ERRATUM NOTIFICATION
[UNDER SECTION 3(2) OF THE KERALA FOREST (VESTING & MANAGEMENT OF ECOLOGICALLY FRAGILE LAND) ACT, 2003] No. EFL 10-40/2003.
26th May 2015.
An approximate extent of 3.94 Ha. of land in Survey Nos. 392/2D, 392/2A, 392/2F and 392/C of Delampady Village of Kasaragode Taluk was notified as Ecologically Fragile Land under Section 3(1) of the Kerala Forest (Vesting and Management of Ecologically Fragile Land) Ordinance 2001 as per Serial Nos. 1 to 4 in the schedule of the Notification No. C6-21437/2000 dated 12-7-2001 published in Kerala Gazette dated 24-7-2001. On noticing certain errors in the above notification dated 12-7-2001 an Erratum Notification No. EFL 12-213/2006 dated 29-7-2006 was published in the Kerala Gazette dated 15-8-2006 correcting the total extent of the land as 1.58 Ha. in Survey Nos. 392/2D, 392/2B, 392/2F and 392/2E and also some corrections in the boundary descriptions. Again another Erratum Notification No. EFL 12-213/06 dated 1-11-2008 was published in the Kerala Gazette dated 25-11-2008 correcting the notified survey number as 392/2C instead of 392/2E and boundary description of notified EFL in Survey No. 392/2B.
As required under the Act, Survey and demarcation of boundaries of the notified EFL has been completed and the correct details of the EFL are notified as in the schedule below.

An approximate extent of 2.50 Ha. of land comprised in Survey No. 38/4 of Shornur II Village, Ottappalam Taluk was notified as Ecologically Fragile Land under Section 3(1) of the Kerala Forest (Vesting and Management of Ecologically Fragile Land) Ordinance 16/2001 as per Serial Number 101 in the schedule vide Notification No. C4-21437/00 dated 20-10-2000 and published in Kerala Gazette No. 1 dated 2-1-2001. Later the extent has been corrected as 2.1030 Ha. and revised boundary descriptions notified vide Erratum Notification No. EFL 12-252/06 dated 28-12-2009 and published in the Kerala Gazette No. 4 dated 26-1-2010.
The Hon'ble EFL Tribunal Palakkad as per judgement dated 22-11-2012 allowed the OA 23/2009 that an extent of 2.1030 Ha. of the above notified land does not qualify the definition of Ecological Fragile Land as defined under EFL Act.
Hence it is hereby notified that the land in the schedule below is excluded from Ecologically Fragile Land.

Sealed competitive tenders are invited under two cover system for supply and erection of Three Numbers of Swiss Cottage Tents along with fully furnished bathroom over raised concrete platform, at Anappady Campus of Sungam Range in Parambikulam Tiger Reserve during 2015-16 by the undersigned for and on behalf of the Governor of Kerala, from registered eligible persons/ companies. The tenders will be accepted upto 3 p. m. on 24-6-2015 and will be opened at 4 p. m. at the office of the undersigned on the same day in the presence of the tenderers who choose to be present. If the notification date happens to be a holiday, tenders will be opened on the next working day at the same time and place. If the tender could not be held on 24-6-2015, it will be conducted on 26-6-2015 or 30-6-2015 at the same place and time.
Both cover ('A'—Technical specifications and 'B'— Financial specifications) must be effectively sealed and put in another cover, which is also sealed and submitted. Cover 'A' and 'B' will be opened as per the schedule given below. Cover 'B' of those tenderers who satisfy the above in cover 'A' will only be opened. The cover 'B' of the rejected tenderers will be returned without opening on finalization of purchase procedure. The tenderers has to provide a receipt for the same.

നിലമ്പൂർ നോർത്ത് ഡിവിഷനിൽ രജിസ്റ്റർ ചെയ്ത വിവിധ വനം കേസുകളിൽ പിടിച്ചെടുത്ത വാഹനങ്ങൾ ഇപ്പോൾ ഉള്ള സ്ഥിതിയിലും അവസ്ഥയിലും ദർഘാസ്/ലേല അടിസ്ഥാനത്തിൽ 2-7-2015-ന് വിൽപ്പന നടത്തുന്നു. ആയതിനായി മത്സരസ്വഭാവമുള്ള ദർഘാസുകൾ ക്ഷണിച്ചുകൊള്ളുന്നു. പട്ടികയിൽ പറയുന്ന ഓരോ വാഹനത്തിനും വെവ്വേറെ ദർഘാസുകൾ സമർപ്പിക്കേ≠താണ്. ദർഘാസുകൾ സമർപ്പിക്കുന്ന കവറിനുമുകളിൽ വാഹന ലേലം എന്നെഴുതി വാഹന നമ്പർകൂടി രേഖപ്പെടുത്തേ≠താണ്. ദർഘാസ് ഫോറങ്ങൾ ലേല ദിവസം ഉച്ചയ്ക്ക് 1 മണിവരെ ഈ ഓഫീസിൽ നിന്നും ലഭിക്കുന്നതാണ്.

1. വാഹനങ്ങൾ ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസറുടെ അനുവാദത്തോടുകൂടി ആഫീസ് സമയത്ത് പരിശോധിച്ച് അവയുടെ തൽസമയ അവസ്ഥ ബോദ്ധ്യപ്പെടേ≠താണ്. ദർഘാസ്/ലേലത്തിന് ശേഷം തൽസംബന്ധമായ പരാതികൾ സ്വീകരിക്കുന്നല്ല.
2. ദർഘാസ് ഫോറം ആവശ്യമുള്ളവർ അവരെ തിരിച്ചറിയുന്നതിന് ഫോട്ടോ പതിച്ച സർക്കാർ അംഗീകൃത തിരിച്ചറിയൽ കാർഡിന്റെ സാക്ഷ്യപ്പെടുത്തിയ പകർപ്പ് ഹാജരാക്കേ≠താണ്.
3. ഓരോ വാഹനത്തിനും വെവ്വേറെ ദർഘാസുകൾ സമർപ്പിക്കേ≠തും നിരതദ്രവ്യം ഈ ആഫീസിൽ അടയ്ക്കേ≠തുമാണ്.
നി›ിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ദർഘാസുകൾ സ്വീകരിക്കുന്നതല്ല.
4. ദർഘാസുകൾ സ്വീകരിച്ചശേഷം ദർഘാസുകാരിൽ സ്ഥലത്തുള്ളവരെ മാത്രം ഉൾപ്പെടുത്തി ഓരോ വാഹനത്തിനും ലേലം നടത്തുന്നതും അതിനുശേഷം ദർഘാസുകൾ തുറക്കുന്നതുമാണ്. ലേല/ദർഘാസുകളിൽ കൂടുതൽ തുക വാഗ്ദാനം ചെയ്യുന്നവരുടെ പേരിൽ ദർഘാസ്/ലേല തുക തൃപ്തികരമാണെങ്കിൽ ലേലം/ദർഘാസുകൾ താൽക്കാലികമായി ഉറപ്പിച്ച് അംഗീകാരത്തിനായി മേലധികാരികൾക്ക് ശുപാർശ ചെയ്യുന്നതാണ്.
5. ദർഘാസ് നൽകുന്നവർക്ക് മാത്രമേ നിരതദ്രവ്യം കെട്ടി ലേലത്തിൽ പങ്കെടുക്കുവാൻ പറ്റുകയുള്ളൂ.
6. ദർഘാസ് സംഖ്യ ഓരോ വാഹനത്തിനും ` 10,000 (പതിനായിരം)-മോ അതിൽ കുറവോ ആണെങ്കിൽ നിരതദ്രവ്യ സംഖ്യ കഴിച്ചുള്ള ബാക്കി തുക ദർഘാസ് തുറക്കുന്ന ദിവസം ആഫീസിൽ ഒടുക്കേ≠താണ്. ദർഘാസ് സംഖ്യ ` 10,000 (പതിനായിരം)-ൽ കൂടുതലാണെങ്കിൽ നിരതദ്രവ്യം ഉൾപ്പെടെ ദർഘാസ് സംഖ്യയുടെ പകുതി അഥവാ ഏറ്റവും കുറഞ്ഞത് ` 10,000 (പതിനായിരം) ദർഘാസ് ദിവസം തന്നെ ഒടുക്കേ≠തും ബാക്കി തുകയും മറ്റ് നികുതികളും ദർഘാസ് അംഗീകരിച്ചതായി അറിയിപ്പ് കിട്ടി 15 ദിവസത്തിനകം സർക്കാരിലേക്ക് ഒടുക്കി വാഹനം ഏറ്റുവാങ്ങേ≠താണ്. ഇപ്രകാരം വാഹനം നീക്കം ചെയ്യുന്നില്ലായെങ്കിൽ ദർഘാസുകാരൻ ആവശ്യപ്പെടുന്നപക്ഷം മറ്റൊരു 15 ദിവസം കൂടി അനുവദിക്കാവുന്നതാണ്. ഇപ്രകാരം ദീർഘിപ്പിച്ച് നൽകുന്ന കാലത്തേക്ക് ബാക്കി സംഖ്യയ്ക്ക് 12 ശതമാനം പലിശയും ദിവസം ` 20 ക്രമത്തിൽ ഇരുപ്പ് (തറ) വാടകയും ഈടാക്കുന്നതായിരിക്കും.
7. മേൽപ്പറഞ്ഞ പ്രകാരം ദീർഘിപ്പിച്ച് നൽകിയ 15 ദിവസങ്ങൾക്കുള്ളിൽ വാഹനം നീക്കം ചെയ്യുന്നില്ലായെങ്കിൽ വാഹനം ടി ദർഘാസുകാരന്റെ പൂർണ്ണ നഷ്ടോത്തരവാദിത്വത്തിൽ വീ≠ും ലേല/ദർഘാസ് അടിസ്ഥാനത്തിൽ വിൽക്കുന്നതും ത∑ൂലം സർക്കാരിനു≠ാകുന്ന നഷ്ടം വീഴ്ച വരുത്തിയ ലേല/ദർഘാസുക്കാരന്റെ പക്കൽനിന്ന് ഈടാക്കുന്നതുമാണ്. വീഴ്ചവരുത്തിയ ദർഘാസുകാരൻ സർക്കാരിലേക്ക് ഒടുക്കിയ തുക ക≠ുകെട്ടുന്നതും ടി തുകയ്ക്ക് ടിയാന് യാതൊരുവിധ അവകാശവും ഉ≠ായിരിക്കുന്നതുമല്ല.
8. ഏറ്റവും കൂടിയ തുക വാഗ്ദാനം ചെയ്യുന്ന ദർഘാസുകാരൻ മേൽപ്പറഞ്ഞ വിധം ദർഘാസ് ദിവസം തുക ഒടുക്കുന്നതിന് തയ്യാറാകാതിരുന്നാൽ ടിയാൻ ഒടുക്കിയ നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടി മുതൽക്കൂട്ടുന്നതും ലേലം/ദർഘാസ് അടുത്ത കൂടുതൽ തുക വാഗ്ദാനം ചെയ്ത ദർഘാസുകാരന്റെ പേരിൽ താൽക്കാലികമായി ഉറപ്പിക്കുന്നതുമായിരിക്കും. ഇപ്രകാരം ക≠ുെ കട്ടുന്ന തുകയ്ക്ക് വീഴ്ച വരുത്തിയ ദർഘാസുകാരന് യാതൊരുവിധ അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല.

11. ദർഘാസ്/ലേലം സംബന്ധിച്ച് നിയമാനുസൃതമായ പോസ്റ്റ് ഓഫറുകൾ എന്തെങ്കിലുമു≠െങ്കിൽ ആയത് ദർഘാസ്/ ലേലത്തീയതി മുതൽ ഏഴ് ദിവസത്തിനകം ഈ ആഫീസിൽ ഹാജരാക്കേ≠താണ്. നി›ിത തീയതിക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ സ്വീകരിക്കുന്നതല്ല. പോസ്റ്റ് ഓഫറുകൾ നൽകുന്നത് സംബന്ധിച്ച് നിലവിലുള്ള എല്ലാ നിയമങ്ങളും ഇവിടെയും ബാധകമായിരിക്കും.

It is hereby notified for the information of the public that the Tender-cum-Auction sale of the following seized vehicles of this Division will be conducted in the office of the undersigned on 2-7-2015 at 3.30 p. m. Sealed tenders superscribed as "Tender of vehicles" and registration number should be submitted for each vehicle. The tender forms will be issued from the office of the undersigned during office hours till 1 p. m. of the date of tender/auction and the filled forms will be accepted till 3 p. m. on the same day. Tender forms are not transferable. Value of tender forms once realised will not be refunded at any cost. EMD as per the schedule attached has to be remitted along with filled tender form. Tender forms not accompanied with EMD will be rejected. Auction will be conducted among the tenderers at 3.30 p. m. at Divisional Forest Office, Nilambur North Division by the undersigned or the officer authorised by him on the same day and the tenders will be opened thereafter. If the date of opening of tender falls on a holiday, the same will be opened on the next working day at the appointed place and time. The sale of vehicle will be confirmed in the name of persons offer highest amount in the tender or in the auction on the day subject to the final order of the officer delegated. (4)-29243/2013 dated 17-10-2014 of Additional Principal Chief Conservator of Forests (Protection), Thiruvananthapuram published in Kerala Gazette No. 43, Volume III Part III dated 4-11-2014 and Notification No. Pro. (4)-29243/2013 dated 3-2-2015 of Additional Principal Chief Conservator of Forests (Vigilance), Thiruvananthapuram published in Kerala Gazette No. 8, Volume IV Part III dated 24-2-2015.
The Divisional Forest Officer, Nilambur North reserves all the right to exclude any quantity of teak and miscellaneous firewood shown in the schedule above from sale. EMD amount of ` 20,000 for teak and miscellaneous firewood can be remitted through online payment system to MSTC by 6 p.m. on the previous day of the e-auction. The buyer registration number has to be mentioned while paying the EMD. For the benefit of the bidders who are not well versed with the online transactions, for some initial period, Range Forests Officer, Edavanna Range will entertain receipt of EMD in the form of Demand Draft payable at State Bank of Travancore, Nilambur Branch drawn in favour of Range Forest Officer, Edavanna Range as was done in the old system, by 2 p.m. on the previous day of e-auction. Only the registered customers who will submit the EMD will be able to participate against the eligible lots in e-auction. If the sale value of bid materials is not paid within the specified time period against any of the bid lot by the H1 bidder, the EMD will be forfeited.
The successful bidder, 35% of the bid value, after adjusting the EMD already remitted, shall be paid within 7 working days of issuance of acceptance letter. The mode of payment is through e-treasury of Government of Kerala or Demand Draft (DD) drawn in favour of Range Forest Officer, Edavanna Range payable at State Bank of Travancore, Nilambur Branch or by cash in Sub Traeasury, Nilambur. If any amount is charged by bank for clearing the Demand Draft, the same shall be borne by the bidder himself.
If any modifications or change in the sale conditions are intimated by the Government/Forest Department, that will also be applicable to this e-auction sale and it will be informed to the bidder before e-auction. The undersigned reserves the right to alter the quantities of the materials mentioned in the above schedule or to cancel the e-auction of any materials without further notice.
