Sub:—Excise Establishment—Final Seniority List of Assistant Excise Inspectors for the period from 1-1-2013 to 31-12-2014—Published—Orders Issued.

Seniority List of Preventive Officers for the period from 2-2-1993 to 30-6-2003 was revised and published vide order read 2nd above in compliance to the judgments of the Hon'ble High Court and the resultant Government directions vide order read 1st above. Aggrieved Preventive Officers filed Civil Appeal No. 3913-31/2011 before the Hon'ble Supreme Court of India. The same is pending with the Hon'ble Apex Court. Final Seniority List of Preventive Officers, for the period from 1-7-2003 to 31-12-2008 was published vide order read as 3rd above. Based on the above Seniority List of Preventive Officers, Seniority List of Assistant Excise Inspectors for the period from 1-1-2009 to 31-12-2012 was finalized and published vide order read as 4th above.

As per the proceedings read as 5th above the Provisional Seniority List of Assistant Excise Inspectors for the period from 1-1-2013 to 31-12-2014 was published and forwarded to all Joint Excise Commissioners, Deputy Excise Commissioners, Assistant Excise Commissioners to the same to serve all concerned and called for objections if any to be considered before finalizing the list on the Commissionerate of Excise within 30 days from the date of order. The seniority list was published in the website of the department and also sent to all offices through e-mail.

Accordingly three objections/representations were received. Sri G. R. Anilkumar and Sri M.V. Ibrahimkutty submitted representations noting errors happened with regard to their date of entry in service, date of birth etc. Sri N. Chandrababu (Sl. No. 37) has submitted that the probation in the cadre of Preventive Officer with respect to Sri V. J. Madhu (Rank No. 1577 of Final Seniority List of Preventive Officers) was declared only on 21-10-2014 hence his seniority might be assigned later. But he has been mistakenly placed above him (Sl. No. 11) in the Provisional Seniority List, hence requested to rearrange his position at eligible place as per rules.

All the above representations have been examined individually and necessary modifications have been effected in cases wherever necessary pursuant to objections found acceptable. The objections were finally disposed of and replies given individually.

Even though Sri V. J. Madhu entered service as Excise Guard on 27-7-1988 and was promoted as Preventive Officer on 1-10-2002, his probation in the cadre of Preventive Officer was declared only on 21-10-2014 vide Order No. DP2-679/14 dated 21-10-2014. Sri V. J. Madhu has not passed the departmental test required for promotion to the post of Assistant Excise Inspector. As he belonged to SC/ST category, he has been temporarily promoted as Assistant Excise Inspector vide Order No. XD3-31386/14 dated 23-12-2014 under Rule 13 (A)(1)(a) and 13(A) 2 of KS & SSR part 2 and G.O. (P) No. 14/12/P & ARD dated 24-2-2012 subject to the condition that if he does not pass the departmental test within three years from the date of promotion he will be reverted to the post of Preventive Officer.

As per the above said rule, an approved probationer can only be given provisional promotion if he belongs to Scheduled Caste or Scheduled Tribe. Therefore his place has been lowered in the seniority list to the vacancy which arose very next to the date after declaration of probation in the cadre of Preventive Officer.

In the above circumstances, the Provisional Seniority List of Assistant Excise Inspectors for the period from 1-1-2013 to 31-12-2014 which was published as per the proceedings read 5th above is finalized subject to the final decision in Civil Appeal No. 3913-31/2011 filed before the Hon'ble Supreme Court of India and published herewith.
