In exercise of the powers conferred under Section 3 of the Kerala State Right to Service Act, 2012 (Act 18 of 2012) the Registrar of Co-operative Societies hereby notifies the services, designated officers, appellate authorities, as well as the time limit for delivery of service and disposal of first appeal/second appeal under the Act as per enclosed Appendix-I.

Explanatory Note
(This does not form part of the Notification, but is intended to indicate its general purport).
Section 3 of the Kerala State Right to Service Act, 2012 (Act 18 of 2012), provides that every Head of Deparment shall notify the services, designated officers, appellate authorities, as well as the time limit for delivery of service and disposal of first appeal/second appeal under the Act in the Gazette. Hence this notification is issued.
The notification is intended to achieve the above object.

I do hereby certify in exercise of the powers conferred on me under Section 7 of the Kerala Co-operative Societies Act, 1969 (Act 21 of 1969) that the following Society, the particulars which is furnished in the categorical statement is registered by me today as a Co-operative Society under the said Act, on the basis of limited liability and that the bye-laws of the undermentioned Society is also hereby registered under the said Section.

റ്റി 1008/2000 നമ്പർ നടപടിക്രമം.
തൈക്കാട് വാർഡ് റസിഡൻസ് വെൽഫെയർ സഹകരണ സംഘം ക്ളിപ്തം നമ്പർ റ്റി. 1008-ന്റെ പ്രവർത്തനം സമാപ്തീകരിക്കുന്നതിന് സൂചന (1) പ്രകാരം ഉത്തരവാകുകയും, സമാപ്തീകരണ നടപടികൾ സ്വീകരിക്കുന്നതിനുവേ≠ി തിരുവനന്തപുരം അസിസ്ററന്റ ് രജിസ്ട്രാർ (ജനറൽ) ആഫീസിലെ ഫോർട്ട് യൂണിറ്റ് ഇൻസ്പെക്ടറെ ലിക്വിഡേറ്ററായി നിയമിക്കുകയും ചെയ്തിരുന്നു. അതനുസരിച്ച് ലിക്വിഡേറ്റർ 5-12-1998-ൽ ടി സംഘത്തിൽ ലിക്വിഡേറ്ററായി ചാർ÷െടുത്തു. തുടർന്ന് ലിക്വിഡേറ്റർ നിയമാനുസരണം ക്ലെയിം നോട്ടീസ് നൽകി. സംഘത്തിന് ഈടാക്കാനുള്ള തുകകൾ ഈടാക്കാനുള്ള നടപടിയും കൊടുത്തുതീർക്കാനുള്ള തുക കൊടുത്തു തീർക്കാനുള്ള നടപടിയും കൈക്കൊള്ളുകയു≠ായി. ചട്ട പ്രകാരമുള്ള കോമൺ ലിക്വിഡേഷൻ ഫ≠് യഥാവിധി ഒടുക്കുകയും ചെയ്തു. വരവ്-ചിലവ് കണക്കുകൾ എ ഇ എൽ ആഡിറ്റർ ആഡിറ്റ് ചെയ്യുകയു≠ായി. തുടർന്ന് 30-12-1998-ന് അവസാന പൊതുയോഗം കൂടുകയും ഉ≠ായി. ഈടാക്കാനുള്ള തുകകളെല്ലാം ഈടാക്കുകയും, കൊടുത്തു തീർക്കാനുള്ള തുകകളെല്ലാം കൊടുത്തുതീർക്കുകയും ചെയ്ത് നടപടിയെല്ലാം പൂർത്തിയാക്കിയ സാഹചര്യത്തിൽ സൂചന (2) പ്രകാരം ലിക്വിഡേറ്റർ റ്റി. 1008-ാം നമ്പർ തൈക്കാട് വാർഡ് റസിഡൻസ് വെൽഫെയർ സഹകരണ സംഘത്തിന്റെ പ്രവർത്തനം സമാപ്തീകരിച്ച് ഉത്തരവാകുകയും, ടി സംഘത്തിന്റെ രജിസ്ട്രേഷൻ റദ്ദ് ചെയ്യുന്നതിന് അപേക്ഷിക്കു കയും ചെയ്യുകയു≠ായി.
മേൽ വിവരിച്ച വസ്തുതകളുടെ അടിസ്ഥാനത്തിൽ ചുവടെ പരാമർശിക്കുന്ന ഉത്തരവ് പുറപ്പെടുവിക്കുന്നു.

ഡി. 2480 പന്തലായനി മോട്ടോർ ട്രാൻസ്പോർട്ട് സഹകരണ സംഘം സമാപ്തീകരണ നടപടികൾ ക്രമപ്രകാരം പൂർത്തിയാക്കിയതിനുശേഷം പുറപ്പെടുവിച്ച സൂചന (2) പ്രകാരമുള്ള അന്തിമ സമാപ്തീകരണ തീരുമാനം അംഗീകരിച്ചു കൊ≠് സംഘത്തിന്റെ രജിസ്ട്രേഷൻ സഹകരണ നിയമത്തിലെ 74-ാം വകുപ്പുപ്രകാരം റദ്ദ് ചെയ്ത് ഇതിനാൽ ഉത്തരവാകുന്നു.
സംഘം വക റിക്കാർഡുകൾ ലിക്വിഡേറ്റർ 3 വർഷക്കാലം സൂക്ഷിക്കേ≠തും അതിനുശേഷം ജോയിന്റ ് രജിസ്ട്രാറുടെ അനുമതിയോടുകൂടി നശിപ്പിക്കേ≠തുമാണ്.

കണ്ണൂർ ജില്ലയിലെ ഇരിട്ടി ആസ്ഥാനമാക്കി 19-10-1983-ൽ രജിസ്റ്റർ ചെയ്ത് 7-1-1984-ൽ പ്രവർത്തനം ആരംഭിച്ച തലശ്ശേരി താലൂക്ക് റ∫ർ ആന്റ ് അഗ്രിക്കൾച്ചറൽ മാർക്കറ്റിംഗ് സഹകരണ സംഘം ക്ലിപ്തം നമ്പർ സി.927 2007-08 മുതൽ പ്രവർത്തന രഹിതമായിരുന്നു. നിക്ഷേപം തിരിച്ചുകൊടുക്കാത്തതു സംബന്ധിച്ച് നിക്ഷേപകർ, കണ്ണൂർ ജില്ലാ സഹകരണ ബാങ്ക് മുതലായവർ ബഹു. ഹൈക്കോടതി മുമ്പാകെ നിരവധി റിട്ട് ഹർജികൾ ഫയൽ ചെയ്തിരുന്നു. പ്രസ്തുത റിട്ട് ഹർജികളും W.A.1399/12-ാം നമ്പർ റിട്ട് അപ്പീലും പരിഗണിച്ച് ബഹു. ഹൈക്കോടതിയുടെ ഡിവിഷൻ ബഞ്ച് സൂചന (1)-ലെ പൊതുവായ വിധിയിലൂടെ ഏതാനും മാർഗ്ഗനിർദ്ദേശങ്ങൾ വകുപ്പ് അധികാരികൾക്ക് നൽകുകയു≠ായി.
ബഹു. ഹൈക്കോടതി വിധിയിലെ നിർദ്ദേശങ്ങളിലെ ഖfiിക 5(5) പ്രകാരം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ സമർപ്പിക്കുന്ന റിപ്പോർട്ട് പരിഗണിച്ചുകൊ≠് സംഘം പുനരുദ്ധീകരണം അസാദ്ധ്യമാണെന്ന് കരുതുന്നപക്ഷം സഹകരണ നിയമം 71-ാം വകുപ്പ് പ്രകാരം സംഘം പ്രവർത്തനം ലിക്വിഡേറ്റ് ചെയ്തു കൊ≠് ലിക്വിഡേറ്ററെ നിയമിക്കുന്നതിന് രജിസ്ട്രാർക്ക് നിർദ്ദേശം നൽകിയിരുന്നു. സംഘത്തിന് ലിക്വിഡേറ്ററെ നിയമിക്കുന്നതിന് സൂചന (2) മുഖേന രജിസ്ട്രാർ ഈ ആഫീസിനോട് നിർദ്ദേശം നൽകിയിരിക്കയാൽ സൂചന (3) ഉത്തരവ് പ്രകാരം കേരള സഹകരണ നിയമം വകുപ്പ് 66 അനുസരിച്ച് പരിശോധനാ റിപ്പോർട്ട് സമർപ്പിക്കുന്നതിനായി കൂത്തുപറമ്പ് സഹകരണസംഘം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) ആഫീസിലെ ഇരിട്ടി യൂണിറ്റ് ഇൻസ്പെക്ടറെ നിയമിച്ചു കൊ≠് ഉത്തരവായിരുന്നു. സൂചന (4) വഴി അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ), കൂത്തുപറമ്പ് പ്രസ്തുത അന്വേഷണ റിപ്പോർട്ട് ഈ ആഫീസിൽ സമർപ്പിച്ചിട്ടു≠്.
പ്രസ്തുത റിപ്പോർട്ട് പരിശോധിച്ചതിൽ നിന്നും സംഘം പുനരുദ്ധാരണം അസാദ്ധ്യമാണെന്ന് ഉത്തമബോദ്ധ്യം വന്ന സാഹചര്യത്തിൽ ചുവടെ ചേർത്ത പ്രകാരമുള്ള ഉത്തരവ് പുറപ്പെടുവിച്ചുകൊള്ളുന്നു.

ക്ലിപ്തം നമ്പർ സി. 927 ആയി രജിസ്റ്റർ ചെയ്ത തലശ്ശേരി താലൂക്ക് റ∫ർ ആന്റ ് അഗ്രിക്കൾച്ചറൽ മാർക്കറ്റിംഗ് സഹകരണ സംഘത്തിന്റെ പ്രവർത്തനം കേരള സഹകരണ നിയമം വകുപ്പ് 71(1) പ്രകാരം സമാപ്തീകരിച്ചുകൊ≠ും, വകുപ്പ് 72 പ്രകാരം സഹകരണ സംഘം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ), കൂത്തുപറമ്പ് കാര്യാലയത്തിലെ ഇരിട്ടി യൂണിറ്റ് ഇൻസ്പെക്ടറെ ലിക്വിഡേറ്ററായി നിയമിച്ചുകൊ≠ും ഇതിനാൽ ഉത്തരവാകുന്നു.
ലിക്വിഡേറ്റർ സംഘത്തിന്റെ ചാർ÷് ഉടൻ ഏറ്റെടുക്കേ≠തും ടി വിവരം യഥാസമയം ഈ ആഫീസിൽ റിപ്പോർട്ട് ചെയ്യേ≠തുമാണ്.
