1. Bidders shall remit the tender document fee and the Earnest Money Deposit using online payment option of e-procurement system only and submitted through the internet online banking of State Bank of Travancore or through NEFT for other banks. Bidders opting for NEFT facility of online payment are advised to exercise this option atleast 72 hours before the closing date of bid to ensure that payment towards tender document fees and EMD are credited and a confirmation is reflected in the e-procurement system. The online NEFT remittance form provided by e-procurement system for making a NEFT transaction is not a payment confirmation.
Kerala Forest Department/NIC/SBT shall not be any kind of delay in payment status confirmation.
2. Bidders are requested to submit scanned copy of tender document would be submitted offline in a sealed cover superscribing the name of work and tender number to the office of the Divisional Forest Officer, Konni through speed post/ registered post as prescribed in the time schedule, failing which such tenders will be rejected.
3. The bidding authority deserves the right to modify/cancel, any/all bids without assigning any reason. The Forest Department will not be responsible for any error like missing of scheduled data while downloading by the bidder and non receipt of documents.
4. Any further clarifications on this tender can be obtained from NIC/the e-tender helpdesk number available in the www.etenders.kerala.gov.in website and from this office during the office hours.
The details regarding e-payment (Bidder's bank account number where he/she is having core banking facility and e-mail ID) should be submitted along with the tender. 1. മലയാറ്റൂർ ഡിവിഷനിൽപ്പെട്ട തു≠ത്തിൽ റെയിഞ്ചിലെ ഭൂതത്താൻകെട്ട് ചെറുകിട ജലവൈദ്യുത പദ്ധതി പ്രൊജŒിനായി അനുവദിച്ച 1.96 ഹെŒർ വനഭൂമിയിൽ നിൽക്കുന്ന മരങ്ങൾ മുറിച്ച് ശേഖരിച്ച് നീക്കം ചെയ്ത് കൊ≠ുപോകുന്നതിനുളള അവകാശം 27-10-2015, 3.30 മണിക്ക് മലയാറ്റൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറോ അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന മറ്റ് ഉദ്യോഗസ്ഥനോ മലയാറ്റൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസിൽവച്ച് 10-12-2013-ലെ കേരള ഗസറ്റ് നമ്പർ 49 വാല്യം II-ൽ അഡീഷണൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (പ്രൊ.) അവർകളുടെ 22-11-2013-ലെ പ്രൊ(5)26274/12-ാം നമ്പരായി പ്രസിദ്ധീകരിച്ചിട്ടുളള ഡിപ്പോ ലേല വ്യവസ്ഥകൾക്കും കൂടാതെ താഴെ പറയുന്ന ലേലവ്യവസ്ഥകൾക്കും നിബന്ധനകൾക്കും വിധേയമായി ദർഘാസ്/ലേലത്തിൽ പരസ്യമായി വിൽക്കുന്നതാണ്. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്ന വ്യ‡ികൾ ദർഘാസിന് മുൻപ് ` 10,000 നിരതദ്രവ്യം കെട്ടിവയ്ക്കേ≠താണ്. വിജയിക്കുന്ന ദർഘാസുകാരൻ/ലേലക്കാരൻ, ദർഘാസ്/ലേലത്തുകയുടെ 35% തുക ദർഘാസ്/ ലേലദിവസം തന്നെ കെട്ടിവയ്ക്കേ≠താണ്. വിജയിയായ ദർഘാസുകാരൻ/ലേലക്കാരൻ നിയമപ്രകാരവും കാലാകാലങ്ങളിൽ നിലവിലുളളതുമായ വാറ്റ്, വനവികസനനികുതി, വരുമാന നികുതി മറ്റ് ബന്ധപ്പെട്ട നികുതികൾ എന്നിവ യഥാസമയം അടയ്ക്കേ≠തു≠്.
ദർഘാസ്/ലേല ദിവസം പൊതു അവധിയായി വന്നാലോ മറ്റേതെങ്കിലും കാരണത്താലോ ദർഘാസ്/ലേലം നടത്താൻ കഴിയാതെ വന്നാൽ ടി ദർഘാസ്/ലേലം അടുത്ത പ്രവൃത്തി ദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും വച്ച് നടത്തുന്നതായിരിക്കും.
2. ടെ≠ർ/ലേലം ഒരു നി›ിത തുകയുടെ അടിസ്ഥാനത്തിലാണ് നി›യിച്ചിരിക്കുന്നത്. ഇതിലേക്കായി സർവ്വെ ചെയ്ത് തിരിച്ചിട്ടുളള പ്രസ്തുത സ്ഥലത്ത് നിൽക്കുന്ന വിവിധ മരങ്ങളുടെ നീക്കം ചെയ്യൽ സംബന്ധിച്ച ജോലിക്ക് വേ≠ിയാണ് ഇത് തീരുമാനിച്ചിരിക്കുന്നത്.
3. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലത്തിന് മുൻപായി ഉൽപ്പന്നങ്ങളുടെ നൽപ് നിൽപ്പ് ക≠് ബോധ്യപ്പെടേ≠തും അവ സംബന്ധിച്ച യാതൊരു പരാതികളും ലേലത്തിനുശേഷം പരിഗണിക്കുന്നതുമല്ല.
4. ദർഘാസുകാരൻ/ലേലക്കാരൻ നേരിട്ട് ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കേ≠താണ്. നിയമപരമായ പവർ ഓഫ് അറ്റോർണി ഇല്ലാത്ത പകരക്കാരെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല.
5. മലയാറ്റൂർ ഡിവിഷനിലേയും മറ്റ് സമീപ ഡിവിഷനുകളിലെയും സπൈ കോൺട്രാക്ടർമാരെ ടി ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.
6. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ വിലാസവും കൈയ്യൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽ നിന്നും വാങ്ങിയ സർട്ടിഫിക്കറ്റ് നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാക്കേ≠താണ്.
7. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ, ആഫീസുമായോ ഏതെങ്കിലും തരത്തിലുളള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസ്/ലേല ദിവസം ദർഘാസുകാരൻ/ലേലക്കാരൻ ഈ ആഫീസിൽ സമർപ്പിക്കേ≠താണ്. ഇത്തരത്തിൽ ദർഘാസുകാരൻ/ലേലക്കാരൻ ബന്ധപ്പെട്ട ആഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുളള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാന്റെ പേരിലുളള ദർഘാസ്/ ലേലം റദ്ദു ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി പ്രവ്യത്തി പുനർലേലം ചെയ്യുന്നതാണ്.
8. ദർഘാസ്/ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുളള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരുലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10%-ൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരുലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽപ്പെട്ട ലേലങ്ങൾക്ക് 20%-ൽ കുറയാതെ പോസ്റ്റ് ഓഫറുകൾ മാത്രമേ പരിഗണിക്കുകയുളളൂ. കൂടാതെ താഴെ പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമാണ്.
(എ) ദർഘാസ്/ലേലത്തിൽ 7 ദിവസത്തിനുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.
(ബി) പോസ്റ്റ് ഓഫറുകാരൻ യഥാർ∞ ദർഘാസ്/ലേലക്കാരൻ ഒടുക്കിയ തുകയുടെ ഇരട്ടി തുക അടയ്ക്കേ≠താണ്.
(സി) ബന്ധപ്പെട്ട പോസ്റ്റ് ഓഫർ തുകയും മറ്റു നികുതികളും ചെലാൻ മുഖാന്തിരമോ ബാങ്ക് രസീത് വഴിയോ, ഈ ആഫീസിൽ നിന്നും രജിസ്റ്റേർഡ് തപാൽ മുഖേന അറിയിച്ച് ഏഴു ദിവസത്തിനുളളിൽ ഒടുക്കി ഈ ആഫീസിൽ ഹാജരാക്കേ≠താണ്. പോസ്റ്റ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ കൂപ്പിന്റെയും അതിലെ നിൽപ്പുമരങ്ങളുടെയും ഗുണനിലവാരവും മറ്റു ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ടശേഷം നി›ിത മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്.
പോസ്റ്റ് ഓഫറുകാരൻ ടി വ്യവസ്ഥകൾ ബോദ്ധ്യപ്പെട്ട് ഉടമ്പടിയിൽ ഏർപ്പെടുന്നപക്ഷം ഇതി∑േൽ ആവശ്യമായ പരസ്യം നൽകി ഒരു പുനർലേലം നടത്തുന്നതാണ്. പുനർലേലത്തിൽ ലഭിക്കുന്ന തുക പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കുറവാണെങ്കിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയ്ക്ക് ടിയാന്റെ പേരിൽ ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തുന്നതായിരിക്കും. പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത ലേലത്തുക അടയ്ക്കുന്നതിൽനിന്നും പിൻമാറുന്നപക്ഷം ടിയാൻ അടച്ചിട്ടുളള സെക്യൂരിറ്റി തുക സർക്കാരിലേക്ക് ക≠ു കെട്ടുന്നതാണ്. പുനർലേലത്തിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കൂടുതൽ തുകയ്ക്ക് ലേലം/ദർഘാസ് നടക്കുകയാണെങ്കിൽ ഉയർന്ന ലേല തുകയ്ക്ക് ആ വ്യ‡ിയുടെ പേരിൽ ലേലം ഉറപ്പിക്കുന്നതും പോസ്റ്റ് ഓഫറുകാരന്റെ സെക്യൂരിറ്റി തുക തിരികെ നൽകുന്നതുമാണ്.

13. ദർഘാസ്/ലേലം കൊളളുന്ന ആൾക്ക് പ്രസ്തുത കൂപ്പിൽ എന്യൂമറേറ്റ് ചെയ്തുനിർത്തിയിരിക്കുന്ന വട്ട മരങ്ങൾക്ക് മാത്രം അവകാശമുള്ളതാകുന്നു.
14. വിജയിയായ ദർഘാസ്/ലേലക്കാരൻ നിലവിലുള്ള നിരക്കിൽ മൂല്യവർദ്ധിത നികുതി, വനവികസന നികുതി, വരുമാന നികുതി എന്നിവയും ഒടുക്കേ≠താണ്.
15. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലം കൊളളുന്ന ആൾ ` 150-ന്റെ മുദ്രപത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടി കൂടി ലേലം കഴിഞ്ഞാലുടൻ ഒപ്പ് വയ്ക്കേ≠താണ്.
16. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുടെ മൂന്നിൽ ഒന്നും മൊത്തം തുകയുടെ 5% ഫോറസ്റ്റ് ഡെവലപ്പ്മെന്റ ് ടാക്സും, നിലവിലുളള നിരക്കിൽ വില്പന നികുതി, ഇൻകം-ടാക്സ് എന്നിവകളും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10% സെക്യൂരിറ്റി ഡെപ്പോസിറ്റും വച്ച് ` 150-ന്റെ മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠തുമാണ്. 15 ദിവസത്തിനുളളിൽ ടി തുകകൾ ഒടുക്കാതിരുന്നാൽ 12% പലിശയോടുകൂടി തുകകൾ ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയവും 24% പലിശയോടുകൂടി വീ≠ും 15 ദിവസത്തെ സമയവും യു‡ം പോലെ മലയാറ്റൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ അനുവദിക്കുന്നതാണ്. ഈ കാലാവധിക്കുളളിലും തുക ഒടുക്കാതെ വന്നാൽ ത്യശ്ശൂർ ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെ 24% പലിശനിരക്കിൽ 15 ദിവസത്തേയും വീ≠ും 48% പലിശനിരക്കിൽ അഡീഷണൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെ സമയം അനുവദിക്കാവുന്നതാണ്. എന്നാൽ മുകളിൽ പറഞ്ഞ കാലാവധികളെല്ലാം കരാർ കാലാവധിക്കുളളിലായിരിക്കും.
17. ബാക്കി മൂന്നിൽ ര≠് ലേലത്തുക ര≠് തുല്യ ഗഡുക്കളായി ഒടുക്കേ≠താണ്. ആദ്യ ഗഡു കരാർ തീയതി മുതൽ 15 ദിവസത്തിനകവും ര≠ാം ഗഡു കരാർ തീയതി മുതൽ ഒരു മാസത്തിനകമോ കരാർ കാലാവധിക്കകമോ ഏതാണോ ആദ്യം ആ കാലാവധിക്കുളളിലും ഒടുക്കേ≠താണ്. ടി കാലാവധിക്കുളളിൽ പണം ഒടുക്കുവാൻ കഴിയാതെ വന്നാൽ 12% പലിശ നിരക്കിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർക്ക് 15 ദിവസത്തേയും 24% പലിശ നിരക്കിൽ ത്യശ്ശൂർ ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെ 30 ദിവസത്തേക്കും, വീ≠ും 30 ദിവസത്തേക്ക് 48% പലിശ നിരക്കിൽ അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെയും കാലാവധി നീട്ടികൊടുക്കാവുന്നതാണ്. എന്നാൽ നീട്ടിക്കൊടുക്കുന്ന കാലാവധികളെല്ലാം തന്നെ കരാർ കാലാവധിക്കുളളിലായിരിക്കും.
18. ഉടമ്പടി കാലാവധി ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 60 ദിവസമാണ്. സാധാരണ ഗതിയിൽ കൂപ്പിന്റെ കാലാവധി നീട്ടികൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും മലയാറ്റൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ, ത്യശ്ശൂർ ഫോറസ്റ്റ് കൺസർവേറ്റർ എന്നിവർ യഥാക്രമം ഒന്നും ര≠ും മാസം വീതം താഴെ പറയും പ്രകാരം പിഴ ഈടാക്കിക്കൊ≠് ഓരോ ജോലിക്കും കാലാവധി നീട്ടികൊടുക്കുന്നതാണ്.
(എ) എന്യൂമറേറ്റ് ചെയ്തതും മുറിക്കാനുളളതുമായ മരങ്ങൾക്ക് ഓരോ ഹെക്ടറിനും അതിന്റെ ഭാഗത്തിനും ` 750 വീതം.
(ബി) നീക്കം ചെയ്യാത്ത രജിസ്റ്റർ ചെയ്തതും അല്ലാത്തതുമായ തടികൾക്ക് ഓരോ ക്യൂ.മീറ്ററിനും അതിന്റെ ഭാഗത്തിനും ` 100 വീതം.

ഒന്നാമത്തെ മാസത്തേക്ക് ടി നിരക്കിലും 2-ാം മാസത്തേക്ക് ഇതിന്റെ ഇരട്ടിയും 3-ാം മാസത്തേക്ക് ഒന്നാം മാസത്തെ നിരക്കിന്റെ മൂന്നിരട്ടിയും എന്ന ക്രമത്തിൽ പിഴ ഈടാക്കുന്നതാണ്. ഇപ്രകാരം നീട്ടി നൽകുന്ന തീയതിക്കുളളിലും നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റിലേക്ക് മുതൽ കൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ാകുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ചെയ്തുതീർക്കുവാനുളള ജോലികൾ ഡിപ്പാർട്ട്മെന്റ ് ചെയ്യിക്കുന്നതും ആയതിൽ വച്ചു≠ാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതുമായിരിക്കും.
19. ടി പ്രദേശത്ത് ശേഖരിച്ച് വയ്ക്കുന്ന തടികളും വിറകും നിലവിലുളള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും നീക്കം ചെയ്യാനുളള ലൈസൻസ് നൽകുന്നത്.

21. ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാ സമയവും കൂപ്പിൽ ഉ≠ായിരിക്കണം.
കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിയിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കേ≠തുമാണ്.
22. യാതൊരു കാരണവശാലും πാന്റേഷനിലെയോ റിസർവ്വിലേയോ മറ്റ് മരങ്ങൾക്കും തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്തുവാൻ പാടില്ല. അങ്ങനെ ഉ≠ാകുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദി ആകുന്നതാണ്.
23. കൂപ്പിന് പുറത്ത് ഫോറസ്റ്റ് സ്ഥലത്തും തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടിക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ അനുവദിക്കുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണങ്ങളാലോ മോശമായ കാലാവസ്ഥമൂലമോ ഉടമ്പടി കാലാവധിക്കുളളിൽ ഇവ നീക്കം ചെയ്തുകൊ≠് പോകാൻ കഴിയാതെ വന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്ടറിന് ` 250 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതായിരിക്കും.
24. കൂപ്പിന് 0.5 കി.മീറ്റർ ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ അനധികൃത കുറ്റകൃത്യങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്. അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ വിവരം ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥരെ ഉടമ്പടിക്കാരൻ അറിയിക്കേ≠താണ്. ഇതിൽ വീഴ്ച വരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടാവുന്നതാണ്.

1. It is hereby notified for the information of the public that the right of collection and removal of standing trees in the Bhoothathankettu Small Hydro Electric Project area (1.96 Ha.) of Thundathil Range of this division as specified in the schedule appended below will be sold in Tender cum Auction by the Divisional Forest Officer, Malayattoor or any other officer authorized by him on 27-10-2015 at 3.30 p. m. in the Divisional Forest Office, Malayattoor subject to the terms and conditions of sale of Timber in Government Timber Depots published in Government Gazette No. 49 Vol. II dated 10-12-2013 vide Notification No. Pro. (5) 26274/12 dated 22-11-2013 of the Addl. Principal Chief Conservator of Forests (P) Thiruvananthapuram and as per general conditions of the sale of tree growth prevailing in the department. In case the notified date happens to be a public holiday the Tender/Auction will be conducted on the next working day at the notified place and time.
2. The auction will be on lump sum basis for the right of collection and removal of entire Jungle wood species growth from the above area mentioned in the schedule hereto the area of which has been surveyed and demarcated on the ground.
3. Intending Tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after the Tender/Auction will not be entertained.
4. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless valid power of attorney is produced prior to commencement of Auction/Tender.
5. A supply contractor of Malayattoor Division or the adjacent Divisions will not be allowed to bid in the Auction/Tender.
6. Intending Tenderers/bidders should produce a certificate from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.
7. The successful Tenderers/Bidders should give an undertaking that he is not related to any officer having control of the work and that he is not supply contractor of this or any adjacent divisions. If this is proved otherwise it shall result in cancellation of the contract and resale of the coupe at his risk and loss.
8. No petition or post offer received after seven days of the conduct of the Tender/Auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is One lakh and above, and more than 20% where the original bid amount is less than One lakh will ordinarily be considered. The post offerer will comply with following terms.
(a) Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.
(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender/Auction date.
(c) The remittance should be made by the chalan or bank deposit and the bank receipt should be produced before the Divisional Forest Officer concerned within seven days from the date of receipt of registered notice to that effect.
The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned, pledging the security deposit for the due fulfilment of the above terms. If the post offerer satisfies the conditions, a re-auction will be conducted after giving the usual publicity as per rules. In the re-auction the price fetched, does not come up to what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.
9. Further particulars can be had either from the office of the Divisional Forest Officer or from the Range Officer concerned.
10. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of ` 10,000 (Rupees Ten Thousand only) for participating in the tender/auction for each plantation/block.
11. The successful Tenderers/Bidders have to remit 35% sale value on the Tender/Auction date. If this 35% value exceeds ` 1,00,000, ` 1,00,000 will be remitted on auction date itself and balance value have to be remitted in the Sub Treasury, Kunnathunadu (Perumbavoor) within 7 working days through the countersigned chalan issued from this office and the receipted chalan submitted to this office. If he fails to remit this amount, the EMD will be forfeited to Govt. and the coupe will be re-auctioned at his risk and loss.

If the value fetched in the resale/re-tender is less than that obtained in the original tender/auction the difference between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/Bidders through legal means including Revenue Recovery Act in force.
13. The participating Tenderers/Bidders have rights only for collection and removal of enumerated standing trees.
14. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax, etc., at the rate prevailing from time to time.
15. The successful Tenderers/Bidders should execute a bounded agreement on a stamp paper worth ` 150 after the completion of the Tender/Auction.
16. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit 1/3rd of the balance sale value and 5% Forest Development Tax, VAT and income tax at the rate in force and security deposit of 10% for the total sale value. The successful Tenderers/Bidders should execute an agreement on a stamp paper worth ` 150. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days shall be granted by the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the amount within the extended period further extension for 15 days by the Conservator of Forests, Thrissur and 15 days by the Addl. Principal Chief Conservator of Forests shall be granted subject to the realization of penal interest at 24% and 48% respectively. But all the extension periods mentioned above will be within the original contract period.
17. The balance 2/3rd sale value should be remitted in two equal installments by the successful Tenderers/Bidders. The first installment should be remitted within 15 days from the date of agreement and the second installment within 30 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers/Bidders fails to remit the above amount within the period mentioned above, extension for 15 days by realizing penal interest at 12% by Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Conservator of Forests concerned and further extension for 30 days by the Addl. Principal Chief Conservator of Forests concerned by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will be within the original contract period.
18. The period of contract will be 60 days from the date of intimation of confirmation. No extension of period of contract shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Conservator of Forests concerned may grant extension of time for one month and two months respectively on realization of penalty or penalties for completion of each work for each month mentioned below:
(a) For enumerated trees and balance unfelled per hectare or fraction thereof—` 750 per hectare.
(b) Unremoved registered logs and unregistered logs—` 100/m3 or fraction thereof.
(c) Unremoved firewood—` 50/Tone or fraction thereof.
Penalty will be assessed and realized on timber, fire wood as the case may be which are either uncollected or unremoved during the original contract period. The Penalty for the first month shall be realized as the above rates; double the rate for the second month and three times of the original rate for the third month shall be realized. If the Tenderers/Bidders fail to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenderers as per the agreement will be forfeited to government and the Tenderers/Bidders shall not have any right on the produce confiscated to Government.
In the above circumstances the balance work to be executed by the Tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the Tenderers/Bidders.
19. The license for removal of timber and fire wood collected in the coupe should be issued only on the basis of the prevailing norms.
20. The Contractor/his agent shall enter the coupe only after getting the written permission from the Divisional Forest Officer, Malayattoor/ Forest Range Officer, Thundathil.
21. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 meters and keep the cairns intact.
22. The contractor will be liable for any damage or loss caused to other trees in the plantation or reserve.
23. The Divisional Forest Officer will give permission to keep the timber and other produce outside the coupe if requested by the contractor at his risk. But if the collected timber/fire wood are not removed within the agreement period due to unforeseen situation/climate, a ground rent @ ` 250/Ha. will be recovered from the contractor.
13th OCT. 2015] FOREST DEPARTMENT 65824. The contractor will be liable for all the illegal activities occurred within 0.5 Km. perimeter of the coupe. Any such activities noticed will be reported to the forest officials by the contractor, otherwise the contract will be cancelled.
25. The security deposit will be refunded only after the successful completion of contract after producing the clearance certificates of VAT, Income Tax, etc. If there is any liabilities outstanding in this respect to the Govt. that will be adjusted from the security deposit of the contractor.
26. All common conditions regarding sale coupe are also applicable to this Tender/Auction.
Further details can be had from the office of the undersigned or from the Office of the Range Forest Officer, Thundathil on all working days.
Remarks:—If the Tender/Auction could not be conducted on the notified date due to any other reason the Tender/ Auction shall be conducted on 6-11-2015 at 3.30 p.m. at the same place. In that case Tender forms will be issued till 1 p.m. on 6-11-2015 and the sealed tenders will be accepted till 3 p.m. on 6-11-2015.

(Ms.) No. 226/81(F) dated 16-12-1981 for working down Timber, and Teak Poles from the marked trees standing in the plantations mentioned in the schedule below and transport the same to the Govt. Timber Depots and temporary dumping site mentioned in the same schedule. The tenderer is bound to comply with the terms and conditions in force, besides the conditions that will be framed by the Government in future in connection with this tender. EMD amount of ` 20,000 for teak and miscellaneous firewood can be remitted though online payment system to MSTC by 6 p.m. on the previous day of the e-auction. The buyer registration number has to be mentioned while paying the EMD. For the benefit of the bidders who are not well versed with the online transations, for some initial period, Range Forest Officer, Edavanna Range will entertain receipt of EMD in the form of Demand Draft payable at State Bank of Travancore, Nilambur Branch drawn in favour of Range Forest Officer, Edavanna Range as was done in the old system, by 2 p.m. on the previous day of e-auction. Only the registered customers who will submit the EMD will be able to participate against the eligible lots in e-auction. If the sale value of bid materials is not paid within the specified time period against any of the bid lot by the H1 bidder, the EMD will be forfeited.
The successful bidder, 35% of the bid value, after adjusting the EMD already remitted, shall be paid within 7 working days of issuance of acceptance letter. Competitive sealed tenders are invited by the undersigned on behalf of the Governor of Kerala in the prescribed form from eligible contractors registered with Kerala PWD for following civil work in Peruvannamuzhy Forest Range during 2015-16. Cost of tender form is non refundable. The tender documents should be properly filled up and should be submitted on or before 2.30 p. m. on 29-10-2015. Subsequently the hard copy attested copy of Registration Certificate, EMD exemption certificate (if any), preliminary agreement in original, signed copy of conditions would be submitted offline in a sealed cover subscribing the name of work and tender No. to the office of the Divisional Forest Officer, Kasaragod Division through speed post/registered post as prescribed in the time schedule, failling which such tenders will be rejected. The bidding authority deserves the right to modify/cancel any/all bids without assigning any reason.
The tender/bids shall be opened online at the office of the Divisional Forest Officer, Kasaragod in the presents of bidders/their representatives who wish to attend the above address. If the tender opening date happens to be on a holiday or non working day due to any other valid reason, the tender opening process will be do on the next working day at same time and place.

The successful tenderer is liable to remit the taxes as per rules, the contractor is bound to give necessary training and awareness to the Forest Department staff and beneficiaries regarding the maintenance of the power fence.
