DENOTIFICATION

The Land described in the schedule below is hereby denotified from the Ecologically Fragile Land.

Explanatory Note

(This does not form part of the notification, but is intended to indicate the general purpose) As extend of 8.0900 Ha. of land in Sy. No. 1960/Pt. of Palakkayam Village of of Anamooly locality of Mannarkkad Forest Range in Mannarkkad Taluk, Mannarkkad Forest Division in Palakkad District was notified as Ecologically Fragile Lands under Section 3(1) of Kerala Forest (Vesting and Management of EFL) Ordinance-2000 as per Notification No. C4-22437/2000 dated 20-10-2000, published in Kerala Gazette No. 1, Volume 46 dated 2-1-2001 as Sl. No. 18.

Following the procedure prescribed under Section 19(3)(b) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Act, 2003, the Custodian (Ecologically Fragile Lands) and Additional Principal Chief Conservator of Forests (WP & R) as per Order No. EFL-7-6928/05 dated 19-3-2014 has ordered to exclude the land having an extent of 3.5940 Ha. in Bit No. 3, which is having rubber plants and "Mucuna" from the purview of the Ecologically Fragile Lands.

Above notification is published to achieve the said purpose.

മറയൂർ ചന്ദന ഡിവിഷനിൽ മറയൂർ റെയിഞ്ചിൽ സർക്കാർ വക ചന്ദന ഡിപ്പോയിൽ ചെത്തിമിനുക്കി സൂക്ഷിച്ചിട്ടുള്ളതും താഴെ പട്ടികയിൽ വിവരിക്കുന്നതുമായ ചന്ദനത്തടികൾ (ബില്ലറ്റുകൾ, വേരുകൾ, ചീളുകൾ), ചന്ദന അറക്കപൊടി, ചന്ദനവെള്ള എന്നിവ 2014 ആഗസ്റ്റ്് മാസം 7-ാം തീയതി വ്യാഴാഴ്ച പകൽ 10 മണിക്ക് മറയൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസറോ അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന മറ്റേതെങ്കിലും ഉദ്യോഗസ്ഥനോ മറയൂർ സർക്കാർ ചന്ദന ഡിപ്പോയിൽ വെച്ച് (മൂന്നാർ-ഉടുമൽ പേട്ട് റോഡിൽ മൂന്നാറിൽ നിന്ന് 42 കിലോമീറ്റർ വടക്കു കിഴക്ക് ദിശയിലും, ഉടുമൽ പേട്ടയിൽ നിന്ന് 45 കിലോമീറ്റർ തെക്ക് പടിഞ്ഞാറ് ദിശയിലും മറയൂർ സ്ഥിതി ചെയ്യുന്നു.) കൊല്ലം റീജിയണൽ അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെയും, കോട്ടയം ഹൈറേഞ്ച് സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെയും സാന്നിദ്ധ്യത്തിൽ ഈ ചന്ദന നോട്ടിഫിക്കേഷൻ പ്രകാരമുള്ള പൊതു ദർഘാസ്/ലേല നിബന്ധനകളും, 22-12-2009-ലെ 50-ാമത് കേരള ഗസറ്റിൽ പ്രസിദ്ധീ കരിച്ചിട്ടുള്ള ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (സംരക്ഷണം), തിരുവനന്തപുരത്തിന്റെ 2-12-2009-ലെ പ്രൊ-(5)-6835/2009-ാം നമ്പർ നോട്ടിഫിക്കേഷൻ പ്രകാരമുള്ള പൊതുദർഘാസ്/ലേല നിബന്ധനകളും 14-10-2008-ലെ 41-ാമത് കേരള ഗസറ്റിൽ പ്രസിദ്ധീ കരിച്ചിട്ടുള്ള മറയൂർ സാന്റൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസറുടെ എം. ഡി. ഇ. 3991/2007 അംഗീകൃത നോട്ടിഫിക്കേഷൻ തീയതി 17-9-2008 പ്രകാരമുള്ള ചന്ദന ദർഘാസ്/ലേല നിബന്ധനകളും പ്രകാരം പരസ്യമായി ദർഘാസ്/ലേലം ചെയ്തു വിൽക്കു ന്നതാണ്. ടി ദർഘാസ്/ലേലദിവസം ഏതെങ്കിലും കാരണവശാൽ ദർഘാസ്/ലേലം നടത്താൻ കഴിയാതെ വന്നാൽ തൊട്ടടുത്ത പ്രവർത്തി ദിവസം നി›ിത സ്ഥലത്തും സമയത്തും വെച്ച് ദർഘാസ്/ലേലം നടത്തുന്നതായിരിക്കും. ദർഘാസിന് ആവശ്യമായ ഫോറങ്ങൾ `300 സർക്കാർ അതത് കാലങ്ങളിൽ നി›യിക്കുന്ന വിൽപന നികുതിയും അടച്ച് മറയൂർ ഫോറസ്റ്റ് റെയിഞ്ചാ ഫീസിൽ നിന്നും ദർഘാസ്/ലേല തീയതിക്ക് ഒരാഴ്ച മുൻപ് മുതൽ ലേല തീയതി രാവിലെ 8 മണിവരെ ലഭ്യമാണ്. ദർഘാസ്/ ലേല ദിവസം രാവിലെ 9 മണിവരെ മറയൂർ റെയ്ഞ്ചാഫീസിൽ ദർഘാസുകൾ സ്വീകരിക്കുന്നതാണ്. നിശ്ചിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ദർഘാസ് ഫോറങ്ങളും, അപൂർണ്ണവും ന്യൂനതയുള്ളതുമായ ദർഘാസ് ഫോറങ്ങളും നിരാകരിക്കുന്ന താണ്. ദർഘാസ് സമർപ്പിക്കുന്ന ആൾ ദർഘാസ് ഫോറങ്ങളിൽ അവർ വാങ്ങാനുദ്ദേശിക്കുന്ന ലോട്ട് നമ്പരുകളും നിരക്കുകളും വ്യ‡മായി രേഖപ്പെടുത്തി ഒപ്പിടേ≠താണ്.

ദർഘാസ്/ലേലത്തിൽ വിജയികളാകുന്നവർ വിലയ്ക്കു വാങ്ങുന്ന ചന്ദനം എങ്ങോട്ട് കൊ≠ുപോകുന്നു, എന്താവശ്യത്തിന് കൊ≠ുപോകുന്നു എന്നത് കണക്കിലെടുക്കാതെ സർക്കാർ നി›യിക്കുന്ന മൂല്യ വർദ്ധിത നികുതി കൂടി അടയ്ക്കാൻ ബാദ്ധ്യസ്ഥരാണ്. നിയമാനുസൃതമായ വാറ്റ്, ഇൻകം ടാക്സ് എന്നിവ ചെലാൻ ലഭിക്കുന്ന മുറയ്ക്ക് ദേവികുളം സബ് ട്രഷറിയിൽ ഒടുക്കി പകർപ്പ് മറയൂർ ഫോറസ്റ്റ് റെയിഞ്ചാഫീസർ മുമ്പാകെ ഹാജരാക്കേ≠താണ്.

The following quantities of cleaned sandalwood (billets, roots and chips), sandal saw dust and sandal sapwood billets, stacked and stored at Government Sandal Depot godown in Marayoor Range will be offered for sale by tender- cum-auction at 10 a. m. on 7th August 2014 at the Government Sandal Depot, Marayoor (Marayoor is situated at Munnar-Udumalpet road 42 Kms North East of Munnar and 45 Kms South West of Udumalpet) by the Divisional Forest Officer, Sandal Forest Division, Marayoor or any other officer authorized for the purpose in the presence of Addl. Principal Chief Conservator of Forests, Regional South, Kollam and the Chief Conservator of Forests, High Range Circle, Kottayam as per sale conditions notified in the tender-cum-auction notification, the general sale conditions published in Kerala Gazette No. 50 dated 22-12-2009 Vide notification No. Pro.(5) -6635/2009 dated 2-12-2009 of the Chief Conservator of Forests (Protection), Thiruvananthapuram and the approved general sandal sale conditions published in Kerala Gazette No. 41 dated 14-10-2008 vide notification No. MDE- 3991/2007 dated 17-9-2008 of the Divisional Forest Officer, Sandal Forest Division, Marayoor. If the tender-cum-auction cannot be conducted on the proposed date due to unavoidable reasons, it will be conducted on the next working day at the same venue and time. The tender forms will be available for sale at Forest Range Office, Marayoor one week before the date of auction at a price of ` 300+VAT as per rules. The sale of tender forms will be closed at 8 a.m. on the date of auction. The sealed tender will be accepted in Forest Range Office, Marayoor until 9 a.m. of the date of auction. The tenders received after the specified time will be rejected.

Incomplete and defective tender forms will also be rejected. The tenderer should clearly record the lot numbers as well as the rate offered for each lot which is intended to be purchased. The tenderer should properly sign in tender forms.

The Divisional Forest Officer, Sandal Division, Marayoor reserves all the right to exclude any class or quantity of sandalwood shown in the schedule above for sale. The tenderer/bidder should produce a certificate issued by the concerned District Magistrate to prove his identity, permanent address, signature and photo. They should produce an attested photocopy of the Electoral Identity Card also. Those who fail to produce the Identity Certificate as above will not be allowed to participate in the sale. Each tenderer/bidder must deposit, before being permitted to participate in the sale, an EMD of ` 50,000 (Rupees Fifty Thousand only) and sign the sale notice in token of acceptance of the sale conditions. The lot number and the rate should be legibly written in the tender form both in figures and words. The successful tenderer/bidder should remit the full sale value if the tender/bid value is less than Rupees fifty thousand only. If the tender/bid value is more than Rupee fifty thousand, 35 % of the sale value, subjected to a minimum of Rupees fifty thousand and a maximum of Rupees two lakh and fifty thousand, should be remitted on the date of auction either in cash or as Nationalised Bank Demand Draft drawn in favour of the Forest Range Officer, Marayoor which is payable at State Bank of Travancore, Munnar Branch. If the 35% of the sale value is more than Rupees two lakh and fifty thousand, the balance amount should be remitted within seven days from the date of auction at the Sub Treasury, Devikulam and the receipted Chalan should be produced before the Forest Range Officer, Marayoor.

Value Added Tax (VAT) as per Rules will be applicable to all successful bidder/tenderer irrespective of the destination of transporation and purpose for the auctioned sandalwood. The Value Added Tax and Income Tax should be remitted at Devikulam Sub Treasury and the Chalan receipt of the same should be produced before the Forest Range Officer, Marayoor in time.

If any modifications or change in the sale conditions are intimated by the Addl. Principal Chief Conservator of Forests (Protection), Thiruvananthapuram that will also be applicable to this tender-cum-auction sale and it will be informed to the bidder/tenderer before tender-cum-auction. The undersigned reserves all the right to alter the quantities of sandal materials mentioned in the above schedule or to cancel the tender-cum-auction of any sandal materials without further notice.
