Explanatory Note

(This does not form part of the notification, but is intended to indicate the general purpose.)

An approximate extent of 20 hectares of Ecologically Fragile Land in old Survey No. 345, 357/1, 358 in Muttil South Village was notified under Sl. No. 2 as per the Notification No. EFL 1-134/2006 dated 2-4-2007 of Custodian (Ecologically Fragile Land) and published in Gazette No. 17, Vol. 52, dated 24-4-2007. On survey and demarcation, actual extent is found to be 22.1412 Ha. and some variations in the boundaries notified earlier. Erratum notification is intended to correct the above variations.

It is hereby notified for the general information of the public that Acacia timber collected from the various Acacia Plantations in Palode Range of Thiruvananthapuram Division will be sold in tender/auction sale as per the schedule furnished below subject to the detailed Tender/Auction sale conditions published in Kerala Gazette No. 49 dated 14-12-2010 in Forest sheet Page Nos. 589 to 595 by Chief Conservator of Forests (Protection), Thiruvananthapuram, vide Notification No. Pro. (5) 5628/2010, dated 2-12-2010 and other rules and conditions in force. Tender forms will be available in Divisional Forest Office, Thiruvananthapuram and Forest Range Office, Palode on payment of ` 200 and VAT.

Tenders will be accepted till the date fixed for tender/auction sale upto 9 a.m. in Range Office, Palode as the case may be. Tenders received after the stipulated date and time will not be entertained. If the date for Tender/Auction happens to a public holiday, harthal or strike, the auction sale will be held in the next working day at the scheduled time and place. Tenders will be opened immediately after the auction sale and further action will be taken as per sale conditions. The intending bidders should satisfy themselves about the quantity and quality of the materials put up for tender/auction sale and no complaints will be entertained later on regarding the same. Further details of tender/auction sale will be available from the Range Office, Palode. Materials taken to stock up to the day before the auction will be included in sale and hence the quantity shown is approximate. If there is no bid or part bid in the 1st day of auction, the remaining materials will be put up for sale on subsequent dates and time shown in the schedule. The Auctioning Officer has discretion to conduct the auction completely or partially and to postpone the auction without assigning any reason, thereof.

The details and necessary documents will be obtained from the office of the Wildlife Warden, Thiruvananthapuram on any working days till 1 p. m. of tender date. Tender form can be obtained by remitting cash including VAT with necessary application. The cost of tender form will not be returned. The terms and conditions applicable to tender formalities in store purchase rules will be applicable to this work also. Tender forms are not transferable. G. O. (P) 84/97/P & T dated 19-8-1997 related to PWD tender is also applicable here. The Earnest Money Deposit will be accepted only as Demand Draft from Nationalized or Scheduled Bank. The Earnest Money Deposit has to be pledged in the name of Wildlife Warden, Thiruvananthapuram and the name of work must be entered on it. A preliminary agreement in Stamp Paper worth ` 100 in prescribed form should also be submitted along with the tender. The tender without the preliminary agreement will be refused. The successful tenderer is liable to remit the taxes as per rules. In case the tender cannot be conducted on the above date, it will be conducted on 13-9-2013 at 3.30 p. m.

TENDER-CUM-AUCTION NOTICE

It is hereby notified that the teak poles, teak billet and jungle wood fire woods collected from final felling of matchwood plantations in Kallar & Achencovil Range of Achencovil Division will be sold in public Tender cum Auction at dumping sites shown in the schedule, by the Divisional Forest Officer, Achencovil or any officer authorised by him, subject to the conditions published in Kerala Gazette No. 29 Vol. I dated 25-12-2012 vide Notification No. Pro. (5) 26274/12 dated 11-12-2012 of the Additional Principal Chief Conservator of Forests (P), Thiruvananthapuram and other conditions prevalent in the Forest Department. Besides the quantity shown in the schedule, the quantity if any delivered to dumping sites before the date of Tender cum Auction will also be included in the sale. If the date of Tender cum Auction noted in the schedule is declared as public holiday, the tender cum auction will be conducted in the next working day at the same time and place and if the proposed tender cum auction is not held due to other reasons, the same will be conducted on the alternate dates as shown in the schedule at the same time and place. Tender forms can be had from the respective Range Office on all working days on payment of ` 400 and VAT.

Those who intend to participate in the Tender cum Auction shall deposit a sum of ` 20,000 as E.M.D. in cash at the time of submission of tender. Those who intend to participate in the auction alone, shall deposit the EMD at the above rate before the commencement of auction.

Intending persons may ensure the quantity and quality of materials put up for auction/tender before the commencement of the same and no complaints will be entertained after the auction/tender. The tenderers/bidders should produce a Certificate showing the permanent address and signature of the bidders duly attested by the concerned Village Officer or any other approved identity documents before depositing the EMD. Those who do not produce any approved identity card or certificate will not be allowed to participate in the tender/auction.

In case any Government Department requires any of the materials put up for the auction the quantity remaining after their selection only will be auctioned. The quantity that may become ready for sale after the publication of this notification will also be included in the tender cum auction. Any further notification to the sale conditions that may be issued by Government after the issuance of this notification will also be applicable to this tender-cum auction.

TENDER-CUM -AUCTION NOTICE

No. A3-968/2013.

19th August 2013.

1. It is hereby notified for the information of the public that the right of collection and removal of standing Elavu and Vatta trees in the 1972 Match Wood Plantation Double Cutting in Kallar Range of this Division as specified in the schedule appended below will be sold in Tender-Cum-Auction by the Divisional Forest Officer, Achencovil or any other officer authorized by him on 30-9-2013 at 11 a. m. in the Divisional Forest Office, Achencovil subject to the terms and conditions of sale of Timber in Government Timber Depots published in Government Gazette No. 29, Vol. I, dated 25-12-2012 vide Notification No. Pro. (5)26274/12, dated 11-12-2012 of the Addl. Principal Chief Conservator of Forests (P), Thiruvananthapuram and as per general conditions of the sale of tree growth prevailing in the department. In case the notified date happens to be a public holiday the Tender/Auction will be conducted on the next working day at the notified place and time.

2. The auction will be on lumpsum basis for the right of collection and removal of entire Elavu and Vatta tree growth from the above Plantation mentioned in the schedule hereto the area of which has been surveyed and demarcated on the ground.

3. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after the Tender/Auction will not be entertained.

4. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless valid power of attorney is produced prior to commencement of Auction/Tender.

5. A supply contractor of Achencovil Division or the adjacent Divisions will not be allowed to bid in the Auction/ Tender.

6. Intending tenderers/bidders should produce a certificate from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.

7. The successful Tenderers/Bidders should give an undertaking that he is not related to any officer having control of the work and that he is not supply contractor of this or any adjacent divisions. If this is proved otherwise it shall result in cancellation of the contract and resale of the coupe at his risk and loss.

8. No petition or post offer received after seven days of the conduct of the tender/auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is One lakh and above, and more than 20% where the original bid amount is less than One lakh will ordinarily be considered. The post offerer will comply with following terms.

(a) Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.

(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender/Auction date.

(c) The remittance should be made by the Chalan or Bank Deposit and the bank receipt should be produced before the Divisional Forest Officer concerned within seven days from the date of receipt of registered notice to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned, pledging the security deposit for the due fulfilment of the above terms. If the post offerer satisfied the conditions, a reauction of the right will be conducted after giving the usual publicity as per rules. In the reauction of the price fetched, does not come up to what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forefeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.

9. Further particulars can be had either from the Office of the Divisional Forest Officer or from the Range Officer concerned.

10. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of ` 10,000 (Rupees Ten thousand only) for participating in the Tender/Auction.

11. The successful tenderers/bidders have to remit 35% sale value on the tender/auction date. If this 35% value exceeds ` 1,00,000, ` 1,00,000 will be remitted on auction date itself and balance value have to be remitted in the Sub Treasury, Punalur within 7 working days through the countersigned chalan issued from this office and the receipted chalan submitted to this office. If he fails to remit this amount, the EMD will be forfeited to Govt. and the coupe will be reauctioned at his risk and loss.

12. If the value fetched in the resale/re-tender is less than that obtained in the original tender/auction the difference between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/Bidders through legal means including Revenue Recovery Act in force.

13. The participating Tenderers/Bidders have rights only for collection and removal of enumerated standing Elavu and Vatta trees and has no right for removing trees like Teak, Rose Wood, etc.

14. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax, etc., at the rate prevailing from time to time.

15. The successful Tenderers/Bidders should execute a bounded agreement on a Stamp Paper worth ` 100 after the completion of the Tender/Auction.

16. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit 1/3rd of the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force and security deposit of 10% for the total sale value. The successful Tenderers/Bidders should execute an agreement on a Stamp Paper worth ` 100. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days shall be granted by the Divisional Forest Officer subject to the realization of 24 % penal interest. Incase of failure to remit the amount within the extended period further extension for 15 days by the Chief Conservator of Forests and 15 days by the Additional Principal Chief Conservator of Forests shall be granted subject to the realization of penal interest at 24% and 48% respectively. But all the extension periods mentioned above will be within the original contract period.

17. The balance 2/3rd sale value should be remitted in two equal installments by the successful Tenderers/Bidders. The first installment should be remitted within 15 days from the date of agreement and the second installment within 30 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers/Bidders fail to remit the above amount within the period mentioned above, extension for 15 days by realizing penal interest at 12% by Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Chief Conservator of Forests concerned and further extension for 30 days by the Additional Principal Chief Conservator of Forests concerned by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will be within the original contract period.

18. The period of contract will be 60 days from the date of intimation of confirmation. No extension of period of contract shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests concerned may grant extension of time for one month and two months respectively on realization of penalty or penalties for completion of each work for each month mentioned below:

(a) For enumerated trees and balance unfelled per hectare or fraction thereof —` 750 per hectare.

(b) Unremoved registered logs and unregistered logs—` 100/m³ or fraction thereof.

(c) Unremoved firewood—` 50/Tone or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during the original contract period. The penalty for the first month shall be realized as the above rates; double the rate for the second month and three times of the original rate for the third month shall be realized. If the Tenderers/ Bidders fail to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenders as per the agreement will be forfeited to Government and the Tenderers/Bidders shall not have any right on the produce confiscated to Government.

In the above circumstances the balance work to be executed by the Tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the Tenderers/Bidders.

19. The license for removal of Elavu and Vatta Timber and Firewood collected in the coupe should be issued only on the basis of the prevailing norms.

20. The contractor/his agent shall enter the coupe only after getting the written permission from the Divisional Forest Officer, Achencovil/Forest Range Officer, Kallar.

21. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 meters and keep the cairns intact.

22. The contractor will be liable for any damage or loss caused to other trees in the plantation or reserve.

23. The Divisional Forest Officer will give permission to keep the timber and other produce outside the coupe if requested by the contractor at his risk. But if the collected timber/firewood are not removed within the agreement period due to unforeseen situation/climate, a ground rent @ ` 250/Ha will be recovered from the contractor.

24. The contractor will be liable for all the illegal activities occurred within 0.4 km. perimeter of the coupe. Any such activities noticed will be reported to the forest officials by the contractor, otherwise the contract will be cancelled.

25. The security deposit will be refunded only after the successful completion of contract after producing the clearance certificates of VAT, Income Tax, etc. If there is any liabilities outstanding in this respect to the Govt. that will be adjusted from the security deposit of the contractor.

26. All common conditions regarding sale coupe are also applicable to this Tender/Auction.

8. ദർഘാസ്/ലേലത്തിന് 7 ദിവസങ്ങൾക്കു ശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുളള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരു ലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽപ്പെട്ട ലേലങ്ങൾക്ക് 20 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകൾ മാത്രമേ പരിഗണിക്കുകയുളളൂ. കൂടാതെ താഴെ പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമാണ്.

(എ) ദർഘാസ്/ലേലത്തിൽ 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.

(ബി) പോസ്റ്റ് ഓഫറുകാരൻ യഥാർ∞ ദർഘാസ്/ലേലക്കാരൻ ഒടുക്കിയ തുകയുടെ ഇരട്ടി തുക അടയ്ക്കേ≠താണ്.

(സി) ബന്ധപ്പെട്ട പോസ്റ്റ് ഓഫർ തുകയും മറ്റു നികുതികളും ചെല്ലാൻ മുഖാന്തിരമോ, ബാങ്ക് രസീത് വഴിയോ ഈ ആഫീസിൽ നിന്നും രജിസ്റ്റേർഡ് തപാൽ മുഖേന അറിയിച്ച് ഏഴു ദിവസത്തിനുളളിൽ ഒടുക്കി ഈ ആഫീസിൽ ഹാജരാക്കേ≠താണ്. പോസ്റ്റ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ കൂപ്പിന്റെയും അതിലെ നിൽപ്പു മരങ്ങളുടേയും ഗുണനിലവാരവും മറ്റു ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ട ശേഷം നി›ിത മുദ്രപ്പത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്.

പോസ്റ്റ് ഓഫറുകാരൻ ടി വ്യവസ്ഥകൾ ബോദ്ധ്യപ്പെട്ട് ഉടമ്പടിയിൽ ഏർപ്പെടുന്നപക്ഷം ഇതിൻമേൽ ആവശ്യമായ പരസ്യം നൽകി ഒരു പുനർലേലം നടത്തുന്നതാണ്. പുനർലേലത്തിൽ ലഭിക്കുന്ന തുക പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനംചെയ്ത തുകയേക്കാൾ കുറവാണെങ്കിൽ, പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയ്ക്ക് ടിയാന്റെ പേരിൽ ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തുന്ന തായിരിക്കും. പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത ലേലത്തുക അടയ്ക്കുന്നതിൽ നിന്നും പിൻമാറുന്നപക്ഷം ടിയാൻ അടച്ചിട്ടുളള സെക്യൂരിറ്റി തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതാണ്. പുനർലേലത്തിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനംചെയ്ത തുകയേക്കാൾ കൂടുതൽ തുകയ്ക്ക് ലേലം/ദർഘാസ് നടക്കുകയാണെങ്കിൽ ഉയർന്ന ലേലത്തുകയ്ക്ക് ആ വ്യ‡ിയുടെ പേരിൽ ലേലം ഉറപ്പിക്കുന്നതും പോസ്റ്റ് ഓഫറുകാരന്റെ സെക്യൂരിറ്റി തുക തിരികെ നൽകുന്നതുമാണ്.

16. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുടെ മൂന്നിൽ ഒന്നും മൊത്തം തുകയുടെ 5 ശതമാനം ഫോറസ്റ്റ് ഡവലപ്പ്മെന്റ ് ടാക്സും നിലവിലുളള നിരക്കിൽ വില്പന നികുതി, ഇൻകം ടാക്സ് എന്നിവയും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10 ശതമാനം സെക്യൂരിറ്റി ഡെപ്പോസിറ്റും വച്ച് ` 100-ന്റെ മുദ്രപ്പത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠തുമാണ്. 15 ദിവസത്തിനുളളിൽ ടി തുകകൾ ഒടുക്കാതിരുന്നാൽ 12 ശതമാനം പലിശയോടുകൂടി തുകകൾ ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയവും 24 ശതമാനം പലിശയോടുകൂടി വീ≠ും 15 ദിവസത്തെ സമയവും യു‡ം പോലെ അച്ചൻകോവിൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർ അനുവദിക്കുന്നതാണ്. ഈ കാലാവധിക്കുളളിലും തുക ഒടുക്കാതെവന്നാൽ കൊല്ലം ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ംപോലെ 24 ശതമാനം പലിശ നിരക്കിൽ 15 ദിവസത്തേയും വീ≠ും 48 ശതമാനം പലിശ നിരക്കിൽ അഡീഷണൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ംപോലെ സമയം അനുവദിക്കാവുന്നതാണ്. എന്നാൽ മുകളിൽ പറഞ്ഞ കാലാവധികളെല്ലാം കരാർ കാലാവധിക്കുളളിലായിരിക്കും.

17. ബാക്കി മൂന്നിൽ ര≠് ലേലത്തുക ര≠് തുല്യ ഗഡുക്കളായി ഒടുക്കേ≠താണ്. ആദ്യ ഗഡു കരാർ തീയതി മുതൽ 15 ദിവസത്തിനകവും ര≠ാം ഗഡു കരാർ തീയതി മുതൽ ഒരുമാസത്തിനകമോ, കരാർ കാലാവധിക്കകമോ ഏതാണോ ആദ്യം ആ കാലാവധിക്കുളളിലും ഒടുക്കേ≠താണ്. ടി കാലാവധിക്കുളളിൽ പണം ഒടുക്കുവാൻ കഴിയാതെവന്നാൽ 12 ശതമാനം പലിശ നിരക്കിൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർക്ക് 15 ദിവസത്തേയും 24 ശതമാനം പലിശ നിരക്കിൽ കൊല്ലം ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ംപോലെ 30 ദിവസത്തേക്കും, വീ≠ും 30 ദിവസത്തേക്ക് 48 ശതമാനം പലിശ നിരക്കിൽ അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ംപോലെയും കാലാവധി നീട്ടികൊടുക്കാവുന്നതാണ്. എന്നാൽ നീട്ടി കൊടുക്കുന്ന കാലാവധികളെല്ലാം തന്നെ കരാർ കാലാവധിക്കുളളിലായിരിക്കും.

18. ഉടമ്പടി കാലാവധി ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 60 ദിവസമാണ്. സാധാരണഗതിയിൽ കൂപ്പിന്റെ കാലാവധി നീട്ടികൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും അച്ചൻകോവിൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ, കൊല്ലം ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ എന്നിവർ യഥാക്രമം ഒന്നും ര≠ും മാസം വീതം താഴെ പറയും പ്രകാരം പിഴ ഈടാക്കിക്കൊ≠് ഓരോ ജോലിക്കും കാലാവധി നീട്ടികൊടുക്കുന്നതാണ്.

(a) എന്യുമറേറ്റ് ചെയ്തതും മുറിക്കാനുളളതുമായ മരങ്ങൾക്ക് ഓരോ ഹെക്ടറിനും അതിന്റെ ഭാഗത്തിനും ` 750 വീതം.

(b) നീക്കം ചെയ്യാത്ത രജിസ്റ്റർ ചെയ്തതും അല്ലാത്തതുമായ തടികൾക്ക് ഓരോ ക്യൂ. മീറ്ററിനും അതിന്റെ ഭാഗത്തിനും ` 100 വീതം.

(c) നീക്കം ചെയ്യാത്ത വിറകിന് ഓരോ ടണ്ണിനും അതിന്റെ ഭാഗത്തിനും ` 50 വീതം.

ഒന്നാമത്തെ മാസത്തേക്ക് ടി നിരക്കിലും 2-ാം മാസത്തേക്ക് ഇതിന്റെ ഇരട്ടിയും 3-ാം മാസത്തേക്ക് ഒന്നാംമാസത്തെ നിരക്കിന്റെ മൂന്നിരട്ടിയും എന്ന ക്രമത്തിൽ പിഴ ഈടാക്കുന്നതാണ്. ഇപ്രകാരം നീട്ടി നൽകുന്ന തീയതിക്കുളളിലും നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റിലേക്ക് മുതൽകൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ാകുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ചെയ്തു തീർക്കുവാനുളള ജോലികൾ ഡിപ്പാർട്ടുമെന്റ ് ചെയ്യിക്കുന്നതും ആയതിൽ വച്ചു≠ാകുന്ന മുഴുവൻ ചിലവും ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതുമായിരിക്കും.

19. കൂപ്പിൽശേഖരിച്ച് വയ്ക്കുന്ന ഇലവ്, വട്ട തടികളും വിറകും നിലവിലുള്ള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും നീക്കം ചെയ്യാനുള്ള ലൈസൻസ് നൽകുന്നത്.

20. അച്ചൻകോവിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെയോ കല്ലാർ റെയിഞ്ചാഫീസറുടെയോ രേഖാമൂലമുള്ള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ, അയാളുടെ ആളുകളോ കൂപ്പിൽ പ്രവേശിക്കുവാൻ പാടുള്ളൂ.

21. ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാസമയവും കൂപ്പിൽ ഉ≠ായിരിക്കണം. കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിയിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കേ≠തുമാണ്.

22. യാതൊരു കാരണവശാലും πാന്റേഷനിലെയോ റിസർവ്വിലേയോ മറ്റ് മരങ്ങൾക്കും, തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്താൻപാടില്ല. അങ്ങനെ ഉ≠ാകുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദി ആകുന്നതാണ്.

23. കൂപ്പിനുപുറത്ത് ഫോറസ്റ്റ് സ്ഥലത്തും തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടിക്കാരന്റെ ഉത്തരവാദി ത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ അനുവദിക്കുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണങ്ങളാലോ, മോശമായ കാലാവസ്ഥാമൂലമോ ഉടമ്പടി കാലാവധിക്കുള്ളിൽ ഇവ നീക്കംചെയ്തുകൊ≠് പോകാൻ കഴിയാതെവന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്ടറിന് ` 250 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽനിന്നും ഈടാക്കുന്നതായിരിക്കും.

24. കൂപ്പിന് 0.4 കീ.മീറ്റർ (2 ഫർലോംഗ്) ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ അനധികൃത കുറ്റകൃത്യങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്. അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ വിവരം ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥരെ ഉടമ്പടിക്കാരൻ അറിയിക്കേ≠താണ്. ഇതിൽ വീഴ്ച വരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടാവുന്നതാണ്.

25. കരാറുകാരന്റെ സെക്യൂരിറ്റി തുക കാലാവധിക്കുശേഷം കരാറുകാരൻ സെയിൽസ് ടാക്സ്, ഇൻകം ടാക്സ്, അഗ്രിക്കൾച്ചറൽ ഇൻകം ടാക്സ് ഇവയുടെ ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റ് ഹാജരാക്കുന്ന മുറയ്ക്ക് തിരിച്ചുനൽകുന്നതാണ്. എന്നാൽ ടി ഇനത്തിൽ ഗവൺമെന്റിലേക്ക് ബാദ്ധ്യതകൾ വല്ലതുമു≠െങ്കിൽ സെക്യൂരിറ്റി തുകയിൽനിന്നും ഈടാക്കുന്നതാണ്.

The tender forms are not transferable. The earnest money deposit noted against the work should be paid along with the tenders by Demand Draft (Cheque will not be acceptable) pledged in favour of the undersigned payable at any Nationalized Bank/Schedule Bank. Incomplete tenders and tenders without EMD are liable to be rejected. The undersigned reserves the right to reject any tender without assigning any reasons thereof. All other conditions prevailing in the Kerala PWD and Forest Department are applicable to this tender also. The tenders not containing the prescribed preliminary agreement in Stamp Paper worth ` 100 will be summarily rejected. If there is no response to any of the works included in this notification, the same will be again tendered on 11-10-2013 or 17-10-2013 as per the same conditions mentioned above at the same time and venue.

It is hereby notified for the general information of the public that the teak poles/teak firewood/miscellaneous firewood collected by final felling works from 1951 Pandupara Teak Plantation of Kannimangalam Forest station in Kalady Range under this Division will be sold in Tender/Auction sale subject to detailed Tender/Auction sale conditions published in Kerala Gazette No. 29 dated 25-12-2012 in Part III on Pages 456 to 461(Forest Sheet) by the Additional Principal Chief Conservator of Forests (Protection), Thiruvananthapuram vide Notification No. Pro (5)-26274/12 dated 11-12-2012 and other rules in force as per the schedule furnished below. Tender forms will be available in Divisional Forest Office, Malayattor and the Forest Range Office, Kalady on payment of ` 200 plus VAT and tender will be accepted on the date of Tender/Auction sale up to 9 a. m. at the Forest Range Office, Kalady. Tenders received after the stipulated date and time will not be entertained. If the date fixed for tender/Auction happens to be a public holiday, harthal or strike, the auction sale will be held on next working day at the scheduled time and place. Tender will be opened immediately after auction sale and further action will be taken as per sale conditions. The intending bidders should satisfy themselves about the quality and quantity of the materials put up for tender/auction sale will be available from the Range Forest Officer, Kalady on working hours. Quantity notified is only approximate. Teak poles and other materials as mentioned above taken to stock up to a day before the auction will be included in the sale. If there is no bid or part bid in first date of auction proposed, the undisposed materials will be put up for sale in subsequent dates as shown in the schedule at the same time and place. The auctioning officer is empowered to conduct auction completely or partly and postponement of auction without assigning any reason thereof.

The successful bidder/tenderer should remit full bid amount soon after the auction, if the bid amount is less than ` 20,000 (Twenty Thousand only). If the bid amount is more than ` 20,000 (Twenty Thousand), 35% of the bid amount should be remitted on the date of auction itself subject to a minimum amount of ` 20,000 (Twenty Thousand only) and a maximum of ` 1,00,000 (One Lakh only) by cash or DD drawn on a Nationalized Bank. If the 35% of the bid amount exceeds ` 1,00,000 (One Lakh only) balance amount exceeding One Lakh should be remitted within seven working days from the date of auction excluding the date of auction by chalan issued by the Range Forest Officer. Valid post offers if any received will also be entertained as per rules in force.

Competitive sealed tenders are invited by the undersigned on behalf of Governor of Kerala in the prescribed form from eligible contractors registered with Kerala PWD for following civil works in Kuttiady and Peruvannamuzhy Forest Ranges during 2013-14. The tender is fixed to be conducted on 11-9-2013. The tender documents can be purchased from the office of the undersigned during office hours upto 1 p. m. on 11-9-2013. Cost of tender form is non refundable. The tender documents should be properly filled up and should be submitted on or before 2.30 p. m. on 11-9-2013. It should be accompanied by all necessary documents, along with Earnest Money Deposit by way of bankers DD, or fixed deposit or National Saving Certificate or any approved certificate drawn in favour of Divisional Forest Officer, Kozhikode, payable at Kozhikode. The intending tenderers should furnish a preliminary agreement in stamp paper worth ` 100 along with tender for each work. Incomplete tenders, or tenders without necessary documents or tenders not in accordance with tender conditions will not be accepted. Tenders will be opened10th SEPT. 2013] FOREST DEPARTMENT 541 and scrutinized at 3.00 p. m. on the same day in the presence of those tenderers who are present at the time by the Divisional Forest Officer, Kozhikode or an officer authorized by him. The Divisional Forest Officer reserves the right to reject any tender either partly or in full, without assigning any reason thereof. If the tender date happens to be a holiday, or the tender could not be conducted on the notified date, due to any other reasons, the tender will be conducted at the same place and time on the next working day, as per the same conditions as detailed below.

If the tender for all works or any of the works could not be conducted on the said date/dates, tender for such works will be conducted at the above place and time with same conditions on 20-9-2013. If tender could not be conducted even on the date tender for the work will be conducted on 25-9-2013 or else 30-9-2013.

Cost of tender forms in respect of works with Estimate from ` 5000 to ` 50000 shall be ` 300+VAT and in respect of works with Estimate of ` 50,001 to 10 lakhs shall be ` 0.20%+ VAT of the cost of the work rounded to the nearest multiple of 100 subject to a minimum of ` 400+VAT and maximum of ` 1500+VAT in respect of works with estimate of above 10 lakhs shall be ` 0.15% + VAT and maximum of ` 2,500 + VAT. All existing rules, regulations, directions etc. prescribed by Kerala PWD and forest department in respect of civil works shall be applicable for this tender also.

Separate, sealed competitive tenders are invited from the registered PWD contractors for the following works in the Kalpetta Range of South Wayanad Division, Kalpetta. This work was tendered to the PWD contractor Sri Rajan, V., Vellarkkadu House, Myladippara. Kalpetta and executed agreement No. 10/12-13 on 2-11-2012. The work could not started in stipulated time.

Tender forms will be issued from this office on 24-9-2013 upto 1 p. m. and will be received upto 2.30 p. m. on 24-9-2013. The Co-operative societies, rendering the tenders should produce true copies of relevant orders exempting them from remittance of EMD/security along with the tenders if any. Otherwise they will have to remit EMD/security applicable.

Each and every tender should accompany preliminary agreement in stamp paper worth ` 100 (Rupees One hundred only) duly signed by the tenderer. സൗത്ത് വയനാട് ഡിവിഷന്റെ കീഴിലുളള കൽപ്പറ്റ റെയിഞ്ചിലെ താഴെപറയുന്ന പ്രവൃത്തി ഏറ്റെടുത്ത് നടത്തുന്ന തിന് 9-10-2012-ൽ നടന്ന ദർഘാസിൽ ശ്രീ രാജൻ, വി., വെള്ളാർക്കാട് ഹൗസ്, മൈലാടിപ്പാറ, കൽപ്പറ്റ എന്ന പി.ഡബ്യു.ഡി കോൺട്രാക്ടർ ദർഘാസ് സമർപ്പിച്ചിരുന്നു. തുടർന്ന് ദർഘാസ് അംഗീകരിച്ച് നൽകിയ പ്രകാരം 2-11-2012-ൽ 10/12-13 നമ്പരായി കരാർ വയ്ക്കുകയും ചെയ്തിരുന്നു.

സാങ്കേതികമായ കാരണങ്ങളാൽ മേൽ പറഞ്ഞ ദിവസം ദർഘാസ് നടത്തുന്നതിന് സാധിക്കാതെ വരികയോ, ദർഘാസിനുളള അപേക്ഷ വാങ്ങിക്കാതിരിക്കുകയോ ചെയ്താൽ ടി ജോലികൾക്കുളള ദർഘാസുകൾ 26-9-2013-ന് അതേ സമയത്ത് നടത്തുന്നതാണ്.

The tender forms can be purchased from the Office of the undersigned during office hours upto 1 p. m. on all working days till the tender date. Cost of tender form is non refundable. The intending tenderer should apply with proof of identity such as Electoral Identity Card, Driving License, Indian Passport etc. along with the Registration Certificate in original to get the tender form. The tender form should be properly filled up and should be submitted on or before 2 p. m. on the date of tender. It should be accompanied by all necessary documents along with Earnest Money Deposit by way of Bankers DD or fixed deposit or National Savings Certificate pledged in favour of Deputy Conservator of Forests & Wildlife Warden, Wayanad Wildlife Division, Sulthan Bathery payable at Sulthan Bathery. The intending tenderers should also furnish a preliminary agreement in Stamp Paper worth ` 100 along with tender of each work. Incomplete tender or tenders without necessary documents or tenders not in accordance with tender conditions will not be accepted. Tenders will be10th SEPT. 2013] FOREST DEPARTMENT 550 opened by the Deputy Conservator of Forests & Wildlife Warden or an Officer authorized by him at 3.30 p. m. on the same day, in the presence of those tenderers who are present at that time. The Deputy Conservator of Forests & Wildlife Warden reserves the right to reject any tender, either partialy or wholly without assigning any reason thereof. If the tender could not be conducted on the notified date due to any reason, it will be conducted at the same place and time on the next working day as per the same conditions.

If the tender for all work or any of the work could not be conducted on the said date/dates, the tender for such work/works will be conducted at the same place and time with same conditions on 3-10-2013. If the tender could not be conducted on that day also, it will be conducted on 10-10-2013. If it could not be conducted on that day also, it will be conducted on 17-10-2013.
