വിഷയം :—സമാപ്തീകരണം—കെ. 427 ജവഹർലാൽ മെമ്മോറിയൽ കൺസ്യൂമർ സഹകരണ സംഘം—രജിസ്ട്രേഷൻ റദ്ദ് ചെയ്ത് പുനർ ഉത്തരവാകുന്നു.

കെ. 427-ാം നമ്പർ ജവഹർലാൽ മെമ്മോറിയൽ കൺസ്യൂമർ സഹകരണ സംഘത്തിന്റെ പ്രവർത്തനം സൂചന (1) പ്രകാരം സമാപ്തീകരിച്ച് വൈക്കം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജ) ഓഫീസിലെ വടയാർ യൂണിറ്റ് ഇൻസ്പെക്ടറെ ലിക്വിഡേറ്ററായി നിയമിച്ച് ഉത്തരവായിട്ടുള്ളതും സൂചന (4) പ്രകാരം ലിക്വിഡേഷൻ നടപടികൾ പൂർത്തീകരിച്ചിട്ടുള്ളതായും ലിക്വിഡേറ്റർ അറിയിച്ചിരിക്കുന്നു. ലിക്വിഡേറ്ററുടെ നടപടികൾ പരിശോധിച്ചതിൽനിന്നും താഴെ പറയുന്ന കാര്യങ്ങൾ ബോദ്ധ്യപ്പെട്ടിരിക്കുന്നു.

എന്നാൽ സഹകരണ സംഘം രജിസ്ട്രാറുടെ സൂചന (7) കത്ത് പ്രകാരം ടി സംഘത്തിന്റെ ലിക്വിഡേഷൻ ചാർ÷് അടച്ചിട്ടില്ലാത്തതിനാൽ ആയതുകൂടി അടച്ചതിനുശേഷം ഉത്തരവിൽ ആവശ്യമായ ഭേദഗതി വരുത്തി പുതിയ ഉത്തരവാക്കുവാൻ നിർദ്ദേശിച്ചിരുന്നു. ആയതിൻ പ്രകാരം വൈക്കം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ)-ന്റെ സൂചന (8) അപേക്ഷ പ്രകാരം കോമൺ ലിക്വിഡേഷൻ ഫ≠ിൽ നിന്നും സൂചന (9) ഉത്തരവനുസരിച്ച് ഫ≠് അനുവദിക്കുകയും ലിക്വിഡേഷൻ ചാർ÷് അടയ്ക്കുകയും ചെയ്തിട്ടു≠്. ടി തുകകൾ ഉൾപ്പെടെയുള്ള ലിക്വിഡേറ്ററുടെ വരവ് ചെലവ് കണക്ക് താഴെ പറയും പ്രകാരമാണ്.

സംഘത്തിന്റെ അവസാന പൊതുയോഗം 31-8-2011-ൽ കൂടി ലിക്വിഡേറ്ററുടെ നടപടി അംഗീകരിച്ചിട്ടുള്ളതും സംഘത്തിന്റെ രജിസ്ട്രേഷൻ റദ്ദ് ചെയ്യുന്ന നടപടികൾ സ്വീകരിക്കുവാൻ ലിക്വിഡേറ്ററെ ചുമതലപ്പെടുത്തിയിട്ടുള്ളതും സൂചന (4) പ്രകാരം രജിസ്ട്രേഷൻ റദ്ദ് ചെയ്യുന്നതിന് അപേക്ഷിച്ചിട്ടുള്ളതും ആയത് ശുപാർശ ചെയ്തിട്ടുള്ളതുമാകുന്നു. ലിക്വിഡേഷൻ കണക്കിൽ ബാക്കി നിൽപില്ല. ഇപ്രകാരം ലിക്വിഡേഷൻ നടപടികൾ പൂർത്തികരിച്ചതായി എനിക്ക് ബോദ്ധ്യമായിരിക്കുന്നു. മേൽ സാഹചര്യത്തിൽ താഴെപ്പറയുന്ന ഉത്തവ് പുറപ്പെടുവിക്കുന്നു.

കെ. 427-ാം നമ്പർ ജവഹർലാൽ മെമ്മോറിയൽ കൺസ്യൂമർ സഹകരണ സംഘത്തിന്റെ രജിസ്ട്രേഷൻ കേരള സഹകരണ നിയമം 74-ാം വകുപ്പ് പ്രകാരം റദ്ദ് ചെയ്തു കൊ≠ും, സംഘത്തിന്റെ പേര് സംഘങ്ങളുടെ പട്ടികയിൽ നിന്നും നീക്കം ചെയ്തു കൊ≠ും പുനർ ഉത്തരവാകുന്നു. ലിക്വിഡേറ്റർ സംഘത്തിന്റെ റിക്കാർഡുകളും ഫയലുകളും ചട്ടം 70-ൽ നിഷ്കർഷിക്കുന്ന പ്രകാരം 3 വർഷക്കാലം സൂക്ഷിക്കേ≠തും ആയതിനുശേഷം ഈ ഓഫീസിന്റെ അനുമതിയോടെ നശിപ്പിക്കാവുന്നതുമാണ്.
