The Divisional Forest Officer, Achencovil for and on behalf of the Governor of Kerala invites online tenders from registered bidders having a valid and active registration with PWD for the following works. Tender documents and tender schedules may be downloaded free of cost from the e-GP website www.etenders.kerala.gov.in. All bid/tender documents are to be submitted online only and in the designation online cover(s)/envelope(s) on the www.etenders.kerala.gov.in website. Bids shall be accepted only through online mode www.etenders.kerala.gov.in website and tenders submitted manually/through post will not be entertained. Late online bids will not be accepted.

15th SEPT. 2015] FOREST DEPARTMENT 5541. Bidders shall remit the tender document fee and the Earnest Money Deposit using online payment option of e-procurement system only and submitted through the internet online banking of State Bank of Travancore or through NEFT for other banks. Bidders opting for NEFT facility of online payment are advised to exercise this option at least 72 hours before the closing date of bid to ensure that payment towards tender document fees and EMD are credited and a confirmation is reflected in the e-procurement system. The online NEFT remittance form provided by e-procurement system for making a NEFT transaction is not a payment confirmation. Kerala Forest Department/NIC/SBT shall not be any kind of delay in payment status confirmation.
2. Bidders are requested to submit scanned copy of the following documents Registration Certificate duly attested by the Superintendent Engineer/ Executive Engineer, PWD Kerala, EMD exemption certificate (if any), preliminary agreement executed in Kerala Stamp Paper worth ` 150 duly filled up proforma for availing e-payment by Online. Subsequently the hard copy of attested copy of Registration Certificate, EMD exemption certificate (if any), preliminary agreement in original would be submitted offline in a sealed cover superscribing the name of work and tender number to the office of the Divisional Forest Officer, Achencovil through speed post/registered post as prescribed in the time schedule, failing which such tenders will be rejected.
3. The bidding authority deserves the right to modify/ cancel any/all bids without assigning any reason. The Forest Department will not be responsible for any error like missing of scheduled data while downloading by the bidder and non receipt of documents.
4. Any further clarifications on this tender can be obtained from NIC/the e-tender Helpdesk number available in the www.etenders.kerala.gov.in website and from this office during the office hours. The details regarding e-payment (Bidder's bank account number where he/she is having core banking facility and email ID) should be submitted along with the tender. Tenders without these details will not be accepted. Technical bid and financial bid shall be submitted in their respective designated online covers.
5. The Forest Department will not be responsible for any inconveniences or loss to the Bidder while uploading/downloading the bid.
6. The tender/bids shall be opened online at the office of the Divisional Forest Office, Achencovil in the presence of bidders/their representatives who wish to attend at the above address. If the tender opening date happens to be on a holiday or non working day due to any other valid reason, the tender opening process will be done on the next working day at same time and place.
7. All other existing conditions related to e-tendering of Kerala PWD will be applicable in this tender also.

It is hereby notified that Teak Poles, Teak Billets and Jungle wood/fire wood collected from final felling/thinning areas of 1953 Teak Plantation at Kambiline (Muthalathodu), 1954 Teak plantation at Muthalathodu, 1967 MW Plantation at Manalar, 1968 MW Plantation at Harijan Colony in Achencovil Range of Achencovil Division will be sold through e-auction shown in the schedule, by the Divisional Forest Officer, Achencovil or any officer authorized by him, subject to the conditions published in Kerala Gazette No. 50 Vol. III dated 23-12-2014 vide Notification No. Pro. (4) 26243/13 dated 3-12-2014 of the Additional Principal Chief Conservator of Forests (P), Thiruvananthapuram and other conditions prevalent in the Forest Department. Besides the quantity shown in the Schedule, the quantity if any delivered to dumping sites before the date of e-auction and that could be loted immediately before the e-auction will also be placed in the e-auction. The produce included in Schedule I (132.50 MT of JW FW) will be sold at the risk and loss of the original bidder, Sri. C.D. Sanu, Sabu Nivas, Achencovi1. The producers included in schedule No. II (Teak Poles II C-199 Nos.) will be sold at the risk and loss of the original bidder, Sri Sathyapalan, P. K., Thadathil Timbers, Kanakapalam P. നിബന്ധനകൾ
1. ടെ≠ർ/ലേലം ഒരു നി›ിത തുകയുടെ അടിസ്ഥാന ത്തിലാണ് നി›യിച്ചിരിക്കുന്നത്. പട്ടികയിലെ നിൽപ്പ് മരങ്ങളുടെ നീക്കം ചെയ്യൽ സംബന്ധിച്ച ജോലിക്കു വേ≠ിയാണ് ഇത് തീരുമാനിച്ചിരിക്കുന്നത്.
2. മേൽ ഒന്നാം പട്ടികയിലേയും ര≠ാം പട്ടികയിലേയും ദർഘാസ്/ലേലം വെവ്വേറെ നടത്തുന്നതും ആയതിനാൽ അവയ്ക്കായി പ്രത്യേകം ടെ≠ർ സമർപ്പിക്കേ≠തും ലേലം വിളി കേൾക്കേ≠തുമാണ്.

6. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ വിലാസവും കൈയൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ സർട്ടിഫിക്കറ്റ് ബന്ധപ്പെട്ട വില്ലേജ് ഓഫീസറിൽനിന്നും വാങ്ങി നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാക്കേ≠താണ്.
7. ഇൻകം ടാക്സ് പാൻ കാർഡ് കൈവശമില്ലാത്ത ആരേയും ദർഘാസിൽ/ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.
8. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ ആഫീസുമായോ, ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു സാക്ഷ്യപത്രം ദർഘാസ്/ ലേല ദിവസം ദർഘാസ്/ലേലക്കാരൻ ഈ ആഫീസിൽ സമർപ്പിക്കേ≠താണ്. ഇത്തരത്തിൽ ദർഘാസുകാരന്/ ലേലക്കാരന് ബന്ധപ്പെട്ട ആഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാന്റെ പേരിലുള്ള ദർഘാസ്/ ലേലം റദ്ദ് ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി മരങ്ങൾ പുനർലേലം ചെയ്യുന്നതാണ്.
9. ദർഘാസ്/ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുള്ള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരു ലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10%-ൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽപ്പെട്ട ലേലങ്ങൾക്ക് 20%-ൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും മാത്രമേ പരിഗണിക്കുകയുള്ളു. കൂടാതെ താഴെപ്പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമാണ്.
(എ) ദർഘാസ്/ലേലത്തിന് 7 ദിവസത്തിനുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.
(ബി) പോസ്റ്റ് ഓഫറുകാരൻ യഥാർ∞ ദർഘാസ്/ ലേലക്കാരൻ ഒടുക്കിയ തുകയുടെ ഇരട്ടി തുക അടയ്ക്കേ≠താണ്.
(സി) ബന്ധപ്പെട്ട പോസ്റ്റ് ഓഫർ തുകയും മറ്റ് നികുതികളും ചെലാൻ മുഖാന്തിരമോ ബാങ്ക് രസീത് വഴിയോ ഈ ആഫീസിൽ നിന്നും രജിസ്റ്റേർഡ് തപാൽ മുഖേന അറിയിച്ച് ഏഴു ദിവസത്തിനുള്ളിൽ ഒടുക്കി ഈ ആഫീസിൽ ഹാജരാക്കേ≠താണ്. പോസ്റ്റ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ നിൽപ്പുമരങ്ങളുടെ ഗുണനിലവാരവും മറ്റ് ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ടശേഷം നി›ിത മുദ്രപ്പത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്.
(ഡി) പോസ്റ്റ് ഓഫറുകാരൻ ടി വ്യവസ്ഥകൾ ബോദ്ധ്യ പ്പെട്ട് ഉടമ്പടിയിൽ ഏർപ്പെടുന്നപക്ഷം ഇതിൻമേൽ ആവശ്യമായ പരസ്യം നൽകി ഒരു പുനർലേലം നടത്തുന്നതാണ്. പുനർ ലേലത്തിൽ ലഭിക്കുന്ന തുക പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കുറവാണെങ്കിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയ്ക്ക് ടിയാന്റെ പേരിൽ ദർഘാസ്/ലേലം സ്ഥിരപ്പെടു ത്തുന്നതായിരിക്കും. പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത ലേലത്തുക അടയ്ക്കുന്നതിൽ നിന്നും പിൻമാറുന്നപക്ഷം ടിയാൻ അടച്ചിട്ടുള്ള സെക്യൂരിറ്റി തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്ന താണ്. പുനർലേലത്തിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കൂടുതൽ തുകയ്ക്ക് ലേലം/ദർഘാസ് നടക്കുകയാണെങ്കിൽ ഉയർന്ന ലേലത്തുകയ്ക്ക് ആ വ്യ‡ിയുടെ പേരിൽ ലേലം ഉറപ്പിക്കുന്നതും പോസ്റ്റ് ഓഫറുകാരന്റെ സെക്യൂരിറ്റി തുക തിരികെ നൽകുന്നതുമാണ്.
10. കൂടുതൽ വിവരങ്ങൾ തെ∑ല ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസിലോ തെ∑ല റെയ്ഞ്ച് ഫോറസ്റ്റ് ആഫീസിലോ എല്ലാ പ്രവൃത്തി ദിവസങ്ങളിലും അന്വേഷിച്ചാൽ അറിയാവുന്നതാണ്.
11. ദർഘാസ്/ലേലത്തിൽ പങ്ക് ചേരണമെന്നാഗ്രഹിക്കുന്നവർ ` 5,500 (അയ്യായിരത്തി അഞ്ഞൂറ്) നിരതദ്രവ്യം കെട്ടിവയ്ക്കേ≠താണ്.
12. കൂടുതൽ തുകയ്ക്ക് ദർഘാസ്/ലേലം കൊള്ളുന്ന ആൾ മൊത്തം ലേലത്തുകയുടെ 35% തുക ലേലം കഴിഞ്ഞാലുടൻ ഒടുക്കേ≠താണ്. ടി തുക ഒടുക്കുന്നതിൽ വീഴ്ച വരുത്തിയാൽ ടിയാൻ ഒടുക്കിയിട്ടുള്ള നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും ടി മരങ്ങൾ ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർ ലേലം ചെയ്യുന്നതുമായിരിക്കും.
13. ദർഘാസ്/ലേലം കൊള്ളുന്ന ആൾക്ക് പ്രസ്തുത മരങ്ങൾക്ക് മാത്രം അവകാശമുള്ളതും മറ്റ് മരങ്ങൾക്ക്് അവകാശമില്ലാത്തതുമാകുന്നു.
14. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലം കൊള്ളുന്ന ആൾ ` 100-ന്റെ മുദ്രപത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടി കൂടി ലേലം കഴിഞ്ഞാലുടൻ ഒപ്പ് വയ്ക്കേ≠താണ്.
15. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയും മൊത്തം തുകയുടെ 14.5% വാറ്റും, മൊത്തം തുകയും, വാറ്റുംകൂടി കൂട്ടുന്ന തുകയുടെ 5% വന വികസന നികുതിയും, വിലയും, വാറ്റും, വന വികസന നികുതിയും ഉൾപ്പെടുന്ന തുകയുടെ 2.5% ആദായ നികുതിയും അതിൻെറ 3% വിദ്യാഭ്യാസ സെസ്സും (പാൻ കാർഡ് ഇല്ലാത്തവർ 20% ആദായനികുതി ഒടുക്കേ≠താണ്) ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10% സെക്യൂരിറ്റി ഡെപ്പോസിറ്റും വച്ച് ` 100-ന്റെ മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്. ടി കാലാവധിക്കുള്ളിൽ ടി തുകകൾ ഒടുക്കാൻ കഴിയാതെ വന്നാൽ 18% പലിശ നിരക്കിൽ തുകകൾ ഒടുക്കുന്നതിന് 30 ദിവസത്തേക്കും, 24% പലിശ നിരക്കിൽ വീ≠ും 30 ദിവസത്തേക്കും ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് യു‡ംപോലെ കാലാവധി നീട്ടിക്കൊടുക്കാവുന്നതാണ്.
15th SEPT. 2015] FOREST DEPARTMENT 56316. മുകളിലെ വ്യവസ്ഥപ്രകാരം നീട്ടിക്കൊടുത്ത കാലാവധി ക്കുള്ളിലും തുക ഒടുക്കി എഗ്രിമെന്റ ് വയ്ക്കുന്നതിന് വീഴ്ച വരുത്തിയാൽ ലേല/ദർഘാസുകാരൻ ഒടുക്കിയിട്ടുള്ള എല്ലാ തുകയും സർക്കാരിലേക്ക് ക≠ുകെട്ടി ലേലം റദ്ദു ചെയ്യുന്നതും ലേല/ദർഘാസു കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി മരങ്ങൾ പുനർലേലം ചെയ്യുന്നതുമാണ്. പുനർലേലം ചെയ്യുമ്പോൾ ലാഭം ഉ≠ാകുകയാണെങ്കിൽ ആയതിന് ലേലക്കാരന് യാതൊരുവിധ അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല. പുനർലേലത്തിലു≠ാകുന്ന എല്ലാ നഷ്ടങ്ങളും വീഴ്ചക്കാരനിൽ നിന്നും ഈടാക്കുന്നതുമാണ്.
17. ഉടമ്പടി കാലാവധി, ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 30 ദിവസമാണ്. സാധാരണ ഗതിയിൽ മരം മുറിച്ച് കടത്തിക്കൊ≠ുപോകുന്നതിനുള്ള കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യ ത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും തെ∑ല ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ ര≠് മാസം വരെ നിയമാനുസൃതമായ പിഴ ഈടാക്കിക്കൊ≠് കാലാവധി നീട്ടിക്കൊടുക്കുന്നതാണ്.
18. ഇപ്രകാരം നീട്ടി നൽകുന്ന തീയതിക്കുള്ളിലും മുറിച്ച് നീക്കം ചെയ്യാതെ നിൽക്കുന്ന മരങ്ങളും മുറിച്ച് നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റ ിലേക്ക് മുതൽകൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്ന തല്ലാത്തതുമാണ്. ഉടമ്പടിക്കാരൻ ചെയ്തു തീർക്കുവാനുള്ള ബാക്കി ജോലികൾ ഡിപ്പാർട്ട്മെന്റ ് ചെയ്യിക്കുന്നതും ആയതിൽ വച്ചു≠ാകുന്ന മുഴുവൻ ചിലവും ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്ന തുമായിരിക്കും.
19. ടി മരങ്ങളിൽ നിന്നും ശേഖരിച്ച് വയ്ക്കുന്ന തടിയും വിറകും നീക്കം ചെയ്യാനുള്ള ലൈസൻസ് നൽകുന്നത് നിലവിലുള്ള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും.
20. ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെയോ റെയിഞ്ചാഫീസ റുടെയോ രേഖാമൂലമുള്ള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ വനത്തിൽ പ്രവേശിക്കുവാൻ പാടുള്ളു.
21. യാതൊരു കാരണവശാലും πാന്റേഷനിലേയോ റിസർവ്വിലേയോ മറ്റ് മരങ്ങൾക്കും തടികൾക്കും സമീപമുള്ള വീടുകൾക്കും വിളകൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്താൻ പാടില്ല. അങ്ങനെ ഉ≠ാവുന്ന നഷ്ടത്തിന് കരാറുകാരൻ പൂർണ്ണ ഉത്തരവാദി ആകുന്നതാണ്.
23. മരത്തിന് 0.4 കി. മീറ്റർ (2 ഫർലോംഗ്) ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ അനധികൃത കുറ്റകൃത്യ ങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്. അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ വിവരം ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥരെ ഉടമ്പടിക്കാരൻ അറിയിക്കേ ≠താണ്. ഇതിൽ വീഴ്ച വരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടാവുന്നതാണ്.
24. കരാറുകാരന്റെ സെക്യൂരിറ്റി തുക കാലാവധിക്കുശേഷം ഗവൺമെന്റിലേക്ക് ബാദ്ധ്യതകൾ വല്ലതുമു≠െങ്കിൽ ടി തുകയിൽ നിന്നും ഈടാക്കിയതിന് ശേഷം ബാക്കി തുക തിരിച്ച് നൽകുന്നതാണ്.
25. ഈ ദർഘാസ്/ലേലത്തിലെ വകുപ്പുകൾ പ്രകാരം ഗവൺമെന്റിലേക്ക് കിട്ടേ≠തായ ഏതൊരു തുകയും ഡിപ്പാർട്ടുമെന്റിൽ നിന്നും ആവശ്യപ്പെടുന്ന സമയത്ത് ദർഘാസുകാരൻ/ലേലക്കാരൻ അടയ്ക്കാൻ വീഴ്ച വരുത്തുന്നപക്ഷം പ്രസ്തുത തുക ഭൂനികുതി കുടിശ്ശിക ആയി പരിഗണിച്ച് നിലവിലുള്ള നിയമപ്രകാരം ഈടാക്കുന്നതാണ്. ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർക്ക് യു‡മെന്ന് തോന്നുന്ന മറ്റ് മാർഗ്ഗങ്ങളിൽ കൂടിയും ഈ തുക ഈടാക്കുവാൻ നടപടികൾ സ്വീകരിക്കുന്നതാണ്.
26. സെയിൽ കൂപ്പുകളെ സംബന്ധിച്ച എല്ലാ പൊതുനിബന്ധന കളും ഈ ദർഘാസ്/ലേലത്തിനും ബാധകമായിരിക്കും.

It is hereby notified for the information of the public that the right of collection and removal of dangerous standing trees on the schedules appended below will be sold in Tender-Cum-Auction by the Divisional Forest Officer, Thenmala or any other officer authorized by him on 29-9-2015 in the Divisional Forest Office, Thenmala on outright sale basis subject to the terms and conditions of sale of timber in Government Timber Depots published in Government Gazette No. 43, dated 4-11-2014, Page Nos. 230 to 236 of Forest Sheet as per Pro (4) 29243/13 dated 17-10-2014 of the Additional Principal Chief Conservator of Forests (Protection), Thiruvananthapuram and as per General Conditions of the sale of tree growth prevailing in the Department. In case the notified date happens to be a public holiday the tender/auction will be conducted on the next working day at the notified place and time.

CONDITIONS
1. The auction/tender will be on lump sum basis for the right of collection and removal of entire trees as mentioned in the schedule.
2. The auction/tender of the sale of trees as mentioned in the schedule will be conducted separately and separate tender/auction will be applicable for each schedule.
3. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before participating in the Tender/Auction.
Complaints if any regarding quality and quantity etc. received after the Tender/Auction will not be entertained.
4. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless valid power of attorney is produced prior to commencement of Auction/Tender.
5. A supply contractor of Thenmala Division or the adjacent Divisions will not be allowed to participate in the Auction/Tender.
6. Intending tenderers/bidders should produce a certificate obtained from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.
7. Those who does not possess Income Tax PAN Card shall not be allowed to participate in the Tender/ Auction.
8. The successful Tenderers/Bidders should give an undertaking that he is not related to any officer having control of the work and that he is not a supply contractor of this or any adjacent divisions. If this is proved otherwise it shall result in cancellation of the contract and resale of the coupe at his risk and loss.
9. No petition or post offer received after seven days of the conduct of the tender/auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is one lakh and above, and more than 20% where the original bid amount is less than one lakh will ordinarily be considered. The post offerer will comply with following terms.
(a) Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.
(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender/Auction date.
(c) The remittance should be made by the Chalan or Bank Deposit and the bank receipt should be produced before the Divisional Forest Officer concerned within seven days from the date of receipt of the registered notice to that effect.
The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the post offerer satisfied with the conditions, are-auction of the right will be conducted after giving the usual publicity as per rules. In the re-auction, if the price fetched, does not come up to what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.
10. Further particulars can be had either from the Office of the Divisional Forest Officer or the Range Officer, Thenmala during working hours.

12. The successful tenderers/bidders have to remit 35% sale value on the tender/auction date itself. If the 35% value exceeds ` 1,00,000, ` 1,00,000 will be remitted on the auction date itself and balance value have to be remitted in the Sub Treasury, Punalur within 7 working days through the countersigned chalan issued from this office and the chalan submitted to this office. If he fails to remit this amount, within the specified time the EMD will be forfeited to Government and the coupe will be re-auctioned at his risk and loss.
13. If the value fetched in the resale/re-tender is less than that obtained in the original tender/sale the difference between them together with all incidental expenditure fixing up the resale including notification charges as assessed by the Divisional Forest Officer will be recovered from the defaulting Tenderers/ Bidders through legal means including Revenue Recovery Act in force.
14. The participating Tenderers/Bidders have right only for collection and removal of enumerated standing trees and has no right for removing any other trees including Teak, Rose wood etc.
15. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax, etc., at the rates prevailing from time to time.
16. The successful Tenderers/Bidders should execute a bounden agreement on Stamp Paper worth ` 100 after the completion of the Tender/Auction.
17. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit 1/3 rd of the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force and security deposit at 10% of the total sale value. The successful Tenderers/Bidders should execute an agreement on Stamp Paper worth ` 100. In case of failure to remit the amount within 15 days, extension shall be granted by the Divisional Forest Officer for 15 days subject to realization of 12% penal interest. Further extension for 15 days shall be granted by the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the amount within the extended period further extension for 15 days by the Chief Conservator of Forests and 15 days by the Additional Principal Chief Conservator of Forests shall be granted subject to realization of penal interest at 24% and 48% respectively. But all the extension periods mentioned above will be within the original contract period.
18. The balance 2/3 sale value should be remitted in two equal instalments by the successful Tenderers/ Bidders. The first instalment should be remitted within 15 days from the date of agreement and the second instalment within 30 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers/Bidders fail to remit the above amount within the period mentioned above extension for 15 days by realizing penal interest at 12% by Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Chief Conservator of Forests concerned and further extension for 30 days by the Additional Principal Chief Conservator of Forest concerned by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will be within the original contract period.
19. The period of contract will be as shown in the schedule hereto appended. No extension of period of contract shall ordinarily be granted. Under very special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests concerned may grant extension of time for one month and two months respectively on realisation of penalty or penalties for completion of each work for each month mentioned below:
(a) For enumerated trees and balance un-felled per hectare or fraction thereof ` 750 per hectare.
(b) Un-removed registered logs and unregistered logs ` 100/m3 or fraction thereof.
(c) Un-removed firewood ` 50/MT or fraction thereof.
Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or un-removed during the original contract period. The penalty for the first month shall be realized at the above rates; double the rate for the second month and three times of the original rate for the third month shall be realized. If the Tenderers/ Bidders fail to remove the entire produce within the above extended period the whole timber and firewood collected by the tenderers as per the agreement will be forfeited to Government and the tenderers/bidders shall not have any right on the produce confiscated to Government.

In the above circumstances the balance work to be executed by the tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the tenderers/bidders.
20. The license for removal of timber and firewood collected from the coupe shall be issued only on the basis of the prevailing norms.
21. The contractor/his agent shall enter the coupe and start work only after getting the written permission from the Divisional Forest Officer, Thenmala/Forest Range Officer, Thenmala.
22. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 meters and keep the cairns intact.
23. The contractor will be liable for any damage or loss caused to other trees in the plantation or reserve.
24. The contractor alone will be responsible for any damage/loss caused to public or private properties, injury/death caused to his workmen or general public during the course of the work carried out by him as per the contract.
25. The Divisional Forest Officer will give permission to keep the timber and other produce outside the coupe if requested by the contractor at his risk. But if the collected timber/firewood are not removed within the agreement period due to unforeseen situation/climate, a ground rent @ ` 250/Ha. will be recovered from the contractor.
26. The contractor will be liable for all the illegal activities occurred within 0.4 km. perimeter of the coupe. Any such activities noticed will be reported to the forest officials by the contractor, failing which the contract is liable to be cancelled.
27. The security deposit will be refunded only after the successful completion of contract after producing the clearance Certificates of VAT, Income Tax etc. If there are any liabilities outstanding in this respect to the Government that will be adjusted from the security deposit of the contractor.
28. All common conditions regarding sale coupe are also applicable to this tender/auction.

കാസറഗോഡ് ഡിവിഷനിലെ കാഞ്ഞങ്ങാട് റെയിഞ്ചിന്റെ അധികാര പരിധിയിൽപ്പെട്ട കയ്യൂർ ഗ്രാമത്തിൽ കയ്യൂർ- ചീമേനി റോഡരികിലായി ഒരു πാസ്റ്റിക് ചാക്കിൽ സൂക്ഷിച്ച നിലയിൽ ക≠െത്തിയ ഉദ്ദേശം 5 കിലോഗ്രാം ചന്ദനമുട്ടികളും 1.500 കിലോഗ്രാം ചന്ദന ചീളുകളും ചീമേനി പോലീസ് 18-9-2014-ൽ കസ്റ്റഡിയിൽ എടുത്ത് ക്രൈം നമ്പർ 387/14-ാം നമ്പരായി കേസ്സ് രജിസ്റ്റർ ചെയ്ത് തുടർ നടപടി കൾക്കായി കാഞ്ഞങ്ങാട് റെയിഞ്ചിലേക്ക് കൈമാറിയിരുന്നു. അതുപ്രകാരം കാഞ്ഞങ്ങാട് റെയിഞ്ചിൽ 1961-ലെ കേരള വനനിയമം സെക്ഷൻ 47എ, 47ബി(1), 47സി(1), 47(എഫ്), 47(ജി), 47(എച്ച്), 52, 61(എ) പ്രകാരം ഒ ആർ. 13/14-ാം നമ്പരായി കേസ്സ് രജിസ്റ്റർ ചെയ്തിരുന്നു.
മേൽ പറഞ്ഞ ചന്ദനത്തിന്റെ ശേഖരണ ഉറവിടമോ അത് കടത്തിക്കൊ≠ുവന്ന പ്രതികളെയോ അന്വേഷണത്തിൽ ക≠െത്താൻ കഴിഞ്ഞിട്ടില്ല. കൂടാതെ ടി ചന്ദനത്തിന് അവകാശവാദമുന്നയിച്ച് ആരും മുന്നോട്ട് വരികയുമു≠ായില്ല. ആയതിനാൽ ഈ കേസ്സിൽ കസ്റ്റഡിയിലെടുത്ത ചന്ദനം 1961-ലെ കേരള വനനിയമം സെക്ഷൻ 69 പ്രകാരം സർക്കാർ മുതലായി കണക്കാക്കി സെക്ഷൻ 61എ(2) പ്രകാരം സർക്കാരിലേക്ക് മുതൽക്കൂട്ടുന്നതിനെതിരെ ആർക്കെങ്കിലും വല്ലതും ബോധിപ്പിക്കാനു≠െങ്കിൽ ഈ നോട്ടീസ് കേരള ഗസറ്റിൽ പ്രസിദ്ധീകരിച്ച് പതിനഞ്ച് ദിവസത്തിനകം നോർത്ത് വയനാട് ഡിവിഷൻ
