and keep the cairns intact.

23. The contractor will be liable for any damage or loss caused to other trees in the plantation or reserve.

24. The contractor alone will be responsible for any damage/loss caused to public or private properties, injury/ death caused to his workmen or general public during the course of the work carried out by him as per the contract.

25. The Divisional Forest Officer will give permission to keep the timber and other produce outside the coupe if requested by the contractor at his risk. But if the collected timber/firewood are not removed within the agreement period due to unforeseen situation/climate, a ground rent @ ` 250/Ha. will be recovered from the contractor.

26. The contractor will be liable for all the illegal activities occurred within 0.4 km. perimeter of the coupe. Any such activities noticed will be reported to the forest officials by the contractor, failing which the contract is liable to be cancelled.

27. The security deposit will be refunded only after the successful completion of contract after producing the clearance Certificates of VAT, Income Tax, etc. If there are any liabilities outstanding in this respect to the Government that will be adjusted from the security deposit of the contractor.

28. All common conditions regarding sale coupe are also applicable to this Tender/Auction.

ദർഘാസ്/ലേല ദിവസം പൊതു അവധിയായി വന്നാലോ മറ്റേതെങ്കിലും കാരണത്താലോ ദർഘാസ്/ലേലം നടത്താൻ കഴിയാതെ വന്നാൽ ടി ദർഘാസ്/ലേലം അടുത്ത പ്രവൃത്തി ദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും വച്ച് നടത്തുന്നതായിരിക്കും.

2. ടെ≠ർ/ലേലം ഒരു നി›ിത തുകയുടെ അടിസ്ഥാനത്തിലാണ് നി›യിച്ചിരിക്കുന്നത്. ഇതിലേക്കായി സർവ്വെ ചെയ്ത് തിരിച്ചിട്ടുള്ള തോട്ടത്തിലെ നിൽപ്പ് മരങ്ങളുടെ നീക്കം ചെയ്യൽ സംബന്ധിച്ച ജോലിക്കുവേ≠ിയാണ് ഇത് തീരുമാനി ച്ചിരിക്കുന്നത്.

3. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലത്തിന് മുമ്പായി ഉൽപ്പന്നങ്ങളുടെ നൽപ് നിൽപ് ക≠് ബോധ്യപ്പെടേ≠തും അവ സംബന്ധിച്ച യാതൊരു പരാതികളും ലേലത്തിനുശേഷം പരിഗണിക്കുന്നതല്ലാത്തതുമാണ്.

4. ദർഘാസുകാരൻ/ലേലക്കാരൻ നേരിട്ട് ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കേ≠താണ്. നിയമപരമായ പവർ ഓഫ് അറ്റോർണി ഇല്ലാത്ത പകരക്കാരെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല.

5. തെ∑ല ഡിവിഷനിലേയും മറ്റ് സമീപ ഡിവിഷനുകളിലേയും സπൈ കോൺട്രാക്റ്റർമാരെ ടി ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.

6. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ വിലാസവും കൈയൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽനിന്നും വാങ്ങിയ സർട്ടിഫിക്കറ്റ് നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാക്കേ≠താണ്.

7. ഇൻകം ടാക്സ് പാൻ കാർഡ് കൈവശമില്ലാത്ത ആരേയും ദർഘാസിൽ/ലേലത്തിൽ പങ്കെടുക്കാൻ അനുവദിക്കുന്നതല്ല.

8. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ ആഫീസ് ജീവനക്കാരുമായോ ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസ്/ലേലദിവസം ദർഘാസുകാരൻ/ലേലക്കാരൻ ഈ ആഫീസിൽ സമർപ്പിക്കേ≠താണ്. ഇത്തരത്തിൽ ദർഘാസുകാരന്/ലേലക്കാരന് ബന്ധപ്പെട്ട ആഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാന്റെ പേരിലുള്ള ദർഘാസ്/ലേലം റദ്ദ് ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പ് പുനർലേലം ചെയ്യുന്നതാണ്.

9. ദർഘാസ്/ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുള്ള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരുലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽ 20 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും മാത്രമേ പരിഗണിക്കുകയുള്ളു. കൂടാതെ താഴെ പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമാണ്.

(എ) ദർഘാസ്/ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.

(സി) ബന്ധപ്പെട്ട പോസ്റ്റ് ഓഫർ തുകയും മറ്റ് നികുതികളും ചെലാൻ മുഖാന്തിരമോ ബാങ്ക് രസീത് വഴിയോ ഈ ആഫീസിൽ നിന്നും രജിസ്റ്റർ തപാൽ മുഖേന അറിയിച്ച് ഏഴുദിവസത്തിനുള്ളിൽ ഒടുക്കി ഈ ആഫീസിൽ ഹാജരാക്കേ≠താണ്. പോസ്റ്റ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ കൂപ്പിന്റെയും അതിലെ നിൽപ്പുമരങ്ങളുടെയും ഗുണനിലവാരവും മറ്റ് ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ടശേഷം നി›ിത തുകയ്ക്കുള്ള മുദ്രപ്പത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്.

പുനർ ലേലത്തിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കൂടുതൽ തുകയ്ക്ക് ലേലം/ദർഘാസ് നടക്കു കയാണെങ്കിൽ ഉയർന്ന ലേലത്തുക വാഗ്ദാനം ചെയ്ത വ്യ‡ിയുടെ പേരിൽ ലേലം ഉറപ്പിക്കുന്നതും പോസ്റ്റ് ഓഫറുകാരന്റെ സെക്യൂരിറ്റി തുക തിരികെ നൽകുന്നതുമാണ്.

12. കൂടുതൽ തുകയ്ക്ക് ദർഘാസ്/ലേലം കൊള്ളുന്ന ആൾ മൊത്തം ലേലത്തുകയുടെ 35 ശതമാനം തുക ലേലം കഴിഞ്ഞാലുടൻ ഒടുക്കേ≠താണ്. ടി 35 ശതമാനം തുക ` 1,00,000-ൽ കൂടുതലാണെങ്കിൽ ` 1,00,000 ലേല ദിവസംതന്നെ ഒടുക്കേ≠തും ബാക്കി തുക 7 പ്രവൃത്തി ദിവസത്തിനകം ഈ ആഫീസിൽ നിന്നും നൽകുന്ന മേലൊപ്പിട്ട ചെലാൻ മുഖാന്തിരം പുനലൂർ സബ് ട്രഷറിയിൽ ഒടുക്കി രസീത് ഹാജരാക്കേ≠തുമാണ്. ടി തുക ഒടുക്കുന്നതിൽ വീഴ്ചവരുത്തിയാൽ ടിയാൻ ഒടുക്കിയിട്ടുള്ള നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും ടി കൂപ്പ് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതുമായിരിക്കും.

13. പുനർ ലേലം/ദർഘാസ് തുക ആദ്യലേല/ദർഘാസ് തുകയേക്കാൾ കുറവായാൽ ടി നഷ്ടവും മറ്റ് ചെലവുകളും ഉൾപ്പെടെ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർ നി›യിക്കുന്ന തുക നഷ്ടം വരുത്തിയ ദർഘാസ്/ലേലക്കാരനിൽ നിന്നും റവന്യൂ റിക്കവറി ഉൾപ്പെടെയുള്ള നിലവിലുള്ള നിയമപ്രകാരം ഈടാക്കുന്നതാണ്.

14. ദർഘാസ്/ലേലം കൊള്ളുന്ന ആൾക്ക് പ്രസ്തുത കൂപ്പിൽ എന്യൂമറേറ്റ് ചെയ്തു നിർത്തിയിരിക്കുന്ന മരങ്ങൾക്ക് മാത്രം അവകാശമുള്ളതും തേക്ക്, ഈട്ടി, മറ്റ് മരങ്ങൾ മുതലായവയ്ക്ക് അവകാശമില്ലാത്തതുമാകുന്നു.

15. വിജയിയായ ദർഘാസ്/ലേലക്കാരൻ നിലവിലുള്ള നിരക്കിൽ മൂല്യവർദ്ധിത നികുതി, വന വികസന നികുതി, വരുമാന നികുതി എന്നിവയും ഒടുക്കേ≠താണ്.

16. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലം കൊള്ളുന്ന ആൾ ` 100-ന്റെ മുദ്രപത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടി കൂടി ലേലം കഴിഞ്ഞാലുടൻ ഒപ്പ് വയ്ക്കേ≠താണ്.

17. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുടെ മൂന്നിൽഒന്നും മൊത്തം തുകയുടെ 5 ശതമാനം ഫോറസ്റ്റ് ഡെവലപ്മെന്റ ് ടാക്സും നിലവിലുള്ള നിരക്കിൽ വിൽപ്പന നികുതി, ഇൻകംടാക്സ് എന്നിവകളും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10 ശതമാനം സെക്യൂരിറ്റി ഡിപ്പോസിറ്റും വച്ച് ` 100-ന്റെ മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്. 15 ദിവസത്തിനുള്ളിൽ ടി തുകകൾ ഒടുക്കാതിരുന്നാൽ 12 ശതമാനം പലിശയോടുകൂടി തുകകൾ ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയവും 24 ശതമാനം പലിശയോടുകൂടി വീ≠ും 15 ദിവസത്തെ സമയവും യു‡ംപോലെ തെ∑ല ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർ അനുവദിക്കുന്നതാണ്. ഈ കാലാവധിക്കുള്ളിലും തുക ഒടുക്കാതെ വന്നാൽ കൊല്ലം സതേൺ സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ംപോലെ 24 ശതമാനം പലിശ നിരക്കിൽ 15 ദിവസത്തേയും വീ≠ും 48 ശതമാനം പലിശ നിരക്കിൽ കൊല്ലം അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെ 15 ദിവ സത്തെയും സമയം അനുവദിക്കാവുന്നതാണ്. എന്നാൽ മുകളിൽ പറഞ്ഞ കാലാവധികളെല്ലാം കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും.

18. ബാക്കി മൂന്നിൽര≠് ലേലത്തുക ര≠് തുല്യ ഗഡുക്കളായി ഒടുക്കേ≠താണ്. ആദ്യഗഡു കരാർ തീയതി മുതൽ 15 ദിവസത്തിനകവും ര≠ാം ഗഡു കരാർ തീയതി മുതൽ ഒരുമാസത്തിനകമോ കരാർ കാലാവധിക്കകമോ ഏതാണോ ആദ്യം ആ കാലാവധിക്കുള്ളിലും ഒടുക്കേ≠താണ്. ടി കാലാവധിക്കുള്ളിൽ പണം ഒടുക്കുവാൻ കഴിയാതെവന്നാൽ 12 ശതമാനം പലിശ നിരക്കിൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർക്ക് 15 ദിവസത്തേയും 24 ശതമാനം പലിശ നിരക്കിൽ കൊല്ലം സതേൺ സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ംപോലെ 30 ദിവസത്തേക്കും 48 ശതമാനം പലിശ നിരക്കിൽ അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ംപോലെ വീ≠ും 30 ദിവസത്തേക്കും കാലാവധി നീട്ടിക്കൊടുക്കാവുന്നതാണ്. എന്നാൽ ഇപ്രകാരം നീട്ടിക്കൊടുക്കുന്ന കാലാവധികളെല്ലാം തന്നെ കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും.

19. ഓരോ തോട്ടത്തിന്റെയും ഉടമ്പടി കാലാവധി ഇതോടൊപ്പമുള്ള പട്ടികയിൽ കാണിച്ചിട്ടു≠്. സാധാരണഗതിയിൽ കൂപ്പിന്റെ കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും തെ∑ല ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർ, കൊല്ലം ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ എന്നിവർ യഥാക്രമം ഒന്നും ര≠ും മാസം വീതം താഴെപറയും പ്രകാരം പിഴ ഈടാക്കിക്കൊ≠് ഓരോ ജോലിക്കും കാലാവധി നീട്ടിക്കൊടുക്കുന്നതാണ്.

(എ) എന്യൂമറേറ്റ് ചെയ്തതും മുറിക്കാനുള്ളതുമായ മരങ്ങൾക്ക് ഓരോ ഹെക്ടറിനും അതിന്റെ ഭാഗത്തിനും ` 750 വീതം. (ബി) നീക്കം ചെയ്യാത്ത രജിസ്റ്റർ ചെയ്തതും അല്ലാത്തതുമായ തടികൾക്ക് ഓരോ ക്യു. മീറ്ററിനും അതിന്റെ ഭാഗത്തിനും ` 100 വീതം

(സി) നീക്കം ചെയ്യാത്ത വിറകിന് ഓരോ മെട്രിക് ടണ്ണിനും അതിന്റെ ഭാഗത്തിനും ` 50 വീതം. ഒന്നാമത്തെ മാസ ത്തേക്ക് ടി നിരക്കിലും 2-ാം മാസത്തേക്ക് അതിന്റെ ഇരട്ടിയും 3-ാം മാസത്തേക്ക് ഒന്നാം മാസത്തെ നിരക്കിന്റെ മൂന്നിരട്ടിയും എന്ന ക്രമത്തിൽ പിഴ ഈടാക്കുന്നതാണ്. ഇപ്രകാരം നീട്ടി നൽകുന്ന തീയതിക്കുള്ളിലും നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റിലേക്ക് മുതൽ കൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ചെയ്തു തീർക്കുവാനുള്ള ബാക്കി ജോലികൾ ഡിപ്പാർട്ട്മെന്റ ് ചെയ്യിക്കുന്നതും ആയതിൽ വച്ചു≠ാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതുമായിരിക്കും.

20. കൂപ്പിൽ ശേഖരിച്ച് വയ്ക്കുന്ന തടികളും വിറകും നീക്കം ചെയ്യാൻ ലൈസൻസ് നൽകുന്നത് നിലവിലുള്ള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും.

21. തെ∑ല ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെയോ തെ∑ല റെയിഞ്ചാഫീസറുടെയോ രേഖാമൂലമുള്ള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ കൂപ്പിൽ പ്രവേശിക്കുവാൻ പാടുള്ളു.

22. ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാ സമയവും കൂപ്പിൽ ഉ≠ായിരിക്കണം. കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കുകയും ചെയ്യേ≠താണ്.

23. യാതൊരു കാരണവശാലും πാന്റേഷനിലേയോ റിസർവ്വിലേയോ മറ്റ് മരങ്ങൾക്കും തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്താൻ പാടില്ല. അങ്ങനെയു≠ാവുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്.

24. പ്രസ്തുത ജോലി നിർവ്വഹണത്തിനിടയിൽ സർക്കാർ മുതലുകൾക്കോ സ്വകാര്യ വ്യ‡ികളുടെ മുതലുകൾക്കോ ഉ≠ാകുന്ന നാശനഷ്ടത്തിനും കരാറുകാരന്റെ ജോലിക്കാർ, പൊതു ജനങ്ങൾ എന്നിവർക്കു സംഭവിക്കാവുന്ന അപകടം, മരണം എന്നിവയ്ക്കും കരാറുകാരൻ മാത്രം ഉത്തരവാദിയായിരിക്കുന്നതാണ്.

25. കൂപ്പിന് പുറത്ത് ഫോറസ്റ്റ് ഡിപ്പാർട്ട്മെന്റ ് വക സ്ഥലത്ത് തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടി ക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ അനുവാദം നൽകുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണ ങ്ങളാലോ മോശമായ കാലാവസ്ഥമൂലമോ ഉടമ്പടി കാലാവധിക്കുള്ളിൽ അവ നീക്കം ചെയ്തുകൊ≠് പോകാൻ കഴിയാതെ വന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്ടറിന് ` 250 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽനിന്നും ഈടാക്കുന്നതായിരിക്കും.

26. കൂപ്പിന് 0.4 കി. മീ. (2 ഫർലോംഗ്) ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ അനധികൃത കുറ്റകൃത്യങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്. അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ വിവരം ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥരെ ഉടമ്പടിക്കാരൻ അറിയിക്കേ≠താണ്. ഇതിൽ വീഴ്ചവരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടാവുന്നതാണ്.

27. കരാറുകാരന്റെ സെക്യൂരിറ്റി തുക കാലാവധിക്ക് ശേഷം കരാറുകാരൻ സെയിൽസ് ടാക്സ്, ഇൻകം ടാക്സ്, അഗ്രികൾച്ചറൽ ഇൻകം ടാക്സ് ഇവയുടെ ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റ് ഹാജരാക്കുന്ന മുറയ്ക്ക് തിരിച്ച് നൽകുന്നതാണ്. എന്നാൽ ടി ഇനത്തിൽ ഗവൺമെന്റിലേക്ക് ബാധ്യതകൾ വല്ലതുമു≠െങ്കിൽ സെക്യൂരിറ്റി തുകയിൽ നിന്നും ഈടാക്കുന്നതാണ്.

2. ദർഘാസ് ഫോറം ആവശ്യമുള്ളവർ അവരെ തിരിച്ചറി യുന്നതിന് ബന്ധപ്പെട്ട വില്ലേജാഫീസറോ മേലധികാരികളോ നൽകിയ സർട്ടിഫിക്കറ്റ് അല്ലെങ്കിൽ ഇലക്ഷൻ കമ്മീഷന്റെ തിരിച്ചറിയൽ കാർഡോ പാസ്പോർട്ടിന്റെ കോപ്പിയോ സഹിതം അപേക്ഷിക്കേ≠താണ്.

3. നി›ിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ദർഘാസുകൾ സ്വീകരിക്കുന്നതല്ല.

4. ഏറ്റവും കൂടുതൽ തുക വാഗ്ദാനം ചെയ്ത ദർഘാസുകൾ/ ലേലം മേലധികാരികൾക്ക് അംഗീകാരത്തിനായി അയയ്ക്കു ന്നതും മറ്റ് ദർഘാസുകാർ നൽകിയ നിരതദ്രവ്യം അപ്പോൾത്തന്നെ തിരിച്ച് നൽകുന്നതുമാണ്.

5. ടെ≠ർ ഫോറം ലേലദിവസം ഉച്ചയ്ക്ക് 1 മണിവരെ അപേക്ഷകർക്ക് ലഭിക്കുന്നതാണ്.

6. ദർഘാസ് സംഖ്യ നിരതദ്രവ്യ സംഖ്യയിൽ കൂടുത ലാണെങ്കിൽ ദർഘാസ്/ലേല സംഖ്യയുടെ 50 ശതമാനം (നിരതദ്രവ്യം ഉൾപ്പെടെ) അപ്പോൾത്തന്നെ നൽകേ≠താണ്.

7. ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനും നിരാകരിക്കുന്നതിനു മുള്ള പൂർണ്ണ അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമായിരിക്കും.

8. ദർഘാസുകൾ/ലേലം അംഗീകരിച്ചതായി അറിയിപ്പുകിട്ടി 15 ദിവസത്തിനകം ബാക്കി ലേല സംഖ്യയും നിയമപ്രകാരമുള്ള നികുതികളും അടച്ച് വാഹനം നീക്കം ചെയ്തി ല്ലെങ്കിൽ ദർഘാസുകാരൻ ആവശ്യപ്പെടുന്നപക്ഷം ബാക്കി സംഖ്യയും 18 ശതമാനം പലിശയും ദിവസത്തിൽ ` 20 തറവാടകയും ഈടാക്കി 15 ദിവസംകൂടി അനുവദിക്കുന്ന തായിരിക്കും. അതിനുശേഷം അവധി അനുവദിക്കുന്നതല്ല.

9. മേൽപ്പറഞ്ഞ സമയപരിധിക്കുള്ളിൽ നീക്കം ചെയ്യാത്ത വാഹനം വീ≠ും ലേലത്തിലോ ടെ≠ർ അടിസ്ഥാന ത്തിലോ മുൻ ലേലക്കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ വിൽക്കുന്നതും, മുൻ ലേല തുക സർക്കാരിലേക്ക് ക≠ു കെട്ടുന്നതുമാണ്. ഈ ലേലംകൊ≠് സർക്കാരിന് നഷ്ടം വരുകയാണെങ്കിൽ മുൻ ലേലക്കാരനിൽനിന്ന് നഷ്ടം വരുന്ന തുക ഈടാക്കുന്നതിനുള്ള നടപടികൾ സ്വീകരിക്കുന്നതും ലാഭം കിട്ടുകയാണെങ്കിൽ മുൻ ലേലക്കാരന് ആയതിന് യാതൊരു അർഹതയും ഉ≠ായിരിക്കുന്നതല്ലെന്നും ആയത് മുഴുവനും സർക്കാരിലേക്ക് മുതൽ കൂട്ടുന്നതുമായിരിക്കും.

10. ദർഘാസ് സ്വീകരിക്കുന്ന ദിവസം പൊതു അവധി ദിവസമായി വന്നാൽ മറ്റൊരു പ്രവൃത്തി ദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും ദർഘാസ് നടത്തുന്ന തായിരിക്കും.

11. മുകളിൽ പറഞ്ഞ വാഹനങ്ങളിൽ ഏതെങ്കിലും വാഹനം ഒഴിവാക്കുന്നതിനും പുറമേ ഏതെങ്കിലും വാഹനം കൂട്ടിച്ചേർക്കുന്നതിനും ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർക്ക് അധികാരമു≠ായിരിക്കും.

12. ടി വാഹനത്തിന്റെ ആർ. സി. ബുക്കും മറ്റ് അനുബന്ധ രേഖകളും ഈ ഓഫീസിൽ ലഭ്യമല്ലാത്തതിനാൽ ആർ. സി. ബുക്കും മറ്റ് രേഖകളും ലേലം വിളിച്ചെടുക്കു ന്നവർ സ്വന്തം ഉത്തരവാദിത്വത്തിൽ ബന്ധപ്പെട്ട വകുപ്പിൽ നിന്നും ലഭ്യമാക്കേ≠താണ്.

Sealed and separate competitive tenders are invited for sale of the Vehicles confiscated under Section 61 A of Kerala Forest Act and condemned department Vehicles shown in the Schedules below.

Sealed tenders should be submitted before the undersingned on or before 24-4-2013 at 3 p. m. at his Office at Kannur. After receiving the tenders the vehicles will be auctioned at 3.30 p. m. among the tenderers and the tender will be opened on the same day after the auction in their presence by the undersigned or an officer authorized by him at his Office at Kannothumchal, Kannur. Tender forms will be sold from the office upto 1 p. m. on the tender date. The tender/ Auction will temporarily be fixed in the name of the highest tenderer/bidder. If any vehicle putup for auction on 24-4-2013 is not sold, the same will be re-tendered/auctioned on 2-5-2013 at same time and venue. Tender conditions are same as this Office Notification No. R.1464/2010 dated 13-8-2010 published on Kerala Gazette No. 37 (Vol. 54). If the notified day happen to be a public holiday, tender will be received and opened on the next working day at the appointed time and place. Further details can be had from the office of the undersigned and from the Range Offices, Taliparamba and Kottiyoor, Kannavam.

ലേല നിബന്ധനകൾ

1. മുകളിൽ പറയുന്ന വാഹനങ്ങൾ ദർഘാസ്/ലേലത്തിന് മുമ്പായി ആഫീസ് സമയത്ത് ബന്ധപ്പെട്ട റെയിഞ്ച് ആഫീസറുടെ അനുവാദത്തോടെ നേരിൽ പരിശോധിച്ച് അവയുടെ ഗുണനിലവാരം ബോദ്ധ്യപ്പെടേ≠താണ്. ഗുണനിലവാരം സംബന്ധിച്ച് ലേലത്തിനുശേഷം ഉന്നയിക്കുന്ന യാതൊരു പരാതിയും പരിഗണിക്കുന്നതല്ല.

2. ദർഘാസ് ഫോറത്തിന്റെ വില, നികുതികൾ എന്നിവ ഓരോ വാഹനത്തിന്റെയും നേരെ കൊടുത്തിട്ടു≠്.

3. ദർഘാസ് ഫോറങ്ങൾ ആവശ്യമുള്ളവരും ഇ.എം.ഡി. അടയ്ക്കേ≠വരും അവരെ തിരിച്ചറിയുന്നതിന് തെരഞ്ഞെടുപ്പ് കമ്മീഷൻ നൽകിയ തിരിച്ചറിയൽ കാർഡ,് ബന്ധപ്പെട്ട വില്ലേജാഫീസർ നൽകിയ പൂർണ്ണമേൽവിലാസവും ഒപ്പും സാക്ഷ്യപ്പെടുത്തിയതുമായ സർട്ടിഫിക്കറ്റ്, ഇന്ത്യൻ പാസ്പോർട്ട്, മറ്റ് നിയമാനുസൃത ഫോട്ടോ പതിച്ച തിരിച്ചറിയൽ രേഖ എന്നിവയിൽ ഏതെങ്കിലും ഒന്ന് സഹിതം അപേക്ഷിക്കേ≠താണ്. ടെ≠ർ ഫോറം വാങ്ങാനാഗ്രഹിക്കുന്നവർ അവരവരുടെ തിരിച്ചറിയൽ കാർഡ് തന്നെ ഹാജരാക്കേ≠താണ്. മറ്റാരുടേതെങ്കിലും തിരിച്ചറിയൽ കാർഡ് ഹാജരാക്കുന്നവർക്ക് യാതൊരു കാരണവശാലും ടെ≠ർ ഫോറം അനുവദിക്കുന്നതല്ല. ഇത്തരത്തിൽ വ്യാജതിരിച്ചറിയൽ കാർഡുകൾ ഹാജരാക്കി ഫോറം കൈപ്പറ്റുന്നവർക്കെതിരെ നിയമാനുസൃതം നടപടികൾ സ്വീകരിക്കുന്നതായിരിക്കും.

4. പൂരിപ്പിച്ച ദർഘാസ് സമർപ്പിക്കുമ്പോൾ നിരതദ്രവ്യം പണമായി ഈ ആഫീസിൽ അടയ്ക്കേ≠താണ്.

5. നി›ിത സമയത്തിനുശേഷം സമർപ്പിക്കുന്ന ദർഘാസുകൾ യാതൊരു കാരണവശാലും സ്വീകരിക്കുന്നതല്ല.

6. അപൂർണ്ണമായതോ നിബന്ധനകൾ പാലിക്കാത്തതോ ആയ ദർഘാസുകൾ പരിഗണിക്കുന്നതല്ല.

7. വിജയികളായവരുടെ നിരതദ്രവ്യം വിൽപ്പന വിലയിലേക്ക് നീക്കിവയ്ക്കുന്നതും മറ്റുള്ളവരുടെ നിരതദ്രവ്യം ലേലം കഴിഞ്ഞ ശേഷം തിരികെ നൽകുന്നതുമാണ്.

8. ദർഘാസ്/ലേല സംഖ്യ നിരതദ്രവ്യത്തേക്കാൾ കൂടുതലാണെങ്കിൽ നിരതദ്രവ്യം ഉൾപ്പെടെ 50% അപ്പോൾത്തന്നെ ഒടുക്കേ≠താണ്. ഇതിൽ വീഴ്ച വരുത്തുന്നവരുടെ നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടി വിളിച്ചെടുത്ത വാഹനം അവരുടെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർ ദർഘാസ്/ലേലം ചെയ്യുന്നതായിരിക്കും.

9. ദർഘാസ്/ലേല സംഖ്യ നിരതദ്രവ്യത്തേക്കാൾ കുറവാണെങ്കിൽ കൂടുതലുള്ള തുക ദർഘാസ് തുറക്കുന്ന ദിവസം തന്നെ തിരിച്ചു നൽകുന്നതായിരിക്കും. ദർഘാസ്/ലേലം സ്വീകരിക്കുന്നതിനോ നിരാകരിക്കുന്നതിനോ ഉള്ള പൂർണ്ണ അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥരിൽ നിക്ഷിപ്തമായിരിക്കും.

10. അധികാരപ്പെട്ട ഉദ്യോഗസ്ഥൻ ദർഘാസ്/ലേലം സ്ഥിരീകരിച്ചാലുടൻ വിജയികളെ വിവരം രേഖാമൂലം അറിയിക്കുന്നതാണ്.

11. ദർഘാസ്/ലേലം അംഗീകരിച്ചതായി അറിയിപ്പുകിട്ടി 15 ദിവസത്തിനകം ബാക്കി സംഖ്യയും നിയമപ്രകാരമുള്ള നികുതികളും അടച്ച് വാഹനം നീക്കം ചെയ്യേ≠താണ്.

12. മേൽപ്പറഞ്ഞ പ്രകാരം 15 ദിവസത്തിനകം വാഹനം നീക്കം ചെയ്തില്ലെങ്കിൽ ലേല/ദർഘാസുകാരന്റെ അപേക്ഷയിൻമേൽ 12% പലിശയും ` 20 ഇരുപ്പുവാടകയും ഈടാക്കിക്കൊ≠് 15 ദിവസംകൂടി പണം അടയ്ക്കാനും വാഹനം നീക്കം ചെയ്യാനും അനുവദിക്കുന്നതാണ്. അതിനുശേഷം പണം അടയ്ക്കാനോ വാഹനം നീക്കം ചെയ്യാനോ കാലാവധി അനുവദിക്കുന്നതല്ല. ഈ സമയപരിധിക്കുള്ളിൽ വാഹനം നീക്കം ചെയ്യാത്തപക്ഷം ദർഘാസ്/ലേലക്കാരന്റെ നഷ്ടോത്തര വാദിത്വത്തിൽ വാഹനം പുനർ ദർഘാസ്/ലേലം ചെയ്യുന്നതും നഷ്ടമു≠ായാൽ ടിയാനിൽ നിന്നും സർക്കാരിനു≠ായ ദർഘാസ്/ലേല ചെലവു സഹിതം ഈടാക്കുന്നതുമായിരിക്കും. ലാഭമു≠ായാൽ അതിൻമേൽ ടിയാന് യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്നതുമല്ല.

13. ദർഘാസുകൾ സമർപ്പിച്ചിട്ടുള്ളവർക്ക് മാത്രമേ ലേലത്തിൽ പങ്കെടുക്കുവാൻ അർഹതയു≠ായിരിക്കുകയുള്ളു.

14. ദർഘാസിലോ ലേലത്തിലോ പറഞ്ഞ തുക സ്വീകരിക്കുന്നതിനോ നിരാകരിക്കുന്നതിനോ ഉള്ള അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമായിരിക്കും.

15. ഏതെങ്കിലും ലേല തീയതി ഒരു പൊതു ഒഴിവ് ദിവസമായി വരികയാണെങ്കിൽ പ്രസ്തുത ടെ≠ർ കം ലേലം തൊട്ടടുത്ത പ്രവർത്തി ദിവസം നടത്തുന്നതായിരിക്കും.

16. ദർഘാസ്/ലേലത്തിനുശേഷം ദർഘാസ്/ലേല സംഖ്യയെക്കാൾ കൂടുതൽ വില കൊടുക്കുവാൻ തയ്യാറാണെന്ന് കാണിച്ചുകൊ≠് നൽകുന്ന വാഗ്ദാനങ്ങൾ (പോസ്റ്റ് ഓഫറുകൾ) താഴെപ്പറയുന്ന നിബന്ധനകൾക്കു വിധേയമായി സ്വീകരിക്കുന്നതായിരിക്കും.

(എ) ദർഘാസ്/ലേല സംഖ്യ ഒരു ലക്ഷം രൂപയേക്കാൾ കൂടുതലാണെങ്കിൽ വാഗ്ദാന സംഖ്യ ദർഘാസ്/ലേല സംഖ്യയുടെ 10 ശതമാനത്തെക്കാൾ കുറയാൻ പാടില്ല.

(ബി) ദർഘാസ്/ലേല സംഖ്യ ഒരു ലക്ഷം രൂപയേക്കാൾ കുറവാണെങ്കിൽ വാഗ്ദാന സംഖ്യ ദർഘാസ്/ലേല സംഖ്യയുടെ 20 ശതമാനത്തിൽ കുറയാൻ പാടില്ല.

(സി) പോസ്റ്റ് ഓഫറിനോടൊപ്പം ഓഫർ തരുന്ന സംഖ്യയുടെ 50% ജാമ്യമായി ഏതെങ്കിലും ദേശസാൽകൃത ബാങ്കിൽ മാറാവുന്ന ഡി. ഡി. ആയോ സർക്കാർ ട്രഷറിയിൽ ചെലാൻ മുഖാന്തിരമോ ഒടുക്കി ഉള്ളടക്കം ചെയ്യേ≠താണ്.

(ഡി) ദർഘാസ്/ലേല തീയതി മുതൽ 7 ദിവസത്തിനകം പോസ്റ്റ് ഓഫറുകൾ ഈ ഓഫീസിൽ ലഭിച്ചിരിക്കണം. പോസ്റ്റ് ഓഫറിൽ പറഞ്ഞ വിലയ്ക്ക് വാഹനം എടുത്തുകൊള്ളാമെന്നുള്ള സമ്മതപത്രം ` 100 (നൂറ് രൂപ മാത്രം) മുദ്രക്കടലാസിൽ എഴുതി നൽകേ≠താണ്.

(ഇ) മേൽനിബന്ധനകൾ അനുസരിച്ചുള്ള പോസ്റ്റ് ഓഫറുകൾ ലഭിച്ചുകഴിഞ്ഞാൽ ബന്ധപ്പെട്ട വാഹനത്തിന്റെ ലേലം റദ്ദു ചെയ്യുന്നതും ആവശ്യമായ പരസ്യം നൽകി പുനർദർഘാസ്/ലേലം നടത്തുന്നതുമാാണ്. ലേലം വിളിക്കുമ്പോൾ പോസ്റ്റ് ഓഫറിൽ രേഖപ്പെടുത്തിയിരിക്കുന്ന വില, ലഭിക്കേ≠ ഏറ്റവും കുറഞ്ഞ വിലയായി കണക്കാക്കി, ലേലം നടത്തുന്നതും ലേലത്തിലോ/ദർഘാസിലോ ഉയർന്ന വില നൽകുന്നവർക്ക് ലേലം ഉറപ്പിക്കുന്നതുമാണ്. ഉയർന്ന വിലയ്ക്ക് ലേലം/ദർഘാസ് കൊള്ളാൻ ആളില്ലാത്തപക്ഷം പോസ്റ്റ് ഓഫർ നൽകിയ ആളിന് വാഗ്ദാനം ചെയ്ത വിലയ്ക്ക് വാഹനത്തിന്റെ ലേലം താൽക്കാലികമായി ഉറപ്പിക്കുന്നതുമാണ്.

17. ദർഘാസുകൾ അംഗീകരിച്ചതായി അറിയിപ്പുകിട്ടി 15 ദിവസത്തിനകം ബാക്കി സംഖ്യയും നിയമ പ്രകാരമുള്ള നികുതികളും അടച്ച് വാഹനം നീക്കം ചെയ്യേ≠താണ്.

18. സർക്കാർ കാലാകാലങ്ങളായി പുറപ്പെടുവിച്ചിരിക്കുന്ന ദർഘാസ്/ലേലം സംബന്ധിച്ച പൊതു വ്യവസ്ഥകൾ ഇതിനും ബാധകമായിരിക്കും.

19. ടി വാഹനങ്ങളുടെ ആർ. സി. ബുക്കും മറ്റ് അനുബന്ധ രേഖകളും ഈ ഓഫീസിൽ ലഭ്യമല്ലാത്തതിനാൽ മേൽ രേഖകൾ ലേലം വിളിച്ചെടുക്കുന്നവർ അവർക്ക് ആവശ്യമായി വരുന്ന പക്ഷം സ്വന്തം ഉത്തരവാദിത്വത്തിൽ ബന്ധപ്പെട്ട വകുപ്പിൽ നിന്നും ലഭ്യമാക്കേ≠താണ്.

20. വാഹനങ്ങൾ വിളിച്ചെടുക്കുന്നവർക്ക് ആദായ നികുതി സംബന്ധിച്ച പാൻകാർഡ് നിർബന്ധമായും ഉ≠ായിരിക്കേ≠താണ്.

പാൻകാർഡിന്റെ പകർപ്പ് ടെ≠ർ ഫോറത്തിനുള്ള അപേക്ഷയോടൊപ്പം ഹാജരാക്കേ≠താണ്.

21. മുകളിൽ പറഞ്ഞ വാഹനങ്ങളിൽ ഏതെങ്കിലും ഒഴിവാക്കുന്നതിനും കൂട്ടിചേർക്കുന്നതിനും കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അധികാരമു≠ായിരിക്കും.
