An approximate extent of 0.7000 Ha. of land comprised in Survey No. 1/8A1A, of Akathethara Village, Palakkad Taluk was notified as Ecological Fragile Land under Section 3 (1) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Ordinance 16/2001 vide Notification No. C4 -21437/2000 dated 20-10-2000 published in Kerala Gazette No. 1 Volume 46 dated 2-1-2001 as Sl. No. 53.

An approximate extent of 3.2456 Ha. of land comprised in Survey No. 1 of Ottappalam I Village, Ottappalam Taluk was notified as Ecologically Fragile Land under Section 3 (1) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Ordinance 16/2001 vide Notification No. C4 -21437/2000 dated 12-7-2001 & published in Kerala Gazette No. 36 dated 11-9-2001 as item No. 53.
The Hon'ble EFL Tribunal Palakkad as per judgment dated 30-4-2010 allowed the OA 1/2008 that an extent of 3.2456 Ha. of the above notified land does not qualify the definition of Ecological Fragile Land as defined under EFL Act, and in the judgment in WP (C) 30634/14 dated 17-11-2014 ordered to restore the land to the petitioner.
Hence it is hereby notified that the land in the schedule below is excluded from Ecologically Fragile Land.

വിജയി ആകുന്ന ദർഘാസുകാരൻ ദർഘാസ് തുകയുടെ 10% വരുന്ന തുകയ്ക്ക് റവന്യൂ അധികാരികളിൽനിന്നും ലഭിക്കുന്ന സോൾവൻസിയോ ഏതെങ്കിലും ദേശസാൽകൃത ബാങ്കിൽ നിന്നുമുള്ള ബാങ്ക് ഗ്യാര≠ിയോ സമർപ്പിക്കേ≠താകുന്നു.

Separate online tenders are invited from eligible 'A' Class contractors registered in the Forest Department in pursuance of G.O. (Ms.) No. 226/81(F) dated 16-12-1981 for working down Timber, Billets and Teak Poles from the marked trees standing in the plantations mentioned in the schedule below and transport the same to the Govt. Timber Depots, Poles & Billets at dumping site mentioned in the same schedule. The tenderer is bound to comply with the terms and conditions in force, besides the conditions that will be framed by the Government in future in connection with this tender.
Tender documents and schedules are available in the website: www.etenders.kerala.gov.in. The Earnest Money Deposit and tender cost for the tender should be submitted through the Internet online banking of SBT or through NEFT for other banks. For submission of tenders visit the website www.etenders.kerala.gov.in.
All bid/ tender documents are to be submitted online only and in the designated Online cover (s)/envelope(s) on the www.etenders.kerala.gov.in. website and tenders submitted manually/through post will not be entertained. Late tenders will not be accepted.
Online tenders/bids are to be accompanied with a preliminary agreement executed in Kerala Stamp Paper worth ` 150. Tenders/bids received online without the scanned copies of relevant documents, preliminary agreement, will not be considered and shall be summarily rejected. The Forest Department will not be responsible for any inconvenience or loss to the Bidder while uploading/ downloading the bid.
The successful tenderer should submit a solvency from the revenue authorities or a bank guarantee issued by a nationalized bank for 10% of the tender amount, if the tender amount exceeds ` 3,00,000. The successful tenderer should execute an agreement in the prescribed format in a stamp paper worth ` 150 within 15 days from the date of intimation of acceptance of the tender after furnishing security deposit equal to 10% of the tender amount or ` 1,00,000 whichever is less. Post offers as per the existing rules shall also be entertained. The tenderers quoting rates separately for timber, poles, billets and firewood shall not be entertained under any circumstances. If the notified date of tender happens to be a holiday, the tender will be conducted on the very next working day at same place and time. ദർഘാസ് ദിവസം സർക്കാർ പൊതു അവധിയായി പ്രഖ്യാപിക്കുകയാണെങ്കിൽ അടുത്ത പ്രവൃത്തി ദിവസം സ്ഥലം, സമയം, നിബന്ധനകൾ ഇവയിൽ മാറ്റമില്ലാതെ ദർഘാസ് നടത്തുന്നതായിരിക്കും. മറ്റെന്തെങ്കിലും കാരണങ്ങളാൽ 12-3-2015-ന് ദർഘാസ് നടത്തുവാൻ കഴിഞ്ഞില്ലെങ്കിൽ സ്ഥലം, സമയം, നിബന്ധനകൾ ഇവയിൽ മാറ്റമില്ലാതെ 16-3-2015, 18-3-2015 എന്നീ ദിവസങ്ങളിൽ ദർഘാസ് നടത്തുന്നതാണ്. കേരള പൊതുമരാമത്ത് വകുപ്പിൽ സിവിൽ ജോലികൾക്ക് ബാധകമായിട്ടുള്ള എല്ലാ നിബന്ധനകളും ഈ ജോലികൾക്കും ബാധകമായിരിക്കും.
2. കമ്പി വേലി സ്ഥാപിക്കുന്നതിനും അറ്റകുറ്റപണികൾ ചെയ്യുന്നതിനും ഏറ്റവും ഗുണനിലവാരമുള്ള ഉപകരണ ങ്ങൾ മാത്രം ഉപയോഗിക്കേ≠താണ്. ഉപകരണങ്ങൾ ബാം•ൂർ ആസ്ഥാനമായ പവർ റിസർച്ച് ഇൻസ്റ്റിറ്റ്യൂട്ടി ന്റെയോ ഡി.ജി.എസ്. ആന്റ ് ഡി.യുടെയോ ഗുണമേ∑ാ സർട്ടിഫിക്കറ്റ് ഉള്ളവയായിരിക്കണം.

(4) 26243/13 dated 3-12-2014 of the Additional Principal Chief Conservator of Forests (P), Thiruvananthapuram and other conditions prevalent in the Forest Department.
Besides the quantity shown in the schedule, the quantity if any delivered to dumping sites before the date of e-Auction will also be included in the sale.

Separate online tenders are invited from eligible 'A' class contractors registered in the Forest Department in pursuance of G. O. (Ms.) No. 226/81(F) dated 16-12-1981 for working down Timber, Billets and Firewood from the marked trees standing in the plantations mentioned in the schedule below and transport the timber to the Government Timber Depot/Depots and firewood/billets to dumping depot mentioned in the same schedule. The tenderer is bound to comply with the terms and conditions in force, besides the conditions that will be framed by the Government in future in connection with this tender. Tender documents and schedules are available in the website www.etenders.kerala.gov.in The Earnest Money Deposit and tender cost for the tender should be submitted through the internet online banking of SBT or through NEFT for other banks. The successful tenderer should execute an agreement in the prescribed format in a stamp paper worth ` 150 within 15 days from the date of acceptance of tender after furnishing security deposit of an amount equal to 10% of the tender amount limited to a maximum of ` 2,00,000 (Rupees Two Lakhs only). A preliminary agreement in the prescribed format in Kerala Government Stamp Paper worth ` 150 should be attached with the tender. Incomplete tender or the tender without the required EMD are liable to be rejected. Tenders without the agreement in stamped paper will be rejected outright. But in deserving cases where agreement has not been received, the Purchasing Officer may exercise his discretion and call upon such tenderer to execute the agreement within a period of ten days from the date of issue of such intimation. A specimen form of agreement will be given along with tender application. The Divisional Forest Officer, Palakkad reserves the right to reject any tender without assigning any reasons. All the rules and regulations regarding tender in force in PWD and Forest Department are applicable to this tender also. 4. The successful tenderer should execute the agreement and commence the work within 15 days from the date of receipt of work order. If he fails to execute the agreement and start to execute the work, the work will be re-tendered at the risk and loss of the original bidder or execute departmentally. (5)-26274/12-ാം നമ്പരായി പ്രസിദ്ധീകരിച്ചിട്ടുള്ള ഡിപ്പോ ലേലവ്യവസ്ഥകൾക്കും കൂടാതെ താഴെപ്പറയുന്ന ലേലവ്യവസ്ഥകൾക്കും നിബന്ധനകൾക്കും വിധേയമായി ദർഘാസ്/ ലേലത്തിൽ പരസ്യമായി വിൽക്കുന്നതാണ്. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്ന വ്യ‡ികൾ ദർഘാസിന് മുൻപ് (1) ` 19,000, (2) ` 30,000, (3) ` 50,000 എന്നിങ്ങനെ ഓരോ തോട്ടത്തിനും നിരതദ്രവ്യം കെട്ടിവയ്ക്കേ≠താണ്. വിജയിക്കുന്ന ദർഘാസുകാരൻ/ലേലക്കാരൻ, അന്നേദിവസം 1 ലക്ഷം രൂപയും ലേലത്തുകയുടെ 1/3 ഭാഗം തുക 7 ദിവസത്തിനകം തന്നെ അടയ്ക്കേ≠താണ്. വിജയിയായ ദർഘാസുകാരൻ/ലേലക്കാരൻ നിയമപ്രകാരവും കാലാകാലങ്ങളിൽ നിലവിലുള്ളതുമായ വാറ്റ്, വനവികസന നികുതി, വരുമാന നികുതി, മറ്റ് ബന്ധപ്പെട്ട നികുതികൾ എന്നിവ യഥാസമയം അടയ്ക്കേ≠തു≠്.

1. ദർഘാസ് കം ലേലം ഒരു നി›ിത തുകയുടെ അടിസ്ഥാനത്തിലാണ് നി›യിച്ചിരിക്കുന്നത്. ഇതിലേക്കായി സർവ്വെ ചെയ്ത് തിരിച്ചിട്ടുള്ള പ്രസ്തുത തോട്ടങ്ങളിലെ നിൽപ്പ്, ചേറ്, എടല, കമ്പിളി, താളി, ഇലവ് തുടങ്ങിയ പട്ടികയിൽ പരാമർശിച്ചതും മാർക്ക് ചെയ്തതുമായ വിവിധ ഇനം മൃദുമരങ്ങളുടെ ശേഖരണവും നീക്കം ചെയ്യലും സംബന്ധിച്ച ജോലിക്കുവേ≠ിയാണ് ഇത് തീരുമാനിച്ചിരിക്കുന്നത്.
2. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലത്തിന് മുൻപായി ഉൽപ്പന്നങ്ങളുടെ നിൽപ്പ് നേരിൽ ക≠് ബോദ്ധ്യപ്പെടേ≠തും ഉൽപ്പന്നത്തിന്റെ ഗുണമേൻമ, അളവ് എന്നിവ സംബന്ധിച്ച യാതൊരു പരാതികളും ലേലത്തിനുശേഷം പരിഗണിക്കുന്നതുമല്ല.
3. ദർഘാസുകാരൻ/ലേലക്കാരൻ നേരിട്ട് ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കേ≠താണ്. നിയമപരമായ പവർ ഓഫ് അറ്റോർണി ഇല്ലാത്ത പകരക്കാരെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല.
4. കണ്ണൂർ ഡിവിഷനിലെയും മറ്റ് സമീപ ഡിവിഷനുകളിലെയും സപ്ളൈ കോൺട്രാക്ടർമാരെ ടി ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.
5. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കൈയ്യൊപ്പും സാക്ഷ്യ പ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽനിന്നും വാങ്ങിയ സർട്ടിഫിക്കറ്റോ സർക്കാർ നൽകിയ ഫോട്ടോ പതിച്ച എെഡന്റിറ്റി കാർഡോ നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാക്കേ≠താണ്.
6. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ ആഫീസുമായോ ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസ് കം ലേല ദിവസം ദർഘാസുകാരൻ/ലേലക്കാരൻ ഈ ഓഫീസിൽ സമർപ്പിക്കേ≠താണ്. ഇത്തരത്തിൽ ദർഘാസുകാരൻ/ലേലക്കാരൻ ബന്ധപ്പെട്ട ആഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാന്റെ പേരിലുള്ള ദർഘാസ് കം ലേലം റദ്ദ് ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പുകൾ പുനർലേലം ചെയ്യുന്നതാണ്.
7. ദർഘാസ് കം ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുള്ള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരുലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽപ്പെട്ട ലേലങ്ങൾക്ക് 20 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും മാത്രമേ പരിഗണിക്കുകയുള്ളൂ. കൂടാതെ താഴെ പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമാണ്.
(1) ദർഘാസ് കം ലേലത്തിന് 7 ദിവസത്തിനുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.
(2) പോസ്റ്റ് ഓഫറുകാരൻ യഥാർ∞ ദർഘാസുകാരൻ/ലേലക്കാരൻ ഒടുക്കിയ തുകയുടെ ഇരട്ടി തുക അടയ്ക്കേ≠താണ്.
(3) ബന്ധപ്പെട്ട പോസ്റ്റ് ഓഫർ തുകയും മറ്റു നികുതികളും ചെലാൻ മുഖാന്തിരമോ ബാങ്ക് രസീത് വഴിയോ ഈ ആഫീസിൽനിന്നും രജിസ്റ്റേർഡ് തപാൽ മുഖേന അറിയിച്ച് ഏഴുദിവസത്തിനുള്ളിൽ ഒടുക്കി ഈ ആഫീസിൽ ഹാജരാക്കേ≠താണ്. പോസ്റ്റ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ കൂപ്പുകളുടെയും അതിലെ നിൽപ്പു മരങ്ങളുടെയും ഗുണ നിലവാരവും മറ്റ് ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ടശേഷം നി›ിത മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്.

8. ദർഘാസ് കം ലേലം സംബന്ധിച്ച കൂടുതൽ വിവരങ്ങൾ കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസിലോ കണ്ണവം റെയിഞ്ചാഫീസുകളിലോ എല്ലാ പ്രവൃത്തി ദിവസങ്ങളിലും അന്വേഷിച്ചാൽ അറിയാവുന്നതാണ്.

10. കൂടുതൽ തുകയ്ക്ക് ദർഘാസ് കം ലേലം കൊള്ളുന്ന ആൾ അന്നേ ദിവസം 1 ലക്ഷം രൂപയും മൊത്തം ലേലത്തുകയുടെ 1/3 തുക ലേലം കഴിഞ്ഞു 7 ദിവസത്തിനകവും ഒടുക്കേ≠താണ്. ടി തുക ഒടുക്കുന്നതിന് വീഴ്ച വരുത്തിയാൽ ടിയാൻ ഒടുക്കിയിട്ടുള്ള നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും ടി കൂപ്പ് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതുമായിരിക്കും.
11. ദർഘാസ് കം ലേലം കൊള്ളുന്ന ആൾക്ക് പ്രസ്തുത കൂപ്പിൽ മാർക്ക് ചെയ്ത് എന്യൂമറേറ്റ് ചെയ്തു നിർത്തിയിരിക്കുന്ന ചേറ്, എടല, കമ്പിളി, താളി, ഇലവ് മറ്റു പലജാതി എന്നീ മരങ്ങൾക്ക് മാത്രം അവകാശമുള്ളതും തേക്ക്, ഈട്ടി മുതലായ മറ്റ് മരങ്ങൾക്ക് അവകാശമില്ലാത്തതുമാകുന്നു.
12. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലം കൊള്ളുന്ന ആൾ ` 100-ന്റെ മുദ്രപത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടി കൂടി ലേലം കഴിഞ്ഞാലുടൻ ഒപ്പ് വയ്ക്കേ≠താണ്.
13. ദർഘാസ് കം ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുടെ ലേലത്തുകയും മൊത്തം തുകയുടെ 5% ഫോറസ്റ്റ് ഡവലപ്മെന്റ ് ടാക്സും നിലവിലുള്ള നിരക്കിൽ വാറ്റ്, ഇൻകം-ടാക്സ് എന്നിവകളും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10% സെക്യൂരിറ്റി ഡെപ്പോസിറ്റും വച്ച് ` 100-ന്റെ മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠തുമാണ്. 15 ദിവസത്തിനുള്ളിൽ ടി തുകകൾ ഒടുക്കാതിരുന്നാൽ 12% പലിശയോടുകൂടി തുകകൾ ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറും മുകളിൽ പറഞ്ഞ കാലാവധിക്കുള്ളിൽ തുകയടയ്ക്കാതിരുന്നാൽ 15 ദിവസത്തെ സമയം ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ, നോർത്തേൺ സർക്കിൾ, കണ്ണൂരിന് 24% പലിശയോടുകൂടി കാലാവധി ദീർഘിപ്പിച്ചു നൽകുന്നതാണ്. പലിശ കണക്കാക്കുമ്പോൾ 15 ദിവസമോ അതിൽ കുറവോ വരുന്നത് പകുതി മാസമായും 15 ദിവസത്തിൽ കൂടുതൽ വരുന്ന ദിവസം ഒരു മാസമായും കണക്കാക്കുന്നതാണ്.
14. മുകളിലെ വ്യവസ്ഥപ്രകാരം നീട്ടിക്കൊടുത്ത കാലാവധിക്കുള്ളിലും തുക ഒടുക്കി എഗ്രിമെന്റ ് വയ്ക്കുന്നതിന് വീഴ്ച വരുത്തിയാൽ ദർഘാസുകാരൻ/ലേലക്കാരൻ അതുവരെ ഒടുക്കിയിട്ടുള്ള എല്ലാ തുകയും നീക്കം ചെയ്യാതെ കിടക്കുന്ന എല്ലാ ഉൽപ്പന്നങ്ങളും സർക്കാരിലേക്ക് ക≠ുകെട്ടി ലേലം റദ്ദ് ചെയ്യുന്നതും ദർഘാസുകാരന്റെ/ലേലക്കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പ് പുനർലേലം ചെയ്യുന്നതുമാണ്. പുനർലേലം ചെയ്യുമ്പോൾ ലാഭം ഉ≠ാകുകയാണെങ്കിൽ ആയതിന് ലേലക്കാരന് യാതൊരുവിധ അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല. പുനർ ലേലത്തിലു≠ാകുന്ന എല്ലാ നഷ്ടങ്ങളും വീഴ്ചക്കാരനിൽനിന്നും ഈടാക്കുന്നതാണ്.
15. ദർഘാസുകാരൻ/ലേലക്കാരൻ ബാക്കി തുക മുതലായവ നീട്ടിക്കൊടുത്ത കാലാവധിക്കുള്ളിലും ഒടുക്കാതിരുന്നാൽ ഉടമ്പടി റദ്ദ് ചെയ്ത് ടിയാൻ അടച്ചിട്ടുള്ള മുഴുവൻ തുകകളും നീക്കം ചെയ്യാതെ കിടക്കുന്ന എല്ലാ ഉൽപ്പന്നങ്ങളും സർക്കാരിലേക്ക് ക≠ുകെട്ടി ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതാണ്. പുനർലേലത്തിൽ ലാഭം ഉ≠ാക്കുകയാണെങ്കിൽ വീഴ്ചക്കാരന് യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല.
16. ഉടമ്പടി കാലാവധി ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 30 ദിവസം തോട്ടം 1-നും 2-നും, 90 ദിവസം തോട്ടം 3-നും അനുവദിച്ചിട്ടു≠്. സാധാരണഗതിയിൽ കൂപ്പിന്റെ കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യ ത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ, ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ, നോർത്തേൺ സർക്കിൾ, കണ്ണൂർ, അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (കോഴിക്കോട് നോർത്ത്) എന്നിവർ യഥാക്രമം തുടർന്നുള്ള 15 ദിവസം വീതം തോട്ടം 1-നും 2-നും, തോട്ടം 3-ന് 30 ദിവസം വീതവും താഴെപറയും പ്രകാരം പിഴ ഈടാക്കിക്കൊ≠് ഓരോ ജോലിക്കും കാലാവധി നീട്ടിക്കൊടുക്കുന്നതാണ്.
(1) എന്യൂമറേറ്റ് ചെയ്തതും മുറിക്കാനുള്ളതുമായ മരങ്ങൾക്ക് ഓരോ ഹെക്ടറിനും അതിന്റെ ഭാഗത്തിനും ` 750 വീതം. (2) നീക്കം ചെയ്യാത്ത രജിസ്റ്റർ ചെയ്തതും അല്ലാത്തതുമായ തടികൾക്ക്/മുളകൾക്ക് ക്യു. മീറ്ററിനും/മെ. ടണ്ണിനും അതിന്റെ ഭാഗത്തിനും ` 100 വീതം.

ഒന്നാമത്തെ 15 ദിവസത്തിന് ടി നിരക്കിലും 2-ാമത്തെ ദീർഘിപ്പിച്ച കാലാവധിയിൽ ഇതിന്റെ ഇരട്ടിയും 3-ാമത്തെ ദീർഘിപ്പിച്ച കാലാവധിയിൽ ഒന്നാമത്തെ 15 ദിവസത്തിന്റെ നിരക്കിന്റെ മൂന്നിരട്ടിയും എന്ന ക്രമത്തിൽ പിഴ ഈടാക്കു ന്നതാണ്. ഇപ്രകാരം നീട്ടി നൽകുന്ന തീയതിക്കുള്ളിലും നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റ ിലേക്ക് മുതൽ കൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ാകുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ചെയ്തുതീർക്കാൻ ബാക്കിയുള്ള ജോലികൾ ഡിപ്പാർട്ട്മെന്റ ് ചെയ്യിക്കുന്നതും ആയതിൽ വച്ചു≠ാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടിക്കാരനിൽനിന്നും ഈടാക്കുന്നതുമായിരിക്കും.
3rd MARCH 2015] FOREST DEPARTMENT 21017. കൂപ്പിൽ ശേഖരിച്ചുവയ്ക്കുന്ന മൃദുമരങ്ങൾ, വിറകുകൾ, എന്നിവ നിലവിലുള്ള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും നീക്കം ചെയ്യാനുള്ള ലൈസൻസ് നൽകുന്നത്.
18. കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെയോ കണ്ണവം ഫോറസ്റ്റ് റെയിഞ്ചാഫീസറുടെയോ രേഖാമൂലമുള്ള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ കൂപ്പിൽ പ്രവേശിക്കുവാൻ പാടുള്ളൂ.
19. ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാ സമയവും കൂപ്പിൽ ഉ≠ായിരിക്കണം. കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിയിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കേ≠തുമാണ്.
20. യാതൊരു കാരണവശാലും πാന്റേഷനിലെയോ റിസർവിലെയോ മറ്റ് മരങ്ങൾക്കും തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്തുവാൻ പാടില്ല. അങ്ങനെ ഉ≠ാകുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്.
21. കൂപ്പിന് പുറത്ത് ഫോറസ്റ്റ് സ്ഥലത്ത് തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടിക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ അനുവദിക്കുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണങ്ങളാലോ മോശമായ കാലാവസ്ഥമൂലമോ ഉടമ്പടി കാലാവധിക്കുള്ളിൽ ഇവ നീക്കം ചെയ്തുകൊ≠ുപോകാൻ കഴിയാതെ വന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്ടറിനോ അതിന്റെ ഭാഗത്തിനോ ` 250 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽനിന്നും ഈടാക്കുന്നതായിരിക്കും.
22. കൂപ്പിന് 0.4 കി. മീറ്റർ (2 ഫർലോങ്ങ്) ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ അനധികൃത കുറ്റകൃത്യങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്. അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ വിവരം ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥരെ ഉടമ്പടിക്കാരൻ അറിയിക്കേ≠താണ്. ഇതിൽ വീഴ്ചവരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടാവുന്നതാണ്.
23. കരാറുകാരന്റെ സെക്യൂരിറ്റി തുക കാലാവധിക്കുശേഷം കരാറുകാരൻ വാറ്റ്, അഗ്രിക്കൾച്ചറൽ ഇൻകം ടാക്സ് ഇവയുടെ ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റ് ഹാജരാക്കുന്നമുറയ്ക്ക് തിരിച്ചു നൽകുന്നതാണ്. എന്നാൽ ടി ഇനത്തിൽ ഗവൺമെന്റിലേക്ക് ബാദ്ധ്യതകൾ വല്ലതുമു≠െങ്കിൽ സെക്യൂരിറ്റി തുകയിൽനിന്നും ഈടാക്കുന്നതാണ്.
24. ഈ ദർഘാസ് കം ലേലത്തിലെ വകുപ്പുകൾ പ്രകാരം ഗവൺമെന്റിനു≠ാകുന്ന ഏതൊരു നഷ്ടവും കിട്ടേ≠തായ ഏതൊരു തുകയും ഡിപ്പാർട്ടുമെന്റിൽനിന്നും ആവശ്യപ്പെടുന്ന സമയത്ത് ദർഘാസുകാരൻ/ലേലക്കാരൻ അടയ്ക്കാൻ വീഴ്ചവരുത്തുന്ന പക്ഷം പ്രസ്തുത തുക ഭൂനികുതി കുടിശ്ശികയായി പരിഗണിച്ച് നിലവിലുള്ള നിയമപ്രകാരം ഈടാക്കുന്നതാണ്. ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർക്ക് യു‡മെന്നുതോന്നുന്ന മറ്റ് മാർഗ്ഗങ്ങളിൽ കൂടിയും ഈ തുക ഈടാക്കുവാൻ നടപടികൾ സ്വീകരിക്കുന്നതാണ്.
25. വനം വകുപ്പിലെ സെയിൽ കൂപ്പുകളെ സംബന്ധിച്ച എല്ലാ പൊതു നിബന്ധനകളും ഈ ദർഘാസ് കം ലേലത്തിനും ബാധകമായിരിക്കും.
26. സർക്കാർ ഉത്തരവ് (സാധാ) നമ്പർ 22/2014/വനം തീയതി 15-1-2014-ലെ സർക്കാർ ഉത്തരവ് ബാധകമാണ്.
27. കരാറുകാരൻ മാർക്ക് ചെയ്ത മൃദുമരങ്ങൾ മാത്രം മുറിക്കേ≠തും തോട്ടത്തിലെ തേക്ക് മരങ്ങളോ മാർക്ക് ചെയ്യാത്ത മറ്റ് മരങ്ങളോ മുറിക്കുകയോ കേടുവരുത്തുവാനോ പാടില്ലാത്തതുമാകുന്നു.

It is hereby notified for the information of the public that the right of collection and removal of enumerated standing Edala, Cheru, Kambili, Thali, Venkana and other misc. species of trees in 1953 Teak Plantation, Nedumpoil, Block 1 ( 6.2 Ha.), 1953 Teak Plantation, Nedumpoil Block II (9.8 Ha.) in Kottiyoor Range and 1955 Softwood Plantation, Kurichiyar coupe Kaniyoor (15 Ha.) in Kannavam Range of this Division as specified in the schedule appended below will be sold in-tender-cum-auction by the Divisional Forest Officer, Kannur or any other officers authorized by him on 10-3-2015 at 11.30 a.m. at the Divisional Forest Office, Kannur, subject to the terms and conditions of sale of timber in Government Timber Depots published in Government Gazette No. 49 dated 10-11-2013 in Page No. 815 to 824 of Forest Sheet as per Pro. (5)-26274/12 dated 22-11-2013 of the Chief Conservator of Forests (P), Thiruvananthapuram. In case the notified date happens to be public holiday, the tender-cum-auction will be conducted on the next working day at the notified place and time. If there is a requirement of re-auction, it will be conducted on 17-3-2015 and 20-3-2015 at the same place.
1. The auction will be on lump sum basis for the right of collection and removal of entire Edala, Cheru, Kambili, Thali, Venkana and other softwood species of trees growth from the above plantations mentioned in the schedule hereto, the area of which has been surveyed and demarked on the ground.
2. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before participating in the Tender-cum-Auction. Complaints if any, regarding quality and quantity etc. received after the Tender-cum-Auction will not be entertained.
3. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another person unless valid power of attorney is produced prior to the commencement of tender cum auction.
4. A supply contractor of Kannur Division or any adjacent divisions will not be allowed to bid in the tender- cum auction.
5. Intending tenderers/bidders should produce photo identity proof issued by Govt. authority or a certificate from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.
6. The successful tenderers/bidders should give an undertaking that he is not related with any officer having control over the work and that he is not a supply contractor of this or any adjacent Division. If this is proved otherwise, it shall result in cancellation of the contract and resale of the coupe at his risk and loss.
7. No post offer received after 7 days of the conduct of the tender cum auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is Rupees One Lakh and above and more than 20% where the original bid amount is less than One Lakh will ordinarily be considered. The post offerer will comply with following terms.
(a) Offer should be made within 7 days of tender cum auction failing to which the offer will not be considered.
(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender-cum auction date.
(c) The remittance should be made by the chalan or Bank deposit and the Bank receipt should be produced before the Divisional Forest Officer concerned within 7 days from the date of receipt of registered notice to that effect.
The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the post offerer satisfied the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules. In the re-auction, the price fetched if does not come up to what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest Bidders/ Tenderers in the re-auction and the amount remitted by the post offerer will be released to him.
3rd MARCH 2015] FOREST DEPARTMENT 2128. Further particulars about the tender cum auction can be had either from the Office of the Divisional Forest Officer or from the Range Office, Kannavam.
9. Intending tenderers/bidders should deposit an Earnest Money Deposit of ` (1) 19,000, (2) 30,000, (3) 50,000 for each Plantation/Block for participating in the tender/auction.
10. The successful tenderers/bidders have to remit 1,00,000 on the tender cum auction date and 1/3 of sale value remit within 7 days from the auction date, failure to which may result in the forfeiture of the E.M.D. to the Government and the resale of coupe at the risk and loss of the person concerned.
11. The successful tenderers/bidders have only the right for the collection and removal of marked Edala, Cheru, Kambili, Thali, Venkana and other softwood trees as mentioned in the Schedule appended and will have no right over Teak, Rosewood or such other unmarked trees.
12. The successful tenderers/bidders should execute a bounden agreement on a Stamp Paper worth ` 100 after the completion of tender-cum-auction.
13. The confirmation of the tender cum auction sale will be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation, the successful tenderers/bidders shall remit the balance 2/3rd sale value and 5% Forest Development Tax, VAT and Income Tax at the rates in force and security deposit of 10% for the total sale value. The successful tenderers /bidders should execute an agreement on a stamp paper worth ` 100. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. In case of failure to remit the amount within the extended period further extension for 15 days by the Chief Conservator of Forests, Northern Circle, Kannur subject to the realization of 24% penal interest. But all the above extension period will be within the original contract period. Failure to remit any of the above instalment even during the extended period will entail cancellation of the contract and forfeiture of all money paid till then and all produce remaining in the coupe. The right thus cancelled will be resold at the risk and loss of the contractor. In calculating interest, 15 days and below will be reckoned as ½ month and over 15 days as one month.
14. 1f the successful tenderers/bidders fails to execute the agreement after remitting the amount even during the extended period as per the above condition, entire amount paid till then will be forfeited to the Government and all the produce left unremoved in the coupe will be confiscated to Government after cancelling the tender- cum-auction. The coupe will be re-auctioned at the risk and loss of the tenderers/bidders. He will be liable for all the loss sustained to the Government and will have no right over the profit derived out of the re-auction of the coupe.
15. Failure to remit any of the above instalment even during the extended period will entail the cancellation of the contract and forfeiture of all the money paid till then and confiscation of all the produce remaining in the coupe. The right thus cancelled will be resold at the risk and loss of the contractor. The contractor will have no right over the profit derived out of the resale of the coupe.
16. The period of contract will be allowed Sl. No. 1 & 2 Plantation is in 30 days and Sl. No. of the Plantation 3 is 90 days from the date of agreement. No extension of period of contract shall be granted on ordinary ground. Under special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests, Northern Circle, Kannur and the Additional Principal Chief Conservator of Forests, (Region North), Kozhikode concerned may grant extension of time for 15 days, further 15 days for Sl No. 1 & 2 plantation and plantation 30 days respectively on realization of penalty or penalties for completion of each work for each extension mentioned below:
(a) For enumerated trees and balance unfelled per hectare or fraction thereof— ` 750 per hectare.
(b) Unremoved registered logs and unregistered logs and bamboo— ` 100/M3/MT or fraction thereof.
(c) Unremoved firewood—` 50/Tonne or fraction thereof.
Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected 3rd MARCH 2015] FOREST DEPARTMENT 213 If the tenderers/bidders fails to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenderers/bidders as per the agreement will be forfeited to Government and the tenderers/bidders will not have any right on the produce confiscated to Government. In the above circumstances the balance work to be executed by the tenderers/bidders shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the tenderers/ bidders.
17. The contractor shall be allowed to remove the timber of Elavu, Kambili Matty, Murikku and other misc. species and firewood from the coupe subject to the law prevailing in the department from time to time.
18. The contractor or his persons shall be allowed to enter in the coupe only after getting the prior permission either from the Divisional Forest Officer, Kannur or from the Forest Range Officer, Kannavam.
19. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 Meters and keep the cairns intact.
20. He will be liable for the damages made to other trees in plantations or RF.
21. The successful tenderers/bidders may allow to stack the timber in the forest area outside the coupe at the risk of the tenderers/bidders upto the period of contract. An amount of ` 250 will be charged as ground rent for the timber unremoved for 1 Ha. or fractions thereof.
22. He will be liable for all illegal activities happened 400 Mtr. (2 Furlong) surrounding of the coupe. Such incidents, if noticed by contractor, should be informed the officer concerned, otherwise will lead to the cancellation of the contract.
23. The security deposit will be released to the contractor on production of clearance certificate. Any liability outstanding will be set off from the security deposit.
24. If the value fetched in the re-tender/re-auction is less than that obtained in the original tender cum auction, the difference between them together with all incidental expenditure to fix up of the resale including notification charges or any other dues or Government loss as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting tenderers/bidders through all legal means including Revenue Recovery Act in force.
25. General condition of the sale of tree growth prevailing in the department from time to time shall be applicable to this Tender cum Auction also.
26. G. O. (Ms.) No. 22/2014/Forest dated 15-1-2014 shall be applicable to this tender cum auction also.
27. No unmarked tree shall be felled or damaged while felling a marked tree. Such instances if any will be treated as violation of agreement condition.
28. The tenderer/bidder should have PAN Card otherwise Income Tax at the higher rate in force will be levied.
