DE-NOTIFICATION

[UNDER SECTION 3(2) OF THE KERALA FOREST (VESTING & MANAGEMENT OF ECOLOGICAL FRAGILE LAND) ACT, 2003] No. EFL-6-132/2010.

30th June 2015.

An approximate extent of 1.5054 Ha of land comprised in Survey No. 211, 213/4 of Kadampazhipuram Village, Ottapalam Taluk was notified as Ecologically Fragile Land under section 3(1) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Ordinance 16 of 2001 vide Notification No. C6-21437/00 dated 12-7-2001 and published in Kerala Gazette No. 36 dated 11-9-2001 as Sl. No. 59.

The Hon'ble EFL Tribunal, Palakkad as per Judgment dated 28-11-2014 allowed the OA 32/10 that the above notified land does not qualify the definition of Ecologically Fragile Land as defined under EFL Act.

Hence it is hereby notified that the land detailed in the Schedule below is excluded from Ecologically Fragile Land.

Explanatory Note

(This does not form part of the notification, but is intended to indicate the general purpose).

An approximate extent of 0.8990 Ha was notified as EFL under Section 3(1) of the Kerala Forest (V/M of EFL) Act, 2003 vide Notification No. EFL 10-311/13 dated 26-10-2013 and published in Kerala Gazette No. 48 Volume 2 dated 3-12-2013 as Sl. No. 37. Later on detailed verification of records and field verification it is found that the notified extent is lying in two bits having separate boundaries. Though the notified area is the sum of the above said two bits, the extent and boundaries have varied. Boundary description in original notification needs correction. The erratum notification is published in the interim to achieve the above objective.

It is hereby notified that Teak Timber IV, Teak Poles, Teak billets and jungle wood fire wood collected from final felling areas of 1950 & 1951 Teak plantation at Punnamonvayal in Chittar North section of Kulathupuzha Range and Acacia timber collected from 2003 Kuttapara Acacia plantation in Aryanad-Palode section of Paruthipally Range in Thiruvananthapuram Division will be sold through e-Auction shown in the schedule, by the Divisional Forest Officer, Thiruvananthapuram or any officer authorized by him, subject to the conditions published in Kerala Gazette No. 43, Vol. III dated 4-11-2014 vide Notification No. Pro.(4) 29243/13 dated 17-10-2014 of the Additional Principal Chief Conservator of Forests (P), Thiruvananthapuram and other conditions prevalent in the Forest Department. Besides the quantity shown in the schedule, the quantity if any delivered to dumping sites before the date of e-Auction and that could be lotted immediately before the e-auction will also be placed in the e-auction. Those who wish to participate have to remit an amount of ` 50,000 for Teak timber, ` 20,000 for Teak poles and Teak billets and firewood/jungle wood and ` 25,000 for acacia timber as EMD as e-payment before the e-auction through MSTC limited. Successful bidders will have to remit 35% of the bid amount on the e-auction itself through e-payment. Successful bidders will have to remit the balance value, VAT, Forest Development Tax, Income Tax and such other taxes that are prevailing at the time of e-auction within the stipulated time limit.

The Earnest Money Deposit should be submitted on e-payment/e-treasury/demand draft/MSTC through the internet online banking of SBT or through NEFT for other banks. All bids/e-auction documents are to be submitted online only and in the designated online cover (s)/envelope (s) on the www.mstcecommerce.com. The bidders who wish to participate in the e-auction should produce a certificate showing the permanent address and signature of the bidders duly attested by the concerned Village Officer, or any other approved identity documents along with the EMD through online. Those who do not produce any approved Identity Card or Certificate will not be eligible to participate in the e-auction.

Intending persons may ensure the quantity and quality of materials put up for e-auction before the commencement of the same and no complaints will be entertained after the e-auction. In case any Govt. Department requires any of the materials put up for the e-auction, the quantity remaining after their selection only will be re-auctioned. It is hereby notified that Teak Poles, Teak Billets and Jungle wood fire wood collected from the final felling/ thinning of Teak Plantation in Erumely Range of Kottayam Division will be sold through e-Auction shown in the schedule, by the Divisional Forest Officer, Kottayam or any officer authorized by him, subject to the conditions published in Kerala Gazette No. 50 Vol. III dated 23-12-2014 vide Notification No. Pro. (4) 26243/13, dated 3-12-2014 of the Additional Principal Chief Conservator of Forests (P), Thiruvananthapuram and other conditions prevalent in the Forest Department.

Besides the quantity shown in the schedule, the quantity if any delivered to dumping sites before the date of e-Auction will also be included in the sale.

The Earnest Money Deposit should be submitted on e-payment/e-treasury/demand draft/MSTC through the internet online banking of SBT or through NEFT for other banks. 2. The bidding authority deserves the right to modify/ cancelled any/all bids without assigning any reason. The Forest Department will not be responsible for any error like missing of scheduled data while downloading by the bidder and non receipt of documents.

The Divisional Forest Officer, Nilambur South reserves all the right to exclude any class or quantity of teak and miscellaneous poles shown in the schedule above for sale. EMD amount of ` 20,000 for teak and miscellaneous poles, firewood can be remitted through online payment system to MSTC by 6 p.m. on the previous day of the e-auction. The buyer registration number has to be mentioned while paying the EMD. For the benefit of the bidders who are not well versed with the online transactions, for some initial period, Range Forests Officer, Karulai Range will entertain receipt of EMD in the form of Demand Draft payable at State Bank of Travancore, Nilambur Branch drawn in favour of Range Forest Officer, Karulai Range as was done in the old system, by 2 p.m. on the previous day of e-auction. Only the registered customers who will submit the EMD will be able to participate against the eligible lots in e-auction. If the sale value of bid materials is not paid within the specified time period against any of the bid lot by the H1 bidder, the EMD will be forfeited.

The successful bidder, 35% of the bid value, after adjusting the EMD already remitted, shall be paid within 7 working days of issuance of acceptance letter. Bidders are requested to submit scanned copy of the following documents Registration Certificate duly attested by the PWD Kerala, EMD exemption certificate (if any), preliminary agreement executed in Kerala Stamp Paper worth ` 500 duly filled up to proforma for availing e-payment by Online. Subsequently the hard copy of attested copy of Registration Certificate, Bid document, EMD exemption certificate (if any), preliminary agreement in original would be submitted offline in a sealed cover superscribing the name of work and tender number to the Office of the Divisional Forest Officer, Nilambur North Division through speed post/registered post as prescribed in the time schedule, failing which such tenders will be rejected.

2. The bidding authority reserves the right to modify/ cancel any/all bids without assigning any reason. The Forest Department will not be responsible for any error like missing of scheduled data, while downloading by the bidder and non receipt of documents.

3. Any other classifications on this tender can be obtained from NIC/KITM, the e-Tender help desk number available in the www.etenders.kerala.gov.in website and from this office (04931 220232) during the office hours. The details regarding e-payment (bidder's bank account number where he/she is having core banking facility and email ID) should be submitted along with the tender. Tenders without these details will not be accepted. Technical bid and financial bid shall be submitted in their respective designated online covers.

4. The Forest Department will not be responsible for any inconvenience or loss to the bidder while uploading/downloading the bid.

5. The tender/bids shall be opened online at the Office of the Divisional Forest Officer, Nilambur North Division at the presence of bidders/their representatives who wish to attend in the above address. If the date of opening tender happens to be a holiday or non working day due to any other valid reason, the tender opening process will be do on the next working day.

1. വാഹനങ്ങൾ ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസറുടെ അനുവാദ ത്തോടുകൂടി ആഫീസ് സമയത്ത് പരിശോധിച്ച് അവയുടെ തൽസമയ അവസ്ഥ ബോദ്ധ്യപ്പെടേ≠താണ്. ദർഘാസിന്/ലേലത്തിനുശേഷം തൽസംബന്ധമായ പരാതികൾ സ്വീകരിക്കുന്നല്ല.

2. ദർഘാസ് ഫോറം ആവശ്യമുള്ളവർ അവരെ തിരിച്ചറിയു ന്നതിന് ഇലക്ഷൻ തിരിച്ചറിയൽ കാർഡിന്റെ സാക്ഷ്യ പ്പെടുത്തിയ പകർപ്പ് ഹാജരാക്കേ≠താണ്.

3. വാഹനത്തിന് പ്രത്യേകം ദർഘാസുകൾ സമർപ്പി ക്കേ≠തും നിരതദ്രവ്യം ഈ ആഫീസിൽ അടയ്ക്കേ≠തുമാണ്. നി›ിത സമയത്തിനുശേഷം ലഭിക്കുന്ന ദർഘാസുകൾ സ്വീകരിക്കുന്നതല്ല.

4. ദർഘാസുകൾ സ്വീകരിച്ചശേഷം ദർഘാസുകാരിൽ സ്ഥലത്തുള്ളവരെ മാത്രം ഉൾപ്പെടുത്തി ലേലം നടത്തുന്നതും അതിനുശേഷം ദർഘാസുകൾ തുറക്കുന്നതുമാണ്. ലേല/ദർഘാസുകളിൽ കൂടുതൽ തുക വാഗ്ദാനം ചെയ്യുന്നവരുടെ പേരിൽ ദർഘാസ്/ ലേല തുക തൃപ്തികരമാണെങ്കിൽ ലേലം/ദർഘാസു കൾ താൽക്കാലികമായി ഉറപ്പിച്ച് അംഗീകാരത്തിനായി മേലധികാരികൾക്ക് ശുപാർശ ചെയ്യുന്നതാണ്.

5. ദർഘാസ് നൽകുന്നവർക്ക് മാത്രമേ നിരതദ്രവ്യം കെട്ടി ലേലത്തിൽ പങ്കെടുക്കുവാൻ പറ്റുകയുള്ളൂ.

6. ദർഘാസ് സംഖ്യ ` 10,000 (പതിനായിരം)-മോ അതിൽ കുറവോ ആണെങ്കിൽ നിരതദ്രവ്യ സംഖ്യ കഴിച്ചുള്ള ബാക്കി തുക ദർഘാസ് തുറക്കുന്ന ദിവസം ആഫീസിൽ ഒടുക്കേ≠താണ്. ദർഘാസ് സംഖ്യ ` 10,000 (പതിനായിരം)-ൽ കൂടുതലാണെങ്കിൽ നിരത ദ്രവ്യം ഉൾപ്പെടെ ദർഘാസ് സംഖ്യയുടെ പകുതി അഥവാ ഏറ്റവും കുറഞ്ഞത് ` 10,000 (പതിനായിരം) ദർഘാസ് ദിവസം തന്നെ ഒടുക്കേ≠തും ബാക്കി തുകയും മറ്റ് നികുതികളും ദർഘാസ് അംഗീകരിച്ചതായി അറിയിപ്പ് കിട്ടി 15 ദിവസത്തിനകം സർക്കാരിലേക്ക് ഒടുക്കി വാഹനം ഏറ്റുവാങ്ങേ≠തുമാണ്. ഇപ്രകാരം വാഹനം നീക്കം ചെയ്യുന്നില്ലായെങ്കിൽ ദർഘാസുകാരൻ ആവശ്യപ്പെടുന്നപക്ഷം മറ്റൊരു 15 ദിവസം കൂടി അനുവദിക്കാവുന്നതാണ്. ഇപ്രകാരം ദീർഘിപ്പിച്ച് നൽകുന്ന കാലത്തേക്ക് ബാക്കി സംഖ്യയ്ക്ക് 12 ശതമാനം പലിശയും ദിവസം ` 20 ക്രമത്തിൽ ഇരുപ്പ് (തറ) വാടകയും ഈടാക്കുന്നതായിരിക്കും.

7. മേൽപ്പറഞ്ഞ പ്രകാരം ദീർഘിപ്പിച്ച് നൽകിയ 15 ദിവസങ്ങൾക്കുള്ളിൽ വാഹനം നീക്കം ചെയ്യുന്നില്ലാ യെങ്കിൽ വാഹനം ടി ദർഘാസുകാരന്റെ പൂർണ്ണ നഷ്ടോത്തരവാദിത്വത്തിൽ വീ≠ും ലേല/ദർഘാസ് അടിസ്ഥാനത്തിൽ വിൽക്കുന്നതും ത∑ൂലം സർക്കാരിനു ≠ാകുന്ന നഷ്ടം വീഴ്ച വരുത്തിയ ലേല/ ദർഘാസുകാരന്റെ പക്കൽ നിന്ന് ഈടാക്കുന്നതുമാണ്. വീഴ്ചവരുത്തിയ ദർഘാസുകാരൻ സർക്കാരിലേക്ക് ഒടുക്കിയ തുക ക≠ുകെട്ടുന്നതും ടി തുകയ്ക്ക് ടിയാന് യാതൊരുവിധ അവകാശവും ഉ≠ായിരിക്കുന്നതുമല്ല.

11. ദർഘാസ്/ലേലം സംബന്ധിച്ച് നിയമാനുസൃതമായ പോസ്റ്റ് ഓഫറുകൾ എന്തെങ്കിലുമു≠െങ്കിൽ ആയത് ദർഘാസ്/ലേലത്തീയതി മുതൽ ഏഴ് ദിവസത്തിനകം ഈ ആഫീസിൽ ഹാജരാക്കേ≠താണ്. നി›ിത തീയതിക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ സ്വീകരി ക്കുന്നതല്ല. പോസ്റ്റ് ഓഫറുകൾ നൽകുന്നത് സംബന്ധിച്ച് നിലവിലുള്ള എല്ലാ നിയമങ്ങളും ഇവിടെയും ബാധകമായിരിക്കും.

8. ഏറ്റവും കൂടിയ തുക വാഗ്ദാനം ചെയ്യുന്ന ദർഘാസുകാരൻ മേൽപ്പറഞ്ഞ വിധം ദർഘാസ് ദിവസം തുക ഒടുക്കുന്നതിന് തയ്യാറാകാതിരുന്നാൽ ടിയാൻ ഒടുക്കിയ നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടി മുതൽക്കൂട്ടു ന്നതും ലേലം/ദർഘാസ് അടുത്ത കൂടുതൽ തുക വാഗ്ദാനം ചെയ്ത ദർഘാസുകാരന്റെ പേരിൽ താൽക്കാലികമായി ഉറപ്പിക്കുന്നതുമായിരിക്കും. ഇപ്രകാരം ക≠ുകെട്ടുന്ന തുകയ്ക്ക് വീഴ്ച വരുത്തിയ ദർഘാസുകാരന് യാതൊരുവിധ അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല.

12. ദർഘാസ് സംബന്ധിച്ച് ഫോറസ്റ്റ് ഡിപ്പാർട്ട്മെന്റ ിൽ നിലവിലുള്ള പൊതുനിയമങ്ങളും മറ്റ് നിബന്ധനകളും ഈ ദർഘാസ്/ലേലത്തിനും ബാധകമായിരിക്കും. നിലവിലുള്ള നിബന്ധനകൾ കാലാനുസൃത മാറ്റത്തിനു വിധേയമായിരിക്കും.

9. ദർഘാസ് സ്വീകരിക്കുന്നതിനും നിരാകരിക്കുന്നതിനും ആവശ്യമെങ്കിൽ കാരണം ബോധിപ്പിക്കാതെ റദ്ദാക്കുന്നതിനും ഉള്ള അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമാണ്.
