വിഷയം:—ഭൂമിയുടെ ന്യായവില നിർണ്ണയം—വി⁄ാപനത്തിൽ ഉൾപ്പെടാതെപോയ വസ്തുക്കളുടെ വില നിർണ്ണയിച്ച് വി⁄ാപനം ചെയ്യുന്നതിലേക്ക് ഉത്തരവാകുന്നു.
സൂചന:—(1) കേരള മുദ്രപ്പത്ര നിയമം 1959 സെക്ഷൻ 28എ (ന്യായവില നിർണ്ണയം).
(2) ശ്രീ. മുഹമ്മദ് ശ്യാം സമർപ്പിച്ച അപേക്ഷ.
(3) മീനാട് വില്ലേജാഫീസറുടെ 11-9-2014-ലെ 347/14 നമ്പർ റിപ്പോർട്ട്.
2010 മാർച്ച് മാസം 6-ാം തീയതിയിലെ അസാധാരണ ഗസറ്റ് വി⁄ാപനപ്രകാരം നിലവിൽ വന്ന ന്യായവില രജിസ്റ്ററിൽ ഉൾപ്പെടാതെപോയ താഴെപ്പറയുന്ന സർവ്വെ നമ്പരിൽപ്പെട്ട വസ്തുവിന് സൂചന റിപ്പോർട്ടിന്റെ അടിസ്ഥാനത്തിൽ കേരള സ്റ്റാമ്പ് ആക്ട് സെക്ഷൻ 28 A പ്രകാരം ന്യായവില നിർണ്ണയിച്ച് ഇതിനാൽ ഉത്തരവാകുന്നു.

വിഷയം:—ഭൂമിയുടെ ന്യായവില—അപാകത പരിഹരിച്ച് പുനർ നിർണ്ണയം നടത്തി ഉത്തരവാകുന്നു.
സൂചന:—(1) കേരള മുദ്രപ്പത്ര നിയമം 1959 സെക്ഷൻ 28എ, ചട്ടം 5 (4).
(2) കൊല്ലം ജില്ലാ കളക്ടറുടെ 14-2-2013-ാം തീയതിയിലെ എം1-38492/12-ാം നമ്പർ നിർദ്ദേശം.
(3) ശ്രീ. യോഹന്നാൻ, ശ്രീമതി മാർഗ്രറ്റ് ആന്റണി, ശ്രീ. ശിവകുമാർ, ശ്രീ. ജോൺസൺ എന്നിവർ സമർപ്പിച്ച അപേക്ഷ.
(4) ഇളമ്പള്ളൂർ വില്ലേജാഫീസറുടെ 335/14, മു≠യ്ക്കൽ വില്ലേജ് ഓഫീസറുടെ 176/14, കലയപുരം വില്ലേജ് ഓഫീസറുടെ 233/14, വിളക്കുടി വില്ലേജാഫീസറുടെ 185/14 നമ്പർ റിപ്പോർട്ടുകൾ.
ഭൂമിയുടെ ന്യായവില നിർണ്ണയിച്ചുകൊ≠് സർക്കാർ പുറപ്പെടുവിച്ച 6-3-2010-ലെ വി⁄ാപനത്തിൽ 3-ാം സൂചനയിൽ പേരു ചേർത്തിട്ടുള്ളവരുടെ കൈവശ വസ്തുക്കളുടെ ക്ലാസിഫിക്കേഷൻ തെറ്റായി രേഖപ്പെടുത്തി വില നിർണ്ണയിച്ച് വി⁄ാപനം ചെയ്തുവന്നിട്ടുള്ളത് പരിഹരിക്കുന്നതിനായി അപേക്ഷ സമർപ്പിച്ചിരിക്കുന്നു.
2പ്രസ്തുത അപേക്ഷകളിൻമേൽ സൂചന (4) പ്രകാരം റിപ്പോർട്ട് സമർപ്പിച്ചിട്ടുള്ളതാണ്. ടി റിപ്പോർട്ടുകളുടെ അടിസ്ഥാന ത്തിലും സൂചന (2) പ്രകാരമുള്ള നിർദ്ദേശത്തിന്റെ അടിസ്ഥാനത്തിലും രേഖകൾ പ്രകാരമുള്ള ശരിയായ ക്ലാസിഫിക്കേഷൻ ചേർത്തും അവയ്ക്കനുസൃതമായ വിലചേർത്തും വി⁄ാപനം ചെയ്യേ≠ത് ആവശ്യമാണെന്ന് ബോദ്ധ്യപ്പെട്ടതിന്റെ അടിസ്ഥാനത്തിൽ ചുവടെ ചേർക്കുംവിധം ഉത്തരവാകുന്നു.

ഭൂമിയുടെ ന്യായവില നി›യിച്ചുകൊ≠് 6-3-2010-ൽ വി⁄ാപനം ചെയ്യപ്പെട്ട ന്യായവിലയിൽ വന്നുചേർന്ന അപാകതകൾ പരിഹരിച്ച് ചുവടെ ചേർത്തിരിക്കുന്ന പ്രകാരം അംഗീകരിച്ച് ഉത്തരവാകുന്നു.
