(This does not form part of the notification, but is intended to indicate the general purpose.)
An extent of 0.2104 Hectares of Ecologically Fragile Land vested in Government under section 3 (1) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Ordinance, 2000 was notified as such vide Notification No. C6-21437/2000 dated 12-7-2001 published in Kerala Gazette No. 36, dated 11-9-2001 as Sl. No. 36 in the schedule. The notified land is lying in two bits. Bit No. 1 in Survey No. 154/6 is having an extent of 36 cents (0.145 ha) and Bit No. 2 in Survey No. 236/10 is having an extent of 16 cents (0.065 ha). The Custodian of Ecologically Fragile Land as per proceedings No. EFL6-523/2008 dated 22-9-2011 under section 19 (3) (b) of the Kerala Forests (Vesting and Management of Ecologically Fragile Lands) Act 2003, has found that 16 cents (0.065 ha) of land in Bit No. 2 in Survey No. 236/10 pt. is not an Ecologically Fragile Land and ordered to exclude the same from the notification. The above notification is intended to achieve above purpose.

It is hereby notified for the information of public that the errors crept in Column Nos.7, 8, 9, 10, 11, 12 and 13 for the land in Sl. No. 90 of the schedule in the Notification No. C4-21437/2000 dated 4-10-2000 published in Kerala Gazette No. 43 dated 31-10-2000 are corrected as shown in the schedule below.

An approximate extent of 15.78 ha of Ecologically Fragile Land vested in Government under section 3 (1) of the Kerala Forest (Vesting & Management of Ecologically Fragile Land) Ordinance 8 of 2000 was notified as such as per Sl. No. 90 in schedule of the Notification No. C4-21437/2000 dated 4-10-2000 published in Kerala Gazette No. 43 dated 31-10-2000. On survey of the said land, actual Ecologically Fragile Land area is found to be only 9.0758 ha, and the boundaries, Survey No. & Village also differ from what has been notified as above. Correct details have to be notified for the information of the public.
Erratum notification is intended to achieve said purpose.

തിരുവനന്തപുരം ഫോറസ്റ്റ് ഡിവിഷന്റെ കീഴിലുള്ള താഴെപ്പറയുന്ന റെയിഞ്ചുകളിലെ വിവിധ ഫോറസ്റ്റു കേസുകളിൽപ്പെട്ട തൊ≠ി തടികൾ, വിറക്, കരി, യന്ത്ര സാമഗ്രികൾ മുതലായവ 2014 വർഷത്തിലെ മാർച്ച് മാസം മുതൽ ഓരോ മാസവും താഴെ കൊടുത്തിരിക്കുന്ന പട്ടികയിൽ അതാതു റെയിഞ്ചിൽ അതിനു നേരേ കാണിച്ചിരിക്കുന്ന തീയതികളിൽ പകൽ 11 മണിക്ക് തിരുവനന്തപുരം ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസറോ അദ്ദേഹം അധികാര പ്പെടുത്തുന്ന മറ്റ് ഉദ്യോഗസ്ഥനോ 16-11-1988-ലെ സർക്കാർ ഉത്തരവ് (എം.എസ്.)100/88/വനം, 4-3-1999-ലെ സർക്കാർ ഉത്തരവ് (എം.എസ്.) 18/99/വനം എന്നീ ഉത്തരവുകൾ, നിലവിലുള്ള മറ്റ് നിയമങ്ങൾ എന്നിവ പ്രകാരം പരസ്യമായി ലേലം ചെയ്തു വിൽക്കുന്നതാണ്. നിർദ്ദിഷ്ട ദിവസം പൊതു അവധിയായി പ്രഖ്യാപിക്കുന്നപക്ഷം അടുത്ത പ്രവർത്തി ദിവസം നി›ിത സമയത്തും സ്ഥലത്തും വച്ച് ലേലം നടത്തു ന്നതായിരിക്കും.
ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ ലേല സമയത്തിനുമുമ്പായി ഈട്ടി/തേക്ക് തടികൾക്ക് ` 20,000, മറ്റു തടികൾക്ക് ` 10,000, മറ്റു വനവിഭവങ്ങൾക്ക് ` 2,000 എന്ന ക്രമത്തിൽ നിരതദ്രവ്യം കെട്ടിവയ്ക്കേ≠താണ്. ലേലത്തിൽ വിളിച്ചിട്ടുള്ള തൊ≠ി സാധനങ്ങളുടെ വില ഇരുപതിനായിരം രൂപയിൽ കവിയുന്നപക്ഷം ലേലത്തുകയുടെ 35 ശതമാനം അല്ലെങ്കിൽ ` 20,000 ഇതിൽ ഏതാണ് കൂടുതൽ ആയതു അന്ന് ലേലം കഴിഞ്ഞാലുടൻ കെട്ടിവെയ്ക്കേ≠താണ്. എന്നാൽ കോടതി ഉത്തരവനുസരിച്ച് കേസ് നിലവിലിരിക്കേ ലേലം ചെയ്യപ്പെടുന്ന തൊ≠ിവസ്തുക്കളുടെ മൊത്തം വില ലേലദിവസം തന്നെ ഒടുക്കേ≠താണ്.
ലേലം സ്ഥിരപ്പെടുത്തിയ വിവരം ലേലക്കാരനെ അറിയിക്കുന്ന നോട്ടീസിന്റെ തീയതി മുതൽ 60 ദിവസത്തിനകം ബാക്കി ലേലത്തുകയും നിയമാനുസൃത നികുതികളും മൊത്ത സംഖ്യയ്ക്ക് നിലവിൽ പ്രാബല്യത്തിലുള്ള ഫൈനാൻസ് ആക്ട് പ്രകാരമുള്ള ആദായ നികുതിയും ഒടുക്കി ലേലത്തിൽ പിടിച്ചിട്ടുള്ള സാധനങ്ങൾ നീക്കം ചെയ്യേ≠താണ്. ലേലത്തുക ഈ കാലാവധിക്കുള്ളിൽ അടയ്ക്കാതിരുന്നാൽ ലേലം റദ്ദു ചെയ്യുന്നതും ലേലക്കാരൻ അടച്ചിട്ടുള്ള തുക സർക്കാരിലേക്ക് മുതൽ കൂട്ടുന്നതും ടി ലേലത്തിൽ പിടിച്ച സാധനങ്ങൾ ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ വീ≠ും ലേലം ചെയ്തു വിൽക്കുമ്പോൾ സർക്കാരിന് നഷ്ടം ഉ≠ാവുകയാണെങ്കിൽ അപ്രകാരമുള്ള നഷ്ടം, പരസ്യക്കൂലി മുതലായവ വ്യവസ്ഥയ്ക്ക് വിധേയമായി മുൻ ലേലക്കാരനിൽനിന്നും ഈടാക്കുന്നതും ലാഭമു≠ാവുകയാണെങ്കിൽ ആയതിനു മുൻ ലേലക്കാരന് യാതൊരു അവകാശവും ഇല്ലാത്തതും ആകുന്നു.
ലേലത്തിൽ പങ്കുകൊള്ളാൻ ഉദ്ദേശിക്കുന്നവർ ലേലം തുടങ്ങുന്നതിനുമുമ്പായി ലേലത്തിനു വച്ചിട്ടുള്ള സാധനങ്ങളുടെ നൽപ്പു നിൽപ്പു സ്ഥിതിയും അളവുകളും മറ്റു വിശദ വിവരങ്ങളും ബോദ്ധ്യപ്പെട്ടിരിക്കേ≠തും, ലേലത്തിനുശേഷം ഈ വക കാര്യങ്ങളെക്കുറിച്ചുള്ള യാതൊരു പരാതികളും പരിഗണിക്കുന്നതല്ലാത്തതുമാകുന്നു. ലേലത്തിനുശേഷം കാലാവസ്ഥ കാരണമോ, അ·ി, വെള്ളപ്പൊക്കം, ഉരുൾപൊട്ടൽ മുതലായ കെടുതികൾ മൂലമോ, തടി, വിറക്, മറ്റ് സാധനങ്ങൾ എന്നിവയ്ക്കു≠ാകുന്ന നഷ്ടത്തിനോ അളവു വ്യത്യാസത്തിനോ, വനം വകുപ്പിനു ഉത്തരവാദിത്വം ഉ≠ായിരിക്കുന്നതല്ല.
ലേലവ്യവസ്ഥകളിൽ എന്തെങ്കിലും മാറ്റങ്ങളോ കൂട്ടിച്ചേർക്കലുകളോ ആവശ്യമായി വരുന്നപക്ഷം ആയതു ലേലത്തിൽ പങ്കെടുക്കുന്നവരെ വായിച്ചു കേൾപ്പിച്ച് ബോധ്യപ്പെടുത്തുന്നതായിരിക്കും.

(5)-26274/12-ാം നമ്പരായി പ്രസിദ്ധീകരിച്ചിട്ടുള്ള ഡിപ്പോ ലേല വ്യവസ്ഥകൾക്കും കൂടാതെ താഴെ പറയുന്ന ലേല വ്യവസ്ഥകൾക്കും നിബന്ധനകൾക്കും വിധേയമായി ദർഘാസ്/ലേലത്തിൽ പരസ്യമായി വിൽക്കുന്നതാണ്. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കാൻ ആഗ്രഹിക്കുന്ന വ്യ‡ികൾ ദർഘാസിന് മുമ്പ് ` 10,000 വീതം നിരതദ്രവ്യം കെട്ടി വയ്ക്കേ≠താണ്. വിജയിക്കുന്ന ദർഘാസുകാരൻ/ലേലക്കാരൻ ദർഘാസ്/ലേലത്തുകയുടെ 35 ശതമാനം തുക ദർഘാസ്/ലേലദിവസം തന്നെ കെട്ടിവയ്ക്കേ≠താണ്. വിജയിയായ ദർഘാസുകാരൻ/ ലേലക്കാരൻ നിയമപ്രകാരവും കാലാകാലങ്ങളിൽ നിലവിലുള്ളതുമായ വാറ്റ്, വനവികസന നികുതി, വരുമാന നികുതി, മറ്റ് ബന്ധപ്പെട്ട നികുതികൾ എന്നിവ യഥാസമയം ഒടുക്കേ≠താണ്.
1. ദർഘാസ്/ലേല ദിവസം പൊതു അവധിയായി വന്നാലോ മറ്റേതെങ്കിലും കാരണത്താലോ ദർഘാസ്/ ലേലം നടത്താൻ കഴിയാതെ വന്നാൽ ടി ദർഘാസ്/ ലേലം അടുത്ത പ്രവൃത്തിദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും വച്ച് നടത്തുന്നതായിരിക്കും.
2. ടെ≠ർ/ലേലം ഒരു നി›ിത തുകയുടെ അടിസ്ഥാന ത്തിലാണ് നി›യിച്ചിരിക്കുന്നത്. ഇതിലേക്കായി സർവ്വേ ചെയ്ത് തിരിച്ചിട്ടുള്ള തോട്ടത്തിലെ മാർക്ക് ചെയ്ത നിൽപ്പ് മരങ്ങളുടെ നീക്കം ചെയ്യൽ സംബന്ധിച്ച ജോലിക്കുവേ≠ിയാണ് ഇത് തീരുമാനിച്ചി രിക്കുന്നത്.
3. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലത്തിന് മുമ്പായി ഉൽപ്പന്നങ്ങളുടെ നൽപ്പ് നിൽപ്പ് ക≠് ബോധ്യപ്പെടേ≠തും അവ സംബന്ധിച്ച യാതൊരു പരാതികളും ലേലത്തിനുശേഷം പരിഗണി ക്കുന്നതല്ലാത്തതുമാണ്.
4. ദർഘാസുകാരൻ/ലേലക്കാരൻ നേരിട്ട് ദർഘാസ്/ ലേലത്തിൽ പങ്കെടുക്കേ≠താണ്. നിയമപരമായ പവർ ഓഫ് അറ്റോർണി ഇല്ലാത്ത പകരക്കാരെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല.
5. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ വിലാസവും കൈയൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽ നിന്നും വാങ്ങിയ സർട്ടിഫിക്കറ്റ് നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാക്കേ≠താണ്.
6. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ, ആഫീസ് ജീവനക്കാരുമായോ, ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസ്/ലേലദിവസം ദർഘാസുകാരൻ/ ലേലക്കാരൻ ഈ ആഫീസിൽ സമർപ്പിക്കേ≠താണ്. ഇത്തരത്തിൽ ദർഘാസുകാരന്/ലേലക്കാരന് ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ, ജീവനക്കാരുമായോ ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്ക പ്പെട്ടാൽ ടിയാന്റെ പേരിലുള്ള ദർഘാസ്/ലേലം റദ്ദ് ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പ് പുനർലേലം ചെയ്യുന്നതാണ്.
7. ദർഘാസ്/ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുള്ള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരു ലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽ 20 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും മാത്രമേ പരിഗണിക്കുകയുള്ളൂ. കൂടാതെ താഴെ പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമാണ്.
(എ) ദർഘാസ്/ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.
(ബി) പോസ്റ്റ് ഓഫറുകാരൻ യഥാർ∞ ദർഘാസ്/ ലേലക്കാരൻ ഒടുക്കിയ തുകയുടെ ഇരട്ടി തുക പോസ്റ്റ് ഓഫറിനോടൊപ്പം സെക്യൂരിറ്റി തുകയായി അടയ്ക്കേ≠താണ്.

22. പ്രസ്തുത ജോലി നിർവ്വഹണത്തിനിടയിൽ സർക്കാർ മുതലുകൾക്കോ, സ്വകാര്യ വ്യ‡ികളുടെ മുതലു കൾക്കോ ഉ≠ാകുന്ന നാശനഷ്ടത്തിനും, കരാറുകാരന്റെ ജോലിക്കാർ, പൊതു ജനങ്ങൾ എന്നിവർക്ക് സംഭവി ക്കാവുന്ന അപകടം, മരണം എന്നിവയ്ക്കും കരാറു കാരൻ മാത്രം ഉത്തരവാദിയായിരിക്കുന്നതാണ്.
23. കൂപ്പിന് പുറത്ത് സർക്കാർ വക സ്ഥലത്ത് തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടി ക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ അസിസ്റ്റന്റ ് ഫോറസ്റ്റ് കൺസർവേറ്റർ അനുവാദം നൽകുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണങ്ങളാലോ മോശമായ കാലാവസ്ഥ മൂലമോ ഉടമ്പടി കാലാവധിക്കുള്ളിൽ അവ നീക്കം ചെയ്തുകൊ≠ുപോകാൻ കഴിയാതെ വന്നാൽ തറ വാടക ഇനത്തിൽ ഹെക്ടറിന് ` 250 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽനിന്നും ഈടാക്കുന്നതായിരിക്കും.

It is hereby notified for the information of the public that the right of collection and removal of standing Acacia trees in 1988 Rajagiri Medicinal Plantation in Social Forestry Range, Kollam of this Division as specified in the schedule appended below will be sold in Tender-Cum-Auction by the Assistant Conservator of Forests, Kollam or any other officer authorized by him on 2-4-2014 at 3 p.m. in the Social Forestry Division, Kollam on outright sale basis subject to the terms and conditions of sale of timber in Government Timber Depots published in Government Gazette No. 29 dated 25-12-2012 Page Nos. 456 to 461 of Forest sheet, as per Pro. (5) 26274/12 dated 11-12-2012 of the Additional Principal Chief Conservator of Forests (Protection), Thiruvananthapuram and as per general conditions of the sale of tree growth prevailing in the Department. In case the notified date happens to be a public holiday the tender/ auction will be conducted on the next working day at the notified place and time.
2. The auction will be on lump sum basis for the right of collection and removal of entire enumerated Acacia trees growth from the above Medicinal Plantation mentioned in the schedule here to the area of which has been surveyed and demarcated on the ground.
3. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before participating in the Tender/ Auction. Complaints if any regarding quality, quantity etc. received after the Tender/Auction will not be enertained.

7. No petition or post offer received after seven days of the conduct of the tender/auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is one lakh and above, and more than 20% where the original bid amount is less than one lakh will ordinarily be considered. The post offerer will comply with following terms.
(a) Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.
(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender/Auction date as security deposit.
(c) The remittance should be made by the Chalan or Bank Deposit and the Bank receipt should be produced before the Assistant Conservator of Forests concerned within seven days from the date of receipt of the registered notice to that effect. If the post offerer satisfied with the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules. In the re-auction, if the price fetched does not come up to what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.
8. Further particulars can be had either from the Office of the Assistant Conservator of Forests, Social Forestry, Kollam or the Range Forest Officer, Social Forestry, Kollam during working hours.
9. Intending tenderers/bidders should deposit Earnest Money Deposit ` 10,000 before tender/auction.
10. The successful tenderers/bidders have to remit 35% of sale value on the tender/auction date. If the 35% value exceeds ` 1,00,000 the tenderer/bidder should remit ` 1,00,000 on the auction date itself and the difference have to be remitted in the District Treasury, Kollam within 7 working days through the countersigned chalan issued from this office. If he fails to remit this amount, within the specified time, the EMD will be forfeited to Government and the coupe will be re-auctioned at his risk and loss.
11. If the value fetched in the re-sale/re-tender is less than that obtained in the original tender/sale the difference between them together with all incidental expenditure fixing up the re-sale including notification charges as assessed by the Assistant Conservator of Forests will be recovered from the defaulting Tenderers/Bidders through legal means including Revenue Recovery Act in force.
12. The participating Tenderers/Bidders have right only for collection and removal of enumerated standing trees and has no right for removing any other trees including Teak, Rose wood etc.
13. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax etc., at the rates prevailing from time to time.
14. The successful Tenderers/Bidders should execute a bounden agreement on Stamp Paper worth ` 100 after the completion of the Tender/Auction.
15. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation, the successful Tenderers/Bidders shall remit 3rd of the balance sale value, VAT and 5% Forest Development Tax, Income Tax etc. at the rate in force and security deposit at 10% of the total sale value. The successful Tenderers/Bidders should execute an agreement on Stamp Paper worth ` 100. In case of failure to remit the amount within 15 days, extension shall be granted by the Assistant Conservator of Forests for 7 days subject to realization of 12% penal interest. Further extension for 7 days shall be granted by the Assistant Conservator of Forests subject to the realization of 24% penal interest. In case of failure to remit the amount within the extended period further extension for 8 days by the Chief Conservator of Forests, Social Forestry, Southern Region, Kollam and 8 days by the Principal Chief Conservator of Forests, Social Forestry shall be granted subject to realization of penal interest at 24% and 48% respectively. But all the extension periods mentioned above will be within the original contract period.
16. The balance q sale value should be remitted in two equal instalments by the successful Tenderers/ Bidders. The first instalment should be remitted within 7 days from the date of agreement and the second instalment within 15 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers/Bidders fail18th MARCH 2014] FOREST DEPARTMENT 236 to remit the above amount within the period mentioned above extension for 7 days by realizing penal interest at 12% by Assistant Conservator of Forests concerned, extension for 8 days by realizing penal interest at 24% by the Chief Conservator of Forests, Social Forestry, Southern Region, Kollam concerned and further extension for 8 days by the Principal Chief Conservator of Forests, Social Forestry concerned by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will be within the original contract period.
17. No extension of period of contract shall ordinarily be granted. Under very special circumstances, for good and sufficient reasons, the Assistant Conservator of Forests and the Chief Conservator of Forests, Social Forestry, Southern Region, Kollam concerned may grant extension of time for one month and two months respectively on realization of penalty or penalties for completion of each work for each month mentioned below:
(a) For enumerated trees and balance un-felled per hectare or fraction thereof ` 750 per hectare.
(b) Unremoved registered logs and unregistered logs ` 100/-m3 or fraction thereof.
(c) Un removed firewood ` 50/MT or fraction thereof.
20. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 meters and keep the cairns intact.
21. The contractor will be liable for any damage or loss caused to other trees in the plantation or Government buildings nearby.
22. The contractor alone will be responsible for any damage/loss caused to public or private properties, injury/death caused to his workmen or general public during the course of the work carrried out by him as per the contract.
23. The Assistant Conservator of Forests will give permission to keep the timber and other produce outside the coupe if requested by the contractor at his risk. But if the collected timber/firewood are not removed within the agreement period due to unforeseen situation/climate, a ground rent @ ` 250/Ha will be recovered from the contractor.
24. The contractor will be liable for all the illegal activities occurred within 0.4 km. perimeter of the coupe. Any such activities noticed will be reported to the forest officials by the contractor, failing which the contract is liable to be cancelled.
25. The security deposit will be refunded only after the successful completion of contract after producing the clearance certificates of VAT, Income Tax etc. If there are any liabilities outstanding in this respect to the Government that will be adjusted from the security deposit of the contractor.
26. All common conditions regarding sale coupe are also applicable to this Tender/Auction.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during the original contract period. The penalty for the first month shall be realized at the above rates; double the rate for the second month and three times of the original rate for the third month shall be realized. Timber, Teak & Miscellaneous firewood available at Perumbathur and Edacode Dumping Depots under Nilambur and Edavanna Ranges as mentioned in the Schedule below will be conducted on the dates noted against each by the Divisional Forest Officer, Nilambur North Division or any other officer authorised by him subject to the sale conditions published by the Additional Principal Chief Conservator of Forests, Thiruvananthapuram vide Number Pro. (5)- 26274/2012 dated 22-11-2013 in Kerala Gazette No. 49, dated 10-12-2013. The auction sale is subject to the sale conditions published by Government from time to time. If the date of auction happens to be a public holiday or if the sale is not conducted due to some other reasons the sale will be conducted on the next working day at the same place and time. 1. ബന്ധപ്പെട്ട വാഹനം തൽനിൽപ്പു സ്ഥിതിയിലാണ് യുന്നതിന് ബന്ധപ്പെട്ട വില്ലേജ് ഓഫീസർ നൽകിയ സർട്ടിഫിക്കറ്റ് തിരഞ്ഞെടുപ്പ് കമ്മീഷൻ നൽകിയ തിരിച്ചറിയൽ കാർഡ് ഇന്ത്യൻ പാസ്സ്പോർട്ട് അല്ലെങ്കിൽ മറ്റ് നിയമാനുസൃതമായ തിരിച്ചറിയൽ രേഖ എന്നിവയിൽ ഏതെങ്കിലുമൊന്ന് ഹാജരാക്കേ≠താണ്.
3. ലേലത്തിന് മുമ്പ് പൂരിപ്പിച്ച ദർഘാസ് ഫോറം സമർപ്പി ക്കുന്നതോടൊപ്പം നിരതദ്രവ്യം കെട്ടിവയ്ക്കേ≠താണ്.
നി›ിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ദർഘാസുകൾ സ്വീകരിക്കുന്നതല്ല.
4. ദർഘാസ് സമർപ്പിക്കുന്നവർക്ക് മാത്രമേ ലേലത്തിൽ പങ്കെടുക്കാൻ അർഹതയുള്ളൂ. ദർഘാസുകൾ സ്വീകരിച്ച ശേഷം ദർഘാസുകാരിൽ സ്ഥലത്തുള്ളവരെ മാത്രം ഉൾപ്പെടുത്തി ലേലം നടത്തുന്നതിനും അതിനുശേഷം ദർഘാസുകൾ തുറക്കുന്നതുമായിരിക്കും. ലേല/ദർഘാ സുകൾ കൂടുതൽ തുക വാഗ്ദാനം ചെയ്യുന്നവരുടെ പേരിൽ ദർഘാസ്/ലേല തുക തൃപ്തികരമാണെങ്കിൽ താൽകാലികമായി ഉറപ്പിച്ച് അംഗീകാരത്തിനായി മേലധികാരികൾക്ക് ശുപാർശ ചെയ്യുന്നതാണ്. സ്വീകരി ക്കാത്ത മറ്റ് ദർഘാസുകാരുടെ നിരതദ്രവ്യം അന്നേ ദിവസം തന്നെ ലേല നടപടികൾക്കുശേഷം തിരികെ നൽകുന്നതുമാണ്.
5. കൂടുതൽ തുകയ്ക്കുള്ള ദർഘാസുകൾ അംഗീകാരത്തി നായി മേലധികാരികൾക്ക് അയയ്ക്കുന്നതും മറ്റുള്ളവ നിരസിക്കുന്നതും അത്തരം ദർഘാസുകാർ നൽകിയ നിരതദ്രവ്യം ലേലത്തിനുശേഷം തിരികെ നൽകുന്ന തുമാണ്.
6. ഉയർന്ന ദർഘാസ് സംഖ്യ നിരതദ്രവ്യ സംഖ്യയേക്കാൾ കൂടുതലാണെങ്കിൽ ദർഘാസ്/ലേല സംഖ്യയുടെ 50% (നിരതദ്രവ്യം ഉൾപ്പെടെ) അപ്പോൾതന്നെ അടയ്ക്കേ≠താണ്.
7. ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനും നിരാകരിക്കുന്നതിനു മുള്ള പൂർണ്ണ അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമായിരിക്കും.
8. ദർഘാസുകൾ അംഗീകരിച്ചതായി അറിയിപ്പ് കിട്ടി 15 ദിവസത്തിനകം ബാക്കി ലേല സംഖ്യയും നിയമപ്രകാരമുള്ള നികുതിയും അടച്ച് വാഹനം നീക്കം ചെയ്യേ≠താണ്.
വിൽപ്പന നടത്തുന്നത്. വാഹനങ്ങളുടെ ഗുണ നിലവാരം
ലേലത്തിനു മുമ്പ് പരിശോധിച്ച് ബോദ്ധ്യപ്പെടേ≠താണ്.
9. മേൽപ്പറഞ്ഞ 15 ദിവസത്തിനകം ബാക്കി സംഖ്യയും വാഹനം അധികൃതരുടെ അനുവാദത്തോടെ എല്ലാ പ്രവൃത്തി ദിവസങ്ങളിലും പരിശോധിക്കാവുന്നതാണ്.
നികുതിയും അടച്ച് വാഹനം നീക്കം ചെയ്യാത്തപക്ഷം മറ്റൊരു 15 ദിവസം കൂടി ബാക്കി സംഖ്യയ്ക്ക് 12% ദർഘാസ്/ലേലത്തിന് ശേഷം വാഹനത്തിന്റെ പലിശയും ദിവസത്തിൽ 20% നിരക്കിൽ തറവാടകയും ഗുണ നിലവാരത്തെ സംബന്ധിച്ച യാതൊരുവിധ പരാതിയും സ്വീകരിക്കുന്നതല്ല.
വസൂലാക്കി സമയം അനുവദിക്കുന്നതായിരിക്കും.
അതിനുശേഷം അവധി അനുവദിക്കുന്നതല്ല.
18th MARCH 2014] FOREST DEPARTMENT 242അപ്രകാരം സമയപരിധിക്കുള്ളിൽ നീക്കം ചെയ്യാത്ത വാഹനം വീഴ്ചവരുത്തിയ ദർഘാസുകാരുടെ/ ലേലക്കാരുടെ നഷ്ടോത്തരവാദിത്വത്തിൽ ഇതേ ദർഘാസ്/ലേല വ്യവസ്ഥകൾക്ക് വിധേയമായി വീ≠ും ദർഘാസ്/ലേലം നടത്തി വിൽക്കുന്നതായിരിക്കും.
10. ദർഘാസ് സംബന്ധിച്ച് ഫോറസ്റ്റ് ഡിപ്പാർട്ടുമെന്റിൽ നിലവിലുള്ള പൊതു നിയമങ്ങളും മറ്റു നിബന്ധനകളും ഈ ദർഘാസ്/ലേലത്തിനും ബാധകമായിരിക്കും.
ദർഘാസ്/ലേലം സ്വീകരിക്കുന്നതിനോ നിരാകരിക്കുന്ന (ഇ) സാധാരണ ദർഘാസ്/ലേലക്കാർ പാലിക്കേ≠ മറ്റെല്ലാ നിബന്ധനകളും പോസ്റ്റ് ഓഫറിൽ പാലിക്കേ≠താണ്.

ദർഘാസ്/ലേലത്തിനുശേഷം 3 ദിവസത്തിനകം കോഴിക്കോട് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽ ലഭിക്കുന്ന രേഖാമൂലമുള്ള ദർഘാസ്/ലേലാനന്തര വാഗ്ദാനങ്ങൾ (പോസ്റ്റ് ഓഫറുകൾ) താഴെ പറയുന്ന വ്യവസ്ഥകൾക്ക് വിധേയമായി സ്വീകരിക്കുന്നതാണ്.
(എ) ദർഘാസ്/ലേലത്തിൽ വാഗ്ദാനം ചെയ്തിട്ടുള്ള തുക ഒരു ലക്ഷത്തിൽ അധികമാണെങ്കിൽ 10 ശതമാനത്തിലും ഒരു ലക്ഷമോ അതിൽ താഴെയോ ആണെങ്കിൽ 20 ശതമാനത്തിലും കൂടുതലായുള്ളതായ വാഗ്ദാനങ്ങൾ മാത്രമേ സ്വീകരിക്കുകയുള്ളു.
(ബി) പോസ്റ്റ് ഓഫർ പ്രകാരം വാഗ്ദാനം ചെയ്യപ്പെടുന്ന മുഴുവൻ തുകയും ഡിമാന്റ ് ഡ്രാഫ്റ്റായി കോഴിക്കോട് ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെ പേരിൽ മാറത്തക്കവിധം ഹാജരാക്കുന്ന ഓഫറുകൾ മാത്രമേ പരിഗണിക്കുകയുള്ളു.
(സി) ഇതിലേക്കായി അന്നേദിവസം പ്രത്യേകം ഉടമ്പടി വയ്ക്കേ≠തുമാണ്.
(ഡി) മേൽപ്പറഞ്ഞ വ്യവസ്ഥകൾക്ക് അനുസൃതമായി പോസ്റ്റ് ഓഫർ സമർപ്പിക്കുന്ന വ്യ‡ിയുടെ അടച്ച തുക മുഴുവൻ സെക്യൂരിറ്റി ഡിപ്പോസിറ്റായി സൂക്ഷിച്ചുകൊ≠് പൊതു ദർഘാസും ലേലവും വീ≠ും നടത്തുന്നതാണ്.
പ്രസ്തുത ദർഘാസ്/ലേലത്തിൽ ലഭിക്കുന്ന ഏറ്റവും കൂടിയ തുക പോസ്റ്റ് ഓഫർ തുകയേക്കാൾ കുറവാണെ ങ്കിൽ പോസ്റ്റ് ഓഫറിൽ വാഗ്ദാനം നൽകപ്പെട്ടിട്ടുള്ള ഡിമാന്റ ് ഡ്രാഫ്റ്റ് പ്രകാരം അടച്ചിട്ടുള്ള മുഴുവൻ തുകയും ദർഘാസ്/ലേല വിലയിലേക്ക് വകയിരുത്തുന്ന താണ്. എന്നാൽ ദർഘാസ്/ലേലത്തിൽ കിട്ടുന്ന തുക യാണ് കൂടുതലെങ്കിൽ അപ്രകാരം ഉയർന്ന വില വാഗ്ദാനം ചെയ്യുന്ന ലേലക്കാരന്റെ പേരിൽ ദർഘാസ്/ ലേലം സ്ഥിരപ്പെടുത്തുന്നതും പോസ്റ്റ് ഓഫർ സമർപ്പിച്ചിട്ടുള്ള ആൾ അടച്ചിട്ടുള്ള മൊത്തം തുകയും മടക്കി കൊടക്കുന്നതുമാണ്.
