പുനലൂർ ഡിവിഷനിൽപ്പെട്ട പത്തനാപുരം റെയിഞ്ചിലെ 2001 പൂവാലിക്കുഴി അക്കേഷ്യ ഓറിക്കുലി ഫോർമിസ് തോട്ടത്തിൽ 2013-14 വർഷത്തിൽ മെസേഴ്സ് എച്ച്. എൻ. എൽ.-ന് എക്സ്ട്രാക്ഷന് അനുവദിച്ചിരുന്നു. ടി തോട്ടത്തിൽ എക്സ്ട്രാക്ഷന് ശേഷം മുറിക്കാതെ ശേഖരിച്ച വൃക്ഷങ്ങൾ എന്യൂമറേറ്റ് ചെയ്തിട്ടുള്ളതും താഴെ പട്ടികയിൽ വിവരിക്കുന്നതുമായ മരങ്ങൾ മുറിച്ച് ശേഖരിച്ച് നീക്കം ചെയ്ത് കൊ≠ുപോകുന്നതിനുള്ള അവകാശം 13-5-2015 പകൽ 11.30 മണിക്ക് പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറോ അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന മറ്റ് ഉദ്യോഗസ്ഥനോ പുനലൂർ ഡിവിഷണൽ ഫോറസ്ററാഫീസിൽ വച്ച് സംരക്ഷണ വിഭാഗം അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്ററ് കൺസർവേറ്ററുടെ 22-11-2013-ലെ പ്രൊ(5)-26274/12-ാം നമ്പരിലും 10-12-2013-ലെ 49-ാം നമ്പർ കേരള ഗസറ്റിലും പ്രസിദ്ധീകരിച്ചിട്ടുളള ഡിപ്പോ ലേല വ്യവസ്ഥകൾക്കും കൂടാതെ താഴെ പറയുന്ന ലേല വ്യവസ്ഥകൾക്കും നിബന്ധനകൾക്കും വിധേയമായി ദർഘാസ്/ലേലത്തിൽ പരസ്യമായി വിൽക്കുന്നതാണ്. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്ന വ്യ‡ികൾ ദർഘാസിന് മുൻപ് പട്ടികയിൽ കാണിച്ചിട്ടുള്ള തുക നിരതദ്രവ്യം കെട്ടിവയ്ക്കേ≠താണ്. വിജയിക്കുന്ന ദർഘാസുകാരൻ/ലേലക്കാരൻ ദർഘാസ്/ലേലത്തുകയുടെ 35% തുക ദർഘാസ്/ലേല ദിവസം മുതൽ ഒരാഴ്ചക്കുള്ളിൽ തന്നെ കെട്ടിവെയ്ക്കേ≠താണ്. വിജയിയായ ദർഘാസുകാരൻ/ലേലക്കാരൻ നിയമപ്രകാരവും കാലാകാലങ്ങളിൽ നിലവിലുളളതുമായ വാറ്റ്, വനവികസന നികുതി, വരുമാന നികുതി, മറ്റ് ബന്ധപ്പെട്ട നികുതികൾ എന്നിവ യഥാസമയം ഒടുക്കേ≠താണ്.
1. ദർഘാസ്/ലേല ദിവസം പൊതു അവധിയായി വന്നാലോ മറ്റേതെങ്കിലും കാരണത്താലോ ദർഘാസ്/ലേലം നടത്താൻ കഴിയാതെ വന്നാൽ ടി ദർഘാസ്/ലേലം അടുത്ത പ്രവൃത്തി ദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും വച്ച് നടത്തുന്നതായിരിക്കും.
2. ദർഘാസ്/ലേലം ഒരു നി›ിത തുകയുടെ അടിസ്ഥാനത്തിലാണ് നി›യിച്ചിരിക്കുന്നത്. ഇതിലേക്കായി സർവ്വേ ചെയ്ത് തിരിച്ചിട്ടുള്ള തോട്ടത്തിലെ നിൽപ്പ് മരങ്ങളുടെ നീക്കം ചെയ്യൽ സംബന്ധിച്ച ജോലിക്ക് വേ≠ിയാണ് ഇത് തീരുമാനിച്ചിരിക്കുന്നത്.
3. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലത്തിന് മുൻപായി ഉൽപ്പന്നങ്ങളുടെ നൽപ്പ് നിൽപ്പ് ക≠് ബോധ്യപ്പെടേ≠തും അവ സംബന്ധിച്ച യാതൊരു പരാതികളും ലേലത്തിന് ശേഷം പരിഗണിക്കുന്നതല്ലാത്തതുമാണ്.
5th MAY 2015] FOREST DEPARTMENT 2684. ദർഘാസുകാരൻ/ലേലക്കാരൻ നേരിട്ട് ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കേ≠താണ്. നിയമപരമായ പവർ ഓഫ് അറ്റോർണി ഇല്ലാത്ത പകരക്കാരെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല.
5. പുനലൂർ ഡിവിഷനിലെയും മറ്റ് സമീപ ഡിവിഷനുകളിലെയും സπൈ കോൺട്രാക്ടർമാരെ ടി ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.
6. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ വിലാസവും കൈയൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽനിന്നും വാങ്ങിയ സർട്ടിഫിക്കറ്റ് നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാക്കേ≠താണ്.
7. ഇൻകം ടാക്സ്, പാൻ കാർഡ് കൈവശമില്ലാത്ത ആരേയും ദർഘാസിൽ/ലേലത്തിൽ പങ്കെടുക്കാൻ അനുവദിക്കുന്നതല്ല.
8. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ ആഫീസ് ജീവനക്കാരുമായോ ഏതെങ്കിലും തരത്തിലുളള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസ്/ലേലദിവസം ദർഘാസുകാരൻ/ലേലക്കാരൻ ഈ ആഫീസിൽ സമർപ്പിക്കേ≠താണ്. ഇത്തരത്തിൽ ദർഘാസുകാരന്/ലേലക്കാരന് ബന്ധപ്പെട്ട ആഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുളള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാൻെറ പേരിലുളള ദർഘാസ്/ലേലം റദ്ദു ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പ് പുനർലേലം ചെയ്യുന്നതാണ്.
9. ദർഘാസ്/ലേലത്തിന് 7 ദിവസങ്ങൾക്ക് ശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുളള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരു ലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10%-ൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽ 20%-ൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും മാത്രമേ പരിഗണിക്കുകയുളളൂ. കൂടാതെ താഴെ പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമാണ്.
(എ) ദർഘാസ്/ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.
(ബി) പോസ്റ്റ് ഓഫറുകാരൻ യഥാർ∞ ദർഘാസ്/ലേലക്കാരൻ ഒടുക്കിയ തുകയുടെ ഇരട്ടി തുക പോസ്റ്റ് ഓഫറിനോടൊപ്പം അടയ്ക്കേ≠താണ്.
(സി) ബന്ധപ്പെട്ട പോസ്റ്റ് ഓഫർ തുകയും മറ്റു നികുതികളും ചെലാൻ മുഖാന്തിരമോ ബാങ്ക് രസീത് വഴിയോ ഈ ആഫീസിൽ നിന്നും രജിസ്റ്റേർഡ് തപാൽ മുഖേന അറിയിച്ച് ഏഴു ദിവസത്തിനുളളിൽ ഒടുക്കി ഈ ആഫീസിൽ ഹാജരാക്കേ≠താണ്. പോസ്റ്റ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ കൂപ്പിന്റെയും അതിലെ നിൽപ്പു മരങ്ങളുടെയും ഗുണനിലവാരവും മറ്റു ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ടശേഷം നി›ിത തുകയ്ക്കുള്ള മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്.
പോസ്റ്റ് ഓഫറുകാരൻ ടി വ്യവസ്ഥകൾ ബോദ്ധ്യപ്പെട്ട് ഉടമ്പടിയിൽ ഏർപ്പെടുന്നപക്ഷം ഇതി∑േൽ ആവശ്യമായ പരസ്യം നൽകി ഒരു പുനർലേലം നടത്തുന്നതാണ്. പുനർ ലേലത്തിൽ ലഭിക്കുന്ന തുക പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കുറവാണെങ്കിൽ, പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയ്ക്ക് ടിയാന്റെ പേരിൽ ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തുന്നതായിരിക്കും. പോസറ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത ലേലത്തുക അടയ്ക്കുന്നതിൽ നിന്നും പിൻമാറുന്നപക്ഷം ടിയാൻ അടച്ചിട്ടുളള സെക്യൂരിറ്റി തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതാണ്.
പുനർലേലത്തിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കൂടുതൽ തുകയ്ക്ക് ലേലം/ ദർഘാസ് നടക്കുകയാണെങ്കിൽ ഉയർന്ന ലേലത്തുക വാഗ്ദാനം ചെയ്ത വ്യ‡ിയുടെ പേരിൽ ലേലം ഉറപ്പിക്കുന്നതും പോസ്റ്റ് ഓഫറുകാരൻെറ സെക്യൂരിറ്റി തുക തിരികെ നൽകുന്നതുമാണ്.
10. കൂടുതൽ വിവരങ്ങൾക്ക് പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസിലോ പത്തനാപുരം റെയിഞ്ച് ഫോറസ്റ്റാഫീസിലോ എല്ലാ പ്രവൃത്തി ദിവസങ്ങളിലും അന്വേഷിച്ചാൽ അറിയാവുന്നതാണ്.
11. ദർഘാസ്/ലേലത്തിൽ പങ്കു ചേരണമെന്നാഗ്രഹിക്കുന്നവർ പട്ടികയിൽ കാണിച്ചിരിക്കുന്ന തുക നിരതദ്രവ്യം കെട്ടിവയ്ക്കേ≠താണ്.
12. കൂടുതൽ തുകയ്ക്ക് ദർഘാസ്/ലേലംകൊളളുന്ന ആൾ മൊത്തം ലേലത്തുകയുടെ 35 ശതമാനത്തിൽ നിരതദ്രവ്യം ഒഴികെയുള്ള തുക 7 പ്രവൃത്തി ദിവസത്തിനകം ഈ ഓഫീസിൽനിന്നും നൽകുന്ന മേലൊപ്പിട്ട ചെലാൻ മുഖാന്തിരം പുനലൂർ സബ് ട്രഷറിയിൽ ഒടുക്കി രസീത് ഹാജരാക്കേ≠തുമാണ്. ടി തുക ഒടുക്കുന്നതിൽ വീഴ്ച വരുത്തിയാൽ ടിയാൻ ഒടുക്കിയിട്ടുളള നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും ടി കൂപ്പ് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതുമായിരിക്കും.
13. പുനർ ലേലം/ദർഘാസ് തുക ആദ്യലേല/ദർഘാസ് തുകയേക്കാൾ കുറവായാൽ ടി നഷ്ടവും മറ്റ് ചിലവുകളും ഉൾപ്പെടെ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർ നി›യിക്കുന്ന തുക നഷ്ടം വരുത്തിയ ദർഘാസ്/ലേലക്കാരനിൽ നിന്നും റവന്യൂ റിക്കവറി ഉൾപ്പെടെയുള്ള നിലവിലുള്ള നിയമപ്രകാരം ഈടാക്കുന്നതാണ്.
14. ദർഘാസ്/ലേലം കൊളളുന്ന ആൾക്ക് പ്രസ്തുത കൂപ്പിൽ എന്യൂമറേറ്റ് ചെയ്തു നിർത്തിയിരിക്കുന്ന മരങ്ങൾക്ക് മാത്രം അവകാശമുളളതും തേക്ക്, ഈട്ടി, മറ്റ് മരങ്ങൾ മുതലായവയ്ക്ക് അവകാശമില്ലാത്തതുമാകുന്നു.
15. വിജയിയായ ദർഘാസ്/ലേലക്കാരൻ നിലവിലുള്ള നിരക്കിൽ മൂല്യവർദ്ധിത നികുതി, വന വികസന നികുതി, വരുമാന നികുതി എന്നിവയും ഒടുക്കേ≠താണ്.
16. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലം കൊള്ളുന്ന ആൾ ` 150-ന്റെ മുദ്രപത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടി കൂടി ലേലം കഴിഞ്ഞാലുടൻ ഒപ്പ് വയ്ക്കേ≠താണ്.
5th MAY 2015] FOREST DEPARTMENT 26917. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുടെ മൂന്നിൽ ഒന്നും മൊത്തം തുകയുടെ 5% ഫോറസ്ററ് ഡെവലപ്പ്മെന്റ ് ടാക്സും നിലവിലുള്ള നിരക്കിൽ വില്പന നികുതി, ഇൻകം-ടാക്സ് എന്നിവകളും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10% സെക്യൂരിററി ഡെപ്പോസിറ്റും വച്ച് ` 150-ന്റെ മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠തുമാണ്. 15 ദിവസത്തിനുള്ളിൽ ടി തുകകൾ ഒടുക്കാതിരുന്നാൽ 12% പലിശയോടുകൂടി തുകകൾ ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയവും 24% പലിശയോടുകൂടി വീ≠ും 15 ദിവസത്തെ സമയവും യു‡ംപോലെ പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ അനുവദിക്കുന്നതാണ്. ഈ കാലാവധിക്കുളളിലും തുക ഒടുക്കാതെ വന്നാൽ കൊല്ലം സതേൺ സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെ 24% പലിശ നിരക്കിൽ 15 ദിവസത്തേക്കും വീ≠ും 48 % പലിശ നിരക്കിൽ കൊല്ലം റീജിയണൽ അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെ 15 ദിവസത്തേക്കും സമയം അനുവദിക്കാവുന്നതാണ്. എന്നാൽ മുകളിൽ പറഞ്ഞ കാലാവധികളെല്ലാം കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും.
18. ബാക്കി മൂന്നിൽ ര≠് ലേലത്തുക ര≠് തുല്യ ഗഡുക്കളായി ഒടുക്കേ≠താണ്. ആദ്യ ഗഡു കരാർ തീയതി മുതൽ 15 ദിവസത്തിനകവും ര≠ാം ഗഡു കരാർ തീയതി മുതൽ ഒരു മാസത്തിനകമോ കരാർ കാലാവധിക്കകമോ ഏതാണോ ആദ്യം ആ കാലാവധിക്കുള്ളിലും ഒടുക്കേ≠താണ്. ടി കാലാവധിക്കുള്ളിൽ പണം ഒടുക്കുവാൻ കഴിയാതെ വന്നാൽ 12% പലിശ നിരക്കിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർക്ക് 15 ദിവസത്തേക്കും 24% പലിശ നിരക്കിൽ കൊല്ലം സതേൺ സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെ 30 ദിവസത്തേക്കും 48% പലിശ നിരക്കിൽ കൊല്ലം റീജിയണൽ അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ്് കൺസർവേറ്ററുടെ യു‡ം പോലെ വീ≠ും 30 ദിവസത്തേക്കും കാലാവധി നീട്ടിക്കൊടുക്കാവു താണ്. എന്നാൽ ഇപ്രകാരം നീട്ടിക്കൊടുക്കുന്ന കാലാവധികളെല്ലാം തന്നെ കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും.
19. ഓരോ തോട്ടത്തിന്റെയും ഉടമ്പടി കാലാവധി താഴെ കാണിച്ചിട്ടു≠്. സാധാരണഗതിയിൽ കൂപ്പിന്റെ കാലാവധിനീട്ടി കൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ, കൊല്ലം ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ എന്നിവർ യഥാക്രമം ഒന്നും ര≠ും മാസം വീതം താഴെ പറയും പ്രകാരം പിഴ ഈടാക്കിക്കൊ≠് ഓരോ ജോലിക്കും കാലാവധി നീട്ടിക്കൊടുക്കുന്നതാണ്.
(എ) നീക്കം ചെയ്യാത്ത രജിസ്ററർ ചെയ്തതും അല്ലാത്തതുമായ തടികൾക്ക് ഓരോ ക്യൂ. മീറററിനും അതിൻെറ ഭാഗത്തിനും ` 100 വീതം.
(ബി) നീക്കം ചെയ്യാത്ത വിറകിന് ഓരോ മെട്രിക് ടണ്ണിനും അതിന്റെ ഭാഗത്തിനും ` 50 വീതം ഒന്നാമത്തെ മാസത്തേക്ക് ടി നിരക്കിലും 2-ാം മാസത്തേക്ക് അതിന്റെ ഇരട്ടിയും 3-ാം മാസത്തേക്ക് ഒന്നാം മാസത്തെ നിരക്കിന്റെ മൂന്നിരട്ടിയും എന്നക്രമത്തിൽ പിഴ ഈടാക്കുന്നതാണ്. ഇപ്രകാരം നീട്ടിനൽകുന്ന തീയതി ക്കുള്ളിലും നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റിലേക്ക് മുതൽകൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ചെയ്തു തീർക്കുവാനുള്ള ബാക്കി ജോലികൾ ഡിപ്പാർട്ട്മെന്റ ് ചെയ്യിക്കുന്നതും ആയതിൽ വച്ചു≠ാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതുമായിരിക്കും.
20. കൂപ്പിൽ ശേഖരിച്ച് വയ്ക്കുന്ന തടികളും വിറകും നീക്കം ചെയ്യാൻ ലൈസൻസ് നൽകുന്നത് നിലവിലുള്ള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും.
21. പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെയോ പത്തനാപുരം റെയിഞ്ചാഫീസറുടെയോ രേഖാമൂലമുളള അനുമതിയോടു കൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ കൂപ്പിൽ പ്രവേശിക്കുവാൻ പാടുള്ളൂ.
22. ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാ സമയവും കൂപ്പിൽ ഉ≠ായിരിക്കണം. കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കുകയും ചെയ്യേ≠തുമാണ്.
23. യാതൊരു കാരണവശാലും പ്ളാന്റേഷനിലേയോ റിസർവ്വിലേയോ മററ് മരങ്ങൾക്കും തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്തുവാൻ പാടില്ല. അങ്ങനെ ഉ≠ാകുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദി ആകുന്നതാണ്.
24. പ്രസ്തുത ജോലി നിർവഹണത്തിനിടയിൽ സർക്കാർ മുതലുകൾക്കോ സ്വകാര്യ വ്യ‡ികളുടെ മുതലുകൾക്കോ ഉ≠ാകുന്ന നാശനഷ്ടത്തിനും കരാറുകാരന്റെ ജോലിക്കാർ, പൊതുജനങ്ങൾ എന്നിവർക്കു സംഭവിക്കാവുന്ന അപകടം, മരണം എന്നിവക്കും കരാറുകാരൻ മാത്രം ഉത്തരവാദിയായിരിക്കുന്നതാണ്.
25. കൂപ്പിന് പുറത്ത് ഫോറസ്റ്റ് ഡിപ്പാർട്ട്മെന്റ ് വക സ്ഥലത്ത് തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടിക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ അനുവാദം നൽകുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണങ്ങളാലോ മോശമായ കാലാവസ്ഥമൂലമോ ഉടമ്പടി കാലാവധിക്കുള്ളിൽ അവ നീക്കം ചെയ്ത് കൊ≠ുപോകാൻ കഴിയാതെ വന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്ടറിന് ` 250 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതായിരിക്കും.
26. കൂപ്പിന് 0.4 കീ. മീററർ (2 ഫർലോംഗ്) ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ അനധികൃത കുറ്റകൃത്യങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്. അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ വിവരം ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥരെ ഉടമ്പടിക്കാരൻ അറിയിക്കേ≠താണ്. ഇതിൽ വീഴ്ച വരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടാവുന്നതാണ്.
27. കരാറുകാരന്റെ സെക്യൂരിററി തുക കാലാവധിക്കുശേഷം കരാറുകാരൻ സെയിൽസ് ടാക്സ്, ഇൻകം ടാക്സ്, അഗ്രികൾച്ചറൽ ഇൻകം ടാക്സ് ഇവയുടെ ക്ളിയറൻസ് സർട്ടിഫിക്കററ് ഹാജരാക്കുന്ന മുറയ്ക്ക് തിരിച്ചു നൽകുന്നതാണ്. എന്നാൽ ടി ഇനത്തിൽ ഗവൺമെന്റിലേക്ക് ബാദ്ധ്യതകൾ വല്ലതുമു≠െങ്കിൽ സെക്യൂരിററി തുകയിൽ നിന്നും ഈടാക്കുന്നതാണ്.

It is hereby notified for the information of the public that the right of collection and removal of remaining standing trees in the 2001 Acacia auriculiformis plantation, Poovalikkuzhy (clear felled area of HNL during 2013-14) in Pathanapuram Range of this Division as specified in the schedule appended below will be sold in Tender cum Auction by the Divisional Forest Officer, Punalur or any other officer authorized by him on 13-5-2015 at 11.30 a. m. in the Divisional Forest Office, Punalur on outright sale basis subject to the terms and conditions of sale of Timber in Government Timber Depots published in Kerala Gazette No. 49 dated 10-12-2013, vide Notification No. Pro. (5)-26274/13 dated 22-11-2013 of the Additional Principal, Chief Conservator of Forests (P.), Forest Headquarters,Thiruvananthapuram and as per General Conditions of the sale of tree growth prevailing in the Department. In case the notified date happens to be a public holiday the Tender/Auction will be conducted on the next working day at the notified place and time.
2. The auction will be on lump-sum basis for the right of collection and removal of remaining trees from the above mentioned 2001 Acacia auriculiformis plantation, Poovalikkuzhy mentioned in the schedule hereto the area of which has been surveyed and demarcated on the ground.
3. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after the Tender/Auction will not be entertained.
4. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another, unless valid power of attorney is produced prior to commencement of Auction/Tender.
5. A supply contractor of Punalur Division or the adjacent divisions will not be allowed to participate in the Auction/Tender.
6. Intending Tenderers/ bidders should produce a certificate obtained from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.
7. Those who does not possess Income Tax PAN Card shall not be allowed to participate in the tender/auction.

The successful Tenderers/Bidders should give an undertaking that he is not related to any officer having control of the work and that he is not a supply contractor of this or any adjacent divisions. If this is proved, it shall result in cancellation of the contract and resale of the coupe at his risk and loss.
9. No petition or post offer received after seven days of the conduct of the Tender/Auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is One Lakh and above and more than 20% where the original bid amount is less than One Lakh will ordinarily be considered. The post offerer will comply with following terms :
(a) Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.
(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender/Auction date.
(c) The remittance should be made by the chalan or bank deposit and the bank receipt should be produced before the Divisional Forest Officer concerned within seven days from the date of receipt of registered notice to that effect.
The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the post offerer satisfied with the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules. In the re-auction, if the price fetched, does not come up to what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.
10. Further particulars can be had either from the Office of the Divisional Forest Officer, Punalur or from the Range Officer, Pathanapuram during working hours.
11. Intending Tenderers/Bidders should deposit Earnest Money Deposit as shown against the schedule before tender/auction.
12. The successful Tenderers/Bidders have to remit 35% sale value on the Tender/Auction date itself. If the 35% value exceeds ` 1,00,000 or the EMD amount whichever is higher will be remitted on the auction date itself and the difference have to be remitted in the Sub Treasury, Punalur within 7 working days through the countersigned chalan issued from this office. If he fails to remit this amount, within the specified time, the EMD will be forfeited to Government and the coupe will be re-auctioned at his risk and loss.
13. If the value fetched in the re-sale/re-tender is less than that obtained in the original tender/sale the difference between them together with all incidental expenditure fixing up the re-sale including notification charges as assessed by the Divisional Forest Officer will be recovered from the defaulting Tenderers/Bidders through legal means including Revenue Recovery Act in force.
14. The participating Tenderers/Bidders have right only for collection and removal of enumerated standing trees and has no right for removing any other trees including Teak, Rose wood etc.
15. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax etc., at the rates prevailing from time to time.
16. The successful Tenderers/Bidders should execute a bounden agreement on Stamp Paper worth `150 after the completion of the Tender/Auction.
17. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit 1/3 rd of the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force and security deposit at 10% of the total sale value. The successful Tenderers/Bidders should execute an agreement on Stamp Paper worth ` 150. In case of failure to remit the amount within 15 days, extension shall be granted by the Divisional Forest Officer for 15 days subject to realization of 12% penal interest. Further extension for 15 days shall be granted by the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the amount within the extended period further extension for 15 days by the Chief Conservator of Forests and 15 days by the Additional Principal Chief Conservator of Forests shall be granted subject to realization of penal interest at 24% and 48% respectively. But all the extension periods mentioned above will be within the original contract period.
5th MAY 2015] FOREST DEPARTMENT 27218. The balance 2/3 sale value should be remitted in two equal instalments by the successful Tenderers/Bidders. The first instalment should be remitted within 15 days from the date of agreement and the second instalment within 30 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers/Bidders fail to remit the above amount within the period mentioned above extension for 15 days by realizing penal interest at 12% by Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Chief Conservator of Forests concerned and further extension for 30 days by the Additional Principal Chief Conservator of Forests concerned by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will be within the original contract period.
19. The period of contract will be as shown in the schedule here to appended. No extension of period of contract shall ordinarily be granted. Under very special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests concerned may grant extension of time for one month and two months respectively on realization of penalty or penalties for completion of each work for each month mentioned below:
(a) Unremoved registered logs and unregistered logs—` 100/m3 or fraction thereof. (b) Unremoved firewood— ` 50/MT or fraction thereof.
Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or un-removed during the original contract period. The penalty for the first month shall be realized at the above rates; double the rate for the second month and three times of the original rate for, the third month shall be realized. If the Tenderers/Bidders fail to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenderers as per the agreement will be forfeited to Government and the Tenderers/Bidders shall not have any right on the produce confiscated to Government.
In the above circumstances the balance work to be executed by the Tenderer shall be completed departmentaly and all the loss sustained to Government in this regard shall be realized from the Tenderers/Bidders.
20. The license for removal of timber and firewood collected from the coupe shall be issued only on the basis of the prevailing norms.
21. The contractor/his agent shall enter the coupe and start work only after getting the written permission from the Divisional Forest Officer, Punalur/ Forest Range Officer, Pathanapuram.
22. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 meters and keep the cairns intact.
23. The contractor will be liable for any damage or loss caused to other trees in the plantation or reserve.
24. The contractor alone will be responsible for any damage/loss caused to public or private properties, injury/death caused to his workmen or general public during the course of the work carried out by him as per the contract.
25. The Divisional Forest Officer will give permission to keep the timber and other produce outside the coupe if requested by the contractor at his risk. But if the collected timber/firewood are not removed within the agreement period due to unforeseen situation/climate, a ground rent @ ` 250/Ha. will be recovered from the contractor.
26. The contractor will be liable for all the illegal activities occurred within 0.4 k.m. perimeter of the coupe. Any such activities noticed will be reported to the forest officials by the contractor, failing which the contract is liable to be cancelled.
27. The security deposit will be refunded only after the successful completion of contract after producing the clearance certificates of VAT, Income Tax etc. If there are any liabilities outstanding in this respect to the Govt. that will be adjusted from the security deposit of the contractor.
28. All common conditions regarding sale coupe are also applicable to this Tender/Auction.

EMD amount of ` 20,000 for Teak Poles/Billets/Firewood and ` 50,000 for Teak Timber (TG CIV) can be remitted through online payment system to MSTC by 6 p. m. on the previous day of the e-auction. The buyer registration number has to be mentioned while paying the EMD. For the benefit of the bidders who are not well versed with the online transactions, for some initial period, Range Forest Officer, Chedleth Range will entertain receipt of EMD in the form of Demand Draft payable at State Bank of Travancore, Sulthan Bathery Branch drawn in favour of Range Forest Officer, Chedleth Range, Pulpally as was done in the old system, by 2 p.m. on the previous day of e-auction. Only the registered customers who will submit the EMD will be able to participate against the eligible lots in e-auction. If the sale value of bid materials is not paid within the specified time period against any of the bid lot by the H1 bidder, the EMD will be forfeited.
