മലപ്പുറം ലേബർ കോൺട്രാക്റ്റ് സഹകരണ സംഘം ക്ലിപ്തം നമ്പർ എം. 546-ന്റെ തെരഞ്ഞെടുക്കപ്പെട്ട ഭരണ സമിതിയുടെ കാലാവധി 29-11-2004-ന് അവസാനി ക്കുന്നതിന് മുന്നോടിയായി പുതിയ ഭരണസമിതി തെരഞ്ഞെടുപ്പ് നടത്തുന്നതിന് വരണാധികാരിയെ നിയമിച്ചു കിട്ടുന്നതിന് പരാമർശം (1) പ്രകാരം സംഘം ഭരണസമിതി തീരുമാനമെടുത്ത് അപേക്ഷിച്ചതിന്റെ അടിസ്ഥാനത്തിൽ പരാമർശം (2) പ്രകാരം മഞ്ചേരി (ജനറൽ) അസിസ്റ്റന്റ ് രജിസ്ട്രാർ ആഫീസിലെ മലപ്പുറം യൂണിറ്റ് ഇൻസ്പെക്ടറെ വരണാധികാരിയായി നിയമിച്ച് നൽകുകയു≠ായി.

29-11-2004-ന് നടത്താൻ നി›യിച്ച ഭരണസമിതി തെരഞ്ഞെടുപ്പിലേക്ക് ആരും തന്നെ നാമനിർദ്ദേശ പത്രിക സമർപ്പിക്കാത്തതിനാൽ പുതിയ ഭരണസമിതി തെരഞ്ഞെടുപ്പ് നടത്താൻ കഴിയാതെ വരികയും തൻമൂലം സംഘത്തിൽ ഉളവായ ഭരണസ്തംഭനം ഒഴിവാക്കുന്നതിന് പരാമർശം (3) ഉത്തരവ് പ്രകാരം പാർട്ട് ടൈം അഡ്മിനിസ്ട്രേറ്ററെ നിയമിക്കുകയും ചെയ്തു.

സംഘം തുറന്ന് പ്രവർത്തിക്കുന്നില്ല എന്നും പുനരു÷ീവിപ്പിക്കുന്നതിന് സാധ്യത വളരെ കുറവാണെന്നും സൂചന (5) പ്രകാരം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) റിപ്പോർട്ട് ചെയ്തതിന്റെ അടിസ്ഥാനത്തിൽ സംഘത്തിന്റെ പ്രവർത്തനസാധ്യത പരിശോധിക്കുന്നതിനായി 1969-ലെ കേരള സഹകരണസംഘം നിയമം വകുപ്പ് 66 പ്രകാരം പരിശോധന നടത്തുന്നതിന് പരാമർശം (6) പ്രകാരം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) മഞ്ചേരി ആഫീസിലെ എ.ആർ.സി. ആന്റ ് ഇ.പി.

ഇൻസ്പെക്ടറെ ചുമതലപ്പെടുത്തിയതിന്റെ അടിസ്ഥാനത്തിൽ പരാമർശം (8) പ്രകാരം പരിശോധന ഉദ്യോഗസ്ഥൻ റിപ്പോർട്ട് സമർപ്പിക്കുകയു≠ായി.

പ്രസ്തുത റിപ്പോർട്ട് പ്രകാരം സംഘം രൂപീകരണ ഉദ്ദേശ ലക്ഷ്യങ്ങളിൽ യാതൊന്നും തന്നെ ഇതിനകം കൈവരിക്കാൻ സാധിച്ചിട്ടില്ല എന്നും സംഘം പ്രവർത്തനം ഇനിയും മുന്നോട്ട് കൊ≠ുപോകുന്നതിന് മെമ്പർമാർക്ക് താല്പര്യമില്ല എന്നതിനാലും പ്രവർത്തനം സമാപ്തീകരിക്കാൻ പരിശോധന ഉദ്യോഗസ്ഥനും പരാമർശം (7) പ്രകാരം അസിസ്റ്റന്റ ് രജിസ്ട്രാറും ശുപാർശ ചെയ്തിട്ടു≠്.

സംഘത്തിന്റെ ഇപ്പോഴത്തെ അവസ്ഥയും പരിശോധന യിൽ വെളിപ്പെട്ട വസ്തുതകളും വിലയിരുത്തുമ്പോൾ സംഘം പ്രവർത്തനം സമാപ്തീകരിക്കലാണ് ഉചിതമായ നടപടി എന്ന് ബോദ്ധ്യപ്പെട്ട സാഹചര്യത്തിൽ സമാപ്തീകരണത്തിന് മുന്നോടിയായി 1969-ലെ കേരള സഹകരണ സംഘം നിയമം വകുപ്പ് 71 (1)-ൽ നിഷ്കർഷിച്ച പ്രകാരം ബന്ധപ്പെട്ട ധനസഹായബാങ്ക് സർക്കിൾ സഹകരണ യൂണിയൻ, സംഘം പാർട്ട് ടൈം അഡ്മിനിസ്ട്രേറ്റർ എന്നിവർക്ക് മേൽ വിഷയത്തിൽ എന്തെങ്കിലും നിവേദനമോ, ആക്ഷേപമോ, അഭിപ്രായമോ ബോധിപ്പിക്കുവാനു≠െങ്കിൽ ആയത് ബോധിപ്പിക്കുന്നതിന് പരാമർശം (9) പ്രകാരം അവസരം നൽകു കയും ചെയ്തു.

സംഘം പ്രവർത്തനം നിർത്തൽ ചെയ്യുന്ന വിഷയത്തിൽ ഉചിതമായ നടപടി സ്വീകരിക്കാവുന്നതാണെന്ന് പരാമർശം (10) പ്രകാരം സർക്കിൾ സഹകരണ യൂണിയന് വേ≠ി സെക്രട്ടറി എന്ന നിലയിൽ അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) മഞ്ചേരി ബോധിപ്പിക്കുകയു≠ായി. മലപ്പുറം ജില്ല സഹകരണ ബാങ്കും പാർട്ട് ടൈം അഡ്മിനിസ്ട്രേറ്ററും നി›ിത സമയപരിധിക്കകം യാതൊന്നും അറിയിക്കുകയു≠ായില്ല.

മേൽ വസ്തുതകളുടെ അടിസ്ഥാനത്തിൽ സംഘം പ്രവർത്തനം പുനരു÷ീവിപ്പിക്കുന്നതിന് യാതൊരു സാധ്യതയും കാണാത്തതിനാൽ സംഘം പ്രവർത്തനം നിർത്തൽ ചെയ്യലാണ് ഉചിതമായ നടപടി എന്ന് എനിക്ക് ബോദ്ധ്യപ്പെട്ട സാഹചര്യത്തിൽ താഴെ പറയും പ്രകാരം ഉത്തരവാകുന്നു.

1969-ലെ കേരള സഹകരണസംഘം നിയമം വകുപ്പ് 71 (1) പ്രകാരം എന്നിൽ നിക്ഷിപ്തമായ അധികാരം ഉപയോഗിച്ച് മലപ്പുറം ലേബർ കോൺട്രാക്റ്റ് സഹകരണ സംഘം ക്ലിപ്തം നമ്പർ എം. 546-ന്റെ പ്രവർത്തനം സമാപ്തീകരിക്കുന്നതിനും സഹകരണസംഘം നിയമം വകുപ്പ് 72 (1) പ്രകാരം മഞ്ചേരി അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) ആഫീസിലെ മലപ്പുറം യൂണിറ്റ് ഇൻസ്പെക്ടറെ സംഘത്തിന്റെ ലിക്വിഡേറ്ററായി നിയമിച്ചുകൊ≠ും ഇതിനാൽ ഉത്തരവാകുന്നു. ലിക്വിഡേറ്റർ ഉടൻതന്നെ ചാർ÷െടുക്കേ≠തും ചാർ÷െടുത്ത തീയതിയിലെ ബാക്കിപത്രം, ചാർ÷് ലിസ്റ്റിന്റെ പകർപ്പ് എന്നിവ സഹിതം ചാർ÷െടുത്ത വിവരം ഈ ഓഫീസിൽ ഉടൻതന്നെ റിപ്പോർട്ട് ചെയ്യേ≠തും നിയമാനുസൃതം സമാപ്തീകരണ നടപടികൾ പൂർത്തിയാക്കേ≠തുമാണ്. സഹകരണനിയമം, ചട്ടം 69 (3) പ്രകാരം ലിക്വിഡേഷൻ സംബന്ധിച്ചുള്ള ത്രൈമാസ പുരോഗതി റിപ്പോർട്ട് യഥാസമയം ഈ ഓഫീസിൽ സമർപ്പിക്കേ≠തുമാണ്.
