Explanatory Note

An approximate extent of 20 Ha. of land comprised in Survey No. 1/8 A1A, R.S. No. 121, 122/1, 2, 123/1, 2, 124/1, 2 of Akathethara Village, Palakkad Taluk was notified as Ecologically Fragile Land under Section 3 (1) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Ordinance 16/2001 vide Notification No. C4-21437/2000 dated 20-10-2000 published in the Kerala Gazette No. 1 dated 2-1-2001 as Sl. No. 62.

On scrutiny of the above said notification under Section 19(3)b of EFL Act, 2003 and Rule 20 of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Rule 2007, the Custodian, EFL as per Order No. EFL6-425/13 dated 5-3-2014, found that actual extent of land in above survey number is only 17.1950 Ha. and the entire extent of 17.1950 Ha (42.49 acres) does not qualify the definition of Ecologically Fragile Lands as defined under Section 2b(1) of the EFL Act 2003 and ordered to remove of the land from said notification. This notification is intended to achieve the above object.

It is hereby notified that Teak timber-IV, Teak poles, and jungle wood fire wood collected from final felling/thinning of matchwood plantation/teak plantation in Achencovil Range of Achencovil Division will be sold through e-Auction shown in the schedule, by the Divisional Forest Officer, Achencovil or any officer authorized by him, subject to the conditions published in Kerala Gazette No. 50 Vol. III dated 23-12-2014 vide Notification No. Pro. (4) 26243/13 dated 3-12-2014 of the Additional Principal Chief Conservator of Forests (P) Thiruvananthapuram and other conditions prevalent in the Forest Department.

Besides the quantity shown in the schedule, the quantity if any delivered to dumping sites before the date of e-Auction will also be included in the sale.

e-Auction documents and connected records are available in the website: www.mstcecommerce.com. The Earnest Money Deposit should be submitted on e-payment/e-treasury/demand draft/MSTC through the internet online banking of SBT or through NEFT for other banks. For submission of e-auction visit the website: www.mstcecommerce.com. All bids/ e-auction documents are to be submitted online only and in the designated online cover(s)/envelope(s) on the www.mstcecommerce.com. Website and e-auction documents submitted manually/through post will not be entertained.

Online e-Auction/bids are to be accompanied with relevant documents. e-Auction/bids received online without the scanned copies of relevant documents will not be considered and shall be summarily rejected. A quantity of 132.50 MT Jungle wood firewood collected from 1968 MW plantation, Harijan Colony by final felling in Achencovil Range and bid in the Tender/Auction dated 12-3-2014 by Sri Sanu Dharmaraj, Sabu Nivas, Achencovil also will also be re-tendered/re-auctioned in the proposed sale at the risk and loss of the original bidder Sri Sanu Dharmaraj. The details are shown in the scheduled appended below.

Intending persons may ensure the quantity and quality of materials put up for e-auction before the commencement of the same and no complaints will be entertained after the e-auction. The bidders should produce a Certificate showing the permanent address and signature of the bidders duly attested by the concerned Village Officer, or any other approved identity documents along with the EMD through online. Those who do not produce any approved identity card or certificate will not be eligible to participate in the e-auction.

In case any Government Department requires any of the materials put up for the e-auction the quantity remaining after their selection only will be re- auctioned. The quantity that may become ready for sale after the publication of this notification will also be included in the tender cum auction. Any further notification to the sale conditions that may be issued by Government after the issuance of this notification will also be applicable to this tender-cum auction.

ദർഘാസ് സമർപ്പിച്ചിട്ടുള്ള കരാറുകാരുടെയോ അവരുടെ പ്രതിനിധിയുടെയോ സാന്നിദ്ധ്യത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ ദർഘാസ് തുറക്കുന്നതാണ്. ദർഘാസ് തുറക്കുന്ന ദിവസം അവധി ആയി സർക്കാർ പ്രഖ്യാപിക്കുകയാണെങ്കിൽ അതിനു തൊട്ടടുത്ത പ്രവൃത്തി ദിവസം ടി സമയത്ത് ദർഘാസുകൾ തുറക്കുന്നതായിരിക്കും.

ദർഘാസ് സംബന്ധമായി ഫോറസ്റ്റ് ഡിപ്പാർട്ട്മെന്റ ിൽ നിലവിലുള്ള എല്ലാ നിബന്ധനകളും ഈ ദർഘാസിനും ബാധകമായിരിക്കും.

കുറിപ്പ് :— സ്വീകാര്യമായ ദർഘാസ് സമർപ്പിക്കുന്ന കരാറുകാരൻ കരാർ തുക 3 ലക്ഷം രൂപയിൽ അധികരിക്കുന്നപക്ഷം, അപ്രകാരം അധികരിച്ച തുകയുടെ 10% വരുന്ന തുകയ്ക്കുള്ള, റവന്യൂ അധികാരികളിൽ നിന്നുള്ള സോൾവൻസിയോ ദേശസാൽകൃത ബാങ്കിന്റെ ബാങ്ക് ഗ്യാരന്റിയോ ഹാജരാക്കേ≠താണ്. ദർഘാസ് സ്വീകരിച്ച് 15 ദിവസത്തിനകം മൊത്തം കരാർ തുകയുടെ 5% തുകയോ അല്ലെങ്കിൽ ` 2,00,000 (` ര≠ു ലക്ഷം)-മോ ഏതാണ് കുറവ് അത് സെക്യൂരിറ്റി അടവാക്കി ` 100-ന്റെ മുദ്രപ്പത്രത്തിൽ നി›ിത കരാറിൽ ഏർപ്പെടേ≠താണ്. ടിമ്പർ, കഴകൾ, വിറക് എന്നിവയ്ക്ക് പ്രത്യേകം പ്രത്യേകം ടെ≠ർ നിരക്ക് ക്വാട്ടു ചെയ്തു സമർപ്പിക്കുന്ന ടെ≠റുകൾ യാതൊരു കാരണവശാലും സ്വീകരിക്കുന്നതല്ല.

2. Bidders are requested to submit scanned copy of the following documents - Registration certificate duly attested by the Gazetted Officer, EMD Exemption Certificate (if any), Preliminary agreement executed in Kerala Stamp Paper worth ` 100 duly filled up proforma for availing e-payment by Online. Subsequently the hard copy of attested copy of Registration Certificate, EMD exemption certificate (if any) preliminary agreement in original would be submitted offline. In a sealed cover superscribing the name of work and tender number to the office of the Divisional Forest Officer, Kottayam through Speed Post/Registered post as prescribed in the time schedule, failing which such tenders will be rejected.

3. The bidding authority deserves the right to modify/cancel, any/all bids without assigning any reason. The Forest Department will not be responsible for any error like missing of scheduled data while downloading by the bidder and non receipt of documents.

4. Any further clarifications on this tender can be obtained from NIC/the e-tender Helpdesk number available in the www.etenders.kerala.gov.in. website and from this office during the office hours. The details regarding e-payment (Bidder's bank account number where he/she is having core banking facility and email ID) should be submitted along with the tender. Tenders without these details will not be accepted. Technical bid and financial bid shall be submitted in their respective designated online covers.

5. The Forest Department will not be responsible for any inconveniences or loss to the Bidder while uploading/ downloading the bid.

If the due date happens to be a holiday, the next working day will be the due date. Cost of tender forms will not be refunded at any instances.

Filled up tender forms along with other documents shall be submitted to the undersigned upto 3 p. m. on 12-2-2015 by post or any approved courier service. In the case of downloaded tender applications, in addition to the prescribed EMD, a demand draft for the tender form value from a Nationalized Bank drawn in favour of Wildlife Warden, Wildlife Division, Munnar payable at Munnar shall also be enclosed. Other mode of remittance of tender form cost is not acceptable.

The Earnest Money Deposit noted against the work should be paid along with the tenders by DD (Cheques or fixed deposit receipts will not be acceptable) in favour of the undersigned payable at any Nationalized Bank at Munnar. Incomplete tender or tenders without EMD are liable to be rejected. The preliminary agreement in stamp paper worth ` 100 should be enclosed with tender. The undersigned reserves the right to reject any tender without assigning any reason. ദർഘാസ് സ്വീകരിച്ചശേഷം പ്രവൃത്തി ലഭിച്ച കരാറുകാരൻ എഗ്രിമെന്റ ് വെച്ച് ജോലി ഏറ്റെടുക്കാതെ വീഴ്ച വരുത്തുന്ന പക്ഷം പ്രസ്തുത പ്രവൃത്തി വീഴ്ചവരുത്തിയ കരാറുകാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർ ദർഘാസ് ചെയ്യുന്നതും ഇപ്രകാരം പുനർ ദർഘാസ് മൂലം സർക്കാരിന് വരുന്ന നഷ്ടങ്ങൾക്ക് ഒറിജിനൽ കരാറുകാരൻ ഉത്തരവാദിയായിരിക്കു ന്നതും അപ്രകാരം ഉ≠ാകുന്ന നഷ്ടങ്ങൾ വീഴ്ചവരുത്തിയ കരാറുകാരന്റെ സ്ഥാവരജംഗമ സ്വത്തുക്കളിൽ നിന്ന് റവന്യൂ റിക്കവറി ആക്ട് പ്രകാരം ഈടാക്കുന്നതിന് ` 100-ന്റെ മുദ്രപത്രത്തിൽ ഒരു സമ്മതപത്രം എഴുതി ഒപ്പിട്ട് ദർഘാസി നോടൊപ്പം സമർപ്പിക്കേ≠തുമാണ്. കേരള പൊതുമരാമത്ത് വകുപ്പിലെ ദർഘാസുകളെ സംബന്ധിച്ച നിലവിലുള്ള എല്ലാ നിയമങ്ങളും ഇതിനും ബാധകമായിരിക്കും. നിയമപ്രകാരമുള്ള പോസ്റ്റ് ഓഫറുകൾ പരിഗണിക്കുന്നതാകുന്നു. ദർഘാസിനായി പരസ്യപ്പെടുത്തിയ തീയതി ഏതെങ്കിലും കാരണത്താൽ അവധിയാകുകയാണെങ്കിൽ തൊട്ടടുത്ത പ്രവൃത്തി ദിവസം അതേ സ്ഥലത്തും സമയത്തും ദർഘാസ് നടത്തുന്നതായിരിക്കും. ഈ ദർഘാസിലെ ഏതൊരു പ്രവൃത്തിയും ഒരു മുന്നറിയിപ്പ് കൂടാതെ റദ്ദ് ചെയ്യുന്നതിനുള്ള പൂർണ്ണ അധികാരം താഴെ ഒപ്പിട്ടിരിക്കുന്ന അധികാരിയിൽ നിക്ഷിപ്തമാകുന്നു.
