എെ.407-ാം നമ്പർ ബൈസൺവാലി ലേബർ കോൺട്രാക്ട് സഹകരണ സംഘം വർഷങ്ങളായി പ്രവർത്തനരഹിതമാണെന്നും സംഘത്തിന് സ്വന്തമായി ആഫീസോ, ജീവനക്കാരോ, ഭരണസമിതിയോ ഇല്ലായെന്നും സംഘത്തിന്റെ ഉദ്ദേശ ലക്ഷ്യങ്ങൾക്കനുസൃതമായി പ്രവർത്തിക്കുന്നതിന് സാധിക്കുകയില്ലായെന്നും കേരള സഹകരണ നിയമം 66-ാം വകുപ്പ് പ്രകാരമുള്ള പരിശോധനയിൽ ക≠െത്തിയതിന്റെ അടിസ്ഥാനത്തിൽ ടി സംഘത്തിന്റെ പ്രവർത്തനം സമാപ്തീകരിക്കാവുന്നതാണ് എന്ന് ഉടുമ്പൻചോല അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) സൂചന (1) പ്രകാരം ശുപാർശ ചെയ്തിട്ടു≠്. ഇതിന്റെ അടിസ്ഥാനത്തിൽ ടി സംഘം സമാപ്തീകരിക്കുന്നതിനെതിരെ ആക്ഷേപങ്ങൾ ക്ഷണിച്ചുകൊ≠് സംഘത്തിനും, ഇടുക്കി ജില്ലാ സഹകരണ ബാങ്കിനും, ഉടമ്പൻചോല സർക്കിൾ സഹകരണ യൂണിയനും സൂചന (2) പ്രകാരം നോട്ടീസ് നൽകുകയു≠ായി. എന്നാൽ നാളിതു വരെയായി ആരിൽ നിന്നും യാതൊരു ആക്ഷേപങ്ങളും ലഭിക്കാത്ത സാഹചര്യത്തിൽ ടി സംഘം പ്രവർത്തനം സമാപ്തീകരിക്കുന്നതിന് ആർക്കും ആക്ഷേപമില്ല എന്ന നിഗമനത്തിൽ കേരള സഹകരണ നിയമ പ്രകാരം എന്നിൽ നിക്ഷിപ്തമായ അധികാരമുപയോഗിച്ച് താഴെപ്പറയുന്ന ഉത്തരവ് പുറപ്പെടുവിക്കുന്നു.

എെ. 407-ാം നമ്പർ ബൈസൺവാലി ലേബർ കോൺട്രാക്ട് സഹകരണ സംഘത്തിന്റെ പ്രവർത്തനം സമാപ്തീകരിക്കുന്നതിനും, സമാപ്തീകരണ നടപടികൾ പൂർത്തിയാക്കുന്നതിലേക്ക് ടി സംഘത്തിന്റെ ലിക്വിഡേറ്ററായി ഉടുമ്പൻചോല അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജ) ആഫീസിലെ 'സി' യൂണിറ്റ് ഇൻസ്പെക്ടറെ നിയമിച്ചുകൊ≠ും യഥാക്രമം കേരള സഹകരണ നിയമം 71(1), 72(1) എന്നീ വകുപ്പുകൾ പ്രകാരം ഇതിനാൽ ഉത്തരവാകുന്നു. ലിക്വിഡേറ്റർ ഉടൻ തന്നെ ചാർ÷െടുക്കേ≠തും ചാർ÷െടുത്ത തീയതിയിലെ ബാക്കിപത്രം, ചാർ÷് ലിസ്റ്റിന്റെ പകർപ്പ് എന്നിവ സഹിതം ചാർ÷െടുത്ത വിവരം ഈ ആഫീസിൽ ഉടൻ തന്നെ റിപ്പോർട്ടു ചെയ്യേ≠തും നിയമാനുസൃതം സമാപ്തീകരണ നടപടികൾ സമയബന്ധിതമായി പൂർത്തിയാക്കേ≠തുമാണ്.

ചുങ്കത്തറ പഞ്ചായത്ത് പട്ടികജാതി സർവ്വീസ് സഹകരണ സംഘത്തിന്റെ തെരഞ്ഞെടുക്കപ്പെട്ട ഭരണസമിതിയുടെ കാലാവധി അവസാനിക്കുകയും, അവസാനം അധികാരത്തിലിരുന്ന ഭരണസമിതി തെരഞ്ഞെടുപ്പ് നടത്തുന്നതിന് നടപടി സ്വീകരിക്കാത്തതുമൂലം സംഘത്തിൽ ഉളവായ ഭരണസ്തംഭനം ഒഴിവാക്കുന്നതിന് അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ), മഞ്ചേരി ആഫീസിലെ നിലമ്പൂർ യൂണിറ്റ് ഇൻസ്പെക്ടറെ പാർട്ട്ടൈം അഡ്മിനിസ്ട്രേറ്ററായി പരാമർശം (1) ഉത്തരവ് പ്രകാരം നിയമിക്കുകയും കാലാവധി പരാമർശം (2) പ്രകാരം ദീർഘിപ്പിച്ച് നൽകുകയുമു≠ായി.

സംഘത്തിന്റെ പ്രവർത്തന സാധ്യത സംബന്ധിച്ച് 1969-ലെ കേരള സഹകരണ സംഘം നിയമം വകുപ്പ് 66 പ്രകാരം നടത്തിയ പരിശോധന റിപ്പോർട്ടിൽ സംഘത്തിന് ഓഫീസോ, ജീവനക്കാരോ ഇല്ലായെന്നും സംഘത്തിന്റെ രൂപീകരണ ഉദ്ദേശ്യ ലക്ഷ്യങ്ങൾ യാതൊന്നും തന്നെ കൈവരിച്ചിട്ടില്ലായെന്നും, സംഘത്തിന്റെ പ്രവർത്തനം സമാപ്തീകരിക്കാനുള്ള നടപടി കൈകൊള്ളാവുന്നതാണെന്നും പരാമർശം (3) പ്രകാരം പരിശോധന ഉദ്യോഗസ്ഥനും, പരാമർശം (4) പ്രകാരം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ)-ഉം റിപ്പോർട്ട് ചെയ്തിട്ടു≠്.

മേൽ വസ്തുതകളുടെ അടിസ്ഥാനത്തിലും, പരിശോധനയിൽ വെളിപ്പെട്ട കാര്യങ്ങൾ വിലയിരുത്തുമ്പോൾ സംഘം പ്രവർത്തനം സമാപ്തീകരിക്കലാണ് ഉചിതം എന്ന് ബോധ്യപ്പെട്ട സാഹചര്യത്തിൽ മേൽ വിഷയത്തിൽ ആക്ഷേപം ബോധിപ്പിക്കുന്നതിന് വകുപ്പ് 71(1) നിഷ്കർഷിച്ച പ്രകാരം പരാമർശം (5) പ്രകാരം സമയം അനുവദിച്ച് നൽകുകയും ചെയ്തെങ്കിലും നി›ിത സമയത്തിനകം ആരുംതന്നെ ആക്ഷേപം ബോധിപ്പിക്കുകയു≠ായില്ല. സംഘത്തിന്റെ രൂപീകരണ ലക്ഷ്യം യാതൊന്നും ഇതുവരെ കൈവരിച്ചിട്ടില്ല. മേൽ സാഹചര്യത്തിൽ താഴെ പറയും പ്രകാരം ഉത്തരവാകുന്നു.

ഉത്തരവ്

1969-ലെ കേരള സഹകരണ സംഘം നിയമം വകുപ്പ് 71 (1) പ്രകാരം എന്നിൽ നിക്ഷിപ്തമായ അധികാരം ഉപയോഗിച്ച് ചുങ്കത്തറ പഞ്ചായത്ത് പട്ടികജാതി സർവ്വീസ് സഹകരണ സംഘം ക്ലിപ്തം നമ്പർ എം. 565-ന്റെ പ്രവർത്തനം സമാപ്തീകരിച്ചുകൊ≠ും സഹകരണ സംഘം നിയമം വകുപ്പ് 72 (1) പ്രകാരം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ), മഞ്ചേരി ആഫീസിലെ നിലമ്പൂർ യൂണിറ്റ് ഇൻസ്പെക്ടറെ ലിക്വിഡേറ്റർ ആയി നിയമിച്ചുകൊ≠ും ഇതിനാൽ ഉത്തരവാകുന്നു.

ലിക്വിഡേറ്റർ ഉടൻ ചാർ÷െടുക്കേ≠തും ചാർ÷െടുക്കുന്ന തീയതിയിലെ ബാക്കിപത്രം, ചാർ÷് ലിസ്റ്റിന്റെ പകർപ്പ് എന്നിവ സഹിതം ചാർ÷െടുത്ത വിവരം ഈ ആഫീസിൽ റിപ്പോർട്ട് ചെയ്യേ≠തും സഹകരണ നിയമം, രജിസ്ട്രാറുടെ സർക്കുലർ നിർദ്ദേശങ്ങൾ എന്നിവയ്ക്ക് വിധേയമായി സമാപ്തീകരണ നടപടി പൂർത്തിയാക്കേ≠തുമാണ്.

സഹകരണ നിയമം, ചട്ടം 69(3) പ്രകാരം ലിക്വിഡേഷൻ സംബന്ധിച്ചുള്ള ത്രൈമാസ പുരോഗതി റിപ്പോർട്ട് യഥാസമയം ഈ ഓഫീസിൽ സമർപ്പിക്കേ≠താണ്.
